Review of the Document CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:40 a.m. on 27 August 2026.

Amparo proceeding filed in case number 26-025211-0007-CO by Nombre01, identity card CED01, against the NATIONAL REGISTRY.

Background:

  1. 1By a brief filed with the Chamber’s Clerk’s Office and added to the case file at 11:50 a.m. on 14 July 2026, the applicant brings an amparo proceeding against the National Registry. In summary, the applicant states that on 03 June 2026, by email sent to account ...01, the applicant filed a request with the Property Registry seeking a complete copy of the qualification file / presentation appointment 2026-20814-C. The applicant further states that the request indicated a legitimate, direct, and current interest, as the applicant is the legal representative of a company that is the registered owner of property recorded under Folio Real PRN03, which is directly affected by the alleged overlaps, effects on the parcel status, and regulations of the Maritime Terrestrial Zone. Nevertheless, the applicant complains that, as of the filing of this amparo proceeding and despite 41 days having elapsed, no response has been received. For these reasons, the applicant requests the intervention of this Chamber.
  2. 2By order issued at 10:14 a.m. on 11 August 2026, this proceeding was admitted, and the Director General and the Director of the Real Estate Registry, both of the National Registry, were given a hearing regarding the facts alleged by the applicant.
  3. 3Agustín Meléndez García and Gabriela Carranza Araya, respectively the Director General and Acting Director of the Real Estate Registry, both of the National Registry, report under oath that:
“(...) II. REGARDING THE EMAIL ADDRESS USED BY THE APPLICANT. With respect to the applicant’s assertion that the National Registry failed to address the requests for access to and copies of the file sent on 3 and 5 June 2026, it is necessary to clarify a number of factual and legal circumstances that are decisive to the proper resolution of this matter.

As a starting point, it should be noted that the Constitutional Chamber has repeatedly recognized that the fundamental rights to petition and to a prompt response, as well as the right of access to administrative information, may validly be exercised by electronic means, provided that these correspond to the official channels established by the Administration for receiving requests.

In this regard, in judgment N2008-009670, issued at 09:55 a.m. on 13 June 2008, that Court emphasized that exercising these rights through information technologies requires the request to be channeled through the electronic means enabled by the relevant institution to receive requests from members of the public. It stated, on the point of interest: ‘In the context of the information and knowledge society, fundamental rights may be exercised through new information technologies. As regards the right to petition and to a prompt response, the use of electronic means gives that right new nuances that must be weighed. Taking into account its progressive and expansive effectiveness, but also the fact that fundamental rights are not absolute, it may be concluded that, to exercise the right to petition and to a prompt response using the means made available by new technologies, the request should be channeled through a freely accessible website of the public entity or body. In addition, that electronic domain must have a hyperlink leading to an email address specifically provided to receive requests, whether on a particular subject or as an inbox for all types of requests’ (emphasis in original) (see also 2017-5247, issued at 10:00 a.m. on 07 April 2017, and 24745–2026, issued at 09:25 a.m. on 02 July 2026).

On the basis of that premise, it is important to note that the evidence submitted by the applicant himself establishes that the emails dated 03 and 05 June 2026 were sent to address ...01.

However, according to the records of the National Registry and the Real Estate Registry (see evidence submitted), that email address has not been operational since 28 October 2025, when it was disabled as an institutional communication channel.

Thereafter, on 05 December 2025, the account was permanently canceled and replaced by the official email address ...02, which has since been the current channel for receiving and handling requests addressed to that office.

The significance of this circumstance is that disabling the account did not occur silently or prevent the interested party from learning the correct way to channel the request. On the contrary, when a user sent communications to the discontinued email address, the system automatically generated a return message expressly stating that the receiving account was blocked and that any request had to be sent to the current official address of the Real Estate Registry, namely ...02.

According to official letter DRI-869-2026 dated 17 August 2026, submitted as evidence with this report, this automatic response mechanism did exist: it informed the sender that the message could not be delivered and expressly provided the correct email address to which the request should be sent.

Consequently, the emails sent by the applicant on 03 and 05 June 2026 did not reach an institutional account enabled to receive and process requests, nor did they come to the attention of the competent office through the official channel established for that purpose.

In addition, the institutional system must have automatically informed the sender of this circumstance and expressly indicated the electronic channel to be used to submit the request validly.

Under these conditions, it cannot be concluded that there was an omission attributable to the Administration. The alleged lack of response did not result from an institutional refusal to process the request or from unjustified inactivity by the National Registry or the Real Estate Registry, but from the objective fact that the request was sent to an email address that had been disabled and for which the email platform had been configured to issue an automatic response stating that the account was out of service and providing the new available service channel.

Therefore, in light of constitutional case law concerning the exercise of fundamental rights by electronic means, the omission attributed to this Administration cannot be deemed established, since the request cited in the application was not submitted through an institutional channel that was current and enabled to receive it. This precludes attributing to the National Registry, specifically the Real Estate Registry, the consequences of using an email address that had been officially replaced several months before the events at issue.

III. REPORT ON THE ADMINISTRATIVE ACTIONS CARRIED OUT IN THE SPECIFIC CASE

To provide the Chamber with a comprehensive account of the facts, this report is based on the technical opinion issued by the Directorate of the Real Estate Registry in official letter DRI-869-2026, as well as on a review of the documentary records on file, from which the following administrative actions and circumstances emerge.

First, it is relevant to note that the applicant’s request concerned cadastral submission number 2026-20814-C, a matter associated with an application for registration filed with the National Cadastre.

In this regard, it was stated that the matter is not a registered cadastral map or a completed registration, but rather a submission that entered the registry workflow for review and currently remains listed in the Plan Information System (SIP) as defective and pending registration.

According to the information provided by the competent technical office, the submission entered the registry system on 10 March 2026 and underwent the ordinary process of registry review. As a result of that review, various technical and legal defects were recorded that prevented registration. Those observations were entered in the corresponding review memorandum, and the document was subsequently dispatched. Since then, no new entries or actions have been recorded in the registry workflow.

Second, as to the property associated with the cadastral submission cited by the applicant, it was verified that it is property registered under folio PRN01 in the province of Guanacaste. The registry system contains the corresponding records and registry notices for that property, including various technical records that were considered during the review of the submission whose information concerns the applicant.

The foregoing facts constitute the relevant administrative background for the legal analysis that follows regarding the alleged violation of the fundamental rights invoked by the applicant.

Against that background, and having clarified the relevant administrative records in this matter, as a third point it is necessary to make a fundamental clarification regarding the legal nature of the information the applicant seeks to obtain.

This constitutional action is based on the assertion that the National Registry failed to provide a complete copy of a purported administrative file concerning cadastral submission number 2026-20814-C. However, that premise does not accord with the nature of the registry and cadastral action at issue or with the legal framework governing the activities of the Real Estate Registry.

As reported by the competent technical office in official letter DRI-869-2026, whose technical opinions have been incorporated into this report, the matter identified as cadastral submission 2026-20814-C is a registry and cadastral matter subject to the review procedure inherent in registry and cadastral functions. That activity does not create an administrative file in the terms provided for in Title II of the General Law of Public Administration.

On this point, it should be recalled that registry activity is governed by a special legal framework, characterized by the application of registry principles and the existence of its own technical procedures. The related records and tracking information are retained through institutional systems designed for those purposes.

Accordingly, when the applicant requests a ‘complete copy of the administrative file,’ the request presupposes the existence of a documentary record that, according to the information provided by the Real Estate Registry, does not exist in the form described in the application.

This does not mean that actions related to the registry submission lack documentary support or tracking mechanisms. On the contrary, the various actions taken in the review procedure are recorded in the relevant institutional systems, including the movements of the matter, the registry records consulted, the technical observations made, and the corresponding review memorandum. It is clarified, however, that these records do not constitute an administrative file assembled under the procedural rules invoked by the applicant.

Thus, the information associated with the registry request exists and is safeguarded in the relevant institutional systems; however, its organization, retention, and consultation reflect the nature of the registry and cadastral function, rather than the documentary structure of an ordinary administrative file.

Accordingly, the claim made in this constitutional proceeding rests on an incorrect legal characterization of the information held by the Administration. This circumstance must be considered when assessing whether there has been any violation of the fundamental rights invoked.

As a fourth matter of interest, it is necessary to address the alleged violation of the rights set out in Articles 27 and 30 of the Political Constitution, which the applicant invokes on the basis of the alleged failure to respond to the requests sent on 03 and 05 June 2026.

However, an examination of the circumstances established in the case file shows that the arbitrary omission required for an amparo proceeding to be granted did not occur.

As set out in the preceding section, the communications submitted by the applicant himself were sent to an email address that was not enabled to receive requests at the time of the events. It was also reported that the account had been disabled and then canceled before the emails at issue in this proceeding were sent.

In addition, it was verified that the institutional email system had been configured to generate an automatic response when it received communications sent to that account. The response informed the sender that the address used was no longer operational and expressly provided the official account enabled to receive and handle requests.

In these circumstances, there is no evidence that would permit attributing to the Administration an omission arising from its failure to process communications sent through an institutional channel that had previously been disabled, particularly when an automatic information mechanism existed specifically to direct members of the public to the official channel established for submitting their requests.

Likewise, without prejudice to the considerations set out regarding the nature of the information requested, no arbitrary denial of access to public information has been established.

Constitutional case law has recognized that the right of access to administrative information guarantees members of the public access to existing public information held by the Administration. However, the facts established do not show that the institution engaged in obstructive or arbitrary conduct aimed at preventing the exercise of that right.

Consequently, the established facts do not show an arbitrary denial of access to public information or an institutional omission capable of constituting the constitutional violation alleged by the applicant.

Finally, as a fifth relevant matter, it is necessary to address the alleged violation of the right of defense and due process invoked by the applicant. However, the circumstances established in this matter do not show any specific impairment of those constitutional guarantees.

Indeed, cadastral submission number PRN02 concerns a matter subject to the technical procedure for registry and cadastral review and remains pending registration because of the defects recorded during that process.

Nor is there any record of an administrative sanctioning proceeding, an action aimed at imposing obligations on the applicant or the applicant’s company, or an administrative decision that directly restricted their legal sphere or prevented them from exercising the ordinary rights of participation, hearing, or challenge provided for in the legal system.

Accordingly, there is no indication of arbitrary, unlawful, or unreasonable conduct attributable to the National Registry or the Real Estate Registry that would establish the constitutional violations alleged in the application.

IV. REQUEST FOR RELIEF

We request that this report regarding the facts at issue in this proceeding be deemed duly and timely submitted, in accordance with the constitutional-level provisions governing the matter, Articles 9, 11, 27, 30, 33, and 140 paragraph 8) of the Political Constitution and Article 32 of the Constitutional Jurisdiction Act. We further request that the Honorable Justices of the Chamber dismiss the amparo proceeding brought against the National Registry, since the applicant’s arguments do not allege violations of a constitutional nature.”

  1. 4By a brief received at 10:25 a.m. on 24 August 2026, the applicant submits as evidence for better determination two Defect Memoranda concerning the same cadastral submission No. 2026-20814-C. The applicant states that the respondents did not inform this Chamber of the existence of defects numbers 4 and 5, nor explain when, how, by whom, or on what basis they were eliminated, revoked, or rendered ineffective, despite asserting that the submission did not reenter the registry workflow. The applicant considers this circumstance particularly important because the two defects that no longer appear are precisely those related to public domain lands and the Maritime Terrestrial Zone, matters directly connected to the subject of this proceeding and to the collective and diffuse interests whose protection was invoked from the outset. The applicant requests:a) that the two Defect Memoranda concerning cadastral submission 2026-20814-C be admitted as evidence for better determination;b) that this amparo proceeding be granted and the respondents be ordered to make immediately and fully available to this party all existing information and documentation concerning cadastral submission 2026-20814-C, regardless of the name or form under which it is retained in the institutional systems;c) that they be ordered to provide the proposed cadastral map submitted, overlap maps, coordinates, technical and legal studies, registry records, the various versions of the Defect Memorandum, electronic records, and other documentation or tracking information related to that submission, especially information connected with defects numbers 4 and 5 concerning public domain lands and the Maritime Terrestrial Zone;d) that they be ordered to provide, together with that information, tracking information that makes it possible to determine when, how, by whom, and on what basis defects numbers 4 and 5 were eliminated, revoked, or rendered ineffective;e) that, in resolving this proceeding, the Chamber consider that the requested information is directly related to public domain property, the Maritime Terrestrial Zone, and collective and diffuse interests, and that access to it therefore extends beyond this party’s strictly private interest.
  2. 5The legal requirements have been observed in the proceedings conducted.

Justice Salazar Alvarado drafts; and, Reasons:

I. SUBJECT OF THE APPLICATION

The applicant states that on 03 June 2026, by email sent to account ...01, the applicant filed a request with the Property Registry seeking a complete copy of the qualification file / presentation appointment 2026-20814-C. The applicant also states that the request indicated a legitimate, direct, and current interest, as the applicant is the legal representative of a company that is the registered owner of property recorded under Folio Real PRN03, which is directly affected by the alleged overlaps, effects on the parcel status, and regulations of the Maritime Terrestrial Zone. Nevertheless, the applicant complains that, as of the filing of this amparo proceeding and despite 41 days having elapsed, no response has been received.

II. FACTS PROVEN

The following facts are considered duly established and relevant to the decision in this matter, either because they have been proven or because the respondent failed to address them, as required by the initial order:

  • a)On 03 June 2026, the applicant sent an information request to email address Cta.Bancaria01, seeking a complete copy of the qualification file / presentation appointment 2026-20814-C. (See the evidence submitted.)
  • b)The email address secretariabienesinmueblesrnp.go.cr ceased to be used on 28 October 2025, and communications are now handled through email ...02. (See the report submitted.)

III. RIGHT TO PETITION AND ACCESS TO PUBLIC INFORMATION

Article 27 of the Political Constitution establishes the right of every person, whether natural or legal, to approach any public body or entity to petition on a matter of interest to them. The Administration or administrative authority must resolve the matter in a timely, reasonable, consistent, and effective manner and within a short period. Article 30 of the Political Constitution, in turn, guarantees free access to administrative offices for the purpose of obtaining information on matters of public interest. This right is not unrestricted—like every constitutional right, it has limits—as State secrets remain protected. The aim is to ensure a transparent administrative function that allows people to access information of a public nature held by the various public entities and bodies. A distinction must nevertheless be made between administrative documents, which are available to everyone, and information concerning an administrative proceeding, which is available only to interested parties.

In this regard, this Chamber’s case law has clearly established that both rights require the competent public authority to take clear, positive action in response to a citizen’s request, while observing the deadlines for replying. Thus, if the request cannot be granted for reasons relating to its subject matter, the authority receiving it must explain, within the period prescribed by law, why it cannot comply.

IV. ON THE MERITS

In this case, the applicant alleged that information had been requested from the National Registry on 03 June 2026 and that no response had been received within a reasonable time. The applicant considers that this omission violated fundamental rights.

The respondent authority, for its part, asserted that the email address to which the applicant sent the information request, namely ...01, is not the official channel enabled to receive requests from users. According to the report submitted under oath, since December 2025 the email address provided for receiving requests has been ...02, and the authority therefore had no knowledge of the request submitted by the applicant.

For purposes of resolving this amparo proceeding, it is important to note that, in Judgment No. 2008-009670, issued at 09:55 a.m. on 13 June 2008, and reiterated on numerous occasions, most recently in No. 2026-003570, issued at 09:20 a.m. on 31 January 2026, this Chamber addressed the right to petition and the use of electronic means:

“(…) In the context of the information and knowledge society, fundamental rights may be exercised through new information technologies. As regards the right to petition and to a prompt response, the use of electronic means gives that right new nuances that must be weighed. Taking into account its progressive and expansive effectiveness, but also the fact that fundamental rights are not absolute, it may be concluded that, to exercise the right to petition and to a prompt response using the means made available by new technologies, the request should be channeled through a freely accessible website of the public entity or body. In addition, that electronic domain must have a hyperlink leading to an email address specifically provided to receive requests, whether on a particular subject or as an inbox for all types of requests (…)”. (To the same effect, see Judgment No. 2021-000297, issued at 09:15 a.m. on 08 January 2021, and No. 2026-011092, issued at 09:20 a.m. on 27 March 2026, among others.)

In light of this and according to this Chamber’s settled case law, requests made by email must be sent to the official email address established by the Administration. Since it has been established in this case that the email account to which the applicant sent the request is no longer an official channel for handling external requests, having been disabled in December 2025, there has been no violation of the right to petition or the right of access to information.

The requests made by the applicant in the brief entered in the case file at 10:25 a.m. on 24 August 2026 are aimed primarily at challenging how a cadastral submission was processed, the technical and legal correctness of the actions taken by the competent administrative offices, and, in particular, the reasons for modifying or removing certain defects identified during that process. This claim requires an examination of technical, registry, and procedural matters that calls for a review of ordinary legality beyond the scope of an amparo proceeding. Determining whether the identified defects were justified, whether their subsequent modification was proper, whether the technical studies were sufficient, and whether those actions complied with the registry, cadastral, and Maritime Terrestrial Zone rules is a task for the administrative authorities and, where appropriate, the competent ordinary courts, not the constitutional jurisdiction.

Accordingly, claims seeking a comprehensive reconstruction of the administrative tracking record, clarification of the technical grounds for particular registry decisions, or review of the legal correctness of those actions concern matters of ordinary legality. Since no current, direct, and independent violation of the fundamental right of access to administrative information warranting protection in this forum has been established, the application must be dismissed.

Therefore, the proper course is to dismiss this application in all respects.

V. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must collect these from the office within a maximum period of thirty working days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at Session No. 43-12, held on 3 May 2012, Article LXXXI.

Therefore:

The application is dismissed.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 26-025211-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el REGISTRO NACIONAL.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala y, agregado al expediente a las 11:50 horas del 14 de julio de 2026, el recurrente interpone recurso de amparo contra el Registro Nacional. Manifiesta en resumen que, el 03 de junio de 2026, mediante correo electrónico dirigido a la cuenta ...01, interpuso ante el Registro de la Propiedad una gestión solicitando copia íntegra del expediente de calificación / cita de presentación 2026-20814-C. Expone que, en esta, además, indicó que ostenta interés legítimo, directo y actual, pues es representante legal de una sociedad que es propietaria registral de la finca inscrita Folio Real PRN03, el cual se encuentra directamente afectado por los presuntos traslapes, afectaciones al estado parcelario y regulaciones de la Zona Marítimo Terrestre. No obstante, reclama que, a la fecha de interposición de este proceso de amparo y a pesar de haber transcurrido 41 días, no ha recibido respuesta alguna. Por tales motivos, solicita la intervención de esta Sala.
  2. 2Por resolución de las 10:14 horas del 11 de agosto de 2026, se dio curso al presente recurso y se le concedió audiencia al Director General y al Director del Registro Inmobiliario, ambos del Registro Nacional, sobre los hechos alegados por la parte recurrente.
  3. 3Informan bajo juramento Agustín Meléndez García y Gabriela Carranza Araya, bajo ese mismo orden Director General y Directora a.i. del Registro Inmobiliario, ambos del Registro Nacional, que:
“(...) II. SOBRE LA DIRECCIÓN ELECTRÓNICA UTILIZADA POR EL RECURRENTE. En relación con la afirmación del recurrente de que el Registro Nacional omitió atender las solicitudes de acceso y copia de expediente remitidas los días 3 y 5 de junio de 2026, resulta imperativo precisar una serie de circunstancias fácticas y jurídicas determinantes para la adecuada resolución del presente asunto.

Como punto de partida, debe señalarse que la Sala Constitucional ha reconocido reiteradamente que los derechos fundamentales de petición y pronta respuesta, así como el derecho de acceso a la información administrativa, pueden ejercerse válidamente mediante el uso de medios electrónicos, siempre que estos correspondan a los canales oficiales dispuestos por la Administración para la recepción de gestiones.

En ese sentido, mediante la sentencia N2008-009670 de las 09:55 horas del 13 de junio de 2008, ese Tribunal destacó que el ejercicio de tales derechos a través de las tecnologías de la información exige que la gestión sea canalizada mediante los medios electrónicos habilitados por la institución respectiva para la recepción de solicitudes por parte de los administrados, al disponer para lo de interés: “En el marco de la sociedad de la información y el conocimiento, los derechos fundamentales pueden ser ejercidos a través de las nuevas tecnologías de la información. En lo que al derecho de petición y pronta respuesta se refiere, la utilización de los medios electrónicos le da nuevos matices, los cuales, deben ser ponderados. Siempre teniendo en consideración su eficacia progresiva y expansiva, pero también, tomando en cuenta el carácter no absoluto de los derechos fundamentales, es posible concluir que, para el ejercicio del derecho de petición y pronta respuesta, empleando los medios que las nuevas tecnologías facilitan, es importante, que el requerimiento sea canalizado a través de una página web de libre acceso del ente o el órgano público.

Adicionalmente, ese dominio electrónico debe contar con un hipervínculo direccionado hacia un correo electrónico dispuesto, específicamente, para recibir solicitudes, sea sobre un tema particular o bien que sirva como buzón para todo tipo gestiones” (el resaltado es propio) (véase también 2017-5247 de las 10:00 horas del 07 de abril del 2017 y 24745–2026 de las 09:25 horas del 02 de julio de 2026).

Partiendo de dicha premisa, es importante destacar que la prueba aportada por el propio recurrente acredita que las comunicaciones electrónicas de fechas 03 y 05 de junio de 2026 fueron remitidas a la dirección ...01.

Sin embargo, según consta en los registros institucionales del Registro Nacional y del Registro Inmobiliario —véase prueba aportada—, dicha dirección electrónica dejó de encontrarse operativa desde el 28 de octubre de 2025, fecha a partir de la cual fue deshabilitada como medio de comunicación institucional.

Posteriormente, el 05 de diciembre de 2025, la cuenta fue cancelada de manera definitiva, sustituyéndose por la dirección electrónica oficial ...02, la cual constituye desde entonces el canal vigente para la recepción y atención de las gestiones dirigidas a esa dependencia.

La relevancia de esta circunstancia radica en que la deshabilitación de la cuenta no operó de manera silenciosa ni impidió al interesado conocer el mecanismo correcto para canalizar su solicitud, sino que, por el contrario, cuando un usuario remitía comunicaciones a la dirección electrónica descontinuada, el sistema generaba automáticamente un mensaje de devolución informando expresamente que la cuenta receptora se encontraba bloqueada y que cualquier gestión debía dirigirse a la dirección oficial vigente del Registro Inmobiliario, sea ...02.

De conformidad con el oficio DRI-869-2026 de fecha 17 de agosto de 2026, aportado como prueba en este informe se desprende precisamente la existencia de dicho mecanismo de respuesta automática, mediante el cual se comunicaba al remitente que el mensaje no podía ser entregado y se le indicaba de forma expresa la dirección electrónica correcta a la cual debía remitir su solicitud.

En consecuencia, los correos electrónicos enviados por el recurrente los días 03 y 05 de junio de 2026 no ingresaron a una cuenta institucional habilitada para la recepción y tramitación de gestiones, ni tampoco llegaron a conocimiento de la dependencia competente a través del canal oficial dispuesto para tales efectos.

Adicionalmente, el propio sistema institucional tuvo que haberle informado de manera automática al remitente sobre dicha circunstancia y señalarle expresamente el medio electrónico que debía utilizar para plantear válidamente su requerimiento.

Bajo estas condiciones, no resulta posible concluir que existiera una conducta omisiva atribuible a la Administración, pues la alegada falta de respuesta no deriva de una negativa institucional a tramitar la gestión ni de una inactividad injustificada por parte del Registro Nacional o del Registro Inmobiliario, sino del hecho objetivo de que la solicitud fue remitida a una dirección electrónica que había sido deshabilitada y respecto de la cual la plataforma de correo electrónico fue parametrizada para emitir una respuesta automática notificando que la cuenta se encuentra fuera de servicio e informando el nuevo canal de atención habilitado.

Por ello, a la luz de la jurisprudencia constitucional relativa al ejercicio de derechos fundamentales mediante medios electrónicos, no puede estimarse configurada la omisión que se atribuye a esta Administración, en tanto la gestión invocada en el recurso no fue presentada a través de un medio institucional vigente y habilitado para su recepción, circunstancia que impide imputar al Registro Nacional, propiamente al Registro Inmobiliario, las consecuencias derivadas de la utilización de una dirección electrónica que había sido oficialmente sustituida con varios meses de anterioridad a los hechos aquí discutidos.

III. INFORME SOBRE LAS ACTUACIONES ADMINISTRATIVAS LLEVADAS A CABO EN EL CASO CONCRETO

Con el propósito de brindar a esa Sala una relación integral de los hechos, el presente informe se fundamenta en el criterio técnico emitido por la Dirección del Registro Inmobiliario mediante el oficio DRI-869-2026, así como en la verificación de los antecedentes documentales que constan, de los cuales se desprenden las siguientes actuaciones y circunstancias administrativas.

En primer término, resulta pertinente señalar que el objeto de la solicitud del recurrente correspondía a la presentación catastral número 2026-20814-C, trámite que se encuentra asociado a una gestión de inscripción registral presentada ante el Catastro Nacional.

Sobre este aspecto, se indicó que el trámite en cuestión no corresponde a un plano catastrado inscrito ni a una inscripción registral perfeccionada, sino a una presentación que ingresó a la corriente registral para su respectiva calificación y que actualmente se mantiene reportada en el Sistema de Información de Planos (SIP) con condición de trámite defectuoso y pendiente de inscripción.

De acuerdo con la información suministrada por la dependencia técnica competente, dicha presentación ingresó al sistema registral el día 10 de marzo de 2026 y fue objeto del proceso ordinario de calificación registral, como resultado de dicha revisión, se consignaron diversos defectos técnicos y jurídicos que impidieron su inscripción; tales observaciones fueron incorporadas en la correspondiente minuta de calificación y posteriormente, el documento fue despachado y, desde entonces, no registra nuevos ingresos ni actuaciones dentro de la corriente registral.

Como segundo aspecto de relevancia, sobre el inmueble vinculado a la presentación catastral citada por el recurrente, se verificó que corresponde a la finca matrícula PRN01 de la provincia de Guanacaste, inmueble respecto del cual constan en el sistema registral los antecedentes y publicidades registrales correspondientes, incluyendo diversos antecedentes técnicos que fueron considerados durante el proceso de calificación de la presentación cuya información interesa al accionante.

Los hechos expuestos constituyen los antecedentes administrativos relevantes que sirven de base para el análisis jurídico que se desarrollará más adelante respecto de la alegada lesión de los derechos fundamentales invocados por el recurrente.

Bajo ese panorama y una vez precisados los antecedentes administrativos relevantes del presente asunto, como tercer punto resulta necesario efectuar una aclaración fundamental respecto de la naturaleza jurídica de la información cuya entrega pretende el recurrente.

La presente acción constitucional parte de la afirmación de que el Registro Nacional omitió suministrar copia íntegra de un supuesto expediente administrativo relacionado con la presentación catastral número 2026-20814-C, sin embargo, dicha premisa no corresponde con la naturaleza propia de la actuación registral-catastral involucrada ni con el régimen jurídico que regula la actividad desarrollada por el Registro Inmobiliario.

Según informó la dependencia técnica competente en el oficio DRI-869-2026, cuyos criterios técnicos han sido incorporados al presente informe, la gestión identificada con la presentación catastral 2026-20814-C corresponde a un trámite registral-catastral sometido al procedimiento de calificación propio de la función registral y catastral, actividad que no genera la conformación de un expediente administrativo en los términos previstos en el Título II de la Ley General de la Administración Pública.

Sobre este extremo debe recordarse que la actividad registral se encuentra sometida a un régimen jurídico especial, caracterizado por la aplicación de los principios registrales y por la existencia de procedimientos técnicos propios, cuya documentación y trazabilidad se conservan mediante los sistemas institucionales diseñados para esos efectos.

En consecuencia, cuando el recurrente solicita la entrega de una "copia íntegra del expediente administrativo", parte de la existencia de un objeto documental que, conforme a la información suministrada por el Registro Inmobiliario, no existe bajo la forma en que ha sido descrito en el recurso.

Lo anterior no significa que las actuaciones relacionadas con la presentación registral carezcan de respaldo documental o de mecanismos de trazabilidad, por el contrario, las distintas actuaciones realizadas dentro del procedimiento de calificación quedan registradas en los sistemas institucionales respectivos, incluyendo los movimientos del trámite, los antecedentes registrales consultados, las observaciones técnicas efectuadas y la correspondiente minuta de calificación, no obstante se aclara que tales registros no constituyen un expediente administrativo conformado bajo las reglas procedimentales invocadas por el accionante.

De esta manera, la información vinculada con la gestión registral existe y se encuentra resguardada en los sistemas institucionales correspondientes; sin embargo, su organización, conservación y consulta responden a la naturaleza propia de la función registral-catastral y no a la estructura documental de un expediente administrativo ordinario.

Así las cosas, la pretensión formulada en esta sede constitucional se sustenta en una caracterización jurídica incorrecta de la información que obra en poder de la Administración, circunstancia que resulta indispensable considerar al momento de valorar la existencia o no de una eventual lesión a los derechos fundamentales invocados.

Como cuarto aspecto de interés corresponde referirse a la alegada vulneración de los derechos consagrados en los artículos 27 y 30 de la Constitución Política, invocada por el recurrente con fundamento en la supuesta falta de respuesta a las solicitudes remitidas los días 03 y 05 de junio de 2026.

Sin embargo, el examen de las circunstancias acreditadas en el expediente evidencia que no se configuró la omisión arbitraria que constituye el presupuesto indispensable para la procedencia del recurso de amparo.

Tal y como quedó expuesto en el apartado anterior, las comunicaciones aportadas por el propio accionante fueron dirigidas a una dirección electrónica que no se encontraba habilitada para la recepción de gestiones al momento de los hechos, se informó además que dicha cuenta había sido deshabilitada y posteriormente cancelada con anterioridad a la remisión de los correos electrónicos objeto de este proceso.

Adicionalmente, se verificó que el sistema institucional de correo electrónico había sido configurado para generar una respuesta automática cuando se recibieran comunicaciones dirigidas a dicha cuenta, mediante la cual se informaba al remitente que la dirección utilizada ya no se encontraba operativa y se le indicaba expresamente la cuenta oficial habilitada para la recepción y atención de sus solicitudes.

Bajo tales circunstancias, no se advierten elementos que permitan atribuir a la Administración una conducta omisiva derivada de la falta de gestión de comunicaciones remitidas a un canal institucional previamente deshabilitado, máxime cuando existía un mecanismo automático de información destinado precisamente a orientar al administrado hacia el medio oficial dispuesto para la presentación de sus requerimientos.

De igual forma, y sin perjuicio de las consideraciones desarrolladas respecto de la naturaleza de la información solicitada, tampoco se acredita una negativa arbitraria de acceso a información pública.

La jurisprudencia constitucional ha reconocido que el derecho de acceso a la información administrativa garantiza a los administrados el conocimiento de la información pública existente y bajo custodia de la Administración, sin embargo, del cuadro fáctico acreditado no se desprende que la institución haya desplegado una conducta obstructiva o arbitraria tendente a impedir el ejercicio de ese derecho.

En consecuencia, de los hechos acreditados no se desprende una negativa arbitraria de acceso a la información pública ni una omisión institucional susceptible de configurar la lesión constitucional alegada por el recurrente.

Finalmente, como quinto aspecto relevante, corresponde referirse a la alegada vulneración del derecho de defensa y del debido proceso invocada por el recurrente. Sin embargo, de las circunstancias acreditadas en el presente asunto no se desprende la existencia de una afectación concreta a tales garantías constitucionales.

En efecto, la presentación catastral número PRN02 corresponde a un trámite sometido al procedimiento técnico de calificación registral-catastral y actualmente permanece pendiente de inscripción debido a los defectos consignados durante dicho proceso.

Asimismo, no consta la existencia de un procedimiento administrativo sancionador, de una actuación dirigida a imponer obligaciones al recurrente o a su representada, ni de una decisión administrativa que haya restringido directamente su esfera jurídica o respecto de la cual se les hubiese impedido ejercer los mecanismos ordinarios de participación, audiencia o impugnación previstos en el ordenamiento jurídico.

En consecuencia, no se advierte la existencia de una actuación arbitraria, ilegal o irrazonable atribuible al Registro Nacional o al Registro Inmobiliario que permita tener por configuradas las lesiones constitucionales alegadas en el recurso.

IV. PETITORIA

Solicitamos se tenga por rendido en forma y tiempo el informe en relación con los hechos objeto del presente recurso y conforme la normativa de rango constitucional que rige la materia, artículos 9, 11, 27, 30, 33 y 140 inciso 8) de la Constitución Política y 32 de la Ley de la Jurisdicción Constitucional y se solicita a los Honorables Magistrados de la Sala, que se declare sin lugar el Recurso de Amparo interpuesto en contra del Registro Nacional, por no constituir los argumentos que ha alegado el recurrente infracciones de carácter constitucional.”

  1. 4Por escrito ingresado a las 10:25 horas del 24 de agosto de 2026, el recurrente aporta como prueba para mejor resolver, dos Minutas de Defectos correspondientes a la misma presentación catastral N.° 2026-20814-C . Refiere que, los recurridos no informaron a esta Sala sobre la existencia de los defectos números 4 y 5, ni explicaron cuándo, cómo, por quién y con qué fundamento fueron eliminados, revocados o dejados sin efecto, pese a afirmar que la presentación no volvió a ingresar a la corriente registral. Estima que, la circunstancia reviste especial importancia porque los dos defectos que dejaron de aparecer son precisamente aquellos relacionados con terrenos demaniales y con la Zona Marítimo Terrestre, materias directamente vinculadas con el objeto del presente recurso y con los intereses colectivos y difusos cuya tutela fue invocada desde su interposición. Solicita: a) tener por aportadas, como prueba para mejor resolver, las dos Minutas de Defectos correspondientes a la presentación catastral 2026-20814-C. b) Declarar con lugar el presente recurso de amparo y ordenar a los recurridos poner a disposición de esta parte, de forma inmediata e íntegra, toda la información y documentación existente relacionada con la presentación catastral 2026-20814-C, independientemente de la denominación o forma bajo la cual sea conservada en los sistemas institucionales;c) ordenar la entrega de la propuesta de plano presentada, mapas de traslape, coordenadas, estudios técnicos y jurídicos, antecedentes registrales, distintas versiones de la Minuta de Defectos, registros electrónicos y demás documentación o trazabilidad relacionada con dicha presentación, especialmente aquella vinculada con los defectos números 4 y 5, relativos a terrenos demaniales y Zona Marítimo Terrestre.;d) Ordenar que, junto con dicha información, los recurridos aporten la trazabilidad que permita determinar cuándo, cómo, por quién y con qué fundamento fueron eliminados, revocados o dejados sin efecto los defectos números 4 y 5;e) Valorar, al resolver el presente recurso, que la información solicitada se encuentra directamente relacionada con bienes de dominio público, Zona Marítimo Terrestre e intereses colectivos y difusos, por lo que su acceso trasciende el interés estrictamente particular de esta parte.
  2. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente manifiesta que, el 03 de junio de 2026, mediante correo electrónico dirigido a la cuenta ...01, interpuso ante el Registro de la Propiedad una gestión solicitando copia íntegra del expediente de calificación / cita de presentación 2026-20814-C. Expone que, también indicó que ostenta interés legítimo, directo y actual, pues es representante legal de una sociedad que es propietaria registral de la finca inscrita Folio Real PRN03, el cual se encuentra directamente afectado por los presuntos traslapes, afectaciones al estado parcelario y regulaciones de la Zona Marítimo Terrestre. No obstante, reclama que, a la fecha de interposición de este proceso de amparo y a pesar de haber transcurrido 41 días, no ha recibido respuesta alguna.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El 03 de junio de 2026, el recurrente remitió una solicitud de información a la dirección electrónica Cta.Bancaria01, mediante la cual requirió copia íntegra del expediente de calificación / cita de presentación 2026-20814-C. (véase al respecto la prueba aportada)
  • b)La dirección electrónica secretariabienesinmueblesrnp.go.cr dejó de utilizarse desde el 28 de octubre de 2025, por lo que las comunicaciones actualmente se gestionan mediante el correo ...02. (véase al respecto el informe rendido)

III. SOBRE EL DERECHO DE PETICIÓN Y ACCESO A LA INFORMACIÓN PÚBLICA

El artículo 27, de la Constitución Política, consagra el derecho que tiene toda persona, tanto física como jurídica, de acudir a cualquier órgano o entidad pública a peticionar sobre un asunto de su interés, el cual deberá ser resuelto por la Administración o autoridad administrativa, en forma oportuna, razonable, congruente, eficaz y en un plazo breve. Por otra parte, el artículo 30, de la Constitución Política, garantiza el libre acceso a los departamentos administrativos con propósitos de información sobre asuntos de interés público, el cual no es irrestricto -pues como todo derecho constitucional posee límites-, ya que quedan a salvo los secretos de Estado. Se procura así una función administrativa transparente, que permita a los sujetos acceder a la información de naturaleza pública que se encuentra en poder de los distintos entes u órganos públicos. Sin embargo, se debe hacer una distinción entre documentación administrativa -disponible para todos- e información relativa a un procedimiento administrativo -disponible solo para las partes interesadas-.

Dentro de este orden de ideas, la jurisprudencia de esta Sala ha establecido con claridad que ambos derechos, exigen a la autoridad pública competente, una acción positiva y clara ante la petición de un ciudadano, respetando los plazos establecidos para dar contestación. Así, si la solución no puede darse por razones de la materia, la autoridad requerida está obligada a explicar, dentro del plazo exigido por la ley, las razones por las cuales no pueda darse cumplimiento a lo pedido.

IV. SOBRE EL FONDO

En el presente caso, el recurrente alegó que solicitó información pública al Registro Nacional en fecha 03 de junio de 2026 y no recibió respuesta dentro de un plazo razonable. Considera que dicha omisión constituye una lesión a sus derechos fundamentales.

Por su parte, la autoridad recurrida afirmó que el correo electrónico al cual el recurrente remitió la solicitud de información, siendo este ...01 no constituye el medio oficial habilitado para la recepción de gestiones de los usuarios. Según se indicó en el informe rendido bajo juramento, desde diciembre de 2025 el correo dispuesto para la recepción de solicitudes es ...02, por lo que no tuvo conocimiento de la solicitud gestionada por el tutelado.

De importancia para la resolución de este amparo, es importante indicar que esta Sala en la Sentencia N° 2008-009670 de las 09:55 horas de 13 de junio de 2008, reiterada en múltiples ocasiones, como recientemente en la N° 2026-003570, de las 09:20 horas del 31 de enero de 2026, abordó lo relativo al derecho de petición y el empleo de medios electrónicos:

“(…) En el marco de la sociedad de la información y el conocimiento, los derechos fundamentales pueden ser ejercidos a través de las nuevas tecnologías de la información. En lo que al derecho de petición y pronta respuesta se refiere, la utilización de los medios electrónicos le da nuevos matices, los cuales, deben ser ponderados. Siempre teniendo en consideración su eficacia progresiva y expansiva, pero también, tomando en cuenta el carácter no absoluto de los derechos fundamentales, es posible concluir que, para el ejercicio del derecho de petición y pronta respuesta, empleando los medios que las nuevas tecnologías facilitan, es importante, que el requerimiento sea canalizado a través de una página web de libre acceso del ente o el órgano público. Adicionalmente, ese dominio electrónico debe contar con un hipervínculo direccionado hacia un correo electrónico dispuesto, específicamente, para recibir solicitudes, sea sobre un tema particular o bien que sirva como buzón para todo tipo gestiones (…)”.

(Igual sentido ver Sentencia N° 2021-000297, de las 09:15 horas del 08 de enero de 2021, y N° 2026-011092, de las 09:20 horas del 27 de marzo de 2026, entre otras) Desde este panorama y según jurisprudencia reiterada de esta Sala, las gestiones planteadas mediante correo electrónico deben ser dirigidas al correo oficial dispuesto por la Administración. De manera, que al acreditarse, en este caso, que la cuenta electrónica a la cual el recurrente remitió su gestión actualmente no es un mecanismo oficial para atender las gestiones externas, debido a que se encuentra deshabilitado desde diciembre de 2025, no se puede tener por violado el derecho de petición y de acceso a información.

En relación con las solicitudes efectuadas por el recurrente en el escrito ingresado al expediente, a las 10:25 horas del 24 de agosto de 2026, dichos alegatos se encuentran dirigidos fundamentalmente a cuestionar la forma en que se tramitó una presentación catastral, la corrección técnica y jurídica de las actuaciones realizadas por las dependencias administrativas competentes y, particularmente, las razones que motivaron la modificación o supresión de determinados defectos advertidos durante dicho trámite. Tal planteamiento supone un examen de aspectos técnicos, registrales y procedimentales que demandan una valoración de legalidad ordinaria ajena al objeto del recurso de amparo. De manera que, determinar la procedencia de los defectos señalados, la corrección de su posterior modificación, la suficiencia de los estudios técnicos realizados, así como la conformidad de tales actuaciones con la normativa registral, catastral y de zona marítimo-terrestre, constituye una labor que corresponde a las autoridades administrativas y, en su caso, a las jurisdicciones ordinarias competentes, mas no a la jurisdicción constitucional.

De esta forma, las pretensiones dirigidas a obtener una reconstrucción integral de la trazabilidad administrativa del expediente, a esclarecer las motivaciones técnicas que sustentaron determinadas decisiones registrales o a cuestionar la corrección jurídica de tales actuaciones, constituyen materias propias de la legalidad ordinaria. En consecuencia, al no verificarse una lesión actual, directa y autónoma del derecho fundamental de acceso a la información administrativa susceptible de tutela en esta sede, el recurso debe ser declarado sin lugar.

En consecuencia, lo procedente es declarar sin lugar el presente recurso en todos sus extremos.

V. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
