The Chamber denied the amparo because environmental viability and the watercourse-work permit were established, no municipal information request was shown, and the SINAC complaint concerned a different body of water.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) denied the amparo application filed against the Municipality of Grecia and the Sistema Nacional de Áreas de Conservación (SINAC) concerning box-culvert works over the Arrozales stream. It found that the project had environmental viability approval from the Secretaría Técnica Nacional Ambiental (SETENA), granted through Resolution No. 070-2020-SETENA, and a watercourse-work permit from the Water Directorate of the Ministerio de Ambiente y Energía (MINAE), issued through Resolution No. DA-1046-2023. It also determined that the municipality had received no project-information request from the protected person, so no denial of access to public information could be attributed to it. The complaint submitted to SINAC on 29 April 2026 concerned the Rosales River, not the Arrozales stream. The Chamber therefore found no act or omission violating fundamental rights. It treated an environmental complaint allegedly unanswered within a reasonable period as an exception permitting constitutional review of the merits.

Key excerptExtracto clave

From this perspective, prima facie, no situation is apparent at this time that would warrant intervention by this constitutional jurisdiction. First, contrary to the applicant's allegation, the works at issue in the sub iudice matter do have the respective permit from the MINAE Water Directorate and environmental viability approval from SETENA; therefore, the alleged omission is not established. In view of the foregoing considerations, it is not possible to establish that the respondent authorities engaged in any act or omission violating the protected person's fundamental rights; accordingly, the application is denied.

Document Review Case: 26-023307-0007-CO Decision No. 2026033808 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 3 September 2026.

Amparo proceeding in case no. 26-023307-0007-CO, filed by Nombre01, identity card CED01, against the MUNICIPALIDAD DE GRECIA AND THE SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).

Background:

  1. 1In a filing added to the case record on 29 June 2026, the amparo applicant filed an amparo application. He states that the physical execution of heavy civil works has publicly begun under the so-called “Special Agreement for Construction of a Box Culvert over Quebrada Arrozales and Road Improvements along the section extending from the intersection with Dirección01 to Dirección03,” entered into by the Municipalidad de Grecia and the private company JBF Desarrolladores S.A. He indicates that these works entail direct, extensive, and aggressive physical intervention in the watercourse of Quebrada Arrozales through construction of a box culvert structure (bridge) and large-scale adjacent earthworks (movimientos de tierra). He alleges that the respondents began removing earth and intervening in the body of water without first obtaining the mandatory environmental approval (Viabilidad Ambiental) from the Secretaría Técnica Nacional Ambiental (SETENA), or the corresponding authorizations from the Dirección de Aguas of MINAE, amid the complete failure of the local SINAC to provide protection. He adds that the respondents (the Mayor’s Office, Engineering Department, and Municipal Presidency) kept the technical file, plans, impact studies, and the agreement itself hidden from the scrutiny of and access by the canton’s residents for more than a year, unlawfully preventing timely preventive public oversight of environmental matters. He alleges that there is a serious defect that destroys the objectivity of the project’s environmental and technical oversight because Engineer Jerson Jiménez Jiménez is acting as both judge and interested party: having been the agreement’s initial supervisor from the Unidad Técnica de Gestión Vial, he is now the Head of Engineering who issues the technical orders to commence and approves execution within the streambed, thereby eliminating all neutral and independent technical supervision of the work. He emphasizes that construction of the box culvert over Quebrada Arrozales by the Municipalidad de Grecia and the private developer, without prior environmental studies, flagrantly violates the principle of prevention derived from Article 50 of the Constitution. He states that on 29 April 2026 he sent a complaint regarding that situation to the email address ...01 of the SINAC Local Office in Grecia. He adds that he also filed a complaint with the Municipalidad de Grecia. However, he asserts that, as of the filing date of this amparo application, the reported situation persists.
  2. 2By decision issued at 3:40 p.m. on 3 July 2026, the President of the Chamber ordered the applicant to submit documentation.
  3. 3In a filing added to the case record on 7 July 2026, the applicant submitted the required documentation.
  4. 4By decision issued at 3:44 p.m. on 21 July 2026, the President of the Chamber admitted the proceeding and requested reports from the mayor and the president of the Concejo Municipal de Grecia, as well as from the head of the SINAC Oficina Subregional de Grecia.
  5. 5In a filing added to the case record on 24 July 2026, Luis Alonso González Arce, head of the Subregión Occidental of SINAC, reports: “1. Regarding the assertions. On the date indicated by Nombre01 (29/04/2026), official Maikol Rodríguez Gómez received at his institutional email address (maikol....04) an attached document sent from the email address ‘...02’. It was addressed to the Mayor of Grecia and referred to the following matters, which I quote verbatim: ‘Dear Sir: The undersigned petitioner, Nombre01, identity card number CED0, acting as a resident of the municipality of Grecia. Ley Orgánica del Ambiente (N° 7554), Article 17: Any project that alters the environment requires an environmental impact assessment and approval from the Secretaría Técnica Nacional Ambiental (SETENA) before it begins. Ley de Aguas (N° 276): Riverbanks are in the public domain, and altering them without authorization is punishable.Código Penal (Art. 58 of the Ley Forestal): Encroaching upon or damaging protected areas is punishable by imprisonment for three months to three years. Allowing pipelines to be installed in protected areas without the required municipal and environmental permits constitutes a serious violation of multiple national laws and local regulations, thereby giving rise to administrative, civil, and potentially criminal liability for you as Municipal Mayor Donald Quesada Rodríguez. Subject of Petition. 1 – I request that you appear at the location where a new section of pipeline is being built in the environmental protection areas of Río Rosales, beyond the Asada de Puente de Piedra intake, where pipelines have never existed. 2 – If it does not have a municipal permit, I request its immediate closure and cessation of the environmental damage. 3 – I request coordination with the environmental authorities for the seizure of tools and Bajok-type machinery, and that a complaint be filed ex officio with the environmental and judicial authorities.Subject of Petition. The right of petition and prompt response is set forth in our legislation, in Articles 27 and 30 of the Constitution. “Article 27: The freedom to petition, individually or collectively, any public official or government entity, and the right to obtain a prompt decision, are guaranteed.” Article 28 of the Political Constitution of Costa Rica establishes that no one may be persecuted or harassed for expressing opinions or performing acts that do not violate the law. I expect a prompt response within the mandatory statutory period. Yours faithfully, Nombre01 Ch. 105740605.’ 2. Regarding the material sent to the SINAC official. The matters reported by Nombre01 on 29 April 2026 and sent through the institutional email account to SINAC official Maikol Rodríguez Gómez clearly concern a location on the bank of Río Rosales, specifically in the district of San José, and do not correspond to the alleged facts referenced in this amparo proceeding, which concern a location at Quebrada Arrozales in the district of Puente de Piedra, as the two locations are approximately seven and a half kilometers apart. 3.Regarding processing in SITADA. The complaint filed by Nombre01 on 29 April 2026 was duly addressed, as recorded in the Sistema Integrado de Trámite y Atención de Denuncias Ambientales (SITADA) under number 62773-2026. 4. Regarding a complaint concerning other work. The records of this office contain no complaint concerning work performed by the municipality in the streambed of Quebrada Arrozales. III. PRELIMINARY CLARIFICATION REGARDING THE SCOPE OF SINAC’S AUTHORITY. Pursuant to Article 50 of the Political Constitution, every person has the right to a healthy and ecologically balanced environment, and the State is responsible for guaranteeing, defending, and preserving that right. Likewise, Article 11 of the Constitution requires public officials to act within the scope of the powers legally conferred upon them, without claiming powers that the legal system does not grant them. Articles 21 and 50 of the Constitution also impose affirmative duties to protect life, health, and the environment.Under Article 11 of the Political Constitution, public officials are mere custodians of authority and may not claim powers that the law does not grant them; Article 50 recognizes the right to a healthy and ecologically balanced environment, which must be protected within the scope of authority established by the legal system. IV. REGARDING THE INSTITUTIONAL COMMUNICATION CHANNEL. In response to the request of the Constitutional Chamber, which stated verbatim that: ‘…the respondent authority shall report whether the email address to which the applicant sent the request is established as an official channel for receiving users’ submissions…’, I state as follows: The official email account made available by the SINAC Oficina Subregional in Grecia to receive notices and submissions from persons dealing with the Administration is ‘...03’, which is the institutional channel formally designated for such purposes.Notwithstanding the foregoing, the email address identified by Nombre01, namely ‘...01’, is in fact an institutional email account assigned to official Maikol Rodríguez Gómez in the performance of his duties within the Administration. This fact demonstrates SINAC’s administrative good faith because, even though the submission was not received through the official email account designated for receiving documents, it came to the attention of an institutional official and was subsequently entered into the formal system for processing environmental complaints. Consequently, rather than constituting a violation of due process, this demonstrates that the Administration acted diligently and favorably toward the person dealing with it. V. REGARDING THE PROPER ADMINISTRATIVE PROCESSING PROVIDED BY SINAC. It must be emphasized that the applicant’s claim rests on an incorrect premise insofar as he asserts that SINAC failed to address a complaint related to Quebrada Arrozales.Analysis of the institutional records shows that the email sent by Mr. Nombre01 on 29 April 2026 referred to different facts, specifically an intervention allegedly taking place along the banks of Río Rosales in the district of San José de Grecia; it was addressed primarily to the Municipal Mayor and was not a specific complaint concerning Quebrada Arrozales. That submission was in fact received by official Maikol Rodríguez Gómez and processed under SITADA case No. 62773-2026. It is therefore legally incorrect to assert that SINAC remained administratively inactive, because the submission actually received was addressed in accordance with established institutional procedures. VI. REGARDING ADMINISTRATIVE DUE PROCESS. Article 39 of the Political Constitution establishes the principle of due process, which is fully applicable to administrative actions. This principle encompasses the Public Administration’s obligation to process, assess, and decide submissions brought before it through previously established procedures, ensuring legal certainty, legality, transparency, and traceability of administrative actions. In this case, SINAC acted in accordance with that principle because it: 1. Received the submission actually made by the applicant. 2. Analyzed the content of the complaint received. 3. Determined the substantive subject matter of the submission. 4. Registered and processed it through the Sistema Integrado de Trámite y Atención de Denuncias Ambientales (SITADA). 5. Preserved the traceability of the corresponding administrative file. The Administration may not extend the scope of a complaint beyond the specific facts reported by the person dealing with it, because doing so would entail departing from the principle of legality that governs every public action. Consequently, SINAC was required to act only with respect to the facts contained in the submission actually made, and not with respect to different facts later included in the amparo application. VII. REGARDING THE RIGHT OF PETITION AND PROMPT RESPONSE.The applicant invokes Articles 27 and 40 of the Political Constitution concerning the right of petition and access to information. The administrative file shows, however, that the submission did come to the Administration’s attention and was entered into the official system for processing environmental complaints under SITADA case No. 62773-2026. A violation of the right of petition occurs when there is an unjustified refusal to consider a submission or when the Administration remains wholly inactive in response to it. Neither circumstance is present here, because the complaint received was institutionally registered and processed. VIII. REGARDING THE ABSENCE OF ANY OMISSION ATTRIBUTABLE TO SINAC IN CONNECTION WITH QUEBRADA ARROZALES. The institutional report also states that there is no record of a complaint filed with the Oficina Subregional de Grecia regarding the work performed at Quebrada Arrozales.Consequently, liability for administrative inaction cannot be attributed with respect to facts that were not formally brought to the attention of the competent authority. The Public Administration may exercise its inspection and oversight powers only within the scope of the knowledge obtained from complaints, inspections, or validly instituted proceedings, pursuant to the principle of legality enshrined in Article (sic) 11 of the Political Constitution and Article 11 of the Ley General de la Administración Pública.”
  6. 6In a filing added to the case record on 29 July 2026, Donald Alberto Quesada Rodríguez and Ricardo González Díaz, respectively the mayor and president of the Concejo, both of the Municipalidad de Grecia, state: “FIRST. Regarding the alleged execution of work without environmental approval and permits. It is absolutely FALSE that the civil works at Quebrada Arrozales lack the corresponding environmental studies and permits. As shown in the technical file and reports of the Jefatura de Ingeniería para el Desarrollo Cantonal (Official Letter MG-IDC-130-2026), the project concerning the ‘Road Improvements to Calle Los Mangos’ (connected to the Condominio Dulúa development) has been processed in strict compliance with the body of applicable law. The intervention has environmental approval duly granted by the Secretaría Técnica Nacional Ambiental (SETENA) through Decision N.° 070-2020-SETENA. Likewise, the Dirección de Aguas of the Ministerio de Ambiente y Energía (MINAE) issued the permit for work within the watercourse through Decision DA1046-2023 (extended through DA-2237-2025).Consequently, the Municipality issued Construction Permit UCC-142-2026 on the basis of plans duly endorsed by the Colegio Federado de Ingenieros y de Arquitectos (CFIA). SECOND. Regarding the alleged concealment of information and restriction of public oversight. It is FALSE that the Municipal Administration kept the technical file, plans, impact studies, or agreement hidden. Local government actions are public. The specific agreement with the private developer was expressly authorized through Municipal Resolution SEC-0657-2024 at a public session of the Concejo Municipal. The municipal records contain no evidence that the applicant, or any other resident, submitted a formal request for access to information related to this project that was denied or ignored. THIRD. Regarding the alleged conflict of interest of the Head of Engineering. It is FALSE that Engineer Jerson Jiménez Jiménez is acting as ‘both judge and interested party.’ His involvement at different stages of the project strictly reflects the performance of his duties and responsibilities within the municipal organizational structure and the administrative reorganization of this entity. His transfer from the Unidad Técnica de Gestión Vial (UTGV) to the Departamento de Ingeniería para el Desarrollo Cantonal (IDC) neither invalidates nor compromises the technical objectivity of the work, which is supported by approvals from external governing bodies (SETENA, DAMINAE, CFIA). FOURTH. Regarding the complaint allegedly filed with the Municipality. In connection with the allegation that the applicant also filed a complaint with the Municipalidad de Grecia, this Honorable Constitutional Chamber must be advised of the serious evidentiary and argumentative deficiency committed by the applicant. The applicant provides no filing date, does not identify the office or department to which the submission was delivered, does not describe its contents, and provides neither a copy nor any other identifying information (such as a sequential number or acknowledgment of receipt). Given such an absence of evidence, it is legally and materially impossible for this Administration to substantiate or establish any municipal fault, whether by act or omission. An alleged violation of the right of petition, prompt decision, or administrative inaction (Article 27 of the Constitution) cannot be protected when the very existence of the complaint has not been established or individually identified in the application. Consequently, the allegation of inaction by this Municipality is inadmissible and reckless. II. SUBSTANTIVE CONSIDERATIONS AND LEGAL GROUNDS. A. Absence of a Violation of the Right to a Healthy Environment (Art. 50 of the Political Constitution): The actions of the Municipalidad de Grecia have strictly complied with the principle of environmental prevention and the prevailing legal framework. Far from acting by omission or arbitrarily, the Municipality made the physical commencement and municipal authorization of the work conditional upon the private developer first obtaining and substantiating the environmental permits (SETENA) and the permit to intervene in the watercourse (Dirección de Aguas).Technical Official Letter MG-IDC-130-2026 unequivocally confirms full compliance with the legally established procedure. The intervention at Quebrada Arrozales is lawful work that has received technical and environmental approval to improve road safety and the area’s hydraulic capacity. B. Full Compliance with the Principle of Publicity and Administrative Transparency (Arts. 27 and 30 of the Constitution and the Código Municipal): In accordance with the Código Municipal and the governing principles of public service, the Municipalidad de Grecia ensured that the process was public. The agreement for development of the project was approved by the Concejo Municipal, the representative body elected by the people and the highest political authority in the canton, whose sessions, minutes, and resolutions are public. The person dealing with the Administration was never prevented from exercising preventive oversight and has failed to demonstrate that access to the administrative file in question was obstructed.C. Regarding the Principle of Legality and Compliance with Procedure (Art. 11 of the Political Constitution and Art. 11 of the LGAP): All municipal actions challenged by the applicant constitute regulated administrative acts issued by the competent bodies within the limits of their powers and based on the technical criteria of the governing institutions. Construction of the box culvert is the product of the legally required interinstitutional coordination.”
  7. 7The statutory requirements have been observed in the proceedings conducted.

Justice Rueda Leal drafts the decision; and, Reasons:

I. PRELIMINARY CLARIFICATION

Before analyzing the merits of the application, it must be clarified that, beginning with Judgment No. 2008-02545 issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa), with certain exceptions, those matters in which it is disputed whether the Public Administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to issue a final administrative act deciding an administrative proceeding instituted ex officio or at a party’s request, or to hear the applicable administrative remedies. This case specifically presents one such exception because it concerns a complaint regarding environmental problems that allegedly was not addressed within a reasonable time.

II. SUBJECT MATTER OF THE APPLICATION

The applicant states that the respondent municipality began work to construct a box culvert structure (bridge) over Quebrada Arrozales. He alleges that earth removal and intervention in the body of water began without first obtaining environmental approval from SETENA or the corresponding authorizations from MINAE and SINAC. He adds that the municipality kept the technical file, plans, impact studies, and agreement itself hidden from the scrutiny of and access by the canton’s residents for more than a year. He further states that Engineer Jerson Jiménez was initially the supervisor of the agreement for execution of the work and is now the head of the office that issues orders to commence and approves execution of the work, a situation that he considers improper. He emphasizes that on 29 April 2026 he filed a complaint with SINAC concerning these events; however, it has not been resolved.

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial decision:

  • a)The work at issue is being carried out as part of the “Road Improvements Dirección03” project. (Documentary evidence).
  • b)The project has environmental approval from SETENA, granted through decision no. 070-2020-SETENA. The Dirección de Aguas of MINAE also issued the corresponding permit for work within the watercourse through decision no. DA-1046-2023. (Documentary evidence)
  • c)The respondent municipality has no record of any request by the person whose rights are protected for information related to the work at issue. (Documentary evidence).
  • d)On 29 April 2026, the applicant filed a complaint with SINAC in which he stated the following facts: “1 – I request that you appear at the location where a new section of pipeline is being built in the environmental protection areas of Río Rosales, beyond the Asada de Puente de Piedra intake, where pipelines have never existed. 2 – If it does not have a municipal permit, I request its immediate closure and cessation of the environmental damage. 3 – I request coordination with the environmental authorities for the seizure of tools and Bajok-type machinery, and that a complaint be filed ex officio with the environmental and judicial authorities (…)”. (Report of the respondent authority and documentary evidence).
  • e)SINAC has received no complaint from the person whose rights are protected concerning Quebrada Arrozales. (Report of the respondent authority).

IV. REGARDING THE SPECIFIC CASE

In the case at hand, the applicant states that the respondent municipality began work to construct a box culvert structure (bridge) over Quebrada Arrozales.

The examination of the case record establishes that the work at issue is being carried out as part of the “Road Improvements Dirección03” project. The project has environmental approval from SETENA, granted through decision no. 070-2020-SETENA. The Dirección de Aguas of MINAE also issued the corresponding permit for work within the watercourse through decision no. DA-1046-2023. The respondent municipality has no record of any request by the person whose rights are protected for information related to the work at issue. On 29 April 2026, the applicant filed a complaint with SINAC in which he stated the following facts: “1 – I request that you appear at the location where a new section of pipeline is being built in the environmental protection areas of Río Rosales, beyond the Asada de Puente de Piedra intake, where pipelines have never existed. SINAC has received no complaint from the person whose rights are protected concerning Quebrada Arrozales.

In view of these circumstances, prima facie, there is no situation that currently warrants the intervention of this constitutional jurisdiction.

First, contrary to the applicant’s allegations, the work at issue does have the corresponding permit from the Dirección de Aguas of MINAE and environmental approval from SETENA; the alleged omission is therefore not established.

Furthermore, in Official Letter no. MG-IDC-130-2026 of 27 July 2026, the respondent municipality explains that the person whose rights are protected has not requested any information concerning the project in question. It therefore cannot be inferred that the respondent authority ever denied him public information regarding the work to be performed at the site. Nor does this Chamber identify any harm of constitutional significance arising from the duties performed by the engineer who worked on the project, in the terms alleged by the applicant.

Finally, although the applicant asserts that SINAC has not resolved a complaint that he filed on 29 April concerning this situation, the sworn report submitted by that authority and the materials in the case record show that the complaint in question did not concern the intervention at Quebrada Arrozales but rather Río Rosales, which is an entirely different location, as explained by the respondent agency.

In light of the foregoing considerations, it cannot be established that the respondent authorities committed any act or omission that infringed the fundamental rights of the person protected by the amparo. The application is therefore denied.

V. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a person seeking judicial relief alleges a violation of the right to prompt and effective justice in administrative proceedings, the Administrative-Litigation Courts, rather than this Chamber, have jurisdiction to hear the legal dispute. Nevertheless, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right is eligible for judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Political Constitution of the Republic of Costa Rica, in those cases in which the petitioner considers that the Administration’s physical actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to modify its line of precedent because, under Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction.

Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional cases and that may properly be heard within this jurisdiction through the constitutional guarantee provided by amparo, in all other cases, for the reasons given by this Court (Judgment N° 2008-02545 issued at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

VI. NOTE BY JUSTICE SALAZAR ALVARADO

As a matter of principle, I consider that cases related to the Public Administration’s action or inaction in repairing, constructing, modifying, or demolishing any infrastructure work should be dismissed because such an omission is a matter of legality whose discussion belongs within the ordinary jurisdiction, where the interested person may argue objections more fully. However, when that administrative conduct, whether an omission or otherwise, results in a violation of other fundamental rights protected within this constitutional jurisdiction, or affects groups considered vulnerable, I do examine the merits because such a situation constitutes an exception to my position on this subject, as occurs in this case, in which the applicant files a complaint concerning infrastructure problems that allegedly was not addressed within a reasonable time.

VII. DOCUMENTATION SUBMITTED TO THE CASE RECORD

The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from notice of this judgment. Any material not collected within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Article XXVI of session no. 27-11 of 22 August 2011 and published in Boletín Judicial no. 19 of 26 January 2012, as well as in the resolution of the Consejo Superior del Poder Judicial approved in Article LXXXI of session no. 43-12 held on 3 May 2012.

Therefore:

The application is denied. Justice Castillo Víquez issues a separate note. Justice Salazar Alvarado issues a separate note.

Considerando:

I. ACLARACIÓN PREVIA
