Amparo proceeding recorded under expediente No. 26-026807-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the MINISTRY OF PUBLIC SECURITY.
Background:
Justice Hess Herrera drafted this decision; and, Reasons:
The applicant files an amparo proceeding against the Ministry of Public Security, on the grounds that officers of the Los Chiles Public Force threatened to evict a group of farmworkers occupying farms 260430 and 355095 without showing a judicial or administrative order. The applicant maintains that this constitutes a real and imminent threat to their fundamental rights and requests that the amparo proceeding be granted.
For purposes of deciding this matter, the following fact is considered duly established, either because it has been proven or because the respondent failed to address it, as required in the initial order:
Upon analyzing the established facts, the reports made under oath, and the evidence added to the expediente, this Court considers that the amparo proceeding must be dismissed.
In this matter, the applicant maintains that officials of the Los Chiles Public Force allegedly made several visits to the properties registered under folios reales 2-00260430-000 and 2-00355095-000, occupied by a group of farmworkers, and on those occasions allegedly stated verbally that they would evict them, despite the absence of a judicial or administrative order authorizing such action. On that basis, the applicant considers that there is a real and imminent threat to the fundamental rights of the occupants.
However, the evidence added to the expediente does not establish that an administrative or judicial eviction order exists, or that actions were taken to carry out or materially prepare an eviction from the aforementioned properties. On the contrary, it was established that, after reviewing the records of the Operations Office of the Los Chiles Police Station, no request for administrative or judicial eviction, or transfer of possession, was being processed with respect to those properties. In addition, the Administrative Evictions Subprocess of the Ministry of Public Security reported under oath that it had neither initiated nor issued an eviction order, while the Los Chiles Police Station indicated that it had carried out no measures for that purpose.
It is true that officers of the Public Force responded to various incidents at those properties on 6, 26, 27, and 28 July, and on 10, 14, 15, 17, and 21 August 2026. However, those interventions concerned incidents involving environmental offenses, logging and illegal transport of timber resources, disturbance of public order, or other similar situations. It has not been established that any eviction was communicated, suggested, or carried out in connection with those actions.
Accordingly, there is no direct evidence or sufficient circumstantial evidence to establish the threat alleged by the applicant. The mere assertion that certain police officers allegedly announced verbally that an eviction might take place, without other objective evidence to support it and in the face of the reports made under oath denying the existence of any order, proceeding, or action directed toward that purpose, is insufficient to establish a certain, concrete, and imminent threat that may be remedied through this constitutional procedure. The amparo jurisdiction may intervene in response to threats to fundamental rights, but those threats must be supported by objective circumstances that make it reasonable to find that they exist, rather than being merely hypothetical or possible.
Consequently, since it has not been established that an eviction order exists or that any action has been taken, or prepared, to evict the applicant or the other people occupying the aforementioned properties, there is no apparent current threat to or impairment of the fundamental rights invoked. Therefore, the amparo proceeding must be dismissed, as is hereby ordered.
The applicant is advised that any paper document, as well as any object or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device that may have been submitted must be collected from the court office within a maximum of 30 working days counted from service of this judgment. Otherwise, any material not collected within this period will be destroyed, pursuant to the “Regulation on the Electronic Expediente before the Poder Judicial,” approved by the Full Court in session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cinco minutos del diecisiete de setiembre de dos mil veintiseis .
Recurso de amparo que se tramita en expediente No. 26-026807-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTERIO DE SEGURIDAD PÚBLICA.
Resultando:
Redacta la Magistrada Hess Herrera; y,
Considerando:
La parte recurrente interpone recurso de amparo contra el Ministerio de Seguridad Pública, al considerar que oficiales de la Fuerza Pública de Los Chiles han amenazado con desalojar a un grupo de campesinos que ocupan las fincas 260430 y 355095, sin exhibir orden judicial ni administrativa. Sostiene que ello constituye una amenaza real e inminente a sus derechos fundamentales y solicita que se declare con lugar el recurso.
De importancia para la decisión de este asunto, se estima como debidamente demostrado el siguiente hecho, sea porque así ha sido acreditado o bien porque el recurrido haya omitido referirse a ello según lo prevenido en el auto inicial:
Del análisis de los hechos acreditados, de los informes rendidos bajo juramento y de la prueba incorporada al expediente, este Tribunal estima que el recurso debe ser declarado sin lugar.
En el presente asunto, la parte recurrente sostiene que funcionarios de la Fuerza Pública de Los Chiles habrían realizado diversas visitas a los inmuebles inscritos bajo los folios reales 2-00260430-000 y 2-00355095-000, ocupados por un grupo de campesinos y que, en esas oportunidades, habrían manifestado verbalmente que procederían a desalojarlos, pese a no existir una orden judicial o administrativa que autorizara tal actuación. A partir de ello, considera configurada una amenaza real e inminente a los derechos fundamentales de las personas ocupantes.
Sin embargo, de los elementos probatorios incorporados al expediente no se acredita la existencia de una orden de desalojo, administrativa o judicial, ni tampoco la realización de actuaciones dirigidas a ejecutar o preparar materialmente un desalojo respecto de los inmuebles referidos. Por el contrario, se tuvo por demostrado que, revisados los registros de la oficina de Operaciones de la Delegación Policial de Los Chiles, no se encontraba en trámite solicitud alguna de desalojo administrativo, judicial o de puesta en posesión respecto de esos bienes. Asimismo, el Sub Proceso de Desalojos Administrativos del Ministerio de Seguridad Pública informó bajo juramento que no había instruido ni dictado orden de desalojo alguna, mientras que la Delegación Policial de Los Chiles indicó que no había ejecutado diligencias con esa finalidad.
Ciertamente, consta que funcionarios de la Fuerza Pública atendieron diversos incidentes en esos inmuebles los días 6, 26, 27 y 28 de julio, así como 10, 14, 15, 17 y 21 de agosto de 2026. No obstante, tales intervenciones estuvieron relacionadas con incidentes vinculados con delitos ambientales, tala y transporte ilegal de recursos maderables, alteración del orden público u otras situaciones semejantes, sin que se haya acreditado que, con ocasión de esas actuaciones, se hubiera comunicado, insinuado o ejecutado algún desalojo.
Así las cosas, no existe prueba directa ni indiciaria suficiente que permita tener por demostrada la amenaza denunciada por la parte recurrente. La sola afirmación de que determinados funcionarios policiales habrían anunciado verbalmente un eventual desalojo, sin otros elementos objetivos que la respalden y frente a los informes rendidos bajo juramento que descartan la existencia de una orden, trámite o actuación encaminada a ese propósito, no resulta suficiente para tener por configurada una amenaza cierta, concreta e inminente susceptible de tutela en esta vía constitucional. La jurisdicción de amparo puede intervenir frente a amenazas a derechos fundamentales, pero estas deben encontrarse sustentadas en circunstancias objetivas que permitan apreciar razonablemente su existencia, y no en una posibilidad meramente hipotética o eventual.
En consecuencia, al no comprobarse que exista orden de desalojo alguna, ni actuación material o preparatoria dirigida a desalojar al recurrente o a las demás personas ocupantes de los inmuebles mencionados, no se advierte una amenaza o afectación actual a los derechos fundamentales invocados. Por ende, lo procedente es declarar sin lugar el recurso, como en efecto se dispone.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
