Background:
“In judgment enforcement proceedings before the [...]), represented by attorney Bernal Gamboa Mora, and JORGE ARTURO LOBO SEGURA, represented by attorney Edgardo Vinicio Araya Sibaja, against THE STATE, represented by public prosecutor Susana Gabriela Fallas Cubero; INDUSTRIAS INFINITO S.A., represented by attorney Juan Carlos Hernández Jiménez; and the NATIONAL SYSTEM OF CONSERVATION AREAS (SINAC), represented by attorney Mary Paz Monge Jara. The association ASOCRUCITAS and the ASOCIACIÓN NORTE POR LA VIDA (UNOVIDA), represented by attorney Edgardo Vinicio Araya Sibaja, appear as intervening parties. The company REFORESTACIÓN INDUSTRIAL LOS NACIENTES S.A. The Administrative Litigation and Civil Treasury Court rejected the objection to jurisdiction based on subject matter raised by Industrias Infinito S.A. and ordered the corresponding proceedings in the matter to continue. Dissatisfied with that decision, defendant Industrias Infinito S.A. filed an objection, for which reason the case file was submitted to this Chamber for review.
REASONS
I.The plaintiffs brought proceedings to enforce judgment No. 4933-2010, issued by the Administrative Litigation and Civil Treasury Court in case No. 08-001282-1027-CA. The operative part of that judgment provided as follows: ‘The defendants Industrias Infinito, Sociedad Anónima, the State, and the National System of Conservation Areas are ordered to fully repair the environmental damage caused by the clear-cutting carried out on the property of Industrias Infinito, Sociedad Anónima, after decision No. 244-2008-SCH was issued. That damage shall be determined in the judgment enforcement phase, taking the following into account: the environmental damage suffered shall be determined by expert evidence, which must contain the recommendations necessary for the full repair of the affected area.’ Accordingly, the plaintiffs request that the judgment declare as follows: ‘RELIEF SOUGHT. 1.- We request that these judgment enforcement proceedings be granted in their entirety and, consequently, that the State be ordered to implement immediately, through the Ministry of Environment, Energy and Telecommunications and SINAC, the works and tasks necessary to repair and restore the affected area, in accordance with the findings of the expert evidence to be obtained in this matter. 2.- The State shall be ordered to indicate whether it has already created a client account within the Caja Única del Estado, into which the funds needed to carry out the works specified in the preceding item must be deposited.
If it has not been created, we request that the State be ordered to create it immediately and inform this Court of the corresponding account number and the bank where it was opened. 3.- The co-defendants shall be ordered to deposit into that account the amounts set by this Court, based on the expert evidence, to carry out the full repair of the affected area. This must be done no later than three business days after the judgment in these enforcement proceedings becomes final, with notice that refusal may result in the initiation of proceedings for disobedience of authority. 4.- The Ministry of Finance shall be ordered to make the corresponding budgetary provisions so that it can deposit the amount set by this Court, based on the expert evidence, for the full repair of the environmental damage caused in the affected area and payment of the personal and procedural costs of the ordinary proceedings and these enforcement proceedings.
In this regard, we also request that the Office of the Comptroller General of the Republic be ordered not to authorize the national budget for the year until the necessary appropriations have been included. 5. The defendants shall be ordered to pay seventeen million colones for APREFLOFAS’s attorney’s fees for the ordinary proceedings, plus 40% to be determined in relation to the damage assessed in the judgment enforcement proceedings, without prejudice to subsequent accountings. 6.- The defendants shall be ordered to pay twenty-five million colones for APREFLOFAS’s attorney’s fees for the cassation proceedings, plus 40% to be determined in relation to the damage assessed in the judgment enforcement proceedings, without prejudice to subsequent accountings. 7. Payment of personal costs, to be calculated based on the expert report, shall be ordered in favor of the attorney for Jorge Arturo Lobo Segura, and it shall be provided that statutory default interest will accrue if payment is not made once the corresponding judgment is final. 8.
Industrias Infinito Sociedad Anónima shall be ordered to cooperate with and allow all activities aimed at preparing the expert evidence ordered in the judgment and carrying out the repair ordered here. 9. We respectfully request that this Court, for the purpose of verifying that enforcement of the judgment has begun to the extent possible, require MINAE, specifically the NATIONAL ENVIRONMENTAL TECHNICAL SECRETARIAT and the Department of Geology and Mines, to report on the status of the proceedings that should have been initiated against the officials identified in the operative part of the judgment in this case. 10.- We also request that MINAE be asked to report on the status of cancellation, in the National Mining Registry, of the concession for the project in question. 11.- We respectfully request that the Public Prosecutor’s Office be asked to report on the individuals identified in the judgment as requiring investigation. 12.- We request that the Bar Association be asked to report on the proceedings that should have been initiated against attorney Sergio Artavia. 13.- We request that the Office of the Attorney General of the Republic be required to report and demonstrate whether the judgment has been published in full in the official gazette, La Gaceta. 14.- The co-defendants shall be ordered to pay both categories of costs in these enforcement proceedings.’ (According to the initial statement of claim visible in the electronic case file on 17/12/2015).
II.By decision No. 2025010055, issued at 11:21 a.m. on 22 October 2022, the Administrative Litigation and Civil Treasury Court rejected the objection to jurisdiction based on subject matter raised by Industrias Infinito S.A. and ordered the corresponding proceedings in the matter to continue. In relevant part, it stated: ‘... Industrias Infinito S.A. bases its argument on the existence of the proceedings conducted before the Constitutional Chamber under No. 19-0011277-0007-CO, enforcement of which is being handled in the Constitutional Jurisdiction. The judgment (sic) issued in those proceedings is similar to the judgment being enforced by this Court, which was issued in the proceedings on the merits that gave rise to these enforcement proceedings, and the company considers that enforcing both judgments together would ensure adequate planning and effective repair of the environmental damage caused.
In relation to this argument, although this Court understands the purpose of the representation of INDUSTRIAS INFINITO S.A., there is a rule establishing that judgments issued by this Court must be enforced by the body of judges it has for that purpose. There is therefore no way to decline jurisdiction conferred by Article 49 of the Constitution and by law—in this case, Title VIII of the Administrative Litigation Procedure Code, and specifically Articles 155, 156, and 157, among others, of that statute. There is no doubt that the legal jurisdiction to enforce judgments issued by the trial sections of this Court rests with the enforcement judges who are part of that same jurisdiction. In this specific case, this judge understands that the reasons advanced by the party concern matters of timing and convenience rather than law. However, since there is no legal basis for this Court to decline jurisdiction over the judgment enforcement proceedings, much less to assert a jurisdictional conflict with the Constitutional Chamber, the objection to jurisdiction must be rejected.’ On 31 October 2025, the attorney for Industrias Infinito S.A. filed an objection, arguing in summary: ‘...
In the view of this representation, the Administrative Litigation Court loses jurisdiction because of the doctrine of attraction in constitutional matters and the existence of another proceeding to enforce judgment No. 2021-020047, issued at 14:01 on 3 September 2021 by the same Constitutional Chamber. The object of enforcement in both proceedings is the same: both seek to restore the environment in the same area, although one has a broader scope than the other. The First Chamber has repeatedly held that: “... this Chamber has stressed that, to determine the competent jurisdiction in each particular case, one must consider: 1. The material or substantive content of the claim; and 2. The applicable legal regime. In this case, the material content of the claim, in light of Article 49 of the Constitution, gives the Administrative Litigation Jurisdiction the competence and authority to review the legality of administrative functions and their substantive conformity or consistency with the body of law.
As for the applicable legal regime, in decision No. 17900-2010, issued at 15:00 on 27 October 2010, the Constitutional Chamber stated: ‘... It should be emphasized that the constituent assembly opted for specialized jurisdictions by subject matter—at least up to a certain level—as a guarantee of sound decisions and a means of achieving the constitutional imperative of prompt and complete justice ...’ What has been quoted requires the analysis of the material content of the claim to be consistent with the applicable legal regime” (see, among others, judgment No. 000754-C-S1-2024, issued at 16:20 on 13 June 2024). Indeed, to determine the jurisdiction of a judicial body, one must review the applicable legal regime and the material content of the claim, and take the specialization of the subject matter into account. When jurisdiction is lost, the judicial body’s legal authority to continue hearing a specific matter lapses.
Such a loss may arise when a matter becomes ancillary to another case, which draws it into its jurisdiction, as explained below. A. Conflicting judgment enforcement proceedings: Two judgments issued by different judicial bodies have the same object: repairing environmental damage in the same place and at the same time. 1. Administrative Litigation Court judgment: In judicial case No. 08-001282-1027-CA, the Administrative Litigation Court issued judgment No. 4933-2010, whose operative part provided as follows: The defendants Industrias Infinito, Sociedad Anónima, the State, and the National System of Conservation Areas are ordered to fully repair the environmental damage caused by the clear-cutting carried out on the property of Industrias Infinito, Sociedad Anónima, after decision No. 244-2008-SCH was issued. That damage shall be determined in the judgment enforcement phase, taking the following into account: the environmental damage suffered shall be determined by expert evidence, which must contain the recommendations necessary for the full repair of the affected area.’ The judgment enforcement proceedings are still underway, and the repair plan has not yet been determined.
Constitutional Chamber judgment: In judicial case No. 19-011277-007-CO, this Chamber issued judgment No. 2021-020047, at 14:01 on 3 September 2021, whose operative part provided as follows: ‘Epsy Campbell Barr, in her capacity as First Vice President of the Republic and appointee of the Council of Government to oversee execution of the Development Plan for the Northern Zone; Andrea Meza Murillo, in her capacity as Minister of Environment and Energy; Daniel Salas Peraza, in his capacity as Minister of Health; Ricardo Morales Vargas, in his capacity as Head of the Health Services Standardization Unit in the Directorate of Environmental Human Health; and Michael Soto Rojas, in his capacity as Minister of Public Security—or those who may hold those offices in their place—are ordered to coordinate in establishing a medium-term plan, within a maximum of three months after notification of this judgment, that adopts the appropriate security measures to define a plan to contain illegal mining in the Crucitas area and, from that point on, to assess the scale and intensity of the environmental damage, conduct a topographical survey of the bodies of water, assess and sample mercury levels in water, soil, and sediment, establish a monitoring baseline, and adopt the appropriate technical measures to remediate the environmental damage.
A schedule of activities and categories of responsible authorities must be established so that, within a maximum of eighteen months after the security plan is finalized, the corresponding remedial actions are being carried out ...’ For the foregoing reasons, on 29 August 2025, the disputed matter was received by this Chamber.
III.This case concerns whether enforcement of a judgment issued by the Administrative Litigation and Civil Treasury Court must be heard by the same court that issued it or by the Constitutional Chamber because that Chamber issued another judgment on the same subject. In this particular case, various claims are made. In summary, the plaintiffs ask that the Ministry of Environment and Energy, the Ministry of Finance, the National System of Conservation Areas, the Office of the Comptroller General of the Republic, and the Office of the Attorney General of the Republic comply with various orders issued in a judgment in proceedings on the merits before the Administrative Litigation and Civil Treasury Court. They also seek payment by the State of compensation for the alleged loss and damage suffered as a result of conduct they consider contrary to the legal system, as well as payment of personal and procedural costs and adjustment of the amount ordered to be paid.
In response to these claims, one of the defendant companies raised an objection to jurisdiction based on subject matter, arguing that because the Constitutional Chamber had issued a judgment along the same lines as the relief sought in these proceedings, the Administrative Litigation Court must suspend the enforcement of its own judgment and order that it be referred to the Constitutional Chamber for consolidation. This is a jurisdictional conflict between the Administrative Litigation Jurisdiction and the Constitutional Jurisdiction. In this regard, Article 7 of the Constitutional Jurisdiction Act, a special provision, states: ‘Article 7. The Constitutional Chamber alone shall resolve matters concerning its own jurisdiction and hear related incidental and preliminary questions that arise before it.’ Accordingly, under the cited provisions, it is for the Constitutional Chamber of the Supreme Court of Justice to determine whether it has jurisdiction over these proceedings. Therefore, this Chamber declines jurisdiction to hear the jurisdictional conflict raised and orders that the matter be referred as soon as possible.
THEREFORE
This Chamber declines jurisdiction to hear the jurisdictional conflict raised and refers the matter to the Constitutional Chamber of the Supreme Court of Justice for the appropriate action.”

I.The First Chamber of the Supreme Court of Justice refers to this Constitutional Court an objection on jurisdictional grounds raised by the legal representative of Industrias Infinito S.A. in the judgment enforcement proceedings conducted in case No. 08-001282-1027-CA before the Administrative Litigation Court. The representative states that, in the proceedings conducted before the Constitutional Chamber under No. 19-0011277-0007-CO, judgment enforcement is already underway in the Constitutional Jurisdiction and concerns a judgment similar to judgment No. 4933-2010 being enforced by that court, issued in the proceedings on the merits that gave rise to those enforcement proceedings. The company’s representative considers that enforcing both judgments together would ensure adequate planning and effective repair of the environmental damage caused. In the representative’s view, the object of enforcement in both proceedings is the same, since both seek to restore the environment in the same area, although one has a broader scope than the other.
However, by decision No. 2025010055, issued at 11:21 a.m. on 22 October 2025, the Administrative Litigation and Civil Treasury Court rejected the objection to jurisdiction based on subject matter and ordered the corresponding proceedings to continue. An objection to that decision was then filed before the First Chamber. The matter is referred under Article 7 of the Constitutional Jurisdiction Act so that this Constitutional Chamber may determine whether the Administrative Litigation Jurisdiction should hear and resolve the matter.
II.This Court considers that the First Chamber of the Supreme Court of Justice is correct: it is for this Constitutional Court alone, to the exclusion of other bodies, to determine its own jurisdiction, under Articles 7 of the Constitutional Jurisdiction Act and 59(5) of the Organic Law of the Judiciary. This includes, of course, defining the scope of matters that may be protected through an amparo proceeding and distinguishing them from matters of ordinary legality. This Constitutional Court is indeed the highest and final interpreter of the Constitution and of its own jurisdiction (see, to the same effect, judgments Nos. 2014-19671 and 2014-19673, among others).
III.This Court notes, however, that this Chamber has already considered the situation raised here in case No. 19-011277-0007-CO, in response to a filing by the same representative of Industrias Infinito S.A. The matter was resolved by judgment No. 2025-22124, issued at 9:15 a.m. on 16 July 2025, as follows:
“I.- OBJECT OF THE FILING. The special judicial attorney for Industrias Infinito S.A. simultaneously submits a brief to the Administrative Litigation Court and this Chamber, seeking a declaration that the former lacks jurisdiction to continue enforcing a judgment dating from 2010 concerning repair of the environmental damage caused by clear-cutting on the company’s property. The attorney considers that the judgment issued by this Chamber concerning environmental damage caused by illegal mining subsumes that other judgment and that, accordingly, the Constitutional Chamber should continue enforcing both judgments.
Regarding the relief sought before this Chamber, it should be clarified that Industrias Infinito S.A. was not a party to this amparo application, nor were the conduct of that legal entity specifically assessed. The applicant therefore lacks standing to make claims in these proceedings. Second, it must be noted that, under Article 153 of the Constitution, the Judiciary is responsible for hearing civil, criminal, commercial, labor, and administrative litigation cases, as well as any others established by law, whatever their nature or the status of the persons involved; finally resolving those cases; and enforcing the resolutions it issues, with the assistance of the public force if necessary. Thus, each judicial instance is responsible for enforcing the judgments it has issued, and this Constitutional Court cannot assume jurisdiction to enforce judgments issued by other jurisdictions in the exercise of their respective legal and constitutional powers.
In this regard, this Chamber has repeatedly stated: ‘The applicant’s claim is inadmissible in this jurisdiction because the Chamber is not responsible for ensuring the enforcement of judicial decisions issued by other bodies. The matter complained of must therefore be resolved in the forum that heard the case, because under Article 153 of the Constitution, that body is responsible for finally resolving the matter and enforcing the decisions it issues, with the assistance of the public force if necessary.’ (Judgment No. 2008-006348. It follows that this Chamber may not assume responsibility for enforcing a final judgment issued in another jurisdiction concerning facts and conduct that, moreover, occurred long before those examined in this amparo proceeding, whose object was to protect fundamental rights and not to determine administrative liability.
Accordingly, the filing addressed to this Court is rejected.” (Emphasis does not appear in the original.)
In light of the foregoing, the applicant must abide by what this Court decided in that judgment, and each jurisdiction must enforce whatever is appropriate in accordance with the findings in each proceeding.
Therefore:

I .- La parte actora formuló proceso de ejecución de sentencia número 4933-2010 dictada por el Tribunal Contencioso Administrativo y Civil de Hacienda, en el expediente numero 08-001282-1027-CA, en la cual en su parte dispositiva resolvió lo siguiente: "Se condena a los demandados Industrias Infinito, Sociedad Anónima, al Estado y al Sistema Nacional de Áreas de Conservación a la reparación integral de los daños ambientales provocados por la tala rasa llevada a cabo en la propiedad de Industrias Infinito, Sociedad Anónima, con posterioridad al dictado de la resolución numero 244-2008-SCH, mismos que se determinarán en la fase de ejecución de sentencia, tomando en cuenta para tales efectos lo siguiente: El daño ambiental sufrido se determinará mediante prueba pericial, la cual deberá contener las recomendaciones necesarias para la reparación integral de la zona afectada.". En consecuencia, la parte actora solicita que en sentencia se declare los siguiente: "PETITORIA. 1.- Solicitamos que se declare con lugar en todos sus extremos la presente ejecución de sentencia y en consecuencia: Se ordene al Estado a implementar inmediatamente, mediante el Ministerio de Ambiente, Energía y Telecomunicaciones y el SINAC, las obras y labores de reparación y restauración de la zona afectada de conformidad con lo determinado mediante la prueba pericial que se recabará en este asunto. 2.- Se ordene al Estado indicar si ya cumplió con la creación de una cuenta cliente dentro de la Caja Única del Estado, en donde deberán ser depositados los montos de dinero necesarios para la ejecución de las obras indicadas en el punto anterior.
De no haberse creado pedimos que se ordene hacerlo inmediatamente, señalando a su Autoridad el número respectivo, así como entidad bancaria donde se hizo. 3.- Se ordene a los codemandados que procedan a depositar, en la mencionada cuenta, los montos de dinero fijados por Su Autoridad a partir de la prueba pericial, para llevar a cabo la reparación integral de la zona afectada. Lo anterior deberá hacerse a más tardar dentro de los tres días hábiles siguientes a la firmeza de la sentencia de esta ejecución bajo la prevención de que en caso de negativa se podrá iniciar proceso de desobediencia a la Autoridad. 4.- Se ordene al Ministerio de Hacienda llevar a cabo las previsiones presupuestarias correspondientes con el fin de hacer el depósito del dinero definido por este Tribunal, a partir de la prueba pericial, para la reparación integral de los daños ambientales causados en la zona afectada y las costas personales y procesales del proceso ordinario y de la presente ejecución.
En esta línea también pedimos que se ordene a la Contraloría General de la República que no autorice el presupuesto nacional del año hasta que se contemplen las partidas necesarias. 5. Se condene a los demandados al pago de diecisiete millones de colones por concepto de costas del abogado de APREFLOFAS, del trámite del proceso ordinario, más el 40% que se determinará respecto de los daños determinados en ejecución de sentencia, sin perjuicio de posteriores liquidaciones. 6.- Se condene a los demandados al pago de veinticinco millones de colones por concepto de costas del abogado de APREFLOFAS del trámite de la Casación, más el 40% que se determinara respecto de los daños determinados en ejecución de sentencia, sin perjuicio de posteriores liquidaciones. 7. Que se ordene el pago de las costas personales, que se liquidarán a partir del peritaje, a favor del abogado de Jorge Arturo Lobo Segura y que se disponga que se generarán intereses legales moratorios por el no pago una vez firme la sentencia respectiva. 8.
Se ordene a Industrias Infinito Sociedad Anónima colaborar y permitir todas las actividades tendientes a la creación de la prueba pericial ordenada en sentencia y a la reparación aquí ordenada. 9. Rogamos solicitar a su Autoridad, que a efecto de verificar que la sentencia se halla comenzado a ejecutar en lo posible, que se exija al MINAE, propiamente a la SECRETARIA TECNICA NACIONAL AMBIENTAL y al Departamento de Geología y Minas que informen sobre el estado de los órganos directores que se debieron haber iniciado contra los funcionarios que se señalaron en la parte dispositiva de la sentencia de este proceso. 10.- Asimismo, solicitamos que se pida informe al MINAE que detalle el estado de la cancelación de la concesión en el Registro Nacional Minero del proyecto de marras. 11.- Rogamos que se solicite informe al Ministerio Público respecto a las personas que se indicaron en la sentencia que deben ser investigados. 12.- Pedimos se solicite informe al Colegio de Abogados respecto procedimiento que se debió de haber iniciado contra el abogado Sergio Artavia. 13.-Pedimos se exija a la Procuraduría General de la República que informe y demuestre si ya se hizo la publicación integral de la sentencia en el Diario Oficial La Gaceta. 14.- Se condene a los codemandados al pago de ambas costas de esta ejecución.". (Según el escrito de demanda inicial visible en expediente electrónico 17/12/2015).
II.El Tribunal Contencioso Administrativo y Civil de Hacienda, mediante resolución número 2025010055 de las once horas con veintiún minutos del veintidós de octubre de dos mil veintidós, rechazó la excepción de incompetencia por materia alegada por Industrias Infinito S.A., y ordenó continuar con el trámite correspondiente del asunto, en lo conducente señaló: " ... Industrias Infinito S.A., basa su argumentación en la existencia del proceso tramitado ante la Sala Constitucional bajo el número 19-0011277-0007-CO, cuya ejecución se está tramitando en la Jurisdicción Constitucional, siendo que las sentencia (sic) dictada en dicho proceso guarda similitud con la sentencia que se ejecuta en este despacho y que fue dictada en el proceso de conocimiento que dio lugar a esta ejecución, al considerar que la ejecución conjunta de ambas sentencias garantiza una adecuada planificación y eficacia en la reparación del daño ambiental ocasionado.
En relación a esta argumentación si bien este Tribunal comprende el propósito de la representación de INDUSTRIAS INFINITO S.A., existe una norma que establece que la ejecución de las sentencias dictadas por el Tribunal deben ser ejecutadas por el cuerpo de jueces que para dichos efectos posee el Tribunal, por lo que no existe modo alguno de que se decline una competencia dada por la Constitución Política en su artículo 49 y la ley en este caso el Titulo VIII del Código Procesal Contencioso Administrativo y en específico los artículos 155, 156 y 157 entre otros, de dicha norma, sin que exista duda alguna que la competencia legal para ejecutar las sentencias dictadas por las secciones de juicio de este Tribunal recae en los jueces ejecutores que forman parte de la misma jurisdicción. Ahora bien, en el caso específico comprende esta juzgadora que las razones alegadas por la parte son más de oportunidad y conveniencia que legales, pero dado que no existe una razón jurídica que permita a este Tribunal declinar su competencia para conocer la ejecución de sentencia y mucho menos sostener un conflicto de competencia con la Sala Constitucional, lo que procede es el rechazo de la incompetencia alegada.".
El apoderado de Industrias Infinito S.A., el treinta y uno de octubre de dos mil veinticinco presentó inconformidad, en síntesis, indicó: "... A criterio de esta representación, la pérdida de competencia del Tribunal Contencioso Administrativo se origina en el fuero de atracción en materia constitucional y la existencia de otro proceso para la ejecución de la sentencia número 2021-020047 de las 14:01 horas del día 3 de setiembre del 2021 dictada por la misma Sala Constitucional. El objeto de ejecución en ambos procesos es el mismo pues se pretende en los dos restaurar ambientalmente una misma área, aunque una con mayor alcance que la otra. En forma reiterada ha sostenido la Sala Primera que: "... esta cámara ha insistido en que, para dilucidar la jurisdicción competente en cada case particular, se debe considerar; 1. El contenido material o sustancial de la pretensión y 2. El régimen jurídico aplicable.
En este caso, el contenido material de la pretensión, a la luz del numeral 49 de la Constitución Política, se le otorga a la jurisdicción Contencioso Administrativa la competencia y atribución de ejercer la fiscalización de la legalidad de la función administrativa, su conformidad sustancial o adecuación con el bloque de legalidad. En el caso del régimen jurídico aplicable, la Sala Constitucional en la resolución no. 17900-2010 de las 15 horas del 27 de octubre de 2010, indicó; " ... Es preciso resaltar que el constituyente opto (sic) por órdenes jurisdiccionales especializados por razón de la materia-por lo menos hasta cierta instancia-, como una garantía de acierto y un medio para el logro del imperativo constitucional de una justicia pronta y cumplida ... ", lo transcrito, obliga a que el análisis del contenido material de la pretensión sea congruente con el régimen jurídico aplicable" (ver entre otras, sentencia numero 000754-C-S1-2024, de las 16:20 horas del 13 de junio del 2024).
Efectivamente, para la definición de la competencia de un órgano jurisdiccional se debe revisar el régimen jurídico aplicable y el contenido material de la pretensión, y tomar en cuenta la especialidad de la materia. Con la pérdida de competencia, se desvanece la facultad legal del órgano jurisdiccional de seguir conociendo un asunto judicial especifico. Esta pérdida puede originarse cuando un asunto pasa a ser accesorio a otro caso, que lo atrae a su fuero según explico de seguido. A. Ejecución de sentencias en conflicto: Existen dos sentencias de órganos jurisdiccionales distintos que tienen el mismo objeto: reparar el daño ambiental en el mismo lugar y al mismo tiempo. 1. Sentencia del TCA: En el expediente judicial N° 08-001282-1027-CA el TCA dictó la sentencia N° 4933-2010, la cual en su parte dispositiva resolvió lo siguiente: Se condena a los demandados Industrias Infinito, Sociedad Anónima, al Estado y al Sistema Nacional de Áreas de Conservación a la reparación integral de los daños ambientales provocados por la tala rasa llevada a cabo en la propiedad de Industrias Infinito, Sociedad Anónima, con posterioridad al dictado de la resolución numero 244-2008-SCH, mismos que se determinarán en la fase de ejecución de sentencia, tomando en cuenta para tales efectos lo siguiente: El daño ambiental sufrido se determinará mediante prueba pericial, la cual deberá contener las recomendaciones necesarias para la reparación integral de la zona afectada.".
La ejecución de sentencia está aún en curso, no definiéndose aun el plan de reparación. Sentencia de la Sala Constitucional: En el expediente judicial número 19-011277-007-CO esta Sala dictó la sentencia número 2021-020047 de las 14:01 horas del día 3 de setiembre del 2021, la cual en la parte dispositiva resolvió lo siguiente: "Se les ordena a Epsy Campbell Barr en su condición de Primera Vicepresidenta de la República y designada por el Consejo de Gobierno para velar por la ejecución del Plan de Desarrollo de la Zona Norte, Andrea Meza Murillo en su condición de Ministra de Ambiente y Energía, Daniel Salas Peraza en su condición de Ministro de Salud, Ricardo Morales Vargas en su calidad de Jefe de la Unidad de Normalización de los Servicios de Salud en Sentencia de la Sala Constitucional: En el expediente judicial N° 19- 011277-007-CO esta Sala dictó la sentencia N° 2021-020047 de las 14:01 Ambiente Humano y a Michael Soto Rojas en su condición de Ministro de Seguridad Publica, o a quienes en su lugar desempeñen dichos cargos que, de forma coordinada, se establezca un plan a mediano plazo, máximo tres meses posteriores a la notificación de esta sentencia, en el que se tomen las medidas de seguridad que correspondan para que se defina un plan de contención para la minería ilegal en la zona crucitas y, a partir de ese momento, se realice una valoración de la magnitud e intensidad del daño ambiental, el levantamiento topográfico de los cuerpos de agua, la valoración y muestreos de los niveles de mercurio en agua, suelo y sedimentos, se establezca una línea base de seguimiento y se tomen las medidas técnicas que correspondan para remediar los daños ambientales.
De lo cual se debe establecer un cronograma de actividades y categorías de autoridades responsables para que, en el término máximo de dieciocho meses posteriores a la concreción del plan de seguridad, estén en cumplimiento las acciones remediales que correspondan ... ". En razón de lo anterior, el veintinueve de agosto de dos veinticinco, ingresó el asunto en conflicto ante esta Sala.
III .- En el presente caso, se discute si la ejecución de una sentencia emitida por el Tribunal Contencioso Administrativo y Civil de Hacienda la debe conocer el mismo tribunal que la emitió o la Sala Constitucional por existir otra sentencia sobre el mismo tema emitida por dicha Sala. En este asunto en particular, se solicitan diversas pretensiones, en síntesis, se solicita que el Ministerio de Ambiente y Energía, el Ministerio de Hacienda, el Sistema Nacional de Áreas de Conservación, la Contraloría General de la República y la Procuraduría General de la República cumplan con diversas órdenes emanadas de una sentencia dictada en un proceso de conocimiento por el Tribunal Contencioso Administrativo y Civil de Hacienda. Pretende, además, el pago de una indemnización por parte del Estado para resarcir los supuestos danos y perjuicios sufridos producto de las conductas que considera disconformes con el ordenamiento jurídico, así como el cobro de las costas personales, costas procesales e indexación del monto ordenado a pagar.
Ante tales pretensiones, una de las empresas demandadas presentó la excepción de incompetencia por la materia al considerar que, por existir una sentencia emitida por la Sala Constitucional que va en la misma línea de lo peticionado en este proceso, el Tribunal Contencioso Administrativo debe de paralizar el proceso de ejecución de su propia sentencia y debe ordenar su remisión a la Sala Constitucional para su acumulación. Se está ante un conflicto de competencia entre la Jurisdicción Contenciosa Administrativa y la Constitucional, al respecto, el artículo número siete de la Ley de la Jurisdicción Constitucional que es una norma que tiene carácter especial ordena: "Artículo 7. Le corresponde exclusivamente a la Sala Constitucional resolver sobre su propia competencia, así como conocer de las cuestiones incidentales que surjan ante ella y de las prejudiciales conexas.". En razón de lo anterior y de conformidad con la normativa citada, es a la Sala Constitucional de la Corte Suprema de Justicia la que debe definir si posee o no la competencia sobre este proceso, en consecuencia, declina esta Sala conocer del conflicto de competencia planteado y se ordena su remisión a la brevedad posible.
POR TANTO
Declina esta Sala conocer del conflicto de competencia planteado, por lo que se remite a la Sala Constitucional de la Corte Suprema de Justicia para lo que corresponda”.
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.La Sala Primera de la Corte Suprema de Justicia, remite a este Tribunal Constitucional una inconformidad por razones de competencia planteada por el representante legal de Industrias Infinito S.A., en el proceso de ejecución de sentencia tramitado en el expediente nro. 08-001282-1027-CA, ante el Tribunal Contencioso Administrativo, en la cual el gestionante señala que, bajo el proceso tramitado ante la Sala Constitucional número 19-0011277-0007-CO, ya se está tramitando en la Jurisdicción Constitucional una ejecución de sentencia, que guarda similitud con la sentencia nro. 4933-2010 que se ejecuta en ese despacho, dictada en el proceso de conocimiento que dio lugar a esa ejecución. El representante de esa empresa considera que la ejecución conjunta de ambas sentencias garantizaría una adecuada planificación y eficacia en la reparación del daño ambiental ocasionado. En su criterio, el objeto de ejecución en ambos procesos es el mismo, pues se pretende en los dos restaurar ambientalmente una misma área, aunque una con mayor alcance que la otra.
Sin embargo, el Tribunal Contencioso Administrativo y Civil de Hacienda, mediante resolución número 2025010055 de las 11:21 horas del 22 de octubre de 2025, rechazó la excepción de incompetencia por materia alegada y ordenó continuar con el trámite correspondiente, respecto de lo cual fue planteada una inconformidad ante la Sala Primera. Lo anterior se plantea conforme lo dispuesto en el ordinal 7 de la Ley de la Jurisdicción Constitucional, a los efectos de que esta Sala Constitucional defina, si el asunto debe conocerlo y resolverlo la jurisdicción contencioso-administrativa o no.
II.Considera este Tribunal, que lleva razón la Sala Primera de la Corte Suprema de Justicia, en cuanto a que corresponde a este Tribunal Constitucional definir de manera exclusiva y excluyente su propia competencia, conforme lo dispuesto en los ordinales 7 de la Ley de la Jurisdicción Constitucional y 59, inciso 5, de la Ley Orgánica del Poder Judicial. Lo que incluye, desde luego, deslindar el ámbito de las cuestiones amparables de las que son de mera legalidad. Ciertamente, este Tribunal Constitucional es el sumo y último intérprete de la Constitución, así como de sus competencias (véanse en igual sentido, las sentencias nros. 2014-19671 y 2014-19673, entre otras).
III.Ahora bien, advierte este Tribunal, que la situación aquí planteada ya fue objeto de conocimiento por parte de esta Sala en el expediente nro. 19-011277-0007-CO, ante la gestión planteada por el mismo representante de Industrias Infinito S.A., la cual fue resuelta mediante sentencia nro. 2025-22124, de las 9:15 horas del 16 de julio de 2025, en el siguiente sentido:
“I.- OBJETO DE LA GESTIÓN. El apoderado especial judicial de Industrias Infinito S.A. dirige un escrito simultáneamente ante el TCA y ante esta Sala con el propósito que se declare la incompetencia de aquel tribunal para continuar con la ejecución de una sentencia que data del año 2010 y relacionada con la reparación de los daños ambientales ocasionados en la finca de su propiedad producto de una tala rasa. Considera que la sentencia dictada por esta Sala relacionada con los daños ambientales provocados por la minería ilegal subsume aquella otra sentencia y que, por tanto, la Sala Constitucional debería continuar con la ejecución de ambas sentencias.
En relación con lo peticionado a esta Sala, conviene aclarar que Industrias Infinito S.A. no fue parte en este recurso de amparo, ni se valoraron en concreto las conductas desplegadas por esa persona jurídica. Por lo tanto, la gestionante no está legitimada para realizar pretensiones dentro de este proceso. En segundo lugar, se hace preciso señalar que de conformidad con el art. 153 de la Constitución Política, le corresponde al Poder Judicial conocer de las causas civiles, penales, comerciales, de trabajo y contencioso-administrativas, así como de las otras que establezca la ley, cualquiera que sea su naturaleza y la calidad de las personas que intervengan; resolver definitivamente sobre ellas y ejecutar las resoluciones que pronuncie, con la ayuda de la fuerza pública si fuere necesario. De modo que a cada instancia jurisdiccional le corresponde ejecutar las sentencias que ha dictado, sin que sea posible que este Tribunal Constitucional se arrogue la competencia para ejecutar las sentencias dictadas por otras jurisdicciones en el marco de sus respectivas atribuciones legales y constitucionales.
Al respecto, esta Sala ha afirmado de forma reiterada que: “Debe decirse que la pretensión de la recurrente es inadmisible en esta jurisdicción por cuanto no le corresponde a la Sala procurar por la ejecución de resoluciones jurisdiccionales adoptadas por otras instancias. Por lo tanto, será en la sede que conoció de dicho proceso donde deba dilucidarse la circunstancia que acusa, pues de conformidad con el artículo 153 de la Constitución Política, a dicho órgano le corresponde resolver, definitivamente, sobre la gestión y ejecutar las resoluciones que pronuncie, con la ayuda de la fuerza pública si fuere necesario”. (Sentencia n.°2008- 006348. Lo destacado no corresponde al original). A partir de lo anterior, se advierte que no es procedente que esta Sala se arrogue la ejecución de una sentencia firme dictada en otra jurisdicción por hechos y conductas que, por lo demás, son mucho anteriores a los examinados en este proceso de amparo, cuyo objeto fue la protección de derechos fundamentales y no la determinación de responsabilidades administrativas.
En consecuencia, se rechaza la gestión dirigida a este Tribunal”. (El énfasis no es del original).
En virtud de lo expuesto, deberá estarse la gestionante a lo resuelto por este Tribunal en esa sentencia y ejecutarse en cada jurisdicción lo que corresponda, según lo considerado en cada proceso.
Por tanto:
Se remite a la Sala gestionante, a lo resuelto por este Tribunal mediante sentencia nro. 2025-22124, de las 9:15 horas del 16 de julio de 2025. Devuélvase los autos a la Sala Primera de la Corte Suprema de Justicia para la tramitación y resolución que corresponda.
