CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 3 September 2026.

Amparo proceeding heard in expediente N°26-026899-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the ASOCIACIÓN DE DESARROLLO INTEGRAL DE RESERVA INDIGENA DE TERRABA DE BUENOS AIRES.

BACKGROUND:

  1. 1By a brief added to the Chamber’s digital expediente at 21:15 on 19 July 2026, the appellant files an amparo application against the Asociación de Desarrollo Integral Indígena de Térraba and states that the appellant is an Indigenous person of the Brörán ethnic group, descended from the Cabrera and Gómez genealogical lineages. The appellant indicates that the family unit peacefully inhabits, resides on, and works land located in the community of Paso Real, in the sector of the Crun Shurin farm (Land of the Deer), which has been subject to agrarian litigation since 2018. The appellant states that the right to inhabit that territory derives from the family distribution made by the appellant’s father, Anselmo Flores Reyes, in a document dated 29 August 2020, recognized by the Consejo de Mayores Brörán and the Comité de Recuperadores de la Finca Crun Shurin. The appellant adds that the appellant’s status as an inhabitant is protected under Article 3 of Ley Indígena N° 6172, which provides for the exclusive use of these lands by the communities inhabiting them.The appellant indicates that the population of the Territorio Indígena de Térraba is a beneficiary of Precautionary Measure MC 321-12 granted by the Inter-American Commission on Human Rights, which obliges the Costa Rican State and its authorities to safeguard, protect, and ensure the continued presence and peaceful subsistence of its inhabitants on their traditional lands. The appellant explains that, in order to develop a family subsistence pig-farming project using the ecological system known as “dry bedding,” the appellant must apply to the Municipalidad de Buenos Aires for a Land-Use Certificate, a requirement for obtaining the corresponding Certificate of Veterinary Operation (CVO) from the Servicio Nacional de Salud Animal (SENASA). The appellant asserts that, for those purposes, on 7 September 2025 a formal request was submitted to the Asociación de Desarrollo Integral Indígena de Térraba (ADIIT), seeking an endorsement or document certifying the appellant’s status as a resident, which is essential to complete the corresponding municipal procedure.The appellant alleges that ADIIT’s conduct is repeated, since in an official letter dated 16 December 2024, issued in connection with a request related to electric service, that entity stated that it had no knowledge of the legitimate and legal existence of the “Territorio indígena de Térraba Brörán,” the Comité de Recuperadores de Crun Shurin, or the Consejo de Mayores Brörán as the territory’s traditional authority. The appellant adds that this position was reaffirmed in a response dated 28 September 2025, in which ADIIT conditioned issuance of the requested document on submission of title deeds or documents transferring private ownership that established ownership of the land where the project is intended to be developed. The appellant maintains that this requirement is impossible to meet and contrary to the communal, inalienable, and imprescriptible nature of Indigenous territories, because requirements foreign to the Indigenous legal framework were imposed, preventing the appellant from obtaining the certificate needed to pursue the productive project.Based on the allegations set out, the appellant considers that the challenged actions violate fundamental rights. The appellant requests that the application be granted with the consequences provided by law.
  2. 2By resolution issued at 13:34 on 28 July 2026, the President of the Chamber admitted this proceeding and gave Genaro Gutiérrez Reyes, in his capacity as president of the Asociación de Desarrollo Integral Indígena de Térraba de Buenos Aires, an opportunity to respond to the facts alleged by the appellant.
  3. 3In a brief entered into the digital expediente on 10 August 2026, Genaro Gutiérrez Reyes, in his capacity as president of the Asociación de Desarrollo Integral Indígena de Térraba, responds to the notice and states as follows: “First: In the same document submitted by the appellant, issued by the association I represent on 16 December 2024, a response had already been given to the matter discussed in the account contained in this allegation; accordingly, as we have continued to indicate in responding to the multiple amparo applications filed by this same appellant, or by the appellant’s father, Mr. Anselmo Flores, this initiative is one more that repeats the same matters and, it seems to us, seeks only to distract us from our duties as governors of our Territory. Accordingly, in addition to what was set out in the document that the appellant is said to have submitted, which we ask to be incorporated into this response, we add the following: In responding to the Amparo proceeding heard under Exp. N° 26-009006-0007-CO, we had already indicated that, by means of DE N° 21475-G, published in the official gazette La Gaceta N° 23 of 3 February 1993, specifically paragraph II of Article 2°, the Consejo de Mayores, or traditional Térraba ethnic authorities, was established as the Council bearing that same name; and by means of DE N° 16569-G, published in the official gazette La Gaceta N° 191 of 8 October 1985, and its amendments, the existence of a people denominated BRÖRÁN is not recognized; the people existing and recognized in our Territory is identified by the name TÉRRABA.ON THE INDIGENOUS TERRITORY OF TÉRRABA AND THE BRORÄN PEOPLE: DE N° 13573-G-C, published in the official gazette La Gaceta N° 94 of 17 May 1982, states: ‘Article 1. It is recognized that each Indigenous ethnic group of Costa Rica is characterized by its own cultural, linguistic, social, and historical traits, different from the cultural traits of other Indigenous communities, such that each ethnic group has its own personality, distinct from that of the other Indigenous groups. Article 2. For purposes of Article 1 of Ley N° 6172 of 29 November 1977, the State recognizes the official existence of eight Indigenous ethnic groups in Costa Rica, namely: 1. Bribrí. 2.Cabécar. 3. Guaymí. 4.Brunka. 5.Térraba. 6.Huetar (Pacacua). 7.Maleku (Guatuso). 8.Chorotega (Nicoya). Article 2. For legal purposes, every Indigenous person in Costa Rica belongs to one of these eight official ethnic groups. Article 3.Each of the eight recognized ethnic groups shall be governed by the general provisions of the Ley Indígena and related decrees, as well as by its own customs and rules. To that end, each of the eight ethnic groups must submit to the Comisión Nacional de Asuntos Indígenas (CONAI) and other competent bodies a document setting out the different customs and rules of its social organization. The various Indigenous reserves belonging to the same ethnic group shall have a single common regulation, valid for all representatives of that ethnic group. Article 4. The State shall not provide an exact or single definition of an Indigenous person; instead, that definition shall be presented separately by each of the eight Indigenous ethnic groups.’ Reference is also made to Article 5 of that decree: ‘Article 5. As regards administration of the Reserves, each Indigenous Reserve constitutes a single Indigenous community, administered by its Asociación de Desarrollo Integral, which is the representative body of each community and serves as the local government of each Indigenous Reserve.’ It is stated that Executive Decrees N° 16569-G and N° 20645-G amended Article 6 of the original decree, consolidating eight ethnic groups distributed among different Indigenous territories.It is indicated that the Térraba ethnic group has a single territory, and it is reiterated that Article 5 remains in force. IN SUMMARY AS TO THIS FIRST ALLEGATION: In addition to the foregoing, the farm referred to by the appellant forms part of our Territory, but is subject to litigation, according to cases heard through ordinary proceedings, namely before the Administrative Litigation Court, expedientes n° 11-000019-1129-AG and 18-000022-1555-AG; both were initiated in the Agrarian Court of Buenos Aires but transferred to the administrative-litigation jurisdiction for lack of subject-matter jurisdiction. Accordingly, any possession claimed by the appellant is in bad faith, and this does not authorize us to support them. The criminal jurisdiction, from the Criminal Court based in Pérez Zeledón, to the Criminal Appeals Court of Cartago, and finally the Sala Tercera, have upheld judgments stating that no right exists under the national or international legal system to forcibly recover real property by violent or de facto means.The decision adopted by this local government, in pursuit of social peace, is that all matters concerning land recovery must be pursued through ordinary judicial channels, so that whoever is entitled to compensation or relocation (Article 5 of Ley Indígena) may receive it, and those who are not, as a result of the relevant judicial proceeding, may be evicted; we neither promote nor protect the aforementioned de facto recoveries. SECOND: The precautionary measure invoked is not relevant to this application, because if it is invoked, it orders the safeguarding of the guarantees of life, liberty, and movement of every member of our ethnic group; and it is the State, not the local government, that may violate it, so it is unreasonable to invoke it in this proceeding. THIRD: We have no knowledge of the appellant’s economic activities; however, the matter had been explained and answered in the memorial issued by the association I represent on 16 December 2024.FOURTH: It is true that the request was submitted, and for that reason a response was given, together with the communication dated 16 December 2024, a document the appellant himself submitted to the case file. FIFTH: This entire allegation was answered when we addressed the first allegation of this application, where we explained the reasons why the appellant and the appellant’s support group have attempted to legitimize a parallel government to ADIIT, which we consider inadmissible for reasons of peaceful coexistence. SIXTH: We reject the appellant’s reading of the Indigenous legislation. It is indicated that OIT Convention N° 107 recognized individual and collective ownership, that Article 3 of Ley Indígena N° 6172 provides that Indigenous people may negotiate their lands only with other Indigenous people, and that this recognizes the individual possession existing in the territory. It is added that collective ownership refers to the registered title to the territory.Finally, it is stated that the appellant repeatedly seeks the assistance of the amparo proceeding to obtain a ruling with erga omnes effect and legitimize himself before the community. FINAL COMMENT: Ladies and Gentlemen Justices: our effort as local government has been, and remains, to promote peaceful coexistence among members of our ethnic group; however, that has been impossible with the appellant, who has self-designated and is supported by a parallel structure they have sought to legitimize and call BRORAN. In keeping with our ancestral traditions and own customs (Art. 4 of Ley Indígena), a decision has been made by 90% of our population to recognize only the CONSEJO DE MAYORES TÉRRABA, to which all Elders who wish to participate are invited. It is added that those who call themselves BRORAN have declared that their purpose is to have the ADII governments revoked and that they have distributed significant expanses of land among themselves.” The respondent requests that the application be denied.
  4. 4The legal requirements have been observed in the proceedings.

Drafted by Justice Salazar Alvarado; and, REASONS:

I. AMPARO PROCEEDINGS AGAINST PRIVATE-LAW PERSONS

Given their exceptional nature, the ordinary procedure for amparo applications against private-law persons must begin by examining whether the case falls within any of the circumstances that make such an application admissible, and, if so, then determining whether it should be granted. In this regard, Article 57 of the Ley de la Jurisdicción Constitucional specifies the circumstances under which amparo is admissible against actions or omissions by private-law persons: when they act or are required to act in the exercise of public functions or powers, or when, in law or in fact, they occupy a position of power against which ordinary judicial remedies are clearly insufficient or too late to protect the fundamental rights or freedoms referred to in Article 2, subsection a), of that same Law. In light of the foregoing, in this specific case, the Court considers it appropriate to examine the merits, given that the respondent association occupies a position of power against which ordinary judicial remedies are clearly insufficient or too late to protect the fundamental rights or freedoms alleged to have been violated. Accordingly, the merits of the application will be considered.

II. SUBJECT OF THE APPLICATION

The appellant alleges that the appellant is an Indigenous person of the Brörán ethnic group, an inhabitant of the Territorio Indígena de Térraba, and that the Asociación de Desarrollo Integral Indígena de Térraba has refused to issue a certificate of the appellant’s status as a resident for the purpose of applying for a Land-Use Certificate required to develop a subsistence productive project. The appellant maintains that the respondent authority conditioned issuance of that document on submission of title deeds or documents transferring ownership, a requirement the appellant considers contrary to the legal framework governing Indigenous territories and harmful to the appellant’s fundamental rights.

III. PROVEN FACTS

The following facts, relevant to resolution of this matter, are deemed duly established:

  • a)Executive Decree N° 21475-G, published in La Gaceta N° 23 on 3 February 1993, established the Consejo de Mayores de Térraba as the traditional ethnic authority of Térraba (see the response submitted by the representative of the respondent association).
  • b)By Executive Decree N° 16569-G, published in La Gaceta N° 191 on 8 October 1985, and its amendments, the existence of a people denominated “Brörán” is not recognized; the corresponding Indigenous territory is identified by the name Térraba (see the response submitted by the representative of the respondent association).
  • c)Under Executive Decrees N° 13573-G-C, N° 16569-G, and N° 20645-G, the Asociación de Desarrollo Integral constitutes the representative body and local government of the Territorio Indígena de Térraba (see the response submitted by the representative of the respondent association).
  • d)The Crun Shurin farm referred to by the appellant forms part of the Territorio Indígena de Térraba and is subject to judicial litigation in expedientes N° 11-000019-1129-AG and N° 18-000022-1555-AG, heard in the administrative-litigation jurisdiction (see the response submitted by the representative of the respondent association).
  • e)The appellant submitted a request to the Asociación de Desarrollo Integral Indígena de Térraba for issuance of a document certifying the appellant’s status as a resident of the territory (see the response submitted by the representative of the respondent association).
  • f)The Asociación de Desarrollo Integral Indígena de Térraba responded to the request submitted by the amparo applicant through official letters dated 16 December 2024 and 28 September 2025 (see the response submitted by the representative of the respondent association).
  • g)The Asociación de Desarrollo Integral Indígena de Térraba does not recognize the so-called Consejo de Mayores Brörán as the traditional authority of the Territorio Indígena de Térraba and recognizes only the Consejo de Mayores de Térraba as the territory’s traditional ethnic authority (see the response submitted by the representative of the respondent association).

IV. ON THE MERITS

Recently, in Judgment N° 2026-005199, issued at 9:34 a.m. on 13 February 2026, this Court ruled on a matter similar to the one under consideration, holding, to the extent relevant, as follows:

“… it is important to emphasize that what is observed on the merits is a dispute concerning the inclusion of certain people in the database for the Térraba Brörán ethnic group and the activities they may or may not carry out in the particular Indigenous territory. In that regard, while the applicant considers that people who are not included in that database may not engage in the commercial activities at issue, it is also true that the ADI itself gave its approval for the respondent municipality to issue the respective permits and licenses; moreover, the respondent argues that ‘there is no recognition of the Brörán ethnic designation in this territory; here we are Térraba or Teribe Indigenous people.’ Now, as to whether a person belongs to the database referred to by the appellant and that person’s status as Indigenous, this Chamber has stated: ‘It is necessary to recall what the Chamber decided in a similar matter concerning the database of people of the Térraba Brörán ethnic group; thus, in judgment n.°26087-2022 issued at 9:45 a.m. on 4 November 2022, it was stated that it is not for the Chamber to “determine whether a person is Indigenous, because, as explained in the precedent cited above, in respect for the self-determination of Indigenous communities, particular weight must be given to the views of the community’s elders, who identify Indigenous people according to their customs and culture.

Accordingly, the database of the Térraba ethnic group is maintained by the community’s Consejo de Mayores together with the Tribunal Supremo de Elecciones and other public institutions. In addition, the appellant’s claim exceeds the summary nature of the amparo proceeding, and any disagreement on this matter must be heard through the competent channels established for that purpose (…)” (Judgment nro. 2023000535 issued at 9:15 a.m. on 13 January 2023).

Thus, it is again emphasized that the particular circumstances of the people identified by the protected party (whether they are Indigenous, whether they should be included in the database at issue, and whether they may engage in commercial activities) exceed the scope of this proceeding and must therefore be disputed before the competent ordinary bodies, through the broader process available in the ordinary courts.

Accordingly, the application is denied.” In the present case, this Chamber finds no reason to depart from the reasoning in the cited precedent, since the complaint raised by the appellant, in substance, repeats a disagreement that asks this Court to review the propriety of the approval issued by the Asociación de Desarrollo Integral Indígena de Térraba and, correspondingly, the validity of the administrative act by which the Municipalidad de Buenos Aires granted a commercial license for the operation of the restaurant at issue within the Indigenous territory. Indeed, the established factual framework shows that the grant of that license was approved in advance by the relevant ADI and that the municipal procedure was conducted on the basis of that approval, such that the claimants’ request necessarily requires this constitutional jurisdiction to examine whether the beneficiary met the conditions required to carry out the commercial activity at issue and whether the ADI acted in accordance with the legal system in granting that authorization.

However, as established in the precedent quoted above, it is not for this Chamber, in the summary procedure of an amparo application, to determine whether a particular person meets the requirements for issuance of a commercial permit or license, much less to review, case by case, the legality of approvals issued by an ADI and of municipal administrative acts issued on the basis of them. Such examination requires a detailed analysis of requirements and personal and community circumstances, as well as legal assessments that exceed the scope of this exceptional proceeding. In addition, in the present matter, the appellant’s claims are closely connected to disputes concerning recognition of Indigenous status, inclusion in or exclusion from certain community databases, and the legitimacy of the internal authorities that grant approvals. Due to their factual and legal complexity, these matters must be resolved by the competent ordinary bodies, which have the evidentiary scope necessary for that purpose.

Accordingly, as in the cited precedent, what underlies the complaint is not a direct and immediate violation of a fundamental right that may be protected in this forum, but a disagreement with administrative actions whose possible invalidity or impropriety must be disputed through the ordinary legal channels provided for that purpose. Consequently, since no constitutional harm warranting this Court’s intervention on the terms requested has been found, and since the requested analysis clearly exceeds the summary nature of amparo, the application must be denied, leaving intact the reasoning this Chamber has already adopted in analogous cases …”.

In the case under review, the appellant alleges that the Asociación de Desarrollo Integral Indígena de Térraba refused to issue a document certifying the appellant’s status as a resident and inhabitant of the Indigenous territory, which is essential to apply for a Land-Use Certificate required to develop a subsistence productive project. The appellant maintains that the refusal resulted from the requirement to submit title deeds or documents transferring ownership, requirements considered incompatible with the communal nature of Indigenous territories.

In this regard, the representative of that association, in the response submitted to this Court, clarifies that the farm referred to by the amparo applicant is subject to judicial proceedings in the administrative-litigation jurisdiction and that matters concerning possession and occupation of those lands are being disputed through the competent ordinary channels. The representative also indicates that, under the rules governing the Territorio Indígena de Térraba, the Asociación de Desarrollo Integral constitutes the representative body and local government of the territory, and that the recognized traditional authority is the Consejo de Mayores de Térraba. The representative adds that the existence of a people or ethnic authority distinct from it under the name “Brörán” is not recognized and that the differences raised by the appellant relate to conflicts over representation, internal organization, and land tenure within the Indigenous territory.

In these circumstances, it is not for this Court to examine matters concerning title, possession, occupation, or recovery of land within the Territorio Indígena de Térraba, or to determine which of the parties’ positions should prevail regarding the representation of particular groups or organizational structures. Resolution of those disputes requires extensive evidentiary and legal debate, which is incompatible with the summary nature of an amparo proceeding. Therefore, the appellant’s claims must be heard by the competent ordinary administrative or judicial bodies, where the appellant may present arguments and claims.

Accordingly, this type of grievance must be raised with the respondent parties or before the ordinary judicial channels established specifically for that purpose, where the appellant may, if desired, present arguments fully, debate the merits, and pursue the appellant’s claims. Therefore, the application must be dismissed, as is hereby ordered.

V. DOCUMENTATION SUBMITTED TO THE EXPEDIENTE

This Chamber must advise the parties that any paper documents, objects, or evidence submitted on any additional device, or by electronic, computer, magnetic, optical, telematic, or new-technology media, must be collected from the clerk’s office within thirty business days after receipt of notice of this judgment. Otherwise, all such material will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N°43-12 held on 03 May 2012, Article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de setiembre de dos mil veintiseis .

Recurso de amparo que se tramita en expediente N°26-026899-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la ASOCIACIÓN DE DESARROLLO INTEGRAL DE RESERVA INDIGENA DE TERRABA DE BUENOS AIRES.

RESULTANDO:

  1. 1Por escrito agregado al expediente digital de la Sala a las 21:15 horas de 19 de julio de 2026, la parte recurrente interpone recurso de amparo contra la Asociación de Desarrollo Integral Indígena de Térraba, y manifiesta que es una persona indígena de la etnia Brörán, descendiente de los troncos genealógicos Cabrera y Gómez. Indica que su núcleo familiar habita, reside y trabaja de forma pacífica tierras ubicadas en la comunidad de Paso Real, sector de la finca Crun Shurin (Tierra de Venado), las cuales se encuentran bajo proceso de litigio agrario desde el año 2018. Señala que su derecho a habitar dicho territorio deriva de la distribución familiar efectuada por su padre, Anselmo Flores Reyes, mediante documento de fecha 29 de agosto de 2020, reconocido por el Consejo de Mayores Brörán y el Comité de Recuperadores de la Finca Crun Shurin. Agrega que su condición de habitante se encuentra amparada en el artículo 3 de la Ley Indígena N° 6172, que consagra el uso exclusivo de estas tierras para las comunidades que las habitan.Indica que la población del Territorio Indígena de Térraba es beneficiaria de la Medida Cautelar MC 321-12 otorgada por la Comisión Interamericana de Derechos Humanos, la cual obliga al Estado costarricense y a sus autoridades a tutelar, proteger y asegurar la permanencia y subsistencia pacífica de sus habitantes en sus tierras tradicionales. Expone que, con el propósito de desarrollar un proyecto familiar de porcinocultura de subsistencia bajo el sistema ecológico denominado “cama seca”, requiere gestionar ante la Municipalidad de Buenos Aires un Certificado de Uso de Suelo, requisito necesario para obtener del Servicio Nacional de Salud Animal (SENASA) el respectivo Certificado Veterinario de Operación (CVO). Afirma que, para tales efectos, el 7 de septiembre de 2025 presentó una solicitud formal ante la Asociación de Desarrollo Integral Indígena de Térraba (ADIIT), mediante la cual requirió un visto bueno o documento que acreditara su condición de vecino, indispensable para realizar el trámite municipal correspondiente.Alega que la conducta de la ADIIT es reiterada, pues mediante oficio de 16 de diciembre de 2024, emitido con ocasión de una gestión relacionada con el servicio eléctrico, dicha entidad manifestó no tener conocimiento de la existencia legítima y legal del “Territorio indígena de Térraba Brörán”, del Comité de Recuperadores de Crun Shurin ni del Consejo de Mayores Brörán como autoridad tradicional del territorio. Añade que esa actuación se reafirmó mediante respuesta de 28 de septiembre de 2025, en la cual la ADIIT condicionó la emisión del documento solicitado a la presentación de títulos de propiedad o documentos traslativos de dominio privado que acreditaran la titularidad del terreno donde pretende desarrollar el proyecto. Sostiene que tal exigencia resulta imposible de cumplir y contraria a la naturaleza comunal, inalienable e imprescriptible de los territorios indígenas, por cuanto se le aplicaron requisitos ajenos al régimen jurídico indígena, impidiéndole obtener la constancia requerida para gestionar su proyecto productivo. Con base en los alegatos expuestos, estima que, con las actuaciones acusadas, se están vulnerando derechos fundamentales. Solicita que se declare con lugar el recurso con las consecuencias de ley.
  2. 2A través de la resolución de las 13:34 horas de 28 de julio de 2026, la Presidencia de la Sala dio curso al presente proceso y concedió traslado a Genaro Gutiérrez Reyes, en su condición de presidente de la Asociación de Desarrollo Integral Indígena de Térraba de Buenos Aires, sobre los hechos alegados por la parte recurrente.
  3. 3Por escrito incorporado al expediente digital el 10 de agosto de 2026, contesta la audiencia conferida Genaro Gutiérrez Reyes, en su condición de presidente de la Asociación de Desarrollo Integral Indígena de Térraba, y manifiesta lo siguiente: “primero: En el mismo documento que aportó el recurrente, emitido por mi representada, en fecha 16 de diciembre de 2024, se le había dado respuesta al tema que comenta en la narración contenida en este hecho; de modo que, como lo hemos venido indicando al dar respuesta a los múltiples recursos de amparo promovidos por el mismo aquí recurrente, o su señor padre, don Anselmo Flores, la presente iniciativa engrosa aquéllas que redundan en lo mismo y que, nos parece, únicamente pretenden desconcentrarnos de nuestras labores como gobernantes de nuestro Territorio. Así las cosas, además de lo expuesto en el documento que se dijo aportó el recurrente, y que pedimos integrar a la presente respuesta, nos permitimos agregar lo siguiente: Al dar respuesta al Recurso de Amparo tramitado bajo el Exp. N° 26-009006-0007-CO; ya habíamos indicado que por medio del DE N° 21475-G, publicado en el Diario Oficial La Gaceta N° 23 de 03 de febrero de 1993; específicamente el párrafo II del artículo 2°, se estableció como el Consejo de Mayores o autoridades étnicas tradicionales Térraba al Consejo que lleva ese mismo nombre y mediante el DE N° 16569-G; publicado en el Diario Oficial La Gaceta N° 191 de 08 de octubre de 1985 y sus reformas, no se reconoce la existencia de un pueblo con la denominación de pueblo BRÖRÁN; y el existente y reconocido en nuestro Territorio se identifica bajo el nombre de TÉRRABA.SOBRE EL TERRITORIO INDÍGENA DE TÉRRABA Y EL PUEBLO BRORÄN: En el DE N° 13573-G-C, publicado en el Diario Oficial La Gaceta N° 94 de 17 de mayo de 1982, se lee: “Artículo 1º. Se reconoce que cada grupo étnico indígena de Costa Rica, es caracterizado por rasgos culturales, lingüísticos, sociales e históricos propios, diferentes de los rasgos culturales de las otras comunidades indígenas, de tal manera que cada grupo étnico tiene una personalidad propia, distinta de la de los otros grupos indígenas. Artículo 2º. Para los efectos del artículo 1º de la Ley N° 6172 del 29 de noviembre de 1977 el Estado reconoce la existencia oficial de ocho grupos étnicos (etnias) indígenas en Costa Rica, a saber: 1. Bribrí. 2.Cabécar. 3. Guaymí. 4.Brunka. 5.Térraba. 6.Huetar (Pacacua). 7.Maleku (Guatuso). 8.Chorotega (Nicoya). Artículo 2. Para efectos legales, todo indígena de Costa Rica pertenece a uno de estos ocho grupos étnicos oficiales.Artículo 3º. Cada uno de los ocho grupos étnicos reconocidos será regido a la vez por las disposiciones generales de la Ley Indígena y decretos conexos, pero también por sus costumbres y reglas propias. A este efecto, cada uno de los ocho grupos étnicos deberá presentar a la Comisión Nacional de Asuntos Indígenas (CONAI) y otros organismos competentes, un documento que exprese las diferentes costumbres y reglas propias de su organización social. Las distintas reservas indígenas pertenecientes a un mismo grupo étnico tendrán un reglamento único común, válido para todos los representantes del grupo étnico. Artículo 4º. El Estado no dará una definición exacta ni única del indígena, sino que esta definición será presentada separadamente por cada uno de los ocho grupos étnicos indígenas”. Asimismo, se hace referencia al artículo 5° del citado decreto: “Artículo 5º. En cuanto a la administración de las Reservas, cada Reserva Indígena constituye una comunidad indígena única, administrada por su Asociación de Desarrollo Integral, quien es el órgano representativo de cada comunidad, y funge como gobierno local de cada Reserva Indígena”.Se indica que mediante los Decretos Ejecutivos N° 16569-G y N° 20645-G se modificó el artículo 6° del decreto original, consolidándose ocho grupos étnicos distribuidos en distintos territorios indígenas. Señala que la etnia Térraba tiene un único territorio y reitera que el artículo 5° se mantiene vigente. EN RESUMEN SOBRE ESTE HECHO PRIMERO: Además de lo expuesto, la finca a que alude el recurrente forma parte de nuestro Territorio; pero se encuentra bajo litigio, según expedientes tramitados en la vía ordinaria, a saber Tribunal Contencioso, expedientes n° 11-000019-1129-AG y 18-000022-1555-AG; ambos iniciados en el Juzgado Agrario de Buenos Aires, pero trasladados a la vía Contenciosa por incompetencia material. Así las cosas, toda posesión reclamada por el recurrente es una de mala fe y ello no nos autoriza a respaldarlos. La jurisdicción penal, desde el Tribunal Penal con sede en Pérez Zeledón, hasta el Tribunal de Apelaciones de Sentencia Penal de Cartago y finalmente la Sala Tercera, han confirmado sentencias que indican que no existe, en el ordenamiento jurídico nacional ni internacional, algún derecho a la recuperación forzosa, por las vías de la violencia o de hecho, de bienes inmuebles.La determinación adoptada por este Gobierno local, en procura de la paz social, es que todo tema de recuperación de tierras se tiene que tramitar en las vías ordinarias judiciales y así quien tenga derecho a ser indemnizado o reubicado (artículo 5° Ley Indígena) que lo sea y quienes no, producto del proceso judicial respectivo, sean desalojados; y no propiciamos ni tutelamos las referidas recuperaciones por las vías de hecho. SEGUNDO: El tema de la medida cautelar invocada no tiene relevancia para el presente recurso, pues si se invoca, por ella se ordena tutelar las garantías de vida, libertad y movimiento a todo miembro de nuestra etnia; y quien puede vulnerarla es el Estado, no el gobierno local; por lo que no tiene razonabilidad invocarla en esta vía. TERCERO: No nos constan las actividades económicas del recurrente; pero el tema se le había expuesto y se le había respondido en el memorial emitido por mi representada desde fecha 16 de diciembre de 2024.CUARTO: Es cierto la presentación de la solicitud y por ello se le dio respuesta, conjuntamente con el comunicado de fecha 16 de diciembre de 2024; documento que el propio recurrente presentó a los autos. QUINTO: A todo este hecho se le dio respuesta al referirnos al hecho primero de este recurso; en donde se le expuso las razones por las cuales él y su grupo de apoyo han tratado de legitimar un gobierno paralelo al de la ADIIT, lo cual consideran inadmisible por razones de pacífica convivencia. SEXTO: Se rechaza la lectura que el recurrente realiza de la legislación indígena. Se indica que el Convenio N° 107 de la OIT reconocía la propiedad individual y colectiva, que el artículo 3 de la Ley Indígena N° 6172 establece que los indígenas solo pueden negociar sus tierras con otros indígenas, y que ello reconoce la posesión individual existente en el territorio. Añade que la propiedad colectiva se refiere a la titularidad registral del territorio.Finalmente señala que el actor busca reiteradamente el auxilio del recurso de amparo para obtener una resolución con fuerza erga omnes y legitimarse ante la comunidad. COMENTARIO FINAL: Señoras y Señores Magistrados: nuestro esfuerzo, como gobierno local, ha sido y es procurar la pacífica convivencia entre los miembros de nuestra etnia; pero ello ha sido imposible con el actor, en tanto autodenominado y apoyado por una estructura paralela que han pretendido legitimar y que denominan BRORAN. En uso de nuestras tradiciones ancestrales y costumbres propias (art. 4° de la Ley Indígena), por mayoría de un 90% de nuestra población, se ha tomado la decisión de que solamente se reconoce el CONSEJO DE MAYORES TÉRRABA, al cual están invitados todos los Mayores que deseen participar. Agrega que los autodenominados BRORAN han declarado como propósito lograr que los gobiernos ADII sean revocados y que se han distribuido importantes extensiones de tierra entre sí”. Solicita se declare sin lugar el recurso.
  4. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

CONSIDERANDO:

I. SOBRE EL RECURSO DE AMPARO CONTRA SUJETOS DE DERECHO PRIVADO

Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para -posteriormente y en caso afirmativo-, dilucidar si es estimable o no. En ese particular, la Ley de la Jurisdicción Constitucional, en su artículo 57, estipula bajo qué supuestos es admisible el amparo contra las acciones u omisiones de sujetos de derecho privado, es decir, cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2°, inciso a), de la misma Ley. Visto lo anterior, en el caso concreto, se estima procedente entrar a conocer el fondo del asunto, considerando que la asociación recurrida se encuentra en una posición de poder frente a la cual los remedios jurisdiccionales comunes resultan claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales que se reclaman como lesionados. En consecuencia, procede conocer el recurso por el fondo.

II. OBJETO DEL RECURSO

El recurrente alega que es una persona indígena de la etnia Brörán, habitante del territorio indígena de Térraba, y que la Asociación de Desarrollo Integral Indígena de Térraba se ha negado a emitirle una constancia que acredite su condición de vecino para la tramitación de un Certificado de Uso de Suelo requerido para el desarrollo de un proyecto productivo de subsistencia. Sostiene que la autoridad recurrida condicionó la emisión de dicho documento a la presentación de títulos de propiedad o documentos traslativos de dominio, exigencia que estima contraria al régimen jurídico de los territorios indígenas y lesivo de sus derechos fundamentales.

III. HECHOS PROBADOS

Se estiman como debidamente demostrados los siguientes hechos, de importancia para la resolución del presente asunto:

  • a)Mediante el Decreto Ejecutivo N° 21475-G, publicado en La Gaceta N° 23 del 3 de febrero de 1993, se estableció como autoridad étnica tradicional de Térraba al Consejo de Mayores de Térraba (ver contestación vertida por el representante de la asociación recurrida).
  • b)Por Decreto Ejecutivo N° 16569-G, publicado en La Gaceta N° 191 del 8 de octubre de 1985 y sus reformas, no se reconoce la existencia de un pueblo con la denominación de “Brörán”, identificándose el territorio indígena correspondiente bajo la denominación de Térraba (ver contestación vertida por el representante de la asociación recurrida).
  • c)De conformidad con los Decretos Ejecutivos N° 13573-G-C, N° 16569-G y N° 20645-G, la Asociación de Desarrollo Integral constituye el órgano representativo y gobierno local del Territorio Indígena de Térraba (ver contestación vertida por el representante de la asociación recurrida).
  • d)La finca Crun Shurin, a la que alude el recurrente, forma parte del Territorio Indígena de Térraba y se encuentra bajo litigio judicial en los expedientes N° 11-000019-1129-AG y N° 18-000022-1555-AG, tramitados en la jurisdicción contencioso-administrativa (ver contestación vertida por el representante de la asociación recurrida).
  • e)El recurrente presentó ante la Asociación de Desarrollo Integral Indígena de Térraba una solicitud para la emisión de un documento que acreditara su condición de vecino del territorio (ver contestación vertida por el representante de la asociación recurrida).
  • f)La Asociación de Desarrollo Integral Indígena de Térraba dio respuesta a la solicitud presentada por el amparado mediante los oficios de 16 de diciembre de 2024 y 28 de septiembre de 2025 (ver contestación vertida por el representante de la asociación recurrida).
  • g)La Asociación de Desarrollo Integral Indígena de Térraba no reconoce al denominado Consejo de Mayores Brörán como autoridad tradicional del Territorio Indígena de Térraba y reconoce únicamente al Consejo de Mayores de Térraba como autoridad étnica tradicional del territorio (ver contestación vertida por el representante de la asociación recurrida).

IV. SOBRE EL FONDO

Recientemente, este Tribunal, en la Sentencia N° 2026-005199 de las 9:34 horas de 13 de febrero de 2026, se pronunció sobre un asunto similar al de estudio, estimando en lo que interesa, lo siguiente:

“… interesa destacar que el fondo lo que se observa es un conflicto relativo a la pertenencia de determinadas personas a la base de datos de la etnia Térraba Brörán y a las actividades que pueden o no desarrollar en el territorio indígena en particular. En ese sentido, si bien el accionante considera que las personas que no se encuentren en dicha base de datos no pueden ejercer las actividades comerciales de marras, no menos cierto es que la propia ADI fue la que otorgó el aval para que la municipalidad accionada otorgara los permisos y patentes respectivas; además, el recurrido argumenta que “no existe en este territorio reconcomiendo alguno de la denominación étnica bröran, acá somos indígenas térrabas o teribes”.

Ahora, respecto de la pertenencia o no a la base de datos referida por el recurrente y a la condición de persona indígena, esta Sala ha indicado: “es menester traer a colación lo resuelto por la Sala, en un asunto similar atinente a la base datos de personas de la etnia Térraba Brörán; así en la sentencia n.°26087-2022 de las 9:45 horas de 4 de noviembre de 2022, en la que se indicó que no le compete a la Sala “determinar si una persona es o no indígena, pues tal y como se expuso en el precedente citado supra, en respeto a la autodeterminación de las comunidades indígenas, debe reconocerse un particular valor al criterio de los ancianos de la comunidad, quienes identifican quiénes son personas indígenas de acuerdo con sus costumbres y cultura. De ahí que el registro de la Base de Datos de la Etnia Térraba sea llevado a cabo por el Consejo de Mayores de la comunidad en conjunto con el Tribunal Supremo de Elecciones y demás instituciones públicas. Aunado a lo anterior, el reclamo de la recurrente excede la naturaleza sumaria del amparo, por lo que cualquier disconformidad con este asunto, debe ser ventilada ante las vías competentes para tales efectos (…)” (Sentencia nro. 2023000535 de las 9:15 horas de 13 de enero de 2023).

Así, se destaca nuevamente que las condiciones particulares de las personas señaladas por el tutelado (si son o no indígenas, si deben pertenecer a la base de datos en cuestión y si pueden ejercer actividades comerciales), son aspectos que exceden la naturaleza de este proceso y que por ende deben discutirse ante las instancias ordinarias competentes, a través de la amplitud que caracteriza a la vía común.

Ergo, se declara sin lugar el recurso”.

En el sub lite, esta Sala no encuentra motivo para variar el criterio vertido en el precedente citado, toda vez que el reproche planteado por la parte recurrente reproduce, en lo sustancial, una inconformidad dirigida a que este Tribunal analice la regularidad del aval emitido por la Asociación de Desarrollo Integral Indígena de Térraba y, de manera correlativa, la validez del acto administrativo mediante el cual la Municipalidad de Buenos Aires otorgó una patente comercial para el funcionamiento del restaurante cuestionado dentro del territorio indígena. En efecto, del marco fáctico acreditado se desprende que el otorgamiento de dicha patente contó con una autorización previa de la ADI respectiva y que la gestión municipal se realizó con base en ese aval, de modo que la pretensión de los accionantes conduce necesariamente a que esta jurisdicción constitucional examine si la persona beneficiaria cumplía o no las condiciones requeridas para desarrollar la actividad comercial de marras y si la ADI actuó conforme al ordenamiento al extender dicha autorización.

Ahora bien, tal como se estableció en el precedente transcrito, no le corresponde a esta Sala, en la vía sumaria del recurso de amparo, determinar si una persona concreta reúne o no los presupuestos exigidos para el otorgamiento de un permiso o patente comercial, ni mucho menos revisar, caso por caso, la legalidad de los avales emitidos por una ADI y de los actos administrativos municipales que se dictan con fundamento en ellos, pues ese examen supone un análisis detallado de requisitos, condiciones personales y comunitarias, así como de valoraciones jurídicas que exceden el ámbito cognoscitivo propio de esta vía excepcional. A ello se suma que, en el presente asunto, el planteamiento de la parte recurrente se encuentra estrechamente vinculado con controversias relativas al reconocimiento de la condición indígena, a la pertenencia o no a determinadas bases de datos comunitarias y a la legitimidad de las autoridades internas que otorgan avales, aspectos que, por su complejidad fáctica y normativa, requieren ser dilucidados en las instancias ordinarias competentes, dotadas de la amplitud probatoria necesaria para tales efectos.

Así las cosas, al igual que en el precedente invocado, lo que subyace en el fondo del reclamo no es una lesión directa e inmediata a un derecho fundamental susceptible de tutela en esta sede, sino una discrepancia con actuaciones administrativas cuya eventual invalidez o improcedencia debe ser discutida a través de los cauces legales ordinarios previstos para ello. En consecuencia, al no advertirse una afectación constitucional que justifique la intervención de este Tribunal en los términos pretendidos, y siendo claro que el análisis solicitado desborda la naturaleza sumaria del amparo, lo procedente es declarar sin lugar el recurso, manteniendo incólume el criterio ya sostenido por esta Sala en supuestos análogos …”.

Ahora bien, en el caso bajo estudio, el recurrente alega que la Asociación de Desarrollo Integral Indígena de Térraba se negó a emitir un documento que acreditara su condición de vecino y habitante del territorio indígena, indispensable para gestionar un Certificado de Uso de Suelo requerido para el desarrollo de un proyecto productivo de subsistencia. Sostiene que dicha negativa obedeció a la exigencia de títulos de propiedad o documentos traslativos de dominio, requisitos que considera incompatibles con la naturaleza comunal de los territorios indígenas.

Al respecto, el representante de esa asociación, en la contestación presentada ante este Tribunal, aclara que la finca a la que alude el amparado se encuentra sometida a procesos judiciales en la jurisdicción contencioso-administrativa y que los aspectos relacionados con la posesión y ocupación de esos terrenos se encuentran en discusión ante las vías ordinarias competentes. Asimismo, indica que, de conformidad con la normativa que regula el Territorio Indígena de Térraba, la Asociación de Desarrollo Integral constituye el órgano representativo y gobierno local del territorio, y que la autoridad tradicional reconocida corresponde al Consejo de Mayores de Térraba. Añade que no reconoce la existencia de un pueblo o autoridad étnica distinta bajo la denominación "Brörán" y que las diferencias planteadas por el recurrente se relacionan con conflictos de representación, organización interna y tenencia de tierras dentro del territorio indígena.

Bajo ese panorama, no le corresponde a este Tribunal analizar cuestiones relativas a la titularidad, posesión, ocupación o recuperación de terrenos dentro del Territorio Indígena de Térraba, ni determinar cuál de las posiciones sostenidas por las partes debe prevalecer respecto de la representación de determinados grupos o estructuras organizativas. Nótese que la resolución de tales controversias exige un amplio debate probatorio y jurídico que resulta incompatible con la naturaleza sumaria del recurso de amparo. Por ende, los reclamos formulados por el recurrente deben ventilarse ante las instancias administrativas o jurisdiccionales ordinarias competentes, sedes en las que podrá hacer valer sus argumentos y pretensiones.

Por ende, este tipo de agravios deben ser planteados ante las partes recurridas o bien, ante las vías jurisdiccionales ordinarias creadas especialmente al efecto; sedes donde podrá el recurrente -si a bien lo tiene-, en forma amplia, plantear sus argumentos, discutir el fondo del asunto y hacer valer sus pretensiones. Ergo, el recurso debe ser desestimado, como en efecto se dispone.

V. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a las partes que, de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo de treinta días hábiles después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 03 de mayo del 2012, artículo LXXXI.
