The Chamber granted the amparo only against the Municipality of Escazú, ordering it to resolve the stagnant-water problem effectively within six months, maintain provisional measures, and pay costs and damages, while denying relief against the Ministry of Health and urging it to continue sanitary oversight.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) partially granted the amparo proceeding solely against the Municipality of Escazú because the inspections, cleaning, pumping, and provisional works undertaken since 2023 had not effectively and promptly resolved the stagnant water outside the applicant’s home. Persistent flooding, mosquitoes, foul odors, health risks, and access difficulties in a household that included particularly vulnerable persons violated the rights to health, a healthy and ecologically balanced environment, and an adequate quality of life. The Chamber ordered the mayor to adopt and implement, within six months after notification, the technical, administrative, and operational measures necessary to ensure proper stormwater drainage, while maintaining provisional mitigation measures until the definitive solution is completed. The amparo was denied as to the Ministry of Health because its inspections, sanitary orders, and ongoing enforcement were considered continuous; nevertheless, the Ministry was urged to continue supervising administrative file N° 065-26 and compliance with the sanitary orders until the detected conditions are corrected.
Key excerptExtracto clave
Consequently, this Chamber finds that the response provided by the Municipality of Escazú was neither effective nor timely in comprehensively resolving the reported problem, thereby violating the applicant’s fundamental rights, particularly the rights to health, a healthy and ecologically balanced environment, and an adequate quality of life. The proper course is therefore to partially grant the application against the Municipality of Escazú under the terms set forth in the operative portion of this judgment. As to the Ministry of Health, the evidence in the record shows that the authority has continuously exercised its sanitary oversight and control powers by conducting inspections and tracing tests, issuing technical reports and sanitary orders, and monitoring compliance in the corresponding administrative file. Accordingly, no omission warranting the granting of the application against it has been established. Nevertheless, because the reported problem has not yet been definitively corrected and in view of the powers conferred upon those authorities by the legal system for the protection of public health, they are directed to take note and are urged to continue monitoring administrative file N° 065-26 and supervising compliance with the sanitary orders issued, as well as to adopt the measures falling within their powers until the detected sanitary conditions are corrected. Consequently, the amparo is denied as to the Ministry of Health.

Document Review Case File: 26-031756-0007-CO Decision No. 2026036873 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 24 September 2026.
Amparo proceeding processed under case file No. 26-031756 0007-CO, filed by [Name 001], identity card [Value 001], against the MUNICIPALIDAD DE ESCAZÚ and the MINISTERIO DE SALUD.
BACKGROUND:
“II. ACTIONS OF THE AREA RECTORA DE SALUD
Indeed, after the complaint was received on 26 February 2026, this Health Authority initiated the corresponding administrative actions, opened the administrative case file, and investigated the reported facts. Folios 001 through 015.
As part of that investigation, multiple sanitary inspections and tracing tests using sodium fluorescein were conducted at the properties identified by the complainant, making it possible to identify discharges of soapy water originating from properties located in the reported area. Folios 16, 17, 19, 41, and 42.
As a result of those measures, Technical Report No. IT-MS-DRRSCS-DARSE-1084 2026 was issued, on the basis of which the need to adopt corrective measures to eliminate the detected sanitary conditions was determined. Folios 21 through 23.
Based on the technical findings obtained, this Authority issued Sanitary Order No. MS-DRRSCS-DARSE-OS-135-2026 against the person responsible for the property identified under real-property folio No. 307567. That order was duly served and subsequently subjected to the corresponding administrative follow-up. Folios 24 through 27.
Likewise, the compliance proposals submitted by the regulated party were technically assessed and, due to the specialized nature of the proposed works, a technical opinion was requested from the Dirección Regional Rectora de Salud Central Sur through official letter No. MS-DRRSCS-DARSE 1346-2026. Folios 39 and 40.
Subsequently, through official letter No. MS-DRRSCS-URS-1147-2026, the Dirección Regional de Rectoría de la Salud Central Sur concluded that the submitted plan did not satisfy the technical requirements requested by this Health Authority. It was therefore declared noncompliant, and the submission of a new proposal was required. Folios 45 through 49.
After a new corrective action plan was received, this Authority again proceeded to assess it and determined that technical deficiencies persisted that prevented it from being considered satisfactory. A new period for its correction was therefore granted. Folios 54 through 64.
Similarly, the investigative actions made it possible to identify another source of the problem, resulting in the issuance of Technical Report No. IT-MS-DRRSCS-DARSE-2044-2026 and Sanitary Order No. MS-DRRSCS-DARSE-OS-224-2026 dated 09 September 2026.
It must be noted that the actions taken by this Health Authority fall within the powers of oversight, control, and protection of public health conferred by the Ley General de Salud. In the exercise of those powers, field investigations were conducted, technical reports and sanitary orders were issued, and the corresponding administrative follow-up was performed, all aimed at correcting the detected sanitary conditions.
The foregoing demonstrates that this Área Rectora de Salud has not remained inactive in response to the complaint filed by the amparo applicant. On the contrary, it has conducted sanitary inspections, tracing tests, technical reports, sanitary orders, requests for specialized opinions, technical assessments of remediation plans, and follow-up measures intended to secure the definitive correction of the reported situation.
Consequently, this Health Authority cannot be accused of an omission or of neglecting its statutory powers, because administrative case file No. 065-26 is currently active, pending, and under institutional supervision, and the administrative measures necessary to verify compliance with the issued sanitary orders and seek a solution to the reported problem remain in effect.
It should also be noted that the administrative case file contains no submission through which the amparo applicant formally requested information on the status of the procedure or copies of the actions taken. This does not alter the fact that this Authority has maintained constant administrative activity from the receipt of the complaint through the date of this report.
It must be emphasized that the persistence of the reported problem does not, in itself, imply inactivity or noncompliance by this Health Authority, since the record shows that administrative acts have been issued to the persons responsible for the identified properties, the corresponding periods for compliance have been granted, the submitted proposals have been technically assessed, and the follow-up measures necessary to guarantee correction of the detected sanitary conditions remain in effect.
As of the date of this report, the issued sanitary orders remain in effect and subject to the corresponding administrative follow-up by this Health Authority, and the actions necessary to verify compliance remain open.
Consequently, the actions described demonstrate that this Health Authority has not engaged in omission, inertia, or neglect of its statutory powers, but rather has carried out an ongoing and progressive intervention aimed at investigating the reported facts and correcting the detected sanitary conditions.
It must be noted that the actions taken by this Health Authority have been aimed at identifying the sources of the reported problem and ordering their correction within the scope of the powers legally conferred upon the Ministerio de Salud. In that regard, the fact that the reported situation had not been fully corrected when the amparo application was filed does not, in itself, constitute an administrative omission, since the administrative case file documents ongoing, continuous, and progressive activity aimed at securing a definitive solution to the detected sanitary conditions.”
“I. SUMMARY OF THE MUNICIPALITY’S POSITION The Municipalidad de Escazú has not committed the omission attributed to it. On the contrary, documentary evidence shows that this local government has continuously addressed the situation reported by Ms. [Name 001] since November 2023—that is, more than a year before the date that the application itself identifies as the first report—by conducting on-site inspections, cleaning channels, storm drains, and inspection boxes, periodically pumping pooled water, constructing pedestrian-access works specifically designed to accommodate the reduced mobility of her family members, and conducting a technical assessment of the area’s Stormwater Drainage System.
In addition, the technical verification conducted by the Subproceso de Gestión Ambiental rules out the existence at the site of any natural body of water, whether piped or aboveground, that would create a protected area affecting the protected person’s property. The dispute therefore does not involve harm to public-domain property or a forest protection area, but solely the hydraulic capacity of the stormwater drainage system, a matter subject to technical assessment and this municipal corporation’s ordinary budget planning.
FACTS A. Assistance provided during 2023 1. On 9 November 2023, at 11:41 a.m., Ms. [Name 001] sent an email to Edgar Zúñiga Sandí, an official of the Subproceso de Mantenimiento de Obra Pública, with the subject line “Report of overflowing sewer and breeding sites,” in which she expressed appreciation for the opportunity to explain her situation and requested an inspection.
2. On 13 November 2023, at 10:23 a.m.—that is, on the second following business day—the Subproceso de Mantenimiento de Obra Pública formally responded, stating that the crew supervisor would clean the area’s water channels to clear the system and prevent pooling caused by blockages, and that the system’s operation would be checked.
3. On 14 November 2023, at 7:50 a.m., the protected person herself CONFIRMED the visit by municipal personnel to the site. In that same email, the official Zúñiga Sandí had stated the previous day, at 10:30 a.m., that he would relay the information to his colleagues.
These three documents prove that, as early as 2023, the Municipalidad de Escazú was aware of the situation, addressed it within a reasonable period, cleaned the channels, and maintained direct communication with the regulated party. The amparo application identifies 7 January DE ESCAZU 2025 as the first report; the documented municipal response therefore predates the applicant’s own account by more than a year.
B. Reports and response during 2025 and 2026 4. On 28 and 29 October and 13 November 2025, the protected person sent additional emails stating that the situation had worsened during the rainy season. Each was received and processed by the Subproceso de Mantenimiento de Obra Pública.
5. On 13 November 2025, the official Pablo Mora Fuentes conducted an on-site inspection while it was raining, specifically to ascertain the system’s actual performance.
The protected person authorized entry onto her property. The following day, the official provided written notice that crews would intervene to remove the pooled water and that the Stormwater Drainage System and the possible causes of its failure would be assessed.
6. Beginning on Saturday, 15 November 2025, crew personnel from the Municipalidad de Escazú have PERIODICALLY pumped out the pooled water, according to rainfall conditions and specifically in response to this case. Those interventions are documented photographically.
7. In early December 2025, municipal crews demolished and rebuilt the sidewalk providing access to Ms. [Name 001]’s property, for the express purpose of creating a pedestrian passage appropriate to her family members’ mobility conditions. The Municipality performed this work using its own resources and at no cost to the regulated party.
8. In January 2026, the technical assessment of the case and the intervention by the Subproceso de Mantenimiento de Obra Pública resumed, in coordination with the Gerencia de Gestión Urbana.
9. On 11 February 2026, the protected person sent another follow-up communication, which was likewise received and processed by the competent sub-process. All of the foregoing is documented in report INF-MOP-0362-2026 dated 9 September 2026, signed by the official Pablo Mora Fuentes of the Subproceso de Mantenimiento de Obra Pública, which is submitted as evidence and whose statements are deemed testimony for all legal purposes pursuant to subsection 2) of Article 301 of the Ley General de la Administración Pública.
c. Specific response to the statement of facts in the application To address individually the facts summarized in the decision providing notice, the following is reported:
This fact is not on record, as detailed in section V of this report.
Through official letter COR-GA-372-2026 dated 10 September 2026, signed by Eng. Jerson Calderón Valverde, Coordinador de Gestión Ambiental, and Geographer María Isabel Sánchez Sánchez, this Municipality’s Subproceso de Gestión Ambiental verified, based on the information officially available as of that date and a review of the Sistema Nacional de Información para la Gestión Integrada del Recurso Hídrico (SINIGIRH) of the Dirección de Agua of the Ministerio de Ambiente y Energia, that:
‘no natural bodies of water are recorded on or near the property, whether piped or not, that affect Ms. Romero’s property by creating protected areas.’ The legal consequence of this verification is relevant: because no natural body of water exists at the site, the situation contemplated in Article 33 of Ley Forestal, No. 7575, does not arise. There is therefore no encroached protected area, no construction within a public-domain watercourse, and no effect on public-domain property requiring restoration. Consequently, the dispute is confined to the capacity of the area’s stormwater drainage system.
It must be added that the definitive determination of the existence and course of bodies of water, whether piped or aboveground, falls to the Dirección de Agua of the Ministerio de Ambiente y Energía in its capacity as the regulatory body for the subject, and that establishing watercourse setback lines is the responsibility of the Instituto Nacional de Vivienda y Urbanismo pursuant to Articles 33 bis and 34 of Ley Forestal, No. 7575. This Municipality lacks authority to replace those bodies in making that determination, without prejudice to the cartographic verification that it is authorized to conduct and that, as explained, yielded a negative result.
Article 1 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, No. 2726, precisely distinguishes three areas of authority: regarding drinking water and the collection and disposal of sewage and liquid industrial waste, the Institute ‘decides all matters relating thereto’; by contrast, regarding stormwater drainage systems in urban areas, the provision assigns it only ‘regulatory responsibility.’ Consistently, Article 2(k) of that same law authorizes municipalities to construct sewer works with the Institute’s prior technical approval, confirming that the physical implementation of stormwater drainage for the cantonal road network is a municipal responsibility under Articles 3 and 4(c) of the Código Municipal.
This Municipality does not evade that responsibility: as established in section ll, it has exercised it by cleaning, conducting periodic pumping and inspections, and constructing access works. It must be clarified, however, that the major intervention in the Stormwater Drainage System constitutes infrastructure work subject to technical study, approval by the Instituto Costarricense de Acueductos y Alcantarillados pursuant to Article 21 of Ley No. 2726, and budgetary allocation in accordance with Article 100 et seq. of the Código Municipal.
It is important to clarify the physical configuration of the water conveyance system in the area. As established in report INF-MOP-0362-2026, the Jaboncillos stormwater drainage system discharges directly into Quebrada Yeguas through a system that runs between properties. Specifically, at the site, conveyance takes place through an outfall pipe that discharges into an open earthen channel, which crosses privately owned green areas before reaching its final discharge point.
This configuration is critical to understanding the reported phenomenon: drainage capacity depends not only on the works located in the public street, but also on the cross-section, slope, and state of maintenance of a conveyance segment located on privately owned land over which this Municipality exercises no direct administration. Thus, although the cleaning and pumping performed by municipal crews are necessary and effective in mitigating the pooling, they cannot, by themselves, replace the major intervention in the system, which is undergoing technical assessment.
It must also be considered that the area’s hydraulic conditions have changed for reasons outside this corporation’s control, including increased intensity of meteorological events and urban development within the watershed, factors that alter the flow volume that the existing infrastructure must accommodate.
v. ALLEGED FACTS NOT FOUND IN THE MUNICIPAL RECORDS We state under oath that, after reviewing the institutional records, THERE IS NO RECORD of any communication issued by this Municipality on 3 August 2026, or on any other date, informing the protected person that the matter fell within the authority of the Instituto Costarricense de Acueductos y Aicantarillados and that she should await that institution’s decision. This municipal corporation has neither disclaimed its authority nor transferred responsibility for addressing the case to another entity.
It is also placed on record that the regulated party’s reports were received by the Subprocesos de Mantenimiento de Obra Pública e Inspección, which are the departments with authority over the subject matter, and were addressed by them as established above.
This Honorable Chamber has determined that its authority in environmental and municipal-service matters is limited to ascertaining whether the institutions have acted responsibly, diligently, and promptly; it is not for the Chamber to verify the technical correctness of the studies or assessments issued, absent manifest arbitrariness or complete omission.
Under that standard, this case discloses no omission, but rather sustained municipal action over time: documented attention since November 2023; responses to reports within reasonable periods; on-site inspections during rainfall; cleaning of channels and inspection boxes; periodic pumping of pooled water; pedestrian-access works specifically constructed in response to the reduced mobility of the persons living on the property; and technical assessment of the system in coordination with the Gerencia de Gestión Urbana.
The fact that a definitive solution for the stormwater drainage system is still in progress does not, by itself, constitute a violation of fundamental rights, where the record shows that the Administration has adopted specific, verifiable, and proportionate measures to mitigate the harm while the major works are carried out” (sic).
Justice Salazar Alvarado authors the decision; and, REASONS:
Before examining the merits of the matter—concerning the alleged violation of the right to a prompt and properly completed procedure—it must be clarified that, beginning with Judgment No. 2008-02545 issued at 08:55 on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction (Jurisdicción Contencioso Administrativa)—with certain exceptions—matters involving a dispute over whether the Public Administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, for issuing a final administrative act resolving an administrative procedure—initiated ex officio or at a party’s request—or for deciding the available administrative challenges. This case presents precisely such an exception, because it concerns the failure to address a complaint filed by the amparo applicant regarding stagnant, foul-smelling water coming from the public street in front of her home in Escazú, a situation that causes flooding, proliferation of mosquitoes, foul odors, health risks, and difficulties accessing the property, and that the respondent authorities have not addressed within a reasonable period, placing the well-being of the protected persons at risk. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.
The amparo applicant complains that, for more than a year, she has faced a persistent problem involving stagnant, foul-smelling water coming from the public street in front of her home in Escazú, a situation that causes flooding, proliferation of mosquitoes, foul odors, health risks, and difficulties accessing the property, particularly because persons in especially vulnerable circumstances live in the home, including her 83-year-old mother and her daughter, who has a severe disability. She maintains that, despite the multiple submissions and complaints made to the Municipalidad de Escazú and the Ministerio de Salud, the authorities have not adopted effective measures to definitively resolve the problem and have limited themselves to partial and insufficient actions.
The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven or because the respondent failed to address them as required in the initial order:
The following fact, which is relevant to the resolution of this matter, is not deemed duly proven:
SOLE FACT. That the Municipalidad de Escazú comprehensively addressed the complaints made by the amparo applicant.
It should be noted that municipalities are responsible for administering local interests and services in each canton, pursuant to Article 169 of the Political Constitution. This is the basis for municipalities’ authority to plan and oversee urban development within their localities. This includes the duty to establish a comprehensive planning policy that ensures urban development consistent with an environment free from pollution.
In the matter at hand, the amparo applicant complains that, for more than a year, she has faced a persistent problem involving stagnant, foul-smelling water originating from the public roadway in front of her home in Escazú, a situation that causes flooding, mosquito proliferation, foul odors, health risks, and difficulties accessing the property, particularly given that persons in especially vulnerable circumstances live in the household, including her 83-year-old mother and her daughter, who has a severe disability. She maintains that, despite the numerous requests and complaints submitted to the Municipalidad de Escazú and the Ministerio de Salud, the authorities have not adopted effective measures to resolve the problem definitively, limiting themselves to partial and insufficient actions.
In this regard, in their reports submitted under oath—with due warning of the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—the respondent authorities state that they have taken various actions intended to address the reported situation. In particular, the Municipalidad de Escazú reports that it conducted site inspections, cleaned drainage channels and sewers, periodically pumped out accumulated water, constructed a sidewalk providing access to the amparo applicant’s home, and performed technical assessments of the stormwater drainage system. For its part, the Ministerio de Salud reports that it processed the complaint submitted by the person protected by the amparo, conducted health inspections and traceability tests, issued technical reports and health orders addressed to the persons identified as responsible for some of the detected discharges, and kept the corresponding administrative file active.
The proven facts show that the problem reported by the amparo applicant has persisted for an extended period and that, as of the filing of this amparo proceeding, it had not been definitively resolved. Although the municipal authorities have taken various steps to address the situation, those actions have not been sufficient to effectively remedy the reported conditions, which continue to adversely affect the amparo applicant and her family unit. Indeed, the municipality itself acknowledges that a definitive solution for the stormwater drainage system is still undergoing technical assessment.
Consequently, this Chamber finds that the response provided by the Municipalidad de Escazú has been neither effective nor timely in comprehensively resolving the problem presented, thereby violating the amparo applicant’s fundamental rights, particularly the rights to health, to a healthy and ecologically balanced environment, and to an adequate quality of life. Accordingly, the amparo proceeding must be granted in part against the Municipalidad de Escazú, under the terms to be specified in the operative portion of this judgment.
VII.With respect to the Ministerio de Salud, the evidence in the record confirms that this authority has continuously exercised its health oversight and control powers by conducting inspections and traceability tests, issuing technical reports and health orders, and monitoring compliance with those orders within the corresponding administrative file. Therefore, no omission warranting the granting of the amparo against it has been established.
Nevertheless, because the reported problem has not yet been definitively corrected, and in view of the powers conferred upon those authorities by the legal system concerning the protection of public health, those authorities are directed to take note and are urged to continue monitoring administrative file N° 065-26 and overseeing compliance with the health orders issued, as well as to adopt the measures falling within their authority until the detected health conditions are corrected. Consequently, the amparo is denied with respect to the Ministerio de Salud.
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the courts of the administrative-litigation jurisdiction, rather than this Chamber, must hear the legal dispute. However, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right may be judicially protected through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in connection with Article 27 of the Political Constitution of the Republic of Costa Rica, in cases in which the petitioner considers that the Administration’s material conduct, administrative acts, or response is adversely affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to modify its line of precedent, since, under section 7 of its Law, this Court alone is responsible for defining its own jurisdiction.
Therefore, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional cases that may properly be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with section 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
I consider that, in environmental matters, where the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative-litigation jurisdiction. Nevertheless, I do address the merits when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (Article 50 of the Political Constitution), as occurs in this case, in which the amparo applicant states that she reported to the respondent authorities the problems involving stagnant, foul-smelling water originating from the public roadway in front of her home in Escazú—a situation causing flooding, mosquito proliferation, foul odors, health risks, and difficulties accessing the property—which the respondent authorities have not addressed within a reasonable period, thereby placing the physical integrity of the persons protected by the amparo at risk.
I dissent with respect to enforcement of the judgment and would order that, pursuant to Art. 56 of the Ley de la Jurisdicción Constitucional (LJC), enforcement be assigned to the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda.
Enforcement of the orders issued by the Constitutional Chamber (Sala Constitucional) must, in principle, be supervised by the Chamber itself. However, that provision contemplates exceptional circumstances in which, as determined by the Chamber itself, enforcement of the judgment is to be assigned to the administrative-litigation jurisdiction:
“Art. 56. Enforcement of judgments is the responsibility of the Constitutional Chamber, except with respect to the assessment and payment of compensation and monetary liabilities, or with respect to other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through administrative-litigation proceedings under the judgment-enforcement procedure provided for in the law governing that jurisdiction.” (Emphasis not in the original).
It should be recalled that the bill concerning the LJC originally provided as follows:
“Art. 56. Judgments favorable to the amparo applicant shall be enforced through administrative-litigation proceedings under the judgment-enforcement procedure provided for in the law governing that jurisdiction.” (Emphasis not in the original).
However, the text was amended by motion so that the provision would be consistent with Art. 153 of the Political Constitution, and the following explanation was given:
“THE SECRETARY:
Motion No. 68 (32-19) by Deputy Chacón Jiménez:
‘Article 57 (formerly 56): so that the text shall read as follows: “Enforcement of judgments is the responsibility of the Constitutional Chamber, except with respect to the assessment and payment of compensation or monetary liabilities, or with respect to other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through administrative-litigation proceedings under the judgment-enforcement procedure provided for in the law governing that jurisdiction.”’ THE PRESIDENT:
Is the motion that was read open for discussion?
Doctor Piza Escalante:
There was a contradiction here with the general principle that courts enforce their own judgments, and it assigned all enforcement to the Administrative-Litigation Jurisdiction; that left the other articles allowing the Chamber to enforce them without effect.
Deputy Corrales Bolaños:
That portion says: ‘or with respect to other matters that the Chamber itself deems appropriate...’; what does that refer to?
Doctor Piza Escalante:
The idea is that, in judgment-enforcement proceedings, the Chamber decides whatever it considers to fall within its responsibility. Everything else is referred to administrative-litigation proceedings.
THE SECRETARY:
Is the motion deemed to have been sufficiently discussed?
THE PRESIDENT:
Discussion concluded. Approved (unanimously, with five deputies present).” (sic). See the records approving the LJC. Emphasis not in the original).
Based on the foregoing, it is clear that the LJC itself authorizes this Chamber to assess and decide whether all or some matters relating to enforcement of the judgment should be referred to the administrative-litigation jurisdiction.
In this specific case, given the scope of the order to definitively resolve the problem reported by the amparo applicant concerning stagnant, foul-smelling water originating from the public roadway in front of her home—a situation causing flooding, mosquito proliferation, foul odors, health risks, and difficulties accessing the property—I consider that the proper course would be to assign the enforcement stage of this matter to the administrative-litigation jurisdiction. This is because the legislation governing this constitutional jurisdiction does not provide suitable mechanisms for monitoring the orders set forth in this judgment, which involve technical matters of some complexity.
By contrast, the provisions of the Código Procesal Contencioso-Administrativo governing enforcement (Art. 155 et seq.) offer clear advantages, including the ability to require schedules, impose fines, establish liability, and oversee stages of compliance, among others. Therefore, pursuant to Art. 56 of the LJC, I consider that the enforcement stage should take place before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
The parties are hereby advised that, if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, telematic, or new-technology device, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any materials not retrieved within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:
The amparo proceeding is granted in part, solely against the Municipalidad de Escazú. Consequently, Orlando Umaña Umaña, in his capacity as mayor of the Municipalidad de Escazú, or whoever holds that office, is ordered to issue the pertinent instructions and undertake the corresponding coordination, within the scope of his authority, so that, within SIX MONTHS of notification of this judgment, the technical, administrative, and operational measures necessary to effectively address the problem reported by the amparo applicant concerning the stagnation and accumulation of water in the vicinity of her home are adopted and implemented, thereby ensuring adequate stormwater drainage and eliminating the reported health and environmental impacts. Furthermore, while the permanent measures are being implemented, he must maintain and implement any provisional measures necessary to mitigate the effects of the problem and prevent further harm to the health, physical integrity, and quality of life of the amparo applicant and the persons residing in the property.
The amparo is denied with respect to the Ministerio de Salud. The authorities of the Ministerio de Salud shall take note of the provisions of Reason VII of this Judgment. The respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The Municipalidad de Escazú is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in administrative-litigation judgment-enforcement proceedings. Justices Castillo Víquez and Salazar Alvarado each issue a separate note. Justice Garro Vargas dissents regarding the forum for enforcement of the judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, would order that this stage be assigned to the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda.- Fernando Castillo V.
