SummaryResumen

The Constitutional Chamber (Sala Constitucional) granted the amparo application against the Municipality of Goicoechea because it had not acted diligently to determine which structures within the La Cangreja River protection zone predated the forest legislation and which were later, potentially unlawful works. Although aerial photographs from the Instituto Geográfico Nacional showed buildings in the area in 1963 and the Municipality invoked non-retroactivity when suspending removal or demolition measures, the Chamber found that this historical evidence did not establish that every current structure had the same status or automatically exempt them from inspection. It ordered the mayor, within one month after notification, to determine whether illegal structures exist in the protected area and, if so, to design within three months a plan addressing the unlawful encroachment. The Municipality was also ordered to pay costs and damages. Justice Garro Vargas dissented only as to the forum for enforcement and would place that phase before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda.

Key excerptExtracto clave

Accordingly, the Court does not find it established that the Municipality of Goicoechea acted diligently to distinguish between structures located within the La Cangreja River protection zone that were built before the Forestry Law took effect and those built subsequently in violation of the applicable rules. The application must therefore be granted as stated in the operative portion of this decision. The application is granted. Fernando Chavarría Quirós, in his capacity as mayor of Goicoechea, or whoever occupies that office in his place, is ordered to undertake the necessary coordination, adopt appropriate measures, and issue the corresponding orders within the scope of his authority so that, within no more than ONE MONTH from notification of this judgment, it is determined whether illegal structures are located within the La Cangreja River protection zone. In addition, if such structures exist, within no more than THREE MONTHS from notification of this decision, he shall design a plan to address the problem alleged by the amparo applicant concerning the unlawful encroachment upon the La Cangreja River protected zone.

Document Review Case: 26-029993-0007-CO Decision No. 2026036726 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 24 September 2026.

Amparo proceeding being processed under case number 26-029993-0007-CO, filed by [Name 001], identity card [Value 001], against the MUNICIPALIDAD DE GOICOECHEA.

Background:

  1. 1By a submission added to the digital case file on 18 August 2026, the applicant filed an amparo application. According to the order admitting the proceeding, the applicant states that: “The Municipalidad de Goicoechea has expressly stated that structures exist within the protection area of the La Cangreja River, located in Calle Blancos in that canton. The applicant maintains that those structures encroach upon the protection zone established in Article 33 of Ley Forestal. The applicant states that various residents have asked the municipality to adopt measures to protect the area and prevent construction that could affect the river channel. The applicant asserts that, despite being aware of the situation and the existing environmental harm, the respondent municipality has not taken the necessary steps to prevent encroachment upon the protected zone or restore its integrity. The applicant adds that the municipality allegedly stated that the interested parties had to visit its offices to arrange actions at the site, although the applicant believes that the municipal authorities are responsible for overseeing and protecting environmental protection areas. The applicant further indicates that, according to the information provided, the municipality merely referred a request to SINAC, while the structures apparently continue to occupy the protection zone. The applicant alleges that the municipal authorities’ inaction places the right to a healthy environment, as well as the safety of nearby communities, at risk because occupation and possible obstruction of the river channel could cause serious damage during the rainy season. The applicant therefore accuses the Municipalidad de Goicoechea of failing to take the actions necessary to restore and protect the La Cangreja River protection area. The applicant requests this Chamber’s intervention.”
  2. 2By a decision of the President of the Chamber issued at 10:58 a.m. on 28 August 2026, the protected party was ordered to cure a deficiency.
  3. 3By a submission added to the digital case file on 7 September 2026, Fernando Chavarría Quirós, acting in his capacity as mayor of Goicoechea, submitted an untimely report. He explains: “Contemporary constitutionalism is built upon the harmonious coordination of essential values that often come into apparent conflict, requiring the legal decision-maker to conduct a rigorous balancing and proportionality analysis. On the one hand, enshrinement of the right to a healthy and ecologically balanced environment, derived from Article 50 of our Political Constitution, is not exhausted by a merely programmatic declaration but is established as an optimization mandate that binds every component of the Public Administration across the board. From this doctrinal perspective, the natural environment is conceived as a diffuse and inalienable legally protected interest whose integrity is an indispensable prerequisite for the effectiveness of other fundamental rights, with the State and territorial corporate entities serving as the primary guarantors of its preservation against degrading anthropogenic forces.Nevertheless, this legitimate protective purpose concerning the ecosystem cannot operate in an axiological vacuum or be implemented with absolute disregard for the fundamental pillars upon which peaceful coexistence and certainty for persons subject to the Administration rest. The principle of legal certainty, doctrinally conceptualized as citizens’ predictable and legitimate expectation that their legal position will not be arbitrarily altered by public authority, constitutes the indispensable foundation upon which the rule of law is erected. This doctrinal category unquestionably includes the protection of acquired rights and respect for consolidated legal situations, which are direct manifestations of the prohibition against arbitrary state action. The most authoritative administrative-law scholarship has insisted that the effectiveness of public action cannot be achieved by destroying the governed population’s legitimate expectations. When a factual or legal condition has remained unchanged over time under a preexisting legal framework, its sudden removal by the Public Administration under the guise of subsequently arising environmental protection undermines the very foundations of the social compact. Accordingly, resolving tensions between urban-planning and environmental police powers and the inviolability of citizens’ property and residential spheres requires rejecting absolutist views. It is not legally viable to employ expansive environmental protection retroactively in an attempt to subject socio-structural realities that were completed and consolidated long before the restrictive legal framework took effect to contemporary regulatory standards. The municipality’s public-authority powers must stop where the constitutional order enshrines social peace through the stability of situations consolidated by the passage of time, creating an insurmountable boundary for the Administration’s punitive or demolition activities.REGARDING THE TECHNICAL AND HISTORICAL INVESTIGATION CONDUCTED BY THE MUNICIPAL DIRECTORATE OF ENGINEERING, OPERATIONS AND URBAN PLANNING. Administrative activity is mandatorily governed by the principle of substantive truth, which imposes upon public bodies an inescapable obligation to verify fully the facts underlying their decisions, going beyond the parties’ mere allegations. In the field of urban-planning and environmental law, this requirement assumes critical importance because the adoption of far-reaching police measures, such as the demolition of structures or eviction from properties, cannot rest on mere conjecture, suspicion, or presumptions of illegality. Legal scholarship agrees that adverse administrative acts require prior, rigorous, and exhaustive technical investigation supported by verifiable empirical evidence conclusively establishing the factual prerequisite authorizing the exercise of punitive powers or powers to restore lawful conditions.Absolute respect for the principle of legality and for adequate technical reasoning in urban-planning police acts has been a consistent theme in this Constitutional Court’s case law. The Constitutional Chamber has repeatedly held that the Administration violates the right to due process when it adopts burdensome determinations affecting private property or the right to housing without definitive, multidimensional technical reports that eliminate all doubt concerning the temporal and spatial framework of the alleged violation. In this regard, judgment number 40409-2025, issued by this Court at 9:43 a.m. on 5 December 2025, must be cited. That judgment analyzed in detail the invalidity of municipal demolition orders lacking a causal nexus duly established through scientific and historical evidence. In that decision, the Constitutional Chamber held emphatically: ‘... This Chamber considers that the Municipality is correct in asserting that recovery of forest protection zones and public areas does not necessarily require the opening of ordinary administrative proceedings with every stage of an administrative process because, when the encroachment is evident, the mere-verification mechanism (mera constatación) applies due to the protection regime established by Ley Forestal N° 7575, Article 33 (use restrictions). In such cases, the Administration verifies the objective violation and orders demolition to restore the legally protected interest, granting the affected parties a reasonable period. However, for “mere verification” to be constitutionally valid and not become arbitrary, it is a sine qua non requirement that the Administration possess absolute technical certainty concerning the encroachment when it issues the act. Verification means that the violation is ascertainable and certain ... The Municipality cannot order demolition based on an assumption of encroachment; it must first obtain the setback determination (alineamiento) from INVU and, once that technical document demonstrates that works exist within the protection zone, it may then apply the summary demolition procedure.’ The cited case-law standard establishes that the Administration cannot order the demolition of works based on a mere assumption of encroachment but must possess sufficient technical evidence to determine with certainty that the harm exists, the location of the protection zone, and the specific structures involved. In the case under review, the Municipalidad de Goicoechea did not remain inactive in response to the reported situation. On the contrary, the Municipal Directorate of Engineering, Operations and Urban Planning conducted a technical and historical investigation by analyzing graphic and cadastral information, including background information showing that structures had existed in the area for decades. That investigation constituted relevant administrative action to clarify the factual and temporal circumstances of the works before adopting a burdensome measure. In particular, the historical documentation prevented a finding, without further analysis, that all current structures were recently built or that their continued presence could automatically be treated as a contemporary violation. The municipal decision not to carry out a sudden demolition while the age, continuity, location, and possible alteration of the works were being verified is therefore consistent with the constitutional requirement of technical certainty before an irreversible measure is adopted.Consequently, the actions taken cannot be characterized as an absolute omission or arbitrary conduct, but rather as part of a technical fact-finding process intended to determine the structures’ current status and their possible impact on the protection zone. This does not relieve the Municipality of its duty to continue taking the steps necessary to delineate the protected area technically, identify any works located within it, and, where appropriate, adopt the corresponding administrative, preventive, or restorative measures, in observance of due process and the applicable legislation. REGARDING HISTORICAL VERIFICATION OF THE STRUCTURES’ PREEXISTENCE AND CONSOLIDATION THROUGH CARTOGRAPHIC RESOURCES OF THE INSTITUTO GEOGRÁFICO NACIONAL. Under the general theory of evidence as applied to public law, historical and scientific documentary evidence enjoys a presumption of suitability and objectivity that is practically insurmountable when it originates from specialized state bodies.Official aerial photographs and cartographic reconstructions are retrospective empirical-verification instruments that allow the legal decision-maker to establish with mathematical precision the factual reality of a territory at a specific time in the past. Doctrinally, the temporal consolidation of a factual situation produces a transformation of reality that the law cannot ignore; the peaceful and prolonged existence of infrastructure for more than six decades exceeds the category of mere administrative tolerance and enters the realm of consolidated realities requiring absolute respect from public authority arising later. This Court has accorded decisive evidentiary value to historical certifications and cartographic materials from the Instituto Geográfico Nacional in resolving disputes concerning encroachment upon protection zones or public-domain areas. The Constitutional Chamber has consistently determined that, where it is certain that a structure predates the restrictive environmental rule, as established through official historical technical evidence, ordering its destruction is legally untenable.A landmark judgment on this subject is judgment number 31791-2023, issued at 9:30 a.m. on 7 December 2023, in which the Court closely scrutinized the value of historical aerial photography as evidence that defeats environmental demolition powers. In that ruling, this Honorable Court held as follows: ‘... Concerning the issue of construction within the protected area of the Barreal Stream protection zone, an on-site inspection (inspección in situ) was conducted, followed by a meticulous geospatial analysis and the collection of cadastral data and cartographic representations pertaining to the locality at issue. These procedures led to a conclusion that deemed it essential to incorporate a sound historical perspective. For that purpose, special consideration was given to the aerial photograph provided by the Instituto Geográfico Nacional, dated 1965 (See Image 1). This visual material reliably demonstrated the existence of the urban settlement under review at that time, which preceded the enactment of Ley de Planificación Urbana number 4220.It should also be emphasized that this urban settlement was already fully established before that law was implemented. By virtue of the principles embedded in the legal framework, retroactive application of regulations is inconsistent with and contrary to the established legal foundations. Recognition and protection of the private-property right consolidated since earlier times are therefore reinforced ...’ Application of the cited case-law standard to the specific case demonstrates the relevance of the technical and historical investigation conducted by this Municipality’s Directorate of Engineering, Operations and Urban Planning. According to the report issued by Engineer Mario Iván Rojas Sánchez, in his capacity as Director of that office, official aerial images from 1963 and 1965 supplied by the Instituto Geográfico Nacional were examined, and structures were observed in the area near the Cangrejos Stream. This cartographic background constitutes objective technical evidence for establishing the apparent preexistence of certain structures and assessing whether the currently existing works correspond wholly or partially to structures already present at the site before certain urban-planning or environmental restrictions took effect. The relevance of that information is that it prevented automatically attributing the recent construction of all the works to the current owners or occupants without first analyzing their age, continuity, identity, and any subsequent expansions, reconstructions, or alterations. The Constitutional Chamber has recognized the importance of technical certainty before demolition is ordered. It has stated in that regard that, when the Administration uses the mere-verification mechanism, the encroachment must be objective, ascertainable, and certain, and demolition cannot be ordered based on a mere assumption.Similarly, in Voto N.° 31791-2023, the Constitutional Chamber reviewed a municipal technical report that incorporated, as an analytical element, a 1965 aerial photograph from the Instituto Geográfico Nacional, used to establish the historical existence of an urban settlement predating the enactment of Ley de Planificación Urbana. In the present case, the investigation conducted by the Directorate of Engineering, Operations and Urban Planning was not a merely formal action, but a measure intended to clarify the temporal and construction-related circumstances of the works before a burdensome and irreversible measure was adopted. The historical information obtained showed that it was not legally prudent to treat all structures as recent construction or to order their removal or demolition without first establishing which works preexisted, which may have been subsequently expanded or altered, and which, if any, were located within the protection zone under a current technical delineation.Accordingly, the municipal decision to suspend the implementation of eviction, removal, or demolition measures while the historical background was assessed was not the result of omission or negligence, but of the need to avoid irreversible administrative action without sufficient certainty concerning the structures’ age, identity, and location. This action is consistent with the duty to provide reasons, the principle of reasonableness, and the constitutional requirement that any demolition measure be based on technically established harm. This does not mean that the Municipality relinquished its oversight powers or that the structures must automatically be considered lawful or untouchable. More precisely, it means that any subsequent action must distinguish apparently preexisting works from any subsequent expansions, reconstructions, or structures and must also be based on a current technical delineation of the protection zone and specific identification of the structures potentially affected.REGARDING THE INABILITY TO IMPOSE SANCTIONS UNDER THE CONSTITUTIONAL PRINCIPLE OF NONRETROACTIVITY OF THE LAW. The principle of nonretroactivity of the law, elevated to fundamental status in Article 34 of the Costa Rican Political Constitution, constitutes one of the most formidable limits on the exercise of the State’s punitive and sanctioning powers. From the perspective of constitutional doctrine, this principle guarantees that legal rules operate exclusively prospectively, categorically prohibiting a new provision from reaching into the past to alter, impair, or extinguish acquired rights or legal situations perfected under the legal framework in force when they arose. In the specific fields of forestry and water law, restrictions imposing mandatory protection zones along the banks of watercourses constitute limitations on the right to property that cannot be given a retroactive expropriatory effect or serve as disguised confiscation without undermining the framework of the rule of law.The Constitutional Chamber has developed a robust and consistent line of case law concerning the scope and limits of Article 34 of the Political Constitution, specifying that subsequent forestry and environmental laws cannot be applied retroactively to the detriment of residential or construction-related situations consolidated before their enactment. This Court has held that, although the environmental interest is of superior rank, its temporal application must observe the unavoidable limits of the constitutional text. This was masterfully expressed in landmark judgment number 02345-2022, issued at 9:15 a.m. on 28 January 2022, in which the Chamber authoritatively resolved that forest-protection strips could not properly be applied retroactively to historical structures. In that judgment, this Constitutional Court reasoned as follows: ‘... As shown by the review of the aerial photograph for 2006, two structures existed on that property: one structure measuring four hundred eighty-nine square meters and another measuring approximately one hundred five square meters, which remained the situation until 2010.As part of the monitoring and oversight of construction activity in the canton, in 2019 the Urban Oversight Process conducted a drone survey that determined the existence of several structures in addition to those already present and also found a one-hundred-sixty-two-square-meter terrace on which, apparently, additional units were to be built. For that reason, the municipality undertook administrative proceedings for urban-planning violations, in this case the construction of structures without a permit ...’ Application of the constitutional principle of nonretroactivity to the specific case requires distinguishing apparently preexisting structures from any subsequent expansion, alteration, reconstruction, or new work. Article 34 of the Political Constitution provides that ‘no law shall be given retroactive effect to the detriment of any person or of that person’s acquired property rights or consolidated legal situations.’ In the present case, the technical report issued by Engineer Mario Iván Rojas Sánchez, in his capacity as Director of Engineering, Operations and Urban Planning of this Municipality, states that official aerial images from 1963 and 1965 supplied by the Instituto Geográfico Nacional show the existence of structures located less than ten meters from the Cangrejos Stream before Ley Forestal N.° 4465 of 1969 was enacted. This background constitutes relevant technical evidence for establishing the apparent preexistence of certain structures and assessing the temporal application of subsequent restrictions. Article 68(2) of Ley Forestal N.° 4465 established a minimum zone of ten meters on both sides of the banks of rivers, streams, or creeks where the terrain was flat, as well as a zone of fifty horizontal meters where the terrain was uneven. Accordingly, if certain structures had already been built before that provision took effect, it was not legally proper automatically to attribute a subsequent construction violation to them or order their demolition solely on the basis of retroactive application of that restriction. The historical information is not invoked as automatic proof that the structures are lawful or as a source of absolute immunity from all administrative action. Its relevance is that it prevented all the works from being treated as recent structures and required a distinction between structures apparently existing before 1969 and any subsequent expansions, reconstructions, alterations, or new buildings. The Constitutional Chamber has recognized that historical photographic evidence may be used as a comparative element to establish the existence of structures on a particular date. In judgment N.° 31791-2023, the Chamber reviewed a municipal technical report that assessed a 1965 aerial photograph from the Instituto Geográfico Nacional to determine the historical existence of an urban settlement predating the enactment of Ley de Planificación Urbana. Moreover, before ordering demolition, the Administration must possess sufficient technical certainty concerning the existence of the encroachment, the delineation of the protected zone, and specific identification of the structures potentially affected. The Constitutional Chamber has stated that the Municipality cannot order demolition based on a mere assumption of encroachment; rather, the harm must be objective, ascertainable, and certain. Consequently, the municipal decision to keep the implementation of removal, eviction, or demolition measures suspended while the cartographic and historical background was analyzed did not, by itself, constitute omission or negligence. On the contrary, it responded to the need to clarify the structures’ age, identity, development, and current location before adopting a burdensome and irreversible measure. This conclusion does not mean that the structures must automatically be considered lawful or that the Municipality relinquished its oversight powers. It means that any subsequent action must distinguish apparently preexisting works from any subsequent works and must also be based on a current technical delineation of the protection zone and specific identification of any structures located within it. It is therefore not legally admissible to attribute absolute inaction to the Municipality because it did not immediately carry out a demolition whose propriety depended on first resolving temporal, technical, and spatial issues. Suspension of the action constituted an administrative precaution intended to avoid retroactive application of a restriction and prevent the adoption of an irreversible measure without the technical certainty required by due process.CONCLUSION. A joint analysis of the factual, technical, and legal elements presented supports the conclusion that the Municipalidad de Goicoechea did not remain inactive in response to the reported situation. On the contrary, the Municipal Administration undertook oversight actions and initiated a technical and historical investigation through the Directorate of Engineering, Operations and Urban Planning to clarify the age, identity, development, and current location of the structures identified by the applicant. In particular, analysis of the official aerial images from 1963 and 1965 supplied by the Instituto Geográfico Nacional provided objective evidence concerning the apparent preexistence of structures in the area. That information does not, by itself, constitute an automatic declaration of legality or necessarily demonstrate that all current structures are identical to those appearing in the historical images. It did, however, prevent automatically attributing the recent construction of all the works to the current owners or occupants without distinguishing apparently preexisting structures from any subsequent expansions, reconstructions, alterations, or buildings. The investigation was also necessary before adopting a burdensome and irreversible measure such as removal or demolition. The Constitutional Chamber has stated that, when the Administration uses the mere-verification mechanism, the encroachment must be objective, ascertainable, and certain, and demolition cannot be ordered based on a mere assumption. In that context, the decision to keep the implementation of removal or demolition measures suspended while the technical and historical background was assessed did not result from disregard for environmental protection, but from the need to avoid irreversible administrative action without first possessing sufficient certainty concerning the structures’ age, identity, construction-related development, and location in relation to the protection zone.Such action is consistent with Article 34 of the Political Constitution because it prevented a subsequent restriction from being applied automatically to characterize as unlawful structures whose preexistence first had to be clarified. Nevertheless, the historical evidence does not absolutely exempt the works from any subsequent oversight or prevent the Municipality from continuing to exercise its authority regarding any duly established current expansions, reconstructions, new structures, or harmful effects. Accordingly, the municipal action cannot be characterized as an absolute omission or relinquishment of oversight powers. The Administration took specific steps intended to establish the temporal and spatial circumstances of the works before adopting an irreversible measure. If the applicant maintains that current environmental harm or subsequent construction exists, that circumstance must be individually identified and established through a contemporary technical assessment, without confusing it with the mere historical existence of structures in the area.Consequently, no constitutionally relevant omission attributable to the Municipality has been established merely because it temporarily suspended the removal or demolition process while the cartographic and technical background was analyzed. The suspension constituted a measure of administrative prudence intended to observe due process, avoid retroactive application of restrictions, and ensure that any subsequent action was based on a precise technical delineation and specific identification of the works potentially affected. RELIEF REQUESTED. On the basis of the reasons stated, I respectfully request that the Justices deem this report duly submitted under oath and the appropriate technical and institutional evidence duly offered, and that they enter judgment declaring this amparo proceeding DENIED in all respects.”
  4. 4A certification signed on 8 September 2026 by the acting secretary and Judicial Technician 3, both of the Constitutional Chamber, states: “Upon review, at 9:57 a.m. on 8 September 2026, of the record of documents received and this case file in the Costa Rican judicial-office management system, it did not appear that, from 02/09/2026 through 04/09/2026, the MAYOR OF GOICOECHEA submitted any pleading or document for the purpose of providing the report requested in the decision issued at 10:58 a.m. on 28 August 2026.”

I. PRELIMINARY ISSUE

Because the respondent authority failed to respond to the notice within the period established by this Court in the order admitting the sub lite matter, pursuant to Article 45 of Ley de la Jurisdicción Constitucional, the application shall be decided on the basis of the other submissions and evidence entered into the record.

II. SUBJECT MATTER OF THE APPLICATION

The applicant states that the Municipalidad de Goicoechea has acknowledged the existence of structures within the La Cangreja River protection area. The applicant explains that several residents have asked the local government to ensure respect for the aforementioned protection zone; nevertheless, no steps have been taken to ensure that the area remains free of structures. The applicant alleges that the municipal corporation supposedly sent an official letter to SINAC, but the structures encroaching upon the protection area remain in place. The applicant requests that the Municipalidad de Goicoechea be ordered to take the appropriate action to ensure that no structures remain in the protected area.

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter:

  • a)By memorandum MG-AG-DI-01815-2023 of 26 June 2023, the Director of Engineering, Operations and Urban Planning of the Municipalidad de Goicoechea stated:

“Regarding the report made (...) concerning encroachment upon the Cangrejos Stream protection zone in the district of Calle Blancos, located 50 meters east and 100 meters north of the former Canal 4, as referenced in your official letter MG-AG-02787-2023, you are advised that the existing residences at that location stand less than 10 meters from the bank of that stream, as is evident from plans SJ-340386-79, SJ-398377-79 and DJ-21207-1953. Ley Forestal 7575 was published in 1996, and Article 33 establishes 10.00-meter setbacks from rivers and irrigation ditches in urban areas. Nevertheless, this Directorate considers, subject to a better legal opinion, that the law cannot be applied retroactively and that legal proceedings therefore cannot be brought concerning structures existing along the banks of rivers and streams before that law.” (See documentary evidence).

  • b)By memorandum MG-AG-03085-2023 of 29 June 2023, the mayor of Goicoechea requested a legal opinion from the Legal Director concerning the matters stated in official letter MG-AG-DI-01815-2023. (See documentary evidence).
  • c)By official letter MG-AG-DI-2746-2023 of 21 September 2023, the Directorate of Engineering, Operations and Urban Planning of the Municipalidad de Goicoechea stated:

“In response to the communication bearing official-letter number MG-AG-3650-2023, which forwards the communication received by the mayor’s office on 26 July 2023 and signed by Mr. [Name 002], owner of property [Value 002], located in Calle Blancos, requesting a prompt response to the reports that led the Directorate of Engineering to serve notice for the Removal or demolition of an improperly situated structure, as he describes it, a notification process conducted in connection with the Cangreja Stream, located in the district of Calle Blancos, for the purpose of restoring river protection areas, an investigation of the area at issue has been conducted using graphic and cadastral resources, yielding the following results: 1. In accordance with the opinion issued by the Legal Directorate, it is important to emphasize that, although the current Ley Forestal, number 7575, dates from 1996, earlier regulatory provisions exist concerning the protection of zones adjacent to the channels of rivers, streams, and creeks. Specific reference is made to Ley Forestal number 4465 of 1969, which was repealed by Article 73 of Law number 7575. Article 68(2) of Ley 4465 specifically regulated protected areas along the banks of watercourses, providing: ‘Article 68.- The following are declared protection zones:

  • 1)Areas surrounding springs originating in hills, within a radius of two hundred meters, and one hundred meters if the springs originate on flat land.
  • 2)A minimum zone of ten meters on both sides of the banks of all rivers, streams, or creeks, whether permanent or not, if the terrain is flat, and fifty horizontal meters if the terrain is uneven.
  • 3)A zone of up to one hundred meters along the shores of natural and artificial lakes and reservoirs.
  • 4)The aquifer-recharge areas of springs whose waters are used for human consumption.’ (Original text). 2. Consistent with the inquiries made to the Instituto Geográfico Nacional (IGN), access was obtained to aerial images taken in 1963 and 1965 of the Cangrejos Stream area. These images show that structures located less than 10 meters from the bank of the Cangrejos Stream already existed in those years, demonstrating that this situation had become consolidated before Ley Forestal number 4465 of 1969 was enacted, as shown in the following image. 3. In light of the foregoing, it is considered that, because the structures predate the aforementioned forestry law and taking into account the principle of nonretroactivity of legislation, that law cannot be applied retroactively. In other words, it cannot affect past situations or impose penalties for actions occurring before it took effect. This principle is enshrined in Article 39 of the Political Constitution of Costa Rica, which provides: ‘The law shall not have retroactive effect except when expressly so provided and when beneficial to persons, provided that the manner of its implementation is determined in the act itself.’ In view of the foregoing, it has been decided to suspend the notification process because evidence of structures predating Ley Forestal has been identified, and, from a technical perspective, it is not considered appropriate to destabilize situations consolidated on many of the properties surrounding the Cangrejos Stream. Nevertheless, this decision remains subject to a better opinion from the Legal Directorate.” (Emphasis added). (See documentary evidence).
  • d)By an official letter received by the Municipalidad de Goicoechea on 14 June 2024, information was requested concerning the recovery of the protection area of the La Cangreja river or stream. (See documentary evidence).
  • e)By official letter MG-AG-DI-02177-2026 of 20 August 2026, the Directorate of Engineering, Operations and Urban Planning of the Municipalidad de Goicoechea states:

“(…) this Directorate had already issued a determination regarding the situation at issue in this amparo proceeding during 2023, as a result of the actions pursued in connection with the structures located near Quebrada Cangrejos. At that time, a technical investigation was conducted using graphic, cartographic, and cadastral information, including aerial photographs supplied by the Instituto Geográfico Nacional (IGN). As a result of that analysis, an aerial photograph from 1963 was obtained, in which it was possible to verify that the buildings existing in the area had already been constructed and consolidated by that date. This circumstance was expressly recorded in official letter MG-AG-DI-2746- 2023, dated 21 September 2023, addressed to the Office of the Mayor, as well as in official letter MG-AG-DI-2749-2023, bearing the same date, addressed to Mr. [Nombre 002]; those documents are attached as background materials for this opinion.

Those official letters stated that, although the forest legislation currently in force is Ley Forestal N.° 7575 of 1996, earlier provisions regulating the protection zones of watercourses already existed. Specifically, reference was made to Ley Forestal N.° 4465 of 1969, Article 68(2) of which established a minimum zone of ten meters on both sides of the banks of rivers, quebradas, or streams, whether permanent or not, when the land was flat, and fifty horizontal meters when the land was steep. Nevertheless, the historical evidence obtained from the Instituto Geográfico Nacional made it possible to establish that the structures under analysis already existed in 1963, that is, before the enactment of Ley Forestal N.° 4465 of 1969. Accordingly, through the aforementioned official letters issued in 2023, this Directorate concluded that it was not appropriate to apply the provisions of the forest legislation retroactively to structures that, according to the available cartographic evidence, had already been consolidated before that legislation entered into force.

That opinion was based, among other considerations, on the principle against retroactivity of laws, set forth in Article 34 of the Constitución Política, under which laws may not be applied retroactively to the detriment of vested rights or consolidated legal situations. Accordingly, in 2023 it was decided to suspend the notification process for removal or demolition that had initially been contemplated, precisely because of the historical evidence demonstrating that the buildings had existed since before the aforementioned forest regulations entered into force (…) this Directorate considers that the situation raised in this amparo proceeding was already the subject of technical and administrative analysis by this Municipality and that there is also documentary evidence from the Instituto Geográfico Nacional establishing that the buildings being challenged are more than sixty years old. Accordingly, from this Directorate’s strictly technical and urban-planning perspective, and subject to a contrary opinion from the Legal Directorate, it is not considered legally appropriate at this time to initiate proceedings for the removal or demolition of those buildings solely on the basis of the protection zone established by forest legislation enacted after their construction, because doing so would entail retroactively applying a regulatory provision to a building situation that had already been consolidated.” (Boldface added). (See documentary evidence).

  • f)On 1 September 2026, the respondent authority was served with the order admitting these proceedings. (See certificate of service).
  • g)The mayor of Goicoechea reports that: “The historical information is not invoked as automatic proof that the structures are lawful or as a source of absolute immunity from all administrative action. Its relevance lies in the fact that it precluded treating all the works as recent construction and required a distinction between structures that apparently existed before 1969 and any subsequent additions, reconstructions, modifications, or new buildings (…) This conclusion does not mean that the structures must automatically be considered lawful or that the Municipality has relinquished its oversight powers. It means that any subsequent action must distinguish between the apparently preexisting works and any later works, and must also be based on a current technical delineation of the protection zone and the specific identification of any structures that may be located within it.” (See report submitted).

IV. THE SPECIFIC CASE

In the case at hand, the amparo applicant states that the Municipalidad de Goicoechea has acknowledged the existence of structures within the protection area of Río la Cangreja. He explains that several residents have asked the local government to ensure compliance with the aforementioned protection zone; nevertheless, no action has been taken to ensure that the area remains free of structures. He alleges that the municipal government purportedly sent an official letter to SINAC, but the structures encroaching on the protection area remain. He requests that the Municipalidad de Goicoechea be ordered to take the appropriate action to ensure that there are no structures in the protected area.

The Court confirms that, in filing MG-AG-DI-01815-2023 of 26 June 2023, the Director of Engineering, Operations, and Urban Planning of the Municipalidad de Goicoechea stated: “In accordance with the contents of your official letter MG-AG-02787-2023 concerning the complaint filed (…) regarding encroachment upon the protection zone of Quebrada Cangrejos in the district of Calle Blancos, located 50 meters east and 100 meters north of the former Canal 4, you are hereby advised that the homes existing at that location are situated less than 10 meters from the bank of that quebrada, as is evident from plans SJ-340386-79, SJ-398377-79, and DJ-21207-1953. Ley Forestal 7575 was published in 1996, and Article 33 thereof establishes 10.00-meter setbacks from rivers and irrigation ditches in urban areas. Nevertheless, this Directorate considers, subject to a contrary legal opinion, that the law cannot be applied retroactively and that legal proceedings therefore cannot be brought in connection with structures existing on the banks of rivers and quebradas before that law.” Through filing MG-AG-03085-2023 of 29 June 2023, the mayor of Goicoechea requested that the Legal Director issue a legal opinion regarding the contents of official letter MG-AG-DI-01815-2023.

In official letter MG-AG-DI-2746-2023 of 21 September 2023, the Engineering, Operations, and Urban Planning Directorate of the Municipalidad de Goicoechea stated: “In response to the communication bearing official letter number MG-AG-3650-2023, which forwards the communication received by the Office of the Mayor on 26 July 2023, signed by Mr. [Nombre 002], owner of property [Valor 002], located in Calle Blancos, in which he requests a prompt response to the complaints that led the Engineering Directorate to serve a notice for the removal or demolition of an improperly situated structure, as he describes it, a notification process conducted in connection with Quebrada Cangreja, located in the district of Calle Blancos, for the purpose of restoring river protection areas, an investigation of the area in question has been conducted using graphic and cadastral resources, yielding the following results: 1.

In accordance with the opinion issued by the Legal Directorate, it is important to emphasize that, although the current Ley Forestal, number 7575, dates from 1996, earlier regulatory provisions exist concerning the protection of areas adjacent to the channels of rivers, quebradas, and streams. In particular, reference is made to Ley Forestal number 4465 of 1969, which was repealed by Article 73 of Law number 7575.

  • 2)A minimum zone of ten meters on both sides of the bank of every river, quebrada, or stream, whether permanent or not, if the land is flat, and fifty horizontal meters if the land is steep.
  • 3)A zone of up to one hundred meters along the banks of natural and artificial lakes and reservoirs.
  • 4)The aquifer recharge areas of springs whose waters are used for human consumption.’ (Original text). 2. Consistent with the inquiries submitted to the Instituto Geográfico Nacional (IGN), access has been obtained to aerial images taken in 1963 and 1965 corresponding to the Quebrada Cangrejos area. These images reveal that structures situated less than 10 meters from the bank of Quebrada Cangrejos already existed in those years, demonstrating that this situation had been consolidated before the enactment of Ley Forestal number 4465 of 1969, as shown in the following image. 3. In view of the foregoing, it is considered that, because the structures predate the aforementioned forest law and in light of the principle against retroactivity of legislation, that law cannot be applied retroactively. In other words, it cannot affect past situations or impose penalties for actions that occurred before it entered into force. This principle is enshrined in Article 39 of the Constitución Política de Costa Rica, which provides as follows: ‘The law shall have no retroactive effect unless expressly provided otherwise and in a manner beneficial to individuals, provided that the manner of its enforcement is determined in the act itself.’ In view of the foregoing, it has been decided to suspend the notification process because evidence has been identified of structures predating the Ley Forestal, and it is not considered appropriate, from a technical perspective, to destabilize consolidated situations on many of the properties surrounding Quebrada Cangrejos. Nevertheless, this decision is subject to a contrary opinion from the Legal Directorate.” (Emphasis supplied). By an official letter marked as received by the Municipalidad de Goicoechea on 14 June 2024, information was requested regarding the restoration of the protection area of the river or quebrada La Cangreja. In official letter MG-AG-DI-02177-2026 of 20 August 2026, the Engineering, Operations, and Urban Planning Directorate of the Municipalidad de Goicoechea states: “(…) this Directorate had already issued a determination regarding the situation at issue in this amparo proceeding during 2023, as a result of the actions pursued in connection with the structures located near Quebrada Cangrejos. The mayor of Goicoechea reports that: “The historical information is not invoked as automatic proof that the structures are lawful or as a source of absolute immunity from all administrative action. It means that any subsequent action must distinguish between the apparently preexisting works and any later works, and must also be based on a current technical delineation of the protection zone and the specific identification of any structures that may be located within it.” It should now be noted that, since at least June 2023, the Municipalidad de Goicoechea has acknowledged that structures exist less than 10 meters from Quebrada la Cangreja; however, it considered that because the Ley Forestal, which established the 10-meter setback area, was published after the structures were built, it could not be applied retroactively. In that regard, in official letter MG-AG-DI-2746-2023 of 21 September 2023, the Engineering, Operations, and Urban Planning Directorate of the Municipalidad de Goicoechea stated: “Consistent with the inquiries submitted to the Instituto Geográfico Nacional (IGN), access has been obtained to aerial images taken in 1963 and 1965 corresponding to the Quebrada Cangrejos area. These images reveal that structures situated less than 10 meters from the bank of Quebrada Cangrejos already existed in those years, demonstrating that this situation had been consolidated before the enactment of Ley Forestal number 4465 of 1969, as shown in the following image. 3. In view of the foregoing, it is considered that, because the structures predate the aforementioned forest law and in light of the principle against retroactivity of legislation, that law cannot be applied retroactively.” For that reason, the local government suspended the notification process for the demolition of the buildings located less than 10 meters from Río Cangreja. Nevertheless, it cannot be overlooked that the same filing stated that “it has been decided to suspend the notification process because evidence has been identified of structures predating the Ley Forestal, and it is not considered appropriate, from a technical perspective, to destabilize consolidated situations on many of the properties surrounding Quebrada Cangrejos.” Thus, although it is apparent that the respondent local government considers that there are structures less than 10 meters from the aforementioned quebrada and that the setback area prescribed by the Ley Forestal would not apply to them because they were built before that law entered into force, it is equally true that it has not been demonstrated that all buildings in the area are in the same circumstances. In this regard, the explanation provided by the mayor of Goicoechea is significant, namely: “The historical information is not invoked as automatic proof that the structures are lawful or as a source of absolute immunity from all administrative action. It means that any subsequent action must distinguish between the apparently preexisting works and any later works, and must also be based on a current technical delineation of the protection zone and the specific identification of any structures that may be located within it.” (Emphasis added).

Accordingly, the Court does not consider it demonstrated that the Municipalidad de Goicoechea acted diligently to distinguish the structures located within the protection area of Río la Cangreja that were built before the Ley Forestal entered into force from those built subsequently in violation of the applicable regulations. The amparo must therefore be granted as set forth in the operative portion of this decision.

V. DISSENTING OPINION OF JUSTICE GARRO VARGAS REGARDING ENFORCEMENT OF THE JUDGMENT

I dissent with respect to the enforcement of the judgment and would order, pursuant to Art. 56 of the Ley de la Jurisdicción Constitucional (LJC), that enforcement be assigned to the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda.

Enforcement of the orders issued by the Constitutional Chamber (Sala Constitucional) is, in principle, to be supervised by this same jurisdiction. That provision, however, establishes exceptional circumstances in which this Court may order that enforcement of the judgment be assigned to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa):

“Art. 56. Enforcement of judgments falls to the Sala Constitucional, except with respect to the calculation and payment of compensation and monetary liabilities, or such other matters as the Chamber itself considers appropriate, in which case enforcement shall take place through administrative-litigation proceedings under the judgment-enforcement procedure prescribed by the law governing that jurisdiction.” (Emphasis does not appear in the original).

It should be recalled that the bill through which the LJC was debated originally provided as follows:

“Art. 56. Judgments favorable to the amparo applicant shall be enforced through administrative-litigation proceedings under the judgment-enforcement procedure prescribed by the law governing that Jurisdiction.” (Emphasis does not appear in the original).

However, the text was amended by motion so that the provision would be consistent with Art. 153 of the Constitución Política, and the following explanation was given:

“THE SECRETARY:

Motion No. 68 (32-19) by Deputy Chacón Jiménez:

‘Article 57 (formerly 56): so that the text shall read as follows: “Enforcement of judgments falls to the Sala Constitucional, except with respect to the calculation and payment of compensation or monetary liabilities, or such other matters as the Chamber itself considers appropriate, in which case enforcement shall take place through administrative-litigation proceedings under the judgment-enforcement procedure prescribed by the law governing that jurisdiction.”’ THE PRESIDENT:

Is the motion as read open for discussion?

Dr. Piza Escalante:

Here there was a contradiction with the general proposition that courts enforce their own judgments, and it referred all enforcement to the Administrative-Litigation Jurisdiction; the other articles that permitted the Chamber to enforce them were therefore left unresolved.

Deputy Corrales Bolaños:

That portion says: ‘or such other matters as the Chamber itself considers appropriate…’; to what does that refer?

Dr. Piza Escalante:

The idea is that, during judgment-enforcement proceedings, the Chamber decides those matters that it considers to fall within its purview. Everything else it refers to administrative-litigation proceedings.

THE SECRETARY:

Is the motion considered to have been sufficiently debated?

THE PRESIDENT:

Debate concluded. Approved (unanimously, with five deputies present).” (sic). See records approving the LJC. Emphasis does not appear in the original).

It is clear from the foregoing that the LJC itself authorizes this Chamber to assess and decide whether all or some matters relating to enforcement of the judgment should be referred to the administrative-litigation jurisdiction.

In this specific case, given the nature of the orders being issued by this Court, I consider it appropriate to assign the enforcement phase of this matter to the administrative-litigation jurisdiction. This is because the regulations governing this constitutional jurisdiction do not provide suitable mechanisms for monitoring the orders set forth in this judgment, which involve highly complex technical matters.

By contrast, the provisions of the Código Procesal Contencioso-Administrativo regarding enforcement (Art. 155 et seq.) offer clear advantages, such as the possibility of requiring schedules, imposing fines, determining liability, supervising stages of compliance, and so forth. Therefore, pursuant to Art. 56 of the LJC, I consider that the enforcement phase should be conducted before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they have submitted any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, those items must be retrieved within no more than 30 business days after service of this judgment. The parties are advised that all materials not collected within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial” (approved by the Corte Plena in Article XXVI of session no. 27-11 of 22 August 2011 and published in Boletín Judicial no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Consejo Superior del Poder Judicial of 3 May 2012.

Therefore:

The amparo is granted. Fernando Chavarría Quirós, in his capacity as mayor of Goicoechea, or whoever holds that office in his stead, is ordered to undertake the necessary coordination, adopt appropriate measures, and issue the relevant orders within the scope of his authority so that, within no more than ONE MONTH after service of this judgment, it is determined whether unlawful structures exist within the protection area of Río la Cangreja. Furthermore, if such structures do exist, he shall, within no more than THREE MONTHS after service of this decision, design a plan to address the problem alleged by the amparo applicant concerning unlawful encroachment upon the protected zone of Río la Cangreja. This order is issued with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person is required to comply with or cause to be complied with, and who fails to comply with it or cause compliance with it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.

The Municipalidad de Goicoechea is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment through administrative-litigation proceedings. Justice Garro Vargas dissents regarding the forum for enforcement of the judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, would order that phase to be assigned to the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda. Notice shall be given.

I. CUESTIÓN PREVIA
