Background:

  1. 1By a document entered into the digital case file on 21 July 2026, the applicants filed an amparo application against the ICAA. According to the order admitting the proceeding, they state as follows:

“[T]hey are residents of Calle Cambronero, Alajuelita, a community suffering from a lack of drinking water due to constant and prolonged service suspensions. They state that, when they filed this amparo proceeding, they had been without drinking water service for three consecutive weeks. They state that the situation described has become a permanent problem of access to drinking water, consequently affecting their quality of life and limiting their ability to meet basic needs. In addition, they assert that the community is exposed to health risks, especially for minors, older adults, persons with disabilities, pregnant women, and persons with chronic illnesses. They maintain that they have submitted multiple requests to the ICAA without those requests being addressed and, consequently, no concrete solution has been provided to the reported problem. For these reasons, they consider their fundamental rights to have been violated and request this Chamber’s intervention.”

  1. 2By order issued at 09:28 on 12 August 2026, this proceeding was admitted and the respondent authorities were asked to report on the facts alleged by the applicants.
  2. 3By documents entered into the digital case file on 18 August 2026, Jorge Mauricio Matamoros Pérez, in his capacity as head of the UEN Customer Service, Zone III GAM, Alajuelita Commercial Office of the ICAA, reports under oath that:

“I. REGARDING THE FACTS ALLEGED BY THE APPLICANT In response to the situation at issue in the amparo, brought by the applicants [Nombre 001] and others against the Costa Rican Institute of Aqueducts and Sewerage, on the basis of the technical report, Exhibit 1: MEMORANDUM No. UEN-SCZIII-GAM-2026-00496, dated 13 August 2026, prepared by Jorge Mauricio Matamoros Pérez, an employee of the UEN Customer Service, Zone III GAM; Exhibit 2: MEMORANDUM No. SG-GSGAM-MZOESTE-2026-00871, dated 14 August 2026, by engineer Sulmericcia Hernández Rodríguez of the Macro West Zone GAM; and Exhibit 3: institutional email [email protected] from engineer Sulmericcia Hernández Rodríguez of the Macro West Zone GAM, Monday 17/8/2026 14:47, which are attached as evidence with this report, and on the scope of the rule set forth in the Reglamento para la Prestación de los Servicios de AyA, it is duly established that: FIRST: Regarding the facts alleged by the applicants, who are residents of Calle Cambronero in Alajuelita and report an impact on continuity of service, it is important to note that the commercial division of AyA has taken all actions within its area of responsibility.

This means that, through the institution’s interactive channels, the population of this sector has been provided with the necessary information through bulletins advising them that a service interruption will occur, explaining the reasons and indicating the approximate times of those events. This has been done through the Official Website www.aya.go.cr, the Institutional App – Servicios AyA, and the Official Social Networks Facebook: Acueductos y Alcantarillados CR. Accordingly, it should be noted that from 01 July through 13 August of this year, 20 bulletins were issued through interactive channels in the affected sector and approximately 21 bulletins in nearby locations, for the purpose of communicating the impact occurring there. (see Exhibit 1: UEN-SCZIII-GAM-2026-00496) SECOND: Additionally, on Thursday, 13 August of this year, the following actions were taken in response to the case: ➢ At 9:00 am, foreman Erick Arce Vindas conducted an inspection visit, during which he met with one of the applicants, [Nombre 020], who shared the amparo application with him and described the service conditions. ➢ At 9:00 am, distribution of drinking water by tanker began. - ➢ At 11:45 am, engineer Sulmericcia Hernández Rodríguez of the Macro West Zone GAM conducted a telephone interview with [Nombre 020], and arrangements were made for the foreman to return to take coordinates and delineate the affected area. ➢ At 1:00 pm, the foreman met with doña Xinia for a second time, and she accompanied him to take the coordinates.

Accordingly, AyA conducted an inspection visit to verify the situation described in the application, with one of the applicants participating. She explained that, in mid-May of this year, they began experiencing low pressure, until in the following weeks they were left without service. Later that same day, 13 August of this year, in the afternoon, a survey was conducted and the affected area was delineated; it was identified along the north side of Calle Cambronero, the stretch of which was defined by the corresponding coordinates. (see Exhibit 2: MEMORANDUM No. SG-GSGAM-MZOESTE-2026-00871 / see Exhibit 3: institutional email [email protected] from Monday 17/8/2026 14:47). THIRD: After the field visit, the case was analyzed, and certain hypotheses arose that must be verified, since there may be an obstruction in the pipe or the reduction may result from changes recently made in the La Chorotega area to improve service, which may have affected that particular stretch.

Consequently, to determine the actual causes and propose a solution, exploratory test pits must be dug at the point where the impact begins, after which a solution will be offered based on the findings of the field investigation. This means that the solutions at the site may correspond to one, several, or all of the following options: a. Clearing the pipe obstruction. b. Changing the boundary of the hydrometric sector (installing one or more boundary valves). c. Constructing and interconnecting a new branch line with its corresponding service connections (improving a branch line 110 m in length). (see Exhibit 2: MEMORANDUM No. SG-GSGAM-MZOESTE-2026-00871). – FOURTH: As indicated in the preceding section, the alternatives for solving the problem will depend on the results obtained from the exploratory test pits; however, a preliminary schedule must be presented transparently now, based on implementation of actions a, b and/or c: (…) The preceding table makes it abundantly clear that the final solution is estimated to take between 5 and 10 weeks, depending on which action must be implemented.

Meanwhile, while this situation is being resolved, the Institution ordered, as of 13 August of this year, that drinking water be distributed daily by tanker trucks to the affected stretch. (see Exhibit 2: MEMORANDUM No. SG-GSGAM-MZOESTE-2026-00871.-)”.

Meanwhile, while this situation is being resolved, the Institution ordered, as of 13 August of this year, that drinking water be distributed daily by tanker trucks to the affected stretch. (see Exhibit 2: MEMORANDUM No. SG-GSGAM-MZOESTE-2026-00871.-)”.

  1. 5The legal requirements have been observed in the proceedings followed.

Justice Garro Vargas drafted the decision; and, Reasons:

I.Subject of the application. The applicants state that they are residents of the community of Alajuelita, Calle Cambronero, where they are facing constant and repeated interruptions of water service, a situation that has become a problem affecting the entire community. They therefore state that they have submitted multiple requests to the respondent authority; however, they complain that, as of the filing date, no solution has been provided to the reported problem.

II.Facts found. The following facts are considered duly established and relevant to deciding this matter:

The applicants are residents of the community of Alajuelita, Calle Cambronero (undisputed fact).

Between 1 July 2026 and 13 August 2026, the ICAA authorities issued 20 bulletins through interactive channels in the affected sector and approximately 21 bulletins in nearby locations, for the purpose of communicating the impact occurring there (see report submitted under oath).

On 12 August 2026, the ICAA authorities were notified of the order admitting this proceeding (see notification records).

On 13 August 2026, the ICAA authorities conducted an inspection at the affected site with the aim of improving service; the following options were therefore proposed: a. Clearing the pipe obstruction. b. Changing the boundary of the hydrometric sector (installing one or more boundary valves). c. Constructing and interconnecting a new branch line with its corresponding service connections (improving a branch line 110 m in length) (see report submitted under oath).

As of 13 August 2026, the ICAA authorities ordered that drinking water be distributed daily by tanker trucks to the affected stretch (see report submitted under oath).

The alternatives proposed to solve the reported problem, together with a preliminary schedule, are as follows:

The ICAA authorities state that the final solution will be implemented within 5 to 10 weeks, depending on which action must be implemented (see report submitted under oath).

III.On the fundamental right to drinking water. This Court has recognized in its case law that the rights to health and life are fundamental human rights that depend on access to drinking water, and that the competent bodies have an unavoidable responsibility to ensure that society as a whole is not deprived of them. Indeed, the Chamber has previously held that, as part of the Law of the Constitution, there is a fundamental right to the supply of drinking water. Thus, in judgment No. 2003-004654, issued at 15:44 on 27 May 2003 and reiterated in judgment No. 2026-027563, issued at 09:25 on 21 July 2026, it held as follows:

“V.- The Chamber recognizes, as part of the Law of the Constitution, a fundamental right to drinking water, derived from the fundamental rights to health, life, a healthy environment, food, and decent housing, among others, as has also been recognized in international human rights instruments applicable in Costa Rica: it is expressly set out in the Convention on the Elimination of All Forms of Discrimination against Women (Art. 14) and the Convention on the Rights of the Child (Art. 24); it is also stated in the International Conference on Population and Development in Cairo (Principle 2), and in numerous other instruments of International Humanitarian Law. Within our Inter-American Human Rights System, the country is particularly bound in this area by Article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (the 1988 ‘Protocol of San Salvador’), which provides:

‘Article 11. Right to a Healthy Environment 1. Everyone has the right to live in a healthy environment and to have access to basic public services.’ Furthermore, the United Nations Committee on Economic, Social and Cultural Rights recently reiterated that access to water is a human right which, in addition to being essential to living a healthy life, is a prerequisite for the exercise of all other human rights.

VI.The foregoing legal framework gives rise to a number of fundamental rights linked to the State’s obligation to provide basic public services. These rights mean, on the one hand, that people may not be unlawfully deprived of those services; but, as in the case of drinking water, they do not establish an enforceable entitlement for any individual to have the State provide public drinking water service immediately and wherever they may be. Rather, in the manner provided for in the same Protocol of San Salvador, these rights require States to adopt measures, as Article 1 of that Protocol provides:

The States Parties to this Additional Protocol to the American Convention on Human Rights undertake to adopt the necessary measures, both domestically and through cooperation among States, especially economic and technical cooperation, to the maximum of their available resources and taking into account their degree of development, in order to achieve progressively, and in accordance with domestic law, the full effectiveness of the rights recognized in this Protocol.

Nor does this mean that the fundamental right to public services is not specifically enforceable. On the contrary, when the State must reasonably provide them, those who hold the right may demand them, and public administrations or, where applicable, private parties providing them in their place may not hide behind alleged resource shortages, the long-standing public excuse for failing to fulfill their duties.” It follows from the foregoing that the so-called fundamental right to water must be afforded to everyone, which means that all individuals must have the possibility of accessing drinking water services on equal terms, since water is essential to human life and health (see, in this regard, judgments No. 2026-022312, issued at 09:30 on 19 June 2026, and No. 2026-027563, issued at 09:25 on 21 July 2026).

IV.The specific case. In this case, it is undisputed, as the respondents have not contested it, that the applicants are residents of the community of Alajuelita, Calle Cambronero, and have experienced problems with the supply of water service, which has been interrupted by operational maneuvers that will allow better water distribution in the aqueduct system.

The established facts show that the ICAA authorities are fully aware of the problem raised by the applicants, since they acknowledge that they issued 20 bulletins through interactive channels in the affected sector and approximately 21 bulletins in nearby locations for the purpose of communicating the impact occurring there. However, it appears that it was only after being notified of this proceeding that they ordered drinking water to be distributed daily by tanker trucks to the affected stretch. This demonstrates an omission by the respondent authority in adopting immediate measures to ensure an adequate water supply despite the irregularities and impacts detected.

Given that the respondents presented a schedule with alternatives for solving the reported problem, which they expect to carry out within a period of 5 to 10 weeks, depending on the actions to be implemented, and given that there is no certainty that the works will be carried out as indicated, the proper course is to address the problem while continuing to adopt interim measures for as long as the underlying problem persists.

Accordingly, the Court finds that the applicants’ claims are well-founded. This application must therefore be granted, and the ICAA must be ordered to make the necessary arrangements and carry out the necessary acts to ensure that the community’s residents have access to drinking water.

V.Documents submitted to the case file. This Chamber must advise the applicants that if they submitted any paper documents, objects, or evidence stored on any additional device or in electronic, computer, magnetic, optical, telematic, or new-technology format, they must retrieve them from the court office within 30 business days after receiving notice of this judgment. Otherwise, all such material will be destroyed in accordance with the “Regulation on Electronic Case Files in the Judiciary,” approved by the Full Court in session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at its session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo application is granted. Lourdes María Suárez Barboza, in her capacity as executive president, and Jorge Mauricio Matamoros Pérez, in his capacity as head of the UEN Customer Service, Zone III GAM, Alajuelita Commercial Office, both of the Costa Rican Institute of Aqueducts and Sewerage, or whoever holds those positions in their stead, are ordered, within the scope of their respective responsibilities, to make the corresponding arrangements and carry out the necessary acts so that, as of notification of this judgment: a) drinking water is provided IMMEDIATELY to the affected community, by such appropriate means as may be necessary, while the required works are carried out; and b) within a maximum period of TWO MONTHS AND TWO WEEKS, the infrastructure works necessary to resolve the problem in the supply of drinking water service in the community of community of Alajuelita, Calle Cambronero, are carried out.

The respondent authority must also continuously monitor the quality of the drinking water consumed by the residents of the area. The foregoing is subject to the warning that, pursuant to Article 71 of the Law of Constitutional Jurisdiction, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, will be sentenced to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Costa Rican Institute of Aqueducts and Sewerage is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be assessed in the administrative-litigation jurisdiction during enforcement of the judgment. Notify the parties.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de setiembre de dos mil veintiseis .

Recurso de amparo interpuesto por [Nombre 001], [Valor 001], [Nombre 002], [Valor 002], [Nombre 003], [Valor 003], [Nombre 004], [Valor 004], [Nombre 005], [Valor 005], [Nombre 006], [Valor 006], [Nombre 007], [Valor 007], [Nombre 008], [Valor 008], [Nombre 009], [Valor 009], [Nombre 010], [Valor 010], [Nombre 011], [Valor 011], [Nombre 012], [Valor 012], [Nombre 013], [Valor 013], [Nombre 014], [Valor 014], [Nombre 015], [Valor 015], [Nombre 016], [Valor 016], [Nombre 017], [Valor 017], [Nombre 018], [Valor 018], [Nombre 019], [Valor 019], [Nombre 020], [Valor 020], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Resultando:

  1. 1Por escrito incorporado al expediente digital el 21 de julio de 2026, los recurrentes interponen recurso de amparo contra el ICAA. Según la resolución de curso, manifiesta lo siguiente:

“[S]on vecinos de Calle Cambronero, Alajuelita, comunidad que adolece del faltante de agua potable con ocasión de las constantes y prolongadas suspensiones del servicio. Así, afirma que al momento en que interpusieron este proceso de amparo, cuentan con tres semanas consecutivas sin el servicio de agua potable. Así, señalan que la situación descrita se ha convertido en un problema permanente de acceso al agua potable, con la consecuente afectación a su calidad de vida y limitando su posibilidad de satisfacer las necesidades básicas. Aunado a ello, afirman que la comunidad se encuentra expuesta a riesgos para la salud, especialmente a personas menores de edad, adultos mayores, personas en condición de discapacidad, mujeres embarazas y personas con enfermedades crónicas. Aseguran que han interpuesto múltiples gestiones ante el ICAA, sin que estas hayan sido atendidas y, por consiguiente, no se ha brindado una solución concreta al problema denunciado. Por tales motivos, consideran lesionados sus derechos fundamentales y solicitan la intervención de esta Sala”.

  1. 2Mediante resolución de las 09:28 horas del 12 de agosto de 2026, se dio curso a este proceso y se les solicitó informe a las autoridades accionadas, sobre los hechos alegados por la parte recurrente.
  2. 3Por escritos incorporados al expediente digital el 18 de agosto de 2026, Jorge Mauricio Matamoros Pérez, en su condición de encargado de la UEN Servicio al Cliente Zona III GAM Oficina Comercial Alajuelita del ICAA, informa bajo juramento que:

“I. EN CUANTO A LOS HECHOS ALEGADOS POR EL RECURRENTE En atención a la situación objeto del amparo, planteada por los recurrentes [Nombre 001] y otros, contra el Instituto Costarricense de Acueductos y Alcantarillados, con fundamento en el informe técnico Prueba 1: MEMORANDO No. UEN-SCZIII-GAM-2026-00496, del 13 de agosto del 2026, elaborado por el funcionario Jorge Mauricio Matamoros Pérez, de la UEN Servicio al Cliente Zona III GAM y Prueba 2: MEMORANDO No. SG-GSGAM-MZOESTE-2026-00871, del 14 de agosto del 2026, de la ingeniera Sulmericcia Hernández Rodríguez, de la Macro Zona Oeste GAM, Prueba 3: Correo electrónico institucional [email protected] de Lunes 17/8/2026 14:47 de la Ingeniera Sulmericcia Hernández Rodríguez, de la Macro Zona Oeste GAM, los cuales se adjuntan como pruebas de este informe y el alcance de la norma que al efecto se regula en el Reglamento para la Prestación de los Servicios de AyA, queda debidamente acreditado que: PRIMERO: Sobre los hechos alegados por parte de los recurrentes, quienes son vecinos de Calle Cambronero en Alajuelita y denuncian una afectación a la continuidad del servicio, es importante señalar, que la parte comercial del AyA ha realizado todas las acciones referentes a su competencia.

Lo anterior significa, que, en los medios interactivos institucionales, se le ha brindado a la población de este sector, la información necesaria a través de los boletines, indicándoles que se presentará una interrupción del servicio, exponiéndoles los motivos e indicando los horarios aproximados de dichos eventos. Esto se ha hecho a través del Sitio Web Oficial www.aya.go.cr, App Institucional – Servicios AyA y las Redes Sociales Oficiales Facebook: Acueductos y Alcantarillados CR. Así las cosas, debe considerarse que entre el 01 de julio al 13 de agosto del presente año, se han emitido 20 boletines por medios interactivos en el sector afectado y aproximadamente, 21 boletines, en lugares aledaños, con la finalidad de comunicar la afectación que se presenta. (ver Prueba 1: UEN-SCZIII-GAM-2026- 00496) SEGUNDO: Por otra parte, el jueves 13 de agosto del presente año, en atención al caso, se realizaron las siguientes acciones: ➢ 9:00 am el capataz Erick Arce Vindas, realizó visita de inspección, donde se reúne con una de las recurrentes, señora [Nombre 020] y ella le comparte el recurso de amparo y le describe la condición del servicio. ➢ 9:00 am se inició reparto de agua potable con cisterna. - ➢ 11:45 am la ingeniera Sulmericcia Hernández Rodríguez, de la Macro Zona Oeste GAM, realizó entrevista telefónica con doña [Nombre 020] y se coordinó atender nuevamente al capataz para levantar las coordenadas y delimitar la afectación. ➢ 1:00 pm el capataz se reúne por segunda vez con doña Xinia, y lo acompaña a levantar las coordenadas.

Así las cosas, el AyA realizó una visita de inspección, con el propósito de verificar la situación expuesta en el recurso, contando con la participación de una de las recurrentes, quien detalló que, a mediados de mayo del presente año, empezaron a experimentar baja presión, hasta llegar en las semanas posteriores, a no contar con el servicio. Luego, ese mismo día, 13 de agosto del presente año, en la tarde, se hizo un recorrido y se delimitó el área afectada, la cual fue identificada al costado norte de calle Cambronero, tramo que se definió mediante las coordenadas respectivas. (ver Prueba 2: MEMORANDO No. SG-GSGAMMZOESTE-2026-00871/ ver Prueba 3: correo electrónico institucional [email protected] de Lunes 17/8/2026 14:47). TERCERO: Una vez realizada la visita de campo, el caso entró a análisis, y surgieron algunas hipótesis que deberán comprobarse, ya que podría existir alguna obstrucción en la tubería o que la disminución sea producto de algunos cambios ejecutados recientemente en la zona de La Chorotega, con el objetivo de mejorar el servicio y estos hayan afectado ese tramo en particular.

Consecuentemente, para determinar las causas reales y plantear una solución, se requiere realizar calicatas exploratorias en el punto donde inicia la afectación, para posteriormente ofrecer la solución que va a depender de los hallazgos que arroje la investigación de campo. Lo anterior significa, que en sitio las soluciones pueden corresponder a uno, varios o a todas las opciones siguientes: a. Desobstrucción de tubería b. Cambio de límite de sector hidrométrico (instalación de una o varias válvulas de límite). c. Construcción e interconexión de nuevo ramal con sus correspondientes acometidas (mejora de ramal de 110 m de longitud). (ver Prueba 2: MEMORANDO No. SG-GSGAM-MZOESTE-2026-00871). – CUARTO: Como se indicó en el apartado anterior, las alternativas para solucionar el problema van a depender de los resultados que se obtengan de las calicatas exploratorias, sin embargo, desde ya se debe plantear con transparencia un cronograma preliminar, que obedece a la implementación de las acciones a, b y/o c: (…) Del cuadro anterior, se infiere con meridiana claridad, que la solución final se estima en tiempo, entre 5 a 10 semanas, dependiendo la acción que deba implementarse.

Por otra parte, mientras se resuelve esta situación, la Institución dio la orden, desde el 13 de agosto del presente año, de repartir diariamente agua potable a través de camiones cisterna en el tramo afectado. (ver Prueba 2: MEMORANDO No. SG-GSGAM-MZOESTE-2026-00871.-)”.

  1. 4Por escritos incorporados al expediente digital el 18 de agosto de 2026, Lourdes María Suárez Barboza, en su condición de presidenta ejecutiva del ICAA, informa bajo juramento que:

“I. EN CUANTO A LOS HECHOS ALEGADOS POR EL RECURRENTE En atención a la situación objeto del amparo, planteada por los recurrentes [Nombre 001] y otros, contra el Instituto Costarricense de Acueductos y Alcantarillados, con fundamento en el informe técnico Prueba 1: MEMORANDO No. UEN-SCZIII-GAM-2026-00496, del 13 de agosto del 2026, elaborado por el funcionario Jorge Mauricio Matamoros Pérez, de la UEN Servicio al Cliente Zona III GAM y Prueba 2: MEMORANDO No. SG-GSGAM-MZOESTE2026-00871, del 14 de agosto del 2026, de la ingeniera Sulmericcia Hernández Rodríguez, de la Macro Zona Oeste GAM, Prueba 3: Correo electrónico institucional [email protected] de Lunes 17/8/2026 14:47 de la Ingeniera Sulmericcia Hernández Rodríguez, de la Macro Zona Oeste GAM, los cuales se adjuntan como pruebas de este informe y el alcance de la norma que al efecto se regula en el Reglamento para la Prestación de los Servicios de AyA, queda debidamente acreditado que: PRIMERO: Sobre los hechos alegados por parte de los recurrentes, quienes son vecinos de Calle Cambronero en Alajuelita y denuncian una afectación a la continuidad del servicio, es importante señalar, que la parte comercial del AyA ha realizado todas las acciones referentes a su competencia.

Así las cosas, el AyA realizó una visita de inspección, con el propósito de verificar la situación expuesta en el recurso, contando con la participación de una de las recurrentes, quien detalló que, a mediados de mayo del presente año, empezaron a experimentar baja presión, hasta llegar en las semanas posteriores, a no contar con el servicio. Luego, ese mismo día, 13 de agosto del presente año, en la tarde, se hizo un recorrido y se delimitó el área afectada, la cual fue identificada al costado norte de calle Cambronero, tramo que se definió mediante las coordenadas respectivas. (ver Prueba 2: MEMORANDO No. SG-GSGAM-MZOESTE-2026-00871/ ver Prueba 3: correo electrónico institucional [email protected] de Lunes 17/8/2026 14:47). TERCERO: Una vez realizada la visita de campo, el caso entró a análisis, y surgieron algunas hipótesis que deberán comprobarse, ya que podría existir alguna obstrucción en la tubería o que la disminución sea producto de algunos cambios ejecutados recientemente en la zona de La Chorotega, con el objetivo de mejorar el servicio y estos hayan afectado ese tramo en particular.

(ver Prueba 2: MEMORANDO No. SG-GSGAM-MZOESTE-2026-00871). – CUARTO: Como se indicó en el apartado anterior, las alternativas para solucionar el problema van a depender de los resultados que se obtengan de las calicatas exploratorias, sin embargo, desde ya se debe plantear con transparencia un cronograma preliminar, que obedece a la implementación de las acciones a, b y/o c: (…) Del cuadro anterior, se infiere con meridiana claridad, que la solución final se estima en tiempo, entre 5 a 10 semanas, dependiendo la acción que deba implementarse.

Por otra parte, mientras se resuelve esta situación, la Institución dio la orden, desde el 13 de agosto del presente año, de repartir diariamente agua potable a través de camiones cisterna en el tramo afectado. (ver Prueba 2: MEMORANDO No. SG-GSGAM-MZOESTE-2026-00871.-)”.

  1. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

Considerando:

I.Objeto del recurso. Los recurrentes manifiestan que son vecinos de la comunidad de Alajuelita, Calle Cambronero, en donde están enfrentando interrupciones constantes y reiteradas del servicio de agua, situación que se ha convertido en una problemática que afecta toda la comunidad, por tal motivo indican que han presentado múltiples gestiones ante la autoridad recurrida; sin embargo, reclaman que a la fecha de interposición no se ha dado una solución a la problemática denunciada.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

Los recurrentes son vecinos de la comunidad de Alajuelita, Calle Cambronero (hecho incontrovertido).

Entre el 1 de julio de 2026 al 13 de agosto de 2026, las autoridades del ICAA han emitido 20 boletines por medios interactivos en el sector afectado y aproximadamente, 21 boletines, en lugares aledaños, con la finalidad de comunicar la afectación que se presenta (ver informe rendido bajo juramento).

El 12 de agosto de 2026, las autoridades del ICAA fueron notificadas de la resolución que dio curso a este proceso (ver actas de notificación).

El 13 de agosto de 2026, las autoridades del ICAA realizaron una inspección en el sitio afectado con el objetivo de mejorar el servicio, por lo anterior se emitieron las siguientes opciones: a. Desobstrucción de tubería b. Cambio de límite de sector hidrométrico (instalación de una o varias válvulas de límite). c. Construcción e interconexión de nuevo ramal con sus correspondientes acometidas (mejora de ramal de 110 m de longitud) (ver informe rendido bajo juramento).

Desde el 13 de agosto de 2026, las autoridades del ICAA dieron la orden de repartir diariamente agua potable a través de camiones cisterna en el tramo afectado (ver informe rendido bajo juramento).

Las alternativas para solucionar la problemática denunciada son las siguientes que se plantean con un cronograma preliminar:

(ver informe rendido bajo juramento).

Las autoridades del ICAA afirman que la solución final se realizará entre 5 a 10 semanas, dependiendo de la acción que deba implementar (ver informe rendido bajo juramento).

III.Sobre el derecho fundamental al agua potable. Este Tribunal ha reconocido, en su jurisprudencia, que el derecho a la salud y a la vida, son derechos fundamentales del ser humano que dependen del acceso al agua potable y que los órganos competentes tienen la responsabilidad ineludible de velar por que la sociedad, como un todo, no los vea mermados. En efecto, la Sala ha dispuesto anteriormente que, como parte del Derecho de la Constitución, existe un derecho fundamental al suministro de agua potable. Así, en la sentencia nro. 2003-004654 de las 15:44 horas del 27 de mayo de 2003, reiterada en la sentencia nro. 2026-027563 de las 09:25 horas del 21 de julio de 2026, se dispuso lo siguiente:

“V.- La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario. En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988), el cual dispone que:

‘Artículo 11. Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos’.

Además, recientemente, el Comité de Derechos Económicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un derecho humano que, además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos.

VI.Del anterior marco normativo se deriva una serie de derechos fundamentales ligados a la obligación del Estado de brindar los servicios públicos básicos, que implican, por una parte, que no puede privarse ilegítimamente de ellos a las personas, pero que, como en el caso del agua potable, no puede sostenerse la titularidad de un derecho exigible por cualquier individuo para que el Estado le suministre el servicio público de agua potable, en forma inmediata y dondequiera que sea, sino que, en la forma prevista en el mismo Protocolo de San Salvador, esta clase de derechos obligan a los Estados a adoptar medidas, conforme lo dispone el artículo primero del mismo Protocolo:

Los Estados Partes en el presente Protocolo Adicional a la Convención Americana sobre Derechos Humanos se comprometen a adoptar las medidas necesarias tanto de orden interno como mediante la cooperación entre los Estados, especialmente económica y técnica, hasta el máximo de los recursos disponibles y tomando en cuenta su grado de desarrollo, a fin de lograr progresivamente, y de conformidad con la legislación interna, la plena efectividad de los derechos que se reconocen en el presente Protocolo’ .

De esto tampoco puede interpretarse que ese derecho fundamental a los servicios públicos no tenga exigibilidad concreta; por el contrario, cuando razonablemente el Estado deba brindarlos, los titulares del derecho pueden exigirlo y no pueden las administraciones públicas o, en su caso, los particulares que los presten en su lugar, escudarse en presuntas carencias de recursos, que ha sido la secular excusa pública para justificar el incumplimiento de sus cometidos”.

De lo anterior, se colige que el denominado derecho fundamental al agua, debe concederse a todas las personas, lo que implica que todos los individuos tengan la posibilidad de acceder, en condiciones de igualdad, a los servicios de agua potable, toda vez que la misma resulta esencial para la vida y la salud humana (ver en ese sentido las sentencias nro. 2026-022312 de las 09:30 horas del 19 de junio de 2026 y nro. 2026-027563 de las 09:25 horas del 21 de julio de 2026).

IV.Sobre el caso concreto. En la especie, se tiene como hecho incontrovertido al no haber sido refutado por los recurridos que los recurrentes son vecinos de la comunidad de Alajuelita, Calle Cambronero, quienes han sufrido una problemática en el suministro del servicio de agua, por cuanto se ha visto interrumpida por maniobras operativas que permitirán una mejor distribución del agua en el acueducto.

Del elenco de hechos probados, se verifica que las autoridades del ICAA tienen pleno conocimiento de la problemática reclamada por los recurrentes, toda vez que reconocen que han emitido 20 boletines por medios interactivos en el sector afectado y aproximadamente, 21 boletines, en lugares aledaños, con la finalidad de comunicar la afectación que se presenta. Sin embargo, se desprende que fue con posterioridad a la notificación de este proceso que dieron la orden de repartir diariamente agua potable a través de camiones cisterna en el tramo afectado. Lo anterior, evidencia una omisión por parte de la autoridad recurrida en adoptar medidas inmediatas para garantizar un adecuado abastecimiento pese a las irregularidades y a las afectaciones detectadas.

En vista de que los recurridos expusieron que un cronogramada con las alternativas para solucionar la problemática denunciada, la cual contemplan que se llevará a cabo en un plazo entre 5 a 10 semanas, dependiendo de las acciones que deba implementar; sin embargo, como no se cuenta con una certeza de que las obras se vayan a ejecutar como se indica lo corrector es que la problemática se solvente mientras que se continúen adoptando acciones paliativas mientras la problemática de fondo persista.

Así las cosas, el Tribunal constata que llevan razón los recurrentes en sus reclamos, por tal razón lo procedente es acoger este recurso y ordenarle al ICAA, que realicen las coordinaciones correspondientes y ejecuten los actos necesarios para garantizar que los habitantes de la comunidad cuenten con acceso a agua potable.

V.Documentación aportada al expediente. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Lourdes María Suárez Barboza, en su condición de presidenta ejecutiva y a Jorge Mauricio Matamoros Pérez, en su condición de encargado de la UEN Servicio al Cliente Zona III GAM Oficina Comercial Alajuelita, ambos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en sus lugares ejerzan tales cargos, que realice las coordinaciones correspondientes y ejecute los actos necesarios, todo dentro del ámbito de sus competencias, para que, a partir de la notificación de esta sentencia: a) DE FORMA INMEDIATA se brinde agua potable a la comunidad afectada, por los mecanismos que resulten pertinentes y entre tanto se realicen las obras necesarias; y b) dentro del plazo máximo de DOS MESES Y DOS SEMANAS, se realicen las obras de infraestructura necesarias para solventar la problemática en el suministro del servicio de agua potable en la comunidad de comunidad de Alajuelita, Calle Cambronero.

Asimismo, deberá la autoridad recurrida dar una vigilancia continua a la calidad del agua potable que consumen los habitantes de la zona. Lo anterior, bajo el apercibimiento que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
