Amparo proceeding filed under case number 26-024687-0007-CO, brought by Nombre01, identity card CED01, against the MUNICIPALITY OF PÉREZ ZELEDÓN.
Background:

Before considering the merits of the matter, it must be clarified that, beginning with judgment no. 2008002545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred matters to the administrative-litigation jurisdiction—with some exceptions—in which the issue is whether the public administration has complied with the time limits set by the General Law on Public Administration (Articles 261 and 325) or sectoral laws governing special administrative proceedings, either to issue a final decision in an administrative proceeding—initiated ex officio or at a party’s request—or to hear the available administrative appeals. This case presents an exception, since it concerns an alleged delay in deciding a complaint regarding work carried out by the respondent Municipality that could endanger the applicant’s physical integrity. That clarified, the specific situation raised in this amparo will now be decided.
The applicant claims that, on 16 April 2026, the Municipality of Pérez Zeledón carried out work with heavy machinery on municipal land adjoining the back of her house. She asserts that, to access the land, they cut the fence around the children’s playground. She comments that the work involved moving earth to level the land. She alleges that the Municipality’s actions weakened and structurally damaged the wall at the back of her property. She maintains that the base of the wall was exposed, leaving the structure uncovered. She indicates that the land was left unstable, causing collapses, and that an opening was created beneath the wall through which her dogs escaped. She alleges that trees were cut down and thrown into the ravine, tires were planted in a protection zone, and children were given access to the bottom of the ravine and the sugarcane field, despite the fact that the watercourse rises substantially during the rainy season and there are snakes. She mentions that on 20 April 2026 she submitted a written request to the respondent authority, as recorded in official letter OFI-020-26-CDS. She explains that, subsequently, in the absence of a response, she reiterated her request in a written submission addressed to the mayor. She indicates that the problem had not been resolved.
The following facts are considered duly established and relevant to deciding this matter:

She alleges that the Municipality’s actions weakened and structurally damaged the wall at the back of her property. The record shows that, on 20 April 2026, the applicant submitted a request to the Municipality of Pérez Zeledón, which was assigned no. SOL-0006-26-CDS. The complaint stated only: “Earthworks on municipal land by a neighbor, who says that he has the required permits.” Accordingly, in official letter OFI-117-26-SSM dated 14 July 2026, addressed to the applicant, the Municipal Services coordinator stated: “Please accept this letter as a greeting and as a response to your request, in which you indicate that earthworks are being carried out on municipal land and are affecting your property. In this regard, I inform you that the corresponding inspection was conducted and it was determined that there is no impact on your property. In addition, the surveyor indicated that there are no problems with your property boundaries. We also inform you that the work carried out on the municipal property has been halted.” Further, in official letter OFI-020-26-CDS dated 14 July 2026, addressed to the person seeking protection, the Municipality’s Services Comptroller clarified: “Please accept my cordial greetings and best wishes for success in your daily work.
I also take this opportunity to inform you that, regarding your request submitted on 20 April 2026 concerning the impact on your property caused by work on municipal property, and in relation to the report issued by Ms. Lorena Núñez Blanco in her capacity as Municipal Services coordinator through documents OFI-065-26-SSM and OFI-117-26-SSM, which states that there is no impact on your property, your request is therefore being closed. We appreciate the request you submitted, as it contributes to the institution’s continuous improvement.” Earlier, it is established that, in a written submission received by the Municipality of Pérez Zeledón on 15 July 2026, the applicant stated: “On 16 April 2026, heavy machinery carried out work on the municipal land adjoining my property, directly affecting my property—specifically, weakening and structurally damaging the wall at the back, exposing its foundations, destabilizing the land, and creating an opening underneath it.
Those interventions also involved removing the fence from the area designated as a playground, leaving the land completely open, without any fencing or safety measures, despite the presence of a ravine at the site. As a direct consequence, a hole was created through which my animals (dogs) escaped. They are aggressive, which considerably increases the risk, since anyone entering the area, especially minors, could be seriously harmed. This creates an imminent danger both because of the exposed ravine and the lack of access control, a situation the Municipality should have prevented. In addition, it is important to note that those interventions were carried out without environmental viability, MINAE authorization, or measures to mitigate harm to third parties, aggravating the situation and showing that the actions were irregular. It should be noted that the individual who entered with machinery consistently stated that he had municipal permits to carry out this work.
However, the results of these interventions—damage to my property, removal of fencing, and creation of risk—call into question the legality, scope, and proper oversight of those permits, if they existed. Based on these facts, I submitted a formal request to the Municipality seeking an inspection, demarcation of property boundaries, repair of the damage, and safety measures. Nevertheless, to date I have received no response from the Mayor’s Office, the Services Comptroller, or any municipal department, and the problem remains unresolved and the risk continues.” Finally, it is established that, on 17 August 2026, the respondent authorities were notified of the order correcting the order admitting the case for processing.
Accordingly, the amparo must be dismissed. In this regard, note that the request of 20 April 2026 was decided by official letters OFI-117-26-SSM and OFI-020-26-CDS, both dated 14 July 2026—that is, well before the respondents were notified of the order admitting this amparo for processing and, therefore, without intervention by the Chamber.
Likewise, the applicant is advised that any disagreement with the response received or the conclusion reached by the Municipality is a matter of ordinary legality, outside this Court’s jurisdiction. Accordingly, if she so wishes, the applicant may pursue her claims through the administrative or ordinary judicial avenue she deems appropriate.
Lastly, this Chamber refrains from ruling on the request of 15 July 2026, first because it exceeds the scope of this proceeding and, second, because the applicant submitted it to the municipal corporation after this proceeding was filed (9 July 2026).
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in the administrative forum, the administrative-litigation courts, rather than this Chamber, must hear the legal dispute. However, with the recent enactment of Law No. 9097, Law Regulating the Right of Petition, it has been established that this right may be protected judicially through the amparo proceeding provided for in Article 32 of the Constitutional Jurisdiction Act, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not mean that this Court must change its line of case law; under Article 7 of its Law, this Court alone defines its own jurisdiction.
Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo remedy, in all other cases the competent judges are those of the administrative-litigation jurisdiction, for the reasons this Court has given (judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008). All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable legal provisions, based on a logical, systemic, and teleological interpretation of the legal system.
As a general principle, I consider that cases related to the activity or inactivity of the Public Administration in the repair, construction, modification, or demolition of any infrastructure work should be dismissed, because such an omission is a matter of legality whose discussion belongs in the ordinary jurisdiction, where the interested person can address their disagreements more fully. However, when that administrative conduct, whether by action or omission, gives rise to a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do consider the merits of the matter, since this situation is an exception to my position in this area. That is the case here, where it is alleged that on 16 April 2026 the Municipality of Pérez Zeledón carried out work with heavy machinery on municipal land adjoining the back of the applicant’s house, causing significant damage both to the children’s playground and to her property, and placing her rights, as well as those of the people and minors who visit the site, at risk.
The parties are advised that any paper documents, as well as objects or evidence contained on electronic, computer, magnetic, optical, telematic, or new technology devices, must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Any such material not collected within this period will be destroyed, as provided in the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011, published in Judicial Bulletin no. 19 of 26 January 2012, as well as in the resolution of the Judicial Branch’s Superior Council, approved in Article LXXXI of session no. 43-12 held on 3 May 2012.
Therefore:
The amparo is dismissed. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número 26-024687-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE PÉREZ ZELEDÓN.
Resultando:
Redacta la Magistrada Hess Herrera; y,
Considerando:
Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite se plantea un supuesto de excepción, pues se está ante la supuesta dilación en resolver una denuncia relativa a una obra realizada por la municipalidad acciona que podría poner en peligro la integridad de la recurrente. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.
La parte recurrente reclama que, el 16 de abril de 2026, la municipalidad de Pérez Zeledón realizó trabajos con maquinaria pesada en un terreno municipal que colinda con la parte trasera de su casa. Asegura que, para ingresar al terreno, cortaron la malla del parque de juegos de niños. Comenta que, en esos trabajos se removieron tierras para nivelar el terreno. Acusa que las acciones de la municipalidad provocaron el debilitamiento y daño estructural de su tapia trasera. Sostiene que se descubrió la base de la tapia, dejando expuesta la estructura. Indica que el terreno quedó inestable, provocando desmoronamientos y se generó un acceso por debajo de la tapia que permitió la salida de sus perros. Alega que se talaron árboles que fueron arrojados a la quebrada, se sembraron llantas en zona de protección y se habilitó el acceso de niños hasta el fondo de la quebrada y el cañal, pese a que en época de lluvias el cuerpo de agua crece mucho y hay serpientes. Menciona que el 20 de abril de 2026 planteó una gestión por escrito ante la autoridad recurrida, según consta en el oficio OFI-020-26-CDS. Explica que, posteriormente, ante la ausencia de respuesta, reiteró su solicitud mediante escrito dirigido al alcalde. Indica que no se había solucionado el problema.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
En el sub lite, la parte recurrente reclama que, el 16 de abril de 2026, la municipalidad de Pérez Zeledón realizó trabajos con maquinaria pesada en un terreno municipal que colinda con la parte trasera de su casa. Asegura que, para ingresar al terreno, cortaron la malla del parque de juegos de niños. Comenta que, en esos trabajos se removieron tierras para nivelar el terreno. Acusa que las acciones de la municipalidad provocaron el debilitamiento y daño estructural de su tapia trasera. Sostiene que se descubrió la base de la tapia, dejando expuesta la estructura. Indica que el terreno quedó inestable, provocando desmoronamientos y se generó un acceso por debajo de la tapia que permitió la salida de sus perros. Alega que se talaron árboles que fueron arrojados a la quebrada, se sembraron llantas en zona de protección y se habilitó el acceso de niños hasta el fondo de la quebrada y el cañal, pese a que en época de lluvias el cuerpo de agua crece mucho y hay serpientes. Menciona que el 20 de abril de 2026 planteó una gestión por escrito ante la autoridad recurrida, según consta en el oficio OFI-020-26-CDS. Explica que, posteriormente, ante la ausencia de respuesta, reiteró su solicitud mediante escrito dirigido al alcalde. Indica que no se había solucionado el problema.
De los autos se desprende que, el 20 de abril de 2026, la accionante planteó una gestión ante la Municipalidad de Pérez Zeledón, a la que se le asignó el nro. SOL-0006-26-CDS. En tal denuncia únicamente se indicó: “Movimiento de tierra en terreno Municipal por parte de un vecino, según indica el señor tiene los permisos requeridos”.
Así, por oficio OFI-117-26-SSM del 14 de julio de 2026, dirigido a la recurrente, la coordinadora de Servicios Municipales consignó: “Sírvase la presente para saludarle y a la vez brindar respuesta a su solicitud donde indica que existe un terreno municipal donde se están realizando movimientos de tierra y esto está afectando su propiedad. De lo anterior le indico que se realizó la inspección correspondiente y se determina que no hay afectación a su propiedad. Además, el ingeniero topógrafo indicó que no hay problemas con los linderos de su propiedad. Por otro lado, le indicamos que los trabajos realizados a la propiedad municipal fueron paralizados”.
Además, por oficio OFI-020-26-CDS del 14 de julio de 2026, dirigido a la tutelada, el contralor de Servicios de la municipalidad aclaró: “Reciba un cordial saludo, deseándole el mayor de los éxitos en sus labores diarias, a la vez aprovecho la oportunidad para hacer de su conocimiento que de acuerdo con su gestión presentada el día 20 de abril de 2026, sobre la afectación de su propiedad por los trabajos realizados en la propiedad municipal. De ello y con relación al informe emitido por la señora Lorena Núñez Blanco en su condición de coordinadora Servicios Municipales, mediante los documentos OFI-065-26-SSM y OFI-117-26- SSM, indica que no existe afectación a su propiedad, es por esto que se procede al archivo de su gestión. Agradecemos su gestión presentada, ya que con ello contribuye al mejoramiento continuo de la gestión de la institución”.
Otrora, se constata que, por escrito recibido en la Municipalidad de Pérez Zeledón el 15 de julio de 2026, la accionante expuso: “En fecha 16 de abril de 2026, en el terreno municipal colindante a mi propiedad, se realizaron trabajos con maquinaria pesada, los cuales provocaron afectaciones directas a mi propiedad, específicamente el debilitamiento y daño estructural de la tapia trasera, así como la exposición de sus cimientos, inestabilidad del terreno y la generación de un acceso por debajo de la misma. Asimismo, dichas intervenciones incluyeron la remoción de la malla del área destinada a play, dejando el terreno completamente abierto, sin ningún tipo de cerramiento ni medidas de seguridad, a pesar de la presencia de una quebrada en el sitio. Como consecuencia directa, se generó un hueco por el cual se salieron mis animales (perros), los cuales son de carácter agresivo, lo que incrementa considerablemente el riesgo, ya que cualquier persona, especialmente menores de edad que ingresen al área, podría resultar gravemente afectada.
Esto configura un peligro inminente, tanto por la exposición de la quebrada como por la falta de control de acceso, situación que debió ser prevenida por la Municipalidad. Adicionalmente, es importante señalar que dichas intervenciones se realizaron sin contar con viabilidad ambiental, autorización del MINAE, ni medidas de mitigación de daños a terceros, lo cual agrava la situación y evidencia una actuación irregular. Cabe resaltar que, en todo momento, el particular que Ingreso con maquinaria manifestó contar con permisos municipales para realizar dichas labores. Sin embargo, los resultados de estas intervenciones; daños a mi propiedad, eliminación de cerramientos y generación de riesgo, ponen en duda la legalidad, alcance y adecuada supervisión de dichos permisos, en caso de haber existido. Con base en estos hechos, procedí a presentar una gestión formal ante la Municipalidad, solicitando inspección, delimitación de linderos, reparación de daños y medidas de seguridad.
No obstante, a la fecha no he recibido respuesta alguna, ni por parte de la Alcaldía, ni de la Contraloría de Servicios, ni de ninguna dependencia municipal, manteniéndose el problema sin solución y el riesgo vigente”.
Finalmente, se constata que, el 17 de agosto de 2026, las autoridades recurridas fueron notificadas de la resolución de rectificación del curso.
Así las cosas, lo correspondiente es declarar sin lugar el recurso. En este sentido, nótese que la gestión del 20 de abril de 2026 fue resuelta mediante los oficios OFI-117-26-SSM y OFI-020-26-CDS, ambos del 14 de julio de 2026, sea, con sobrada antelación a que los accionados fueran notificados de la resolución de curso de este amparo y, por ende, sin que mediara la intervención de la Sala.
De igual forma, se advierte a la accionante que cualquier disconformidad con la respuesta obtenida o la conclusión a la que llegó la municipalidad, es un extremo de mera legalidad, ajeno a la competencia de este Tribunal. Por ende, si a bien lo tiene, la accionante podrá plantear sus reclamos en la vía administrativa o jurisdiccional ordinaria que estime pertinente.
Por último, esta Sala omite pronunciarse respecto a la gestión del 15 de julio de 2026, en primer lugar porque excede el objeto de este recurso y, en segundo lugar, porque fue planteada por la accionante ante la corporación con posterioridad a la interposición de este recurso (9 de julio de 2026).
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008- 02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, donde se alega que el 16 de abril de 2026, la Municipalidad de Pérez Zeledón realizó trabajos con maquinaria pesada en un terreno municipal que colinda con la parte trasera de su casa, lo cuales generaron daños importantes tanto al parque de juegos de niños, como a su propiedad, poniendo en riesgo sus derechos así como los de las personas y menores de edad que acuden a dicho lugar.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
Se declara sin lugar el recurso. El magistrado Castillo Víquez pone nota. El magistrado Salazar Alvarado pone nota.
