Review of the Document CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty minutes on 10 September 2026.

Amparo proceeding filed by [Nombre 001], identity card [Valor 001], against the NATIONAL ROAD COUNCIL (CONAVI), the MUNICIPALITY OF OREAMUNO, and the MINISTRY OF HEALTH (MS).

Background:

  1. 1By a submission entered in the digital case file on 23 June 2026, the claimant files an amparo proceeding against CONAVI, the Municipality of Oreamuno, and MS. According to the order admitting the proceeding, the claimant states the following:

“[O]n 18 December 2025, acting as legal representative of [Nombre 006], the claimant submitted a request to CONAVI seeking the removal of the drains located on its property, located in Cipreses de Oreamuno, on Crossing Route No. 30703, because of the harm and damage they have caused on several occasions to the land, due to the wastewater and stormwater passing through the property, which has also affected the residential development located along the southern side of the property. The claimant alleges that, by LETTER-CONAVI-CA-DIE-GCSU-DRC-077 of 22 January 2026, CONAVI’s Road and Bridge Conservation Department responded as follows: ‘In conclusion, based on the General Public Roads Act (Law No. 5060), the request to remove the drains cannot be granted as presented, because the legal framework requires adjoining property owners to receive and allow the water from the road to flow through, and to keep the immediate drains in perfect condition and free of obstructions.

Consequently, CONAVI cannot remove drainage infrastructure necessary for road safety and conservation in response to a particular request, especially when any damage must be substantiated by an expert report and wastewater matters fall within the responsibility of the Ministry of Health and the Costa Rican Institute of Aqueducts and Sewers (AyA), not this Administration. Therefore, the request for removal is denied and, instead, only measures that are technically appropriate within the institution’s authority to ensure proper drainage and protection of the public interest may be taken.’ The claimant adds that a complaint, No. 0108-2025, was also filed with the Ministry of Health concerning the environmental damage caused by the same situation. However, the claimant alleges that the following response was received: ‘According to the investigation and inter-institutional coordination carried out by this official, the wastewater from the upper part of the La Pavilla sector is indeed discharging onto the complainant’s property.

The owners’ current position is that they do not wish to continue receiving their neighbors’ wastewater, and therefore the request to CONAVI is aimed at diverting that water. We are awaiting the technical report from CONAVI engineer Braulio Fonseca to determine the actions this Ministry should take.’ The claimant adds that a request was also submitted to the Municipality of Oreamuno, which was answered by agreement 3-2026, considered at regular meeting No. 26-2025 held by the Cantonal Road Board on 16 February 2026, which states: ‘It is unanimously agreed: To forward to CONAVI the letter sent by Mr. [Nombre 001], legal representative of [Nombre 006], legal entity ID No. [Valor 002], for the corresponding analysis, since this is a crossing route within that entity’s jurisdiction. A copy is sent to the interested party and the Cantonal Road Board for their information. Final agreement.’ The claimant argues that, as of the date this proceeding was filed, the reported problem had not been resolved and therefore considers their fundamental rights to have been violated.”

  1. 2By order issued at 13:59 on 29 June 2026, this proceeding was admitted and the respondent authorities were asked to report on the facts alleged by the claimant.
  2. 3By a submission entered in the digital case file on 7 July 2026, Erick Mauricio Jiménez Valverde, in his capacity as mayor of the Municipality of Oreamuno de Cartago, reports under oath that:

“FIRST: Having reviewed the proceeding filed by the claimant, Mayor Erick Jiménez Valverde, on behalf of the Municipality of Oreamuno, provides this report under oath. SECOND: The Technical Unit and Road Management, and its head, Eng. Carlos Núñez Castro, have managed the problem with the Cantonal Road Board on 16 February 2026. The reported case falls within CONAVI’s jurisdiction, and the problem was referred to Eng. Braulio Fonseca Ramírez, zone engineer, Road and Bridge Conservation Department, since it concerns Crossing Route No. 30703, a matter within that entity’s jurisdiction. THIRD: Likewise, regarding the stated problem, the Municipality will continue coordinating with CONAVI and the Ministry of Health to provide a solution or assistance in this case reported by the claimant. FOURTH: Mr. [Nombre 001] is being notified of the request submitted to the Constitutional Chamber at the email address: [email protected], and a call was made to mobile numbers: 8610-9573/8382-4014.”

  1. 4By a submission entered in the digital case file on 7 July 2026, Jason Adrián Pérez Anchía, in his capacity as executive director of CONAVI, reports under oath that:

“II. PRELIMINARY CONSIDERATIONS (BACKGROUND) Before analyzing the facts set out by the claimant, it is appropriate to clarify the administrative context in which this request arose. On 18 December 2025, Mr. [Nombre 001], acting on behalf of [Nombre 006], submitted a request to the National Road Council seeking removal of the drains on National Crossing Route No. 30703, arguing that discharges from the drainage system were affecting property belonging to the entity he represents. Before that request, specifically on 10 December 2025, the Ministry of Health coordinated an inter-institutional inspection at the site, with the participation of officials from that Ministry and the National Road Council, in order to verify the existing conditions and technically assess the reported situation. Following that inspection and the technical and legal analysis conducted by the Road and Bridge Conservation Department, the National Road Council issued LETTER-CONAVI-CA-DIE-GCSV-DRC-077-2026, dated 22 January 2026, formally responding to the requester and explaining the technical, legal, and jurisdictional reasons why it could not grant the request to remove the existing drainage structures.

Those structures form an integral part of the hydraulic infrastructure of the National Route and are essential to road safety, proper evacuation of stormwater, and preservation of public infrastructure. Subsequently, in connection with this amparo proceeding, the Road and Bridge Conservation Department issued the technical report contained in LETTER-CONAVI-CA-DIE-GCSV-DRC-1143-2026, which confirms the institutional position previously communicated to the claimant, describes the actions taken by the Administration, and concludes that there are no new facts justifying a change to the technical position adopted by the National Road Council. It also states that no specific damage technically attributable to the operation of the drainage system administered by this Institution has been substantiated. It is therefore clear that the National Road Council has not remained inactive in response to the claimant’s request.

On the contrary, it addressed the request in a timely manner, conducted field inspections, carried out the relevant technical assessments, coordinated actions with other competent institutions, and issued a formal response, duly reasoned and based on the legal system in force. Consequently, the subject of this proceeding is not an administrative omission or a failure by CONAVI to respond, but the claimant’s disagreement with the content of the administrative decision adopted. From a constitutional perspective, that is a substantially different matter, which will be addressed in the following sections. III. MERITS REVIEW Before addressing the facts set out by the claimant individually, this Administration considers it necessary to make several clarifications essential to defining the true subject of the dispute submitted to this Honorable Chamber for consideration. A comprehensive analysis of the amparo application and the documents in the administrative file shows that the claimant’s disagreement concerns the National Road Council’s decision not to grant the request to remove the existing drainage structures on National Crossing Route No. 30703, whose outlets are directed toward land owned by the company the claimant represents.

That circumstance, however, cannot be interpreted as an omission, arbitrary conduct, or illegitimate action by the National Road Council. On the contrary, the Administration addressed the request through the procedure applicable under the legal system, conducting technical inspections at the site, participating in the inter-institutional inspection convened by the Ministry of Health, assessing the existing infrastructure, analyzing the applicable legal framework, and issuing a formal, duly reasoned response setting out the technical and legal reasons why the requested relief could not be granted. In this regard, it is important to emphasize that this proceeding does not challenge the absence of an administrative response, but rather its content. That is, the claimant does not accuse the National Road Council of remaining silent in response to the request, but expresses disagreement with the technical and legal position by which this Administration concluded that removing the existing drainage infrastructure was not warranted, because it is an essential element for the proper hydraulic functioning of the National Route, the safety of its users, and the preservation of public infrastructure.

It should also be noted that the drainage works at issue were not recently carried out by the National Road Council. According to the technical information gathered during the inspections and the claimant’s own statements, this condition has existed for more than a decade, and the property owner knew of it and even voluntarily authorized it from the time it was built. This Administration also considers it essential to clarify that the claimant presents the situation as a single problem, although from a technical and legal standpoint it comprises two clearly distinct matters. On the one hand, there is the stormwater drainage system for National Crossing Route No. 30703, whose construction, maintenance, and operation fall to the National Road Council pursuant to the powers assigned to it by the Act Establishing the National Road Council and the General Public Roads Act. The purpose of these works is to collect, channel, and discharge stormwater from the roadway, thereby ensuring road safety and preservation of public infrastructure.

On the other hand, the claimant asserts that wastewater is being introduced into the drainage system. If that is occurring, it is a matter entirely distinct from the operation of the National Route’s stormwater drainage system and must be investigated, monitored, and addressed by the competent health authorities, particularly the Ministry of Health and, as applicable, the Costa Rican Institute of Aqueducts and Sewers. The National Road Council has no legal authority to intervene in those discharges. Accordingly, it is not legally valid to attribute all the situations described by the claimant to the National Road Council when a significant part of the reported facts concerns matters that the legislature has expressly assigned to other public institutions. It should also be clarified that the claimant’s request was not for a technical assessment or an investigation of the situation described.

What the claimant expressly requested was removal of the existing drains on the National Route. The Administration comprehensively analyzed that request and concluded, by means of a duly substantiated technical opinion, that the action was neither technically nor legally appropriate, since it would entail removing public infrastructure essential to the road’s proper hydraulic functioning, thereby jeopardizing road safety, pavement stability, and protection of the public interest. Thus, the alleged ‘failure to resolve the problem’ raised in the proceeding does not arise from an administrative omission, but from the claimant’s disagreement with the content of an administrative decision issued within the National Road Council’s powers and supported by technical and legal criteria and the public interest. In light of these considerations, this Administration will address each of the facts set out by the claimant individually.

IV. FACTS. In response to the facts summarized by that Honorable Constitutional Chamber in the order granting this Administration a hearing, they are answered as follows: Fact One: It is true that on 18 December 2025 Mr. [Nombre 001], acting as legal representative of [Nombre 006], submitted a request to the National Road Council seeking removal of the drains located on property owned by that company, located in the Barrio La Pavilla area, district of Cipreses, canton of Oreamuno, adjoining National Crossing Route No. 30703. The request was duly received, processed, and reviewed by the National Road Council’s competent technical departments, and the corresponding administrative assessment was initiated. Fact Two: It is true that the National Road Council issued LETTER-CONAVI-CA-DIE-GCSV-DRC-077-2026, dated 22 January 2026, formally responding to the claimant’s request. It is necessary to clarify, however, that this response was neither an unreasoned denial nor a failure to address the request.

On the contrary, it followed a technical and legal analysis by the Road and Bridge Conservation Department, which concluded that the requested removal of the outlets was not appropriate because they form part of a National Route’s drainage system and constitute infrastructure essential to ensure the road’s proper hydraulic functioning, road safety, and preservation of public infrastructure. The response also explained to the requester that any presence of wastewater is a matter outside the National Road Council’s powers and must be addressed by the competent health authorities. Fact Three: It is true that the claimant filed a complaint with the Ministry of Health and that the institution took actions related to the situation described. It should be clarified, however, that the National Road Council’s participation in that proceeding was limited to the scope of its legally assigned powers: it took part in the inter-institutional inspection convened by the Oreamuno Health Area on 10 December 2025, verified the conditions of the National Route’s drainage system, and provided the technical information requested.

Consequently, the actions taken by the Ministry of Health in its administrative proceeding cannot be attributed to the National Road Council and do not create additional obligations beyond the scope of authority assigned to it by law. Fact Four: It is true that the Municipality of Oreamuno considered the claimant’s request and agreed to refer it to the National Road Council because it concerned a National Crossing Route. In exercising that authority, the National Road Council considered the request, conducted the relevant inspections, technically assessed the existing infrastructure, and issued the institutional response mentioned above. Accordingly, it cannot be maintained that the Administration remained inactive in response to the claimant’s request. Fact Five: The assertion that the National Road Council failed to resolve the stated problem or committed an omission that violated fundamental rights is rejected.

What actually occurred was that, after carrying out the corresponding technical assessment, the Administration concluded that the specific solution requested by the claimant—namely, removal of the existing drainage structures—was neither technically nor legally appropriate. Consequently, the claimant’s disagreement concerns the content of the administrative decision and not an absence of an institutional response. In addition, the inspections carried out by the Road and Bridge Conservation Department identified no specific, current damage technically attributable to the operation of infrastructure administered by the National Road Council, nor any new facts that would justify changing the technical position issued in LETTER-CONAVI-CA-DIE-GCSV-DRC-077-2026 (…) VI. CONCLUSIONS In accordance with the established facts, the documents submitted, and the legal analysis set out, this Administration concludes as follows: 1.

The National Road Council addressed Mr. [Nombre 001]’s request in a timely manner and took the administrative and technical actions required within the scope of its legal powers, including participating in the inter-institutional inspection convened by the Ministry of Health, technically assessing the existing infrastructure, and issuing a formal, reasoned, and duly substantiated response through LETTER-CONAVI-CA-DIE-GCSV-DRC-077-2026. 2. The drainage infrastructure at issue forms an integral part of the hydraulic system of National Crossing Route No. 30703 and is essential for collecting, channeling, and discharging stormwater. It is necessary to ensure road safety, preserve public infrastructure, and protect the general interest, as determined by the Road and Bridge Conservation Department. 3. The Administration’s technical analysis determined that there are no grounds to justify removing or modifying the existing drainage structures.

For that reason, the claimant’s request was denied by a duly reasoned decision adopted on the basis of technical and legal criteria and the public interest. 4. The issue of possible wastewater entering the drainage system is distinct from the National Route’s stormwater drainage and, therefore, its investigation, control, and any resulting action fall to the Ministry of Health and, as applicable, the Costa Rican Institute of Aqueducts and Sewers. The National Road Council has no legal authority to intervene in those discharges. 5. No arbitrary, illegitimate, or omissive conduct attributable to the National Road Council has been established. On the contrary, the Administration acted in strict compliance with the principle of legality, within the scope of the powers conferred on it by the legal system, observing the principles of reasonableness and proportionality and protecting the public interest. 6.

The claimant’s disagreement does not arise from an absence of an administrative response, but from disagreement with the content of the technical and legal decision adopted by the National Road Council. That circumstance, by itself, does not constitute a violation of fundamental rights that may be remedied through an amparo proceeding. 7. Accordingly, a comprehensive review of the case file reveals no action or omission attributable to the National Road Council that has violated or threatens to violate the fundamental rights invoked by the claimant. Therefore, the constitutional requirements for granting this proceeding against that institution have not been met.”

  1. 5By a submission entered in the digital case file on 9 July 2026, Oscar Rodríguez González, in his capacity as director of the Oreamuno Health Area, reports under oath that:

“II. ACTIONS OF THE MINISTRY OF HEALTH IN THE CASE AT ISSUE: Background: On 26 August 2025, this Health Area Directorate received a complaint against the neighbors in the La Pavilla sector, located in the canton of Oreamuno, district of Cipreses, specifically 700 meters south of Bar Chaquetas, on the National Route road toward Cervantes. It was assigned consecutive number No. 0108-2025 because an underground pipe crosses the public road and carries stormwater and soapy water toward part of the complainant’s property, causing problems for the agricultural crops and livestock on the property. On 10 December 2025, official [Nombre 005] conducted an inspection visit together with CONAVI engineer Braulio Fonseca and engineer Valeria Zuñiga and the complainants, as recorded in Inspection Record MS-DRRSCE-DARSO-AIO-GQM-01-2025. During the visit, they managed to ‘…identify a concrete pipe that receives wastewater from the settlement farther up the road, crosses beneath the National Route, and then discharges onto the complainants’ property…’ [Sic] (See folio No. 0007), as recorded in Technical Report No. MS-DRRSCE-DARSO-IT-0201-2026, signed by official [Nombre 005] and dated 7 July 2026.

According to the aforementioned Technical Report, the complainants state ‘…that this pipe was installed many years ago when the road (National Route) was paved and that their father agreed at that time to receive the water in his capacity as owner because it was only stormwater. [Sic] (See folios Nos. 0034 to 0040). During the joint visit, and as recorded in Technical Report No. MS-DRRSCE-DARSO-IT-0201-2026, CONAVI engineer Braulio Fonseca ‘…tells the complainants that they must prepare a letter requesting an opinion based on the analysis of the case background, to be submitted by email.’ [Sic] (See folios Nos. 0004 to 0006). On 17 January 2026, email No. CARTA-CONAVI-CA-DIE-GCSV-DRC-077-2026 was received (see folios Nos. 0011 to 0013), signed by CONAVI engineer Braulio Fonseca Ramírez, zone 1-7, setting out his opinion on the case and stating: ‘In conclusion, based on the General Public Roads Act (Law No. 5060), the request to remove the drains cannot be granted as presented, because the legal framework requires adjoining property owners to receive and allow the water from the road to flow through, and to keep the immediate drains in perfect condition and free of obstructions.

Consequently, CONAVI cannot remove drainage infrastructure necessary for road safety and conservation in response to a particular request, especially when any damage must be substantiated by an expert report and wastewater matters fall within the responsibility of the Ministry of Health and the Costa Rican Institute of Aqueducts and Sewers (AyA), not this Administration. Therefore, the request for removal is denied and, instead, only measures that are technically appropriate within the institution’s authority to ensure proper drainage and protection of the public interest may be taken…’ [Sic] (See folio No. 0012). According to Technical Report No. MS-DRRSCE-DARSO-IT-0201-2026, on 27 January 2026, official [Nombre 005] held a meeting with the complainants in the meeting room of the Oreamuno Health Area Directorate. At that meeting, the following was agreed: ‘The complainants state that, after discussing the matter as a family, they decided not to stop the water from entering the property, but rather to ask the person leasing the land to carry out regular and timely maintenance of the channel.

Their father, who owns the property, decided not to interfere in the matter, so his daughters, who are responsible for the situation, will handle it. They add that they are concerned because during the rainy season the amount of water entering the property is considerable and, at the end of the property, the neighbors in Residencial La Pavilla have placed a mesh screen on the public road. Given the amount of water during the rainy season and the possibility that the screen may become clogged and fail, flooding could occur, affecting both the property and the public road and, consequently, the homes in Residencial La Pavilla, since their land is lower. In anticipation of this situation, this official proposes a meeting with the parties involved so that they can determine who is responsible for maintaining both the channel within the property and the screen placed by the neighbors in Residencial La Pavilla.

A meeting is agreed for Wednesday, 4 February 2026, at 1:30 p.m. at the site, with members of the Cipreses Development Association, the neighbors in Residencial La Pavilla, the complainants, and this official, in order to reach good agreements and find solutions benefiting all parties.’ [Sic] (See folio No. 0018). On 4 February 2026, according to Technical Report No. MS-DRRSCE-DARSO-IT-0201-2026, a meeting organized by official [Nombre 005] took place, attended by [Nombre 002], [Nombre 001], [Nombre 003], and [Nombre 004] as complainants and property owners; Sonia Coto Solano on behalf of the Cipreses Development Association and as a member of the Municipal District Council; Agnes Mora Rugama on behalf of the neighbors in Residencial La Pavilla; and Carlos Mora Ulloa, who leases the land for cultivation. The following was agreed: ‘The property owners state that, although their father authorized the stormwater to enter the property years ago, his daughters, who are the heirs, do not agree with that decision now.

They add that for years they have received not only stormwater but also wastewater from homes in the sector, so the problem is becoming increasingly difficult. They state that the neighbors in Residencial La Pavilla placed a grate at the end of the property, on the public road side, to ensure that any solid waste carried by the channel remains there and does not enter the pipe leading into the residential development and cause flooding in the homes. They add that the neighbors in the residential development who installed the grate do not maintain it, causing the water to stagnate on the property and damage adjacent crops. They also state that Carlos Mora Ulloa, who leases the land for cultivation, carried out some maintenance work on the channel located within the property. In response, Agnes Mora Rugama states that their homes have indeed been affected during the rainy season because debris has blocked the pipe, causing flooding in the residential development.

The grate is observed to be blocked with plant remains carried by the rain into the channel entering the Martínez family’s property, causing the grate to become blocked and preventing the free flow of water. Ms. Agnes Mora Rugama is told that the neighbors in Residencial La Pavilla are responsible for keeping the grate clean to prevent it from becoming blocked, and she agrees. Carlos Mora Ulloa, who leases the property for cultivation, is told that he must keep the channel clear to prevent debris from falling into it, which could cause a blockage and consequently overflow and flood the crops. Sonia Coto Solano, representing the Cipreses District Council before the Municipality of Oreamuno, is asked to use her good offices with the Road Commission, of which she is an active member, to raise the problem and request a written technical opinion to assist in reaching a decision. This official tells the parties involved that conducting house-by-house inspections to determine which homes discharge their wastewater into the storm sewer and then onto Mr. [Nombre 001]’s property is a very slow process, so it must be carried out gradually.

Based on this, inspections will be scheduled gradually, depending on the Health Area’s capacity, to begin the house-by-house inspection process. Since this concerns wastewater entering the storm sewer, simply requesting that the kitchen sink pipe be opened would make it possible to determine which homes are doing so and which are not.’ [Sic] (See folios Nos. 0029 to 0030). On 4 February 2026, an inspection visit was made to 4 homes, with a positive result for wastewater originating from laundry sinks. On 1 July 2026, inspection visits in the sector were rescheduled; however, only one home could be assessed because no one opened the doors at the other homes. Visits will therefore be rescheduled for a different day and time. This Health Area Directorate will issue the corresponding Health Orders and schedule the relevant follow-up, and will keep the complainants and this Honorable Constitutional Chamber informed.

It is important to mention that, according to Technical Report No. MS-DRRSCE-DARSO-IT-0201-2026, the residential development has no stormwater infrastructure. This situation aggravates the reported problem, and as of the preparation of this document, no opinion has yet been received from CONAVI or the Municipality of Oreamuno regarding construction of the infrastructure works necessary to channel the stormwater from this residential development.”

  1. 6By certification dated 13 July 2026, the following was recorded:

“[U]pon review at eight hours and twenty-eight minutes on 13 July 2026, in the COSTA RICAN JUDICIAL CASE MANAGEMENT SYSTEM, of the REGISTER OF DOCUMENTS RECEIVED AND THIS CASE FILE, it did not appear that, between 29 June and 12 July 2026, the CONAVI ROAD AND BRIDGE CONSERVATION MANAGER had submitted any written statement or document to provide the report requested in the order issued at thirteen hours and fifty-nine minutes on 29 June 2026, in case file No. 26-022578-0007-CO, which is an AMPARO PROCEEDING brought by [Nombre 001].”

  1. 7In the proceedings followed, the legal requirements have been observed.

Prepared by Justice Garro Vargas; and, Reasons:

I.Subject of the proceeding. The claimant states that a request was submitted to the respondent authorities to remove the drains from the property of [Nombre 006], located on Crossing Route No. 30703 in Cipreses de Oreamuno, because they cause damage to the land and the residential development located along the southern side of the property, due to wastewater and stormwater passing through that property. The claimant alleges, however, that CONAVI stated the request could not be granted because the legal framework requires adjoining property owners to receive and allow the water from the road to flow through and to keep the drains in perfect condition and free of obstructions, while the other authorities continue to fail to assist in resolving the stated problem. The claimant requests the Chamber’s intervention.

II.Preliminary issue. Since the CONAVI Road and Bridge Conservation manager failed to submit the report within the time set by this Court in the order admitting this matter, in accordance with Article 45 of the Law on Constitutional Jurisdiction, the constitutionality of the matter will be analyzed on the basis of the other evidence submitted to the case file.

III.Exception to Article 41 of the Political Constitution. Before considering the merits of the matter—concerning the alleged violation of the right to a prompt and duly completed procedure—it must be clarified that, since judgment No. 2008-02545 of 8:55 on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—those matters in which it is disputed whether the public administration has or has not complied with the time limits established by the General Public Administration Act (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, for issuing a final act in an administrative proceeding—instituted on its own initiative or at a party’s request—or for considering the available administrative appeals. This case presents an exception, since, according to the claimant, it concerns a complaint filed with the respondent authorities regarding a problem involving the discharge of wastewater and stormwater that allegedly has not been resolved. That point having been clarified, the specific situation raised in this amparo proceeding will now be decided.

IV.Facts found. The following facts are deemed duly established and relevant to the decision in this matter:

On 10 December 2025, the Oreamuno Health Area initiated an inter-institutional inspection with the participation of CONAVI officials, for the purpose of verifying the conditions at the site, identifying the drainage infrastructure present, and gathering technical information related to the reported situation (see evidence submitted).

On 18 December 2025, the claimant submitted a request to CONAVI seeking removal of the drains from the property of [Nombre 006], located on Crossing Route No. 30703 in Cipreses de Oreamuno, because they cause damage to the land and the residential development located along the southern side of the property, due to wastewater and stormwater passing through that property (undisputed fact).

In technical report No. MS-DRRSCE-DARSO-IT-05-2026 of 19 January 2026, personnel from the Oreamuno Health Area recorded the following findings from the inspection conducted:

“Upon arriving at the location with CONAVI officials, engineer Braulio Fonseca and engineer Valeria Zúñiga, after coordinating with the parties, the investigation tour was carried out. Together with the complainants, we were able to determine that there is a concrete pipe receiving wastewater from the settlement farther up the road, which crosses beneath the National Route and then discharges onto their property. The complainants state that this pipe was installed many years ago when the road (National Route) was paved and that their father agreed at that time, as property owner, to receive the water because it was only stormwater. Despite this, the heirs do not currently agree to continue receiving that water, especially considering that it now includes wastewater and not just stormwater. CONAVI engineer Braulio Fonseca tells the complainants that they must prepare a letter requesting an opinion based on the analysis of the case background, to be submitted by email. Accordingly, we await action by the complainants and a subsequent opinion from CONAVI official engineer Braulio Fonseca to determine whether this Ministry must take any other action. No breach of Ley 9028 or Ley 10066 or their Regulations is found, and therefore this Ministry takes no action in relation to this matter.” On that basis, they issued the following conclusions:

“According to the investigation and inter-institutional coordination carried out by this official, the wastewater from the upper part of the La Pavilla sector is indeed discharging onto the complainants’ property. The owners’ current position is that they do not wish to continue receiving their neighbors’ wastewater, and therefore the request to CONAVI is aimed at diverting that water. We are awaiting the Technical Report from CONAVI engineer Braulio Fonseca to determine the actions this Ministry should take. RECOMMENDATIONS: It is recommended that follow-up be provided, if necessary, after CONAVI’s Technical Opinion” (see evidence submitted).

By means of letter No. CARTA-CONAVI-CA-DIE-GCSV-DRC-077-2026 of 22 January 2026, CONAVI’s Road and Bridge Conservation Department addressed the claimant’s request as follows:

“With regard to the request for intervention concerning Travesía Route No. 30703, the following is stated as a consequence: BACKGROUND By means of a document received by email on 18 December 2025, signed by Mr. [Nombre 001], legal representative of Maiodora S.R.L., the request to eliminate the drains located on its property, situated in Cipreses de Oreamuno, Barrio La Pavilla, is set out as follows: ‘…in my capacity as legal representative of Maiodora S.R.L., corporate identification number [Valor 002], I wish to vehemently request the elimination of the drains located on my property, situated in Cipreses de Oreamuno, in Barrio La Pavilla, by the road that runs along the west side of the property. On one occasion more than 10 years ago, I voluntarily authorized the construction of the aforementioned drains on my property, but this has caused me multiple problems involving contamination, flooding, damage to crops, and even damage to the residential development located on the south side of the property, due to the stormwater and wastewater coming from the road, since Conavi did not install the corresponding roadside drainage channels at the time…’ (…) FINDINGS AND LEGAL BASIS As part of the process of addressing and following up on the complaint initially filed with the Ministry of Health, that institution coordinated and called a joint site inspection, during which the appellant formally submitted his request for action.

During the inspection conducted on 10 December 2025, the existence of cross-drainage structures was confirmed, with outlets directed toward the identified property. Based on what was observed in the field and what the owner indicated, that discharge is attributable to a condition that has persisted for more than a decade, associated with the historical management of stormwater runoff in the area, before its current urban development. It is likewise established that the appellant acknowledges that this condition was voluntarily authorized more than ten years ago. The owner also stated that wastewater from nearby homes may be entering the drainage system. In this regard, it is clarified that CONAVI lacks legal authority to manage, treat, or intervene in wastewater. In accordance with the Ley General de Salud (Ley N.° 5395) and the Reglamento de Vertido y Reúso de Aguas Residuales (Decreto Ejecutivo N.° 33601-S-MINAE), those responsibilities fall to the Ministry of Health and the Instituto Costarricense de Acueductos y Alcantarillados (AyA).

Regarding the request to ‘eliminate the drains,’ it is reported that granting the request as presented is not legally appropriate, pursuant to the Ley General de Caminos Públicos (Ley N.° 5060), for the following reasons: a) Nature and public purpose of road drainage. Cross-drainage and its outlets constitute infrastructure essential to the preservation, stability, and safety of the road. In this context, removing existing outlets without an equivalent technical solution would transfer the hydraulic and geotechnical risk to the roadway and third parties, which is incompatible with the public interest protected by the applicable regulations. Ley N.° 5060 also recognizes the public nature of roads and the State’s authority over their construction and improvement. b) Legal obligation of the adjoining landowner regarding road waters and drains. Ley N.° 5060 provides that possessors of adjoining properties are required to receive and allow the waters from roads to flow when the difference in terrain elevation so requires and, when their properties are adjacent to drains, they must keep them in perfect operating condition and free of obstructions.

Consequently, the requested removal does not comply with the applicable legal framework. c) Claims for damages: expert opinion requirement and limitation period. If a claim for compensation is pursued, the law requires that every estimate of damages and losses be supported by an expert opinion and establishes a one-year limitation period for claiming compensation from the time the damage is caused. Accordingly, general allegations of damage without technical and expert support and without a specific time frame do not require the Administration to remove public infrastructure. Without prejudice to the foregoing, this Administration will continue the technical inspections necessary to determine, within the scope of its authority, the measures appropriate to ensure the proper functioning of the drainage system and protection of the road. Finally, if the possible entry of wastewater is confirmed, it is reiterated that its assessment and handling fall within the remit of the corresponding health authorities, as this matter is outside CONAVI’s authority.

CONCLUSIONS In conclusion, based on the Ley General de Caminos Públicos (Ley N.° 5060), the request to eliminate the drains cannot be granted as presented, since the legal framework requires adjoining landowners to receive and allow road waters to flow and to keep nearby drains in perfect condition and free of obstructions. Consequently, CONAVI cannot remove drainage infrastructure necessary for road safety and preservation in response to an individual request, especially since any damage must be substantiated by an expert opinion and wastewater matters fall to the Ministry of Health and the Instituto Costarricense de Acueductos y Alcantarillados (AyA), not this Administration. Therefore, the request for removal is denied and, instead, only such measures as are technically appropriate within the institution’s authority to ensure the proper functioning of the drainage system and protection of the public interest will be taken’ (see report submitted under oath and evidence provided).

The CONAVI authorities stated:

‘In the reported area there are cross-drainage works that form part of the road infrastructure of the National Route, whose purpose is to collect and convey stormwater from the road to its natural discharge point, through the respective outlets located on the adjoining land’ (see evidence provided).

On 4 February 2026, the Oreamuno Health Area Office conducted an inspection in the affected area (see evidence provided).

By means of technical report no. MS-DRRSCE-DARSO-IT-37-2026 of 2 March 2026, the staff of the Oreamuno Health Area Office concluded:

‘The reported problem has worsened, since currently it involves not only stormwater but also wastewater coming from homes in the area. In the area where the complainant’s property is located, wastewater from the homes can clearly be seen crossing the street through a concrete pipe and then discharging at this point. Within the property there is a channel dug into the ground that receives all the water, both stormwater and wastewater, when the proper course is for this water to flow through the infrastructure located along the edge of the street. The complainant does not wish to receive the wastewater any longer, so the steps taken before the institutions seek to have the pipe removed and/or relocated. The position stated by CONAVI specifies that the Ministry of Health is responsible for the wastewater from the homes, which is correct; therefore, this official must take the actions required in accordance with the responsibilities of my institution. RECOMMENDATIONS: 4 It is recommended that monthly visits be scheduled to begin a gradual, house-by-house assessment to determine which homes discharge wastewater into the storm sewer, a situation that must be corrected under current legislation’ (see evidence provided).

On 13 February 2026, the appellant submitted a request to the Cantonal Road Board of the Municipality of Oreamuno (see report submitted under oath and evidence provided).

On 16 February 2026, the Cantonal Road Board of the Municipality of Oreamuno considered the problem reported by the appellant (see report submitted under oath and evidence provided).

By means of resolution no. 3-2026 of 16 February 2026, the Cantonal Road Board of the Municipality of Oreamuno agreed to refer the complaint to CONAVI as the competent authority, specifically to Eng. Braulio Fonseca Ramírez of CONAVI’s Road and Bridge Maintenance Department, because it concerns route no. 30703 (see report submitted under oath and evidence provided).

On 22 April 2026, the Oreamuno Health Area Office conducted an inspection in the affected area (see evidence provided).

On 1 July 2026, the Oreamuno Health Area Office conducted an inspection in the affected area (see evidence provided).

By means of technical report no. MS-DRRSCE-DARSO-IT-201-2026 of 7 July 2026, the staff of the Oreamuno Health Area Office recorded the following findings from the inspection conducted:

‘It is this official’s view that it is not necessary to conduct fluorescein tests, since the approach is to ask each person in the home to open the sink pipe so it can be observed. There is no infrastructure along the edge of the street to channel stormwater, so what can be seen is the conventional roadside gutter. The investigation begins with the first home from north to south, belonging to Mr. Adolfo Mora Castro, holder of identity card No. 302930354. POSITIVE RESULT. Next, the home of Mr. Guillermo Mora Castro, holder of identity card No. 10816019, is visited. POSITIVE RESULT. The investigation continues at the home of Mr. Victor Gómez Rivas, holder of identity card No. 303850193. POSITIVE RESULT. The home of Mr. Melvin Mora (second surname unknown) is assessed; no one is present, but his neighbor indicates that all the homes discharge their wastewater into the roadside gutter. POSITIVE RESULT.

On 1 July 2026, the investigation continues; this time it is only possible to assess the home of Mr. Abel Manrow Umaña (identity card number unknown). His daughter attends to me and says that, indeed, the soapy water from her father’s home also discharges into the roadside gutter. POSITIVE RESULT. The investigation continues. Potato residue is observed in the roadside gutter; according to the neighbors, there is a laundry business on the property, so that residue apparently comes from that location. The property belongs to Mr. Manuel Fernández Gómez. The intercom is rung several times; after a while, a person answers who says she is the cleaning lady and reports that her employers are not there at that time, so it is not possible to determine whether wastewater from this business discharges into the roadside gutter. The inspection continues at the remaining homes, but no one comes out when called from the street, so the investigation must be rescheduled to continue. No violation of Ley 9028 or Ley 10066 and their Regulations is established, so this Ministry takes no action on this matter.’ Based on the foregoing, they issued the following conclusions:

‘The reported problem has worsened, since wastewater from homes in the La Pavilla area is now discharging onto the complainant’s property in addition to stormwater. There is no infrastructure anywhere in the La Pavilla area to receive and channel stormwater, so in some stretches it runs along the edge of the street and in others through a channel dug directly into the ground. In the area where the complainant’s property is located, wastewater from the homes can clearly be seen crossing the street through a concrete pipe and ultimately discharging onto the property. Within the property there is a channel dug into the ground that receives all the water, both stormwater and wastewater. It is unknown whether the channel has always existed naturally or was created to channel the water. The complainant states that they no longer wish to receive wastewater, so the steps taken before the institutions seek to have the pipe removed and/or relocated.

The position stated by CONAVI in Official Letter CARTA-CONAVI-CA-DIE-GCSV-DRC-077-2026 is that resolving the problem is outside its authority and that the Ministry of Health is responsible for wastewater from the homes; it therefore recommends that this agency take the actions required in accordance with our authority. To date, five homes have been assessed, and they discharge their wastewater into the roadside gutter in front, which crosses the street through a concrete pipe and ultimately flows onto the complainant’s property. The investigation must be rescheduled to determine with certainty which other homes and/or businesses in the area are discharging wastewater onto the complainant’s property and to take the corresponding actions under current legislation. RECOMMENDATIONS: It is recommended that a Sanitary Order be issued requiring the necessary work to be carried out within the properties so that wastewater is treated and channeled directly to drainage in such a way that it does not reach the roadside gutter in front of the homes and subsequently discharge onto the complainants’ property.

Mr. Adolfo Mora Castro, holder of identity card No. 302930354. Mr. Guillermo Mora Castro, holder of identity card No. 10816019. Mr. Victor Gómez Rivas, holder of identity card No. 303850193. Mr. Melvin Mora (second surname and identity card number unknown). Mr. Abel Manrow Umaña (identity card number unknown). Reschedule the investigation to continue at the remaining homes and establishments’ (see evidence provided).

The Oreamuno Health Area Office authorities stated:

‘[T]here is no stormwater infrastructure in the residential development, which exacerbates the reported problem, and, at the time this document was prepared, no position had yet been received from CONAVI or the Municipality of Oreamuno regarding the construction of the infrastructure works necessary to channel stormwater from this residential development’ (see report submitted under oath).

V.Facts not proven. The following facts are not considered duly proven:

That the CONAVI authorities have adopted any appropriate measures to ensure the proper functioning of the drainage system and protection of the road (the record).

That the Oreamuno Health Area Office authorities have issued the corresponding Sanitary Orders, as provided for in technical report no. MS-DRRSCE-DARSO-IT-201-2026 of 7 July 2026 (the record).

VI.The specific case. In this matter, based on the established facts, it is proven that the respondent authorities were indeed fully aware of the problem reported by the appellant, but it has not been clearly established what actions and interinstitutional coordination the CONAVI authorities and the Oreamuno Health Area Office undertook to resolve that problem definitively.

As follows from the reports submitted under oath—with due warning of the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—the affected area is in Barrio La Pavilla, district of Cipreses, canton of Oreamuno, adjoining National Travesía Route no. 30703. The record shows that various interinstitutional inspections have been conducted by CONAVI and the Oreamuno Health Area Office, as detailed in proven facts c, g, and m. In this regard, it is confirmed that a problem does in fact exist, caused by the discharge of stormwater and wastewater onto the property in question, affecting the right of the area’s residents to enjoy a healthy, ecologically balanced environment and a dignified quality of life.

Now, although this Court understands that the problem reported cannot be resolved on the terms sought by the appellant, as he was advised by Official Letter no. CARTA-CONAVI-CA-DIE-GCSV-DRC-077-2026 of 22 January 2026, the fact remains that the problem persists and the corresponding actions have not been taken within the respondents’ areas of authority to resolve or mitigate the discharge of this water onto the reported property. Note that, on the one hand, the CONAVI authorities told the appellant that they would conduct the technical inspections necessary to determine, within the scope of their authority, the measures appropriate to ensure the proper functioning of the drainage system and protection of the road; however, there is no evidence that they did so. On the other hand, the MS authorities recommended issuing various Sanitary Orders against the owners of the properties that were discharging wastewater; nevertheless, it has not been proven that those orders were issued, much less served.

Accordingly, this Chamber determines that the CONAVI authorities and the Oreamuno Health Area Office have failed to take the actions and measures aimed at carrying out the appropriate works to channel and convey stormwater and wastewater so that it does not flow through the area identified by the appellant. In this Constitutional Court’s view, regardless of the actions for which each authority is responsible in this matter under its respective sphere of authority, the fact remains that, in the present case, their inertia and lack of efficiency in promptly addressing the reported situation are evident. This constitutes a violation of the right to a prompt and duly completed procedure and poses a risk to the residents of the area affected by the water discharge.

In light of the foregoing, the appropriate course is to grant the amparo proceeding solely against these authorities, on the terms set out in the operative part of this judgment.

VII.Lastly, as regards the authorities of the Municipality of Oreamuno, the appropriate course is to dismiss the amparo proceeding, since, before it was filed, they referred the complaint to CONAVI, the authority competent to resolve the alleged problem because it concerns a national route.

VIII.Note of Justice Castillo Víquez regarding prompt and duly completed administrative justice. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and duly completed justice in administrative proceedings, the dispute must be heard by the Administrative Litigation Courts and not by this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right may be protected judicially through the amparo proceeding established by Article 32 of the Law on Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s actions, its administrative acts, or its response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of precedent, since under Article 7 of its Law it is exclusively for this Court to define its own jurisdiction.

Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo proceeding, in all other cases, and for the reasons given by this Court (judgment No. 2008-02545, at 8:55 a.m. on 22 February 2008), the competent courts are the Judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable legal provisions, based on a logical, systemic, and teleological interpretation of the legal system.

IX.Dissenting vote of Justice Garro Vargas regarding enforcement of the judgment.

I dissent regarding enforcement of the judgment, so that, pursuant to Article 56 of the Law on Constitutional Jurisdiction (LJC), enforcement is assigned to the Enforcement Area of the Administrative and Civil Treasury Court.

Enforcement of orders issued by the Constitutional Chamber is, in principle, to be overseen by that same jurisdiction. However, that provision establishes exceptions under which the Court may order enforcement of the judgment to be assigned to the administrative-litigation jurisdiction:

‘Art. 56. Enforcement of judgments is the responsibility of the Constitutional Chamber, except as regards the assessment and payment of compensation and pecuniary liabilities, or other matters that the Chamber itself considers appropriate, in which case it shall be carried out in the administrative-litigation jurisdiction, under the judgment enforcement procedure provided for in the law governing that jurisdiction.’ (Emphasis does not appear in the original.)

It should be recalled that the draft bill under discussion for the LJC originally provided as follows:

‘Art. 56. Judgments favorable to the appellant shall be enforced in the administrative-litigation jurisdiction, under the judgment enforcement procedure provided for in the law governing that Jurisdiction.’ (Emphasis does not appear in the original.)

However, the text was amended by motion so that the provision would be consistent with Article 153 of the Political Constitution, and the following explanation was given:

‘THE SECRETARY:

There was a contradiction here with the general principle that the Courts enforce their own judgments, and all enforcement was being sent to the Administrative Litigation Jurisdiction; the other articles allowing the Chamber to enforce them would then be left hanging.

That part says: “or other matters that the Chamber itself considers appropriate…,” what is it referring to?

The idea is that the Chamber, in the judgment enforcement proceeding, resolves what it considers to be its responsibility. The rest is sent to the Administrative Litigation Jurisdiction.

It is clear from the foregoing that the LJC itself authorizes this Chamber to assess and decide whether it is necessary to refer all or some aspects relating to enforcement of the judgment to the administrative-litigation jurisdiction.

In this specific case, given the nature of the orders being issued by this Court, I consider it appropriate to assign the enforcement phase of the matter to the administrative-litigation jurisdiction. This is due to the lack of suitable mechanisms under the regulations governing this constitutional jurisdiction to monitor the orders set out in this judgment, which involve highly complex technical matters.

By contrast, the provisions of the Código Procesal Contencioso-Administrativo regarding enforcement (Article 155 et seq.) offer clear advantages, such as the ability to request schedules, impose fines, assign responsibility, and monitor stages of compliance, among others. Therefore, pursuant to Article 56 of the LJC, I consider that the enforcement phase should take place before the Enforcement Area of the Administrative and Civil Treasury Court, under that Code’s judgment enforcement rules.

X.Documents provided to the case file. This Chamber must instruct the appellant that, if any paper documents, objects, or evidence supported by any additional device, or by electronic, computer, magnetic, optical, telematic, or new technology media were provided, they must be collected from the Court’s offices within 30 business days after receipt of notice of this judgment; otherwise, all such materials will be destroyed in accordance with the provisions of the ‘Regulations on Electronic Case Files before the Judiciary,’ approved by the Corte Plena at its session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at its session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo proceeding is granted in part due to the failure to act of the Consejo Nacional de Viabilidad and the Ministry of Health. Oscar Rodríguez González, in his capacity as director of the Oreamuno Health Area Office, or whoever holds that office, is ordered to take the necessary steps so that the relevant Sanitary Orders are issued IMMEDIATELY and the necessary coordination is carried out to ensure compliance. Likewise, Jason Adrián Pérez Anchía, in his capacity as executive director of the Consejo Nacional de Viabilidad, and Oscar Rodríguez González, in his capacity as director of the Oreamuno Health Area Office, or whoever holds those offices, are ordered to take all appropriate and necessary actions within the scope of their respective authority so that, within a maximum period of SIX MONTHS from service of this judgment, a plan is adopted with measures to channel and convey the water in order to correct the health problem concerning the routing of wastewater and stormwater discharges in the area that is the subject of this proceeding.

They are advised that, pursuant to Article 71 of the Law on Constitutional Jurisdiction, anyone who receives an order that they must comply with or ensure compliance with, issued in an amparo proceeding, and fails to comply with it or ensure compliance, shall be punished by imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Consejo Nacional de Viabilidad are ordered to pay the costs, damages, and losses caused by the acts on which this declaration is based, which shall be assessed in enforcement proceedings in the administrative-litigation jurisdiction. Justice Castillo Víquez files a note. Justice Garro Vargas dissents regarding the forum for enforcement of the judgment and, pursuant to Article 56 of the Law on Constitutional Jurisdiction, orders that this phase be assigned to the Enforcement Area of the Administrative and Civil Treasury Court. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del diez de setiembre de dos mil veintiseis .

Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el CONSEJO NACIONAL DE VIALIDAD (CONAVI), la MUNICIPALIDAD DE OREAMUNO y el MINISTERIO DE SALUD (MS).

Resultando:

  1. 1Por escrito incorporado al expediente digital el 23 de junio de 2026, la parte recurrente interpone recurso de amparo conta el CONAVI, la Municipalidad de Oreamuno y el MS. Según la resolución de curso, manifiesta lo siguiente:

“[E]l 18 de diciembre de 2025, en su condición de representante legal de la [Nombre 006], planteó una gestión ante el CONAVI, mediante la cual solicitó la eliminación de los desagües ubicados en su propiedad, ubicada en Cipreses de Oreamuno, en Ruta de Travesía No. 30703, por el perjuicio y daños que estos ocasionaron en varias oportunidades a los terrenos, por las aguas residuales y pluviales que pasan a través de la finca y que ha llegado a perjudicar también al residencial ubicado al costado sur de la propiedad. Alega que mediante CARTA-CONAVI-CA-DIE-GCSU-DRC-077 del 22 de enero de 2026, la Gerencia de Conservación de Vías y Puentes de CONAVI, le respondió lo siguiente: “En conclusión, con sustento en la Ley General de Caminos Públicos (Ley N. 5060), la solicitud de eliminar los desagües no es atendible en los términos planteados, por cuanto el marco legal obliga a los colindantes a recibir y dejar discurrir las aguas del camino y a mantener los desagües inmediatos en perfecto estado y libres de obstáculos.

En consecuencia, CONAVI no puede suprimir infraestructura de drenaje necesaria para la seguridad y conservación vial por un requerimiento particular, máxime cuando eventuales daños deben acreditarse con dictamen pericial y las materias de aguas residuales corresponden al Ministerio de Salud y el Instituto Costarricense de Acueductos y Alcantarillados (AyA), no a esta Administración. Por tanto, se rechaza la pretensión de eliminación y, en su lugar, únicamente procederá lo que técnicamente corresponda dentro de competencia institucional para asegurar el adecuado funcionamiento del drenaje y la protección del interés público”. Añade que también planteó la denuncia No. 0108-2025 ante el Ministerio de Salud por los daños ambientales que esa misma situación ha causado. Sin embargo, aduce que se le respondió lo siguiente: “Según la investigación y la coordinación interinstitucional realizada por parte de esta funcionaria las aguas residuales del sector de la Pavilla calle arriba en efecto están desfogando en la Finca propiedad de la parte denunciante.

La posición actual de los propietarios es que no desean seguir recibiendo las aguas residuales de sus vecinos por lo que la solicitud a CONAVI va en la línea de que esas aguas sean desviadas. Quedamos a la espera del informe Técnico del Ingeniero Braulio Fonseca funcionario del CONAVI para determinar las acciones a seguir por parte de este Ministerio”. Agrega que también planteó la solicitud ante la Municipalidad de Oreamuno, la cual fue contestada con el acuerdo 3-2026, conocido en sesión ordinaria N° 26-2025, celebrada por la Junta Vial Cantonal el 16 de febrero de 2026, que indica: “Se acuerda por unanimidad: Trasladar al CONAVI la nota enviada por el señor [Nombre 001], representante legal, [Nombre 006]. cédula jurídica N° [Valor 002], para el análisis correspondiente puesto que es una ruta de travesía y de competencia de dicha entidad. Se copia al interesando y a la Junta Vial Cantonal para conocimiento, Acuerdo firme”. Reclama que a la fecha de interposición del presente recurso no se ha resuelto el problema denunciado, por lo que estima lesionados sus derechos fundamentales”.

  1. 2Mediante resolución de las 13:59 horas del 29 de junio de 2026, se dio curso a este proceso y se les solicitó informe a las autoridades accionadas, sobre los hechos alegados por la parte recurrente.
  2. 3Por escrito incorporado al expediente digital el 7 de julio de 2026, Erick Mauricio Jiménez Valverde, en su condición de alcalde de la Municipalidad de Oreamuno de Cartago, informa bajo juramento que:

“PRIMERO: Visto el recurso presentado por la persona recurrente, se brinda informe bajo fe de juramento del señor Alcalde don Erick Jiménez Valverde en representación de la Municipalidad de Oreamuno. SEGUNDO: Que. la Unidad Técnica y Gestión Vial y su encargado el Ing. Carlos Núñez Castro ban gestionado la problemática con la Junta Vial Cantonal el 16 de febrero del 2026. El caso denunciado es competencia del CONAVI a quien se le traslado la problemática al Ing. Braulio Fonseca Ramírez, ingeniero de zona, Gerencia de Conservación de Vías y Puentes, siendo una tura de travesía No. 30703 correspondencia propia de su competencia. TERCERO: Asimismo, sobre la problemática indicada, la Municipalidad seguirá coordinando con el CONAVI y el Ministerio de Salud para brindar una solución o colaboración a este caso denunciado por el recurrente. CUARTO: Se precede a notificar al señor [Nombre 001] sobre la solicitud presentada ante la Sala Constitucional al correo: [email protected] y se llamó al móvil: 8610-9573/8382-4014”.

  1. 4Por escrito incorporado al expediente digital el 7 de julio de 2026, Jason Adrián Pérez Anchía, en su condición de director ejecutivo del CONAVI, informa bajo juramento que:

“II. CONSIDERACIONES PREVIAS (ANTECEDENTES) Previo al análisis de los hechos expuestos por el recurrente, resulta oportuno precisar el contexto administrativo en el que se origina la presente gestión. El día 18 de diciembre de 2025 el señor [Nombre 001], actuando en representación de la [Nombre 006]., presentó ante el Consejo Nacional de Vialidad una solicitud mediante la cual requirió la eliminación de los desagües existentes sobre la Ruta Nacional de Travesía No. 30703, argumentando que las descargas provenientes del sistema de drenaje afectaban una propiedad de su representada. Con anterioridad a dicha gestión, específicamente el 10 de diciembre de 2025, el Ministerio de Salud coordinó una inspección interinstitucional en el sitio, con participación de funcionarios de esa cartera ministerial y del Consejo Nacional de Vialidad, a efectos de verificar las condiciones existentes y valorar técnicamente la situación denunciada.

Como resultado de esa inspección y del análisis técnico y jurídico efectuado por la Gerencia de Conservación de Vías y Puentes, el Consejo Nacional de Vialidad emitió la CARTACONAVI-CA-DIE-GCSV-DRC-077-2026, de fecha 22 de enero de 2026, mediante la cual se brindó respuesta formal al gestionante, explicando las razones técnicas, legales y competenciales que impedían acceder a la pretensión de eliminar las estructuras de drenaje existentes, al constituir estas parte integral de la infraestructura hidráulica de la Ruta Nacional y resultar indispensables para la seguridad vial, la adecuada evacuación de las aguas pluviales y la conservación de la infraestructura pública. Posteriormente, con ocasión del presente recurso de amparo, la Gerencia de Conservación de Vías y Puentes emitió el informe técnico contenido en la CARTA-CONAVI-CA-DIE-GCSVDRC-1143-2026, en el cual se ratifica el criterio institucional previamente comunicado al recurrente, se describen las actuaciones realizadas por la Administración y se concluye que no existen hechos nuevos que justifiquen modificar la posición técnica adoptada por el Consejo Nacional de Vialidad.

Asimismo, se señala que no se acreditaron daños concretos y técnicamente atribuibles al funcionamiento del sistema de drenaje administrado por esta Institución. De esta manera, resulta evidente que el Consejo Nacional de Vialidad no ha permanecido inactivo frente a la gestión del recurrente. Por el contrario, atendió oportunamente su solicitud, realizó inspecciones de campo, efectuó las valoraciones técnicas correspondientes, coordinó actuaciones con otras instituciones competentes y emitió una respuesta formal, debidamente motivada y fundada en el ordenamiento jurídico vigente. En consecuencia, el objeto del presente recurso no versa sobre una omisión administrativa ni sobre la ausencia de respuesta por parte del CONAVI, sino sobre la disconformidad del recurrente con el contenido de la decisión administrativa adoptada, circunstancia que constituye una cuestión sustancialmente distinta desde la perspectiva constitucional y que será desarrollada en los apartados siguientes.

III .ATENCIÓN POR EL FONDO Previo a referirnos de manera puntual a los hechos expuestos por el recurrente, esta Administración estima necesario efectuar varias precisiones que resultan indispensables para delimitar el verdadero objeto de la controversia sometida al conocimiento de esa Honorable Sala. Del análisis integral del escrito de interposición del recurso de amparo, así como de la documentación que conforma el expediente administrativo, se desprende que la inconformidad del recurrente se centra en la decisión adoptada por el Consejo Nacional de Vialidad de no acceder a su solicitud de eliminar las estructuras de drenaje existentes sobre la Ruta Nacional de Travesía No. 30703, cuyos desfogues se orientan hacia un terreno propiedad de la sociedad que representa. No obstante, dicha circunstancia no puede interpretarse como una actuación omisiva, arbitraria o ilegítima por parte del Consejo Nacional de Vialidad.

Por el contrario, la Administración atendió la gestión presentada por el recurrente mediante el procedimiento que correspondía conforme al ordenamiento jurídico, realizando inspecciones técnicas en el sitio, participando en la inspección interinstitucional convocada por el Ministerio de Salud, valorando la infraestructura existente, analizando el marco normativo aplicable y emitiendo una respuesta formal, debidamente motivada, mediante la cual expuso las razones técnicas y jurídicas que impedían acceder a la pretensión planteada. En ese sentido, resulta importante destacar que el presente recurso no cuestiona la inexistencia de respuesta administrativa, sino el contenido de dicha respuesta. Es decir, el recurrente no acusa al Consejo Nacional de Vialidad de haber guardado silencio frente a su gestión, sino que manifiesta su disconformidad con el criterio técnico y jurídico mediante el cual esta Administración concluyó que no era procedente eliminar la infraestructura de drenaje existente, por constituir ésta un elemento esencial para el adecuado funcionamiento hidráulico de la Ruta Nacional, la seguridad de sus usuarios y la conservación de la infraestructura pública.

Debe señalarse, además, que las obras de drenaje objeto de discusión no corresponden a una intervención reciente realizada por el Consejo Nacional de Vialidad. Según consta en la información técnica recopilada durante las inspecciones efectuadas y en las propias manifestaciones del recurrente, se trata de una condición existente desde hace más de una década, cuya permanencia fue conocida e incluso autorizada voluntariamente por el propietario del inmueble desde su construcción. Asimismo, esta Administración considera indispensable aclarar que el recurrente plantea como si se tratara de un único problema una situación que, desde el punto de vista técnico y jurídico, comprende dos materias claramente diferenciadas. Por una parte, se encuentra el sistema de drenaje pluvial de la Ruta Nacional de Travesía No. 30703, cuya construcción, conservación y funcionamiento corresponden al Consejo Nacional de Vialidad en cumplimiento de las competencias que le asigna la Ley de Creación del Consejo Nacional de Vialidad y la Ley General de Caminos Públicos.

Dichas obras tienen como finalidad captar, conducir y evacuar las aguas pluviales provenientes de la vía, garantizando la seguridad vial y la conservación de la infraestructura pública. Por otra parte, el propio recurrente afirma que al sistema de drenaje se estarían incorporando aguas residuales provenientes de viviendas cercanas. Tal situación, de existir, constituye una materia completamente distinta al funcionamiento del drenaje pluvial de la Ruta Nacional y corresponde ser investigada, fiscalizada y atendida por las autoridades competentes en materia sanitaria, particularmente el Ministerio de Salud y, según corresponda, el Instituto Costarricense de Acueductos y Alcantarillados, sin que el Consejo Nacional de Vialidad tenga competencia legal para intervenir sobre dichas descargas. En consecuencia, no resulta jurídicamente válido atribuir al Consejo Nacional de Vialidad la totalidad de las situaciones descritas por el recurrente, cuando parte importante de los hechos denunciados corresponde a materias cuya atención ha sido expresamente atribuida por el legislador a otras instituciones públicas.

Igualmente, conviene precisar que la gestión presentada por el recurrente no consistió en solicitar una valoración técnica o una investigación sobre la situación expuesta. Lo que expresamente requirió fue la eliminación de los desagües existentes sobre la Ruta Nacional. Esa pretensión fue analizada de manera integral por la Administración, la cual concluyó, mediante criterio técnico debidamente fundamentado, que dicha actuación no resulta técnica ni jurídicamente procedente, por cuanto implicaría eliminar infraestructura pública indispensable para el adecuado funcionamiento hidráulico de la vía, comprometiendo la seguridad vial, la estabilidad del pavimento y la protección del interés público. Por ello, la supuesta "falta de solución" alegada en el recurso no deriva de una omisión administrativa, sino de la discrepancia del recurrente con el contenido de una decisión administrativa que fue emitida dentro del ámbito de las competencias del Consejo Nacional de Vialidad, con sustento en criterios técnicos, jurídicos y de interés público.

Bajo estas consideraciones, esta Administración procederá a referirse, de manera puntual, a cada uno de los hechos expuestos por el recurrente. IV. HECHOS. En atención a los hechos resumidos por esa Honorable Sala Constitucional en la resolución que confiere audiencia a esta Administración, se procede a contestarlos de la siguiente manera: Hecho Primero: Es cierto que el señor [Nombre 001], actuando en su condición de representante legal de la [Nombre 006]., presentó el 18 de diciembre de 2025 una gestión dirigida al Consejo Nacional de Vialidad, mediante la cual solicitó la eliminación de los desagües ubicados en una propiedad de dicha sociedad, localizada en el sector de Barrio La Pavilla, distrito de Cipreses, cantón de Oreamuno, colindante con la Ruta Nacional de Travesía No. 30703. Dicha gestión fue debidamente recibida, tramitada y analizada por las dependencias técnicas competentes del Consejo Nacional de Vialidad, iniciándose la valoración administrativa correspondiente.

Hecho Segundo: Es cierto que el Consejo Nacional de Vialidad emitió la CARTA-CONAVICA-DIE-GCSV-DRC-077-2026, de fecha 22 de enero de 2026, mediante la cual dio respuesta formal a la gestión presentada por el recurrente. No obstante, resulta necesario aclarar que dicha respuesta no constituyó una negativa inmotivada ni una desatención de la solicitud planteada. Por el contrario, obedeció a un análisis técnico y jurídico efectuado por la Gerencia de Conservación de Vías y Puentes, mediante el cual se concluyó que la eliminación de los desfogues solicitada no resultaba procedente, por formar parte del sistema de drenaje de una Ruta Nacional y constituir infraestructura indispensable para garantizar el adecuado funcionamiento hidráulico de la vía, la seguridad vial y la conservación de la infraestructura pública. Asimismo, en dicha respuesta se explicó al gestionante que la eventual presencia de aguas residuales constituye una materia ajena a las competencias del Consejo Nacional de Vialidad, correspondiendo su atención a las autoridades sanitarias competentes.

Hecho Tercero: Es cierto que el recurrente presentó una denuncia ante el Ministerio de Salud y que dicha institución realizó actuaciones relacionadas con la situación expuesta. Sin embargo, debe aclararse que la participación del Consejo Nacional de Vialidad dentro de ese procedimiento se limitó al ámbito de las competencias que legalmente le corresponden, participando en la inspección interinstitucional convocada por el Área Rectora de Salud de Oreamuno el 10 de diciembre de 2025, verificando las condiciones del sistema de drenaje de la Ruta Nacional y brindando la información técnica requerida. En consecuencia, las actuaciones desarrolladas por el Ministerio de Salud dentro de su procedimiento administrativo no pueden ser atribuidas al Consejo Nacional de Vialidad ni generan obligaciones adicionales fuera del ámbito competencial que la ley le asigna. Hecho Cuarto: Es cierto que la Municipalidad de Oreamuno conoció la gestión presentada por el recurrente y acordó remitirla al Consejo Nacional de Vialidad por tratarse de una Ruta Nacional de Travesía.

Precisamente en virtud de dicha competencia, el Consejo Nacional de Vialidad conoció la gestión, efectuó las inspecciones correspondientes, valoró técnicamente la infraestructura existente y emitió la respuesta institucional antes indicada. Por consiguiente, no puede sostenerse que la Administración haya permanecido inactiva frente a la solicitud presentada por el recurrente. Hecho Quinto: Se rechaza la afirmación de que el Consejo Nacional de Vialidad no haya resuelto la problemática planteada o que haya incurrido en una omisión lesiva de derechos fundamentales. Lo que efectivamente ocurrió fue que la Administración, luego de realizar la valoración técnica correspondiente, concluyó que la solución específica solicitada por el recurrente —consistente en eliminar las estructuras de drenaje existentes— no resultaba técnica ni jurídicamente procedente. En consecuencia, la inconformidad del recurrente se refiere al contenido de la decisión administrativa y no a una falta de respuesta institucional.

Asimismo, de las inspecciones realizadas por la Gerencia de Conservación de Vías y Puentes no se identificaron daños concretos, actuales y técnicamente atribuibles al funcionamiento de la infraestructura administrada por el Consejo Nacional de Vialidad, ni hechos nuevos que justificaran modificar el criterio técnico emitido mediante la CARTA-CONAVI-CA-DIE-GCSV-DRC-077-2026 (…) VI. CONCLUSIONES De conformidad con los hechos acreditados, la documentación aportada y el análisis jurídico expuesto, esta Administración concluye lo siguiente: 1. El Consejo Nacional de Vialidad atendió de manera oportuna la gestión presentada por el señor [Nombre 001], realizando las actuaciones administrativas y técnicas que correspondían dentro del ámbito de sus competencias legales, incluyendo la participación en la inspección interinstitucional convocada por el Ministerio de Salud, la valoración técnica de la infraestructura existente y la emisión de una respuesta formal, motivada y debidamente fundamentada mediante la CARTACONAVI-CA-DIE-GCSV-DRC-077-2026. 2.

La infraestructura de drenaje objeto de controversia forma parte integral del sistema hidráulico de la Ruta Nacional de Travesía N.° 30703 y constituye un elemento indispensable para la captación, conducción y evacuación de las aguas pluviales, siendo necesaria para garantizar la seguridad vial, la conservación de la infraestructura pública y la protección del interés general, según lo determinó la Gerencia de Conservación de Vías y Puentes. 3. El análisis técnico efectuado por la Administración determinó que no existen elementos que justifiquen la eliminación o modificación de las estructuras de drenaje existentes, razón por la cual la pretensión formulada por el recurrente fue rechazada mediante una decisión debidamente motivada, adoptada con fundamento en criterios técnicos, jurídicos y de interés público. 4. La problemática relacionada con la eventual incorporación de aguas residuales al sistema de drenaje corresponde a una materia distinta del drenaje pluvial de la Ruta Nacional y, por tanto, su investigación, control y eventual atención compete al Ministerio de Salud y, según corresponda, al Instituto Costarricense de Acueductos y Alcantarillados, sin que el Consejo Nacional de Vialidad ostente competencia legal para intervenir sobre dichas descargas. 5.

No se acreditó la existencia de una actuación arbitraria, ilegítima u omisiva atribuible al Consejo Nacional de Vialidad. Por el contrario, la Administración actuó en estricto apego al principio de legalidad, dentro del ámbito de las competencias que le confiere el ordenamiento jurídico, observando criterios de razonabilidad, proporcionalidad y protección del interés público. 6. La inconformidad planteada por el recurrente no deriva de una ausencia de respuesta administrativa, sino de su desacuerdo con el contenido de la decisión técnica y jurídica adoptada por el Consejo Nacional de Vialidad, circunstancia que, por sí misma, no constituye una vulneración de derechos fundamentales tutelable mediante el recurso de amparo. 7. En consecuencia, del análisis integral del expediente no se desprende la existencia de una acción u omisión atribuible al Consejo Nacional de Vialidad que haya lesionado o amenace lesionar los derechos fundamentales invocados por el recurrente, razón por la cual no concurren los presupuestos constitucionales necesarios para declarar con lugar el presente recurso respecto de esta institución”.

  1. 5Por escrito incorporado al expediente digital el 9 de julio de 2026, Oscar Rodríguez González, en su condición de director de la Dirección de Área Rectora de Salud de Oreamuno, informa bajo juramento que:

“II. ACTUACIONES DEL MINISTERIO DE SALUD EN EL CASO DE MARRAS: Antecedentes: El día 26 de agosto del 2025, ingresa a esta Dirección de Área Rectora de Salud denuncia en contra de los vecinos del sector de La Pavilla ubicado en el cantón Oreamuno, distrito Cipreses específicamente del Bar Chaquetas 700 metros al sur, Ruta Nacional camino hacia Cervantes a la que se le asignó el consecutivo N° 0108-2025, debido a que hay una tubería subterránea que atraviesa la vía pública y lleva aguas pluviales y jabonosas que hacia una parte de una finca de la parte denunciante, lo que genera problemas en los cultivos agrícolas y el ganado que poseen en la propiedad. El día 10 de diciembre del 2025, la funcionaria [Nombre 005], realizó visita de inspección en conjunto con el Ingeniero Braulio Fonseca y la Ingeniera Valeria Zuñiga del Consejo Nacional de Vialidad (CONAVI) y de los denunciantes, según consta en el Acta de Inspección MS-DRRSCE-DARSO-AIO-GQM-01-2025, durante la visita se logra “…identificar una tubería de concreto que recibe las aguas residuales del caserío calle arriba la cual cruza subterráneamente la Ruta Nacional y posteriormente descarga en la finca de su propiedad…” [Sic] (Ver folio N° 0007), según consta en el Informe Técnico N° MS-DRRSCE-DARSO-IT-0201-2026, suscrito por la funcionaria [Nombre 005], fechado del 07 de julio del 2026.

Según el Informe Técnico supracitado, los denunciantes refieren “…que esa tubería fue instalada desde hace muchos años cuando se asfaltó la calle (Ruta Nacional) y que su padre estuvo de acuerdo en ese momento en recibirlas en su condición de propietario porque se trataba solo de aguas pluviales. [Sic] (Ver folios N° 0034 al 0040). Durante la visita conjunta, y según consta en el Informe Técnico N° MS-DRRSCE-DARSOIT-0201-2026, el Ing. Braulio Fonseca del CONAVI, le “…indica a la parte denunciante que deben elaborar una nota solicitando el criterio según el análisis que se le haga a los antecedentes del caso, esto vía correo electrónico.” [Sic] (Ver folios N° 0004 al 0006). El día 17 de enero 2026 se recibe vía correo electrónico el N° CARTA-CONAVI-CA-DIEGCSV-DRC-077-2026, (Ver folios N° 0011 al 0013) suscrito por el Ingeniero Braulio Fonseca Ramírez, zona 1-7 del CONAVI externando criterio sobre el caso, indicando que: “En conclusión, con sustento en la Ley General de Caminos Públicos (Ley N. 5060), la solicitud de eliminar los desagües no es atendible en los términos planteados, por cuanto el marco legal obliga a los colindantes a recibir y dejar discurrir las aguas del camino y a mantener los desagües inmediatos en perfecto estado y libres de obstáculos.

En consecuencia, CONAVI no puede suprimir infraestructura de drenaje necesaria para la seguridad y conservación vial por un requerimiento particular, máxime cuando eventuales daños deben acreditarse con dictamen pericial y las materias de aguas residuales corresponden al Ministerio de Salud y el Instituto Costarricense de Acueductos y Alcantarillados (AyA), no a esta Administración. Por tanto, se rechaza la pretensión de eliminación y, en su lugar, únicamente procederá lo que técnicamente corresponda dentro de competencia institucional para asegurar el adecuado funcionamiento del drenaje y la protección del interés público…” [Sic] (Ver folio N° 0012). Según el Informe Técnico N° MS-DRRSCE-DARSO-IT-0201-2026, el día 27 de enero del 2026, la funcionaria [Nombre 005], mantuvo reunión en la Sala de Reuniones de la Dirección del Área rectora de Salud de Oreamuno junto con la parte denunciante.

En dicha reunión se acuerda lo siguiente: “Refiere la parte denunciante que conversado en familia sobre el tema decidieron no eliminar la entrada de aguas a la finca sino más bien solicitar a la persona que está alquilando el terreno que le de mantenimiento constante y oportuno a dicho canal. Su padre quien es el propietario de la finca toma la decisión de no interferir en el tema por lo que las encargadas serán sus hijas que son quienes están a cargo de la situación. Agregan que su preocupación es porque en época de lluvia la cantidad de agua que reciben en la finca es bastante y que al final de la finca en vía pública los vecinos del Residencial La Pavilla colocaron una malla. Con la cantidad de agua en época de lluvia y el posible colapso de la malla por atascamiento esta provocaría inundación, que afectaría tanto la finca como la vía pública y por consecuencia se podrían ver afectadas las viviendas del Residencial La Pavilla ya que los terrenos están más bajos.

Previendo toda esta situación esta funcionaria propone una reunión con las partes involucradas de forma tal que se puedan sentar responsabilidades de a quien le corresponde dar el mantenimiento tanto al canal dentro de la finca como a la malla colocada por los vecinos del Residencial La Pavilla. Se acuerda una reunión para el miércoles 04 de febrero 2026 a la 1.30 de la tarde en el sitio tanto con miembros de la Asociación de Desarrollo de Cipreses, los vecinos del Residencial La Pavilla, la parte denunciante y esta funcionaria con el fin de llegar a buenos acuerdos generando soluciones para el beneficio de todas las partes.” [Sic] (Ver folios N° 0018) El día 04 de febrero del 2026, según consta en el Informe Técnico N° MS-DRRSCEDARSO-IT-0201-2026, se lleva a cabo una reunión organizada por la funcionaria [Nombre 005], en la que asisten los señores [Nombre 002], [Nombre 001], [Nombre 003], [Nombre 004] en su condición de denunciantes y propietarios de la finca, señora Sonia Coto Solano por parte de la Asociación de Desarrollo de Cipreses y miembro del Consejo de Distrito a nivel Municipal, señora Agnes Mora Rugama por parte de los vecinos del Residencial La Pavilla y señor Carlos Mora Ulloa en su condición de arrendatario del terreno para cultivarlo, en donde se acuerda lo siguiente: “Por parte de los propietarios del terreno refieren que a pesar de que su padre desde años atrás dio la autorización para que las aguas pluviales ingresaran por dentro de la finca en la actualidad sus hijas que son las herederas no comparten la decisión.

Agregan que durante años han recibido no solo las aguas pluviales sino también las aguas residuales de las viviendas del sector por lo que la problemática cada vez se complica más. Señalan que por parte del Residencial La Pavilla colocaron una parrilla al final de la finca, pero del lado de la vía pública para propiciar que cualquier residuo solido que venga por el canal se quede ahí y no se introduzca dentro de la tubería que ingresa al Residencial causando inundaciones en las viviendas. Agregan que a esa parrilla no se le da mantenimiento por parte de los vecinos del Residencial que fueron los que la instalaron por lo que el agua se estanca dentro de la finca generando daños a los cultivos adyacentes. Indican además que la persona que alquila el terreno para cultivarlo señor Carlos Mora Ulloa realizó algunos trabajos de mantenimiento en el canal que se localiza dentro de la finca. Al respecto agrega la señora Agnes Mora Rugama que en efecto sus viviendas se han visto afectadas en la época de lluvia ya que los residuos han obstruido la tubería generando inundaciones dentro del residencial.

En efecto se observa la parrilla obstruida con restos de hierbas que son arrastradas por la lluvia hacia el canal que ingresa a la propiedad de los señores Martínez lo que genera que esta colapse impidiendo el libre tránsito del agua. Se le indica a la señora Agnes Mora Rugama que es responsabilidad de los vecinos del Residencial La Pavilla mantener limpia la parrilla para evitar que ésta se obstruya a lo que refiere estar de acuerdo. Al señor Carlos Mora Ulloa persona que tiene arrendada la propiedad para cultivarla se le indica que debe mantener limpio el cauce del canal para evitar que caigan residuos lo que ocasionaría que se obstruya y por ende se salga lo que podría también anegar los cultivos. Por parte de la señora Sonia Coto Solano en representación del Consejo de Distrito de Cipreses ante la Municipalidad de Oreamuno se le solicita interponga sus buenos oficios en la Comisión Vial de la cual es miembro activo la problemática y solicite criterio Técnico por escrito al respecto como insumo para mejor resolver.

Por parte de esta funcionaria se les indica a las partes involucradas que el proceso de realizar visitas de inspección casa por casa para determinar cuáles de ellas están desfogando sus aguas residuales al alcantarillado pluvial y posteriormente a la propiedad del señor [Nombre 001] es muy lento por lo que se debe realizar de forma paulatina. Partiendo de este dato se programarán de forma paulatina según la capacidad del Area Rectora para iniciar con el proceso de inspecciones casa por casa, por tratarse de aguas residuales hacia el alcantarillado pluvial con solo solicitar la apertura del tubo del fregadero se podría determinar quiénes si y quienes no.” [Sic]. (Ver folios N° 0029 al 0030). El día 4 de febrero del 2026, se realiza visita de inspección a 4 viviendas, dando como resultado positivo par aguas residuales provenientes de las pilas. El día 01 de julio del 2026, se reprogramaron visitas de inspección en el sector, no obstante, solo una vivienda se pudo valorar ya que en las demás viviendas no abrieron, por lo que se reprogramaran visitas en otro día y horario diferente.

Por parte de esta Dirección de Área Rectora de Salud, se estarán girando las Ordenes Sanitarias correspondientes y se programará el seguimiento respectivo, de lo cual, se mantendrá informada a la parte denunciante, así como a esta Honorable Sala Constitucional. Es importante mencionar que según el Informe Técnico N° MS-DRRSCE-DARSO-IT-0201- 2026, en la urbanización no existe infraestructura pluvial, situación que agrava la problemática denunciada y que al momento de la elaboración de este documento no se tienen aún criterio de parte de CONAVI o de la Municipalidad de Oreamuno sobre la construcción de obras de infraestructuras necesarias para encausar las aguas pluviales de esta urbanización”.

  1. 6Por constancia del 13 de julio de 2026, se consignó:

“[R]evisado, a las ocho horas veintiocho minutos del trece de julio de dos mil veintiséis, en el SISTEMA COSTARRICENSE DE GESTIÓN DE DESPACHOS JUDICIALES el CONTROL DE DOCUMENTOS RECIBIDOS Y ESTE EXPEDIENTE, no apareció que del veintinueve de junio al doce de julio de dos mil veintiseis, el GERENTE DE CONSERVACIÓN DE VÍAS Y PUENTES CONAVI haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las trece horas cincuenta y nueve minutos del veintinueve de junio de dos mil veintiséis, en el expediente número 26-022578-0007-CO que es RECURSO DE AMPARO promovido por [Nombre 001]”.

  1. 7En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

Considerando:

I.Objeto del recurso. La parte recurrente manifiesta que presentó ante las autoridades accionadas una solicitud para eliminar los desagües de la propiedad de [Nombre 006]., ubicada en la ruta de Travesía nro. 30703 en Cipreses de Oreamuno, debido a que provocan daños a los terrenos y el residencial, ubicado al costado sur de la propiedad, por las aguas residuales y pluviales que pasan a través de dicha finca; sin embargo, reclama que el CONAVI le indicó que la solicitud no resultaba atendible debido a que el marco legal obliga a los colindantes a recibir y dejar discurrir las aguas del camino y a mantener los desagües en perfecto estado y libres de obstáculos, con el agravante de que las otras autoridades siguen sin colaborar para la resolución de la problemática expuesta. Solicita la intervención de la Sala.

II.Cuestión previa. En vista que el gerente de Conservación de Vías y Puentes del CONAVI omitió rendir el informe dentro del plazo fijado por este Tribunal en la resolución de curso de este asunto, de conformidad con el artículo 45 de la Ley de la Jurisdicción Constitucional se procede a analizar la constitucionalidad del asunto con base en los demás elementos aportados a los autos.

III.Sobre la excepción al artículo 41 de la Constitución Política. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia nro. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativo a los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción pues, según el dicho de la parte recurrente, se está ante una denuncia interpuesta ante las autoridades recurridas por un problema de descarga de aguas residuales y pluviales que presuntamente no ha sido resuelta. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

IV.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

El 10 de diciembre de 2025, el Área Rectora de Salud Oreamuno promovió una inspección interinstitucional con la participación de funcionarios del CONAVI, con el propósito de verificar las condiciones existentes en el sitio, identificar la infraestructura de drenaje presente y recopilar información técnica relacionada con la situación denunciada (ver prueba aportada).

El 18 de diciembre de 2025, el recurrente presentó una gestión ante el CONAVI, por medio de la cual solicitó la eliminación de los desagües de la propiedad de [Nombre 006]., ubicada en la ruta de Travesía nro. 30703 en Cipreses de Oreamuno, debido a que provocan daños a los terrenos y el residencial, ubicado al costado sur de la propiedad, por las aguas residuales y pluviales que pasan a través de dicha finca (hecho incontrovertido).

Por medio del informe técnico nro. MS-DRRSCE-DARSO-IT-05-2026 del 19 de enero de 2026, el personal del Área Rectora de Salud Oreamuno consignó los siguientes hallazgos ante la inspección realizada:

“Al llegar al lugar en compañía de funcionarios del CONAVI Ingeniero Braulio Fonseca y la Ingeniera Valeria Zúñiga previa coordinación con las partes se realiza el recorrido como parte de la investigación. En compañía de los denunciantes se logra determinar la presencia de una tubería en concreto que recibe las aguas residuales del caserío calle arriba la cual cruza subterráneamente la Ruta Nacional y posteriormente descarga en la finca de su propiedad. Refiere la parte denunciante que esa tubería fue instalada desde hace muchos años cuando se asfaltó la calle (Ruta Nacional) y que su padre estuvo de acuerdo en ese momento en recibirlas en su condición de propietario porque se trataba solo de aguas pluviales. Pese a ello en la actualidad los herederos no están de acuerdo en seguir recibiendo esas aguas y mucho menos tomando en cuenta que ya no se trata solo de aguas pluviales sino también de aguas residuales.

El Ingeniero Braulio Fonseca del CONAVI le indica a la parte denunciante que deben elaborar una nota solicitando el criterio según el análisis que se le haga a los antecedentes del caso, esto vía correo electrónico. Así las cosas, quedamos a la espera de las acciones por parte de los denunciantes y posterior criterio del funcionario del CONAVI Ingeniero Braulio Fonseca para determinar si por parte de este Ministerio se tiene que tomar alguna otra medida. No se determina incumplimiento de la Ley 9028 y la Ley 10066 y sus Reglamentos por lo que no se toma ninguna acción por parte de este Ministerio con relación a este tema”.

Por lo anterior, emitieron las siguientes conclusiones:

“Según la investigación y la coordinación interinstitucional realizada por parte de esta funcionaria las aguas residuales del sector de la Pavilla calle arriba en efecto están desfogando en la Finca propiedad de la parte denunciante. La posición actual de los propietarios es que no desean seguir recibiendo las aguas residuales de sus vecinos por lo que la solicitud a CONAVI va en la línea de que esas aguas sean desviadas. Quedamos a la espera del Informe Técnico del Ingeniero Braulio Fonseca funcionario del CONAVI para determinar las acciones a seguir por parte de este Ministerio. RECOMENDACIONES: Se recomienda de ser necesario dar el seguimiento posteriormente al Criterio Técnico del CONAVI” (ver prueba aportada).

Por medio del oficio nro. CARTA-CONAVI-CA-DIE-GCSV-DRC-077-2026 del 22 de enero de 2026, la Gerencia de Conservación de Vías y Puentes del CONAVI atendió la gestión del recurrente de la siguiente manera:

“En relación con la solicitud de intervención para la Ruta de Travesía No. 30703, se da como consecuente lo siguiente: ANTECEDENTES Mediante documento recibido por medio de correo electrónico el 18 de diciembre de 2025, suscrito por el señor [Nombre 001], representante legal de la sociedad Maiodora S.R.L, se expone la solicitud de la eliminación de los desagües ubicados en su propiedad, localizada en Cipreses de Oreamuno, Barrio La Pavilla, como se muestra: “…en calidad de representante legal de la sociedad Maiodora S.R.L., cédula jurídica No. [Valor 002], deseo solicitar, vehementemente, la eliminación de los desagües, ubicados en mi finca, ubicada en Cipreses de Oreamuno , en Barrio La Pavilla , de la carretera que pasa al costado oeste de la propiedad. En una oportunidad hace más de 10 años, yo voluntariamente autoricé, para que los mencionados desagües , fueran construidos en mi propiedad, pero esto me ha provocado múltiples problemas, de contaminación , de inundación , daños a los siembros , y hasta daños para el residencial que se ubica al costado sur de la finca , por las aguas pluviales y residuales que vienen de la carretera, pues , el Conavi, no colocó las cunetas correspondientes en su oportunidad…” (…) HALLAZGOS Y FUNDAMENTO JURÍDICO Como parte del proceso de atención y seguimiento de la denuncia presentada inicialmente ante el Ministerio de Salud, dicha institución coordinó y convocó una visita de inspección conjunta al sitio, ocasión en la cual el recurrente formalizó su solicitud de atención.

Durante la inspección efectuada el 10 de diciembre de 2025, se constató la existencia de estructuras de drenaje transversal, cuyos desfogues se orientan hacia la propiedad señalada. Conforme a lo observado en campo y a lo indicado por el propietario, dicha descarga responde a una condición que se mantiene desde hace más de una década, asociada al manejo histórico de la escorrentía pluvial del sector, previo al desarrollo urbano actual. De igual forma, se tiene por acreditado que el recurrente reconoce que dicha condición fue autorizada voluntariamente desde hace más de diez años. Asimismo, el propietario manifestó la posible incorporación de aguas residuales provenientes de viviendas cercanas. Sobre este particular, se aclara que el CONAVI carece de competencia legal para gestionar, tratar o intervenir aguas residuales. En apego a la Ley General de Salud (Ley N.° 5395) y al Reglamento de Vertido y Reúso de Aguas Residuales (Decreto Ejecutivo N.° 33601-S-MINAE), tales responsabilidades corresponden al Ministerio de Salud y al Instituto Costarricense de Acueductos y Alcantarillados (AyA).

En cuanto a la solicitud de “eliminación de los desagües”, se informa que no resulta jurídicamente procedente acceder a lo peticionado en los términos planteados, con fundamento en la Ley General de Caminos Públicos (Ley N.° 5060), por las razones siguientes: a) Naturaleza y finalidad pública del drenaje vial. El drenaje transversal y sus desfogues constituyen infraestructura indispensable para la conservación, estabilidad y seguridad del camino. En ese marco, suprimir desfogues existentes sin una solución técnica equivalente trasladaría el riesgo hidráulico y geotécnico a la calzada y a terceros, lo cual es incompatible con el interés público que tutela la normativa. La Ley N.° 5060 reconoce, además, el carácter público de los caminos y la competencia estatal sobre su construcción y mejoramiento b) Obligación legal del colindante respecto a las aguas del camino y los desagües. La Ley N.° 5060 establece que los poseedores de predios colindantes están obligados a recibir y dejar discurrir las aguas de los caminos cuando el desnivel del terreno así lo determine y, cuando sus fundos estén inmediatos a desagües, deben mantenerlos en perfecto estado de servicio y libres de obstáculos.

En consecuencia, la eliminación solicitada no se ajusta al régimen legal aplicable. c) Reclamos por daños: requisito pericial y prescripción. En caso de pretenderse un reclamo indemnizatorio, la Ley exige que toda estimación por daños y perjuicios esté sustentada en dictamen pericial y establece un plazo de prescripción de un año para reclamar indemnización desde que se causaren los daños. Por tanto, alegaciones genéricas de daños sin respaldo técnico-pericial y sin delimitación temporal concreta no obligan a la Administración a eliminar infraestructura pública. Sin perjuicio de lo anterior, esta Administración mantendrá las verificaciones técnicas necesarias para determinar, dentro del ámbito de sus competencias, las medidas que resulten procedentes para el adecuado funcionamiento del drenaje y la protección de la vía. Finalmente, de confirmarse la eventual incorporación de aguas residuales, se reitera que su valoración y atención compete a las autoridades sanitarias correspondientes, por tratarse de una materia ajena a la competencia del CONAVI CONCLUSIONES En conclusión, con sustento en la Ley General de Caminos Públicos (Ley N.° 5060), la solicitud de eliminar los desagües no es atendible en los términos planteados, por cuanto el marco legal obliga a los colindantes a recibir y dejar discurrir las aguas del camino y a mantener los desagües inmediatos en perfecto estado y libres de obstáculos.

En consecuencia, CONAVI no puede suprimir infraestructura de drenaje necesaria para la seguridad y conservación vial por un requerimiento particular, máxime cuando eventuales daños deben acreditarse con dictamen pericial y las materias de aguas residuales corresponden al Ministerio de Salud y el Instituto Costarricense de Acueductos y Alcantarillados (AyA), no a esta Administración. Por tanto, se rechaza la pretensión de eliminación y, en su lugar, únicamente procederá lo que técnicamente corresponda dentro de competencia institucional para asegurar el adecuado funcionamiento del drenaje y la protección del interés público” (ver informe rendido bajo juramento y prueba aportada).

Las autoridades del CONAVI señalaron que:

“En el sector denunciado se encuentran obras de drenaje transversal que forman parte de la infraestructura vial de la Ruta Nacional, las cuales tienen como finalidad captar y conducir las aguas pluviales provenientes de la vía hacia su punto natural de descarga, mediante los respectivos desfogues ubicados sobre el terreno colindante” (ver prueba aportada).

El 4 de febrero de 2026, el Área Rectora de Salud Oreamuno realizó una inspección en la zona afectada (ver prueba aportada).

Por medio del informe técnico nro. MS-DRRSCE-DARSO-IT-37-2026 del 2 de marzo de 2026, el personal del Área Rectora de Salud Oreamuno concluyó:

“La problemática denunciada se ha agravado ya que en la actualidad no se trata únicamente de aguas pluviales sino también de aguas residuales que provienen de las viviendas del sector. En el sector donde se ubica la propiedad de la parte denunciante claramente se observa que las aguas residuales provenientes de las viviendas atraviesan la calle mediante una tubería de concreto posteriormente y desfogan hacia este punto. Dentro de la finca existe un canal construido en el suelo que recibe todas las aguas tanto pluviales como residuales cuando lo correcto es que estas aguas fluyan por la infraestructura ubicada en la orilla de la calle. La parte denunciante no desea recibir más las aguas residuales por lo que las gestiones realizadas ante las instituciones van en la línea de que se elimine y/o se reubique la tubería. El criterio generado por el CONAVI especifica que le corresponde al Ministerio de Salud el tema de las aguas residuales provenientes de las viviendas enunciado que es correcto por lo que esta funcionaria debe realizar las acciones que corresponden de acuerdo con las competencias de mi representada.

RECOMENDACIONES: 4 Se recomienda programar una vez al mes para iniciar de forma paulatina con la evaluación casa por casa con el fin de determinar cuáles de ellas desfogan las aguas residuales hacia el alcantarillado pluvial, situación que debe ser corregida según la legislación vigente” (ver prueba aportada).

El 13 de febrero de 2026, el recurrente presentó una gestión ante la Junta Vial Cantonal de la Municipalidad de Oreamuno (ver informe rendido bajo juramento y prueba aportada).

El 16 de febrero de 2026, la Junta Vial Cantonal de la Municipalidad de Oreamuno conoció la problemática denunciada por el recurrente (ver informe rendido bajo juramento y prueba aportada).

Por medio del acuerdo nro. 3-2026 del 16 de febrero de 2026, la Junta Vial Cantonal de la Municipalidad de Oreamuno acordó trasladar la denuncia por competencia ante el CONAVI, propiamente al Ing. Braulio Fonseca Ramírez de la Gerencia de Conservación de Vías y Puentes del CONAVI por tratarse de la ruta nro. 30703 (ver informe rendido bajo juramento y prueba aportada).

El 22 de abril de 2026, el Área Rectora de Salud Oreamuno realizó una inspección en la zona afectada (ver prueba aportada).

El 1 de julio de 2026, el Área Rectora de Salud Oreamuno realizó una inspección en la zona afectada (ver prueba aportada).

Por medio del informe técnico nro. MS-DRRSCE-DARSO-IT-201-2026 del 7 de julio de 2026, el personal del Área Rectora de Salud Oreamuno consignó los siguientes hallazgos ante la inspección realizada:

“Es criterio de esta funcionaria que no es necesario realizar las pruebas de fluorosceina ya que la estrategia es solicitar a cada persona que se encuentra en la vivienda que abra el tubo del fregadero para observar. No existe infraestructura a orilla de calle para encausar las aguas pluviales por lo que lo que se observa es el caño convencional. Se inicia con la investigación tomando la primera vivienda de norte a sur la cual pertenece al señor Adolfo Mora Castro portador de la cédula de identidad N°302930354. RESULTADO POSITIVO. Seguidamente se visita la vivienda del señor Guillermo Mora Castro portador de la cédula de identidad N°10816019. RESULTADO POSITIVO. Se continua con la vivienda del señor Victor Gómez Rivas portador de la cedula de identidad N°303850193. RESULTADO POSITIVO. Se evalúa la vivienda del señor Melvin Mora (se desconoce segundo apellido) no se encuentra a ninguna persona, pero su vecino indica que todas las viviendas desfogan Las aguas residuales al caño que pasa por el frente.

RESULTADO POSITIVO. En fecha 01 de julio 2026 se continua con la investigación esta vez solo es posible evaluar la vivienda del señor Abel Manrow Umaña (se desconoce su número de cédula) me atiende su hija la cual indica que en efecto las aguas jabonosas de la vivienda de su padre también descargan en el caño. RESULTADO POSITIVO. Se continúa con la investigación se observa en el caño residuos de papa según indican los vecinos en la propiedad existe una lavandería por lo que esos residuos en apariencia provienen de ese sitio. La propiedad le pertenece al señor Manuel Fernández Gómez, se llama en varias ocasiones por el intercomunicador, después de un rato responde una persona quien indica ser la señora de la limpieza refiere que sus patrones no se encuentran en ese momento por lo que no se logra determinar si las aguas residuales de esta actividad desfogan en el caño. Se continúa con el recorrido en el resto de las viviendas ante el llamado desde el área de calle no sale ninguna persona por lo que se debe reprogramar para continuar con la investigación. No se determina incumplimiento de la Ley 9028 y la Ley 10066 y sus Reglamentos por lo que no se toma ninguna acción por parte de este Ministerio con relación a este tema”.

Por lo anterior, emitieron las siguientes conclusiones:

“La problemática denunciada se ha agravado ya que en la actualidad en la propiedad de la parte denunciante no únicamente desfogan aguas pluviales sino también aguas residuales que provienen de las viviendas del sector La Pavilla. En todo el sector La Pavilla no existe infraestructura para recibir y encausar las aguas pluviales, por lo que estas pasan en algunos trechos por la orilla de la calle y en otros por un canal hecho directamente en el suelo. En el sector donde se ubica la propiedad de la parte denunciante claramente se observa que las aguas residuales provenientes de las viviendas atraviesan la calle mediante una tubería de concreto desfogando finalmente en la finca. Dentro de la finca existe un canal construido en el suelo que recibe todas las aguas tanto pluviales como residuales. Se desconoce si el canal ha existido desde siempre de forma natural o fue creado para encausar las aguas.

La parte denunciante externa que no desean recibir más las aguas residuales por lo que las gestiones realizadas ante las instituciones van en la línea de que se elimine y/o se reubique la tubería. El criterio generado por el CONAVI mediante Oficio CARTA-CONAVI-CA-DIE-GCSV-DRC-077-2026 es que no es de su competencia resolver la problemática e indica que le corresponde al Ministerio de Salud el tema de las aguas residuales provenientes de las viviendas por lo que recomiendan que sea este ente el que realice las acciones que corresponden de acuerdo con nuestras competencias. A la fecha se han evaluado cinco viviendas las cuales desfogan sus aguas residuales en el caño que pasa por el frente, cruzan la calle mediante tubería de concreto y finalmente caen en la finca de la parte denunciante. Se debe reprogramar para determinar a ciencia cierta cuáles otras viviendas y/o actividades de la zona están desfogando las aguas residuales hacia la propiedad de la parte denunciante y tomar las acciones correspondientes según lo indica la legislación vigente.

RECOMENDACIONES: Se recomienda notificar Orden Sanitaria ordenando realizar los trabajos que sean necesarios dentro de sus propiedades para que las aguas residuales sean tratadas y encausadas directamente hacia drenaje de forma tal que no lleguen hasta el caño que pasa por el frente de sus viviendas y posteriormente descarguen en la finca propiedad de los denunciantes. Señor Adolfo Mora Castro portador de la cédula de identidad N°302930354. Señor Guillermo Mora Castro portador de la cédula de identidad N°10816019. Señor Victor Gómez Rivas portador de la cedula de identidad N°303850193. Señor Melvin Mora (se desconoce segundo apellido y número de cédula). Señor Abel Manrow Umaña (se desconoce su número de cédula). Reprogramar para continuar con la investigación en las viviendas y establecimientos faltantes” (ver prueba aportada).

Las autoridades del Área Rectora de Salud Oreamuno señalaron:

“[E]n la urbanización no existe infraestructura pluvial, situación que agrava la problemática denunciada y que al momento de la elaboración de este documento no se tienen aún criterio de parte de CONAVI o de la Municipalidad de Oreamuno sobre la construcción de obras de infraestructuras necesarias para encausar las aguas pluviales de esta urbanización” (ver informe rendido bajo juramento).

V.Hechos no probados. No se estiman como debidamente demostrados los siguientes hechos:

Que las autoridades del CONAVI hayan adoptado alguna medida que resulten procedentes para el adecuado funcionamiento del drenaje y la protección de la vía (los autos).

Que las autoridades del Área Rectora de Salud Oreamuno hayan dictado las órdenes sanitarias correspondientes, según lo dispuesto en el informe técnico nro. MS-DRRSCE-DARSO-IT-201-2026 del 7 de julio de 2026 (los autos).

VI.Sobre el caso concreto. En la especie, del elenco de hechos probados, se tiene por demostrado que efectivamente las autoridades accionadas tienen pleno conocimiento de la problemática denunciada por el recurrente, sin que se haya logrado establecer con claridad las acciones y las coordinaciones interinstitucionales pertinente para resolver de forma definitiva dicha problemática por parte de las autoridades del CONAVI y del Área Rectora de Salud Oreamuno.

Según se desprende de los informes rendidos bajo juramento —con oportuno apercibimiento de las consecuencias, incluso penales, previstas en el artículo 44, de la Ley que rige esta Jurisdicción— que el sector afectado se encuentra en el Barrio La Pavilla, distrito de Cipreses, cantón de Oreamuno, colindante con la Ruta Nacional de Travesía nro. 30703. En el cual, consta que se han efectuado distintas inspecciones interinstitucionales entre el CONAVI y el Área Rectora de Salud Oreamuno —que se detallan en los hechos probados c, g y m—. En ese sentido, se verifica que efectivamente existe una problemática ocasionada por la descarga de aguas pluviales y de aguas residuales en la propiedad en cuestión lo que afecta el derecho a disfrutar de un ambiente sano, ecológicamente equilibrado y de un nivel digno de calidad de vida a los vecinos de la zona.

Ahora, si bien este Tribunal comprende que la problemática denunciada no se puede ser solventada en los términos pretendidos por el recurrente, tal como se le indicó a través del oficio nro. CARTA-CONAVI-CA-DIE-GCSV-DRC-077-2026 del 22 de enero de 2026, lo cierto del caso es que la problemática persistente sin que se hayan adoptado las acciones correspondientes, dentro del ámbito de competencia de los recurridos, para solventar o paliar la descarga de tales aguas en la propiedad denunciada. Nótese que por un lado las autoridades del CONAVI le indicaron al recurrente que se iban a adoptar las verificaciones técnicas necesarias para determinar, dentro del ámbito de sus competencias, las medidas que resulten procedentes para el adecuado funcionamiento del drenaje y la protección de la vía; sin embargo, no consta que se haya cumplido con lo indicado; y por otro lado las autoridades del MS recomendaron la emisión de distintas órdenes sanitarias contra los dueños de las propiedades que estaban desfogando las aguas residuales; no obstante, tampoco se tiene por demostrado que se hayan emitido y mucho menos notificado.

En consecuencia, esta Sala determina que ha existido una inacción por parte de las autoridades del CONAVI y del Área Rectora de Salud Oreamuno en efectuar aquellas acciones y diligencias dirigidas destinadas a ejecutar las obras pertinentes de canalización y de conducción de las aguas pluviales y de las aguas residuales, con la finalidad de que no discurran en la zona indicada por el recurrente. En criterio de este Tribunal Constitucional, independientemente, de las actuaciones que le correspondan en esta materia a cada una de las autoridades según el marco de sus competencias, lo cierto es que, en el sub examine, queda manifiesta su inercia y falta de eficiencia para atender con prontitud, la situación acusada, lo cual, configura un quebranto al derecho a un procedimiento pronto y cumplido que implica un riesgo a los vecinos del sector que se ve afectada por la descarga de las aguas.

En mérito de lo expuesto, lo procedente es declarar con lugar el recurso solamente contra estas autoridades en los términos dispuestos en la parte dispositiva de esta sentencia.

VII.Finalmente, en cuanto a las autoridades de la Municipalidad de Oreamuno lo procedente es desestimar el recurso, toda vez que, de previo a la interposición de este recurso, remitieron la denuncia formulada ante la autoridad competente para resolver la problemática alegada ante el CONAVI al tratarse de una ruta nacional.

VIII.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.

A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

IX.Voto salvado de la magistrada Garro Vargas sobre la ejecución de la sentencia.

Salvo el voto respecto de la ejecución de la sentencia, para que, de conformidad con el art. 56 de la Ley de la Jurisdicción Constitucional (LJC), sea residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda.

La ejecución de las órdenes dictadas por la Sala Constitucional corresponde, en principio, ser fiscalizada por esta misma jurisdicción. Sin embargo, esa norma contempla supuestos de excepción en los que, por determinación de este Tribunal, se ordene residenciar la ejecución de la sentencia en la jurisdicción contencioso-administrativa:

“Art. 56. La ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias, o en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción.” (Lo destacado no corresponde al original).

Recuérdese que en el proyecto de ley de discusión de la LJC se preveía originalmente lo siguiente:

“Art. 56. Las sentencias favorables al recurrente se ejecutarán en la vía contencioso-administrativa por el procedimiento de ejecución de sentencia previsto en la ley Reguladora de esa Jurisdicción.” (Lo destacado no corresponde al original).

Sin embargo, el texto fue modificado vía moción para que la norma fuera coincidente con lo regulado en el art. 153 de la Constitución Política, pero se realizó la siguiente explicación:

“EL SECRETARIO:

Moción No. 68 (32-19) del diputado Chacón Jiménez:

“artículo 57 (antes 56): para que el texto se lea así: “la ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones o responsabilidades pecuniarias en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción”.

En discusión la moción leída?

Doctor Piza Escalante:

Aquí había una contradicción con la tesis genérica de que son los Tribunales los que ejecutan sus sentencias y enviaba la Jurisdicción Contencioso Administrativo toda la ejecución; entonces quedaban al aire los otros artículos que le permitían a la Sala ejecutarlos.

Diputado Corrales Bolaños:

En esa parte dice: “o en otros aspectos que la propia Sala considere del aso…”, a qué se está refiriendo?

Doctor Piza Escalante:

La idea es que la Sala, en la vía de ejecución de sentencia, resuelva lo que ella considere que le corresponde. Lo que demás, lo envía a la vía Contencioso Administrativa.

EL SECRETARIO:

Se considera suficientemente discutida la moción?

EL PRESIDENTE:

A partir de lo anterior, está claro que la propia LJC autoriza a esta Sala para que valore y decida si es preciso derivar a la jurisdicción contencioso-administrativa todos o algunos los aspectos relativos a la ejecución de la sentencia.

En este caso concreto, en virtud de la entidad de las órdenes que está girando este Tribunal, estimo que lo procedente es residenciar la fase de ejecución del asunto en la jurisdicción contencioso-administrativa. Lo anterior, debido a la inexistencia de mecanismos idóneos previstos por la normativa que rige a esta jurisdicción constitucional para dar seguimiento a las órdenes consignadas en esta sentencia que revisten aspectos técnicos de gran complejidad.

En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (art. 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el art. 56 de LJC, considero que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

X.Documentación aportada al expediente. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso por la falta de intervención del Consejo Nacional de Viabilidad y del Ministerio de Salud. Se le ordena a Oscar Rodríguez González, en su condición de director de la Dirección de Área Rectora de Salud de Oreamuno, o a quien ejerza ese cargo, que realice las gestiones necesarias para que, de FORMA INMEDIATA, se emitan las órdenes sanitarias pertinentes y se coordine lo pertinente para asegurar su cumplimiento. Asimismo, se le ordena a Jason Adrián Pérez Anchía, en su condición de director ejecutivo del Consejo Nacional de Viabilidad y a Oscar Rodríguez González, en su condición de director de la Dirección de Área Rectora de Salud de Oreamuno, o a quienes ejerzan esos cargos, que realice todas las acciones pertinentes y necesarias, dentro del ámbito de sus competencias, a fin de que, en el plazo máximo de SEIS MESES, contado a partir de la notificación de esta sentencia, se adopten un plan con medidas de canalización y de conducción para corregir la problemática sanitaria de encausamiento de las descargas de las aguas residuales y de las aguas pluviales en la zona objeto de este proceso.

Se advierte que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Consejo Nacional de Viabilidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez pone nota. La magistrada Garro Vargas salva el voto respecto de la sede de la ejecución de la sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que esa fase sea residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda. En cuanto a las autoridades de la Municipalidad de Oreamuno se desestima el recurso. Notifíquese.- Fernando Castillo V.
