033809-26. PUBLIC SERVICES. IT IS ALLEGED THAT ASADA IDA CAÑA BLANCA REFUSED TO CONNECT SERVICE TO A SOCIAL-HOUSING DWELLING, DESPITE HAVING PREVIOUSLY CERTIFIED WATER AVAILABILITY, WHICH ENABLED THE APPLICANT TO PROCESS THE HOUSING VOUCHER AND BUILD THE PROPERTY. THE SUBSEQUENT REFUSAL, BASED ON PIPELINE LIMITATIONS THAT SHOULD HAVE BEEN ASSESSED BEFORE THE CERTIFICATE WAS ISSUED, VIOLATED THE RIGHT TO WATER AND THE PRINCIPLES OF LEGITIMATE EXPECTATION AND LEGAL CERTAINTY. THE APPLICATION IS PARTIALLY GRANTED, AND THE PROPERTY IS ORDERED TO BE PROVIDED WITH DRINKING WATER WITHIN ONE MONTH. VCG09/2026 “(…) III.- ON THE RIGHT TO WATER AND THE REQUIREMENTS THAT MAY BE IMPOSED IN AN APPLICATION FOR WATER SERVICES. The Chamber’s case law has repeatedly recognized the so-called fundamental right to water, under which all persons must be afforded the possibility of equal access to drinking-water services, since water is essential to human life and health.
However, the fundamental-right status of this right does not entail unrestricted access to water services, since the administration may validly establish general requirements that each applicant must meet in order to assess their particular request. Thus, in ruling No. 2006-1898, at 9:53 a.m. on 17 February 2006—reiterated, among others, in rulings Nos. 2007-13310, at 10:57 a.m. on 14 September 2007, and 2008-16311, at 5:30 p.m. on 30 October 2008—the Chamber held that:
“The applicant alleges (…) that, despite their requests and efforts, the respondent Institute has refused to provide them with drinking-water service on the grounds that this is an informal settlement and its inhabitants do not have a subdivision plan establishing that they own the properties. In this regard, the record establishes, based on the report submitted under oath by the respondent authority, that there is an impossibility of installing household drinking-water services in the community where the applicant lives for two specific reasons: the lack of adequate infrastructure and the interested parties’ failure to submit applications meeting the legal requirements (...). In ruling No. 2004-12185, at 13:31 hours on 29 October 2004, this Chamber stated in a similar case that the Costa Rican Institute of Aqueducts and Sewers could not be compelled to evade the provisions of its Regulation on the Provision of Services to Customers or the General Drinking Water Law.
Accordingly, unless the protected party meets the conditions and requirements set out therein, regular service cannot be provided, even though drinking-water service must be available to everyone because it is an essential service. Given these two objective reasons why regular drinking-water service cannot be supplied to the applicant—failure to meet the requirements for connection of a new service, beginning with submission of an application, and the existence of adequate infrastructure in the area—there is no basis for concluding that the respondent Institute denied regular service because the protected party and their neighbors lack title to the properties they occupy. It should also be added that, under Article 33 of the aforementioned Regulation, lack of title does not appear to be an obstacle to requesting connection of a new drinking-water service, provided the requirements set out in that provision are met.
In any event, the record also establishes that, although regular drinking-water service has not been provided, the applicant and the other neighbors have a public water source installed by the Institute so that they may obtain water for their basic needs. This Court therefore considers that it was the applicant’s and local residents’ own omission—their failure to establish that they had submitted applications to install a new drinking-water service in their community—that prevented their situation from being assessed to determine whether, particularly by meeting the requirements of Article 33 of the Regulation on the Provision of Services to Customers, the infrastructure limitations could be overcome in their case and regular drinking-water service provided to them.” It is therefore understood that, although a fundamental right to water exists and may be asserted against the relevant administration, provision of the service may be subject to compliance with the requirements for its granting and to the material possibility of supply; that is, there must be no technical circumstances that make it impossible or inadvisable for the administration to provide drinking-water service.
This means that the administration is not required to provide drinking-water service where technical reasons make it inadvisable or impossible, and it must adequately inform the applicant of the reasons their request cannot be fulfilled” (see ruling No. 2018-8650, at 09:15 hours on 1 June 2018; 2018-7369, at 9:45 hours on 11 May 2018; and No. 2016-18026, at 9:05 hours on 7 December 2016).

In deciding this case, it is very important to take into account what this Constitutional Chamber held in ruling No. 2024010181, at 9:20 hours on 19 April 2024, where it established:
“III.- ON THE MERITS. After analyzing the evidence submitted and the report made under oath by the respondent authority, following due warning of the consequences provided for in Article 44 of the Constitutional Jurisdiction Law, this Court considers it established that the applicant owns a property located in San Ramón, Alajuela, specifically in Piedades Norte, registered under real property folio No. 571180-000. It may be inferred that on 26 March 2022 the applicant submitted to the respondent authority an application for drinking water for an undeveloped property intended for agricultural use, accessed by an agricultural easement that reaches a public road 159.09 meters away; application No. SIGDD-2022-00006761. However, the basic review of application No. SIGDD-2022-00006761-1-AP determined that it would not be appropriate for the Institute to approve the application for availability of drinking water and sanitary sewer service for the proposed project because it lacked the technical feasibility required to approve availability applications in the CO-A-35-San Ramón system.
The technical feasibility determination was based on Drinking Water Feasibility Inspection SIGDD-2022-00006761-1-1-1, submitted by the Technical Head of Operation and Maintenance of the San Ramón Cantonal Water System for the Central West Region, which stated: ‘No distribution and collection infrastructure exists in front of the property, according to the technical assessment.’ This was notified to the applicant through the NO AVAILABILITY Certificate ruling of 04 August 2022. In light of this situation, it is established that the protected party filed a motion for revocation and/or an appeal in the alternative against the decision of ICAA; however, by ruling at 7:00 hours on 12 August 2022, the motion for revocation was denied. Likewise, by ruling GG-R-2022-0727, at 10:00 hours on 21 September 2022, the appeal was rejected.
It was established that on 21 September 2022 the applicant submitted a new application for drinking water, No. SIGDD-2022-00020625, to the respondent authority. In this regard, it was established that ICAA issued letter No. SIGDD2022-0000625-1-1-1 of 16 November 2023, in which it stated the following: ‘DRINKING WATER IS AVAILABLE ON THE PUBLIC ROAD; A SEWER SYSTEM IS NOT AVAILABLE.’ This was notified to the interested party in the letter of 16 November 2023 under the following terms: ‘In response to the availability request, I am enclosing the Certificate of Positive Availability of Drinking Water and Negative Availability of Sanitary Sewer Service No. 2022-00020625-1, which, in summary, states the following: The sanitary sewer network is not operating in the area.’ It is established that on 07 February 2024 the applicant submitted an application for a new drinking-water service, No. P21112024020005, but upon receiving that application the cantonal office noticed an error and proceeded to investigate, taking into account the prior evidence and again assessing whether the circumstances of the application had actually changed and the circumstances for which application for availability SIGDD-2022-00006761-1-1-1 had been denied.
Finally, it was confirmed that, in letter No. SG-GSP-RC-2024-00132 of 05 March 2024, the respondent authority notified the interested party that it could not process the application for the new service, No. P21112024020005. In essence, it stated: ‘On 07 February 2024, application 21112024020005 was issued in the name of [Name 001], identity card [Value 001], for a housing construction project, following an application for connection of a new drinking-water service to be located on the property registered under real property folio 2-571180-000, whose recorded nature is PASTURE LAND, accessible through an agricultural easement located in Piedades Norte District, San Ramón Canton, Alajuela Province, according to Cadastral Plan No. A-2032273-2018, with the address 115 meters northwest and 260 meters west of Cabinas del Bosque Lodge (…) according to a search in the National Property Registry, the distance from the public road to the land by way of the agricultural easement is approximately 190 meters (…) To provide services within the easement, it must be registered in favor of AYA, and the criteria indicated above must also be met.
In conclusion, under these circumstances the Institution is unable to grant what was requested. The documents in the administrative file are conclusive in this regard; it would be improper for the Institution to grant a new service contrary to the Principle of Legality and to the science and technical knowledge referred to in Articles 11 and 16 of the General Law of Public Administration. AyA must therefore comply with the regulations governing it; otherwise it would breach the legal system (…) Finally, as has been demonstrated, application for the new service No. P21112024020005 cannot be processed.’ In ruling No. 2012-016181, at 9:05 hours on 27 November 2012, reiterated in ruling No. 2015002749, at 09:05 hours on 27 February 2015, this Chamber addressed a matter similar to the present case in the following terms:
“V.- SPECIFIC CASE. It is established that the protected party had been issued an initial availability letter on 24 October 2011 so that she could process approval of Cadastral Plan No. SJ-919550-0. The document was valid for no more than six months, expiring in April 2012. On the basis of that document, among other permits and authorizations, the applicant built her home and requested that the respondent Association issue an availability letter so that drinking-water service could be provided to the property. However, this was denied because, according to the latest flow measurement conducted by personnel of the Institute of Aqueducts and Sewers, the captured springs were insufficient to supply the current population—a finding recorded in memorandum No. SUB-G-GSC-UEN-AP-EBD-2012-686 of 25 May 2012. This situation was communicated to the protected party. Based on these facts, this Court considers that the principle of legitimate expectation was violated to the detriment of the protected party.
Indeed, although the first availability letter was issued to her in 2011, the protected party legitimately relied on the respondent Association—which, as stated above, exercises public powers—and built her home, incurring the substantial expense this entails, in the expectation that drinking-water service would be supplied to her. Certainly, under Article 21, subsection 19), of the Regulation on Associations Administering Community Aqueduct and Sewer Systems, Executive Decree No. 32529, ASADAS may issue a water availability seal—valid for 6 months for single-family homes and one year for other developments, renewable—‘provided that there is technical feasibility, that the service provided is not adversely affected, and that infrastructure exists’ (emphasis added). Nevertheless, consistent with the principle of legitimate expectation and good faith, the respondent Association must be advised that before issuing a drinking-water availability letter, the necessary measurements must be taken to verify whether water is available, thus avoiding causing members of the public to make substantial and futile investments if, after their homes or buildings have been built, they cannot be supplied with drinking water.
As a consequence of the foregoing, the application must be granted, with the consequences detailed in the operative part of this ruling.” In the case at hand, the proven facts show that, by letter No. SIGDD2022-0000625-1-1-1 of 16 November 2023, ICAA issued a certificate of positive drinking-water availability for the property registered under real property folio No. 571180-000, located in San Ramón, Alajuela, specifically in Piedades Norte, in the applicant’s name, under the following terms: “DRINKING WATER IS AVAILABLE ON THE PUBLIC ROAD; A SEWER SYSTEM IS NOT AVAILABLE.” This was notified to the protected party in a letter dated 16 November 2023 under the following terms: “In response to the availability request, I am enclosing the Certificate of Positive Availability of Drinking Water and Negative Availability of Sanitary Sewer Service No. 2022-00020625-1, which, in summary, states the following: The sanitary sewer network is not operating in the area.” On the basis of that document, among other permits and authorizations, such as land-use approval and construction permit No. PC-079-2024 issued by the Municipality of San Ramón, the protected party began building her home.
Later, on 07 February 2024, she applied to the respondent institution for a new drinking-water service, No. P21112024020005; however, this was denied by letter No. SG-GSP-RC-2024-00132 of 05 March 2024 because of a technical impossibility: there was no sewer-system availability along the property boundary. In this case, this Court considers that ICAA violated the principle of legitimate expectation to the detriment of the protected party. In that regard, the applicant’s own account establishes that she legitimately relied on the respondent authority and built her home, incurring the substantial expense this entails and expecting to be supplied with drinking-water service. Nevertheless, almost three months after letter No. SIGDD2022-0000625-1-1-1 of 16 November 2023 was issued, her application for a new service was denied. For these reasons, it is considered that the protected party’s principle of legal certainty and right to prompt and effective justice were also violated.
Note that an application for drinking water entails an administrative procedure that must be reviewed and decided by the respondent Institute. In this case, it is clear that the respondent issued a certificate of positive drinking-water availability, but later denied the application for a new drinking-water service because of an error. In this regard, it is necessary to mention the following statement by ICAA in its report, insofar as relevant: “On 21 September 2022, the availability application was submitted again, as shown at folios 62 and 63 of the administrative file, with the decision at folios 68 to 69. The new request was initiated again under number SIGDD-2022-00020625. We report that, on this occasion, the cantonal office received assistance in deciding availability applications, and this time they decided the application positively without taking into account that the easement was agricultural and everything that entails in this case.
At that point, the situation that had existed since the previous decision had not changed. That positive availability decision took effect on 16 November 2023. Because this latest decision was outside the jurisdiction of the San Ramón cantonal office, it was decided by other collaborating offices outside the Central Region Directorate and processed positively for the user, with an incorrect decision, since the initial circumstances had not changed, access by agricultural easement remained the same, and as of the date of this report there is no evidence that infrastructure has been installed pursuant to an additional application or a Water Capacity letter authorizing it.” It added: “Upon receiving this application, the cantonal office noticed the error and conducted an investigation, taking into account the prior evidence and reassessing whether the circumstances of the application had actually changed, including the circumstances for which application for availability SIGDD-2022-00006761-1-1-1 had been denied.
For that reason, the response to Ms. [Name 001], in document SG-GSP-RC-2024-00132 of 05 March, explained the reasons why the application for the new service could not be processed.” This Chamber has now ruled that access to drinking water is a service that also enables the realization and protection of other fundamental rights, such as quality of life and health (see, in a similar vein, ruling No. 2017002404, at 09:45 hours on 17 February 2017). It has also recognized, however, that where technical reasons make the supply of drinking water absolutely impossible, no violation of a fundamental right occurs (see, in a similar vein, ruling No. 07779-2019, at 09:15 hours on 03 May 2019, among others). In this case, before ICAA mistakenly issued the certificate of positive drinking-water availability, it had already determined that it would not be appropriate to approve the application for availability of drinking water and sanitary sewer service because the technical feasibility required to approve availability applications in the CO-A-35-San Ramón system was lacking.
From this perspective, although it is important to state that this Court lacks jurisdiction to determine whether the drinking-water availability sought by the applicant should be granted, since that depends on technical criteria issued by ICAA authorities, the institution empowered by law to carry out such acts, in this case the Court does find a violation of the protected party’s principle of legitimate expectation, the principle of legal certainty, and her right to prompt and effective justice. The application must therefore be granted, with the consequences detailed in the operative part. (…)
The report made under oath by the respondent authority, with the potential criminal consequences provided for in Article 44 of the Constitutional Jurisdiction Law, establishes a violation of the fundamental rights of the applicant, on the basis of the considerations set out below. In this regard, it is established that, in letter ASADA-IDA-CB-07-2024 of 30 April 2024, the representative of Asada IDA Cañal Blanca informed the applicant, in response to her request, that the community’s Asada did have water availability for domestic use for plan P-1357570-2009. For an application for a service connection point, the requirements of the AyA regulations had to be met. It is also established that, for property No. 6-170304-000, cadastral plan P-1357570-2009, the Municipality of Osa processed and approved construction permit No. PC-511-02-10-2024 for construction of a housing-voucher home of approximately 42 square meters.
The application was made in the name of Ms. [Name 002], the registered owner of the property. The project documents also show that Mr. [Name 001] was the beneficiary of the social-housing dwelling and had the owner’s authorization to complete the relevant process. Municipal records also contain land-use assessments CUS-2050-2022 and CUS-0485-2024, relating to the property identified by plan P-1357570-2009. Those assessments determined that the proposed project was compliant and could proceed. As to water availability, it is important to state that the project documents include letter ASADA-IDA-CB-07-2024, dated 30 April 2024, issued by the Administrative Association of the Aqueduct and Sanitary Sewer of the IDA Caña Blancal Settlement and addressed to Ms. [Name 002]. In that document, ASADA itself stated that water was available for domestic use for the property identified by plan P-1357570-2009.
It also stated that an application for a service connection point had to meet the requirements established by the regulations of the Costa Rican Institute of Aqueducts and Sewers. Subsequently, on 15 January 2025, the applicant requested installation of water service from the respondent Asada. In addition, on 18 January 2025, personnel of the respondent Asada conducted an inspection and determined that the pipe running beneath the street pavement was half an inch in diameter, which made a water connection impossible. This was communicated to the applicant by letter ASADA-IDA-CB-026-2025 of 27 January 2025. Note that in this case, letter ASADA-IDA-CB-07-2024 dated 30 April 2024, issued by the Administrative Association of the Aqueduct and Sanitary Sewer of the IDA Caña Blancal Settlement, informed the applicant that water was available for domestic use for the property identified by plan P-1357570-2009.
In view of the foregoing and the case law cited above, the respondent Asada’s refusal to interconnect water service to the property in question, on which a house was built after the Municipality of Osa issued the relevant permits, violates the human right to water and the principles of legitimate expectation and legal certainty to the detriment of the applicant. The application is denied as to the Municipality of Osa and the Costa Rican Institute of Aqueducts and Sewers, since they did not violate any fundamental right of the applicant. PRINCIPLE OF LEGITIMATE EXPECTATION “(…) IV.- REGARDING THE PRINCIPLE OF LEGITIMATE EXPECTATION. In ruling No. 2018-002910, at 09:15 hours on 23 February 2018, this Chamber held as follows:
“IV.- Regarding this principle, it was previously assumed axiomatically that every unlawful act with favorable content could invariably be set aside by the Administration in any situation, without regard to any particular circumstances. However, beginning in the mid-1950s, both legal scholarship and case law began to recognize that blind and rigid application of that rule seriously harmed the confidence placed by members of the public in the Administration, as well as good faith and legal certainty. Thus, in a judgment dated 14 May 1956, the Administrative Litigation Court of Berlin developed the principle of legitimate expectation, which was later adopted by the Court of Justice of the European Community in its rulings of 22 March 1961 and 13 July 1965 (Lemmerz-Werk). The principle essentially reinforces citizens’ trust where, in certain circumstances of the specific case, considerations of equity and good faith prevent the Administration from taking measures contrary to an expectation induced by the reasonable stability of its decisions, on the basis of which individuals have taken particular measures.
In our continent, by way of example only, the Constitutional Court of Colombia, in Judgment T-308/11 of 28 April 2011, stated: ‘The principle of legitimate expectation promotes an atmosphere of tranquility in the relationships that members of the public establish with public authorities or private parties, so that they may expect in good faith that their actions will not be abruptly changed unless a constitutionally legitimate purpose takes precedence. Legal scholars have argued that legitimate expectation means that certain expectations generated by one legal subject vis-à-vis another, in response to specific conduct, produce consistent results in an atmosphere of trust that may be broken only to give way to the public interest. In relationships between the administration and members of the public, legal scholars have defined legitimate expectation as an ethical value that forms part of good faith and encompasses “the need for loyal, honest conduct, the kind of conduct that, in people’s estimation, may be expected of a person.” (…) “Applying the principle of good faith will allow the person subject to the administration’s authority to regain confidence that the administration will not demand more than is strictly necessary to achieve the public purposes pursued in each specific case.
Nor will it demand this in the wrong place, at the wrong time, or in the most inappropriate manner, taking account of that person’s personal and social circumstances and the public’s own needs.” Accordingly, legitimate expectation is to be understood as the certain expectation that a legal or material situation treated in a particular way in the past will not be treated in an extremely different manner in another period, unless a constitutionally acceptable cause justifies the change. In this regard, this Court has held that “a person subject to the administration’s authority is not the holder of an acquired right, but merely has an expectation that a particular factual situation or legal regulation will not be changed abruptly; consequently, their legal situation may be modified by the Administration. As an element of good faith, legitimate expectation may extend to an expectation that specific regulatory conditions governing a situation will continue, or that more burdensome requirements than those already imposed will not be applied to achieve a purpose, unless constitutionally valid reasons exist for doing so.” Indeed, the ratio iuris of the principle protecting legitimate expectation is that the development of legal relationships requires an atmosphere of trust in which the rules of the game, once established, are respected.
This is especially relevant in relationships with the Administration, since the legal instrument governing that relationship is the administrative act, which is a unilateral manifestation of the State’s will. Amparo proceeding filed by [Name 001], identity card [Value 001], and [Name 002], identity card [Value 002], against the ADMINISTRATIVE ASSOCIATION OF THE AQUEDUCT AND SANITARY SEWER OF THE IDA CAÑA BLANCA SETTLEMENT.
BACKGROUND:
Pipe study (18 January 2025). Present at the inspection were Secretary Jann Diery Porras Rodríguez and plumbers Juan Navas Maroto and Fidel Rodríguez Delgado. The study was conducted and determined that the pipe running beneath the pavement was half an inch in diameter, making an additional connection impossible. The Municipalidad de Osa had told the Asada Board of Directors for the 2022-2024 period what to do so that the community and the Asada would not have conflicts with potable water service in the future. It gave them recommendations and suggestions to follow, which they did not follow. The Asada requested from the Municipalidad de Osa the document concerning the improvements and precautions that had to be made before the asphalt was widened (document attached as evidence). The municipality sent a document referring to CIRCULAR-AM-018-2024-2028, setting out a work plan, since in some sectors of our community the pipe is on the right-hand side of the road and in others on the left; it is not on both sides, but on one or the other.
The Solano Rodríguez family’s lot and home are on the right-hand side, while the pipe is on the left-hand side, with the pavement in between. We consulted the Municipalidad de Osa to see whether they could help us with the impact, and they told us that if the Asada broke the pavement, it would have to restore it to its original condition. Our community’s Asada is small, with monthly income of 1,100,000 colones, and does not have enough money to carry out a costly repair. To address the impact on the Solano Rodríguez family and several family groups, the Asada Board of Directors approved proceeding with a branch line, consisting of a 4-inch pipe. The project would be carried out on the left-hand side of the road, starting at the storage tank, so that potable water service could be provided to the affected families. During the project, the Asada encountered two problems. First, weather conditions: heavy rain and the failure of other families to divert water caused pipe that had already been buried to become exposed because of the large volume of water coming from a family’s parcel.
The matter has already been referred to AyA and the Municipalidad de Osa (Risk Management). The second problem concerns a stretch near the property of the Chinchilla Lázaro family, identity card number 103750824. They own a property with an approved survey plan; a 4-inch pipe must be buried near the property. In previous years, the Asada excavated and buried a 2-inch pipe there with Ms. Lázaro’s authorization to do so on her property. Currently, Ms. Lázaro objects and will not allow the new pipe to be installed, saying that it is private property, even though she allowed the other pipe many years ago. As an Asada, we know that a pipe providing potable water service cannot be on private property, because it is understood that it must be on public property. There is overhead electrical wiring above it, which should properly be public. But the woman claims that it is private property, uses a machete, and our President respectfully asked her to lower the machete.
She said she was accustomed to carrying that implement in her hand and is preventing the project from being carried out successfully. Removing the 2-inch pipe would not be possible either. This matter has already been reported to AyA and INDER.
As for case No. 2, other families are seeking a solution to obtain an accessible road. They went to the authorities and hired a lawyer to resolve the impact through an amparo proceeding. The Board of Directors for 2024-2026 tried to join and find a solution so it could continue working on the 4-inch pipe project. At first, it could not join; later, the Board of Directors hired a lawyer so it could be added to the relevant legal matter and seek a solution. We have been sending emails to various government bodies, including the Municipalidad de Osa, INDER, AyA, and the Water Directorate.
Our community has been greatly affected in recent years by climatic impacts, such as the El Niño effect, which brings little rain, and the summer season. When these conditions occur during the year, many users in our community are affected, so water service is shut off overnight from 8:00pm to 4:30am. These shutoffs restore normal potable water service and result in few impacts. Without them during those periods, our users would be greatly affected. Given these circumstances, AyA sent a technician to our community to conduct a field study and other analyses. In preparing the document, the technician provided conclusions and recommendations that we must follow and comply with. The document will be attached as evidence.
Conclusions:
• As a Board of Directors, we have sought solutions to improve potable water service in our community, such as building a branch line to carry water service to sectors where access for pipes has been very difficult because of the asphalt laid by the Municipalidad de Osa.
• Several impacts have made it difficult for us to improve potable water service, including weather conditions and the passage through the property of the family mentioned in the preceding written account.
7 • As an Asada, we have sought solutions and assistance from various government bodies to help us address and overcome the different situations that have complicated implementation of the project.
• We have focused on identifying springs (nacientes) and improving potable water service. Currently, two springs provide water to the storage tank. Two others have been gauged and their water analyzed by Laboratorio San Martín, but they were not sufficiently effective, and we were advised to continue looking for other sources to improve service.
• Finally, we have tried to conduct many investigations, approach institutions, and seek support to improve our community and provide better access to potable water for our community and those who have no water connection and are waiting for one.
• We acknowledge that before undertaking projects or improving potable water service, we must approach our governing body, AyA. We cannot proceed without prior legal approval as support.
• It is important to mention that this aqueduct was built in 2002, and the entire main pipe route was built in Asentamiento Ida Caña Blancal, donated by INDER. At that time the adjoining property was a cattle farm; starting in 2010, the owners of that farm began subdividing it, without having presented or notified the ASADA of any possible development project. (The home of Mr. [Nombre 002] and Mr. [Nombre 001].)
“FIRST: WE HAVE NO KNOWLEDGE OF THIS. As to the request for service availability made by the applicants on 30 April 2024 to ASADA IDA Caña Blancal, it is important to state that neither this Executive Presidency nor the Community Aqueducts Regional Office (ORAC Brunca) has knowledge of that request. By resolution of the AyA Board of Directors No. 2006 – 011, approved at Ordinary Session No. 2006 – 001, Article 06, of 24 July 2007, and published in Official Gazette La Gaceta No. 78 of 03 January 2006, the Instituto Costarricense de Acueductos y Alcantarillados granted a delegation agreement to the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Asentamiento IDA Caña Blancal, Distrito Palmar, Cantón de Osa, Provincia de Puntarenas, legal entity identification No. 3 – 002 – 346318. Accordingly, under the Regulation for the Provision of AyA Services, AyA Board of Directors resolution No. 2020 – 442, published in Official Gazette La Gaceta No. 17 of 24 January 2006, with the endorsement of the Contraloría General de la República, by Official Letter No. 3736-2006 of 14 March 2006, that ASADA is authorized to issue certificates of service availability (articles 29 to 38), certificates of water capacity (articles 39 to 43), and/or grants of permanent service connections (articles 67 to 76), as applicable, provided technical feasibility exists (Arts. 8, 9 and 14 of the RPSAyA and 45 of the ASADAS Regulation).
Accordingly, the association’s Board of Directors is responsible not only for ensuring that applicants meet the requirements established for each specific case, but also for ensuring that verified technical feasibility exists before issuing the legally appropriate act. In addition, Lic. Boris Gamboa Valladares, Head of the Community Aqueducts Regional Office (ORAC), Brunca Region, states in memorandum No. GSD-UEN-GAR-2026- 03631, dated 11 August 2026: ‘FIRST: WE HAVE NO KNOWLEDGE OF THIS. HOWEVER: ASADA IDA Cañablancal, legal entity identification No. 3-002-346318, received from the Community Aqueducts Regional Office (ORAC Brunca) Official Letter GSD-UEN-GAR-2025-02854, which determines that the system operated by the ASADA has a water deficit.’ On this matter, Ing. Allan Andrey Rojas Castro, Rural Aqueducts Management Unit, states in Official Letter No. GSD-UEN-GAR-2026-02854, dated 25 June 2026: ‘IV.- Conclusions …
The aqueduct of Asentamiento IDA Cañablancal serves a total of 97 users as of April 2026, with an estimated population of 262 people. Based on the change in the number of users between April 2025 and April 2026, there has been an increase of 12,79.’ The aqueduct has 100% installed micrometering but lacks a macrometer, so there is no record with which to calculate the system’s unaccounted-for-water indicator. A water balance of the Asentamiento IDA Cañablancal aqueduct identified a water deficit, evidenced by the reasons given and the requests for water supply by tanker truck made by the ASADA. Considering the users’ consumption pattern in the aqueduct, the available flow from intakes 1 and 2 is sufficient to supply 44 users, while there are 97 in total. Based on the critical gauging value, the system’s current flow shortfall is 0,67 l/s, while the usable flow from Batambal 3 and Batambal 4 springs is 0,17 l/s combined.
Their addition to the system will therefore be insufficient to cover the shortfall required by current users. … V.- Recommendations … If new sources with enough flow to cover the aqueduct’s water deficit cannot be identified, registered, tapped, and used, it is recommended that the technical feasibility of interconnecting the Asentamiento IDA Cañablancal system with the nearest aqueduct be assessed, in this case the Palmar Norte aqueduct operated by the Osa Cantonal Office of AyA. Under current conditions, it is recommended that no new potable water services be granted, even within the aqueduct’s service area, because an increase in users will worsen the water deficit and deteriorate the service conditions received by current users.’ (emphasis ours) SECOND: WE HAVE NO KNOWLEDGE OF THIS. The matter of procedures carried out before other State offices to obtain a purported housing allowance is not a fact known to our represented party.
THIRD: WE HAVE NO KNOWLEDGE OF THIS. The request for service availability made to the new Board of Directors of ASADA IDA Caña Blancal is not a fact known to our represented party. As stated in the first fact, the association has a duly granted Delegation Agreement from AyA, so the Asada is responsible for directly handling requests for certificates of service availability, certificates of water capacity, and/or permanent service connections.
FOURTH: WE HAVE NO KNOWLEDGE OF THIS. The request for service availability made to the new Board of Directors of ASADA IDA Caña Blancal is not a fact known to our represented party. As stated in the first fact, the association has a duly granted Delegation Agreement from AyA, so that ASADA is responsible for directly handling requests for certificates of service availability, certificates of water capacity, and/or permanent service connections. In this regard, Lic. Boris Gamboa Valladares, Head of the Community Aqueducts Regional Office (ORAC), Brunca Region, states in memorandum No. GSDUEN-GAR-2026-03631, dated 11 August 2026: ‘FOURTH: WE HAVE NO KNOWLEDGE OF THIS, HOWEVER: See the response to Fact One.’ FIFTH: PARTIALLY TRUE. The actions taken by the applicants before ASADA IDA Cañablancal in January 2025 are unknown. However, as to the request made by the association to ORAC Brunca, we state that Lic. Boris Gamboa Valladares, Head of the Community Aqueducts Regional Office (ORAC), Brunca Region, affirms in memorandum No. GSD-UEN-GAR-2026- 03631, dated 11 August 2026: ‘FIFTH: WE HAVE PARTIAL KNOWLEDGE OF THIS: We do not know what action was taken on 18 January 2025.
However, the ORAC Brunca engineering area issued instructions following a request from the ASADA, contained in Official Letter GSD-UEN-GAR-2025-02455, requiring that one of the three identified actions be carried out. It must be reiterated that the water deficit condition currently persists for this ASADA, as indicated in the response to Fact One.’ (emphasis ours) SIXTH: WE HAVE NO KNOWLEDGE OF THIS. However, Lic. Boris Gamboa Valladares, Head of the Community Aqueducts Regional Office (ORAC), Brunca Region, states in memorandum No. GSD-UEN-GAR-2026-03631, dated 11 August 2026: ‘SIXTH: WE HAVE NO KNOWLEDGE OF THIS, HOWEVER: At a meeting with the Board of Directors of ASADA IDA Cañablancal held on 12 May 2026 (see Log 12- 05-26 IDACANABLANCAL), it was agreed to carry out a water balance of the system administered by the ASADA. Report GSD-UEN-GAR-2026-02854 indeed indicates the existence of a water deficit, as mentioned in the response to Fact One.
ORAC Brunca currently has no pending matter involving the complainants [understood to mean the applicants] or ASADA.’ SEVENTH: THIS IS NOT A FACT. It is the applicants’ personal assessment, so we will not comment on it.
LEGAL GROUNDS
1. The provision of public services. Limits and restrictions. This Constitutional Court has addressed this matter and concluded that there are valid reasons for denying service, one of which is the absence of infrastructure belonging to the operator (AyA or an ASADA with a delegation agreement). In this regard, the Constitutional Chamber stated:
Page 5 of 9 “In this way, the fundamental-right status of this right does not imply unrestricted access to water services, since the administration may validly establish general requirements that each applicant must meet in order to assess the individual request. Accordingly, the possibility is recognized of limiting the granting of new water connections in order to ensure the continuity of the public potable water supply service to current users and homes receiving that service—see judgments Nos. 2007-17475, at eleven hours and five minutes on 30 November 2007, and 2008 - 11390, at eleven hours and twenty-nine minutes on 22 July 2008. In this regard, in judgment No. 2006-1898, at nine hours and fifty-three minutes on 17 February 2006—reiterated, among others, in judgment No. 2007-13310, at ten hours and fifty-seven minutes on 14 September 2007—the Chamber held:
‘The applicant alleges (…) that, despite the requests and efforts made, the respondent Institute has refused to provide them with potable water service on the grounds that they live in an informal settlement and its residents do not have a subdivision plan establishing that they own the properties. In this regard, the record establishes, based on the report submitted under oath by the respondent authority, that it is impossible to install household potable water services in the community where the applicant lives for two specific reasons: the lack of adequate infrastructure and the failure of interested parties to submit applications that meet legal requirements (...). In judgment No. 2004-12185 of 29 October 2004, at 13:31, this Chamber stated, in a similar case, that it was not possible to require the Instituto Costarricense de Acueductos y Alcantarillados to disregard the provisions of its Regulation for the Provision of Services to Customers or the General Law on Potable Water.
Accordingly, so long as the person protected by the amparo does not meet the conditions and requirements established therein, although potable water service must be available to everyone because it is an essential service, it cannot be provided to that person on a regular basis. Given the existence of these two objective reasons why regular potable water service cannot be supplied to the applicant—failure to meet the requirements for a new service connection, beginning with submission of the application, and the existence of adequate infrastructure in the area—there is no reason to conclude that the respondent Institute’s denial of regular service was because the person protected by the amparo and the neighbors lacked title to the properties they occupy. It should also be added that, under article 33 of the cited Regulation, lack of title does not appear to be an obstacle to requesting a new potable water connection, provided the requirements stated in that provision are met.
In any event, the record also establishes that, although regular potable water service has not been provided, the applicant and other neighbors have access to a public water source installed by the Institute for their basic needs. Accordingly, this Court considers that it was the applicant’s own omission, along with that of the local residents, in failing to establish that they had submitted applications to install new potable water service in the community where they live, that prevented their circumstances from being assessed to determine whether, upon meeting—above all—the requirements of article 33 of the Regulation for the Provision of Services to Customers, the infrastructure limitations could be overcome in their case and regular potable water service provided.’ It is therefore understood that, although there is a fundamental right to water that may be asserted against the relevant administration, service provision may be made subject to meeting the requirements established for its grant and to the material possibility of supply.
That is, there must be no technical circumstances that make it impossible or inadvisable for the administration to provide potable water service. Where technical reasons advise against or prevent it, the administration has no obligation to provide potable water service and must properly inform the applicant of the reasons the request cannot be granted.” Vote No. 2009-009936. (emphasis ours) In this regard, it is important to state that the aqueduct system of ASADA IDA Cañablancal was analyzed by the ORAC Brunca Engineering Technical Area. On this matter, Ing. Allan Andrey Rojas Castro, Rural Aqueducts Management Unit, stated in Official Letter No. GSD-UEN-GAR-2026-02854, dated 25 June 2026: “This report presents the water balance of the Asentamiento IDA Cañablancal aqueduct in Palmar de Osa, in response to the assignment made through memorandum GSD-UEN-GAR-2026-02602. It analyzes water quality, water capacity, and storage capacity. …
I.- Executive Summary … This report assesses the aqueduct’s water and storage balance based on a projection of demand growth over a 20-year period, which is compared with the installed water and storage capacity. The need for a water balance arises from the rationing of water service that the ASADA has been forced to carry out because of the rapid growth in users and the flow deficit. Available historical data indicate that, on average, the number of users grew at an annual rate of 4.25% from 2019 through 2025, with an acceleration between 2025 and 2026, when the number of users grew by 12,79%. … III.- Analysis Page 7 of 9
Lastly, it is important to reiterate that, according to Lic. Boris Gamboa Valladares, Head of the Community Aqueducts Regional Office (ORAC), Brunca Region, in memorandum No. GSD-UEN-GAR-2026-03631, dated 11 August 2026, ORAC Brunca currently has no pending matter to address involving either the applicants or ASADA IDA Cañablancal.”
“FIRST. The background is that the Municipalidad de Osa was joined to the present constitutional proceeding in connection with events relating to the lack of access to potable water service for the property identified in cadastral survey plan P- 1357570-2009. In this regard, it is necessary to clarify that the Municipalidad de Osa does not provide, administer, or operate the potable water supply service for the property at issue in the application, nor is it responsible for operating, maintaining, or connecting the relevant aqueduct. The municipality’s involvement was limited to exercising its powers in urban planning and construction, particularly with respect to land-use procedures and the corresponding construction permit. Accordingly, any analysis of possible municipal responsibility must be based on the actions that actually fell within this Administration’s responsibilities, and not on those belonging to the entity responsible for providing and administering potable water service.
SECOND. According to information supplied by the Urban Development and Services Directorate, construction permit No. PC-511-02-10-2024 was processed for property No. 6-170304-000, cadastral survey plan P-1357570-2009, for construction of an approximately 42-square-meter housing-bonus home. The application was made in the name of Ms. [Nombre 002], the registered owner of the property. The project documents also show that Mr. [Nombre 001] is listed as the beneficiary of the social-interest housing and had the owner’s authorization to carry out the relevant procedure. The municipal records also include land-use opinions CUS-2050-2022 and CUS-0485-2024 for the property identified by survey plan P-1357570-2009. Those records determined that the proposed project was compliant and could proceed, subject to applicable conditions, requirements, and provisions. It must be clarified that land-use opinions are not themselves construction permits and do not replace the other requirements for carrying out a work.
THIRD. Regarding water availability, it is important to state that the project documents include Official Letter ASADA-IDA-CB-07-2024, dated 30 April 2024, issued by the Asociación Administradora del Acueducto y Alcantarillado Sanitario del Asentamiento IDA Caña Blancal and addressed to Ms. [Nombre 002]. In that document, the ASADA itself stated that it had water available for domestic use for the property identified by survey plan P-1357570-2009. It also stated that the requirements established in the Instituto Costarricense de Acueductos y Alcantarillados regulations had to be met to request a water connection. This background is particularly relevant because it establishes that the Municipalidad did not determine or certify the property’s water availability; that information came from the aqueduct’s administering entity. Consequently, in the construction procedure, the Municipalidad relied on documentation issued by the entity competent for the water service.
FOURTH. Within its territorial jurisdiction, the Municipalidad de Osa exercises the powers assigned to it by the legal system concerning planning, urban control, and construction authorization. Article 15 of the Urban Planning Law recognizes municipal governments’ authority and competence to plan and control urban development within their respective territories. Article 74 of the Construction Law also provides that all construction work must be carried out under a license from the relevant municipality. In addition, section 117 of the Construction Regulations establishes water-service availability as a requirement for buildings and allows that availability to be established through documentation issued by AyA, the operator responsible for providing the service, or an ASADA, as applicable. In this case, as part of the construction procedure, the Municipalidad verified the relevant documentation issued by the ASADA.
It was therefore not for the Municipalidad to replace the aqueduct operator’s technical judgment, determine the water infrastructure’s capacity on its own, or assume the operator’s service-provision functions. Accordingly, the construction permit is an administrative authorization issued in the exercise of urban-planning and construction powers. Granting it does not make the Municipalidad the provider of potable water service, nor does it itself guarantee that the aqueduct operator will carry out the actual connection. These are distinct areas of responsibility: administrative authorization to carry out a work is one thing, and actual provision of the public services required for that work to function is another.
FIFTH. According to the facts set out in the decision by which that Chamber gave notice to this Municipalidad, the applicant subsequently sought a potable water connection from the ASADA. It is also stated that the ASADA carried out a technical inspection on 18 January 2025 and determined that the existing pipe beneath the pavement was half an inch in diameter, which, according to the information provided, prevented installation of a new water connection. The decision also states that this information was sent to the Instituto Costarricense de Acueductos y Alcantarillados, Pérez Zeledón office. It is therefore important to establish that the described facts relate to circumstances arising after the construction procedure, and particularly to the technical conditions of the aqueduct infrastructure and the possibility of making the connection. These records do not show that the Municipalidad participated in determining the infrastructure’s condition or prevented, ordered, or conditioned the service connection.
SIXTH. The right of access to potable water has constitutional recognition, and its protection is the responsibility of the institutions with authority over service provision under the legal system. Potable water supply is governed by a specific institutional framework in which the Instituto Costarricense de Acueductos y Alcantarillados (AyA) exercises oversight functions and ASADAS may provide service within the scope of the relevant delegation. In that framework, actions relating to aqueduct operations, infrastructure maintenance, determination of the technical conditions for connections, and actual service provision must be assessed with respect to the entities having substantive authority over those activities. Since the Municipalidad de Osa does not administer the aqueduct at issue in this proceeding and has no authority to replace the ASADA in operating the system or unilaterally order a connection, requiring the Municipalidad to directly resolve a problem belonging to the aqueduct’s infrastructure or operation would assign it a power that the legal system has not conferred on it.”
Drafted by Justice Cruz Castro; and, Reasons:
The applicant states that, on 30 April 2024, ASADA IDA Caña Blanca issued official letter No. ASADA-IDA-CB-07-2024, indicating that water was available for domestic use for the property identified by cadastral plan P-1357570-2009, and noting only that the application for a service connection had to meet the requirements established by the applicable regulations. The applicant states that, relying on that certification and having met the relevant requirements, they took the necessary steps to build a home through a housing subsidy, submitted the required documentation, and completed construction of the property, with only the installation of the drinking water service remaining. The applicant indicates that, later, following a change in the membership of the ASADA Board of Directors, they again sought a water connection, informing the entity that a service connection had been provided for on the property and requesting the corresponding inspection to determine its location and whether it could be used.
The applicant reports that, at a Board of Directors meeting held on 15 January 2025, it was agreed that a technical inspection would be carried out to assess the condition of the existing infrastructure and consider possible solutions to ensure access to the service. The applicant adds that the inspection was carried out on 18 January 2025, and it was determined that the existing pipe beneath the pavement was one-half inch in diameter, which, as indicated, prevented installation of a new water connection. The applicant further states that this information was sent to the Instituto Costarricense de Acueductos y Alcantarillados (AyA), Pérez Zeledón office. Nevertheless, the applicant maintains that, despite the time elapsed, the many steps taken, and the prior certification recognizing water availability for domestic use, the competent authorities have neither adopted an effective solution nor proceeded with installation of the drinking water service.
In this context, the applicant considers that the lack of access to drinking water seriously affects their living conditions and violates their fundamental rights by preventing them from fully enjoying a home that has already been built and for which the relevant authorizations had been obtained.
The following facts are deemed established as relevant to resolving this amparo application:
The Chamber’s case law has repeatedly recognized the so-called fundamental right to water, under which everyone must be afforded the possibility of equal access to drinking water services, since water is essential to human life and health. However, the fundamental nature of this right does not entail unrestricted access to water services, because the administration may validly establish general requirements that each applicant must meet so that their specific request can be assessed. Thus, in judgment No. 2006-1898, issued at 9:53 a.m. on 17 February 2006—and reiterated, among others, in judgments Nos. 2007-13310, issued at 10:57 a.m. on 14 September 2007, and 2008-16311, issued at 5:30 p.m. on 30 October 2008—the Chamber held that:
“The applicant alleges (…) that, despite their requests and efforts, the respondent Institute has refused to provide them with drinking water, arguing that the settlement is an informal settlement and its residents do not have a subdivision plan establishing that they own the properties. In this regard, the record establishes, on the basis of the report submitted under oath by the respondent authority, that there are two specific reasons why household drinking water services cannot be installed in the community where the applicant lives: the lack of adequate infrastructure and the failure of interested parties to submit applications that meet the legal requirements (...). In judgment No. 2004-12185, issued at 13:31 on 29 October 2004, this Chamber addressed a case similar to the present one and held that the Instituto Costarricense de Acueductos y Alcantarillados could not be compelled to disregard the provisions of its Regulations on the Provision of Services to Customers or the General Drinking Water Law.
Accordingly, so long as the person seeking amparo does not meet the conditions and requirements set out therein, although drinking water must be accessible to everyone because it is an essential service, it cannot be provided to that person on a regular basis. Given the existence of those two objective reasons why a regular drinking water service cannot be provided to the applicant—their failure to meet the requirements for a new service connection, beginning with submission of the application, and the lack of adequate infrastructure in the area—there is no basis for concluding that the respondent Institute denied the regular service because the person seeking amparo and their neighbors lack title to the properties they occupy. It should also be added that, under Article 33 of the aforementioned Regulations, lack of title to a property does not appear to prevent someone from applying for a new drinking water connection, provided that the requirements set out in that provision are met.
In any event, the record also establishes that, although a regular drinking water service has not been provided, the applicant and the other neighbors have access to a public water source installed by the Institute to supply their basic needs. Accordingly, this Court considers that it was the applicant’s and the locality’s residents’ own omission—their failure to establish that they had applied for installation of a new drinking water service in their community—that prevented their situation from being assessed to determine whether, especially upon meeting the requirements of Article 33 of the Regulations on the Provision of Services to Customers, the infrastructure limitations could be overcome in their case and a regular drinking water service provided to them.” It follows that, although there is a fundamental right to water that may be asserted against the relevant administration, provision of the service may be conditioned on meeting the requirements established for its grant and on the material possibility of supplying it.
That is, there must be no technical circumstances that make it impossible or inadvisable for the administration to provide drinking water. Where technical reasons make provision inadvisable or impossible, the administration has no obligation to provide the drinking water service, but it must adequately inform the applicant of the reasons why the request cannot be granted” (see judgment No. 2018-8650, issued at 09:15 on 1 June 2018; No. 2018-7369, issued at 9:45 a.m. on 11 May 2018; and No. 2016-18026, issued at 9:05 a.m. on 7 December 2016).
In resolution No. 2018-002910, issued at 09:15 on 23 February 2018, this Chamber stated as follows:
“IV.- On this principle, it was previously assumed axiomatically that any unlawful act conferring a benefit could invariably be set aside by the administration in any situation, without regard to any particular circumstances. However, since the mid-1950s, both legal scholarship and case law began to recognize that blind and rigid application of that rule seriously undermined the trust that members of the public had placed in the administration, as well as good faith and legal certainty. Thus, in its judgment of 14 May 1956, the Administrative Litigation Court of Berlin developed the principle of legitimate expectation, which was later adopted by the Court of Justice of the European Community in its decisions of 22 March 1961 and 13 July 1965 (Lemmerz-Werk). The principle essentially supports citizens’ trust in the administration by recognizing that, in certain circumstances of a particular case, equity and good faith prevent the administration from taking measures contrary to the expectation created by the reasonable stability of its decisions, on the basis of which individuals have taken certain steps.
By way of example, in our continent, the Constitutional Court of Colombia stated in Judgment T-308/11 of 28 April 2011: ‘The principle of legitimate expectation seeks to create an environment of trust in the relationships that individuals build with public authorities or private parties, so that they may reasonably expect in good faith that their conduct will not be abruptly altered unless a constitutionally legitimate purpose takes precedence. Legal scholars have argued that legitimate expectation means that certain expectations one legal subject creates in another through specific conduct produce consistent results in an environment of trust that can be broken only to give way to the public interest. In relations between the administration and members of the public, legal scholars have defined legitimate expectation as an ethical value that forms part of good faith and encompasses “the need for loyal, honest conduct, conduct that, in people’s estimation, may be expected of a person.” (…) “Applying the principle of good faith will allow the member of the public to regain trust that the administration will not demand more than is strictly necessary to achieve the public purposes pursued in each specific case.
Nor will it demand it at a time or in a manner that is most inappropriate in light of that person’s personal and social circumstances and the public needs themselves.” Accordingly, legitimate expectation is to be understood as the certain expectation that a legal or factual situation handled in a particular way in the past will not be treated in an extremely unequal manner in another period, unless a constitutionally acceptable reason legitimizes the change. In this regard, this Court has held that “a member of the public does not hold an acquired right, but merely has an expectation that a particular factual situation or legal regulation will not be changed unexpectedly; consequently, their legal situation may be changed by the administration. As an element incorporated into good faith, legitimate expectation may be reflected in the expectation that specific regulatory conditions governing a situation will continue, or that more onerous requirements than those already imposed to achieve a purpose will not be applied, unless constitutionally valid reasons exist for doing so.” Indeed, the ratio iuris of the principle protecting legitimate expectation is that the development of legal relationships requires an environment of trust in which the rules of the game, once established, are respected.
This is especially relevant in relations with the administration, since the instrument governing those relations is the administrative act, which is simply a unilateral manifestation of the State’s will. Therefore, citizens need legal instruments to defend themselves against the administration’s unilateral power and superiority (see Judgment No. 2016-008000, issued at 11:52 a.m. on 10 June 2016).”
In resolving the present case, it is very important to take into account what this Constitutional Chamber held in judgment No. 2024010181, issued at 9:20 a.m. on 19 April 2024, which stated:
“III.- ON THE MERITS. After analyzing the evidence submitted and the report made under oath by the respondent authority, with due warning of the consequences provided for in Article 44 of the Constitutional Jurisdiction Act, this Court finds it established that the applicant owns property located in San Ramón de Alajuela, specifically in Piedades Norte, registered under real folio No. 571180-000. It may be inferred that on 26 March 2022 the applicant submitted to the respondent authority an application for drinking water for an undeveloped property designated for agricultural use, access to which is via an agricultural easement located as far as 159.09 meters from a public road; application No. SIGDD-2022-00006761. However, the preliminary review of application No. SIGDD-2022-00006761-1-AP determined that it would not be appropriate for the Institute to approve the request for availability of drinking water and sanitary sewer service for the proposed project because the technical feasibility required to approve availability requests in the CO-A-35-San Ramón system was lacking.
The technical feasibility determination was based on Drinking Water Feasibility Inspection SIGDD-2022-00006761-1-1-1, submitted by the Technical Operations and Maintenance Chief of the San Ramón Cantonal Water System, Central West Region, which states: ‘There is no distribution and collection infrastructure in front of the property, according to the technical opinion.’ The foregoing was notified to the applicant by means of a NO AVAILABILITY Certificate resolution dated 04 August 2022. In the circumstances described, the person seeking protection filed a motion for reconsideration and, in the alternative, an appeal against the ICAA’s decision. However, by resolution issued at 7:00 a.m. on 12 twelve August 2022, the motion for reconsideration was denied. Likewise, by resolution GG-R-2022-0727, issued at 10:00 a.m. on 21 September 2022, the appeal was dismissed.
“It was established that on 21 September 2022 the applicant submitted a new application for drinking water, No. SIGDD-2022-00020625, to the respondent authority. In this regard, it was established that the ICAA issued official letter No. SIGDD2022-0000625-1-1-1 on 16 November 2023, stating: ‘DRINKING WATER IS AVAILABLE ON THE PUBLIC ROAD; THERE IS NO SANITARY SEWER SYSTEM AVAILABLE.’ The interested party was notified of this by official letter dated 16 November 2023, which stated: ‘In response to the availability request, please find attached the Certificate of Positive Drinking Water Availability and Negative Sanitary Sewer Availability No. 2022-00020625-1, which, in summary, states the following: The Sanitary Sewer network is not operating in the area.’ It is established that on 07 February 2024 the applicant applied for a new drinking water service, No. P21112024020005. However, upon receiving the application, the cantonal office noticed an error and proceeded to investigate, taking into account the previous evidence and again assessing whether the conditions underlying the application had in fact changed, as well as the conditions that had led to denial of Availability application SIGDD-2022-00006761-1-1-1.
Finally, it was confirmed that, in official letter No. SG-GSP-RC-2024-00132 of 05 March 2024, the respondent authority notified the interested party that it could not process the application for new service No. P21112024020005. In substance, it stated: ‘On 07 February 2024, application 21112024020005 was issued in the name of [Nombre 001], identity card [Valor 001], for a housing construction project, in response to an application for a new drinking water service connection. The service would be located on property registered under real folio 2-571180-000, whose designated use is PASTURE LAND, with access via an agricultural easement located in Piedades Norte District, San Ramón Canton, Alajuela Province, according to Cadastral Plan No. A-2032273-2018, at an address 115 meters NW and 260 meters W of the Cabinas del Bosque Lodge (…) according to a search of the National Property Registry, the distance from the public road to the property via the agricultural easement is approximately 190 meters (…) To provide services within the easement, it must be registered in favor of AYA, and the above criteria must also be met.
In conclusion, in these circumstances the Institution is unable to grant the request. The documents in the administrative case file are conclusive in this regard; it would be improper for the Institution to grant a new service in violation of the Principle of Legality and of the science and technical standards referred to in Articles 11 and 16 of the General Law on Public Administration. AyA must therefore comply with the regulations governing it; otherwise it would violate the legal system (…) Finally, as established, application for new service No. P21112024020005 cannot be processed.’ “This Chamber, in judgment No. 2012-016181, issued at 9:05 a.m. on 27 November 2012 and reiterated in judgment No. 2015002749, issued at 09:05 a.m. on 27 February 2015, ruled as follows when addressing a matter similar to this case:
“V.- THE SPECIFIC CASE. It is established that the person seeking amparo had been granted an initial availability letter, issued on 24 October 2011 for the purpose of processing approval of cadastral plan No. SJ-919550-0. That document was valid for no more than six months and expired in April 2012. On the basis of that document, among other permits and authorizations, the applicant built her home and asked the respondent Association to issue an availability letter so that drinking water service could be provided to the property. However, this was denied because, according to the latest flow measurement conducted by personnel of the Instituto de Acueductos y Alcantarillados, the captured springs were insufficient to supply the current population—a view recorded in memorandum No. SUB-G-GSC-UEN-AP-EBD-2012-686 of 25 May 2012. The person seeking protection was informed of that situation. In light of these facts, this Court considers that the principle of legitimate expectation was violated to the detriment of the person seeking protection.
Indeed, although the first availability letter was issued in 2011, the person seeking protection legitimately relied on the respondent Association—which, as stated above, exercises public powers—and built her home, at considerable expense, expecting that she would be supplied with drinking water. Certainly, under Article 21(19) of the Regulations on Community Aqueduct and Sewer System Administrators’ Associations, Executive Decree No. 32529, ASADAS may issue a water availability seal—valid for 6 months for single-family homes and one year for other developments, renewable—‘provided that technical feasibility exists, the quality of service provided is not adversely affected, and infrastructure exists’ (emphasis added). Nevertheless, consistent with the principles of legitimate expectation and good faith, the respondent Association must be advised that before issuing a drinking water availability letter, the necessary measurements must be taken to verify whether water is available, thus avoiding causing members of the public to incur substantial and futile expense if, after their homes or buildings are constructed, they cannot be supplied with drinking water.
“VI.- CONCLUSION. As a result of the foregoing, the application must be granted, with the consequences set out in the operative part of this judgment.” In the present case, the established facts show that by official letter No. SIGDD2022-0000625-1-1-1 of 16 November 2023, the ICAA issued a certificate of positive drinking water availability for the property registered under real folio No. 571180-000, located in San Ramón de Alajuela, specifically in Piedades Norte, in the applicant’s name, under the following conditions: “DRINKING WATER IS AVAILABLE ON THE PUBLIC ROAD; THERE IS NO SANITARY SEWER SYSTEM AVAILABLE.” This was notified to the person seeking amparo by official letter of 16 November 2023 in the following terms: “In response to the availability request, please find attached the Certificate of Positive Drinking Water Availability and Negative Sanitary Sewer Availability No. 2022-00020625-1, which, in summary, states the following: The Sanitary Sewer network is not operating in the area.” On the basis of that document, among other permits and authorizations, such as land-use approval and building permit No. PC-079-2024 issued by the Municipality of San Ramón, the person seeking protection began construction of her home.
Subsequently, on 07 February 2024, she applied to the respondent institution for a new drinking water service, No. P21112024020005. However, this was denied by official letter No. SG-GSP-RC-2024-00132 of 05 March 2024 because of a technical impossibility: it was determined that no sanitary sewer system was available along the property boundary. In this case, in this Court’s view, the ICAA violated the principle of legitimate expectation to the detriment of the person seeking amparo. In that regard, the applicant’s own statements show that she legitimately relied on the respondent authority and built her home, at considerable expense, expecting that she would be supplied with drinking water. Nevertheless, nearly three months after official letter No. SIGDD2022-0000625-1-1-1 of 16 November 2023 was issued, her application for a new service was denied. For the foregoing reasons, it is considered that the person seeking protection’s principle of legal certainty and right to prompt and effective justice were also violated.
Note that an application for drinking water entails an administrative procedure that the respondent Institute must assess and decide. In this case, it is clear that the respondent issued a positive drinking water availability determination, but later denied the application for a new drinking water service because of an error. In this regard, it is necessary to mention the following statement by the ICAA in its report: “On 21 September 2022, the availability request was submitted again, as shown on pages 62 and 63 of the administrative case file, with the decision on pages 68 and 69. The new application was opened under number SIGDD-2022-00020625. On this occasion, we were informed that the cantonal office had received assistance in deciding availability requests, and the assisting office issued a positive decision without taking into account that the easement was agricultural and all that this case entails.
The circumstances that had existed since the prior decision had not changed. That positive availability decision took effect on 16 November 2023. Since this latest decision fell outside the remit of the San Ramón cantonal office, it was decided by other collaborating offices outside the Central Region Directorate and issued directly and positively to the user, as an incorrect decision, because the initial circumstances had not changed: access via the agricultural easement remained the same, and as of the date of this report, there is no evidence that infrastructure was installed pursuant to any additional application or Water Capacity letter authorizing it.” It adds: “When the cantonal office received this application, it noticed the error and investigated, taking into account the prior evidence and reassessing whether the circumstances of the application had in fact changed, and the circumstances that had led to denial of Availability application SIGDD-2022-00006761-1-1-1.
For that reason, Ms. [Nombre 001] was sent document SG-GSP-RC-2024-00132 on 05 March, explaining why the application for a new service could not be processed.” This Chamber has addressed access to drinking water as a service that also enables the realization and protection of other fundamental rights, such as quality of life and health (see, in a similar vein, judgment No. 2017002404, issued at 09:45 on 17 February 2017). It has also recognized that where technical reasons make the supply of drinking water absolutely impossible, no fundamental right is violated (see, in a similar vein, judgment No. 07779-2019, issued at 09:15 on 03 May 2019, among others). In this case, before the ICAA mistakenly issued the certificate of positive drinking water availability, it had already determined that it would not be appropriate to approve the application for availability of drinking water and sanitary sewer service because the technical feasibility required to approve availability applications in the CO-A-35-San Ramón system was lacking.
From this perspective, although it is important to note that this Court lacks jurisdiction to determine whether the water availability sought by the applicant should be granted, since that depends on technical criteria issued by the ICAA authorities, the institution empowered to carry out such acts under its regulations, in the present case the principle of legitimate expectation, the principle of legal certainty, and the person seeking amparo’s right to prompt and effective justice are found to have been violated. Accordingly, the application must be granted, with the consequences set out in the operative part. (…)
The report submitted under oath by the respondent authority, with even the criminal consequences provided for in Article 44 of the Constitutional Jurisdiction Act, establishes a violation of the applicant’s fundamental rights, for the reasons set out below. In this regard, it is established that, in official letter ASADA-IDA-CB-07-2024 of 30 April 2024, the representative of Asada IDA Cañal Blanca informed the applicant, in response to the request submitted, that the community Asada did have water available for domestic use for cadastral plan P-1357570-2009. To apply for a service connection, the requirements of the AyA regulations had to be met. It is also established that, with respect to property No. 6-170304-000, cadastral plan P-1357570-2009, the Municipality of Osa processed and approved building permit No. PC-511-02-10-2024 for construction of a housing-subsidy home of approximately 42 square meters.
The application was made in the name of Ms. [Nombre 002], the registered owner of the property. The project documents also show that Mr. [Nombre 001] is listed as the beneficiary of the social-interest housing and had the owner’s authorization to complete the relevant process. The municipal records also include land-use opinions CUS-2050-2022 and CUS-0485-2024 for the property identified by cadastral plan P-1357570-2009. Those records determined that the proposed project complied with the requirements and could proceed. Regarding water availability, it is important to note that the project documents include official letter ASADA-IDA-CB-07-2024, dated 30 April 2024, issued by the Asociación Administradora del Acueducto y Alcantarillado Sanitario del Asentamiento IDA Caña Blancal and addressed to Ms. [Nombre 002]. In that document, the ASADA itself stated that water was available for domestic use for the property identified by cadastral plan P-1357570-2009.
It also stated that applications for a service connection had to meet the requirements established in the regulations of the Instituto Costarricense de Acueductos y Alcantarillados. Subsequently, on 15 January 2025, the applicant requested that the respondent Asada install the water service. In addition, on 18 January 2025, personnel of the respondent Asada conducted an inspection and determined that the pipe running beneath the street pavement was one-half inch in diameter, making a water connection impossible. The applicant was informed of this by official letter ASADA-IDA-CB-026-2025 dated 27 January 2025. Note that, in this case, official letter ASADA-IDA-CB-07-2024 dated 30 April 2024, issued by the Asociación Administradora del Acueducto y Alcantarillado Sanitario del Asentamiento IDA Caña Blancal, informed the applicant that water was available for domestic use for the property identified by cadastral plan P-1357570-2009.
In view of the foregoing and the case law cited above, the respondent Asada’s refusal to interconnect the water service to the property in question, on which a home was built after the relevant permits had been issued by the Municipality of Osa, violates the human right to water and the principles of legitimate expectation and legal certainty to the detriment of the applicant. The application is denied as to the Municipality of Osa and the Instituto Costarricense de Acueductos y Alcantarillados, because they did not violate any fundamental right of the applicant. Accordingly, this amparo application must be granted on the terms set out in the operative part of this decision.
The parties are advised that any paper documents, objects, or evidence submitted on an additional electronic, computing, magnetic, optical, or telematic device, or produced using new technologies, must be collected from the Court office within a maximum of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 on 26 January 2012, and in the resolution approved by the Judicial Council at session No. 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:
The amparo application is partially granted. Juana Solís Mora, in her capacity as President of the Asociación Acueducto y Alcantarillado Sanitario del Asentamiento Ida Caña Blanca, or whoever holds that office, is ordered to issue the appropriate instructions and make the necessary arrangements within the scope of her authority so that, within a maximum period of ONE MONTH from notification of this decision, she implements the measures required to provide drinking water service to the applicant’s property, as required by law. The respondent authority is warned that, under Article 71 of the Constitutional Jurisdiction Act, anyone who receives an order that they must carry out or cause to be carried out, issued in an amparo proceeding, and fails to carry it out or cause it to be carried out, shall be sentenced to imprisonment for three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Asociación Acueducto y Alcantarillado Sanitario del Asentamiento Ida Caña Blanca is ordered to pay the costs, damages, and losses caused by the acts underlying this declaration, to be quantified in enforcement proceedings before the administrative-litigation jurisdiction. The application is denied as to the other respondent authorities. Notify the parties.

033809-26. SERVICIOS PÚBLICOS. SE RECLAMA QUE LA ASADA IDA CAÑA BLANCA SE NEGÓ A CONECTAR EL SERVICIO A UNA VIVIENDA DE INTERÉS SOCIAL, PESE A HABER CERTIFICADO PREVIAMENTE LA DISPONIBILIDAD HÍDRICA QUE PERMITIÓ TRAMITAR EL BONO Y CONSTRUIR EL INMUEBLE. LA NEGATIVA POSTERIOR, FUNDADA EN LIMITACIONES DE LA TUBERÍA QUE DEBIERON VALORARSE ANTES DE EMITIR LA CERTIFICACIÓN, LESIONÓ EL DERECHO AL AGUA Y LOS PRINCIPIOS DE CONFIANZA LEGÍTIMA Y SEGURIDAD JURÍDICA. SE DECLARA PARCIALMENTE CON LUGAR Y SE ORDENA DOTAR LA PROPIEDAD DE AGUA POTABLE EN UN MES. VCG09/2026 “(…) III.- SOBRE EL DERECHO AL AGUA Y LOS REQUISITOS EXIGIBLES EN LA SOLICITUD DE SERVICIOS DE AGUA. La jurisprudencia de la Sala es reiterada en reconocer el denominado derecho fundamental al agua, por el cual debe concederse a todas las personas la posibilidad de acceder en condiciones de igualdad a los servicios de agua potable, toda vez que la misma resulta esencial para la vida y la salud humanas.
No obstante, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración válidamente puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento. Así, en sentencia número 2006-1898, de las nueve horas cincuenta y tres minutos del 17 de febrero de 2006 – reiterada, entre otras, por sentencias números 2007-13310, de las diez horas cincuenta y siete minutos del 14 de setiembre de 2007, y 2008- 16311, de las diecisiete horas treinta minutos del 30 de octubre de 2008- estableció la Sala que:
“El recurrente alega (…) que pese a las solicitudes y esfuerzos hechos, el Instituto recurrido se ha negado a brindarles el servicio de agua potable aduciendo que se trata de un precario y que sus habitantes no cuentan con un plano de segregación que establezca que son propietarios de los inmuebles. Al respecto, se encuentra acreditado en autos, con base en el informe rendido bajo juramento por la autoridad recurrida, que existe una imposibilidad para instalar servicios de agua potable domiciliaria en la comunidad que habita el recurrente por dos motivos específicos: la falta de una infraestructura adecuada y de presentación de solicitudes con cumplimiento de requisitos legales por parte de los interesados (...). Esta Sala, en la sentencia No. 2004- 12185 de las 13:31 horas del 29 de octubre del 2004, en un caso similar al presente, señaló que no era posible obligar al Instituto Costarricense de Acueductos y Alcantarillados a eludir lo dispuesto en su Reglamento de Prestación de Servicios a los Clientes ni en la Ley General de Agua Potable.
De ahí que, en el tanto el amparado, no reúna las condiciones y requisitos ahí exigidos, aunque el servicio de agua potable debe estar al alcance de toda persona por tratarse de un servicio esencial, no se le puede proveer de manera regular. Dada la existencia de esos dos motivos objetivos por los cuales no es posible suministrar un servicio de agua potable regular al accionante: su falta de cumplimiento de requerimientos para la conexión de un servicio nuevo, empezando, por la presentación de la solicitud y la existencia de una infraestructura adecuada en la zona, no existe motivo alguno para entender que la denegatoria de la prestación del servicio regular por parte del Instituto recurrido se deba al hecho que el amparado y sus vecinos no cuentan con títulos de propiedad sobre los inmuebles que poseen. A lo anterior cabe agregar que con base en el artículo 33 del Reglamento referido, la falta de un título de propiedad no parece ser un obstáculo para solicitar la conexión de un servicio nuevo de agua potable, en tanto se cumplan los requerimientos que indica esa norma.
En todo caso, se encuentra acreditado también que aunque no se ha suministrado el servicio regular de agua potable, el recurrente y demás vecinos cuentan con fuente pública que el Instituto instaló para que puedan abastecerse, para sus necesidades básicas. De ahí que considere este Tribunal que ha sido la propia omisión del recurrente y de los vecinos de la localidad, quienes no acreditan haber presentado las solicitudes para la instalación de un servicio nuevo de agua potable en la comunidad donde habitan, la que ha impedido que se valore su situación a efectos de determinar si, cumpliendo, sobre todo los requerimientos del artículo 33 del Reglamento de Prestación de Servicios a los Clientes, las limitaciones de infraestructura pueden ser superadas en su caso y se les puede proveer de un servicio regular de agua potable.” Se entiende entonces, que si bien existe un derecho fundamental al agua que puede ser exigido a la administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen a la administración a brindar el servicio de agua potable, situación que determina que la administración carece de la obligación de prestar el servicio de agua potable en caso de existir razones técnicas que lo desaconsejen o imposibiliten, debiendo informar adecuadamente al gestionante las razones por las cuales no puede atenderse su solicitud» (véase sentencia N° 2018-8650 de las 09:15 hrs. del 1° de junio de 2018, 2018-7369 de las 9:45 horas de 11 de mayo de 2018 y la N° 2016-18026 de las 9:05 horas del 7 de diciembre de 2016).

En la resolución del presente caso, es de gran importancia tomar en cuenta lo resuelto por ésta Sala Constitucional en la sentencia nro. 2024010181 de las 9:20 horas del 19 de abril de 2024, donde se estableció:
“III.- SOBRE EL FONDO. Después de analizar los elementos probatorios aportados y el informe rendido bajo juramento por la autoridad recurrida, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, este Tribunal tiene por acreditado que la recurrente es dueña de un inmueble ubicado en San Ramón de Alajuela, propiamente en Piedades Norte, inscrita en el folio real No. 571180-000. Se colige que el 26 de marzo de 2022 la accionante presentó ante la autoridad recurrida una solicitud de agua potable para un inmueble sin construir de vocación agrícola cuyo acceso es mediante servidumbre de naturaleza agrícola que se ubica hasta calle púbica a 159.09 metros; solicitud No. SIGDD-2022-00006761. No obstante, del estudio básico de la solicitud No. SIGDD-2022-00006761-1-AP se determinó que no resultaba congruente para el instituto aprobar la solicitud de disponibilidad de agua potable y alcantarillado sanitario para el eventual proyecto debido a que no cuenta con factibilidad técnica requerida para la aprobación de las solicitudes de disponibilidad ubicadas en el sistema CO-A-35-San Ramón.
La factibilidad técnica se fundamentó en la Inspección de Factibilidad de Agua Potable SIGDD-2022-00006761-1-1-1 remitido por el Jefe técnico de Operación y Mant. Sist. de Agua Cantonal de San Ramón de la Región Central Oeste, donde se indica “Inexistencia de infraestructura de distribución y recolección frente al inmueble según criterio técnico”. Lo anterior fue notificado a la recurrente mediante resolución de Constancia de NO DISPONIBILIDAD del 04 de agosto del 2022. Ante el escenario descrito, se coteja que la tutelada interpuso un recurso de revocatoria y/o apelación en subsidio contra lo dispuesto por el ICAA; empero, mediante resolución de las 7: 00 horas del 12 doce de agosto del 2022 se declaró sin lugar el recurso de revocatoria. Asimismo, mediante resolución GG-R-2022-0727 de las 10:00 horas del 21 de septiembre del 2022 se rechazó el recurso de apelación.
Quedó demostrado que el 21 de setiembre de 2022 la accionante presentó ante la autoridad recurrida la nueva la solicitud de agua potable No. SIGDD- 2022-00020625. En ese sentido, se demostró que el ICAA generó el oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, en el cual indicó lo siguiente: "SI HAY DISPONIBILIDAD DE AGUA POTABLE EN LA VÍA PÚBLICA, NO HAY DISPONIBILIDAD DE SISTEMA DE ALCANTARILLADO”. Lo anterior fue notificado a la interesada en el oficio del 16 de noviembre de 2023 en las siguientes condiciones: “En atención a la solicitud de disponibilidad, me permito hacerle llegar adjunto la Constancia de Disponibilidad de Agua Potable Positivo y Alcantarillado Sanitario Negativo N°2022-00020625-1, el cuál en resumen señala lo siguiente: La red de Alcantarillado Sanitario no se encuentra en funcionamiento en la zona”. Se coteja que el 07 de febrero de 2024 la promovente gestionó la solicitud del nuevo servicio de agua potable No. P21112024020005, pero al recibir el trámite en cuestión la cantonal se percató de un error y procedió a realizar una investigación; ello, tomando en cuenta la evidencia pasada, valorando nuevamente sí la condición de la solicitud realmente había cambiado y las condiciones por la que fue negada la solicitud de Disponibilidad SIGDD-2022-00006761-1-1-1.
Finalmente, se confirmó que en oficio No. SG-GSP-RC-2024-00132 del 05 de marzo de 2024, la autoridad recurrida le notificó a la interesada que no podía dar trámite a la solicitud del nuevo servicio No. P21112024020005. En lo medular, se indicó: “En fecha 07 de febrero del 2024, se emite solicitud 21112024020005 a nombre de [Nombre 001], cédula de identidad [Valor 001], para el proyecto de Construcción de vivienda, ante la solicitud de conexión de nuevo servicio de agua potable, el cual se ubicaría en la propiedad, matrícula da folio real 2-571180-000, cuya naturaleza señala TERRENO DE POTRERO, acceso a través de servidumbre agrícola localizada en Distrito Piedades Norte, Cantón de San Ramón, Provincia de Alajuela, según Plano Catastrado No. A-2032273-2018, con dirección 115 metros al NW y 260 metros W de las Cabinas del Bosque Lodge (…) según consulta en el Registro Nacional de la propiedad, la distancia de la vía pública al terreno por la servidumbre agrícola es de 190 metros aproximado (…) Para prestar servicios a lo interno de la servidumbre debe inscribirla a favor de AYA, así como cumplir con los criterios antes señalados.
En conclusión, ante esta circunstancia la Institución se ve imposibilitada de otorgar lo pedido. Los documentos que contiene el expediente administrativo son concluyentes, en este sentido mal haría la Institución otorgando un nuevo servido, contraria al Principio de Legalidad, a la ciencia y la técnica que señalan los artículos 11 y 16 de la Ley General de la Administración Pública. Siendo entonces que AyA debe respetar la normativa que lo rige, en caso contrario estaría transgrediendo el ordenamiento jurídico (…) Finalmente, como se comprueba no se puede dar trámite a la solicitud de nuevo servicio No. P21112024020005”.
Esta Sala, mediante sentencia No. 2012-016181 de las 9:05 horas de 27 de noviembre de 2012, reiterado en la sentencia No. 2015002749 de las 09:05 horas del 27 de febrero de 2015, al conocer un asunto similar al de este expediente, se pronunció en los siguientes términos:
“V.- CASO CONCRETO. Queda acreditado que a la amparada se le había otorgado una primera carta de disponibilidad, extendida el 24 de octubre de 2011, a efecto de tramitar el visado del plano catastrado No. SJ-919550-0, documento que tenía de vigencia un plazo no mayor a seis meses que venció en abril de 2012. Con base en ese documento, entre otros permisos y autorizaciones, la recurrente construyó su vivienda y solicitó a la Asociación recurrida, que le extendiera la carta de disponibilidad para que se le otorgue el servicio de agua potable en el inmueble. No obstante, esto le fue rechazado pues, según el último aforo realizado por personeros del Instituto de Acueductos y Alcantarillados, las nacientes captadas son insuficientes para abastecer a la población actual —criterio recogido en el memorando No. SUB-G-GSC-UEN-AP-EBD-2012-686 de 25 de mayo de 2012—; situación que le fue comunicada a la tutelada.
Partiendo de este esquema fáctico, en criterio de este Tribunal, en el presente asunto se violentó el principio de confianza legítima en perjuicio de la amparada. En efecto, si bien, la primera carta de disponibilidad se le extendió en el 2011, la amparada confió legítimamente en la Asociación recurrida —la que, como se dijo supra, está ejerciendo potestades públicas— y construyó su casa de habitación, con el gasto importante de recursos que eso conlleva, con la expectativa que se le suministraría el servicio de agua potable. Ciertamente, conforme el artículo 21, inciso 19), del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No.32529, las ASADAS pueden otorgar el sello disponibilidad hídrica —con vigencia de 6 meses para viviendas unifamiliares y de un año para otros desarrollos, prorrogable— “siempre que exista viabilidad técnica, no vaya en detrimento de la calidad del servicio que se presta y exista infraestructura” (el énfasis es agregado).
No obstante, en concordancia con el principio de confianza legítima y de buena fe, debe advertirse a la Asociación recurrida que antes de emitir una carta de disponibilidad de agua potable, deben realizarse las mediciones necesarias para verificar si existe agua disponible y así evitar hacer incurrir a los administrados en fuertes e inútiles inversiones si después de construidas sus viviendas o edificaciones, no se les puede dotar de agua potable.
Como corolario de lo expuesto, se impone acoger el recurso planteado con las consecuencias que se detallan en la parte dispositiva de esta sentencia”.
En el sub lite del elenco de hechos probados se desprende que mediante oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023 el ICAA emitió la constancia de disponibilidad de agua potable positivo para la propiedad inscrita en el folio real No. 571180-000 localizada en San Ramón de Alajuela, propiamente en Piedades Norte a nombre de la recurrente, en las siguientes condiciones: "SI HAY DISPONIBILIDAD DE AGUA POTABLE EN LA VÍA PÚBLICA, NO HAY DISPONIBILIDAD DE SISTEMA DE ALCANTARILLADO”. Esto fue notificado a la parte amparada en oficio del 16 de noviembre de 2023 en las siguientes condiciones: “En atención a la solicitud de disponibilidad, me permito hacerle llegar adjunto la Constancia de Disponibilidad de Agua Potable Positivo y Alcantarillado Sanitario Negativo N°2022-00020625-1, el cuál en resumen señala lo siguiente: La red de Alcantarillado Sanitario no se encuentra en funcionamiento en la zona”.
Con base en ese documento, entre otros permisos y autorizaciones, tales como el uso de suelo y el permiso de construcción No. PC-079-2024 emitido por la Municipalidad de San Ramón, la tutelada inició el proceso de construcción de su vivienda. Posteriormente, sea el 07 de febrero de 2024, gestionó ante la institución accionada la solicitud del nuevo servicio de agua potable No. P21112024020005; empero, le fue rechazada mediante el oficio No. SG-GSP-RC-2024-00132 del 05 de marzo de 2024; esto, debido a la existencia de una imposibilidad técnica, pues se determinó que no existe frente al lindero del inmueble disponibilidad de sistema de alcantarillado. En la especie, en criterio de este Tribunal, en el caso de marras el ICAA violó el principio de confianza legítima en perjuicio de la parte amparada. En esa línea de ideas, adviértase que del propio dicho de la recurrente se determina que confió legítimamente en la autoridad recurrida y construyó su casa de habitación con el gasto importante de recursos que eso conlleva y con la expectativa que se le suministraría el servicio de agua potable.
No obstante, casi tres meses después de que se emitiera el oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, la solicitud de nuevo servicio le fue rechazada. Por lo expuesto, se considera que también lesionó el principio de seguridad jurídica de la tutelada, así como su derecho a obtener justicia pronta y cumplida. Nótese que la solicitud de agua potable conlleva un procedimiento administrativo, el cual debe ser analizado y resuelto por el instituto accionado. En este caso, resulta claro que la recurrida emitió la disponibilidad de agua potable positivo, pero luego denegó la solicitud del nuevo servicio de agua potable debido a un error. En ese sentido, es menester traer a colación lo subrayado por el ICAA en su informe, en lo conducente: “El 21 de setiembre de 2022, vuelve a presentar la solitud de disponibilidad como se demuestra en los folios 62 y 63 del expediente administrativo y su resolución en los folios del 68 al 69, la nueva gestión se inicia de nuevo con el numero SIGDD- 2022- 00020625, se informa, que, en esta ocasión, la oficina cantonal recibió colaboración para la resolución de disponibilidades en donde en esta ocasión resolvieran de manera positiva sin tomar en cuenta que la servidumbre era agrícola y todo lo que implica este caso.
Ya que hasta ese momento no había cambiado la situación que se presentaba desde la resolución anterior. Dicha resolución de disponibilidad positiva se hizo efectiva el 16 de noviembre del año 2023. Esta última resolución al quedar fuera de la gestión de la oficina cantonal de San Ramón, fue resulta por otras oficina colaboradoras fuera de la Dirección Región Central y se gestiona de forma positiva hacia el usuario directamente, con una resolución incorrecta, debido a que la condición inicial no tuvo ningún cambio y el acceso por servidumbre agrícola se mantuvo y a la fecha de este informe, no se evidencia colocación de infraestructura, por medio de alguna solicitud adicional o carta de Capacidad Hídrica que lo autorice”. Agrega: “La cantonal al recibir este trámite, se percata del error, y realiza la investigación, tomando en cuenta la evidencia pasada y valorando nuevamente, la condición de la solicitud si realmente había cambiado, las condiciones por la que fue negada la solicitud de Disponibilidad SIGDD-2022-00006761-1-1-1; Por tal motivo se responde a la señora [Nombre 001], con el documento SG-GSP-RC-2024-00132 el 05 de marzo, explicando los argumentos del porque no se puede dar trámite a la solicitud del nuevo servicio”.
Ahora, esta Sala se ha pronunciado sobre el acceso al agua potable como un servicio que permite, a su vez, la realización y garantía de otros derechos fundamentales como a la calidad de vida y la salud (véase en similar sentido la sentencia No. 2017002404 de las 09:45 horas del 17 de febrero de 2017) pero también ha reconocido que cuando existen razones técnicas que imposibiliten, de forma absoluta, el suministro de agua potable, no se presenta una lesión a un derecho fundamental (véase en similar sentido la sentencia No. 07779-2019 de las 09:15 horas del 03 de mayo de 2019, entre otras). En el caso de marras, previo a que el ICAA emitiera la constancia de disponibilidad de agua potable positivo por error, ya había determinado que no resultaba congruente aprobar la solicitud de disponibilidad de agua potable y alcantarillado sanitario debido a que no se cuenta con la factibilidad técnica requerida para la aprobación de las solicitudes de disponibilidad ubicadas en el sistema CO-A-35-San Ramón.
Bajo esta óptica, si bien es importante señalar que este Tribunal no cuenta con la competencia para determinar si procede o no otorgar la disponibilidad de agua que pretende la accionante, pues esto obedece a criterios técnicos emitidos por las autoridades del ICAA, institución con la potestad normativa para realizar tales actos, en el sub examine sí se estima violentado el principio de confianza legítima de la amparada, así como el principio de seguridad jurídica y su derecho a obtener justicia pronta y cumplida, por lo que se impone acoger el recurso con las consecuencias que se detallan en la parte dispositiva. Del informe rendido bajo juramento por la autoridad recurrida, con las consecuencias incluso penales que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una infracción a los derechos fundamentales de la parte recurrente, con fundamento en las consideraciones que a continuación se exponen. Al respecto, se acredita que en oficio ASADA-IDA-CB-07-2024 del 30 de abril de 2024, el representante de la Asada IDA Cañal Blanca le indicó a la recurrente que en respuesta a la solicitud enviada, la Asada de la comunidad si cuenta con disponibilidad hídrica para uso doméstico, para el plano P-1357570-2009. Para solicitud de prevista debe cumplir con los requisitos del reglamento AyA. Por otra parte, se constata que respecto de la finca N.° 6-170304-000, plano catastrado P-1357570-2009, se tramitó y aprobó por parte de la Municipalidad de Osa el permiso de construcción N.° PC-511-02-10-2024 para la construcción de una vivienda de bono de aproximadamente 42 metros cuadrados.
El trámite fue realizado a nombre de la señora [Nombre 002], propietaria registral del inmueble, asimismo, consta en la documentación del proyecto que el señor [Nombre 001] figura como beneficiario de la vivienda de interés social y que contaba con autorización de la propietaria para realizar el trámite correspondiente. En los registros municipales constan, además, los criterios de uso de suelo CUS-2050-2022 y CUS-0485-2024, correspondientes al inmueble identificado con el plano P-1357570-2009. En dichos antecedentes se determinó que el proyecto pretendido era conforme y podía desarrollarse. Con respecto a la Disponibilidad de Agua, es importante indicar que dentro de la documentación correspondiente al proyecto consta el oficio ASADA-IDA-CB-07-2024, de fecha 30 de abril de 2024, emitido por la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Asentamiento IDA Caña Blancal y dirigido a la señora [Nombre 002].
En dicho documento, la propia ASADA manifestó que contaba con disponibilidad hídrica para uso doméstico respecto del inmueble identificado con el plano P-1357570-2009. Asimismo, señaló que para solicitar la prevista debían cumplirse los requisitos establecidos en el reglamento del Instituto Costarricense de Acueductos y Alcantarillados. Posteriormente, el 15 de enero de 2025, la parte recurrente solicitó a la Asada recurrida la instalación del servicio de agua. Además, el 18 de enero de 2025, personal de la Asada recurrida realizó una inspección y determinó que la tubería que pasa por el pavimento de la calle es media pulgada, lo cual imposibilita la toma de agua. Lo anterior, le fue comunicado a la recurrente por oficio ASADA-IDA-CB-026-2025 del 27 de enero de 2025. Nótese que en el presente caso, en el oficio ASADA-IDA-CB-07-2024 de fecha 30 de abril de 2024 emitido por la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Asentamiento IDA Caña Blancal le indicó a la recurrente que contaba con disponibilidad hídrica para uso doméstico respecto del inmueble identificado con el plano P-1357570-2009.
En virtud de lo anterior y la jurisprudencia supra citada, la negativa de la Asada recurrida de realizar la interconexión del servicio de agua en la propiedad en cuestión y sobre la cual se construyó una vez que se emitieron los permisos respectivo de la Municipalidad de Osa una casa, provoca una lesión al derecho humano al agua, al principio de confianza legítima y seguridad jurídica en perjuicio de la parte recurrente. En cuanto a la Municipalidad de Osa y el Instituto Costarricense de Acueductos y Alcantarillados se declara sin lugar el recurso, pues no vulneraron ningún derecho fundamental en contra de la recurrente. En consecuencia, corresponde acoger este amparo en los términos que se dirán en la parte dispositiva de este pronunciamiento. (…)” ... Ver más Sentencias Relacionadas Contenido de Interés:

PRINCIPIO DE CONFIANZA LEGÍTIMA “(…) IV.- RELATIVO AL PRINCIPIO DE CONFIANZA LEGÍTIMA. Esta Sala, en la resolución No. 2018-002910 de las 09:15 horas del 23 de febrero de dos 2018, dispuso lo que de seguido se transcribe:
“IV.- Sobre este principio, anteriormente se asumió de manera axiomática que, irremediablemente, todo acto ilegal de contenido favorable podía ser dejado sin efecto por parte de la Administración en cualquier tipo de situación, sin atender a ninguna circunstancia en particular. No obstante, desde mediados de los cincuentas, tanto la doctrina como la jurisprudencia empezaron a detectar que una aplicación ciega y rígida de la regla antedicha lesionaba seriamente la confianza depositada por los administrados en la Administración, así como la buena fe y la seguridad jurídica. De este modo, mediante sentencia de 14 de mayo de 1956, el Tribunal Contencioso- Administrativo de Berlín desarrolló el principio de confianza legítima, que luego fue adoptado por el Tribunal de Justicia de la Comunidad Europea en sus pronunciamientos de 22 de marzo de 1961 y 13 de julio de 1965 (Lemmerz-Werk), y que básicamente apuntala la confianza de los ciudadanos en la medida que, en ciertas circunstancias del caso concreto, razones de equidad y buena fe le impiden a la Administración tomar medidas contrarias a la esperanza inducida por la razonable estabilidad de sus decisiones, en función de las cuales los particulares han adoptado determinadas medidas.
En nuestro continente, tan solo a manera de ejemplo, el Tribunal Constitucional de Colombia, por Sentencia T- 308/11 de 28 de abril de 2011, ha precisado: “El principio de confianza legítima propugna por la edificación de un ambiente de tranquilidad en las relaciones que construyen los asociados frente a las autoridades públicas o los particulares, de forma tal que puedan esperar, de buena fe, que sus actuaciones no sean variadas de manera abrupta a menos de que prime un fin constitucionalmente legítimo. Doctrinariamente se ha defendido que la confianza legítima implica que determinadas expectativas generadas por un sujeto de derecho frente a otro en razón a un comportamiento específico produzcan resultados uniformes en un ambiente de confianza que sólo puede ser quebrantada para dar paso al interés público. En el marco de la relaciones entre la administración y los administrados, la doctrina ha definido la confianza legítima como un valor ético que integra la buena fe y que comprende “la necesidad de una conducta leal, honesta, aquella conducta que, según la estimación de la gente, puede esperarse de una persona.” (…) “La aplicación del principio de la buena fe permitirá al administrado recobrar la confianza en que la administración no va a exigirle más de lo que estrictamente sea necesario para la realización de los fines públicos que en cada caso concreto persiga.
Y en que no le va a ser exigido en su lugar, en el momento ni en la forma más inadecuados, en atención a sus circunstancias personales y sociales, y a las propias necesidades públicas.” Así las cosas, la confianza legítima ha de entenderse como la expectativa cierta de que una situación jurídica o material, abordada de cierta forma en el pasado, no sea tratada de modo extremadamente desigual en otro periodo, salvo que exista una causa constitucionalmente aceptable que legitime su variación. En este sentido, esta Corporación ha sostenido que “el administrado no es titular de un derecho adquirido sino que simplemente tiene una mera expectativa en que una determinada situación de hecho o regulación jurídica no serán modificadas intempestivamente, y en consecuencia su situación jurídica puede ser modificada por la Administración. Como elemento incorporado al de buena fe, la confianza legítima puede proyectarse en el hecho de que se espere la perpetuación de específicas condiciones regulativas de una situación, o la posibilidad de que no se apliquen exigencias más gravosas de las ya requeridas para la realización de un fin, salvo que existan razones constitucionalmente válidas para ello.” En efecto, la ratio iuris del principio de protección a la confianza legítima consiste en que el desarrollo de las relaciones jurídicas requiere de un ambiente de confianza, en el que las reglas de juego, una vez dadas, se respetan.
Lo anterior resulta de mayor relevancia en el caso de las relaciones para con la Administración, toda vez que, en este caso, el instrumento jurídico relacional es el acto administrativo, el cual no es sino una manifestación unilateral de voluntad del Estado. Ergo, el ciudadano necesita de instrumentos jurídicos para defenderse de la unilateralidad y superioridad de la Administración (ver Sentencia N° 2016-008000 de las 11:52 horas del 10 de junio de 2016)”. Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], [Nombre 002], cédula de identidad [Valor 002], contra la ASOCIACION ADMINISTRADORA DE ACUEDUCTO Y ALCANTARILLADO SANITARIO DEL ASENTAMIENTO IDA CAÑA BLANCA.
RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
Considerando:
La parte recurrente manifiesta que, en fecha 30 de abril de 2024, la ASADA IDA Caña Blanca emitió el oficio N.° ASADA-IDA-CB-07-2024, mediante el cual indicó que existía disponibilidad hídrica para uso doméstico respecto del inmueble identificado con el plano P-1357570-2009, señalando únicamente que la gestión de prevista debía ajustarse a los requisitos establecidos por la normativa aplicable. Señala que, con fundamento en dicha certificación y una vez cumplidos los requisitos correspondientes, realizó las gestiones necesarias para la construcción de una vivienda mediante bono habitacional, aportando la documentación requerida y logrando concluir la construcción del inmueble, quedando pendiente únicamente la instalación del servicio de agua potable. Indica que, posteriormente, tras un cambio en la integración de la Junta Directiva de la ASADA, volvió a gestionar la conexión del servicio de agua, poniendo en conocimiento de la entidad la existencia de una prevista en la propiedad y solicitando la verificación correspondiente para determinar su ubicación y viabilidad de utilización.
Refiere que, en sesión de Junta Directiva celebrada el 15 de enero de 2025, se acordó realizar una inspección técnica para analizar las condiciones de la infraestructura existente y valorar posibles soluciones para garantizar el acceso al servicio. Añade que, el 18 de enero de 2025, se efectuó la inspección respectiva, determinándose que la tubería existente bajo el pavimento era de media pulgada, circunstancia que, según se indicó, impedía la instalación de una nueva toma de agua. Señala además que dicha información fue remitida al Instituto Costarricense de Acueductos y Alcantarillados (AyA), sede Pérez Zeledón. No obstante, sostiene que, pese al tiempo transcurrido, a las múltiples gestiones realizadas y a la existencia de una certificación previa que reconocía la disponibilidad hídrica para uso doméstico, las autoridades competentes no han adoptado una solución efectiva ni han procedido con la instalación del servicio de agua potable.
En ese contexto, considera que la falta de acceso al servicio de agua potable afecta gravemente sus condiciones de vida y vulnera sus derechos fundamentales, al impedirle disfrutar plenamente de una vivienda que ya fue construida y para la cual se habían gestionado las autorizaciones correspondientes.
De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:
La jurisprudencia de la Sala es reiterada en reconocer el denominado derecho fundamental al agua, por el cual debe concederse a todas las personas la posibilidad de acceder en condiciones de igualdad a los servicios de agua potable, toda vez que la misma resulta esencial para la vida y la salud humanas. No obstante, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración válidamente puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento. Así, en sentencia número 2006-1898, de las nueve horas cincuenta y tres minutos del 17 de febrero de 2006 – reiterada, entre otras, por sentencias números 2007-13310, de las diez horas cincuenta y siete minutos del 14 de setiembre de 2007, y 2008- 16311, de las diecisiete horas treinta minutos del 30 de octubre de 2008- estableció la Sala que:
“El recurrente alega (…) que pese a las solicitudes y esfuerzos hechos, el Instituto recurrido se ha negado a brindarles el servicio de agua potable aduciendo que se trata de un precario y que sus habitantes no cuentan con un plano de segregación que establezca que son propietarios de los inmuebles. Al respecto, se encuentra acreditado en autos, con base en el informe rendido bajo juramento por la autoridad recurrida, que existe una imposibilidad para instalar servicios de agua potable domiciliaria en la comunidad que habita el recurrente por dos motivos específicos: la falta de una infraestructura adecuada y de presentación de solicitudes con cumplimiento de requisitos legales por parte de los interesados (...). Esta Sala, en la sentencia No. 2004- 12185 de las 13:31 horas del 29 de octubre del 2004, en un caso similar al presente, señaló que no era posible obligar al Instituto Costarricense de Acueductos y Alcantarillados a eludir lo dispuesto en su Reglamento de Prestación de Servicios a los Clientes ni en la Ley General de Agua Potable.
De ahí que, en el tanto el amparado, no reúna las condiciones y requisitos ahí exigidos, aunque el servicio de agua potable debe estar al alcance de toda persona por tratarse de un servicio esencial, no se le puede proveer de manera regular. Dada la existencia de esos dos motivos objetivos por los cuales no es posible suministrar un servicio de agua potable regular al accionante: su falta de cumplimiento de requerimientos para la conexión de un servicio nuevo, empezando, por la presentación de la solicitud y la existencia de una infraestructura adecuada en la zona, no existe motivo alguno para entender que la denegatoria de la prestación del servicio regular por parte del Instituto recurrido se deba al hecho que el amparado y sus vecinos no cuentan con títulos de propiedad sobre los inmuebles que poseen. A lo anterior cabe agregar que con base en el artículo 33 del Reglamento referido, la falta de un título de propiedad no parece ser un obstáculo para solicitar la conexión de un servicio nuevo de agua potable, en tanto se cumplan los requerimientos que indica esa norma.
En todo caso, se encuentra acreditado también que aunque no se ha suministrado el servicio regular de agua potable, el recurrente y demás vecinos cuentan con fuente pública que el Instituto instaló para que puedan abastecerse, para sus necesidades básicas. De ahí que considere este Tribunal que ha sido la propia omisión del recurrente y de los vecinos de la localidad, quienes no acreditan haber presentado las solicitudes para la instalación de un servicio nuevo de agua potable en la comunidad donde habitan, la que ha impedido que se valore su situación a efectos de determinar si, cumpliendo, sobre todo los requerimientos del artículo 33 del Reglamento de Prestación de Servicios a los Clientes, las limitaciones de infraestructura pueden ser superadas en su caso y se les puede proveer de un servicio regular de agua potable.” Se entiende entonces, que si bien existe un derecho fundamental al agua que puede ser exigido a la administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen a la administración a brindar el servicio de agua potable, situación que determina que la administración carece de la obligación de prestar el servicio de agua potable en caso de existir razones técnicas que lo desaconsejen o imposibiliten, debiendo informar adecuadamente al gestionante las razones por las cuales no puede atenderse su solicitud» (véase sentencia N° 2018-8650 de las 09:15 hrs. del 1° de junio de 2018, 2018-7369 de las 9:45 horas de 11 de mayo de 2018 y la N° 2016-18026 de las 9:05 horas del 7 de diciembre de 2016).
Esta Sala, en la resolución No. 2018-002910 de las 09:15 horas del 23 de febrero de dos 2018, dispuso lo que de seguido se transcribe:
“IV.- Sobre este principio, anteriormente se asumió de manera axiomática que, irremediablemente, todo acto ilegal de contenido favorable podía ser dejado sin efecto por parte de la Administración en cualquier tipo de situación, sin atender a ninguna circunstancia en particular. No obstante, desde mediados de los cincuentas, tanto la doctrina como la jurisprudencia empezaron a detectar que una aplicación ciega y rígida de la regla antedicha lesionaba seriamente la confianza depositada por los administrados en la Administración, así como la buena fe y la seguridad jurídica. De este modo, mediante sentencia de 14 de mayo de 1956, el Tribunal Contencioso- Administrativo de Berlín desarrolló el principio de confianza legítima, que luego fue adoptado por el Tribunal de Justicia de la Comunidad Europea en sus pronunciamientos de 22 de marzo de 1961 y 13 de julio de 1965 (Lemmerz-Werk), y que básicamente apuntala la confianza de los ciudadanos en la medida que, en ciertas circunstancias del caso concreto, razones de equidad y buena fe le impiden a la Administración tomar medidas contrarias a la esperanza inducida por la razonable estabilidad de sus decisiones, en función de las cuales los particulares han adoptado determinadas medidas.

Lo anterior resulta de mayor relevancia en el caso de las relaciones para con la Administración, toda vez que, en este caso, el instrumento jurídico relacional es el acto administrativo, el cual no es sino una manifestación unilateral de voluntad del Estado. Ergo, el ciudadano necesita de instrumentos jurídicos para defenderse de la unilateralidad y superioridad de la Administración (ver Sentencia N° 2016-008000 de las 11:52 horas del 10 de junio de 2016)”.
En la resolución del presente caso, es de gran importancia tomar en cuenta lo resuelto por ésta Sala Constitucional en la sentencia nro. 2024010181 de las 9:20 horas del 19 de abril de 2024, donde se estableció:
“III.- SOBRE EL FONDO. Después de analizar los elementos probatorios aportados y el informe rendido bajo juramento por la autoridad recurrida, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, este Tribunal tiene por acreditado que la recurrente es dueña de un inmueble ubicado en San Ramón de Alajuela, propiamente en Piedades Norte, inscrita en el folio real No. 571180-000. Se colige que el 26 de marzo de 2022 la accionante presentó ante la autoridad recurrida una solicitud de agua potable para un inmueble sin construir de vocación agrícola cuyo acceso es mediante servidumbre de naturaleza agrícola que se ubica hasta calle púbica a 159.09 metros; solicitud No. SIGDD-2022-00006761. No obstante, del estudio básico de la solicitud No. SIGDD-2022-00006761-1-AP se determinó que no resultaba congruente para el instituto aprobar la solicitud de disponibilidad de agua potable y alcantarillado sanitario para el eventual proyecto debido a que no cuenta con factibilidad técnica requerida para la aprobación de las solicitudes de disponibilidad ubicadas en el sistema CO-A-35-San Ramón.
La factibilidad técnica se fundamentó en la Inspección de Factibilidad de Agua Potable SIGDD-2022-00006761-1-1-1 remitido por el Jefe técnico de Operación y Mant. Sist. de Agua Cantonal de San Ramón de la Región Central Oeste, donde se indica “Inexistencia de infraestructura de distribución y recolección frente al inmueble según criterio técnico”. Lo anterior fue notificado a la recurrente mediante resolución de Constancia de NO DISPONIBILIDAD del 04 de agosto del 2022. Ante el escenario descrito, se coteja que la tutelada interpuso un recurso de revocatoria y/o apelación en subsidio contra lo dispuesto por el ICAA; empero, mediante resolución de las 7: 00 horas del 12 doce de agosto del 2022 se declaró sin lugar el recurso de revocatoria. Asimismo, mediante resolución GG-R-2022-0727 de las 10:00 horas del 21 de septiembre del 2022 se rechazó el recurso de apelación.
Quedó demostrado que el 21 de setiembre de 2022 la accionante presentó ante la autoridad recurrida la nueva la solicitud de agua potable No. SIGDD- 2022-00020625. En ese sentido, se demostró que el ICAA generó el oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, en el cual indicó lo siguiente: "SI HAY DISPONIBILIDAD DE AGUA POTABLE EN LA VÍA PÚBLICA, NO HAY DISPONIBILIDAD DE SISTEMA DE ALCANTARILLADO”. Lo anterior fue notificado a la interesada en el oficio del 16 de noviembre de 2023 en las siguientes condiciones: “En atención a la solicitud de disponibilidad, me permito hacerle llegar adjunto la Constancia de Disponibilidad de Agua Potable Positivo y Alcantarillado Sanitario Negativo N°2022-00020625-1, el cuál en resumen señala lo siguiente: La red de Alcantarillado Sanitario no se encuentra en funcionamiento en la zona”. Se coteja que el 07 de febrero de 2024 la promovente gestionó la solicitud del nuevo servicio de agua potable No. P21112024020005, pero al recibir el trámite en cuestión la cantonal se percató de un error y procedió a realizar una investigación; ello, tomando en cuenta la evidencia pasada, valorando nuevamente sí la condición de la solicitud realmente había cambiado y las condiciones por la que fue negada la solicitud de Disponibilidad SIGDD-2022-00006761-1-1-1.
Finalmente, se confirmó que en oficio No. SG-GSP-RC-2024-00132 del 05 de marzo de 2024, la autoridad recurrida le notificó a la interesada que no podía dar trámite a la solicitud del nuevo servicio No. P21112024020005. En lo medular, se indicó: “En fecha 07 de febrero del 2024, se emite solicitud 21112024020005 a nombre de [Nombre 001], cédula de identidad [Valor 001], para el proyecto de Construcción de vivienda, ante la solicitud de conexión de nuevo servicio de agua potable, el cual se ubicaría en la propiedad, matrícula da folio real 2-571180-000, cuya naturaleza señala TERRENO DE POTRERO, acceso a través de servidumbre agrícola localizada en Distrito Piedades Norte, Cantón de San Ramón, Provincia de Alajuela, según Plano Catastrado No. A-2032273-2018, con dirección 115 metros al NW y 260 metros W de las Cabinas del Bosque Lodge (…) según consulta en el Registro Nacional de la propiedad, la distancia de la vía pública al terreno por la servidumbre agrícola es de 190 metros aproximado (…) Para prestar servicios a lo interno de la servidumbre debe inscribirla a favor de AYA, así como cumplir con los criterios antes señalados.
En conclusión, ante esta circunstancia la Institución se ve imposibilitada de otorgar lo pedido. Los documentos que contiene el expediente administrativo son concluyentes, en este sentido mal haría la Institución otorgando un nuevo servido, contraria al Principio de Legalidad, a la ciencia y la técnica que señalan los artículos 11 y 16 de la Ley General de la Administración Pública. Siendo entonces que AyA debe respetar la normativa que lo rige, en caso contrario estaría transgrediendo el ordenamiento jurídico (…) Finalmente, como se comprueba no se puede dar trámite a la solicitud de nuevo servicio No. P21112024020005”.
Esta Sala, mediante sentencia No. 2012-016181 de las 9:05 horas de 27 de noviembre de 2012, reiterado en la sentencia No. 2015002749 de las 09:05 horas del 27 de febrero de 2015, al conocer un asunto similar al de este expediente, se pronunció en los siguientes términos:
“V.- CASO CONCRETO. Queda acreditado que a la amparada se le había otorgado una primera carta de disponibilidad, extendida el 24 de octubre de 2011, a efecto de tramitar el visado del plano catastrado No. SJ-919550-0, documento que tenía de vigencia un plazo no mayor a seis meses que venció en abril de 2012. Con base en ese documento, entre otros permisos y autorizaciones, la recurrente construyó su vivienda y solicitó a la Asociación recurrida, que le extendiera la carta de disponibilidad para que se le otorgue el servicio de agua potable en el inmueble. No obstante, esto le fue rechazado pues, según el último aforo realizado por personeros del Instituto de Acueductos y Alcantarillados, las nacientes captadas son insuficientes para abastecer a la población actual —criterio recogido en el memorando No. SUB-G-GSC-UEN-AP-EBD-2012-686 de 25 de mayo de 2012—; situación que le fue comunicada a la tutelada.
Partiendo de este esquema fáctico, en criterio de este Tribunal, en el presente asunto se violentó el principio de confianza legítima en perjuicio de la amparada. En efecto, si bien, la primera carta de disponibilidad se le extendió en el 2011, la amparada confió legítimamente en la Asociación recurrida —la que, como se dijo supra, está ejerciendo potestades públicas— y construyó su casa de habitación, con el gasto importante de recursos que eso conlleva, con la expectativa que se le suministraría el servicio de agua potable. Ciertamente, conforme el artículo 21, inciso 19), del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No.32529, las ASADAS pueden otorgar el sello disponibilidad hídrica —con vigencia de 6 meses para viviendas unifamiliares y de un año para otros desarrollos, prorrogable— “siempre que exista viabilidad técnica, no vaya en detrimento de la calidad del servicio que se presta y exista infraestructura” (el énfasis es agregado).
No obstante, en concordancia con el principio de confianza legítima y de buena fe, debe advertirse a la Asociación recurrida que antes de emitir una carta de disponibilidad de agua potable, deben realizarse las mediciones necesarias para verificar si existe agua disponible y así evitar hacer incurrir a los administrados en fuertes e inútiles inversiones si después de construidas sus viviendas o edificaciones, no se les puede dotar de agua potable.
Como corolario de lo expuesto, se impone acoger el recurso planteado con las consecuencias que se detallan en la parte dispositiva de esta sentencia”.
En el sub lite del elenco de hechos probados se desprende que mediante oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023 el ICAA emitió la constancia de disponibilidad de agua potable positivo para la propiedad inscrita en el folio real No. 571180-000 localizada en San Ramón de Alajuela, propiamente en Piedades Norte a nombre de la recurrente, en las siguientes condiciones: "SI HAY DISPONIBILIDAD DE AGUA POTABLE EN LA VÍA PÚBLICA, NO HAY DISPONIBILIDAD DE SISTEMA DE ALCANTARILLADO”. Esto fue notificado a la parte amparada en oficio del 16 de noviembre de 2023 en las siguientes condiciones: “En atención a la solicitud de disponibilidad, me permito hacerle llegar adjunto la Constancia de Disponibilidad de Agua Potable Positivo y Alcantarillado Sanitario Negativo N°2022-00020625-1, el cuál en resumen señala lo siguiente: La red de Alcantarillado Sanitario no se encuentra en funcionamiento en la zona”.
Con base en ese documento, entre otros permisos y autorizaciones, tales como el uso de suelo y el permiso de construcción No. PC-079-2024 emitido por la Municipalidad de San Ramón, la tutelada inició el proceso de construcción de su vivienda. Posteriormente, sea el 07 de febrero de 2024, gestionó ante la institución accionada la solicitud del nuevo servicio de agua potable No. P21112024020005; empero, le fue rechazada mediante el oficio No. SG-GSP-RC-2024-00132 del 05 de marzo de 2024; esto, debido a la existencia de una imposibilidad técnica, pues se determinó que no existe frente al lindero del inmueble disponibilidad de sistema de alcantarillado. En la especie, en criterio de este Tribunal, en el caso de marras el ICAA violó el principio de confianza legítima en perjuicio de la parte amparada. En esa línea de ideas, adviértase que del propio dicho de la recurrente se determina que confió legítimamente en la autoridad recurrida y construyó su casa de habitación con el gasto importante de recursos que eso conlleva y con la expectativa que se le suministraría el servicio de agua potable.
No obstante, casi tres meses después de que se emitiera el oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, la solicitud de nuevo servicio le fue rechazada. Por lo expuesto, se considera que también lesionó el principio de seguridad jurídica de la tutelada, así como su derecho a obtener justicia pronta y cumplida. Nótese que la solicitud de agua potable conlleva un procedimiento administrativo, el cual debe ser analizado y resuelto por el instituto accionado. En este caso, resulta claro que la recurrida emitió la disponibilidad de agua potable positivo, pero luego denegó la solicitud del nuevo servicio de agua potable debido a un error. En ese sentido, es menester traer a colación lo subrayado por el ICAA en su informe, en lo conducente: “El 21 de setiembre de 2022, vuelve a presentar la solitud de disponibilidad como se demuestra en los folios 62 y 63 del expediente administrativo y su resolución en los folios del 68 al 69, la nueva gestión se inicia de nuevo con el numero SIGDD- 2022- 00020625, se informa, que, en esta ocasión, la oficina cantonal recibió colaboración para la resolución de disponibilidades en donde en esta ocasión resolvieran de manera positiva sin tomar en cuenta que la servidumbre era agrícola y todo lo que implica este caso.
Ya que hasta ese momento no había cambiado la situación que se presentaba desde la resolución anterior. Dicha resolución de disponibilidad positiva se hizo efectiva el 16 de noviembre del año 2023. Esta última resolución al quedar fuera de la gestión de la oficina cantonal de San Ramón, fue resulta por otras oficina colaboradoras fuera de la Dirección Región Central y se gestiona de forma positiva hacia el usuario directamente, con una resolución incorrecta, debido a que la condición inicial no tuvo ningún cambio y el acceso por servidumbre agrícola se mantuvo y a la fecha de este informe, no se evidencia colocación de infraestructura, por medio de alguna solicitud adicional o carta de Capacidad Hídrica que lo autorice”. Agrega: “La cantonal al recibir este trámite, se percata del error, y realiza la investigación, tomando en cuenta la evidencia pasada y valorando nuevamente, la condición de la solicitud si realmente había cambiado, las condiciones por la que fue negada la solicitud de Disponibilidad SIGDD-2022-00006761-1-1-1; Por tal motivo se responde a la señora [Nombre 001], con el documento SG-GSP-RC-2024-00132 el 05 de marzo, explicando los argumentos del porque no se puede dar trámite a la solicitud del nuevo servicio”.
Ahora, esta Sala se ha pronunciado sobre el acceso al agua potable como un servicio que permite, a su vez, la realización y garantía de otros derechos fundamentales como a la calidad de vida y la salud (véase en similar sentido la sentencia No. 2017002404 de las 09:45 horas del 17 de febrero de 2017) pero también ha reconocido que cuando existen razones técnicas que imposibiliten, de forma absoluta, el suministro de agua potable, no se presenta una lesión a un derecho fundamental (véase en similar sentido la sentencia No. 07779-2019 de las 09:15 horas del 03 de mayo de 2019, entre otras). En el caso de marras, previo a que el ICAA emitiera la constancia de disponibilidad de agua potable positivo por error, ya había determinado que no resultaba congruente aprobar la solicitud de disponibilidad de agua potable y alcantarillado sanitario debido a que no se cuenta con la factibilidad técnica requerida para la aprobación de las solicitudes de disponibilidad ubicadas en el sistema CO-A-35-San Ramón.
Bajo esta óptica, si bien es importante señalar que este Tribunal no cuenta con la competencia para determinar si procede o no otorgar la disponibilidad de agua que pretende la accionante, pues esto obedece a criterios técnicos emitidos por las autoridades del ICAA, institución con la potestad normativa para realizar tales actos, en el sub examine sí se estima violentado el principio de confianza legítima de la amparada, así como el principio de seguridad jurídica y su derecho a obtener justicia pronta y cumplida, por lo que se impone acoger el recurso con las consecuencias que se detallan en la parte dispositiva. (…)
Del informe rendido bajo juramento por la autoridad recurrida, con las consecuencias incluso penales que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una infracción a los derechos fundamentales de la parte recurrente, con fundamento en las consideraciones que a continuación se exponen. Al respecto, se acredita que en oficio ASADA-IDA-CB-07-2024 del 30 de abril de 2024, el representante de la Asada IDA Cañal Blanca le indicó a la recurrente que en respuesta a la solicitud enviada, la Asada de la comunidad si cuenta con disponibilidad hídrica para uso doméstico, para el plano P-1357570-2009. Para solicitud de prevista debe cumplir con los requisitos del reglamento AyA. Por otra parte, se constata que respecto de la finca N.° 6-170304-000, plano catastrado P-1357570-2009, se tramitó y aprobó por parte de la Municipalidad de Osa el permiso de construcción N.° PC-511-02-10-2024 para la construcción de una vivienda de bono de aproximadamente 42 metros cuadrados.
El trámite fue realizado a nombre de la señora [Nombre 002], propietaria registral del inmueble, asimismo, consta en la documentación del proyecto que el señor [Nombre 001] figura como beneficiario de la vivienda de interés social y que contaba con autorización de la propietaria para realizar el trámite correspondiente. En los registros municipales constan, además, los criterios de uso de suelo CUS-2050-2022 y CUS-0485-2024, correspondientes al inmueble identificado con el plano P-1357570-2009. En dichos antecedentes se determinó que el proyecto pretendido era conforme y podía desarrollarse. Con respecto a la Disponibilidad de Agua, es importante indicar que dentro de la documentación correspondiente al proyecto consta el oficio ASADA-IDA-CB-07-2024, de fecha 30 de abril de 2024, emitido por la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Asentamiento IDA Caña Blancal y dirigido a la señora [Nombre 002].
En dicho documento, la propia ASADA manifestó que contaba con disponibilidad hídrica para uso doméstico respecto del inmueble identificado con el plano P-1357570-2009. Asimismo, señaló que para solicitar la prevista debían cumplirse los requisitos establecidos en el reglamento del Instituto Costarricense de Acueductos y Alcantarillados. Posteriormente, el 15 de enero de 2025, la parte recurrente solicitó a la Asada recurrida la instalación del servicio de agua. Además, el 18 de enero de 2025, personal de la Asada recurrida realizó una inspección y determinó que la tubería que pasa por el pavimento de la calle es media pulgada, lo cual imposibilita la toma de agua. Lo anterior, le fue comunicado a la recurrente por oficio ASADA-IDA-CB-026-2025 del 27 de enero de 2025. Nótese que en el presente caso, en el oficio ASADA-IDA-CB-07-2024 de fecha 30 de abril de 2024 emitido por la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Asentamiento IDA Caña Blancal le indicó a la recurrente que contaba con disponibilidad hídrica para uso doméstico respecto del inmueble identificado con el plano P-1357570-2009.
En virtud de lo anterior y la jurisprudencia supra citada, la negativa de la Asada recurrida de realizar la interconexión del servicio de agua en la propiedad en cuestión y sobre la cual se construyó una vez que se emitieron los permisos respectivo de la Municipalidad de Osa una casa, provoca una lesión al derecho humano al agua, al principio de confianza legítima y seguridad jurídica en perjuicio de la parte recurrente. En cuanto a la Municipalidad de Osa y el Instituto Costarricense de Acueductos y Alcantarillados se declara sin lugar el recurso, pues no vulneraron ningún derecho fundamental en contra de la recurrente. En consecuencia, corresponde acoger este amparo en los términos que se dirán en la parte dispositiva de este pronunciamiento.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara parcialmente con lugar el recurso. Se les ordena a Juana Solís Mora, en su condición de Presidenta de la Asociación Acueducto y Alcantarillado Sanitario del Asentamiento Ida Caña Blanca, o a quien ocupe ese cargo, que gire las órdenes pertinentes y dispongan lo necesario dentro del ámbito de sus competencias, para que, en el plazo máximo de UN MES, contado a partir de la notificación de este pronunciamiento, ejecuten las medidas que correspondan para dotar del servicio de agua potable en la propiedad de la recurrente como en derecho corresponda. Se advierte a la autoridad recurrida que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Asociación Acueducto y Alcantarillado Sanitario del Asentamiento Ida Caña Blanca al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la jurisdicción contencioso-administrativa. En cuanto a las demás autoridades recurridas se declara sin lugar el recurso. Notifíquese.
