The Chamber denied the amparo because the dispute over water measurement, billing, and reimbursement involved ordinary legality that could be addressed administratively, and no violation or threat to fundamental rights was established.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) denied the amparo application filed against the Instituto Costarricense de Acueductos y Alcantarillados (AyA) over high bills, water-service suspensions, allegedly unclear explanations, and reported mistreatment. The applicant sought review of her payments and consumption, reimbursement of overcharges, repayment of expenses for pipes and inspections, and compensation for resulting harm. According to the facts the Chamber found proven, AyA processed and notified her complaints, replaced a water meter that had stopped recording consumption, inspected the equipment, and ruled out leaks attributable to the institutional measuring system. AyA also redistributed accumulated consumption under Article 97, subsection Vii, of the Reglamento de Prestación de Servicios a los Clientes and restored service following suspensions for nonpayment. The Chamber concluded that the dispute concerned the accuracy of billed amounts and claims for reimbursement, which presented issues of ordinary legality to be pursued through the applicable administrative mechanisms. Because no violation or threat to a fundamental right was established, constitutional amparo was not the proper proceeding.

Key excerptExtracto clave

In this regard, the Chamber concludes that the issue raised does not fall within the powers conferred on this jurisdiction. The applicant believes that this Constitutional Chamber should order a review of the payments she has made, require that she be charged according to her actual consumption, and direct the reimbursement of amounts overpaid. She also seeks repayment of the money spent replacing pipes and hiring a company to determine whether leaks existed, because she maintains that the respondent authority should have performed that work. In other words, she seeks to litigate in the constitutional jurisdiction a dispute concerning the amount charged by the respondent Institute for drinking-water service, a matter involving ordinary legality rather than constitutionality. Consequently, because no fundamental right is found to have been violated or threatened and the matter instead concerns disagreement with the amount charged, the dispute may be addressed and resolved administratively through the legal mechanisms established for that purpose. The amparo application is denied.

Document Review Case file: 26-024007-0007-CO Decision No. 2026033004 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:40 a.m. on 27 August 2026.

Amparo proceeding processed under case file N° 26-024007-0007-CO, filed by Nombre02, identity card N° CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

BACKGROUND:

  1. 1By a submission filed with the Office of the Clerk of the Chamber and added to the case file on 3 July 2026, the amparo applicant filed an amparo application against the Instituto Costarricense de Acueductos y Alcantarillados. She explains that:

“For more than ten years I have been filing complaints with them regarding the high water-service consumption charges. The amount became so high that two years ago they cut off my water and demanded that, in order to restore it, I had to pay the debt, which exceeded two million colones across 6 bills, and I entered into a payment arrangement that I have kept current. After that, the water bill went down because they changed the meter, and I continued paying both the bill and the payment arrangement. In September 2025, they changed the meter again, and in October I began receiving bills for nearly 200 thousand and one hundred thousand. I went to complain again, and they told me by email that the charge was correct, even though, as I explained to them, three adults live in my house, all of whom leave for work; one spends most of his time at his girlfriend’s home, and my son and I practically only come home to sleep.

Despite the complaints, they state that the charge is correct. I then sent the Complaint to Aresep, where they accepted the highest bills, namely those for October, November, December, February, March, and May. They are not consecutive because the bills not included since that date were for amounts between 35 thousand and 50 thousand, and I have continued paying them even though the amounts are high given the circumstances explained above. In April, they sent someone to cut off the water even though ARESEP had not answered the complaints. Starting with the people who came to cut it off and those who attended to me at the AYA office, I was verbally mistreated by the person who assisted me and by the Area Manager (you can see this in the attached complaint I filed for mistreatment). After that, I called Aresep, went to the Defensoría de los Habitantes, and that same day ended up going to the AyA Comptroller’s Office, which had my water reconnected.

That day, the stress, anger, and frustration caused by the mistreatment were so severe that the next day I ended up at the Hospital and the INS. I was on medical leave for more than a month, because I have spent years trying to have them charge me fairly for this water problem. It is not fair for a household of 3 people who work even on Saturdays, and worst of all, they do not provide the service as they should and their answers are unclear. On 17 June, while I was outside the country, I paid the June bill, and even so they came again to cut off the water, leaving me defenseless. It was chaos because my son was alone, and they told him that only I could go and resolve what they claimed was the problem, even though I was current and the disputed bills remained unanswered. He had university classes and had to go to work the next day. In the end, I called and the people at AYA told me that unless the entire debt was paid, the water would not be reconnected. I had to borrow money and pay everything so that they would come and reconnect it.

Given all of the above, the stress brought me to a very critical state of health, from which I had only just begun to recover, in addition to the money I paid for something that they have not fixed and amounts exceeding 600.000 thousand for something that is not my fault and for which they have no clear answers. Yesterday, I received the water bill by email and, now that I am current, they sent me a bill for 128.000 thousand that has no explanation or logic, and even the figures do not add up to the amount they are charging. I went back, and a young man who did not know what to say assisted me; then the person who had mistreated me walked by, and they told me it was a fine, without explaining what it was for, when supposedly they should only charge the monthly bill and reconnection fee.

Everything I recount in these lines represents years of mistreatment and worry, of having been left without water on many occasions, and of being forced to pay excessive bills for which they provide no explanation. Through all these charges, they are violating my rights to receive a knowledgeable explanation of the charge and to have the amount for water correspond to what is used in my home by THREE people who leave for work, leaving no one there, while they charge without measure or explanation.

I therefore request that you intervene and require them to conduct a study of the charges I have already paid, charge me according to my actual water consumption, and refund the excess money charged, with a clear and understandable explanation of amounts that vary so widely. I also request compensation for the Damages and losses caused to me by this entire situation and by years of struggling with an Institution that has never acted responsibly, including my stress and illness, the amount of money I have paid it, and the additional money I have spent replacing all the pipes and hiring a company to tell me whether there was a leak, which was their job, but they never came to do it. There is also the disrespect and lack of consideration shown by the manager of that Branch, who, as I mentioned, never apologized, and that is why the country is the way it is, because of unqualified people like him.

Regarding everything mentioned above, I am sending copies of everything that has been done, the bills, and the responses, to verify that what is stated here is true. I am a single mother and pay a mortgage, water, electricity, cable, food, and all household expenses. By this I want to make clear that I never expected anything to be given to me for free; I simply wanted to be charged fairly. I am not the only one who experiences this with that institution. I have witnessed so many people arrive there and be mistreated and not know how to defend themselves, often out of fear and lack of knowledge that we have rights and that those rights cannot be violated.” (sic). Based on the allegations set forth, she considers that the challenged actions are violating fundamental rights. She requests that the application be granted, with the consequences prescribed by law.

  1. 2By a decision issued at 15:49 on 31 July 2026, the proceeding was admitted, and the general manager of the Instituto Costarricense de Acueductos y Alcantarillados was afforded an opportunity to respond.
  2. 3José Darío Guzmán Álvarez, in his capacity as general manager of the Instituto Costarricense de Acueductos y Alcantarillados, reports the following regarding the alleged facts:

“I.- REGARDING THE FACTS ALLEGED BY THE AMPARO APPLICANT Through technical report No. UEN-SCZIV-GAM-2026-00573, signed by Nombre01 of UEN Servicio al Cliente Zona IV GAM, the actions taken by AyA in connection with the applicant’s complaint are reported under oath. That report is attached as integral evidence supporting this response and states, in summary:

FIRST: Regarding the administrative applications filed by the applicant. A review of the records in the Sistema Comercial Integrado (OPEN SCI) confirms that the complaints filed were duly processed, decided, and notified to the email address supplied by the user (...01). Notable actions include: official letter UEN-SCZII-GAM-2026-00034 dated 19/01/2026, official letter OF-0154-DGAU-2026 dated 28/01/2026, the corresponding decision dated 17/02/2026, and official letter UEN-SCZII-GAM-2026-00632 dated 29/06/2026. This demonstrates that the Administration provided timely responses to the complaints submitted.

SECOND: According to the service-order module, the following technical inspections were conducted to verify the condition of the installations: On 06/08/2025, the old water meter (hidrómetro) (reading: 954 m3) was replaced with a new one (reading: 0 m3) under order 52212577, confirming that the new device records correctly and has no leaks. Subsequently, on-site inspections to verify the reading and search for leaks in the security box (Ford box) were conducted on 04/10/2025, 21/10/2025, 23/12/2025, and 26/05/2026. All these technical visits determined that the water meter records correctly and that there are no leaks attributable to the institutional metering equipment.

THIRD: Regarding replacement of the metering equipment and billing, it is clarified that the removed water meter had a recording problem and had reached the end of its useful life, for which reason it was included in the national replacement program. Beginning with the period of 23/02/2023, that water meter stopped at a reading of 954 m3, resulting in billed consumption of 0 m3 (under-registration) through July 2025. Once the new equipment was installed, it began recording actual consumption. For the period of 26/08/2025, consumption of 0 m3 was billed, and the bill dated 25/09/2025 reflected a cumulative reading of 76 m3. In view of this situation, in strict compliance with Article 97, subsection Vii (Distribution of Consumption), of the Reglamento de Prestación de Servicios a los Clientes, AyA analyzed and redistributed consumption by setting each period at 38 m3, thereby regularizing the fair and accurate reading of the property’s actual consumption.

FOURTH: Regarding the disconnections and service provided, it is clarified that service was lawfully suspended for delinquency on two occasions. The first was on 18/03/2026, with automatic reconnection performed that same day because of the complaint submitted to ARESEP (Filing GD-000993-2026). The second suspension occurred on 17/06/2026 due to nonpayment of overdue bills; when the user paid the debt on 18/06/2026, reconnection was performed immediately. Regarding the alleged mistreatment at the Paseo Colón Service Point, the complaint was addressed under Filing IN.CS N° 0268-2026, and through official letter No. UEN-SCC-GAM-2026-01168 dated 20/03/2026, the Institution formally offered the appropriate apologies for the service received.

FIFTH: Regarding the actions taken by AYA The facts established through the technical report support the conclusion that there was no arbitrary act or omission attributable to the Instituto Costarricense de Acueductos y Alcantarillados. The bills issued reflect the effective and actual consumption measured at the property following the installation of a water meter in perfect condition, and the corresponding regulatory redistribution was applied (Article 97 of the Reglamento de Prestación de Servicios) because the prior meter had stopped and was recording 0 m3.

As established Consistent with the foregoing, the water meter was replaced because it had reached the end of its useful life and was entered into the national replacement program, whose purpose is to analyze, plan, and manage all meters that, due to age and wear, fail to record actual consumption, whether because of under-registration, over-registration, or errors in their readings. This process was established by the regulatory authority through the TECHNICAL STANDARD: WATER METERS FOR WATER-SUPPLY SERVICE AR-HSA-2008, which provides that:

“Measurement of consumption, or universal individual metering, is the fair and equitable means of regulating charges and payment for drinking-water service, thereby putting into practice the principle of service at cost, promoting the conservation and efficient use of drinking water, and reducing water pollution by discharging less wastewater into bodies of water. Thus, regulating the quality, location, operation, and maintenance of water meters guarantees the user a fair and accurate reading of consumption.” Promoting efficient water use, which is achieved to a significant extent through the installation of water meters, extends the useful life of water sources and postpones increasingly costly investments.

Effective measurement of consumption depends on instruments that meet minimum quality standards and on appropriate maintenance criteria and standards.

The following benefits of measuring drinking-water consumption, among others, have been identified:

Reduction of demand and investment costs. Controlling consumption through measurement encourages users to reduce the amount of drinking water they consume and to avoid waste, thereby reducing demand and, consequently, investment costs. It has been sufficiently demonstrated that demand without consumption measurement greatly exceeds demand with effective measurement.

Efficient use of the resource. Efficient water use generates smaller quantities of wastewater, with the resulting environmental benefits, and reduces the costs of conveying, treating, and ultimately disposing of such water.

Optimization of water-resource use. The reduction in demand achieved through consumption measurement promotes optimal use of water sources because, in general, water resources close to population centers are being depleted or have been depleted, and increasingly large investments are required to bring water from more distant locations. This entails higher investment, operating, and maintenance costs, which translate into higher rates.

Control of the water balance. Consumption measurement, together with macro-metering of the water entering the distribution system, makes it possible to calculate the water balance and determine losses and the corrective measures required for recovery; in other words, it makes it possible to optimize the system.

Control of leaks in internal installations. The flow indication, through the starting indicator or the roller on the water meter’s liter scale, makes it possible to identify internal leaks.

Fairness in service charges. Consumption measurement is the mechanism that ensures fairness in service charges: those who consume more must pay more. Furthermore, the customer may decide how much more to consume and, consequently, how much more to pay.

Likewise, the service suspensions were carried out within the Institution’s collection authority in response to failure to pay obligations arising from the service, with reconnections performed promptly when appropriate or when the debt was brought current. In this regard, the Institution has guaranteed consideration of the complaints and the user’s due process. Regarding complaints strictly associated with service billing for amounts owed, the consistent case law of this Constitutional Chamber has held that an amparo proceeding is not the appropriate avenue for resolving disputes over billed amounts when the Institution has technically verified the accuracy of the consumption.

From the foregoing, it follows that the institution I represent acted within the framework permitted by the Legal System, seeking and weighing, specifically in this case, a solution to the applicant’s complaint by conducting technical studies in accordance with the regulations in force. That study is estimated to take an average of one calendar month from the outcome of the leak repair, at which time AYA made the corresponding adjustments.

It is very important to emphasize that the actions taken complied with the governing regulations, without arbitrary manipulation of service delivery, and that duly supported and reasoned actions were taken at all times, as described. It is therefore evident that the Instituto acted in accordance with law and that none of its acts violated any constitutional right. On the contrary, the arguments presented and evidence submitted support the conclusion that AyA indeed acted as required.

II. RELIEF REQUESTED

Based on the regulations cited and the evidence I hereby submit, I respectfully request that this Authority DENY this Amparo Application and exempt AyA from all liability and any award of costs, damages, and losses.”

  1. 4The legal requirements have been observed in the proceedings followed.

Justice Salazar Alvarado authors the decision; and, REASONS:

I. SUBJECT MATTER OF THE APPLICATION

The applicant states that she has experienced billing problems for more than a decade. She indicates that she entered into a payment arrangement for a debt exceeding two million colones after her service was cut off two years ago. She argues that, following a meter replacement in September 2025, she began receiving bills for excessive amounts (close to one hundred thousand and two hundred thousand colones), which do not correspond to the actual consumption of a three-person household whose occupants spend most of their time away from the home. She also questions the due process and customer service provided, citing a lack of clear answers, the institution’s refusal to review the charges on the ground that they are correct, and alleged verbal mistreatment by branch officials and the area manager. She further explains that the stress arising from the situation, the service interruptions, and the treatment she received caused health problems requiring hospital care and medical leave.

Finally, she describes a situation that occurred in June 2026, when her service was cut off while she was outside the country despite her being current, and she was required to pay the entire debt before reconnection. Additionally, she reports a new bill for one hundred twenty-eight thousand colones, which was described to her as a “fine” without a clear explanation. She considers that this Constitutional Chamber should order a review of the payments she has made, require that she be charged according to her actual consumption, and order a refund of the excess amount paid. She also seeks an order requiring reimbursement of the money she spent replacing pipes and hiring a company to determine whether there were any leaks, because that work should have been performed by the respondent authority.

II. PROVEN FACTS

The following relevant facts are deemed duly established and material to the resolution of this application:

1. Regarding the administrative applications filed by the applicant, all were processed, decided, and notified to the email address supplied by the user (...01), according to the records of the Sistema Comercial Integrado (OPEN SCI). Notable actions include: official letter UEN-SCZII-GAM-2026-00034 dated 19/01/2026, official letter OF-0154-DGAU-2026 dated 28/01/2026, the corresponding decision dated 17/02/2026, and official letter UEN-SCZII-GAM-2026-00632 dated 29/06/2026 (see, in this regard, the report submitted by the respondent authority and the evidence provided).

2. The respondent authority conducted the following technical inspections to verify the condition of the installations: On 06/08/2025, the old water meter (reading: 954 m3) was replaced with a new one (reading: 0 m3) under order 52212577, confirming that the new device records correctly and has no leaks. 4. Service was lawfully suspended for delinquency on two occasions. The first was on 18/03/2026, with automatic reconnection performed that same day because of the complaint submitted to ARESEP (Filing GD-000993-2026). The second suspension occurred on 17/06/2026 due to nonpayment of overdue bills; when the user paid the debt on 18/06/2026, reconnection was performed immediately (see, in this regard, the report submitted by the respondent authority and the evidence provided).

5. Regarding the alleged mistreatment at the Paseo Colón Service Point, the complaint was addressed under Filing IN.CS N° 0268-2026, and through official letter No. UEN-SCC-GAM-2026-01168 dated 20/03/2026, the Institution formally offered the appropriate apologies for the service received (see, in this regard, the report submitted by the respondent authority and the evidence provided).

6. The decision admitting this proceeding was served on the respondent authority on 6 August 2026 (see, in this regard, the certificates of service added to the record).

III. PROVEN FACTS

The following relevant facts are deemed duly established and material to the resolution of this application:

Sole fact. That there is any application filed by the applicant concerning the provision of drinking-water service at her residence that remains pending resolution (the record).

IV. MERITS

The applicant states that she has experienced billing problems for more than a decade. She indicates that she entered into a payment arrangement for a debt exceeding two million colones after her service was cut off two years ago. She also seeks an order requiring reimbursement of the money she spent replacing pipes and hiring a company to determine whether there were any leaks, because that work should have been performed by the respondent authority.

For his part, the general manager of the Instituto Costarricense de Acueductos y Alcantarillados stated under oath, regarding the administrative applications filed by the applicant, that all were processed, decided, and notified to the email address supplied by the user (...01), according to the records of the Sistema Comercial Integrado (OPEN SCI). Notable actions include: official letter UEN-SCZII-GAM-2026-00034 dated 19/01/2026, official letter OF-0154-DGAU-2026 dated 28/01/2026, the corresponding decision dated 17/02/2026, and official letter UEN-SCZII-GAM-2026-00632 dated 29/06/2026.

He further stated that the following technical inspections were conducted to verify the condition of the installations: On 06/08/2025, the old water meter (reading: 954 m3) was replaced with a new one (reading: 0 m3) under order 52212577, confirming that the new device records correctly and has no leaks. All these technical visits determined that the water meter records correctly and that there are no leaks attributable to the institutional metering equipment.

It was also explained that the water meter at the home of the person protected by the amparo had a recording problem and reached the end of its useful life, for which reason it was included in the national replacement program. Additionally, it was explained that service was lawfully suspended for delinquency on two occasions.

Finally, regarding the alleged mistreatment at the Paseo Colón Service Point, the complaint was addressed under Filing IN.CS N° 0268-2026, and through official letter No. UEN-SCC-GAM-2026-01168 dated 20/03/2026, the Institution formally offered the appropriate apologies for the service received.

In this regard, the Chamber concludes that the issue raised does not fall within the powers conferred on this jurisdiction. It should be noted that the applicant considers that this Constitutional Chamber should order a review of the payments she has made, require that she be charged according to her actual consumption, and order a refund of the excess amount paid. She also seeks an order requiring reimbursement of the money she spent replacing pipes and hiring a company to determine whether there were any leaks, because that work should have been performed by the respondent authority. In other words, she seeks to litigate before the constitutional jurisdiction a dispute concerning the amount charged by the respondent Instituto for drinking-water service, a matter involving issues of ordinary legality rather than constitutionality. At this point, it is important to reiterate the evidentiary value that the legislature assigned to reports submitted by respondent authorities, through enactment of the Law establishing this jurisdiction, specifically in the second paragraph of Article 44 of the Ley de la Jurisdicción Constitucional.

It is precisely on the basis of the foregoing that such reports, unless conclusively rebutted through other evidence, will be deemed true, without prejudice, of course, to the criminal liability that the respondent authority would incur if it engaged in the conduct specified by that same law.

Consequently, because no fundamental right is found to have been violated or threatened and there is merely disagreement with the amount charged, the matter may be disputed and resolved through administrative channels using the legal mechanisms established for that purpose.

V. DOCUMENTATION SUBMITTED TO THE CASE FILE

CONSIDERANDO:

I. OBJETO DEL RECURSO
