Amparo application filed by [Nombre 001], identity card [Valor 001], against the CONSEJO DE TRANSPORTE PÚBLICO (CTP).

Background:

  1. 1By a written submission received through the Chamber’s Online Services on 1 May 2026, the applicant files an amparo application against the Consejo de Transporte Público. She states that, since 2020, residents of Calle Las Rusias, in Granadilla Norte de Curridabat, have reported violations by Autotransportes Cesmag S.A., operator of route no. 50. She asserts that the buses use the public road as an unauthorized terminal, parking area, and maneuvering point. She indicates that the vehicles remain with their engines running for prolonged periods, make improper turns, and produce noise, emissions, and risks to residents’ health, safety, and quality of life. She notes that the Chamber had already considered the issue in case files 21-015939-0007-CO and 24-003401-0007-CO. She explains that the CTP issued orders requiring the company to comply with the operating plan, stop using Calle Las Rusias as a terminal stop, and turn off the engines when boarding or alighting took more than three minutes.Nevertheless, she maintains that the violations continued. She adds that, on 31 August 2025, she filed a new complaint through the official grievances module. She requested definitive revocation of the use of the location, the opening of sanctioning proceedings, and coordination with other institutions.   2. 2By resolution issued at 21:46 on 4 June 2026, the proceeding was admitted and a report was requested from the executive director of the Consejo de Transporte Público.
  3. 3In a written submission received by the Chamber’s Secretariat on 10 June 2026, Sidia María Cerdas Ruiz, in her capacity as judicial representative of the Consejo de Transporte Público, reports under oath. She explains that she serves in that capacity while the person to hold the Executive Directorate is appointed, pursuant to the agreement adopted under Article 7.1 of ordinary session 28-2026 of 23 April 2026. She indicates that the Department of Inspection and Control issued official letter CTP-DT-DIC-CA-0151-2026 of 9 June 2026, addressed to the institution’s legal counsel, to report that the Technical Directorate had responded to the user by means of official letter CTP-DT-CA-0242-2026, issued that same date. She states that the latter letter was sent to the contact method indicated by the applicant. She explains that, regarding the closure ordered by official letter CTP-DT-DIC-ADD-1320-2025, the Administration reported that the company responded to the complaint on 16 September 2025 and that the applicant did not raise an objection within the three-business-day period, so the matter was closed.She adds that a review of the Department of Engineering’s records found no request to modify the route or establish a terminal stop on Calle Las Rusias for route no. 50. For that reason, the user was told that, if she required a modification, she had to submit a formal request to the Document Reception Office. She reports that random inspections would be carried out at the site. Their results would be sent to the Board of Directors and subsequently communicated. She specifies that, at that time, the CTP did not have a constituted Board of Directors, so matters referred to it would be considered when sessions resumed. She adds that requests for continuous oversight and the opening of sanctioning proceedings would be subject to the results of the study and subsequent consideration by the Board of Directors. She indicates that the coordination request would be sent to the institutions and police bodies identified by the applicant, according to their respective powers.The company would also be reminded that it must keep its engines off when parking exceeds three minutes. She maintains that the remaining matters did not fall within the CTP’s remit. She concludes that the institution received, processed, and communicated the matters within its sphere of authority. She asserts that there is no current omission and that the requests made in the amparo came to the CTP’s attention when the application was served. She asks that the proceeding be closed and the application denied.
  4. 4By a written submission received through the Chamber’s Online Services on 15 June 2026, the applicant argues that the CTP only establishes that a formal response was issued, not that the reported conduct ceased. She notes that no recent inspection records, photographs, videos, logs, identification of vehicles, verified schedules, or current technical reports were submitted. She emphasizes that the agreement communicated on 7 October 2021 had already ordered the company to comply with the operating plan and not to use Calle Las Rusias as a terminal stop. She asserts that the agreement also provided for referring the matter to the Directorate of Legal Affairs if the violations persisted. She maintains that the absence of an administrative challenge to the closure does not show that the conduct ceased or eliminate the duty to oversee subsequent or ongoing conduct. She adds that the assertion that no authorized terminal exists on Calle Las Rusias confirms the basis of her complaint. She specifies that the announced inspections lack a date, method, responsible persons, and documentation process. She also rejects the claim that the absence of a Board of Directors justifies postponing technical measures, since the CTP itself adopted measures to ensure institutional continuity. She reiterates her request that immediate, verifiable, and documented measures be ordered.
  5. 5In the conduct of the proceeding, the legal requirements have been observed.

Drafted by Justice Araya García; and, Reasons:

I.Preliminary matter. Before analyzing the merits of the allegation—concerning the alleged violation of the right to a prompt and duly completed proceeding—it must be clarified that, since judgment No. 2008-02545 of 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits set by the Ley General de la Administración Pública (Articles 261 and 325) or by sectoral laws for special administrative proceedings, in order to issue a final act in an administrative proceeding—initiated on the administration’s own motion or at the request of a party—or to hear the applicable administrative appeals.

In this case, one of those exceptional situations arises, since the applicant complains of the failure to effectively and promptly resolve a complaint concerning noise, vibrations, gas emissions, and risks to residents, with possible effects on their health, safety, and quality of life, a matter directly linked to protection of the right to a healthy and ecologically balanced environment.

II.Subject of the application. The applicant alleges that Autotransportes Cesmag S.A., operator of route no. 50, continues to use Calle Las Rusias as an unauthorized terminal, parking area, and maneuvering point. She claims that the vehicles remain with their engines running for prolonged periods, make improper turns, and produce noise, vibrations, and gas emissions. She asserts that this conduct affects residents’ health, safety, quality of life, and right to a healthy and ecologically balanced environment. She also maintains that the Consejo de Transporte Público closed complaint no. 8119 without materially verifying that the conduct had ceased, without sufficiently assessing the evidence submitted, and without adopting effective measures, which she considers contrary to her right to effective administrative protection.

III.Proven facts. The following are deemed duly established and relevant to the decision in this matter:

  • a)On 7 October 2021, the Secretariat of Minutes of the Consejo de Transporte Público informed Autotransportes Cesmag S.A., residents of Calle Las Rusias, the Department of Inspection and Control, the Technical Directorate, the Department of Legal Affairs, the Dirección General de la Policía de Tránsito, and the Executive Directorate of the decision adopted by the Board of Directors under Article 3.1 of ordinary session 76-2021 of 5 October 2021. The communication was signed by the person serving as Secretary of Minutes. That agreement ordered Autotransportes Cesmag S.A. to comply with the operating plan for route no. 50, not to use Calle Las Rusias as a terminal stop, to respect the authorized routes, stops, and terminals, and to turn off the engines when boarding or alighting took more than three minutes. It also provided for referral to the Directorate of Legal Affairs if the conduct persisted and assigned the Traffic Police to carry out checks (see certification from the Secretariat of Minutes submitted to the digital case file).
  • b)On 26 September 2024, official letter CTP-DT-DIC-OF-0883-2024 was issued, signed by the head of the Department of Inspection and Control and the Technical Directorate of the CTP and addressed to the applicant. It reported that inspections on 22 and 23 August 2024 detected vehicles parked in unauthorized places, engines running for several minutes, and U-turns. It also indicated that, following a meeting with company representatives, inspections on 24 and 25 September 2024 detected no irregularities during the study period. The CTP deemed the order fulfilled and stated that it would continue monitoring (see official letter CTP-DT-DIC-OF-0883-2024 submitted to the digital case file).
  • c)On 30 March 2025, the applicant sent an email to several officials of the Consejo de Transporte Público. She reported that Autotransportes Cesmag S.A. buses continued to park on Calle Las Rusias, in Granadilla Norte de Curridabat, with their engines running at different times of day. In the absence of a response, on 25 May 2025 she reiterated the matter and requested that the reported situation be resolved (see emails submitted by the applicant to the digital case file).
  • d)On 27 May 2025, official letter CTP-DT-DIC-CA-0135-2025 was issued, signed by the head of the Department of Inspection and Control of the CTP and addressed to the applicant. She was informed that she had to file a new complaint through the official grievances module to ensure control and traceability of the matter (official letter CTP-DT-DIC-CA-0135-2025 submitted to the digital case file).
  • e)On 31 August 2025, the applicant filed complaint no. 8119 through the CTP’s official grievances module. She alleged that the unauthorized use of Calle Las Rusias as a terminal, improper maneuvers, noise, and emissions from vehicles with their engines running persisted. She requested definitive revocation of the use of the location, the opening of sanctioning proceedings, and coordination with other institutions (see the complaint transcribed in official letter CTP-DT-DIC-ADD-1320-2025).
  • f)On 16 September 2025, official letter CTP-DT-DIC-ADD-1320-2025 was issued by the Department of Inspection and Control of the CTP and addressed to the applicant and Autotransportes Cesmag S.A. The letter stated that the operator had responded, had taken the necessary actions, that the conduct had ended, and that no violation was ongoing. Complaint no. 8119 was deemed addressed and its closure was ordered. The applicant was given three business days to raise an objection (see official letter CTP-DT-DIC-ADD-1320-2025 submitted to the digital case file).
  • g)The resolution admitting this amparo application was served on the Consejo de Transporte Público on 5 June 2026 (see proof of service incorporated into the digital case file).
  • h)On 9 June 2026, official letter CTP-DT-CA-0242-2026 was issued, signed by the Technical Directorate and the head of the Department of Inspection and Control of the CTP and addressed to the applicant. It stated that the complaint remained closed because no timely objection had been filed. It reported that no route modification or authorized terminal on Calle Las Rusias was on record. It also announced random inspections, subsequent submission of their results to the Board of Directors, referral of the request to other institutions, and a reminder to the company to turn off its engines. The letter was sent by email that same day (see official letter CTP-DT-CA-0242-2026 and proof of transmission submitted by the respondent authority).

IV.Unproven fact. The following relevant fact is deemed not established for purposes of this decision:

Sole fact.—That the Consejo de Transporte Público carried out inspections between the filing of complaint no. 8119 and its closure, or produced a technical report documenting the material cessation of the reported conduct.

V.The specific case. Article 41 of the Political Constitution guarantees prompt and duly completed justice. This protection also includes the Administration’s duty to process and resolve matters substantively, consistently, and with reasons. When a complaint concerns a possible ongoing impairment of fundamental rights, the response cannot consist solely of compliance with a formality. There must be a reasonable assessment of the facts and evidence, as well as the measures necessary within the authority’s sphere of competence.

In this case, it is established that the applicant filed complaint no. 8119 through the official channel indicated to her by the CTP itself. She reported facts occurring after the September 2024 inspections and submitted material intended to show that they persisted. Despite this, official letter CTP-DT-DIC-ADD-1320-2025 concluded that the operator had addressed the facts and taken the necessary actions. It also declared that the conduct had ended. However, it did not identify the corrective measures that had been verified. Nor did it record a current inspection, specifically address the applicant’s evidence, or explain why the operator’s response sufficed to establish that the conduct had materially ceased.

The Administration knew that the problem had recurred. In 2021, its Board of Directors had ordered the company to comply with the operating plan and had provided for additional measures in the event of further violations. In August 2024, the CTP itself again confirmed unauthorized parking, engines running, and U-turns. Accordingly, in response to a new formal complaint filed in August 2025, it was not sufficient to forward it to the operator, receive its response, and close the matter without objectively verifying the material facts.

Official letter CTP-DT-CA-0242-2026 likewise does not establish that the violation was remedied. It was issued after notice that this amparo had been admitted. It announces future inspections but provides no results. Moreover, the assertion that no authorized terminal exists on Calle Las Rusias does not adequately address the complaint. The applicant did not request authorization to establish a terminal. She reported the actual use of an unauthorized location. Finally, the temporary absence of a Board of Directors did not prevent inspections from being carried out, findings from being documented, technical reports from being prepared, coordination with other institutions, or the preparation of any measures that might be appropriate.

Consequently, the closure of the complaint lacked sufficient substantive reasoning, and the response issued after this amparo was admitted did not remedy the violation. This infringed the applicant’s right to obtain a substantive, consistent, and duly reasoned administrative decision, protected by Article 41 of the Political Constitution.

The Chamber cannot substitute itself for the Consejo de Transporte Público in determining which technical, evidentiary, corrective, or sanctioning measures are appropriate. It is for that Administration to assess the facts and evidence, order any inquiries it deems necessary to ascertain the real facts, and issue a reasoned decision on each request made in the complaint.

VI.Note by Justice Castillo Víquez regarding prompt and duly completed administrative justice. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and duly completed justice in administrative proceedings, the legal dispute must be heard by the Administrative Litigation Courts and not by this Chamber. However, with the recent enactment of Law No. 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is subject to judicial protection through the amparo application provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material acts, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of precedent; under section 7 of its Law, this Court alone is responsible for defining its own jurisdiction.

Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo proceeding, in all other cases, for the reasons given by this Court (judgment No. 2008-02545 of 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with section 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable legal rules, based on a logical, systemic, and teleological interpretation of the legal order.

VII.Documents submitted to the case file. The parties are advised that if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the office within a maximum period of 30 business days from service of this judgment. Otherwise, any such material not retrieved within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session number 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session number 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The application is granted. Sidia María Cerdas Ruiz, in her capacity as judicial representative of the Consejo de Transporte Público, and whoever serves as Executive Director of that Council are ordered, within the scope of their respective powers, to coordinate what is necessary so that, within a maximum period of ONE MONTH from service of this judgment, the complaint filed by the applicant on 31 August 2025 is decided anew by means of a duly reasoned and consistent decision that comprehensively assesses the reported facts, the evidence submitted, and each of the requests made. The decision must be served on the applicant within the same period. The respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they must comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Consejo de Transporte Público is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be assessed in enforcement proceedings before the administrative-litigation jurisdiction. Justice Castillo Víquez enters a note. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cinco minutos del diecisiete de setiembre de dos mil veintiseis .

Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el CONSEJO DE TRANSPORTE PÚBLICO (CTP).

Resultando:

  1. 1Por escrito recibido mediante Gestión en Línea de la Sala el 1 de mayo de 2026, la recurrente interpone recurso de amparo contra el Consejo de Transporte Público. Manifiesta que, desde 2020, los vecinos de Calle Las Rusias, en Granadilla Norte de Curridabat, han denunciado incumplimientos de Autotransportes Cesmag S.A., operadora de la ruta no. 50. Afirma que los autobuses utilizan la vía pública como terminal, estacionamiento y punto de maniobras no autorizado. Indica que las unidades permanecen con los motores encendidos durante periodos prolongados, realizan giros indebidos y producen ruido, emisiones y riesgos para la salud, la seguridad y la calidad de vida de los vecinos. Señala que la Sala ya había conocido la problemática en los expedientes 21-015939-0007-CO y 24-003401-0007-CO. Expone que el CTP dictó órdenes para que la empresa respetara el esquema operativo, dejara de utilizar Calle Las Rusias como parada terminal y apagara los motores cuando el abordaje o desabordaje superara tres minutos.No obstante, sostiene que los incumplimientos continuaron. Agrega que, el 31 de agosto de 2025, presentó una nueva denuncia mediante el módulo oficial de inconformidades. Solicitó la revocatoria definitiva del uso del punto, la apertura de un procedimiento sancionatorio y la coordinación con otras instituciones. Acusa que, mediante oficio CTP-DT-DIC-ADD-1320-2025 del 16 de setiembre de 2025, la Administración archivó la denuncia no. 8119 con base en la respuesta del operador, sin efectuar una comprobación material, sostenida y contemporánea de los hechos. Alega que tampoco se atendieron de manera sustantiva sus solicitudes. Pide que se declare con lugar el recurso y que se ordenen medidas de inspección, fiscalización, coordinación y corrección efectivas.
  2. 2Mediante resolución de las 21:46 horas del 4 de junio de 2026, se dio curso al proceso y se solicitó informe al director ejecutivo del Consejo de Transporte Público.
  3. 3Por escrito recibido en la Secretaría de la Sala el 10 de junio de 2026, informa bajo juramento Sidia María Cerdas Ruiz, en condición de mandataria judicial del Consejo de Transporte Público. Explica que ejerce esa representación mientras se nombra a la persona titular de la Dirección Ejecutiva, conforme al acuerdo adoptado en el artículo 7.1 de la sesión ordinaria 28-2026 del 23 de abril de 2026. Indica que el Departamento de Inspección y Control emitió el oficio CTP-DT-DIC-CA-0151-2026 del 9 de junio de 2026, dirigido a la asesoría jurídica de la institución, para comunicar que la Dirección Técnica había respondido a la usuaria por medio del oficio CTP-DT-CA-0242-2026 de esa misma fecha. Señala que este último oficio fue notificado al medio indicado por la recurrente. Expone que, respecto del archivo dispuesto en el oficio CTP-DT-DIC-ADD-1320-2025, la Administración comunicó que la empresa contestó la denuncia el 16 de setiembre de 2025 y que la recurrente no formuló inconformidad dentro del plazo de tres días hábiles, por lo que la gestión quedó archivada.Añade que, al revisar los registros del Departamento de Ingeniería, no se encontró solicitud de modificación del recorrido ni de establecimiento de una parada terminal en Calle Las Rusias para la ruta no. 50. Por ese motivo, se indicó a la usuaria que, si requería una modificación, debía presentar una solicitud formal ante la Ventanilla de Recepción de Documentos. Informa que se realizarían inspecciones aleatorias en el sitio. Sus resultados serían remitidos a la Junta Directiva y posteriormente comunicados. Precisa que, en ese momento, el CTP no contaba con Junta Directiva conformada, por lo que los asuntos remitidos serían conocidos cuando se reanudaran las sesiones. Agrega que las peticiones de fiscalización continua y apertura de un procedimiento sancionatorio quedarían sujetas a los resultados del estudio y al posterior conocimiento de la Junta Directiva. Indica que la solicitud de coordinación sería remitida a las instituciones y cuerpos policiales señalados por la recurrente, según sus competencias.También se recordaría a la empresa que debe mantener apagados los motores cuando el estacionamiento supere tres minutos. Sostiene que los demás extremos no correspondían a requerimientos del CTP. Concluye que la institución conoció, tramitó y comunicó las gestiones dentro de su ámbito competencial. Afirma que no existe una omisión actual y que las pretensiones formuladas en el amparo llegaron a conocimiento del CTP con el traslado del recurso. Solicita que el proceso sea archivado y que el recurso se declare sin lugar.
  4. 4Por escrito recibido mediante Gestión en Línea de la Sala el 15 de junio de 2026, la recurrente aduce que el CTP únicamente acredita la emisión de una respuesta formal, pero no el cese de las conductas denunciadas. Señala que no se aportaron actas de inspección recientes, fotografías, videos, bitácoras, identificación de unidades, horarios verificados ni informes técnicos actuales. Destaca que el acuerdo comunicado el 7 de octubre de 2021 ya ordenó a la empresa ajustarse al esquema operativo y no utilizar Calle Las Rusias como parada terminal. Afirma que ese acuerdo también previó la remisión del asunto a la Dirección de Asuntos Jurídicos si persistían los incumplimientos. Sostiene que la ausencia de una impugnación administrativa contra el archivo no demuestra el cese de los hechos ni elimina el deber de fiscalizar conductas posteriores o continuadas. Agrega que la afirmación de que no existe una terminal autorizada en Calle Las Rusias confirma el fundamento de su denuncia. Precisa que las inspecciones anunciadas carecen de fecha, método, responsables y forma de documentación. También rechaza que la falta de Junta Directiva justifique la postergación de actuaciones técnicas, pues el propio CTP adoptó medidas para garantizar la continuidad institucional. Reitera su solicitud de que se dispongan actuaciones inmediatas, verificables y documentadas.
  5. 5En la substanciación del proceso se han observado las prescripciones de ley.

Redacta el Magistrado Araya García; y,

Considerando:

I.De previo. De previo a analizar el fondo del alegato –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 hrs. de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes.

Precisamente, en el sub lite se configura uno de esos supuestos excepcionales, pues la accionante reclama la falta de resolución efectiva y oportuna de una denuncia por ruido, vibraciones, emisiones de gases y riesgos para los vecinos, con posible incidencia en su salud, seguridad y calidad de vida, materia directamente vinculada con la tutela del derecho a un ambiente sano y ecológicamente equilibrado.

II.Objeto del recurso. La recurrente acusa que Autotransportes Cesmag S.A., operadora de la ruta no. 50, continúa utilizando Calle Las Rusias como terminal, estacionamiento y punto de maniobras no autorizado. Alega que las unidades permanecen con los motores encendidos durante periodos prolongados, realizan giros indebidos y producen ruido, vibraciones y emisiones de gases. Afirma que esas conductas afectan la salud, la seguridad, la calidad de vida y el derecho de los vecinos a un ambiente sano y ecológicamente equilibrado. Asimismo, sostiene que el Consejo de Transporte Público archivó la denuncia no. 8119 sin verificar materialmente el cese de los hechos, sin valorar suficientemente la prueba aportada y sin adoptar medidas efectivas, lo que estima contrario a su derecho a la tutela administrativa efectiva.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes:

  • a)El 7 de octubre de 2021, la Secretaría de Actas del Consejo de Transporte Público comunicó a Autotransportes Cesmag S.A., vecinos de Calle Las Rusias, Departamento de Inspección y Control, Dirección Técnica, Departamento de Asuntos Jurídicos, Dirección General de la Policía de Tránsito y Dirección Ejecutiva, lo resuelto por la Junta Directiva en el artículo 3.1 de la sesión ordinaria 76-2021 de 5 de octubre de 2021. La comunicación fue suscrita por quien ejercía la Secretaría de Actas. En ese acuerdo se ordenó a Autotransportes Cesmag S.A. ajustarse al esquema operativo de la ruta no. 50, no utilizar Calle Las Rusias como parada terminal, respetar los recorridos, paradas y terminales autorizados y apagar los motores cuando el abordaje o desabordaje superara tres minutos. Además, se previó la remisión a la Dirección de Asuntos Jurídicos si persistían las conductas y se comisionó a la Policía de Tránsito para efectuar verificaciones (ver certificación de la Secretaría de Actas aportada al expediente digital).
  • b)El 26 de setiembre de 2024 se emitió el oficio CTP-DT-DIC-OF-0883-2024, suscrito por la jefatura del Departamento de Inspección y Control y la Dirección Técnica del CTP, dirigido a la accionante. Se informó que las inspecciones de 22 y 23 de agosto de 2024 detectaron unidades estacionadas en lugares no autorizados, motores encendidos durante varios minutos y giros en “U”. También se indicó que, después de una reunión con representantes de la empresa, las inspecciones de 24 y 25 de setiembre de 2024 no detectaron anomalías durante el periodo de estudio. El CTP tuvo por atendido lo ordenado y manifestó que continuaría el seguimiento (ver oficio CTP-DT-DIC-OF-0883-2024 aportado al expediente digital).
  • c)El 30 de marzo de 2025, la recurrente remitió un correo electrónico a varias personas funcionarias del Consejo de Transporte Público. Informó que los autobuses de Autotransportes Cesmag S.A. continuaban estacionándose en Calle Las Rusias, en Granadilla Norte de Curridabat, con los motores encendidos a distintas horas del día. Ante la falta de respuesta, el 25 de mayo de 2025 reiteró la gestión y solicitó que se resolviera la situación denunciada (ver correos electrónicos aportados por la recurrente al expediente digital).
  • d)El 27 de mayo de 2025 se emitió el oficio CTP-DT-DIC-CA-0135-2025, suscrito por la jefatura del Departamento de Inspección y Control del CTP, dirigido a la accionante. Se le informó que debía presentar una nueva denuncia en el módulo oficial de inconformidades para garantizar el control y la trazabilidad de la gestión (oficio CTP-DT-DIC-CA-0135-2025 aportado al expediente digital).
  • e)El 31 de agosto de 2025, la recurrente presentó mediante el módulo oficial de inconformidades del CTP la denuncia no. 8119. Alegó que persistían el uso no autorizado de Calle Las Rusias como terminal, las maniobras indebidas, el ruido y las emisiones de unidades con motores encendidos. Solicitó la revocatoria definitiva del uso del punto, la apertura de un procedimiento sancionatorio y la coordinación con otras instituciones (ver denuncia transcrita en el oficio CTP-DT-DIC-ADD-1320-2025).
  • f)El 16 de setiembre de 2025 se emitió el oficio CTP-DT-DIC-ADD-1320-2025, proveniente del Departamento de Inspección y Control del CTP y dirigido a la accionante y a Autotransportes Cesmag S.A. En el acto se indicó que el operador había contestado, que había realizado las acciones necesarias, que la conducta había concluido y que no existía una infracción en curso. Se tuvo por atendida la denuncia no. 8119 y se dispuso su archivo. Se concedió a la recurrente un plazo de tres días hábiles para manifestar inconformidad (ver oficio CTP-DT-DIC-ADD-1320-2025 aportado al expediente digital).
  • g)La resolución que dio curso al presente recurso fue notificada al Consejo de Transporte Público el 5 de junio de 2026 (ver acta de notificación incorporada al expediente digital).
  • h)El 9 de junio de 2026 se emitió el oficio CTP-DT-CA-0242-2026, suscrito por la Dirección Técnica y la jefatura del Departamento de Inspección y Control del CTP, dirigido a la accionante. Se indicó que el archivo de la denuncia se mantuvo por falta de inconformidad oportuna. Se comunicó que no constaba una modificación del recorrido ni una terminal autorizada en Calle Las Rusias. Asimismo, se anunciaron inspecciones aleatorias, la posterior remisión de sus resultados a la Junta Directiva, el traslado de la petición a otras instituciones y un recordatorio a la empresa sobre el apagado de motores. El oficio fue remitido por correo electrónico ese mismo día (ver oficio CTP-DT-CA-0242-2026 y comprobante de envío aportados por la autoridad recurrida).

IV.Hecho no probado. Se estima como no demostrado el siguiente hecho, de relevancia para esta resolución:

Único.- El Consejo de Transporte Público hubiera efectuado inspecciones entre la presentación de la denuncia no. 8119 y su archivo, o un informe técnico que documente el cese material de las conductas denunciadas.

V.Sobre el caso concreto. El artículo 41 de la Constitución Política garantiza una justicia pronta y cumplida. Esta protección también comprende el deber de la Administración de tramitar y resolver las gestiones de forma sustancial, congruente y motivada. Cuando una denuncia se refiere a una posible afectación continuada de derechos fundamentales, la respuesta no puede agotarse en el cumplimiento de una formalidad. Debe existir una valoración razonable de los hechos y de la prueba, así como la adopción de las actuaciones que resulten necesarias dentro del ámbito competencial de la autoridad.

En el caso concreto, se constata que la recurrente presentó la denuncia no. 8119, por el canal oficial que el propio CTP le indicó. Denunció hechos posteriores a las inspecciones de setiembre de 2024 y aportó elementos dirigidos a demostrar su persistencia. Pese a ello, el oficio CTP-DT-DIC-ADD-1320-2025 concluyó que el operador había atendido los hechos y realizado las acciones necesarias. También declaró que la conducta había finalizado. Sin embargo, no individualizó las medidas correctivas verificadas. Tampoco consignó una inspección actual, confrontó de forma concreta la prueba de la denunciante ni explicó por qué la contestación del operador bastaba para acreditar el cese material.

La Administración conocía la reiteración de la problemática. En 2021, su Junta Directiva había ordenado a la empresa respetar el esquema operativo y había previsto actuaciones adicionales ante nuevos incumplimientos. En agosto de 2024, el propio CTP comprobó nuevamente estacionamientos no autorizados, motores encendidos y giros en “U”. Por ello, frente a una nueva denuncia formal presentada en agosto de 2025, no resultaba suficiente trasladarla al operador, recibir su respuesta y archivar el asunto sin una comprobación objetiva de la realidad material.

El oficio CTP-DT-CA-0242-2026 tampoco acredita la reparación de la lesión. Fue emitido después de notificado el curso de este amparo. Anuncia inspecciones futuras, pero no aporta resultados. Además, la afirmación de que no existe una terminal autorizada en Calle Las Rusias no responde adecuadamente a la denuncia. La accionante no solicitó autorización para establecer una terminal. Denunció el uso material de un punto no autorizado. Finalmente, la falta temporal de Junta Directiva no impedía realizar inspecciones, documentar hallazgos, elaborar informes técnicos, coordinar con otras instituciones ni preparar las actuaciones que correspondieran.

En consecuencia, el archivo de la denuncia careció de una fundamentación material suficiente y la respuesta emitida después del curso del amparo no subsanó la lesión. Lo anterior vulneró el derecho de la recurrente a obtener una resolución administrativa sustantiva, congruente y debidamente motivada, tutelado por el artículo 41 de la Constitución Política.

La Sala no puede sustituir al Consejo de Transporte Público en la determinación de las actuaciones técnicas, probatorias, correctivas o sancionatorias que procedan. Corresponde a esa Administración valorar los hechos y la prueba, disponer las diligencias que estime necesarias para alcanzar la verdad real y resolver de manera motivada cada una de las solicitudes formuladas en la denuncia.

VI.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.

A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Sidia María Cerdas Ruiz, en condición de mandataria judicial del Consejo de Transporte Público, y a quien ejerza la Dirección Ejecutiva de ese Consejo, que, dentro del ámbito de sus respectivas competencias, coordinen lo necesario para que, dentro del plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se resuelva nuevamente la denuncia presentada por la recurrente el 31 de agosto de 2025, mediante una resolución debidamente motivada y congruente, en la que se valoren integralmente los hechos denunciados, la prueba aportada y cada una de las solicitudes formuladas. Lo resuelto deberá ser notificado a la recurrente dentro del mismo plazo. Se advierte a la autoridad recurrida que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Consejo de Transporte Público al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
