Review of the Document CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:40 a.m. on 27 August 2026.
Amparo proceeding filed in case No. 26-025347-0007-CO by Nombre01, identity card CED01, against the SAN ISIDRO DE CÓBANO DE PUNTARENAS RURAL AQUEDUCT ADMINISTRATIVE ASSOCIATION and the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.
BACKGROUND:
“It is hereby stated that the ASADA currently has no operational infrastructure in front of Mr. Nombre01’s property, because the works corresponding to the existing distribution network in that sector are in the process of being received by this Association. Consequently, the existing pipe has not been formally donated to or received by the ASADA and therefore is not yet part of the operational infrastructure under this Association’s administration and responsibility. For that reason, it is currently not possible to provide drinking-water supply service to that property.” They request that the amparo application be denied.

In amparo applications directed against private entities, as in this case, the Chamber has clearly stated: “Given their exceptional nature, the ordinary procedure for amparo applications against private-law entities must begin by examining whether, in the particular case, one of the circumstances that makes the application admissible exists, and—if so—then determining whether it should be granted” (Judgment No. 151-97). Article 57 of the Constitutional Jurisdiction Act provides that this kind of claim may be brought against acts or omissions of private-law entities when they act or are required to act in the exercise of public functions or powers, or when they are, in law or in fact, in a position of power against which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights or freedoms referred to in Article 2(a) of that same Act. In the present case, the Chamber considers that the San Isidro de Cóbano Aqueduct Administrative Association is exercising a public function, and therefore the amparo application is admissible (see Judgment No. 2010-005400, issued at 10:15 on 19 March 2010).
The applicant states that they requested drinking-water service from the San Isidro de Cóbano Rural Aqueduct and Sewer Administrative Association. However, access to water has not been provided. They consider their fundamental rights to have been violated.
The following facts, relevant to deciding this matter, are considered duly established, either because they have been proven or because the respondent failed to address them as required in the initial order:

SOLE. That, after 2013, the applicant submitted a formal request for connection to drinking-water service to the San Isidro de Cóbano Rural Aqueduct and Sewer Administrative Association or the Costa Rican Institute of Aqueducts and Sewers.
In repeated precedents, this Court has recognized the so-called fundamental right to water, under which everyone must be afforded the possibility of equal access to drinking-water services, as they are essential to life and health. Likewise, this Chamber has held that, despite the foregoing, the fundamental-right status of this right does not imply unrestricted access to water services, since the Administration may validly establish general requirements that each applicant must meet in order to assess their particular request (see, in this regard, Judgment No. 2018-004915, issued at 09:30 on 23 March 2018). It has also stated that, although there is a fundamental right to water, provision of the service may be made subject to compliance with the requirements established for its granting and to the material possibility of supply; that is, there must not be technical circumstances that make it impossible or inadvisable to provide drinking-water service (see, in this regard, Judgments No. 2009-003825, issued at 16:49 on 10 March 2009, and No. 2018-004915, issued at 09:30 on 23 March 2018, among others).
In this case, the applicant asserts that they requested drinking-water service for their home from the respondent association. However, as of the filing of this amparo application, they still have no access to water.
In this regard, although both the representative of the respondent association and the authorities of the Costa Rican Institute of Aqueducts and Sewers state that there are no pending requests in the applicant’s name awaiting resolution, they also assert that there is currently no water capacity or infrastructure to provide new services.
Thus, in light of the established factual record and what was stated in the preceding section, this Court cannot disregard the legal and technical requirements for providing a service. In that connection, it is established that, on an unspecified date, the applicant submitted a request to the Costa Rican Institute of Aqueducts and Sewers, which was resolved by letter dated 18 November 2013, stating that new services could not be granted because of a lack of water resources. As for the San Isidro Rural Aqueduct and Sewer Administrative Association, there is no evidence showing that the applicant formally approached that association to request drinking-water service. In any event, what the applicant alleges does not violate their fundamental rights, since it amounts in fact to disagreement with the technical criteria issued in 2013, which prevented the requested service connection. Such disagreements should not be examined or resolved in this Constitutional Jurisdiction, but rather by the respondents themselves or through the competent legality proceedings, so that the matter may be resolved as required by law. Accordingly, the amparo application must be dismissed, as is hereby ordered.
For the reasons set out below, we consider that the present amparo application should be granted. In the majority’s view, the judgment dismisses the amparo because, in its opinion, the challenged denial is not the result of arbitrary or discriminatory conduct, but is based on technical criteria; however, it fails to weigh adequately that access to drinking water is a fundamental right indispensable to life, health, and human dignity.
Article 21 of the Political Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution imposes on the State the duty to guarantee the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—as interpreted by the CESCR in General Comment No. 15—recognize the human right to water, requiring States to adopt positive measures for its full realization. A heightened obligation is imposed on the State in a social and democratic state governed by the rule of law; for this reason, the supply of water is a priority obligation of public authorities.
A public-service provider cannot merely identify deficiencies in the system; it has a legal duty to plan, anticipate, and carry out the actions needed to progressively guarantee access to water service, especially when it is for human consumption.
This does not mean requiring the impossible, but rather requiring the adoption of reasonable, alternative, or progressive measures so that people are not left without protection.
Water is not just any service; it is an essential human right. Therefore, the respondent entity cannot disregard its duty to guarantee it by hiding behind technical limitations without offering effective solutions.
For these reasons, we consider that the amparo application should be granted, at least to order the adoption of concrete and progressive measures to guarantee, within a reasonable period, the protected party’s effective access to drinking water. Water is an asset and a fundamental right whose effective enjoyment must be ensured; this is an inescapable duty.
The parties are advised that, if they have submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the Court’s Office within a maximum period of thirty working days, counted from notification of this judgment. Otherwise, any material not collected within this period will be destroyed, pursuant to the “Regulation on the Electronic Case File before the Judiciary,” approved by the Full Court in Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at Session No. 43-12, held on 3 May 2012, Article LXXXI.
THEREFORE:
The amparo application is denied. Justices Cruz Castro and Rueda Leal dissent and would grant the amparo application.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .
Recurso de amparo que se tramita en expediente N°26-025347-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DE SAN ISIDRO DE CÓBANO DE PUNTARENAS y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
RESULTANDO:
“Se hace contar que la ASADA no cuenta actualmente con infraestructura operativa frente a la propiedad del señor Nombre01, debido a que las obras correspondientes a la red de distribución existente en ese sector se encuentran en proceso de recepción por parte de esta Asociación. En consecuencia, la tubería existente no ha sido formalmente donada ni recibida por la ASADA, por lo que aún no forma parte de la infraestructura operativa bajo la administración y responsabilidad de esta Asociación, razón por la cual actualmente no es posible brindar el servicio de abastecimiento de agua potable en dicho inmueble”.
Solicitan se declare sin lugar el recurso.
Redacta el Magistrado Salazar Alvarado; y,
CONSIDERANDO:
Tratándose de acciones de amparo dirigidas contra sujetos privados, como es aquí el caso, la Sala ha sido clara al decir: "Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para –posteriormente y en caso afirmativo– dilucidar si es estimable o no" (Sentencia N°151-97). Establece el artículo 57, de la Ley de la Jurisdicción Constitucional, que esta clase de demandas se conceden contra las acciones u omisiones de sujetos de derecho privado cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a), de la misma Ley. En el sub judice, considera la Sala que la Asociación Administradora del Acueducto San Isidro de Cóbano está actuando en ejercicio de una función pública por lo que resulta procedente el amparo (véase la Sentencia N°2010-005400 de las 10:15 horas del 19 de marzo de 2010).
La parte recurrente manifiesta que ha solicitado, ante el Asociación Administradora del Acueducto y Alcantarillado Rural de San Isidro de Cóbano, el servicio de agua potable. No obstante, no se ha brindado el acceso al líquido. Considera lesionados sus derechos fundamentales.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
No se estima como debidamente demostrado el siguiente hecho, de relevancia para la resolución de este asunto:
ÚNICO. Que posterior al año 2013, el recurrente haya planteado alguna solicitud formal de conexión del servicio de agua potable ante la Asociación Administradora del Acueducto y Alcantarillado Rural de San Isidro de Cóbano o el Instituto Costarricense de Acueductos y Alcantarillados.
Este Tribunal, en reiterada jurisprudencia, ha reconocido el denominado derecho fundamental al agua, por el cual, debe concederse a todas las personas la posibilidad de acceder en condiciones de igualdad a los servicios de agua potable, al resultar esencial para la vida y la salud. De igual manera, ha dicho esta Sala que, pese a lo anterior, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la Administración, válidamente, puede establecer requisitos generales de necesario cumplimiento por cada solicitante, para valorar su particular requerimiento (véase en ese sentido la Sentencia N° 2018-004915 de las 09:30 horas de 23 de marzo de 2018). Además, se ha señalado que, si bien existe un derecho fundamental al agua, la prestación del servicio puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento, y a que exista posibilidad material de suministro, esto es, que no pululen situaciones técnicas que imposibiliten o desaconsejen brindar el servicio de agua potable (véanse en ese sentido las Sentencias N° 2009-003825 de las 16:49 horas del 10 de marzo de 2009, y N° 2018-004915 de las 09:30 horas del 23 de marzo de 2018, entre otras).
En el sub lite, la recurrente asegura que ha solicitado, ante la asociación recurrida, el servicio de agua potable en su vivienda. No obstante, a la fecha de interposición de este recurso, no cuenta con acceso al líquido.
Al respecto, a pesar de que tanto el representante de la asociación recurrida como las autoridades del Instituto Costarricense de Acueductos y Alcantarillados exponen que no existen gestiones pendientes de resolución a nombre del tutelado. En todo caso, aseguran que actualmente no se cuenta con capacidad hídrica ni infraestructura para dotar de nuevos servicios.
Así, de conformidad con la base fáctica acreditada, y según lo indicado en el acápite anterior, este Tribunal no puede obviar los requisitos legales y técnicos para la dotación de un servicio. Bajo esa inteligencia, se tiene por demostrado que en fecha indeterminada, el recurrente planteó una solicitud ante el Instituto Costarricense de Acueductos y Alcantarillados, el cual fue resuelto mediante oficio de fecha 18 de noviembre de 2013, indicándose que no era posible otorgar nuevos servicios por la carencia de recurso hídrico. En cuanto a la Asociación Administradora de Acueducto y Alcantarillado Rural de San Isidro, no existen elementos probatorios que acrediten que el recurrente haya acudido formalmente ante dicha asociación a requerir el servicio de agua potable. En todo caso, lo expuesto por la parte recurrente no resulta lesivo a sus derechos fundamentales, puesto que corresponde, en realidad, a una disconformidad con los criterios técnicos emitidos desde el 2013, que impedían la conexión del servicio pretendido. En ese sentido, las disconformidades presentadas no deben ser analizadas ni resueltas en esta Jurisdicción Constitucional, sino ante las propias recurridas, o bien, en las vías de legalidad competentes, a efectos de que se resuelva lo que en derecho corresponda. Consecuentemente, lo procedente es desestimar el recurso, como en efecto se dispone.
Conforme a las consideraciones que indicamos a continuación estimamos que el presente recurso debe declararse con lugar. En el criterio de mayoría, la sentencia desestima el amparo porque, a su juicio, la negativa impugnada no obedece a una actuación arbitraria o discriminatoria, sino que encuentra fundamento en criterios técnicos; sin embargo se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.
El artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.
El proveedor del servicio público no puede limitarse a constatar insuficiencias del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.
No se trata de obligar a lo imposible, sino de exigir la adopción de medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.
El agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la entidad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.
Por estas razones, estimamos que el recurso debe declararse con lugar, al menos para ordenar la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del Despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
