SummaryResumen
The Constitutional Chamber (Sala Constitucional) partially granted an amparo proceeding against the Tribunal Ambiental Administrativo due to unjustified delays in proceedings concerning forests, waterways, protection areas, and other activities subject to environmental oversight. The Chamber held that Articles 41 and 50 of the Constitution require environmental complaints to be processed and decided promptly, and that technical complexity or unanswered requests to SINAC offices does not release the Tribunal from actively advancing cases, coordinating, monitoring deadlines, and considering evidentiary alternatives. It ordered final decisions within six months in files 019-25-01-TAA, 262-24-01-TAA, and 171-25-03-TAA, and prescribed further action and a two-month post-hearing deadline for file 243-04-02-TAA. It granted amparo concerning file 066-22-03-TAA solely for damages and costs because that matter was decided while the proceeding was pending. It denied relief regarding file 172-25-01-TAA and referred the complaint concerning 222-14-03-TAA for enforcement of an earlier judgment.

The duty to coordinate is not exhausted by issuing repeated requests. The Tribunal must use its legal powers to obtain the necessary inputs, monitor deadlines, bring failures to comply to the attention of the competent authorities, and assess any available evidentiary alternatives. It is not required to replace specialized expertise or anticipate an adverse decision, but it must effectively direct the proceedings. The omission declared here concerns that duty belonging to the respondent body. The amparo must therefore be granted on these three grounds. The Tribunal must take the necessary measures to advance and coordinate the proceedings, complete the investigation, and issue and communicate the legally appropriate decision within a maximum period of six months. This period accounts for the need to obtain specialized inputs and, where appropriate, bring charges and hold a hearing. Preparatory measures must begin immediately and may not be deferred until the end of that period.

Document Review Decision No. 2026036732 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 24 September 2026.
Amparo proceeding filed by [Name 001], identity card No. [Value 001], against the TRIBUNAL AMBIENTAL ADMINISTRATIVO.
BACKGROUND
Justice Salazar Alvarado drafts the opinion; and, Reasons:
Before analyzing the merits of the matter, it must be clarified that, since Judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa)—with some exceptions—matters involving a dispute over whether the administration has complied with the time limits established by the General Law on Public Administration (Articles 261 and 325) or by sector-specific laws for concluding, by means of a final administrative act, an administrative proceeding initiated on its own motion or at a party’s request, or for deciding the applicable administrative remedies. This sub judice matter presents precisely such an exception, because it concerns the failure to decide several complaints filed by the amparo applicant before the Tribunal Ambiental Administrativo regarding alleged harm to natural resources and activities subject to environmental oversight, which allegedly have not been decided within a reasonable period. In view of the foregoing, this Chamber will assess the possible delay in addressing the submission. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.
II.Subject matter of the proceeding. The amparo applicant alleges that the Tribunal Ambiental Administrativo has failed to issue final decisions in cases 019-25-01-TAA, 066-22-03-TAA, 262-24-01-TAA, 171-25-03-TAA, 172-25-01-TAA, 222-14-03-TAA, and 243-04-02-TAA, concerning complaints of alleged harm to natural resources and activities subject to environmental oversight, despite the time elapsed since they were opened and since the latest actions he identifies, with delays that, in some matters, extend for more than one or two decades. He maintains that the absence of a decision determining whether liability exists prolongs uncertainty, favors the entrenchment of the reported interventions, and weakens the prevention and remediation of environmental harm. He therefore considers his fundamental rights to have been violated and requests that the respondent authority be ordered to decide those proceedings immediately and definitively.
The following facts are considered duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as required by the initial order:
For purposes of deciding this matter, the following facts are not considered duly established:
Article 50 of the Political Constitution recognizes the right to a healthy and ecologically balanced environment and authorizes persons to report violations that threaten or impair it. In conjunction with Article 48 of the Constitution and Articles 29 and 33 of the Law on Constitutional Jurisdiction, that provision permits review of the applicant’s claim for environmental protection, even though he was not the original complainant in all the proceedings. Therefore, the fact that matter 066-22-03-TAA was initially brought by another person, or that the amparo applicant joined 243-04-02-TAA in 2025, does not in itself exclude his standing to challenge an omission affecting collective environmental interests.
The relief sought does not consist of obtaining preexisting information or a response to a simple request. The applicant seeks the conclusion of investigations that require evidentiary activity and, where applicable, adversarial proceedings. The central standard is therefore Article 41 of the Constitution, in conjunction with Article 50, rather than the ten-day period established for the right of petition in Article 32 of the Law on Constitutional Jurisdiction. The environmental dimension of the claim prevents it from being reduced to an ordinary dispute over administrative time limits: the delay may compromise the effectiveness of natural-resource protection.
The constitutional analysis is confined to determining whether the authority processed and decided the complaints within a reasonable time. It is not appropriate here to establish the liability of the reported persons, declare the existence of environmental harm, or decide whether each activity required environmental approval. Those issues must be resolved in the competent proceedings, with due respect for the right of defense.
Articles 41 and 50 of the Political Constitution require administrative action intended to protect the environment to be timely and effective. Articles 103 and 111 of the Organic Environmental Law assign the Tribunal Ambiental Administrativo specific duties to hear and decide complaints. Exercising those powers requires obtaining the necessary technical information, but also actively promoting its production and adopting the appropriate decisions without leaving proceedings indefinitely under investigation.
In Judgment No. 2023-000660, issued at 9:15 a.m. on 13 January 2023, this Chamber granted an amparo because of the Tribunal Ambiental Administrativo’s delay in deciding an environmental complaint and ordered that it be concluded within no more than three months. That precedent shows that the performance of investigative steps and the need to complete an investigation must be assessed against the proceeding’s actual duration and the obligation to decide it. Its application to this matter nevertheless requires examination of the chronology and status of each case. Likewise, Judgment No. 2024-026420, issued at 9:35 a.m. on 13 September 2024 and specifically concerning case 222-14-03-TAA, ordered that a hearing be held on a specified date and that the complaint be decided within the following month. With respect to that proceeding, this judgment constitutes a specific order whose enforcement must be respected.
The two-month period in Article 261 of the General Law on Public Administration provides a statutory benchmark for concluding a proceeding, although the investigation’s actual complexity cannot be disregarded. The reasonableness of its duration must be weighed according to the nature of the facts, the indispensable evidence, the conduct of the parties and authorities, and the effect of the delay on the rights at stake. Merely listing actions separated by long intervals or generally invoking the need for reports is insufficient to rule out a violation.
Proven facts a), c), and d) show that these three matters remain pending reports requested from SINAC offices. The respondent authority maintains that it cannot bring charges without supporting grounds and that the failure of other offices to cooperate explains the delay. The Chamber recognizes the need for sufficient evidence and respect for due process; that requirement, however, does not release the body directing the proceedings from its duty to actively pursue their continuation.
In case 019-25-01-TAA, following the fourth request of 22 October 2025, the next action specifically identified in the report was the fifth request of 2 September 2026. More than ten months elapsed without evidence of any effective action directed at overcoming the obstacle. The complaint had been filed in January 2025. The renewed request made after service of this amparo confirms that the matter remained pending, but it neither explains the prior interval nor constitutes a decision.
In cases 262-24-01-TAA and 171-25-03-TAA, the number of properties and the need to identify the facts pertaining to each one justify the boundary-determination and severance measures described in the reports. However, following the inspections and technical reports of November 2025, the requests made to Área de Conservación Osa in December of that year were not repeated until July 2026 and again in September. That sequence reveals periods of inactivity that have not been specifically justified. Recognition of the matter’s initial complexity does not permit an investigation to be extended indefinitely because an administrative office has failed to respond.
The duty to coordinate is not exhausted by issuing repeated requests. The Tribunal must use its statutory powers to seek the necessary information, monitor deadlines, bring noncompliance to the attention of the competent authorities, and assess the available evidentiary alternatives. It is not required to supply specialized knowledge or anticipate a finding of liability, but rather to effectively direct the proceedings. The omission declared here concerns that duty of the respondent body itself.
References to amparo proceedings No. 25-010935-0007-CO and No. 25-027496-0007-CO are not, by themselves, sufficient to establish that their subject matter is identical to the entirety of the delay examined here. The analysis of this issue concerns the prolonged investigations shown by the current reports, particularly the periods following the actions of November and December 2025; it does not review the decisions in those proceedings.
The proceeding must therefore be granted on these three grounds. The Tribunal must take the necessary measures to move the proceedings forward and coordinate their processing, complete the investigations, and issue and communicate the legally appropriate decision within a maximum period of six months. This period reflects the need to obtain specialized information and, where appropriate, bring charges and hold a hearing. Preparatory steps must begin immediately and may not be deferred until that period expires.
Proven facts h) and i) show that the complaint was received in August 2004 and that, twenty-two years later, the proceeding still lacks a final decision. The account provided by the authority itself shows intervals of several years between actions: following the steps taken in 2007, an inspection in 2013 is noted; requests made in 2020 and 2022 and new proceedings in 2025 are then described. Although there were requests for suspension, criminal proceedings, and a need for procedural correction, no sufficient justification has been provided for the overall duration of the matter.
The subsequent nullity declared in September 2026 and the new charges constitute actions continuing the proceeding. They are not equivalent to the issuance of a final decision and do not eliminate the delay that had already occurred. The duty to preserve the validity of the proceeding must be fulfilled promptly; otherwise, each procedural correction would operate as a new starting point that would make it impossible to review the duration of the administrative action.
Nor does the date on which the amparo applicant joined the proceeding alter the length of time that a complaint concerning environmental protection has remained unresolved. The protected interest transcends his individual position as an assisting party. The violation arises from the absence of a timely administrative determination, and finding such a violation does not require treating the harm attributed to the reported persons as proven.
Accordingly, this ground must be granted, and the hearing scheduled for 5 November 2026 must be held if it has not already taken place, with a final decision issued and communicated within one month after the hearing, subject to due process. The new notice of hearing does not by itself satisfy the purpose of the proceeding, and there has therefore been no complete cessation of the conduct that would make Article 52 of the Law on Constitutional Jurisdiction applicable.
The evidence establishes that the complaint was received in March 2022 and that the municipal report was received on 4 December 2024.
The complaint was dismissed by decision No. 910-2026-TAA, issued at 12:30 p.m. on 2 September 2026, which was served on the parties the following day, 3 September 2026 (official letter O-403-2026-TAA, pages 42 to 45, and official letter 95 in the administrative case file).
The authority identifies no subsequent actions that would justify the time elapsed before the final administrative act of 2 September 2026. Thus, even using receipt of that report as the benchmark, approximately one year and nine months elapsed before a decision was issued. It has not been shown that any specific impediment during that period made it reasonable to leave the decision pending.
The dismissal was issued after 28 August 2026, the date on which the order admitting the proceeding was served, and because the respondent authority states under oath that it was communicated to the parties, the omission ceased while the amparo was pending. Accordingly, under Article 52 of the Law on Constitutional Jurisdiction, that circumstance does not require that the proceeding be denied, as the respondent argues.
In this case, the violation is established by examining the duration of the proceeding and the absence of a sufficient explanation for the period following the municipal report, and not exclusively by the subsequent issuance of the administrative act. This ground must therefore be granted for purposes of compensation and costs under Articles 51 and 52 of the cited law. Because the final decision has been issued and communicated, it is not appropriate to order that the same proceeding be decided again. Nor does the Chamber express any opinion on whether the substance of the dismissal complies with environmental law.
The circumstances of this proceeding differ from the preceding ones. According to the evidence, the investigation included an inspection in November 2025 and the receipt of reports from various institutions, the last of which was received on 5 January 2026. The Tribunal dismissed the complaint by decision No. 780-2026-TAA, issued at 1:47 p.m. on 28 July 2026, before the amparo was filed.
The report submitted refutes the assertion that the matter remains without a final decision. The absence of physical archiving is not equivalent to the absence of a decision. The period of review following the reports must be assessed in the context of the investigation that gave rise to the proceeding and the collective assessment of the information obtained; the available evidence does not establish a constitutionally unjustified delay that would support granting this ground. The Chamber does not consider a specific date of service of the decision to have been established solely by the assertion that no remedies were filed. However, the alleged violation presented here is not an independent failure to communicate that decision but the absence of a final administrative act. The amparo must therefore be denied with respect to case 172-25-01-TAA. This ruling does not validate the substance of the dismissal or prevent it from being challenged through the appropriate channels.
Judgment No. 2024-026420, issued at 9:35 a.m. on 13 September 2024 in case 24-018198-0007-CO, did not merely order general action to advance the proceeding: it ordered that a hearing be held on 1 November 2024 and that a final decision be issued within the following month. The omission now alleged regarding case 222-14-03-TAA coincides with the duty to decide that was already imposed. Under Articles 53 and 56 of the Law on Constitutional Jurisdiction, review of compliance with that mandate belongs to the enforcement phase of the proceeding in which it was issued. The subsequent investigative actions, modification of the charges, and new hearing must be assessed there to determine their effect on compliance and the appropriate measures. A new amparo proceeding cannot be used to replace that order with another or to grant a period that indirectly modifies the prior ruling. Consequently, this ground must be rejected as a new amparo proceeding; the initial submission must be severed, and a copy thereof, together with report O-404-2026-TAA and this decision, must be transmitted to case No. 24-018198-0007-CO for consideration as a claim of noncompliance. This referral does not establish personal liability for disobedience, an issue requiring the corresponding procedure and assessment.
The proceeding must be granted in part because of the proven delays in cases 019-25-01-TAA, 262-24-01-TAA, 171-25-03-TAA, and 243-04-02-TAA, as well as with respect to 066-22-03-TAA to the extent provided in Article 52 of the Law on Constitutional Jurisdiction. The orders are directed to those exercising the powers of presidency and management of the matters so that, within the scope of their authority, they take action and seek any necessary decisions from the collegial body. The granting of the proceeding concerns the duty to process and decide matters promptly. It does not require the complaints to be upheld, a particular penalty to be imposed, or indispensable evidence to be dispensed with.
The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the Chamber within a maximum period of thirty working days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at Session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 January 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at Session No. 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE
The proceeding is granted in part. Adriana Bejarano Alfaro, in her capacity as President of the Tribunal Ambiental Administrativo, and Ana María de Montserrat Gómez de la Fuente Quiñónez, in her capacity as Vice President and head of group 03, both of the Tribunal Ambiental Administrativo, or whoever holds those offices, are ordered to issue the appropriate instructions, promote the necessary agreements, and carry out the actions within their respective powers so that processing of cases 019-25-01-TAA, 262-24-01-TAA, and 171-25-03-TAA is advanced immediately; the pending reports are obtained through effective coordination and follow-up; and the legally appropriate final decision in each case is issued and communicated within SIX MONTHS from service of this judgment. With respect to case 243-04-02-TAA, they must take the actions within their powers so that the scheduled hearing is held on 5 November 2026, if it has not already taken place, and the final decision is issued and communicated within TWO MONTHS after that hearing.
All the foregoing must be carried out with due respect for due process and the parties’ right of defense. With respect to case 066-22-03-TAA, the proceeding is granted pursuant to Article 52 of the Law on Constitutional Jurisdiction. The respondent authorities are advised that, under Article 71 of the Law on Constitutional Jurisdiction, any person who disobeys an order issued in an amparo proceeding shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days. The State is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified in proceedings to enforce the judgment before the administrative-litigation jurisdiction. The proceeding is denied with respect to case 172-25-01-TAA. The ground concerning case 222-14-03-TAA is rejected as a new amparo proceeding; accordingly, the initial submission shall be severed, and a copy thereof, together with report O-404-2026-TAA and this decision, shall be transmitted to case 24-018198-0007-CO so that the claim may be considered as a submission alleging noncompliance with Judgment No. 2024-026420, issued at 9:35 a.m. on 13 September 2024.- Fernando Castillo V.
