Res. 33798-2026 Sala Constitucional · Sala Constitucional · 03/09/2026
OutcomeResultado
The Chamber denied the amparo application because the denial of water availability rested on technical limitations and the well concession never authorized population supply, so neither ICAA’s denial nor MINAE’s action culminating in the sealing order was deemed arbitrary.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) denied the amparo application filed on behalf of residents of Bosques de Brasil, Mora, who alleged that sealing well AB-1719 would deprive them of their only source of drinking water and that the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) had unjustifiably denied service availability. The Chamber recognized the fundamental right to water but reiterated that it does not entail unrestricted access: a provider may deny a connection for objective technical or legal reasons. It found that the property lay outside the area directly operated by ICAA and that distribution infrastructure and sufficient water and hydraulic capacity were absent, with additional topographical limitations. As to MINAE, the Chamber determined that the concession issued to Pueblo Mediterráneo S.A. authorized the well solely for domestic use on one specified property, not for population supply to subdivided lots. It therefore found the concession denial and sealing order justified and rejected claims of arbitrariness or breach of legitimate expectations.

In this regard, this Chamber has repeatedly held that, although the fundamental right to water and access to it under equal conditions are recognized because water is an essential service for life and health, that right does not entail unrestricted access to water, since service providers may validly establish general conditions and requirements for access. Likewise, entities—whether public or private—that administer the service may deny applications for water service or for a water-availability letter when the applicant does not meet the requirements or when technical or legal reasons justify the denial. Those considerations are fully applicable to this case, in which water availability was denied for technical reasons. Consequently, this Court finds that the denial of water availability is supported by technical reasons and therefore does not constitute arbitrary action. Against this background, the amparo application must be denied because no arbitrary action by the authorities of the MINAE Water Directorate is apparent to the detriment of the protected parties’ fundamental rights.

Document Review Decision No. 2026033798 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 3 September 2026.
Amparo proceeding processed under case number 26-021424-0007-CO, filed by Nombre05, identity card CED03, on behalf of Nombre01, identity card CED04, Nombre02, identity card CED05, and Nombre04, identity card CED06, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) and the MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).
Background:
Justice Hess Herrera writes for the Court; and, Reasons:
The amparo applicant alleges that the persons on whose behalf the application was filed reside in San José, Mora, Colón, Barrio Bosques de Brasil. The applicant states that 8 families live in that neighborhood and built homes in good faith. The applicant states that both the protected persons and the other families in the area depend exclusively on well AB-1719 as their sole source of drinking water. The applicant clarifies that some lot owners cannot develop housing projects for the same reason, which exacerbates the collective impact. The applicant explains that well PRN03 has been under concession since May 1997, pursuant to resolution R-106-97, and that the concession was renewed in January 2014 through resolution R-109-2014. The applicant contends that, based on that State concession, the families built their homes and established their lives in the neighborhood over the course of decades, legitimately relying on the State’s authorizations.
The applicant contends that the concession expired in January 2024 without being renewed in a timely manner by the original concession holder; however, in January 2026 MINAE formally denied renewal of the well concession through resolution R-038-2026-MINAE. The applicant asserts that the technical irregularities originating during construction of the well predated the resident neighbors’ acquisition of the properties; those neighbors did not participate at any time in constructing or locating the well and acted in good faith in reliance on the State authorizations then in force. The applicant alleges that, regardless of the original developer’s responsibility, the State has a nonwaivable constitutional obligation to guarantee the current residents’ human right to water, an obligation that cannot be transferred to private third parties. The applicant states that, through certificate SIGDD-2025-00103885-1-2-NAP dated 31 October 2025, the Instituto Costarricense de Acueductos y Alcantarillados denied the availability of drinking water for the neighborhood, citing the absence of distribution infrastructure in front of the property.
Nevertheless, the applicant indicates that a GPS measurement verified in the field on 9 June 2026 established that the Estación de Desinfección Retana of the ICAA is located only 178 meters in a straight line from the Bosques de Brasil river, which the applicant contends demonstrates that the absence of service is not an insurmountable geographic or technical impossibility, but rather results from an infrastructure-investment decision that the ICAA has not made. The applicant states that drinking-water service was requested from ASADA Barrio La Trinidad de Mora, but on 26 May 2026 it issued a “Certificate of No Water Availability,” on the ground that the neighborhood lies outside the perimeter of its Delegation Agreement granted by the ICAA itself. The applicant alleges that the situation described seriously affects the families in the area because, first, the Dirección de Aguas del MINAE recommended sealing the neighborhood’s only well and, second, the Instituto Costarricense de Acueductos y Alcantarillados does not authorize the nearest ASADA to provide service for jurisdictional reasons that the ICAA itself defines and controls.
The applicant states that an urgent complaint was filed in April 2026 concerning the imminent public-health risk posed by sealing well PRN03 when no alternative drinking-water supply exists for the resident families.
The following facts are deemed duly established and relevant to the determination of this matter:
Regarding the Instituto Costarricense de Acueductos y Alcantarillados:
Regarding the Dirección de Aguas del MINAE
In the matter before the Chamber, the amparo applicant alleges that the persons on whose behalf the application was filed reside in San José, Mora, Colón, Barrio Bosques de Brasil. The applicant explains that well AB-1719 has been under concession since May 1997, pursuant to resolution R-106-97, and that the concession was renewed in January 2014 through resolution R-109-2014.
Now, with respect to the Instituto Costarricense de Acueductos y Alcantarillados, it has been established that, in report UEN-GAR-2018-04520 of 13 November 2018, the engineer from the ICAA’s UEN Gestión de Acueductos Rurales stated: “BACKGROUND Ms. Olga Jiménez, a civil engineer and representative of Mr. Stefan Karl Kuhn, appeared before the ORAC Metropolitana. They requested that the ASADA de Barrio La Trinidad de Mora assume operation of a small private drinking-water supply system serving approximately 17 homes; however, that operating entity denied the request. According to the information provided by Engineer Jiménez, the 17 properties that were sold at the time by Mr. Stefan are supplied by a well that was lawfully drilled and for which the respective concession was granted, although not for the purpose of carrying out urban-development activities. Accordingly, the Dirección de Agua del MINAE advised Mr.
Stefan of that irregularity and invited him to complete the appropriate procedures so that the nearest operator could assume operation of this small system. The nearest operator is the ASADA de Barrio La Trinidad de Mora, which denied the request on the grounds that the system is outside its jurisdiction and that it lacks the water-supply capacity to serve it. In light of the foregoing, Engineer Jiménez requested AyA’s intervention to clarify the situation, and this office coordinated a visit to the ASADA de Barrio La Trinidad to assess the situation and obtain its views. The visit was scheduled for 26 October 2018, with the participation of Mr. Nombre06, President of the Board, and Ms. Xinia Retana, Treasurer of the Board. RELEVANT ASPECTS First, what was requested of the members of the ASADA de Barrio La Trinidad was that they take us to the area where Mr. Stefan’s supply system is located, which can be seen in the following image: According to the measurements taken, Mr.
Stefan’s water-supply system is located 615 m from the ASADA’s office and lies precisely on the boundary between the Acueducto de Brasil de Mora (AyA) and the ASADA de Barrio La Trinidad system. The infrastructure existing in Mr. Stefan’s system is unknown, and the property was not entered during that visit. Regarding the willingness of the ASADA de Barrio La Trinidad to assume the operation and administration of that system, its representatives state that they are not opposed; however, they emphasize that they do not have sufficient water resources to meet the new needs and that the entity would assume administration of the system only if the well’s production is guaranteed and the situation is assessed and its views obtained.

I must also indicate that the study must be submitted to this ORAC Metropolitana for the corresponding review and approval.” Furthermore, in official letter UEN-SCMED-GAM-2026-01350 of 9 July 2026, the ICAA’s UEN Servicio al Cliente Medición GAM clarified: “FOURTH: The legal and technical grounds for denying application number SIGDD-2025-00103885-1-2-NAP are associated with the following: It is important to indicate that the purpose of issuing administrative acts granting or denying services in a given area is to inform the person concerned of the existing circumstances regarding water-supply capacity, collection capacity, and environmental conditions offered or experienced by AyA systems at a particular location. The foregoing is based on ‘basic studies’ and even more specialized studies depending on the nature of the project, which constitute the basis for issuing the act and must address, among other matters: the project’s location, an analysis in relation to the area’s water inventory, the project’s vulnerability, size, projected liters per second, type of activity, population growth, environmental factors that could be affected, and any other matters requiring technical assessment.
According to certificates SIGDD-2025-00103885-1-2-NAP (Certificate of Unavailability of Water-Supply and Sewerage Services), as well as 2025-00103885-1-AP (Technical Drinking-Water Assessment), it is stated that: ‘(...) No distribution or collection infrastructure exists in front of the property for which availability was requested. Images 6 and 7. (...)’ Accordingly, it is important to clarify that a request for water availability is not denied arbitrarily or capriciously, but on technical grounds demonstrating the REAL AND CURRENT LACK of water-supply and/or hydraulic capacity in the water-supply system. Consequently, it may be stated that there is no technical feasibility for granting a favorable determination of availability for drinking-water supply because of a technical impediment, since no production and distribution infrastructure currently exists in front of the property, and granting it would contravene Articles 7 (subsection 12), 8, and 14 of the Reglamento de Prestación de Servicios de AyA.
Furthermore, based on the technical assessment conducted, it is not possible to issue the Certificate of Water-Supply Capacity (Constancia de Capacidad Hídrica, CCH), because there is no distribution pipeline in the vicinity of the property through which a connection to the supply system could be made. Likewise, the water-supply system lacks the water-supply and hydraulic capacity required to meet new demand, and therefore service cannot feasibly be guaranteed under current conditions. Article 7—Definitions. For purposes of these Regulations, the following shall mean: 12. Technical feasibility for granting a service: When distribution and collection networks exist in front of the boundaries of the property, or there is direct access by means of a public road or right-of-way easement (servidumbre de paso) to the property for which service is requested. The systems must have sufficient water-supply, hydraulic, purification, and treatment capacity to provide new services.
The system must satisfy the established quality attributes. It must be legally and environmentally possible. The applicant or applicants must comply with urban-development regulations and the established requirements. (EMPHASIS NOT IN ORIGINAL TEXT) Article 8—Services. AyA shall provide water-supply services for population use and wastewater sanitation within the coverage area, provided that the area has technical and legal feasibility. (EMPHASIS NOT IN ORIGINAL TEXT). The internal systems and installations necessary for the use of the services are the user’s responsibility. Article 9—Technical conditions for providing services. The provider of drinking-water and sanitation services is required to provide them within optimal service parameters in terms of quality, quantity, continuity, reliability, equality, universal access, efficiency, timeliness, sustainability, and a human-rights-based approach, except in cases of force majeure, unforeseen events, or duly publicized maintenance periods affecting the coverage area where the property is located.
(EMPHASIS NOT IN ORIGINAL TEXT) Regarding the minimum dynamic-pressure parameter per service, the optimal service that the provider must guarantee is 10 meters of water column (m.c.a.) at the connection point where the metering system is located. Article 14—Conditions for providing services. AyA shall provide its services once technical feasibility has been verified for constructed properties or properties to be developed that are used as residences or for commercial or industrial activities and that satisfy the requirements and authorized uses under these Regulations. AyA shall provide drinking-water and sanitation services along a street or public road, or over a pipeline and right-of-way easement registered in favor of AyA or third parties, as applicable under Article 16 of these Regulations. The foregoing shall apply provided that operational AyA networks exist. (...) In addition to the foregoing, it is appropriate to recall that the Reglamento para la Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes.
AR-PSAYA-2013, Resolution N° 54-2014 of 18 September 2014, published through Supplement N°50, and its amendment entitled ‘Prestación de los Servicios de Acueducto, Alcantarillado e hidrantes AR-PSAYA-2015,’ adopted through Resolution N° RJD-053-2016 in Supplement 55 of La Gaceta N°69 on 12 April 2016, provides as follows in Section 9: ‘... under no circumstances shall expansions be authorized that jeopardize existing water resources or the capacity of the Sewerage System and its treatment facilities, to the detriment of the community served or the inhabitants of potential new developments....’ (EMPHASIS NOT IN ORIGINAL TEXT) It is important to mention that drinking-water systems are dynamic; that is, they cannot be conceptualized as remaining static over time. Accordingly, water balances progressively limit their water-supply capacity in relation to the supply and demand arising from applications received in a given sector, such that each application is analyzed according to the system’s conditions at that time.
It is clear that we must comply with existing regulations and, although the supply of drinking water is indeed a public service, it is also clear that we must ensure compliance with the principle of legality governing the Public Administration and with the Political Constitution, under which the Institution must comply with its own Regulations and may make no exception. Accordingly, the right to water does not exempt anyone from complying with the requirements established in the Reglamento de Prestación de Servicios de AyA. Lastly, it is important to mention Article 11 of the Political Constitution of Costa Rica, which states verbatim: ‘Public officials are mere custodians of authority. They are required to perform the duties imposed on them by law and may not arrogate powers not granted therein. They must swear to observe and comply with this Constitution and the laws (...).’ FIFTH: According to the information available in AyA’s institutional map viewers, the property is located outside the coverage area of the services administered by that institution.
Likewise, according to the information submitted, the ASADA La Trinidad operates in the area and could be the entity administering the water-supply system that serves the property. SIXTH: Regarding the denial of Certificate of Service Availability N.° SIGDD-2025-00103885-1-2-NAP, on 3 November 2025 a submission filed by Mr. Nombre05 was received and was addressed through Resolution N.° UEN-SCMED-GAM-DyNS-2025-00842, issued on 23 December 2025. Subsequently, on 29 December 2025, a hierarchical administrative appeal (recurso jerárquico) against Resolution N.° UEN-SCMED-GAM-DyNS-2025-00842 was received and forwarded to the Gerencia General through Memorandum N.° UEN-SCMED-GAM-DyNS-2026-00129 for review and resolution. The response to the hierarchical administrative appeal was issued through Resolution number GG-R-2026-0400, notice of which was given on 9 July 2026. Conclusions: The denial of water availability was supported by technical and regulatory criteria.
AyA determined that there was no distribution infrastructure in front of the property and insufficient water-supply and hydraulic capacity to serve a new connection, and therefore concluded that the technical-feasibility requirements established in the Reglamento para la Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes were not met. Consequently, the denial was not based on a discretionary decision, but on verified technical limitations. The property is outside the coverage area administered by AyA. According to the institutional map viewers, the property located in the canton of Mora, district of Colón, does not fall within the coverage of AyA’s services. It was further stated that the ASADA La Trinidad operates in that area and could be the entity with authority to provide drinking-water service. The administrative procedure complied with the stages for challenge and response to the person concerned.
After the certificate of unavailability was issued, the applicant filed a request for reconsideration and subsequently a hierarchical administrative appeal. Both were processed by the Administration in accordance with the established procedure, culminating in the issuance of the corresponding resolution and notice thereof on 9 July 2026, demonstrating that the interested party was afforded the opportunity to exercise the administrative remedies provided by the regulations.” For its part, Memorandum UEN-SCMED-GAM-2026-01351 of 9 July 2026 stated: “In addition to the foregoing, infrastructure administered and operated by AyA is located in the area, but supplying the community from it is not technically feasible because of topographic-elevation criteria. The Los Rodríguez tank is located at an elevation of 863 meters above sea level, and the Retana tank at an elevation of 832 meters above sea level.
Meanwhile, the community identified as Dirección03 is located at elevations ranging from 840 meters above sea level to 883 meters above sea level, which constitutes sufficient technical grounds for denying availability from the infrastructure associated with those tanks. Based on the foregoing, there are technical impediments to supplying flow in the sector. First, because of elevation; second, because of infrastructure and the investment project this would entail; and third and most importantly, because the area is operated not by AyA but by an ASADA. Conclusion Based on the technical information provided, it is concluded that it is not feasible for AyA to provide drinking-water service to the property because the sector is supplied by the ASADA Barrio La Trinidad de Ciudad Colón de Mora, is outside AyA’s operational area, and the existing institutional infrastructure cannot supply the area because of topographic-elevation limitations and the absence of the required infrastructure.
Consequently, the denial of water availability is technically justified.” In this regard, this Chamber has repeatedly held that, although the fundamental right to water and to equal access thereto is recognized because water is an essential service for life and health, that right does not entail unrestricted access to water, since service providers may validly establish general conditions and requirements for access to that service. It is likewise valid for the entities—public or private—that administer the service to deny requests for water or for a water-availability letter when the interested party does not satisfy the requirements or when technical or legal reasons justify the denial. Thus, for example, in Judgment number 2016-006027 at 09:05 on 6 May 2016, this Chamber held as follows:
“In Judgment 2014-9134 at 14:05 on 19 June 2014, which addressed an issue very similar to the one raised in this amparo proceeding, this Constitutional Court ruled: ‘(...) In repeated judgments on this matter, this Chamber has stated that the supply of drinking water is considered a public service under the Costa Rican legal system and that, as such, every provider of public services—whether a public or private entity—is required to provide the service continuously, efficiently, under conditions of equality, and with adaptation to technological changes (see, in this regard, Judgment 2001-09676 at eleven twenty-five on 26 September 2001 and Judgment 2004-08161 at ten fifty-three on 23 July 2004). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the State entities charged with providing the public drinking-water service, is also required to provide that service continuously, adaptably, efficiently, and equally to all inhabitants.
However, the case law of this Constitutional Court has also stated that, where there is a legal impediment (meaning failure to comply with requirements established in the applicable regulations) or a formal impediment (meaning the absence of a Water-Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear installation costs when there is no drinking-water distribution network and infrastructure must be constructed. Thus, in these cases, it has been made clear that this is not a denial of access to drinking-water service, but rather an inability to provide it or the necessary participation of the interested party in overcoming a technical impediment, namely, the lack of infrastructure. In other words, provided that the failure to furnish drinking-water service is not capricious, arbitrary, or unfounded, but is justified by a legal or material impediment, there is no violation of fundamental rights.
In the specific case, the evidence submitted and the report given under oath confirm that AyA did not arbitrarily deny the application filed by the amparo applicant, but did so because of the failure to satisfy all the technical and legal requirements established by the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for the approval of new services.’” Those arguments are fully applicable to the specific case, in which water availability was denied for technical reasons. Consequently, this Court considers that the denial of water availability is supported by technical grounds and therefore does not constitute arbitrary conduct.
Furthermore, it must be noted that whether water availability should be granted, as well as the soundness of the technical reasons supporting the respondent party’s decision, are not matters to be litigated in this Jurisdiction, because they constitute a dispute of ordinary legality falling outside this Chamber’s jurisdiction. Nor may this Court act as a mediator before a particular natural or legal person—whether the latter is governed by public or private law—to intercede on behalf of a third person so that the requested relief may be granted. The amparo applicant’s request that availability be granted is therefore improper and outside this Court’s authority. Accordingly, the amparo applicant may, if he sees fit, submit his objections or claims to the respondent authorities or through the competent judicial proceedings, in which he may fully litigate the merits of the matter and assert his claims.
Consequently, this aspect of the application must be denied.
Regarding this aspect, the Chamber finds it established that, through Resolution nro. R-0109-2014-AGUAS-MINAE of 30 January 2014, the Dirección de Aguas del MINAE granted Pueblo Mediterráneo S.A. a concession for well PLA01 for use on property PRN01 and solely for domestic use.
For its part, the evidence submitted and the report given under oath show that the Dirección de Aguas del MINAE did not authorize the well for population use.
Subsequently, on 9 June 2018, an application was filed with the Dirección de Aguas seeking to designate property PRN02 as the new property benefiting from the well concession. In response to that application, the authority consulted the certification system of the Registro Nacional de la Propiedad and detected that property PRN01, for which the concession had been granted to Pueblo Mediterráneo S.A., had undergone subdivisions (segregaciones). The concessionaire company was therefore asked to inform the Dirección de Agua whether water was being drawn from well PLA01 for the subdivided properties, but no response was received.
Thus, Resolution R-0155-2021-AGUAS-MINAE of 2 February 2021 stated: “THIRD: In connection with that application, through official letter AL-0432-2016 of 09 August 2016, the Dirección de Agua ordered the owners of real-property folio PRN02 and Stefan Karl Kuhn, representative of the concessionaire company PUEBLO MEDITERRÁNEO S. A., to provide information, stating that the property number for which the concession was originally granted had been checked in the Registro Público and showed further subdivisions, and therefore requesting that they indicate whether water was being drawn from well PRN03 for those properties or state where their water was being drawn from; however, no response appears in expediente 8203-P. FOURTH: Engineer Mariel Celeste González Artavia, an official of the Unidad Hidrológica Tárcoles Pacífico Central of the Dirección de Agua, stated in official letter DA-UHTPCOSJ-0739-2018 of 20 March 2018, in response to the request to follow up on official letter AL-0432-2016, that after reviewing the background, ‘Mr.
Karl Kuhn (representative of PUEBLO MEDITERRÁNEO S. A.) was contacted by email (...01) and by telephone.... Mr. Kuhn stated that he was currently in discussions with A y A regarding donation of the well and the land, but that there was opposition from some neighbors who wished to obtain their water from that well. Mr. Kuhn indicates that, through official letter SGG-2015-0132 (dated 27/02/2018), AyA stated that it was analyzing the request....’ FIFTH: Memorandum N° UEN-OS-GAM-2018-00171 of 23 July 2018 appears in expediente 8203-P. In that memorandum, an official of AyA’s UEN Optimización de Sistemas GAM, writing to that Institution’s Dirección Jurídica regarding the well of Sociedad Pueblo Mediterráneo S. A., stated that ‘...because of the well’s location and the sector it supplies, as well as this source’s topographic elevation relative to the nearest supply systems of the Acueducto Metropolitano AyA, it is not technically feasible for A y A to assume this system.
It is recommended that the system be assumed by the ASADA de la Trinidad de Mora, and access to the well and the sector it supplies requires crossing part of that ASADA’s coverage area.’ SIXTH: Through official letter AL-0356-2018 of 24 August 2018, the legal advisory office of the Dirección de Agua informed Karl Kuhn, representative of Pueblo Mediterráneo S. A., that the concession had mistakenly been granted to property PRN01 when it should have been granted to property PRN04. It also informed him of Ms. Nombre03’s request to transfer the concession to property PRN02, which was improper because she was not a representative of the concessionaire. He was further informed that a review of the Registro Nacional de la Propiedad showed that the matter involved a residential development and population-based human-consumption uses of water that were not authorized by the concession; accordingly, pursuant to the official letter cited in the preceding paragraph, he was required to apply to the ASADA de la Trinidad de Mora for the provision of the public service and was granted a period of 6 months.
SEVENTH: On 10 October 2018, Karl Kuhn, representative of Pueblo Mediterráneo S. A., responded to official letter AL-0356-2018, attaching a response from the ASADA Barrio La Trinidad de Mora and stating that he had asked AyA’s Dirección Regional Oeste de Asadas to clarify that response because no other ASADA existed in the area where the well was located. The official letter to which he referred was dated 21 September 2018 and declined to assume the well because it was outside La Trinidad’s jurisdiction and the ASADA lacked the water-supply capacity for a development. That document was signed by Karen Arias Retana, identity card CED01, without specifying her authority or any technical assessment. EIGHTH: Through official letter DA-1530-2018 of 04 October 2018, addressed to the Presidenta Ejecutiva of A y A and served on 9 October 2018, the Director de Agua reported the situation described and stated as follows: ‘Because this concerns population-based human consumption and, under Ley 2726, it falls within that institution’s authority to provide that service, the case is brought to its attention so that it may proceed as appropriate.
It goes without saying that the Municipalidad del cantón de Mora is being copied so that it does not approve further construction permits on that property. Once the case has been addressed, you are requested to notify this Directorate so that it may inform the interested party before the sealing order is issued.’ NINTH: On 14 November, the Dirección de Agua received, by means of an official letter signed by Mr. Stefan Karl Kuhn, legal representative of Pueblo Mediterráneo S. A., AyA Site Visit Report UEN-GAR-2018-04520, signed by Engineer Esteban Ramírez Gutiérrez of the UEN Gestión de Acueductos Rurales. Thus, by submitting that official letter to the Dirección de Agua, he acknowledged and received notice of its contents, including that the matter had to be resolved through AyA. As relevant for purposes of this act, the following may be quoted from Section 2. RELEVANT ASPECTS of that letter: ‘First, what was requested of the members of the ASADA de Barrio La Trinidad was that they take us to the area where Mr.
Stefan’s supply system is located (...).’ ‘...it lies precisely on the boundary between the Acueducto de Brasil de Mora (AyA) and the ASADA de Barrio La Trinidad system.’ Likewise, Section 3. CONCLUSIONS states as follows: ° The supply system does not fall within the definition of an authorized operating entity, and regularizing this situation is therefore of the utmost importance. ° The supply system is located on the boundary between the Acueductos de Brasil de Mora, which is administered by AyA, and Dirección01; accordingly, either of the two water-supply systems could assume its administration, provided that it has the necessary technical capacity. ° The characteristics of the supply system are completely unknown, making it necessary to conduct a technical study describing the system, the characteristics of its component infrastructure, verification of well production, pressure tests on the distribution network, and a water balance between production and demand. ° If the study determines that the system requires improvements, they must be made by the interested party, and the ASADA may begin operating the system only after they have been completed.
Likewise, the land on which the well and storage tank are located and the pipeline rights-of-way must be duly registered in the ASADA’s name when it begins operating the system. TENTH: Through official letter AL-0465-2018 of 20 November 2018, the Legal Coordinator of the Dirección de Agua asked the representative of Pueblo Mediterráneo S. A. to indicate the approximate date on which AyA would assume provision of the service at the site and the well in question could be sealed, so that the ongoing unlawful use would not continue. Alternatively, he was asked to clarify whether the well would be assumed by any of the ASADAS mentioned in official letter UEN-GAR-2018-04520 so that registration of the source could be ordered, all within a period of 10 days pursuant to Article 264 of the Ley General de la Administración Pública.” ( ) “THIRD: According to the statement of facts set out in the Background section of this resolution, expediente 8203-P presents two situations with different procedural remedies.
First, the change to population use of the concession for the use of groundwater granted in that expediente through Resolution R-0109-2014-AGUAS-MINAE at eight fifty-seven on 30 January 2014. Not only was that change made without notifying MINAE, but the user was also given coordinated follow-up with AyA concerning the steps required so that either that Institution or an ASADA would provide the service or assume source well PRN03, because it was demonstrated and has been more than sufficiently acknowledged by PUEBLO MEDITERRÁNEO S. A., corporate identification number 3-101-243294, through its representative Stefan Karl Kuhn, resident identification number 175-000006505, that a residential development is supplied from that concession. He has been sufficiently informed of the steps he must take before AyA and that the supply issue cannot be resolved through a water concession for human consumption (domestic use).
As a consequence of the foregoing, the Director de Agua’s official letter to the Presidenta Ejecutiva of AyA states: ‘Because this concerns population-based human consumption and, under Ley 2726, it falls within that institution’s authority to provide that service, the case is brought to its attention so that it may proceed as appropriate. It goes without saying that the Municipalidad del cantón de Mora is being copied so that it does not approve further construction permits on that property.’” ( ) “THEREFORE, THE MINISTER OF ENVIRONMENT AND ENERGY RULES: I. PUEBLO MEDITERRÁNEO S. A., corporate identification number 3-101-243294, through its representative Stefan Karl Kuhn, resident identification number 175-000006505, IS HEREBY FORMALLY ORDERED FOR THE FIRST TIME to take notice that the change in use of the groundwater-use concession granted through Resolution R-0109-2014-AGUAS-MINAE at eight fifty-seven on 30 January 2014 for drilled well number AB-1719, from domestic use to population use, constitutes grounds for expiration of the water concession because it contravenes Article 26, subsection II, of the Ley de Aguas, as has been more than sufficiently established by the statement of facts set out in the Operative section and in light of the regulations and reasoning contained in the Reasons section of this resolution.” Finally, in Resolution R-2606-2025-AGUAS-MINAE of 21 November 2025, in response to Pueblo Mediterráneo S.A.’s application to extend the concession, it was ruled: “SEVENTH: On 10 August 2025, Pueblo Mediterráneo S. A. stated that, ‘in view of the request to seal well AB-1719,’ it requested that the sealing order remain stayed until A y A or an ASADA assumes the water-supply system, because approximately 12 homes obtain water from it for domestic use.
EIGHTH: The application for a water concession through drilled well AB-1719 is being processed in expediente administrativo 8203-P. The same expediente contains Resolution R-0155-2021-AGUAS-MINAE, which ordered well AB-2552 sealed because it is used for population supply, a use falling outside MINAE’s authority. The administrative expediente contains no record that well AB-2552 was sealed; accordingly, a criminal complaint must be filed for Disobedience, an offense defined in Section 314 of the Código Penal.” “THEREFORE, THE MINISTER OF ENVIRONMENT AND ENERGY RULES: I. TO DENY PUEBLO MEDITERRÁNEO S. A., corporate identification number 3-101-243294, represented by Mr. Stefan Karl Kuhn, residence identification number CED07, a concession for the use of groundwater because well number AB-1719 does not comply with the 40-meter setback from the ROP or the 100-meter setback required by the Ley Forestal.
II. TO ORDER PUEBLO MEDITERRÁNEO S. A. TO SEAL WELL NUMBER AB-1719 WITHIN ONE MONTH in accordance with the guidelines established in Decreto N° 45053-MINAE and, within the same period, to report the sealing to the Dirección de Agua for field verification. III. TO ORDER THE DIRECCIÓN DE AGUA TO FILE A CRIMINAL COMPLAINT FOR THE OFFENSE OF DISOBEDIENCE, defined in Article 314 of the Código Penal, for FAILURE TO COMPLY WITH THE ORDER TO SEAL well number AB-2552 issued through Resolution R-0155-2021-AGUAS-MINAE at fourteen twenty-two on 2 February 2021.” Thus, it should be noted that, from the outset, the well concession was granted solely to Pueblo Mediterráneo S.A. for use on property PRN01 and solely for domestic use. Nevertheless, that concessionaire improperly used the well, properties were subdivided, and the well was used for an unauthorized purpose, namely, the residential development.
It was precisely for that reason that Resolution R-0155-2021-AGUAS-MINAE of 2 February 2021 stated: “PUEBLO MEDITERRÁNEO S. A., corporate identification number 3-101-243294, through its representative Stefan Karl Kuhn, resident identification number 175-000006505, IS HEREBY FORMALLY ORDERED FOR THE FIRST TIME to take notice that the change in use of the groundwater-use concession granted through Resolution R-0109-2014-AGUAS-MINAE at eight fifty-seven on 30 January 2014 for drilled well number AB-1719, from domestic use to population use, constitutes grounds for expiration of the water concession because it contravenes Article 26, subsection II, of the Ley de Aguas, as has been more than sufficiently established by the statement of facts set out in the Operative section and in light of the regulations and reasoning contained in the Reasons section of this resolution.” Subsequently, in Resolution R-2606-2025-AGUAS-MINAE of 21 November 2025, the concession was denied because the requirements had not been met, and the sealing of well AB-1719 was ordered.
Against this background, the application must be denied because no arbitrary conduct by the authorities of the Dirección de Aguas is apparent to the detriment of the protected party’s fundamental rights. This is because, from the outset, the well was not authorized for population use or for properties other than the one recorded under real-property folio PRN01.
It is therefore improper for this Chamber to endorse the applicant party’s contention that legitimate expectations were infringed when, instead, third parties, such as the protected persons, have used a well not authorized for their water supply, notwithstanding even the existence of the aforementioned Resolutions R-0155-2021-AGUAS-MINAE of 2 February 2021 and R-2606-2025-AGUAS-MINAE of 21 November 2025.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any electronic, computer, magnetic, optical, or telematic device or produced using new technologies, such items must be collected from the Chamber’s offices within a maximum period of 30 business days from notice of this judgment. Notice is given that any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Article XXVI of Session nro. 27-11 of 22 August 2011, published in Boletín Judicial nro. 19 of 26 January 2012, as well as the decision of the Consejo Superior del Poder Judicial approved in Article LXXXI of Session nro. 43-12 held on 3 May 2012.

Redacta la Magistrada Hess Herrera; y,
Considerando:

(RESALTADO NO CORRESPONDE A TEXTO ORIGINAL).
