OutcomeResultado
The Chamber granted the amparo against the Ministry of Health and MOPT and ordered them to resolve the complaint definitively within one month, but denied it as to MINAE because the submission was not sent through an official receiving channel.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the amparo proceeding only against the Ministry of Health and the Ministry of Public Works and Transportation (MOPT) because they failed to act promptly on a complaint filed on 29 April 2026 concerning the irregular occupation of State-owned public-domain property as a clandestine storage site for vehicles, scrap, and waste, creating contamination and disease-vector risks. Although MOPT opened an administrative file and both institutions later conducted inspections and issued sanitary and eviction orders, the decisive measures occurred after notice that the amparo had been admitted. Because those orders were still within their compliance periods, the Chamber ordered both ministries to take the measures necessary to resolve the complaint definitively within one month, ordered the State to pay costs and resulting damages, and warned of the consequences of noncompliance. The amparo was denied as to MINAE because the complaint had been sent to an email address that was not an official channel for receiving such submissions.

Accordingly, the amparo must be granted only against the Ministry of Health and the Ministry of Public Works and Transportation for the following reasons: (a) it is determined that the corresponding complaint was sent to the email account ars.naranjo@misalud.go.cr on 29 April 2026; however, it was not until 13 July 2026 that the health authorities—the Ministry of Health—conducted an inspection of the site. The evidence shows that these actions resulted from notice, on 7 July 2026, of the decision admitting this amparo, since no reasons were given for the failure to address the complaint earlier; and (b) similarly, although MOPT opened the corresponding administrative proceeding, it was not until 15 July 2026—following notice that this amparo had been admitted—that it inspected the site and served the decision ordering eviction from the public-domain property at issue. On that basis, given that the respondent authorities issued a series of administrative orders—a sanitary order and an order to vacate public-domain property—concerning the reported property, which remain within their compliance periods, the proper course is to grant the amparo on the terms stated in the operative portion so as to provide a definitive solution to the reported problem. Lastly, and without prejudice to the foregoing, no acts or omissions by the Ministry of Environment and Energy are observed that would warrant this Chamber's intervention, because the allegedly unanswered request was sent through a channel that is not an official mechanism of the respondent authority for receiving that type of submission.

Amparo proceeding processed under case file number 26-023853-0007-CO, filed by [Name 001], identity card [Value 001], against the MINISTRY OF ENVIRONMENT AND ENERGY, MINISTRY OF PUBLIC WORKS AND TRANSPORTATION, and MINISTRY OF HEALTH.
Background:
Justice Hess Herrera writes the opinion; and, Reasons:
Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and effective proceedings—it must be clarified that, since judgment No. 2008-02545 of 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa), with certain exceptions, matters involving whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, for issuing a final administrative act deciding an administrative proceeding—instituted ex officio or at a party’s request—or for hearing the applicable administrative remedies. This case presents precisely such an exception because it concerns a complaint filed with the Ministry of Health, the Ministry of Public Works and Transportation, and the Ministry of Environment and Energy regarding an environmental situation. Having clarified this point, the Court proceeds to decide the specific situation raised in this amparo proceeding.
Because Alexander Sánchez Cabo, Minister of Health, and Efraím Zeledón Leiva, Minister of Public Works and Transportation, failed to state in their sworn reports whether the email addresses ars.naranjo@misalud.go.cr, junior.araya@mopt.go.cr, and contraloria@mopt.go.cr, respectively, are designated as official means of communication with the institutions they represent, this fact is deemed true, and the constitutionality of this matter shall be analyzed in accordance with Article 45 of the Ley de la Jurisdicción Constitucional.
III.SUBJECT MATTER OF THE APPLICATION.- The applicant states that on 29 April 2026 he reported to the respondent authorities the unlawful occupation of State-owned real property, identified as registered property [Value 002], located near National Route No. 1, Autopista Bernardo Soto, which is being used as an unauthorized storage site for scrap vehicles, explaining that the occupation creates significant environmental and health risks arising from the accumulation of waste and the possible proliferation of disease vectors. Nevertheless, as of the filing date of this application, more than two months had elapsed without the respondent authorities issuing any decision.
The following facts are deemed duly established and relevant to deciding this matter, either because they have been proven or because the respondent failed to address them as required by the initial order:
ACTIONS OF THE MINISTRY OF ENVIRONMENT AND ENERGY:
V.MERITS.- From the reports submitted by the representatives of the respondent authority—which are deemed to have been made under oath, subject to the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and from the body of evidence, it has been established that on 29 April 2026 the applicant sent to the email addresses ars.naranjo@misalud.go.cr, junior.araya@mopt.go.cr, contraloria@mopt.go.cr, dcalvo@minae.go.cr, [Name 001] wbrenes@elawf.com, a letter addressed to the Ministry of Environment and Energy, Ministry of Health, Ministry of Public Works and Transportation, and Dirección General de Ingeniería de Tránsito, stating, insofar as relevant: “(…) The unlawful occupation of land located in [...] and having the status of property in the public domain (bien demanial) has currently been verified. That property, registered as property number [Value 002], has been invaded by a private individual who, acting in complete disregard of the legal system, has transformed a public space into an unauthorized storage site for scrap vehicles, without any authorization, clearance, or operating permit to do so.
The seriousness of this occupation lies not only in the usurpation of State property, but also in the negative externalities that directly affect public health and social well-being. Because these vehicles have been dismantled and abandoned outdoors, sources of contamination and rapidly multiplying mosquito breeding sites responsible for the transmission of diseases have arisen. It is imperative to emphasize that this health risk is a real and current threat hanging over a population of older adults who live on the adjoining property. Because of their vulnerable status and the special protection guaranteed by our legal system, they are being forcibly exposed to contaminants and risks that the State has an unavoidable duty to mitigate. From the standpoint of the powers held by the Ministry of Public Works and Transportation and the Dirección General de Ingeniería de Tránsito, the presence of this metal waste and these vehicle structures within a setback and easement area of Route 1 constitutes a flagrant violation of the Ley General de Caminos Públicos.
Likewise, for the Ministry of Environment and Energy and the Ministry of Health, it is evident that this solid waste is being managed outside all health and environmental regulations, without the required clearance and permit mandated by the Ley Orgánica del Ambiente and the Ley General de la Salud for such activities. I therefore request that your authorities undertake the intervention required by law by performing the duties assigned to them by the legal system. It is imperative that the Ministry of Health issue the corresponding health orders, that the Ministry of Public Works and Transportation and the Dirección General de Ingeniería de Tránsito recover the invaded strip of land, and that the Ministry of Environment and Energy oversee the environmental damage caused. (…)” (sic)
Regarding the processing of that request, the following has been established: a) On 13 July 2026, the Área Rectora de Salud de Grecia conducted a health inspection and prepared technical report MS-DRRSCN-DARSG-IT-346-2026; in view of the findings, Health Order MS-DRRSCN-DARSG-OS-97-2026 was issued to Mr. [Name 002], in his capacity as occupant of the State-owned land and the person responsible for the waste found there. That instrument ordered him to: 1. Remove from the property all scrap vehicles, vehicles in a state of abandonment, tires, automotive parts, and other waste accumulated under his responsibility. 2. Dispose of that waste through an authorized waste manager or in accordance with the mechanisms established by the regulations in force. 3. Eliminate conditions conducive to water accumulation and the formation of vector breeding sites. 4. Refrain from depositing waste, end-of-life vehicles, or discarded materials on the property again.
A period of thirty business days from notification was established for compliance with the order, after which a follow-up inspection must be conducted. Likewise, because the situation is occurring on real property owned by the State and allocated to the Proyecto Corredor San José-San Ramón, the matter was brought to the attention of the Viceministerio de Infraestructura of the Ministry of Public Works and Transportation for action within its authority; and b) For its part, the Ministry of Public Works and Transportation ordered the opening of administrative file N° 2026-147-D that same day, and on 04 May 2026 it informed the applicant that the submitted documentation would be assessed and the corresponding administrative procedure determined. Subsequently, on 14 July 2026, the Departamento de Inspección Vial y Demoliciones issued decision DVOP-DI-DV-IVD-2026-051, ordering the premises to be vacated and the vehicles, structures, and other property unlawfully located within registered property [Value 002] to be removed, granting a non-extendable period of fifteen business days, with notice that otherwise the corresponding removal, demolition, and administrative seizure would be carried out in coordination with the Ministry of Public Security.
Similarly, on 15 July 2026, a field inspection was conducted, the reported occupation was verified, and administrative decision DVOP-DI-DV-IVD-2026-051 was personally served on the responsible party. Likewise, on 16 July 2026, the applicant was notified of the outcome of the actions taken and informed that the Departamento de Inspección Vial y Demoliciones would continue monitoring the proceeding until the property in the public domain had been effectively recovered.
Accordingly, the application must be granted solely against the Ministry of Health and the Ministry of Public Works and Transportation, for the following reasons: a) It is determined that the corresponding complaint was sent to the email account ars.naranjo@misalud.go.cr on 29 April 2026; however, it was not until 13 July 2026 that the health authorities—the Ministry of Health—conducted a site inspection. The evidence shows that those actions resulted from notification, on 07 July 2026, of the order admitting this amparo proceeding, because no reasons are stated as to why the complaint was not addressed earlier; and b) Similarly, although MOPT opened the corresponding administrative proceeding, it was not until 15 July 2026—following notification of the order admitting this amparo proceeding—that it inspected the site and served the decision ordering that the property in the public domain at issue in this proceeding be vacated. Based on the foregoing, because the respondent authorities issued a series of administrative orders—a health order and an order to vacate property in the public domain—concerning the reported property, and the periods for compliance with those orders have not yet expired, the application must be granted on the terms stated in the operative portion in order to provide a definitive resolution to the reported problem.
VI.Lastly, and without prejudice to the foregoing, no action or omission by the Ministry of Environment and Energy is apparent that would warrant this Chamber’s intervention, because the request alleged to have gone unanswered was sent to an address that is not an official means through which the respondent authority receives such requests.
I have supported this Court’s position that, when a person seeking judicial protection alleges a violation of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the Administrative-Litigation Courts rather than by this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding established in Article 32 of the Ley de la Jurisdicción Constitucional, in connection with Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s physical acts, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court must modify its body of precedent, as Article 7 of its Law grants it exclusive authority to define its own jurisdiction.
Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances and that may be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 of 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding legal provisions, based on a logical, systemic, and purposive interpretation of the legal system.
This Chamber must advise the applicant that, if any document has been submitted, whether on paper, as well as objects or evidence stored on any additional device or by electronic, computer, magnetic, optical, telematic, or new-technology media, such items must be collected from the Court within 30 business days after receipt of notice of this judgment; otherwise, all such material will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:
The application is granted solely against the Ministry of Health and the Ministry of Public Works and Transportation. Alexander Sánchez Cabo, Minister of Health, and Efraím Zeledón Leiva, Minister of Public Works and Transportation, or whoever may hold those positions in their stead, are ordered to issue, within the scope of their powers, the orders necessary for the complaint filed by the applicant on 29 April 2026 to be definitively resolved as appropriate, within ONE MONTH from notification of this judgment. The respondents are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that the person must comply with or cause to be complied with and fails to do so shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the facts on which this declaration is based, which shall be quantified in proceedings to enforce the judgment before the administrative-litigation jurisdiction. As to the Ministry of Environment and Energy, the application is denied. Justice Castillo Víquez files a note. Let notice be given.- Fernando Castillo V.

- Fernando Castillo V.
