CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty on 16 September 2026.

Amparo proceeding filed by [Nombre 001], identity card number [Valor 001], an Indigenous person belonging to the Maleku ethnic group, against the ASOCIACIÓN DE DESARROLLO INTEGRAL DEL TERRITORIO INDÍGENA MALEKU (ADI MALEKU) (Association for the Integral Development of the Maleku Indigenous Territory).

Background:

  1. 1In a written submission filed through Gestión en Línea at 18:36 on 30 August 2026, the petitioner files an amparo proceeding and states: “Purpose of the application: ➢ Environmental destruction — violation of the right to a healthy and ecologically balanced environment (Article 50 of the Political Constitution). I, [Nombre 001], identity card No. [Valor 002], an Indigenous person belonging to the Maleku ethnic group, residing in [Nombre 002], respectfully appear before this Honorable Constitutional Chamber to file this amparo proceeding against the Asociación de Desarrollo Integral del Territorio Indígena Maleku (ADI Maleku) (Association for the Integral Development of the Maleku Indigenous Territory), for violation of my fundamental right to a healthy and ecologically balanced environment, based on the following facts and legal grounds. I. FACTS1) I am a Costa Rican citizen, an Indigenous person belonging to the Maleku ethnic group, Palenque Margarita, Guatuso, province of Alajuela.2) I am the registered owner of the property recorded in the National Registry under number [Valor 003], located within the Maleku Indigenous Territory, with a consolidated registry history dating from 1974, that is, predating the promulgation of the Indigenous Law No. 6172 of 1977.3) ADI Maleku, by means of Agreement No. 6.3 of Resolution No. 1 2026, granted Ms. [Nombre 003] a possessory right over that property, even though it is registered in my name in the National Registry.4) On 24 July 2026, third parties, motivated by the administrative act described above, entered my property without authorization and cut down six trees (one guaba, two jobos, and three maderos de montaña), causing certain environmental harm that cannot be fully repaired. II. LEGAL GROUNDS A. ADI Maleku’s action is an act of a public nature subject to constitutional review Integral Development Associations are private legal entities; however, both this Chamber’s case law and the criteria of the Procuraduría General de la República (Office of the Attorney General of the Republic) have recognized that, when they exercise public functions—such as granting possessory rights, administering communal property, or representing the Indigenous community in court—their acts are subject to the principle of legality and constitutional review under Article 57 of the Constitutional Jurisdiction Act. Agreement No. 6.3 of Resolution No. 1-2026 is precisely that type of act: a local Indigenous government decision disposing of a possessory right, placing ADI Maleku in a position of authority against which ordinary judicial remedies are clearly insufficient or too late to prevent the environmental harm already caused. On this basis, I request that the application be admitted. B. Violation of the right to a healthy and ecologically balanced environment (Article 50 of the Political Constitution) Article 50 of the Political Constitution guarantees everyone the right to a healthy and ecologically balanced environment. This Chamber has reiterated that an environmental amparo is available when the harm arises from a decision or action by a public authority, without requiring prior exhaustion of other avenues. The felling of the six trees described in the fourth fact is not an isolated act between private parties: it stems directly from Agreement No. 6.3, which granted a third party an apparent possessory title over property that does not belong to that party, thereby enabling the entry and environmental destruction complained of. There is therefore a direct causal link between ADI Maleku’s administrative act and the ecological harm caused, which makes the amparo against that Association admissible, as grounds for admitting the application. C. Indigenous status and consolidated registered ownership reinforce the basis for the amparo Unlike cases in which constitutional case law has upheld the authority of Indigenous Development Associations to dispose of possession of communal lands—such as Resolution No. 2025-037679, concerning the governance and protection of a territory against occupation by non-Indigenous persons—in this case there is no dispute as to my status as a Maleku Indigenous person, and property No. [Valor 003] is not an asset held in undifferentiated communal tenure, but an individually registered property in the National Registry since 1974, with a registry history predating the Indigenous Law itself. The community governance authority that case law recognizes for ADIs to administer collective access to land is not equivalent to authority to grant, through an internal agreement, possession of individually registered property and thereby, in practice, enforce a private debt guarantee between private parties. III. CLARIFICATION REGARDING THE SCOPE OF THIS APPLICATION The undersigned states that, in relation to the property in dispute, administrative-litigation proceedings are pending (Exp. 26 002909-1027-CA) in which the nullity of Agreement No. 6.3 is being contested, as well as a criminal complaint (Exp. 26-001132-0306-PE) concerning the events arising from the tree felling. It is not the undersigned’s intention for this Chamber to rule on the nullity of the administrative act or on the criminal liability of the persons involved, matters that fall within their respective jurisdictions. The sole relief sought in this application is immediate protection of the right to a healthy environment, through a protective measure preventing further acts of physical alteration on the property while the aforementioned proceedings are resolved. The undersigned clarifies that this application does not seek to diminish the importance of or disregard ADI Maleku’s role as the local government of the Indigenous territory, a function recognized by law and respected by the undersigned. It should also be noted that, in both the administrative-litigation proceedings (Exp. 26-002909-1027-CA) and the criminal case (Exp. 26-001132-0306 PE), judicial authorization is already on record for ADI Maleku to be represented by a public defender, which shows that both jurisdictions already recognize the seriousness and complexity of the underlying matter. For precisely that reason, the only thing requested of this Chamber is the adoption of an urgent interim measure to protect the environment while those proceedings—already pending and with representation assured—continue through their ordinary course. IV. RELIEF SOUGHT1) That this amparo proceeding be granted in its entirety for violation of the fundamental right to a healthy and ecologically balanced environment (Article 50 of the Political Constitution).2) That the Asociación de Desarrollo Integral del Territorio Indígena Maleku (ADITIM) (Association for the Integral Development of the Maleku Indigenous Territory) be ordered to: A. Immediately issue an administrative resolution suspending the effects of Agreement No. 6.3 of Resolution No. 1-2026, which shall remain in effect until a final judgment is issued in the judicial proceedings already filed. B. Formally and personally notify Ms. [Nombre 003], Mr. [Nombre 004], and any other person who intends to enter or carry out physical acts on property No. [Valor 003] of that suspension, warning them that they must refrain from entering, felling trees, carrying out works, or performing any act that physically alters the property while the measures ordered by this Chamber remain in effect. Entry onto the property and any physical act thereon shall be prohibited to anyone other than the registered owner while the judicial proceedings related to the property are finally resolved. C. Refrain from issuing any new agreement or authorization purporting to dispose of possession or use of property No. [Valor 003] while no final judgment has been issued in the ordinary judicial proceedings currently pending.3) As an urgent interim measure (Article 41 LJC), that the Honorable Chamber order the halting of any works, tree felling, or alteration of the environment on that property while this application or the ordinary proceedings currently pending are resolved. V. IMPORTANCE OF THE URGENCY OF THE INTERIM MEASURE Pursuant to Article 41 of the Constitutional Jurisdiction Act, which authorizes this Chamber to order such interim or provisional measures as it deems necessary to prevent serious or difficult-to-repair harm, I request the immediate adoption of the measures necessary to prevent continuation of the acts complained of and further harm to the property. This is because, after the criminal complaint was filed, new harm to the property that is the subject of this application has occurred. The requested measure seeks to prevent continuation of the acts complained of while the aforementioned proceedings advance, and to prevent any physical confrontation between the parties involved. In fact, the undersigned has deliberately avoided going in person to the property in dispute, precisely to prevent any confrontation that could lead to serious consequences for the persons involved. I therefore consider it prudent and necessary for the measure to be ordered immediately, to protect the environment and the life and physical integrity of all persons involved.” (SIC).
  2. 2Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily reject, on procedural or substantive grounds, at any time, including upon filing, any application before it that proves manifestly inadmissible, or when it considers there is sufficient evidence to reject it, or that it is merely a reiteration or reproduction of an earlier identical or similar application that was rejected.

Drafted by Justice Castillo Víquez; and, Reasons:

I. PURPOSE OF THE APPLICATION

The petitioner alleges that he is an Indigenous person belonging to the Maleku ethnic group. He asserts that he is the registered owner of property number [Valor 003], located within the Maleku Indigenous Territory, with a consolidated registry history dating from 1974, that is, predating the promulgation of Indigenous Law number 6172 of 1977. He alleges that ADI Maleku, by means of Agreement number 6.3 of Resolution number 1- 2026, granted Ms. [Nombre 003] a possessory right over that property, even though it is registered in his name. He claims that On 24 July 2026, third parties, motivated by the administrative act described above, entered my property without authorization and cut down six trees (one guaba, two jobos, and three maderos de montaña), causing certain environmental harm that cannot be fully repaired. He alleges a violation of his right to a healthy and ecologically balanced environment and his property right, asserting that the aforementioned property is not an asset held in undifferentiated communal tenure.

He states that the dispute has already been brought before the administrative-litigation jurisdiction in the proceedings conducted under file number 26 002909-1027-CA, as well as before the criminal courts, through the complaint being processed under file number 26-001132-0306-PE.

He requests an order directing the respondent ADI to suspend the effects of Agreement 6.3 of Resolution 1-2026 until judgment is issued in the judicial proceedings already filed, to notify Ms. Noemy Mejían Marín so that she refrains from entering, felling trees, carrying out works, or performing any act that alters the property, and to refrain from issuing any new agreement. He also requests an urgent interim measure.

II. ALLEGED VIOLATION OF THE RIGHT TO A HEALTHY ENVIRONMENT

The purpose of an amparo proceeding is to provide timely protection against violations or direct threats to fundamental rights and freedoms, not to serve as a general mechanism for channeling other types of requests. Accordingly, one cannot seek to have the Constitutional Chamber act, by way of amparo, merely as a body that processes complaints or reports, since this would not only require taking complex evidence, which is incompatible with the summary nature of this forum, but would also mean directly replacing the administrative authority’s will and usurping public offices’ management of matters within their jurisdiction. For that reason, the Chamber has declined to hear environmental complaints directly. In this regard, it should be noted that the corresponding complaints must be formally submitted in writing to the authorities competent in the subject matter, in order to bring an issue of interest to their attention. This does not mean that the Chamber requires exhaustion of the administrative avenue, but rather simply acknowledges that, as stated above, this jurisdiction cannot directly replace the Administration.

In this case, the petitioner comes directly to the Chamber to report the alleged felling of trees on property [Valor 003], located within the Maleku Indigenous Territory, which took place on 24 July 2026. However, he does not indicate that he submitted any complaint or claim in writing to the competent Authorities. Instead, he comes directly before this Chamber to lodge the complaint, so that the Chamber may act as a body that processes complaints or as an oversight body for compliance with duties by the respondents, which falls outside the competence of this specialized jurisdiction. Therefore, the appropriate course, if the petitioner so wishes, is to submit the complaints and requests directly to the competent administrative bodies, or through the corresponding judicial avenue, as he indicates he has done. Consequently, the application is inadmissible with respect to this issue, and so it is declared.

III.REGARDING THE ADI’S DECISION IN AGREEMENT NUMBER 6.3 OF RESOLUTION 1-2026. On the other hand, the petitioner seeks to challenge the decision in Agreement number 6.3 of Resolution 1-2026, on the grounds that the property for which Ms. [Nombre 003] was granted a possessory right is his property and is not part of undifferentiated communal tenure; he therefore seeks the Chamber’s intervention to suspend the effects of the agreement and issue an interim measure in his favor. In this regard, it should be clarified that it is not for this Constitutional Chamber to determine, on the basis of the applicable infra-constitutional regulations and the ancestral principles, beliefs, and customs of the Maleku Indigenous community, matters concerning ownership and possession of the asset or who has rights over the property in question. This not only exceeds the summary nature of an amparo proceeding and this Court’s jurisdiction, but also forms part of the community’s own internal law, and its disputes must be resolved through the avenues and mechanisms provided for that purpose under Indigenous customary law and the infra-constitutional legal system (see, to similar effect, judgments 2021009131 of 09:05 on 7 May 2021, 2021007505 of 09:15 on 16 April 2021, and 2021008583 of 09:15 on 30 April 2021).

In any event, as the petitioner himself indicates, the dispute has already been brought before the administrative-litigation jurisdiction in the proceedings conducted under file number 26 002909-1027-CA, as well as before the criminal courts through the complaint being processed under file number 26-001132-0306-PE. Accordingly, it is in those forums that the petitioner must discuss not only the merits of the matter, but also seek whatever interim measures he deems appropriate so that the matter may be resolved in accordance with law. Consequently, the amparo is inadmissible with respect to this issue, as is hereby declared.

IV. DOCUMENTATION SUBMITTED TO THE FILE

The petitioner is advised that if any paper document, or any object or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, has been submitted, it must be collected from the office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena (Full Court) at session No. 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 on 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciseis de setiembre de dos mil veintiseis .

Recurso de amparo interpuesto por [Nombre 001], cédula de identidad número [Valor 001], persona indígena perteneciente a la etnia Maleku; contra la ASOCIACIÓN DE DESARROLLO INTEGRAL DEL TERRITORIO INDÍGENA MALEKU (ADI MALEKU).

Resultando:

  1. 1Por escrito presentado por Gestión en Línea a las 18:36 el 30 de agosto de 2026, la parte recurrente interpone recurso de amparo y manifiesta que: “Objeto del recurso: ➢ Destrucción ambiental — violación al derecho a un ambiente sano y ecológicamente equilibrado (artículo 50 de la Constitución Política). Yo, [Nombre 001], cédula de identidad N.° [Valor 002], indígena perteneciente a la etnia Maleku, con domicilio en [Nombre 002], comparezco respetuosamente ante esta Honorable Sala Constitucional a interponer el presente recurso de amparo contra la Asociación de Desarrollo Integral del Territorio Indígena Maleku (ADI Maleku), por la violación de mi derecho fundamental a un ambiente sano y ecológicamente equilibrado, con fundamento en los siguientes hechos y consideraciones de derecho. I. HECHOS1) Soy ciudadano costarricense, indígena perteneciente a la etnia Maleku, Palenque Margarita, Guatuso, provincia de Alajuela.2) Soy titular registral de la finca inscrita en el Registro Nacional bajo el número [Valor 003], ubicada dentro del Territorio Indígena Maleku, con antecedente registral consolidado desde 1974, es decir, anterior a la promulgación de la Ley Indígena N.° 6172 de 1977.3) La ADI Maleku, mediante el Acuerdo N.° 6.3 de la Resolución N.° 1 2026, adjudicó a la señora [Nombre 003] un derecho de posesión sobre dicha finca, pese a estar esta inscrita a mi nombre en el Registro Nacional.4) El 24 de julio de 2026, terceras personas, motivadas por el acto administrativo antes descrito, ingresaron sin autorización a mi propiedad y talaron seis árboles (una guaba, dos jobos y tres maderos de montaña), causando un daño ambiental cierto y de imposible reparación plena. II. FUNDAMENTOS DE DERECHO A. La actuación de la ADI Maleku es un acto de naturaleza pública sujeto al control constitucional Las Asociaciones de Desarrollo Integral son personas jurídicas de naturaleza privada; sin embargo, tanto la jurisprudencia de esta Sala como los criterios de la Procuraduría General de la República han reconocido que, cuando ejercen funciones de naturaleza pública —como adjudicar derechos de posesión, administrar bienes comunales o representar judicialmente a la comunidad indígena—, sus actos quedan sujetos al principio de legalidad y al control de constitucionalidad, en los términos del artículo 57 de la Ley de la Jurisdicción Constitucional. El Acuerdo N.° 6.3 de la Resolución N.° 1-2026 constituye precisamente ese tipo de acto: una decisión de gobierno local indígena que dispuso de un derecho de posesión, colocando a la ADI Maleku en una posición de autoridad frente a la cual los remedios jurisdiccionales comunes resultan claramente insuficientes o tardíos para evitar el daño ambiental ya materializado. Con base en este argumento solicito su admisibilidad. B. Violación del derecho a un ambiente sano y ecológicamente equilibrado (artículo 50 de la Constitución Política) El artículo 50 de la Constitución Política garantiza el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. Esta Sala ha reiterado que el amparo ambiental procede cuando la afectación surge de una decisión o actuación de una autoridad pública, sin que sea necesario agotar previamente otras vías. La tala de los seis árboles descrita en el hecho cuarto no es un acto aislado entre particulares: deriva directamente del Acuerdo N.° 6.3, que otorgó a un tercero un título aparente de posesión sobre un inmueble que no le pertenece, habilitando de hecho el ingreso y la destrucción ambiental denunciada. Existe, por tanto, una relación de causalidad directa entre el acto administrativo de la ADI Maleku y el daño ecológico producido, lo que hace procedente el amparo contra dicha Asociación, como fundamento de admisibilidad. C. La calidad indígena y la titularidad registral consolidada refuerzan la procedencia del amparo A diferencia de los supuestos en que la jurisprudencia constitucional ha avalado la competencia de las Asociaciones de Desarrollo Indígena para disponer de la posesión sobre tierras de naturaleza comunal —como en la Resolución N.° 2025-037679, referida a la gobernanza y protección de un territorio frente a la ocupación de personas no indígenas—, en el presente caso no existe controversia alguna sobre mi condición de indígena Maleku, y la finca N.° [Valor 003] no es un bien de tenencia comunal indiferenciada, sino un inmueble individualmente inscrito en el Registro Nacional desde 1974, con antecedente registral anterior a la propia Ley Indígena. La potestad de gobernanza comunitaria que la jurisprudencia reconoce a las ADI para administrar el acceso colectivo a la tierra no equivale a una potestad para adjudicar, mediante un acuerdo interno, la posesión de un bien inscrito individualmente y ejecutar así, de hecho, la garantía de una deuda privada entre particulares. III. PRECISIÓN SOBRE EL ALCANCE DE ESTE RECURSO El suscrito deja constancia de que, en relación con la finca en conflicto, se encuentra en trámite un proceso Contencioso-Administrativo (Exp. 26 002909-1027-CA) en el que se discute la nulidad del Acuerdo N.° 6.3, así como una denuncia penal (Exp. 26-001132-0306-PE) por los hechos derivados de la tala. No es intención del suscrito que esta Sala se pronuncie sobre la nulidad del acto administrativo ni sobre la responsabilidad penal de las personas involucradas, materias que corresponden a sus respectivas jurisdicciones. La única pretensión de este recurso es obtener la tutela inmediata del derecho a un ambiente sano, mediante una medida de protección que impida la continuación de actos de transformación material sobre el inmueble mientras se resuelven los procesos ya referidos. El suscrito aclara que este recurso no pretende restar importancia ni desconocer el rol de la ADI Maleku como gobierno local del territorio indígena, función que la ley le reconoce y que el suscrito respeta. Debe señalarse, además, que tanto en el proceso Contencioso-Administrativo (Exp. 26-002909-1027-CA) como en la causa penal (Exp. 26-001132-0306 PE) ya consta la autorización judicial para que la ADI Maleku sea representada por un defensor público, lo cual evidencia que ambas jurisdicciones ya reconocen la seriedad y complejidad del asunto de fondo. Precisamente por ello, lo único que se solicita a esta Sala es la adopción de una medida cautelar urgente que proteja el ambiente mientras esos procesos —ya en trámite y con representación garantizada— siguen su curso natural. IV. PETITORIA1) Que se declare con lugar el presente recurso de amparo en todos sus extremos por violación al derecho fundamental a un ambiente sano y ecológicamente equilibrado (artículo 50 de la Constitución Política).2) Que se ordene a la Asociación de Desarrollo Integral del Territorio Indígena Maleku (ADITIM): A. Emitir de forma inmediata una resolución administrativa de suspensión de los efectos del Acuerdo N.º 6.3 de la Resolución N.º 1-2026 la cual deberá mantenerse vigente hasta que se dicte sentencia firme en los procesos judiciales ya presentados. B. Notificar formal y personalmente dicha suspensión a la señora [Nombre 003], al señor [Nombre 004] y a cualquier otra persona que pretenda ingresar o realizar actos materiales sobre la finca N.º [Valor 003], apercibiéndoles de que deberán abstenerse de ingresar, talar, realizar obras o ejecutar cualquier acto de alteración material sobre dicho inmueble mientras se encuentren vigentes las medidas ordenadas por esta Sala. El ingreso al inmueble y la realización de cualquier acto material sobre este quedarán prohibidos para cualquier persona distinta del titular registral, mientras se resuelven definitivamente los procesos judiciales relacionados con la finca. C. Abstenerse de emitir cualquier nuevo acuerdo o autorización que pretenda disponer de la posesión o uso del inmueble N.º [Valor 003] mientras no exista sentencia firme en los procesos judiciales ordinarios en trámite.3) Que como medida cautelar urgente (artículo 41 LJC), la Honorable Sala ordene la paralización de cualquier obra, tala o alteración del medio ambiente en dicho inmueble mientras se resuelve este recurso o los procesos ordinarios en trámite. V. IMPORTANCIA DE LA URGENCIA DE LA MEDIDA CAUTELAR Al amparo del artículo 41 de la Ley de la Jurisdicción Constitucional, que faculta a esta Sala a decretar las medidas cautelares o provisionales que estime necesarias para evitar daños graves o de difícil reparación, solicito la adopción inmediata de las medidas necesarias para impedir la continuación de los actos denunciados y prevenir un mayor daño al inmueble. Esto debido a que, con posterioridad a la interposición de la denuncia penal, se han materializado nuevos agravios sobre el inmueble objeto de este recurso. La medida solicitada busca evitar que continúen los actos denunciados mientras avanzan los procesos ya referidos, así como prevenir cualquier confrontación física entre las partes involucradas. De hecho, el suscrito ha evitado deliberadamente acudir de forma personal al inmueble en conflicto, precisamente para prevenir cualquier confrontación que pudiera derivar en consecuencias graves para las personas involucradas. Por ello, considero prudente y necesario que la medida sea ordenada de manera inmediata, en protección del ambiente y de la vida e integridad física de todas las personas involucradas.” (SIC).
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente aduce que es indígena perteneciente a la etnia Maleku. Asegura que es titular registral de la finca número [Valor 003], ubicada dentro del Territorio Indígena Maleku, con antecedente registral consolidado desde 1974, es decir, anterior a la promulgación de la Ley Indígena número 6172 de 1977. Acusa que la ADI Maleku, mediante el Acuerdo número 6.3 de la Resolución número 1- 2026, adjudicó a la señora [Nombre 003] un derecho de posesión sobre dicha finca, pese a que está inscrita a su nombre. Reclama que El 24 de julio de 2026, terceras personas, motivadas por el acto administrativo antes descrito, ingresaron sin autorización a mi propiedad y talaron seis árboles (una guaba, dos jobos y tres maderos de montaña), causando un daño ambiental cierto y de imposible reparación plena. Acusa la violación a su derecho a un ambiente sano y ecológicamente equilibrado y su derecho de propiedad, pues asegura que la mencionada finca no es un bien de tenencia comunal indiferenciada.

Refiere que el conflicto ya se encuentra judicializado ante la jurisdicción Contencioso Administrativa en el proceso que se tramita en expediente número 26 002909-1027-CA, así como en la vía penal, a través de la denuncia que se tramita en expediente número 26-001132-0306-PE.

Solicita que se ordene a la ADI recurrida suspender los efectos del Acuerdo 6.3 de la Resolución 1-2026, hasta que se dicte sentencia en los procesos judiciales ya presentados, notificar a la señora Noemy Mejían Marín, para que se abstenga de ingresar, talar, realizar obras o ejecutar cualquier acto de alteración del inmueble y abstenerse de emitir cualquier nuevo acuerdo. Asimismo, solicita que se dicte medida cautelar urgente.

II. SOBRE LA PRESUNTA VIOLACIÓN AL DERECHO A UN AMBIENTE SANO

La finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas directas a los derechos y libertades fundamentales, no servir como un instrumento genérico para canalizar peticiones de otros tipos. En virtud de lo anterior, no puede pretenderse que, por la vía del amparo, la Sala Constitucional haga las veces de una mera instancia tramitadora de quejas o denuncias, puesto que ello no solamente haría necesario efectuar probanzas complicadas, incompatibles con la naturaleza sumaria de esta sede, sino también sustituir directamente la voluntad administrativa y suplantar a los despachos públicos en la gestión de los asuntos de su competencia. De allí que la Sala se haya negado a conocer directamente denuncias en materia ambiental. En este sentido, debe mencionarse que las correspondientes denuncias deben ser presentadas formalmente por escrito, ante las autoridades competentes en la materia con el fin de exponer un asunto de su interés. Tómese en cuenta que esto último no significa que la Sala exija agotar la vía administrativa, sino la simple aceptación de que, como se dijo anteriormente, esta jurisdicción no puede sustituir directamente a la Administración.

En el presente caso, el recurrente acude directamente a la Sala a denunciar la supuesta tala de árboles en la finca [Valor 003], ubicada dentro del Territorio Indígena Maleku que se realizó el 24 de julio de 2026. Sin embargo, no indica haber planteado por escrito ninguna denuncia o reclamo ante las Autoridades competentes. Por el contrario, acude directamente ante esta Sala a formular la denuncia, a fin de que esta Sala funja como instancia tramitadora de denuncias o ente fiscalizador del cumplimiento de deberes por parte de los recurridos, lo que resulta ajeno a las competencias de esta jurisdicción especializada. Por lo tanto, lo propio es que el recurrente, si a bien lo tiene, presente las denuncias y gestiones directamente ante las instancias administrativas competentes, o bien, en la vía judicial correspondiente, tal como indica haberlo hecho. En consecuencia, el recurso es inadmisible en cuanto a este extremo y así se declara.

III.SOBRE LO RESUELTO POR LA ADI EN EL ACUERDO NÚMERO 6.3 DE LA RESOLUCIÓN 1-2026. Por otra parte, el recurrente pretende cuestionar lo resuelto en el Acuerdo número 6.3 de la Resolución 1-2026, por considerar que la finca sobre la cual se le otorgó derecho de posesión a la señora [Nombre 003] es de su propiedad y no forma parte de la tenencia comunal indiferenciada, por lo que pretende que esta Sala intervenga, suspenda los efectos del acuerdo y dicte una medida cautelar a su favor. Al respecto, cabe aclarar que, a esta Sala Constitucional no le corresponde determinar, con base en la normativa infraconstitucional aplicable, así como los principios, creencias y costumbres ancestrales de la comunidad indígena Maleku, lo relativo a la titularidad y posesión del bien, quienes tienen derecho sobre la finca en cuestión, por cuanto ello no solo excede la naturaleza sumaria del recurso de amparo y la competencia de este Tribunal, sino que además, forma parte del derecho interno propio de la comunidad indígena, cuyos conflictos deben dirimirse a través de las vías y mecanismos dispuestos al efecto en el derecho consuetudinario indígena y el ordenamiento jurídico infraconstitucional (véanse en similar sentido las sentencias 2021009131 de las 09:05 horas del 07 de mayo de 2021, 2021007505 de las 09:15 horas del 16 de abril de 2021 y 2021008583 de las 09:15 horas del 30 de abril de 2021).

En todo caso, tal como lo indica el propio recurrente, el conflicto ya se encuentra judicializado ante la jurisdicción Contencioso Administrativa en el proceso que se tramita en expediente número 26 002909-1027-CA, así como en la vía penal, a través de la denuncia que se tramita en expediente número 26-001132-0306-PE; de manera que, será en esas vías donde deberá el recurrente no solo discutir el fondo del asunto, sino también gestionar las medidas cautelares que estimen procedentes para que se resuelva como en Derecho corresponda. En consecuencia, el amparo resulta inadmisible en cuanto a este extremo, como en efecto se declara.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
