CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 10 September 2026.
Amparo proceeding brought by [Nombre 001], identity card [Valor 001], against the ADMINISTRATIVE ASSOCIATION OF THE AQUEDUCT (ASADA) OF RIVAS and the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (ICAA).
Background:
Drafted by Justice Araya García; and, Reasons:
I.Object of the application. The applicant stated that the property where she resides (registration No. 610144-000) has no drinking-water supply service, despite her having requested one from the ASADA of Rivas. She complained that the infrastructure is located in front of the property. She stated that service had been denied to her despite her being a person with a disability and having serious medical conditions. She emphasized that other properties in the area do have this precious resource.
II.Admissibility of amparo applications against private-law entities. Under Article 57 of the Constitutional Jurisdiction Act, an amparo application is admissible against acts or omissions of private-law entities when they act, or are required to act, in the exercise of public functions or powers, or when they are, in law or in fact, in a position of power such that ordinary judicial remedies are clearly insufficient or too slow to guarantee the fundamental rights or freedoms referred to in Article 2(a) of that Act. In this case, the Chamber considers that the respondent ASADA is in a position of power such that ordinary judicial remedies would be insufficient and too slow to protect the fundamental rights of the party seeking amparo. The application is therefore admissible.
III.Preliminary matter. By order issued at 22:33 hours on 28 May 2026, the amparo application was admitted and notice was given to the President of the ASADA of Rivas. That decision expressly stated: “(…) The foregoing is subject to the warning that, pursuant to Articles 44, second paragraph, and 45 of the cited Act, the report will be deemed to have been made under oath (only for the public agency), such that any inaccuracy or falsehood will subject the reporting party to the penalties for perjury or false testimony, depending on the nature of the facts stated in it, and failure to report will result in the facts being deemed true and the application being capable of being granted. For these purposes, the report must be submitted personally and not through an attorney-in-fact (…)” (sic) (emphasis not in original). Nevertheless, the brief submitted was signed by Edgar Francisco Jiménez Risco in his capacity as Special Judicial Attorney-in-Fact for the entity. Accordingly, pursuant to Article 45 in relation to Article 65 of the Constitutional Jurisdiction Act, the report is deemed not to have been submitted and the facts are deemed true. The amparo application is therefore decided on the basis of all the evidence in the case file.
IV.Facts found. The following facts are considered duly proven and relevant to deciding this matter:
The protected party lives at property No. 610144-000 with her husband, Isaac Elizondo Barquero (see the application brief and memorandum No. GSD-UEN-GAR-2026-02449, added to the digital case file).
No distribution pipe belonging to an authorized operator passes through the sector where the property where the protected party lives is located; that is, it is outside the coverage area (see memoranda Nos. GSD-UEN-GAR-2026-02449 and GSD-UEN-GAR-2026-02429, added to the digital case file).
An ASADA La Bonita transmission pipe does pass through the area; this pipe lacks technical feasibility for providing permanent service connections (see memoranda Nos. GSD-UEN-GAR-2026-02449 and GSD-UEN-GAR-2026-02429, added to the digital case file).
As explained by the Special Judicial Attorney-in-Fact for the ASADA of Rivas: “(…) The property where the applicant says she resides is a property acquired by her partner (…) in May 2010. It is property with an agricultural purpose, as shown by the registry study (land for cultivation) and its cadastral plan (for cultivation). When they acquired that property, they knew not only the use of the property they were acquiring, but also that my client did not supply water to it or to that particular area. I do not know the justification given to the Municipality of Pérez Zeledón for construction of the dwelling; however, I can assure you that my client has never issued an endorsement or approval attesting to the service’s feasibility. The dwelling was therefore built with knowledge that the area had no drinking-water supply service. The pipes in front of the property are there because they belong to the ASADA of La Bonita, as the applicant herself says, and because the property where she says she lives is precisely in La Bonita de Rivas, an area covered by that ASADA.
Note that the plan clearly specifies that the property is in La Bonita de Rivas. Although the two ASADAS are neighbors, they are obviously not the same entity and are governed by different administrations. We therefore have no authority over what the ASADA of La Bonita decides, nor may we use the supply networks of other ASADAS. New services in neighboring areas have always been supplied according to criteria of responsibility and feasibility, and services have been installed only when they have first received the corresponding approval and prior commitment. Notwithstanding the foregoing, and as the applicant herself says, my client has no services anywhere near the property; the closest is more than 300 meters away (…)” (sic) (see the brief added to the digital case file).
By letter No. 0001083-AR-2025, signed on 19 June 2025 by the President of the ASADA of Rivas, Isaac Norberto Elizondo Barquero was informed as follows: “(…) This property does NOT have SANITARY SEWER service in front of it. The ASADA of Rivas has no distribution network in front of this property: Address: 800 meters east of Rancho La Botija. Registration: 610144-000 Cadastral plan: 1254237-2008. For the reasons stated above, water availability is DENIED (…)” (sic) (see the evidence submitted by the Special Judicial Attorney-in-Fact for the ASADA of Rivas, added to the digital case file).
The letter No. GSD-UEN-GAR-2026-01942 of 5 May 2026, signed by officials of the ICAA’s UEN Management of ASADAS, was sent to [Nombre 001]. It explained: “(…) In response to your brief sent to Casa Presidencial concerning the lack of access to drinking-water service at your property, you are informed that your situation has been repeatedly reviewed, analyzed, and addressed by the Costa Rican Institute of Aqueducts and Sewers (AyA), in coordination with the ASADA of Rivas de Pérez Zeledón, the authorized operating entity in the sector. By letter GSD-UEN-GAR-2025-02815, dated 23 July 2025, a formal response was provided to a prior request, reiterating the current technical position: a technical study must be submitted to the ASADA of Rivas, in accordance with the Regulations for the Provision of AyA Services, because there was no technical feasibility to provide the service at that time. As part of the institutional follow-up, a meeting was held on 14 October 2025 with officials of the UEN Management of Rural Aqueducts and ASADA Strengthening, at which it was agreed to review your case again with the ASADA of Rivas.
That meeting took place on 29 October 2025, and it was concluded that the technical limitations persist, chiefly the lack of available water resources and the fact that your property is outside the coverage area of the aqueduct managed by that ASADA. These results were officially communicated to you by letter GSD-UEN-GAR-2026-00222, dated 21 January 2026. In addition, through letter 0001149–AR–2025, the ASADA of Rivas recorded the multiple steps taken, including formal responses, Board of Directors meetings, and judicial history, in which the absence of water resources and of a distribution network in the relevant sector was determined. In this context, you have been clearly and repeatedly informed that, for possible access to drinking-water service, the interested party must submit a technical study and any works resulting from that study must eventually be carried out in order to enable service in the sector.
The study must be assessed by the ASADA of Rivas and AyA in light of the actual availability of water resources and the applicable technical criteria. In conclusion, you have received timely institutional attention and have been told what steps to follow. The current limitations stem from objective technical conditions beyond this Institution’s control. AyA reiterates its willingness to continue providing you with technical support within the regulatory framework and the actual capabilities of the system (…)” (sic) (see the report submitted and the evidence provided by the ICAA authorities, added to the digital case file).
V.Denial of a request for drinking-water availability due to failure to meet requirements or legal, formal, technical, or material impossibility. The Chamber’s case law has recognized the so-called fundamental right to water, under which all persons must be afforded the opportunity to access drinking-water services on equal terms, since water is essential to human life and health. However, the fundamental nature of this right does not entail unrestricted access to water services, since the administration may establish general requirements that each applicant must meet when its particular request is assessed. Specifically, as to the denial of a request for drinking-water availability due to failure to meet requirements or legal, formal, technical, or material impossibility, this Court explained in judgment No. 2023-009594, issued at 09:15 hours on 28 April 2023:
“(…) It is established that the respondent institute rejected the request for drinking-water service on the ground that there was no water availability and no sewer system in front of the property. In this regard, this Court has held that the Costa Rican Institute of Aqueducts and Sewers, aqueduct and sewer administrative associations, municipalities, and other institutions that provide drinking-water supply services may validly reject service requests submitted to them or make them conditional when technical or legal reasons justify doing so. Thus, in judgment No. 2016-006027, issued at 09:05 hours on 06 May 2016, this Chamber held:
“ This Constitutional Court, in judgment 2014-9134, issued at 14:05 hours on 19 June 2014, which addressed an issue very similar to the one raised in this application, held: ‘(...) This Chamber has repeatedly stated in judgments on this subject that the supply of drinking water is considered under Costa Rican law to be a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and in a manner that adapts to technological change (see judgment 2001-09676, issued at eleven hours and twenty-five minutes on the twenty-sixth of September two thousand one, and judgment 2004-08161, issued at ten hours and fifty-three minutes on the twenty-third of July two thousand four). It is therefore clear that the Costa Rican Institute of Aqueducts and Sewers, as one of the state entities responsible for providing the public drinking-water service, is also required to provide this service continuously, adaptably, efficiently, and equally to all inhabitants.
However, this Constitutional Court’s case law has also held that, in the face of legal impossibility (failure to meet requirements established in the applicable regulations) or formal impossibility (absence of a water distribution network), it is reasonable not to grant service requests or to require the interested party to bear installation costs when no drinking-water distribution network exists and infrastructure must be built. In such cases, it is clear that this is not a denial of access to drinking-water service, but rather an inability to provide it or the interested party’s necessary participation in overcoming a technical impossibility, namely the lack of infrastructure. In other words, where the failure to provide drinking-water service is not capricious, arbitrary, or unsupported, but is justified by legal or material impossibility, there is no violation of fundamental rights.
In this case, the evidence submitted and the report made under oath confirm that AyA did not arbitrarily reject the applicant’s request, but did so because not all of the technical and legal requirements set out in the Regulations for the Provision of Services to Clients of the Costa Rican Institute of Aqueducts and Sewers for approving new services had been met.’” This ruling may be supplemented by judgment No. 2017-005245, issued at 10:00 hours on 07 April 2017, which held, in relevant part:
“According to the report submitted by the authorities of the respondent municipality, the applicant’s complaint as to whether the place where Ms. Garbanzo Morelli owns property lies outside the water supply area is a matter for the Costa Rican Institute of Aqueducts and Sewers to address, since the Municipality has no authority over it. The Costa Rican Institute of Aqueducts and Sewers, for its part, states that it acted in accordance with the regulations governing it and properly exercised its regulatory function, taking duly reasoned and substantiated action throughout, as detailed. It is therefore evident that the Institute acted in accordance with law, since the technical report issued by the UEN Optimization of Systems and New Developments GAM, letter UEN-OSND-GAM- 2017-00082, clearly states that drinking water is unavailable for the property identified by Ms. Rocío Patricia Garbanzo in her amparo application.
The report further adds that a review of the property’s history shows that it belonged to the property recorded under [Valor 005] and that, according to a search of the National Registry, the latter was subdivided, resulting in four properties without an availability request having been made for that subdivision. Accordingly, this Chamber cannot establish any omission or arbitrary action by the respondent authority. The amparo must therefore be denied, and it must be reiterated that, according to the evidence submitted, failure to supply drinking-water service to the applicant’s lot is not capricious, arbitrary, or unsupported, but is justified by the absence of drinking-water availability in the sector. (See, to similar effect, judgments Nos. 2014-9134, issued at 14:05 hours on 19 June 2014, and 2016007240, issued at 09:20 hours on 27 May 2017, among others.) In light of the foregoing, there is no violation of fundamental rights and the amparo application should therefore be dismissed.” As to denial of drinking-water service for objective reasons, judgment No. 2019-023102, issued at 08:50 hours on 22 November 2019, must also be mentioned. In deciding a similar amparo application, the Chamber declared:
“On the other hand, the report submitted under oath by the respondent authority explains that although properties adjoining the applicant’s property have water service, they have different characteristics. It distinguishes that the three properties resulting from parent property 2-254199-000, including the applicant’s property, were recorded in the cadastre in April 2018, as shown by the plan submitted by the interested party, after the opinions C-258-2017 of 9 November 2017 and C-300-2017 of 13 December 2017 of the Procuraduría General de la República (PGR). Those opinions confirm that the obligations set out in Article 10(2) of the Urban Planning Act remain fully in force, while also recalling the need to obtain prior approval from AyA in response to Article 21 of its constituent act. Accordingly, since it does not appear that the lots subdivided from the parent property containing the applicant’s property were granted water availability without AyA’s approval—which is required for subdivision under Article 21 of the Constituent Act of AyA, No. 2726—or without approval from the National Institute of Housing and Urbanism (INVU), as required by Article 10(2) of the Urban Planning Act and Article 21 of the Constituent Act of AyA, unequal treatment to the detriment of the protected party is ruled out, and the denial of drinking-water availability is found to have been based on objective reasons.
As a result, the respondent authority’s action is not found to have been arbitrary, and the application is dismissed in all respects, as is hereby ordered. The applicant is also advised that she may challenge the decision on her drinking-water request before the authority or in the administrative-litigation jurisdiction.” Under these circumstances, the respondent institute denied the protected party’s request, fully informing her of the technical reasons why it could not be granted, namely that drinking water was unavailable in front of the property because there was no sewer system. Whether the requested service should be granted is not a matter to be considered in this jurisdiction, since it falls outside its authority. It may also be added that this Court has repeatedly held that applications for drinking-water service may be dismissed when technical impossibilities arise, requirements established below the constitutional level are not met, or technical or legal criteria justify doing so.
Moreover, this Chamber must not act as a mediator with a particular natural or legal person—whether the latter is a public- or private-law entity—to intercede on behalf of a third party so that the third party may obtain what the applicants seek, as the applicant asks the Court to do in this case. The applicant must therefore raise her objections or claims before the respondent authority or in the competent judicial forum, where she may fully litigate the merits and assert her claims. Accordingly, the application is dismissed, as is hereby ordered (…)” (emphasis not in original).
It follows that although there is a fundamental right to water that may be asserted before the ICAA or the respective ASADAS, provision of the service may also be conditioned on meeting the requirements for its grant and on the material possibility of supplying it—that is, there must be no technical circumstances that prevent or advise against doing so (see also judgment No. 2023-022230, issued at 09:15 hours on 8 September 2023).
VI.The specific case. In judgment No. 2022017546, issued at 09:15 hours on 29 July 2022, this Constitutional Chamber resolved amparo application No. 22-011392-0007-CO, brought by Isaac Norberto Elizondo Barquero (the applicant’s husband) against the ASADA of Rivas and the ICAA. On that occasion, it held:
“(…) After analyzing the evidence submitted, this Court rules out a violation of the applicant’s fundamental rights. The record duly establishes that the protected party owns property recorded under No. 610143 000, located in the community of Rivas in Pérez Zeledón. It is established that he repeatedly requested drinking-water availability and received a response from the respondent ASADA on each occasion, stating that his property had neither a drinking-water distribution network nor a sanitary sewer network in front of it. In addition, it is apparent that, due to the applicant’s persistence, the President of the respondent ASADA sought a legal opinion from the Costa Rican Institute of Aqueducts and Sewers. The authorities of the Regional Office of Community Aqueducts for the Brunca Region confirmed that a negative service-availability determination had been issued, since a technical study complying with the ASADA Regulations and AyA’s Regulations for the Provision of Services must be prepared.
In light of the foregoing, this Chamber finds that the denial complained of was not arbitrary or unjustified, since technical obstacles prevent the provision of drinking-water service to the applicant. Accordingly, it must be reiterated that, although this Court has recognized the right to drinking-water supply as an emerging right serving individuals, it has also held that applications for drinking-water service may be dismissed when technical impossibilities arise, requirements established below the constitutional level are not met, or technical and/or legal criteria justify doing so—as in this case. In addition, the applicant must be advised that it is not for this Court to analyze whether the reasons given for denying water availability are valid, much less to determine whether the requested service should be granted. Those matters do not correspond to this constitutional jurisdiction because they fall outside its authority.
Finally, this Court must not act as a mediator with a particular natural or legal person to intercede on behalf of a third party so that the third party may obtain what the protected party seeks, as requested. The applicant may, if he so wishes, raise his objections or claims before the respondent authority or in the competent judicial forum, where he may fully litigate the merits and assert his claims. In light of the foregoing, the application should be dismissed (…)”
Therefore:
The application is denied (…)” (sic) (emphasis not in original).
VII.In the sub judice case, it was established that the protected party lives at property No. 610144-000 with her husband. No distribution pipe belonging to an authorized operator passes through the sector where the protected party’s property is located; that is, it is outside the coverage area. An ASADA La Bonita transmission pipe does pass through the area, but that pipe lacks technical feasibility for providing permanent service connections. As explained by the Special Judicial Attorney-in-Fact for the ASADA of Rivas: “(…) The property where the applicant says she resides is a property acquired by her partner (…) in May 2010. It is property with an agricultural purpose, as shown by the registry study (land for cultivation) and its cadastral plan (for cultivation). When they acquired that property, they knew not only the use of the property they were acquiring, but also that my client did not supply water to it or to that particular area.

That meeting took place on 29 October 2025, and it was concluded that the technical limitations persist, chiefly the lack of available water resources and the fact that your property is outside the coverage area of the aqueduct managed by that ASADA. These results were officially communicated to you by letter GSD-UEN-GAR-2026-00222, dated 21 January 2026. In addition, through letter 0001149–AR–2025, the ASADA of Rivas recorded the multiple steps taken, including formal responses, Board of Directors meetings, and judicial history, in which the absence of water resources and of a distribution network in the relevant sector was determined. In this context, you have been clearly and repeatedly informed that, for possible access to drinking-water service, the interested party must submit a technical study and any works resulting from that study must eventually be carried out in order to enable service in the sector.
The study must be assessed by the ASADA of Rivas and AyA in light of the actual availability of water resources and the applicable technical criteria. In conclusion, you have received timely institutional attention and have been told what steps to follow. The current limitations stem from objective technical conditions beyond this Institution’s control. AyA reiterates its willingness to continue providing you with technical support within the regulatory framework and the actual capabilities of the system (…)” (sic) (emphasis not in original).
Based on the foregoing, it may be stated that:
IX.No violation or threat to a fundamental right is evident, nor is there any indication of discrimination. The applicant is reminded that it is not for this Constitutional Chamber to determine whether, under the applicable laws or regulations, the availability she seeks should be granted or whether she should be authorized to carry out infrastructure works. Nor is it for this Chamber to determine whether the water availability allegedly granted to neighbors was granted in violation of the laws and regulations below the constitutional level. All of this exceeds both the summary nature of an amparo application and this Court’s authority, as defined by law and the Political Constitution itself. Any dispute on these matters must be raised and resolved before the ASADA itself, the ICAA, or the competent ordinary legality jurisdiction.
X.Conclusion. Under these circumstances, the amparo application is inadmissible and must be declared as such.
XI.Dissenting opinion of Justices Cruz Castro and Rueda Leal. In the sub judice case, the applicant complains of inadequate drinking-water service where she lives.
In this regard, as has occurred in other matters in which problems of a similar scale in water supply have been alleged (for example, case file no. 20-004883-0007-CO), we consider it essential to include the Public Services Regulatory Authority (Aresep) as a party. Indeed, in the judgment issued in the aforementioned proceeding (no. 2020007754, at 9:45 a.m. on 24 April 2020), the Chamber noted that, in its report, Aresep identified a series of problems at the Costa Rican Institute of Aqueducts and Sewerage concerning investment in infrastructure, losses from unaccounted-for water, and implementation capacity. On that occasion, this Court held: “In this regard, the record shows not only that the water-supply problem had been evident since 2017, but also that ARESEP pointed out that ICAA was behind on infrastructure investment and, in addition, had significant losses due to unaccounted-for water. The regulatory body also stated that the water service operators’ capacity to carry out projects had not been what was desired.” Accordingly, we dissent and order that processing of the amparo proceeding continue so that a report may be requested from the general regulator of the Public Services Regulatory Authority.
XII.Documents submitted to the case file. The parties are advised that if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum period of 30 working days from notification of this judgment. Otherwise, all material not collected within this period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session N° 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo application is dismissed. Justices Cruz Castro and Rueda Leal dissent and order that processing of the amparo proceeding continue so that a report may be requested from the general regulator of the Public Services Regulatory Authority.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del diez de setiembre de dos mil veintiseis .
Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO (ASADA) DE RIVAS y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto del recurso. La recurrente aseguró que el inmueble donde reside (matrícula 610144-000) no cuenta con servicio de suministro de agua potable, pese a que lo ha solicitado a la ASADA de Rivas. Reclamó que al frente del bien existe la infraestructura. Afirmó que se le ha denegado el servicio sin importar que es una persona discapacitada con padecimientos médicos delicados. Enfatizó que otras propiedades de la zona sí cuentan con el preciado líquido.
II.Sobre la admisibilidad de los recursos de amparo contra sujetos de Derecho Privado. A tenor de lo dispuesto por el artículo 57 de la Ley de la Jurisdicción Constitucional, es admisible el recurso de amparo contra las acciones u omisiones de sujetos de derecho privado, cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a) de la misma Ley. En el presente caso estima la Sala que la ASADA recurrida, se encuentra en una posición de poder frente a la cual los remedios jurisdiccionales ordinarios resultarían insuficientes y tardíos, para tutelar los derechos fundamentales de la parte amparada, por lo que el recurso resulta admisible.
III.Cuestión preliminar. Mediante el auto de las 22:33 horas de 28 de mayo de 2026, se admitió el recurso de amparo y se dio traslado al Presidente de la ASADA de Rivas. En dicha resolución expresamente se indicó: “(…) Lo anterior bajo la prevención que conforme a lo dispuesto en los artículos 44 párrafo 2º y 45 de la Ley citada, se considerará dado bajo juramento (sólo para la dependencia pública), de manera que cualquier inexactitud o falsedad hará incurrir a la parte informante en las penas del perjurio o del falso testimonio, según la naturaleza de los hechos contenidos en él, y que la omisión en informar causará que se tenga por ciertos los hechos y se pueda declarar con el lugar el recurso, para cuyos efectos deberá rendirlo personalmente y no por medio de apoderado (…)” (sic) (el énfasis no pertenece al original). No obstante, se aportó un escrito firmado por Edgar Francisco Jiménez Risco, en su condición de Apoderado Especial Judicial de la entidad. Por consiguiente, en aplicación de los artículos 45 en relación con el 65 de la Ley de la Jurisdicción Constitucional, se tiene por no rendido el informe y por ciertos los hechos. Así las cosas, se resuelve el recurso de amparo con base en todos los elementos de juicio que constan en el expediente.
IV.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
La tutelada habita el inmueble No. 610144-000, junto con su esposo Isaac Elizondo Barquero (ver el escrito de interposición, así como el memorando No. GSD-UEN-GAR-2026-02449, agregado al expediente digital).
En el sector donde se ubica la propiedad donde reside la amparada, no pasa una tubería de distribución de algún operador autorizado, es decir, se encuentra fuera del área de cobertura (ver los memorandos Nos. GSD-UEN-GAR-2026-02449 y GSD-UEN-GAR-2026-02429, agregados al expediente digital).
Sí pasa una tubería de conducción de la ASADA La Bonita; esta tubería no cuenta con factibilidad técnica para otorgar conexiones permanentes de servicios (ver los memorandos Nos. GSD-UEN-GAR-2026-02449 y GSD-UEN-GAR-2026-02429, agregados al expediente digital).
Según explicó el Apoderado Especial Judicial de la ASADA Rivas: “(…) La finca en la que manifiesta residir la recurrente, es una finca adquirida por su pareja (…) en mayo del año 2010, la cual es una propiedad con una vocación agraria según se desprende del estudio registral (naturaleza terreno para cultivos) y del plano de la misma (para cultivos). Cuando ellos adquieren dicha propiedad, tienen conocimiento no solo del uso de la finca adquirida, sino que además en la misma y en esa zona en particular, no existe suministro de agua por parte de mi representada. Desconozco la justificación invocada ante la municipalidad de Pérez Zeledón para la construcción de la vivienda, más sin embargo, puedo asegurar que mi representada nunca ha otorgada visado o visto bueno de viabilidad del servicio; por lo que la construcción de una vivienda se hizo a sabiendas de que la zona no tenía servicio de suministro de agua potable.
La existencia de tuberías frente a la propiedad, es en razón de que dichas tuberías pertenecen a la ASADA de La Bonita, como bien lo dice la recurrente, y se da en función de que la propiedad donde manifiesta vivir la recurrente, está justamente en la Bonita de Rivas, que es una zona de cobertura de dicha ASADA. Nótese como en el plano, claramente especifica que el inmueble se encuentra en La Bonita de Rivas; pese a que ambas ASADAS somos vecinas, evidentemente no es lo mismo, y nos regimos bajo administraciones diferentes, por lo que de lo que disponga la ASADA de La Bonita nosotros no tenemos injerencia alguna, ni tampoco podemos disponer de las redes de abastecimiento de otras ASADAS. El abastecimiento de nuevos servicios en zonas aledañas, se ha dado siempre bajo criterios de responsabilidad y viabilidad, y cuando se han instalado servicios es porque estos de previo ya han contado con el consecuente aval y compromiso previo.
No obstante lo anterior, y como bien lo menciona la recurrente, de parte de mi representada no existen servicios ni remotamente cerca, siendo el más próximo a más de 300 metros de distancia (…)” (sic) (ver el escrito agregado al expediente digital).
Mediante el oficio No. 0001083-AR-2025, firmado el 19 de junio de 2025 por el Presidente de la ASADA de Rivas, se comunicó a Isaac Norberto Elizondo Barquero, lo siguiente: “(…) Dicha propiedad NO cuenta al frente con el servicio de ALCANTARILLADO SANITARIO. La ASADA de Rivas no cuenta con red de distribución al frente de esta propiedad: Dirección: 800 metros este de Rancho La Botija. Matrícula: 610144-000 Plano catastro: 1254237-2008 Por las razones antes mencionadas, se da DISPONIBILIDAD NEGATIVA (…)” (sic) (ver la prueba aportada por el Apoderado Especial Judicial de la ASADA de Rivas, agregada al expediente digital).
A [Nombre 001] se le hizo llegar el oficio No. GSD-UEN-GAR-2026-01942 de 5 de mayo de 2026, suscrito por funcionarios de la UEN Gestión de ASADAS del ICAA, en el que se le explicó: “(…) En atención a su escrito remitido a Casa Presidencial, relacionado con la falta de acceso al servicio de agua potable en su propiedad, se le informa que su situación ha sido conocida, analizada y atendida de manera reiterada por el Instituto Costarricense de Acueductos y Alcantarillados (AyA), en coordinación con la ASADA de Rivas de Pérez Zeledón, ente operador autorizado en el sector. Mediante oficio GSD-UEN-GAR-2025-02815, de fecha 23 de julio de 2025, se le brindó respuesta formal a una gestión previa, reiterándose el criterio técnico vigente: la necesidad de presentar un estudio técnico ante la ASADA de Rivas, de conformidad con el Reglamento para la Prestación de los Servicios de AyA, debido a la inexistencia de factibilidad técnica para brindar el servicio en ese momento.
Como parte del seguimiento institucional, el 14 de octubre de 2025 se sostuvo una reunión con autoridades de la UEN Gestión de Acueductos Rurales y de Fortalecimiento de ASADAS, acordándose revisar nuevamente su caso con la ASADA de Rivas. Dicha reunión se realizó el 29 de octubre de 2025, concluyéndose que persisten las limitaciones técnicas, principalmente la falta de disponibilidad hídrica y el hecho de que su propiedad se encuentra fuera del área de cobertura del acueducto administrado por dicha ASADA. Estos resultados le fueron comunicados oficialmente mediante oficio GSD-UEN-GAR-2026-00222, de fecha 21 de enero de 2026. Adicionalmente, la ASADA de Rivas, por medio del oficio 0001149–AR–2025, dejó constancia de las múltiples gestiones realizadas, incluyendo respuestas formales, reuniones de Junta Directiva y antecedentes judiciales, en los cuales se determinó la inexistencia de recurso hídrico y de red de distribución en el sector correspondiente.
En ese contexto, se le ha informado de manera clara y reiterada que, para un eventual acceso al servicio de agua potable, es indispensable la presentación de un estudio técnico por parte de la interesada y el eventual desarrollo de las obras resultantes en dicho estudio para poder habilitar el servicio en dicho sector, el cual deberá ser valorado por la ASADA de Rivas y el AyA conforme a la disponibilidad real del recurso hídrico y a los criterios técnicos aplicables. En conclusión, se le ha brindado atención institucional oportuna, se le ha indicado el proceder correspondiente, y las limitaciones actuales obedecen a condiciones técnicas objetivas, ajenas a la voluntad de esta Institución. El AyA reitera su disposición de continuar brindándole acompañamiento técnico dentro del marco normativo y de las posibilidades reales del sistema (…)” (sic) (ver el informe rendido y la prueba aportada por las autoridades del ICAA, agregado al expediente digital).
V.Sobre la denegatoria de una solicitud de disponibilidad de agua potable por incumplimiento de requisitos o imposibilidad jurídica, formal, técnica o material. La jurisprudencia de la Sala ha reconocido el denominado derecho fundamental al agua por el cual debe concederse a todas las personas la posibilidad de acceder, en condiciones de igualdad, a los servicios de agua potable, toda vez que esta resulta esencial para la vida y la salud humanas. No obstante, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento. Particularmente en lo que respecta a la denegatoria de una solicitud de disponibilidad de agua potable por incumplimiento de requisitos o imposibilidad jurídica, formal, técnica o material, este Tribunal en la sentencia No. 2023-009594 de las 09:15 horas de 28 de abril de 2023, explicó:
“(…) se constata que el instituto recurrido rechazó la solicitud del servicio de agua potable bajo el argumento que no hay disponibilidad de agua y sistema de alcantarillado al frente de propiedad. Al respecto, este Tribunal ha señalado que el Instituto Costarricense de Acueductos y Alcantarillados, las asociaciones administradoras de acueductos y alcantarillados, las municipalidades y demás instituciones que prestan el servicio de suministro de agua potable, pueden rechazar válidamente las solicitudes de servicio de agua potable que les sean formuladas o condicionarlas si existen razones técnicas o legales que así lo justifican. De esta forma, en sentencia No. 2016-006027 de las 09:05 horas del 06 de mayo de 2016, esta Sala consideró:
“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes.
Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales.
En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”.
Este pronunciamiento puede complementarse con la sentencia No. 2017-005245 de las 10:00 horas del 07 de abril de 2017, que en lo conducente dispuso:
“Del informe rendido por las autoridades de la municipalidad recurrida se indica que el reclamo de la recurrente, respecto de si el lugar donde tiene la propiedad la señora Garbanzo Morelli está fuera o no del abastecimiento de agua, le corresponderá al Instituto Costarricense de Acueductos y Alcantarrillados referirse al respecto, ya que la Municipalidad no tiene competencia para ello. Y por su parte, el Instituto Costarricense de Acueductos y Alcantarillados menciona que han actuado conforme a la normativa que lo regula, ejerciendo su función rectora como corresponde, llevando a cabo en todo momento actuaciones debidamente fundamentadas y razonadas como se detalló, se evidencia así que el Instituto ha procedido conforme a derecho, ya que según el informe técnico emitido por la UEN Optimización de Sistemas Nuevos Desarrollos GAM, oficio UEN-OSND-GAM- 2017-00082, se indica claramente que para el inmueble que cita la señora Rocío Patricia Garbanzo en su recurso de amparo, no existe la disponibilidad de agua potable.
Además agrega el informe, que en análisis de los antecedentes de este inmueble se tiene que pertenecía a la propiedad con catastro [Valor 005] y según consulta al Registro Nacional, ésta última fue fraccionada y de la misma resultaron cuatro propiedades sin mediar la gestión del trámite de disponibilidad para dicho fraccionamiento. Así las cosas, esta Sala no logra acreditar ninguna omisión o actuación arbitraria por parte de la autoridad recurrida, en consecuencia lo correspondiente es declarar sin lugar el amparo, y reiterar que según la prueba aportada, la falta de dotación del servicio de agua potable en el lote de la recurrente no es una actuación antojadiza, arbitraria o sin fundamento, sino que está justificada en la inexistencia de disponibilidad de agua potable en el sector. (Ver en similar sentido las sentencias números 2014-9134 de las 14:05 horas del 19 de junio de 2014 y 2016007240 de las 09:20 horas del 27 de mayo 2017, entre otras). Bajo esa inteligencia, no se está frente a la infracción de derechos fundamentales y, por ello, lo pertinente es desestimar el recurso de amparo”.
Sobre la denegatoria del servicio de agua potable por razones objetivas, se impone mencionar la sentencia No. 2019-023102 de las 08:50 horas del 22 de noviembre de 2019, al conocer de un amparo similar la Sala declaró lo siguiente:
“Por otro lado, en el informe dado bajo la gravedad de juramento por parte de la autoridad recurrida, se explica que si bien hay propiedades que colindan con la de la recurrente, que cuentan con el servicio de agua, ello se debe a que presentan características distintas. Distingue que, los tres fundos derivados de la finca madre 2-254199-000, entre los que se encuentra el de la recurrente, se catastraron en abril del año 2018, según se verifica en el plano aportado por la interesada, en fecha posterior a los pronunciamientos C-258-2017 del 9 de noviembre del 2017 y C-300-2017 del 13 de diciembre del 2017 de la Procuraduría General de la República (PGR), los cuales confirman la plena vigencia de las obligaciones contenidas en el artículo 10, inciso 2) de la Ley de Planificación Urbana, al tiempo que recuerda la necesidad de obtener la aprobación previa por parte del AyA, en respuesta a lo dispuesto en el artículo 21 de su ley constitutiva.
Así las cosas, al no desprenderse que a los lotes segregados de la finca madre del fundo propiedad de la recurrente, se les haya dado la disponibilidad pese a no contar con el visto del AyA - necesario para el fraccionamiento, de conformidad con lo señalado en el artículo 21 de la Ley Constitutiva del AyA, N° 2726- o con el visto bueno del Instituto Nacional de Vivienda y Urbanismo (INVU), de conformidad con lo señalado en el artículo 10, inciso 2) de la Ley de Planificación Urbana y el artículo 21 de la Ley Constitutiva del AyA; se descarta un trato desigual en perjuicio de la tutelada, y se aprecia que la denegatoria de disponibilidad de agua potable se fundamentó en razones objetivas. Corolario de lo anterior, se descarta que la actuación de la autoridad recurrida haya sido arbitraria y procede desestimar el recurso en todos sus extremos, como en efecto se dispone, no sin antes advertir a la recurrente su derecho de cuestionar lo resuelto en relación con su solicitud de agua potable, ante la autoridad o ante la jurisdicción contenciosa administrativa” Bajo tal estado de las cosas, el instituto recurrido rechazó la petición de la parte amparada, haciéndole saber cabalmente las razones de orden técnico por las cuales no procedía atender su solicitud, como es que no hay disponibilidad de agua potable al frente de la propiedad, pues no hay sistema de alcantarillado.
La procedencia o no del servicio solicitado no es un asunto que deba discutirse en esta jurisdicción, toda vez que es ajeno al ámbito de su competencia y cabe agregar que en reiteradas ocasiones este Tribunal ha sostenido que resulta posible desestimar las gestiones presentadas para el otorgamiento del servicio de agua potable, cuando se presenten imposibilidades técnicas, incumplimiento de requisitos infraconstitucionales o existan criterios técnicos o legales que así lo justifiquen. Por otra parte, este Sala no debe fungir como mediador ante una determinada persona física o jurídica ‒ya sea ésta última de derecho público o privado‒, para interceder por una tercera persona a fin de que se le conceda lo que las partes recurrentes pretenden, tal y como así lo solicita el gestionante que se proceda en este caso. Por ello, deberá plantear sus inconformidades o reclamos ante la autoridad recurrida o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, se desestima el recurso como en efecto se dispone (…)” (el énfasis no pertenece al original).
Se entiende, entonces, que si bien existe un derecho fundamental al agua que puede ser exigido ante el ICAA o ante las respectivas ASADAS, la prestación del servicio también puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen brindarlo (ver en este sentido también la sentencia No. 2023-022230 de las 09:15 horas de 8 de setiembre de 2023).
VI.Sobre el caso concreto. Esta Sala Constitucional mediante la sentencia No. 2022017546 de las 09:15 horas de 29 de julio de 2022, resolvió el recurso de amparo No. 22-011392-0007-CO, planteado por Isaac Norberto Elizondo Barquero (esposo de la recurrente), en contra de la ASADA de Rivas y el ICAA. En dicha oportunidad se dispuso lo siguiente:
“(…) Después de analizar los elementos probatorios aportados, este Tribunal descarta la lesión la lesión a los derechos fundamentales del recurrente. Del estudio de los autos, ha sido debidamente acreditado que el amparado es propietario de la finca matricula N° 610143 000, situada en la comunidad de Rivas en Pérez Zeledón. Se tiene por demostrado que ha solicitado en reiteradas ocasiones la disponibilidad de agua potable, razón por la cual, en cada una de ellas ha recibido respuesta por parte de la ASADA accionada, quienes le han indicado que su propiedad no mantiene al frente red de distribución de agua potable ni red de Alcantarillado Sanitario. Aunado a ello, se observa que por la insistencia del recurrente, el presidente de la ASADA recurrida solicitó criterio jurídico al Instituto Costarricense de Acueductos y Alcantarillados, por lo que las autoridades de la oficina Regional de Acueductos Comunales de la Región Brunca, confirmaron la emisión de una disponibilidad del servicio negativa, toda vez que se debe realizar un estudio técnico que cumpla con lo establecido en el Reglamento de ASADAS y el Reglamento de Prestación de Servicios del AyA.
A partir de lo expuesto, esta Sala determina que la denegatoria reclamada no resulta arbitraria ni mucho menos injustificada, ya que existen imposibilidades técnicas para brindar el servicio de agua potable a la recurrente. De ese modo, se debe reiterar que, si bien este Tribunal ha reconocido el derecho al suministro de agua potable como un derecho emergente y al servicio de los individuos, también ha señalado que resulta posible desestimar las gestiones presentadas para el otorgamiento del servicio de agua potable, cuando se presenten imposibilidades técnicas, incumplimiento de requisitos infraconstitucionales o existan criterios técnicos y/o legales que así lo justifiquen -como sucede en este caso-. Aunado a ello, se le debe advertir que no le corresponde a este Tribunal analizar si las razones emitidas para denegar el servicio de disponibilidad de agua son válidas, mucho menos determinar la procedencia o no del servicio solicitado, tales extremos no corresponder ser discutidos en esta jurisdicción constitucional, ya que es ajeno al ámbito de su competencia.
Finalmente, este Tribunal no debe fungir como mediador ante una determinada persona física o jurídica para interceder por una tercera persona a fin de que se le conceda lo que pretende, tal y como así lo solicita el amparado. Por ello, deberá el accionante -si a bien lo tiene- plantear sus inconformidades o reclamos ante la autoridad recurrida o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En virtud de lo expuesto, lo procedente es desestimar el recurso (…)
Por tanto:
Se declara sin lugar el recurso (…)” (sic) (el énfasis no pertenece al original).
VII.En el sub examine quedó demostrado que la tutelada habita el inmueble No. 610144-000, junto con su esposo. En el sector donde se ubica la propiedad donde reside la amparada no pasa una tubería de distribución de algún operador autorizado, es decir, se encuentra fuera del área de cobertura. Sí pasa una tubería de conducción de la ASADA La Bonita; pero esta tubería no cuenta con factibilidad técnica para otorgar conexiones permanentes de servicios. Según explicó el Apoderado Especial Judicial de la ASADA Rivas: “(…) La finca en la que manifiesta residir la recurrente, es una finca adquirida por su pareja (…) en mayo del año 2010, la cual es una propiedad con una vocación agraria según se desprende del estudio registral (naturaleza terreno para cultivos) y del plano de la misma (para cultivos). Cuando ellos adquieren dicha propiedad, tienen conocimiento no solo del uso de la finca adquirida, sino que además en la misma y en esa zona en particular, no existe suministro de agua por parte de mi representada.
Desconozco la justificación invocada ante la municipalidad de Pérez Zeledón para la construcción de la vivienda, más sin embargo, puedo asegurar que mi representada nunca ha otorgada visado o visto bueno de viabilidad del servicio; por lo que la construcción de una vivienda se hizo a sabiendas de que la zona no tenía servicio de suministro de agua potable. La existencia de tuberías frente a la propiedad, es en razón de que dichas tuberías pertenecen a la ASADA de La Bonita, como bien lo dice la recurrente, y se da en función de que la propiedad donde manifiesta vivir la recurrente, está justamente en la Bonita de Rivas, que es una zona de cobertura de dicha ASADA. Nótese como en el plano, claramente especifica que el inmueble se encuentra en La Bonita de Rivas; pese a que ambas ASADAS somos vecinas, evidentemente no es lo mismo, y nos regimos bajo administraciones diferentes, por lo que de lo que disponga la ASADA de La Bonita nosotros no tenemos injerencia alguna, ni tampoco podemos disponer de las redes de abastecimiento de otras ASADAS.
El abastecimiento de nuevos servicios en zonas aledañas, se ha dado siempre bajo criterios de responsabilidad y viabilidad, y cuando se han instalado servicios es porque estos de previo ya han contado con el consecuente aval y compromiso previo. No obstante lo anterior, y como bien lo menciona la recurrente, de parte de mi representada no existen servicios ni remotamente cerca, siendo el más próximo a más de 300 metros de distancia (…)” (sic) (el énfasis no pertenece al original). Mediante el oficio No. 0001083-AR-2025, firmado el 19 de junio de 2025 por el Presidente de la ASADA de Rivas, se comunicó a Isaac Norberto Elizondo Barquero (esposo de la amparada), lo siguiente: “(…) Dicha propiedad NO cuenta al frente con el servicio de ALCANTARILLADO SANITARIO. La ASADA de Rivas no cuenta con red de distribución al frente de esta propiedad: Dirección: 800 metros este de Rancho La Botija. Matrícula: 610144-000 Plano catastro: 1254237-2008 Por las razones antes mencionadas, se da DISPONIBILIDAD NEGATIVA (…)” (sic) (el énfasis no pertenece al original).
A [Nombre 001] se le hizo llegar el oficio No. GSD-UEN-GAR-2026-01942 de 5 de mayo de 2026, suscrito por funcionarios de la UEN Gestión de ASADAS del ICAA, en el que se le explicó: “(…) En atención a su escrito remitido a Casa Presidencial, relacionado con la falta de acceso al servicio de agua potable en su propiedad, se le informa que su situación ha sido conocida, analizada y atendida de manera reiterada por el Instituto Costarricense de Acueductos y Alcantarillados (AyA), en coordinación con la ASADA de Rivas de Pérez Zeledón, ente operador autorizado en el sector. Mediante oficio GSD-UEN-GAR-2025-02815, de fecha 23 de julio de 2025, se le brindó respuesta formal a una gestión previa, reiterándose el criterio técnico vigente: la necesidad de presentar un estudio técnico ante la ASADA de Rivas, de conformidad con el Reglamento para la Prestación de los Servicios de AyA, debido a la inexistencia de factibilidad técnica para brindar el servicio en ese momento.
Como parte del seguimiento institucional, el 14 de octubre de 2025 se sostuvo una reunión con autoridades de la UEN Gestión de Acueductos Rurales y de Fortalecimiento de ASADAS, acordándose revisar nuevamente su caso con la ASADA de Rivas. Dicha reunión se realizó el 29 de octubre de 2025, concluyéndose que persisten las limitaciones técnicas, principalmente la falta de disponibilidad hídrica y el hecho de que su propiedad se encuentra fuera del área de cobertura del acueducto administrado por dicha ASADA. Estos resultados le fueron comunicados oficialmente mediante oficio GSD-UEN-GAR-2026-00222, de fecha 21 de enero de 2026. Adicionalmente, la ASADA de Rivas, por medio del oficio 0001149–AR–2025, dejó constancia de las múltiples gestiones realizadas, incluyendo respuestas formales, reuniones de Junta Directiva y antecedentes judiciales, en los cuales se determinó la inexistencia de recurso hídrico y de red de distribución en el sector correspondiente.
En ese contexto, se le ha informado de manera clara y reiterada que, para un eventual acceso al servicio de agua potable, es indispensable la presentación de un estudio técnico por parte de la interesada y el eventual desarrollo de las obras resultantes en dicho estudio para poder habilitar el servicio en dicho sector, el cual deberá ser valorado por la ASADA de Rivas y el AyA conforme a la disponibilidad real del recurso hídrico y a los criterios técnicos aplicables. En conclusión, se le ha brindado atención institucional oportuna, se le ha indicado el proceder correspondiente, y las limitaciones actuales obedecen a condiciones técnicas objetivas, ajenas a la voluntad de esta Institución. El AyA reitera su disposición de continuar brindándole acompañamiento técnico dentro del marco normativo y de las posibilidades reales del sistema (…)” (sic) (el énfasis no pertenece al original).
A partir de lo expuesto es posible afirmar:
IX.No se evidencia la lesión o amenaza de un derecho fundamental; tampoco existe indicio alguno de discriminación. Se recuerda a la promovente que no le corresponde a esta Sala Constitucional definir si a tenor de las disposiciones legales o reglamentarias aplicables procede o no el otorgamiento de la disponibilidad que requiere, o bien si se le debe autorizar para llevar a cabo obras de infraestructura. Tampoco es ante esta Sala donde se debe determinar si las disponibilidades supuestamente otorgadas a los vecinos, lo fueron o no al margen del ordenamiento jurídico infraconstitucional. Todo lo anterior excede tanto la naturaleza sumaria del recurso de amparo, como la competencia de este Tribunal, delimitada en la Ley y la propia Constitución Política. Cualquier discusión al respecto debe ser expuesta y resuelta sea ante la propia ASADA, el ICAA, o bien en la sede jurisdiccional de legalidad ordinaria que corresponda.
X.Conclusión. Bajo estas circunstancias el recurso de amparo deviene improcedente, y así debe declararse.
XI.Voto salvado de los magistrados Cruz Castro y Rueda Leal. En el sub examine, la parte accionante reclama la inadecuada prestación del servicio de agua potable en el lugar donde vive.
Al respecto, tal y como ha ocurrido en otros asuntos en los que se han alegado problemas de abastecimiento de esa magnitud (por ejemplo, el expediente nro. 20-004883-0007-CO), consideramos imprescindible tener como parte a la Autoridad Reguladora de Servicios Públicos (Aresep). Incluso, en la sentencia dictada en el proceso referido (nro. 2020007754 de las 9:45 horas de 24 de abril de 2020), la Sala valoró que Aresep, al rendir su informe, puntualizó una serie de problemas del Instituto Costarricense de Acueductos y Alcantarillados en relación con la inversión en infraestructura, pérdidas por agua no contabilizada y capacidad de ejecución. En esa oportunidad, este Tribunal consideró: “Al respecto, no solo consta que la problemática de desabastecimiento de agua se venía reflejando desde el 2017, sino que la ARESEP puntualizó que el ICAA tenía un rezago en la inversión en infraestructura y, además, significativas pérdidas por concepto de agua no contabilizada. Asimismo, el ente regulador también afirmó que la capacidad de ejecución de los proyectos por parte de los operadores del servicio de agua potable no ha sido la deseable”.
En consecuencia, salvamos el voto y ordenamos continuar la tramitación del recurso a los efectos de que se solicite informe al regulador general de la Autoridad Reguladora de los Servicios Públicos.
XII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso. Los magistrados Cruz Castro y Rueda Leal salvan el voto y ordenan continuar la tramitación del recurso a los efectos de que se solicite informe al regulador general de la Autoridad Reguladora de los Servicios Públicos.
