CASE FILE: No. 26-030218-0007-CO PROCEEDING: AMPARO APPLICATION RULING: No. 2026033412 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine forty a.m. on 27 August 2026.
Amparo proceeding conducted in case file number 26-030218-0007-CO, filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (AYA).
BACKGROUND:
Drafted by Justice Castillo Víquez; and, REASONS:
The applicant expresses disagreement with the August bill for potable water. The applicant states that they requested a payment arrangement; however, they were told that one was not possible for that amount. For these reasons, the applicant requests the Chamber’s intervention.
In light of the applicant’s allegations, the applicant is advised that the purpose of an amparo application is to provide timely protection against violations or threats to fundamental rights and freedoms, and not to serve as an instrument for reviewing the legality of acts of the various Public Administrations. For this reason, the Chamber cannot act as an appellate tribunal in the matter presented and review whether the charge or billing for the water service challenged by the amparo applicant conforms to actual consumption and the legislation in force, since that is an ordinary question of legality that must be resolved through the ordinary process. Likewise, investigating and reviewing the causes of the high consumption falls outside this Chamber’s jurisdiction because it exceeds the summary nature of amparo.
Accordingly, it is not for this jurisdiction to intervene on the applicant’s behalf before the respondent authority to determine, under the infra-constitutional rules governing the matter, whether the bill in question was properly charged. Therefore, the applicant may, if they so choose, raise their objections through the administrative process itself or before the competent court, where they may fully discuss the merits of the matter and assert their claims.
Therefore, the application is inadmissible, as is hereby declared.
The parties are advised that any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted must be collected within a maximum period of 30 business days, counted from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session No. 27-11 of 22 August 2011 and published in Judicial Bulletin No. 19 of 26 January 2012) and Article LXXXI of session No. 43-12 of the Superior Council of the Judiciary of 3 May 2012.

Recurso de amparo que se tramita en expediente número 26-030218-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA).
RESULTANDO:
Redacta el Magistrado Castillo Víquez; y,
CONSIDERANDO:
El recurrente manifiesta su disconformidad con la facturación del mes de agosto por concepto de agua potable. Menciona que gestionó un arreglo de pago; empero, se le indicó que por ese monto no era posible. Por lo anterior, solicita la intervención de la Sala.
Vistas las alegaciones de la parte recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de las distintas Administraciones Públicas. Por esta razón, la Sala no puede actuar como tribunal de alzada en la materia expuesta y revisar si el cobro o facturación por el servicio de agua que la parte amparada impugna se ajusta o no al consumo real y a la normativa legal vigente, puesto que ello es un diferendo de legalidad ordinaria que debe ser dirimido en la vía común. Asimismo, escapa al ámbito de competencia de esta Sala, investigar y revisar las causas del alto consumo, por cuanto excede la naturaleza sumaria del amparo.
De esta manera, no le corresponde a esta jurisdicción interceder a su favor ante la autoridad recurrida a fin de determinar, según la normativa infraconstitucional que rige la materia, la procedencia del cobro de la factura de marras. Por ello, la amparada podrá plantear, si a bien lo tiene, sus reparos en la propia vía administrativa o en la sede jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.
Ergo, el recurso es inadmisible como en efecto se declara.
Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
POR TANTO:
Se rechaza de plano el recurso.
