Review of the Document CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:35 a.m. on 17 September 2026.
Amparo proceeding filed under case number 26-030668-0007-CO by [Nombre 001], identity card [Valor 001], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Background:
Drafted by Justice Salazar Alvarado; and, Reasons:
I.Subject of the application. The applicant alleges that the Instituto Costarricense de Acueductos y Alcantarillados failed to address, within a reasonable time, a report of a water leak submitted on 11 March 2026 and the complaints concerning high consumption and the amount billed. She alleges that this inaction left the breakdown unrepaired for more than five months, caused continuous waste of water resources, and resulted in excessive billing that, as of 20 August 2026, totaled ₡1.027.516. She considers her right to prompt and effective justice to have been violated.
II.Regarding the exception under Article 41 of the Political Constitution. One of the matters raised could constitute a violation of the right to prompt and effective administrative justice. In this regard, it should be clarified that, since Judgment N° 2008-002545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction, with some exceptions, matters in which it is disputed whether a public authority has complied with the time limits established by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, for the purpose of resolving by final decision an administrative proceeding initiated on the authority’s own motion or at a party’s request, or hearing the applicable administrative appeals. This case presents an exception, since the matter under review concerns the failure to inspect and promptly repair leaks reported to the Instituto Costarricense de Acueductos y Alcantarillados. Accordingly, the Chamber will decide the application.
III.Facts established. The following facts, relevant to the decision in this matter, are deemed duly established, either because they have been proven or because the respondent failed to address them as required by the initial order:
IV.Facts not established. The following fact relevant to this ruling is not deemed established:
SOLE. That the respondent authority communicated the outcome of the complaints submitted concerning the amount billed for drinking-water service.
V.Merits. From review of the case file and the established facts, it is established that on 11 March 2026, the applicant reported a leak to the respondent Institute and that, when she filed this amparo on the following 22 August, the breakdown had still not been addressed. The respondent authority acknowledges that the repair was delayed because the workload exceeded the crews’ operational capacity. It also admitted that the report was internally associated with NIS 2003804, even though the leak concerned the adjacent service NIS 2003803, and that the leak did in fact increase the recorded consumption from the bill dated 15 April 2026.
It should be noted that almost six months elapsed between the initial report and the repair, a manifestly excessive period given that the leak was located at the water meter and its fittings, wasted drinking water, and generated abnormal consumption with direct financial consequences for the user.
Thus, the applicant promptly reported the breakdown, and the error in associating it with one of two adjacent services and the claimed lack of operational capacity are matters internal to the Institute’s organization that cannot be made a burden for the person it serves. This is especially so where the institution acknowledges that the leak resulted in erroneous bills and that, for that reason, the user was not required to pay them until they had been corrected.
This Chamber does not overlook that the ordinary determination of consumption, rates, balances, or possible compensation claims may involve questions of legality that belong in the ordinary administrative or judicial channels. However, this case does not seek only a review of a rate calculation. The core of the amparo is the prolonged failure to carry out a necessary material act to address a reported breakdown, which kept the leak active and caused not only abnormal billing but also excessive waste of drinking water. The repair carried out on 3 September 2026 further confirms that the matter required a concrete and feasible material action. That action materially restored the situation complained of by the amparo applicant: the water meter was left leak-free and the balance on the affected bills was reduced to ₡21.654,72, calculated on average consumption of five cubic meters per month.
As to the latter point, although this Tribunal cannot determine the substantive validity of the amounts billed and collected, it has been verified that the applicant submitted several complaints about the excessive amount billed for drinking-water service. Therefore, once the leak has been addressed and the relevant matters verified, the Administration is required to inform her of the outcome of the actions taken, identifying the periods reviewed, the decision made concerning the amounts billed, and the reasons supporting it.
For that reason, repairing the leak alone does not resolve the dispute concerning the challenged bills and the correction of the amounts.
Accordingly, the failure to address the report for nearly six months and the failure to communicate the outcome of the complaints submitted violate the applicant’s right to prompt and effective administrative justice, enshrined in Article 41 of the Political Constitution. Therefore, the application must be granted.
I have supported this Tribunal’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the Administrative-Litigation Courts, not by this Chamber. However, with the recent enactment of Law n.° 9097, Law on the Regulation of the Right of Petition, it has been established that this right may receive judicial protection through the amparo proceeding provided for in Article 32 of the Law on Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not require this Tribunal to change its line of precedent; under number 7 of its Law, this Tribunal has exclusive authority to define its own jurisdiction.
Accordingly, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo proceeding, in all other cases, for the reasons given by this Tribunal (Judgment N° 2008-02545, issued at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this accords with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding legal rules, based on a logical, systemic, and teleological interpretation of the legal system.
The parties are advised that any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted must be collected from the office within a maximum period of thirty business days from service of this judgment. Otherwise, any such material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at Session N° 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin N° 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at Session N° 43-12, held on 3 May 2012, Article LXXXI.
Therefore:
The application is GRANTED. José Darío Guzmán Álvarez, in his capacity as general manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that position, is ordered to take the appropriate measures within the scope of his authority immediately and, within ten days from service of this ruling, to respond to the administrative complaints submitted by the user concerning the amount billed. The respondent party is warned that, pursuant to Article 71 of the Law on Constitutional Jurisdiction, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with it or enforce it, shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration; these shall be determined in enforcement proceedings before the administrative-litigation jurisdiction.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cinco minutos del diecisiete de setiembre de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número 26-030668-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. La recurrente alega que, el Instituto Costarricense de Acueductos y Alcantarillados omitió atender, dentro de un plazo razonable, el reporte de una fuga de agua presentado el 11 de marzo de 2026 y los reclamos planteados por el alto consumo y el monto facturado. Alega que, esa inactividad mantuvo la avería durante más de cinco meses, ocasionó un desperdicio continuo del recurso hídrico y produjo facturaciones excesivas que, al 20 de agosto de 2026, ascendían a ₡1.027.516. Considera lesionado su derecho a una justicia pronta y cumplida.
II.Sobre la excepción del artículo 41, de la Constitución Política. Uno de los aspectos señalados podría configurar una lesión al derecho a una justicia administrativa pronta y cumplida. Al respecto, debe aclararse que, a partir de la Sentencia N° 2008-002545, de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa, con algunas excepciones, aquellos asuntos en los que se discute si la autoridad pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, a fin de resolver por acto final un procedimiento administrativo, incoado de oficio o a instancia de parte, o conocer de los recursos administrativos procedentes. Precisamente, en este recurso se plantea un supuesto de excepción pues el sub examine está ante la falta de inspección y reparación oportuna de fugas reportadas al Instituto Costarricense de Acueductos y Alcantarillados. En virtud de lo anterior, la Sala entrará a resolver el recurso.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
IV.Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución:
ÚNICO. Que la autoridad recurrida haya comunicado el resultado de los reclamos planteados en relación con el monto de facturación por el servicio de agua potable.
V.Sobre el fondo. Del estudio de los autos, y a partir de la relación de hechos probados, se tiene por acreditado, que el 11 de marzo de 2026, la recurrente reportó al Instituto recurrido una fuga y al interponer el presente recurso de amparo, el 22 de agosto siguiente, la avería aún no había sido atendida. Por su parte, la autoridad recurrida reconoce que la reparación se demoró porque la carga de trabajo excedía la capacidad operativa de las cuadrillas y también admitió que, el reporte fue asociado internamente al NIS 2003804, pese a que la fuga correspondía al servicio colindante NIS 2003803, y que efectivamente, esa fuga incrementó el consumo registrado desde la factura del 15 de abril de 2026.
Nótese que, entre el reporte inicial y la reparación transcurrieron casi seis meses, lapso que resulta manifiestamente excesivo, atendiendo a que se trataba de una filtración localizada en el hidrómetro y sus accesorios, que desperdiciaba agua potable y generaba consumos anormales con efectos económicos directos para la usuaria.
De manera que, la recurrente cumplió oportunamente con comunicar la avería siendo que el error de asociación entre dos servicios colindantes y la insuficiencia operativa invocada son circunstancias pertenecientes a la organización interna del Instituto y no pueden convertirse en una carga para la administrada. Menos aún cuando la institución reconoce que la fuga produjo facturaciones erróneas y que, por esa razón, la usuaria no debía pagarlas hasta que se efectuara la corrección.
Esta Sala no desconoce que la determinación ordinaria de consumos, tarifas, saldos o eventuales reclamos indemnizatorios puede involucrar cuestiones de legalidad que corresponden a las vías administrativas o jurisdiccionales comunes; sin embargo, en este caso no se solicita únicamente revisar un cálculo tarifario. El núcleo del amparo es la omisión prolongada de ejecutar una actuación material indispensable para atender una avería reportada, omisión que mantuvo la fuga activa y originó no solo la facturación anormal sino un desperdicio desmedida de agua potable. De modo que, la reparación efectuada el 3 de septiembre de 2026, confirma además, que la gestión requería una actuación material concreta y posible siendo que dichas actuaciones restablecieron materialmente la situación reclamada por la amparada: el hidrómetro quedó sin fuga y el saldo de las facturas afectadas se redujo a ₡21.654,72, calculado sobre el consumo promedio de cinco metros cúbicos mensuales.
Sobre esto último, si bien este Tribunal no puede definir la procedencia sustantiva de los montos facturados y los cobros efectuados, lo cierto es que se verificó que, la recurrente presentó varios reclamos por el monto desmedido en la facturación del servicio de agua potable, por lo que, una vez resuelta la fuga y verificado lo correspondiente, la Administración se encuentra en la obligación de comunicarle el resultado de las actuaciones realizadas, con indicación de los periodos examinados, la decisión adoptada en relación con los montos facturados y las razones que la sustentan.
Por ello, la sola reparación de la fuga no permite tener por resuelta la controversia relativa a los recibos objetados y la rectificación de los montos.
Así las cosas, la falta de atención del reporte durante un plazo cercano a seis meses y la omisión de comunicar la resolución a los reclamos planteados vulnera el derecho de la recurrente a una justicia administrativa pronta y cumplida, consagrado en el artículo 41, de la Constitución Política. Además, Procede, por ende, declarar con lugar el recurso.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara CON LUGAR el recurso. Se ordena a José Darío Guzmán Álvarez, en su condición de gerente general del Instituto Costarricense de Acueductos y Alcantarillados o a quien ocupe dicho puesto, que de forma inmediata tome las medidas correspondientes en el ámbito de sus competencias, y dentro del plazo de diez días a partir de la notificación de esta resolución brinde respuesta a los reclamos administrativos planteados por la usuaria en relación al monto de facturación efectuado. Se advierte a la parte recurrida que, de conformidad con lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere, o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.- Fernando Castillo V.
