Amparo proceeding in expediente N°26-028023-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.
BACKGROUND:
Drafted by Justice Salazar Alvarado; and, REASONS:
The applicant alleges that the community of Liberia has been affected by the suspension of drinking water service and therefore considers fundamental rights to have been violated.

From the relationship between Articles 21 and 50 of the Political Constitution, one can infer people’s rights to life, health, and a healthy and ecologically balanced environment, which are closely connected, since life, as the Constitution’s highest value, requires special protection: without life, protection of the other fundamental rights would be of little use. Accordingly, life must be protected in all its aspects—physical, mental, and environmental—and it is precisely here that the importance of protecting the environment and natural resources arises, in order to promote people’s well-being. Among other things, this well-being is achieved by protecting and conserving the quality and quantity of water resources so that the water is potable for human consumption, thereby protecting people’s health. Because water is necessary for hygiene, food, and drink, its contamination can cause serious harm to public health.
In this regard, the State must provide the protection and conservation mentioned above through the bodies it designates for that purpose. Those bodies must adopt the measures needed to guarantee everyone access to this resource and ensure compliance with those measures. In this vein, the right to water arises, and this Constitutional Court may protect it through amparo (Judgment N° 2007-005482, at 14:39 on 24 April 2007, reiterated on multiple occasions, including N° 2007-005482, at 09:20 on 31 January 2025).
In the present case, the applicant alleges that the community of Liberia has been affected by the suspension of drinking water service supplied by the Costa Rican Institute of Aqueducts and Sewers.
In this regard, the respondent authorities state in their report, submitted under oath—with prior warning of the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—that service was affected following a fault in a main pipe, which was addressed immediately. They state that, while the repairs were being carried out, users were informed about the water service and its suspension, and access to water was guaranteed by tanker trucks. They clarify that service was restored on 03 August 2026.
In similar cases, the Chamber has considered it appropriate to adopt certain measures to distribute the water obtained and thereby guarantee supply to existing users, since the situation is not attributable to the respondent institution (see, in this regard, Judgments N° 2016-14465, at 9:05 on 7 October 2016, N° 2014-9134, at 14:05 on 19 June 2014, and N° 2016-7240, at 09:20 on 27 May 2017, among others). Accordingly, the reported situation was caused by a force majeure circumstance, namely, a pipe failure. In response to this problem, the respondent institution has taken the necessary actions to minimize its effects and guarantee drinking water to everyone living in the area by supplying water through tanker trucks that travel through the affected areas. In addition, information about the suspensions and repairs was communicated to residents of the affected areas through publications in the official media of the Costa Rican Institute of Aqueducts and Sewers and the Municipality of Liberia.
In any event, if the applicant considers that the community where the applicant resides was not duly informed of the service suspensions, that is a complaint that must be submitted to the respondent authorities (see, in a similar vein, Judgments N°2026-022313, at 09:30 on 19 June 2026, N°2026-028821, at 09:25 on 30 July 2026, and N°2026-031084, at 09:30 on 13 August 2026). Finally, the body of evidence does not show that the applicant filed any complaint or request with the Costa Rican Institute of Aqueducts and Sewers concerning deficiencies in water service. In view of the foregoing, the amparo application must be dismissed, as is hereby ordered.
This Chamber must advise the parties that, if they submitted any paper documents, objects, or evidence stored on any additional device or in electronic, computer, magnetic, optical, telematic, or new technology format, they must retrieve them from the office within thirty business days after receiving notice of this judgment. Otherwise, all such materials will be destroyed in accordance with the “Regulation on the Electronic Expediente before the Judiciary,” approved by the Corte Plena at session N°27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial N°19 on 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session N°43-12 held on 03 May 2012, Article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de setiembre de dos mil veintiseis .
Recurso de amparo que se tramita en expediente N°26-028023-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el INSTITUTO COSTARRICENSE DE ACUEDUECTOS Y ALCANTARILLADOS.
RESULTANDO:
Redacta el Magistrado Salazar Alvarado; y,
CONSIDERANDO:
La parte recurrente alega la comunidad de Liberia se ha visto afectada por la suspensión del servicio de agua potable, por lo que estima lesionados sus derechos fundamentales.
Se estiman como debidamente demostrados los siguientes hechos, de importancia para la resolución del presente asunto:

ÚNICO. Que el recurrente no tenga acceso a agua potable.
De la relación de los artículos 21 y 50, de la Constitución Política, se desprenden el derecho de las personas a la vida, la salud y a un medio ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la constitución, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. Así las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública.
En ese sentido, la protección y conservación a la que se hace referencia, debe ser brindada por el Estado a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (Sentencia N° 2007-005482 de las 14:39 horas del 24 de abril del 2007, reiterada en múltiples ocasiones, entre ellas la N° 2007-005482, de las 09:20 horas del 31 de enero de 2025).
En el sub lite, la parte recurrente acusa que la comunidad de Liberia se ha visto afectada por la suspensión del servicio de agua potable suministrado por el Instituto Costarricense de Acueductos y Alcantarillados.
Al respecto, las autoridades recurridas, en su informe rendido bajo la solemnidad del juramento – con oportuno apercibimiento de las consecuencias, incluso penales, previstas en el artículo 44, de la Ley que rige esta Jurisdicción- expone que se dio una afectación en el servicio tras la avería de una tubería principal, la cual fue intervenida de forma inmediata. Aseguran que, en el tanto se realizaban los arreglos, se ha comunicado a los usuarios lo relativo al servicio de agua y su suspensión y se garantizó el acceso al líquido mediante camiones cisterna. Aclaran que el servicio fue restablecido desde el 03 de agosto anterior.
En casos similares, la Sala ha estimado procedente adoptar determinadas medidas para distribuir el líquido obtenido, y así garantizar el suministro a los usuarios ya existentes, pues dicha situación no resulta imputable a la institución recurrida (ver en este sentido las Sentencias N° 2016-14465 de las 9:05 horas del 7 de octubre de 2016, N° 2014-9134 de las 14:05 horas del 19 de junio de 2014 y N° 2016-7240 de las 09:20 horas del 27 de mayo 2017, entre otras). Así las cosas, la situación denunciada fue provocada por una circunstancia de fuerza mayor, como lo es la avería de una tubería. Ante esta problemática, la institución recurrida ha tomado las acciones necesarias para minimizar la situación y garantizar el agua potable a todas las personas que habitan en la zona, mediante el suministro de agua a través de camiones cisterna que hacen los recorridos por las zonas afectadas. Aunado a ello, lo relativo a las suspensiones y las reparaciones fue comunicado a los vecinos de los sectores afectados mediante publicaciones en los medios oficiales del Instituto Costarricense de Acueductos y Alcantarillados y de la Municipalidad de Liberia.
En todo caso, si el recurrente considera que la comunidad donde reside no ha sido debidamente informada de las suspensiones del servicio, ello constituye una queja que debe ser presentada ante las autoridades recurridas (véanse, en similar sentido, las Sentencias N°2026-022313 de las 09:30 horas del 19 de junio de 2026, N°2026-028821 de las 09:25 horas del 30 de julio de 2026 y N°2026-031084 de las 09:30 horas del 13 de agosto de 2026). Finalmente, del elenco probatorio no se extrae que el recurrente haya presentado queja o gestión alguna ante el Instituto Costarricense de Acueductos y Alcantarillados, respecto a las deficiencias en la prestación del servicio de agua. Bajo ese panorama, lo procedente es desestimar el recurso, como en efecto se dispone.
Debe prevenir esta Sala a las partes que, de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo de treinta días hábiles después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N°27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial N°19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 03 de mayo del 2012, artículo LXXXI.
POR TANTO:
