Background:
Justice Rueda Leal drafts this ruling; and, Reasons:
I.Subject of the application. The petitioner alleges that the Municipality of San Ramón approved not treating grass or other plants from gardens as garbage. The petitioner considers that, by paying the garbage collection fee, they are entitled to the service.
II.Facts found. The following facts are considered duly established and relevant to the decision in this matter:
III.The particular case. In this case, the petitioner alleges that the Municipality of San Ramón approved not treating grass or other plants from gardens as garbage. The petitioner considers that, by paying the garbage collection fee, they are entitled to the service.
The record establishes that the petitioner is 82 years old. By Official Letter AM-GM-DDU-SMA-138-2026 of 10 July 2026, the Head of Municipal and Environmental Services of the Municipality of San Ramón stated: “(…) As the person in charge of the Municipal Services Unit of the Municipality of San Ramón, responsible for the Ordinary Solid Waste Collection Service, I must begin by stating that it is correct that the service user’s plant matter was not collected. I must recall that Integrated Solid Waste Management in the country is governed by the Comprehensive Waste Management Act N°8839, Article 8(b) and (h) of which establishes the following municipal functions: (b) To issue regulations in the canton for the classification, selective collection, and final disposal of waste, which must be consistent with the objectives of this Act and its regulations. (h) To set fees for waste management services that include the costs of carrying out integrated waste management, in accordance with the municipal integrated waste management plan, this Act, and its regulations, and in proportion to the quantity and quality of the waste generated, ensuring the strengthening of the infrastructure needed to provide those services and guaranteeing their self-financing.
Article 43, ‘Obligations of the Generator,’ subsection (b) of this same Act states that the waste generator must ‘Separate waste at its source, classify it, and deliver it to an authorized manager or a municipal system, in accordance with the regulations implementing this Act and the applicable municipal regulations, in order to facilitate its recovery.’ Based on what is stipulated in the aforementioned Act, by Agreement N° 05 of Ordinary Session N° 96 of 18 July 2017, the Municipal Council of the Municipality of San Ramón ratified Agreement N° 01 of Ordinary Session N° 93 of 04 July 2017 and definitively approved the ‘REGULATIONS FOR INTEGRATED SOLID WASTE MANAGEMENT GOVERNING THE TERRITORY OF THE CANTON OF SAN RAMÓN WHERE THE MUNICIPALITY CONCERNED HAS JURISDICTION.’ Article 3, ‘Definitions,’ subsections mm and pp, of those regulations clearly define ordinary waste and garden waste. Subsection mm) Garden waste: Waste obtained from pruning and garden maintenance tasks, such as grass, leaves, branches, flowers, fruit, among other things.
It may be considered biodegradable waste. Subsection pp) Ordinary waste: Waste of a domestic nature generated in homes and any other source that has a composition similar to household waste. Furthermore, Article 11, ‘Obligation to separate and classify generated waste,’ of these regulations states that ‘In accordance with Article 39 of Act N° 8839, solid waste generators are obliged to separate and classify their waste and deliver it to the municipal collection system or to whomever the Municipality designates, for its recovery and final disposal, provided that municipal logistics can make use of the effort.’ Likewise, Article 18 of these regulations states that the ordinary waste collection service does not include the collection of waste such as logs, roots, and branches, which shall be treated as non-traditional waste. (…) 4. The petitioner pays a fee for the collection service for ‘ordinary solid waste,’ which does not include garden waste.
It is important to note that collecting garden waste and pruning debris as part of the ordinary service would result in a financial imbalance (an unlawful subsidy), since that cost is not included in the current fee schedule. 5. The petitioner placed in the public thoroughfare material that is not classified as ordinary waste, which authorizes the workers not to collect it.” In these circumstances, on the terms set out in the application, no violation capable of being declared in this constitutional jurisdiction is established.
In this regard, the complaint is not about the absence or total interruption of the waste collection service, nor about any problem that, by its scale, poses a risk to people’s physical integrity or a public health problem that would warrant the Chamber’s intervention.
In this regard, if the petitioner considers that they are entitled to the collection of grass or other plant matter, or that it is included in the fee they pay, they may submit their claims to the local government itself or through the ordinary judicial process, so that they may present their position for adversarial consideration and introduce the evidence they consider relevant. The same applies if they disagree with the municipality’s waste classification.
For the foregoing reasons, the application is denied.
IV.Documents submitted to the expediente. The parties are advised that, if they submitted any paper document, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them within a maximum period of 30 business days from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of Session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and Article LXXXI of Session of the Superior Council of the Judiciary no. 43-12 of 3 May 2012.
Therefore:
The application is denied.

Recurso de amparo tramitado en el expediente nro. 26-022379-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE SAN RAMÓN.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. La parte recurrente acusa que la Municipalidad de San Ramón aprobó no considerar basura ni el zacate ni otras plantas vegetales de los jardines. Considera que tiene derecho por pagar la tasa de recolección de basura.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
III.Sobre el caso concreto. En el sub lite, la parte recurrente acusa que la Municipalidad de San Ramón aprobó no considerar basura ni el zacate ni otras plantas vegetales de los jardines. Considera que tiene derecho por pagar la tasa de recolección de basura.
Del estudio de los autos se tiene por demostrado, que el accionante tiene 82 años. El jefe de Servicios Municipales y Ambientales de la Municipalidad de San Ramón, mediante oficio AM-GM-DDU-SMA-138-2026 de 10 de julio de 2026, consignó: “(…) Como encargado de la Unidad de Servicios Municipales de la Municipalidad de San Ramón, responsable del Servicio de Recolección de Residuos Sólidos Ordinarios. Debo iniciar indicando, que es correcto el hecho de que no se recogió el material vegetal al usuario del servicio. Debo recordar que la Gestión Integral de los Residuos Sólidos en el país está regida por la Ley para la Gestión Integral de Residuos N°8839, la cual en su artículo 8 inciso b y h, establece como funciones de las municipalidades: b) Dictar los reglamentos en el cantón para la clasificación, recolección selectiva y disposición final de residuos, los cuales deberán responder a los objetivos de esta ley y su reglamento. h) Fijar las tasas para los servicios de manejo de residuos que incluyan los costos para realizar una gestión integral de estos, de conformidad con el plan municipal para la gestión integral de residuos, esta ley y su reglamento, y en proporción con la cantidad y la calidad de los residuos generados, asegurando el fortalecimiento de la infraestructura necesaria para brindar dichos servicios y garantizando su autofinanciamiento.
Esta misma ley en su Artículo 43 “Obligaciones del Generador” inciso b, señala que el generador de residuos debe “Separar los residuos desde la fuente, clasificarlos y entregarlos a un gestor autorizado o a un sistema municipal, de conformidad con el Reglamento de esta Ley y el reglamento municipal que le corresponda, con el fin de facilitar su valorización”. En base a (sic) lo estipulado en la Ley supracitada, el Concejo Municipal de la Municipalidad de San Ramón por medio del Acuerdo N° 05 de la Sesión N° 96 Ordinaria del 18 de julio del 2017, ratificó el Acuerdo N° 01 de la Sesión N° 93 Ordinaria del 04 de julio de 2017, aprobó en forma definitiva el “REGLAMENTO PARA LA GESTIÓN INTEGRAL DE RESIDUOS SÓLIDOS QUE RIGE PARA EL TERRITORIO DEL CANTÓN DE SAN RAMÓN DONDE LA MUNICIPALIDAD RESPECTIVA CUENTA CON JURISDICCIÓN”. Dicho reglamento, en su Artículo 3 “Definiciones", inciso mm y pp define claramente que son residuos ordinarios y residuo de jardín.
Inciso mm) Residuo de jardín: Son aquellos residuos que se obtienen de las tareas de poda y de mantenimiento de los jardines, tales como: pasto, hojas, ramas, flores, frutos, entre otros. Pueden considerarse como residuos biodegradables. Inciso pp) Residuo ordinario: Residuos de carácter doméstico generados en viviendas y en cualquier otra fuente, que presentan composiciones similares a los de las viviendas. Por otra parte este reglamento en su Artículo 11°. “Obligación de separar y clasificar los residuos generados”, señala que “De conformidad con el artículo 39° de la Ley N° 8839, los generadores de residuos sólidos están obligados a separarlos, clasificarlos y entregarlos al sistema municipal de recolección o a quien la Municipalidad designe, para su valorización y disposición final, siempre y cuando la logística municipal pueda aprovechar el esfuerzo”. Así mismo el Artículo 18° de este mismo reglamento, señala que el servicio de recolección de residuos ordinarios no incluye la recolección de residuos tipo troncos, raíces y ramas, los cuales se tratarán como residuos no tradicionales.
(…) 4. Que el recurrente paga una tasa por el servicio de recolección de "residuos sólidos ordinarios", dentro del cuál (sic) no se contemplan los residuos de jardín. Es importante señalar que la recolección de residuos de jardín y podas de forma ordinaria implicaría un desbalance financiero (un subsidio ilegal), ya que ese costo no está contemplado en la fijación tarifaria actual. 5. Que el recurrente sacó a la vía pública un material que no está contemplado como residuos ordinario, lo cual autoriza a los operarios a no recolectar estos residuos”.
Desde este panorama, en los términos planteados en el escrito de interposición, se descarta alguna transgresión susceptible de ser declarada en esta jurisdicción constitucional.
Sobre el particular, lo que se reclama no es la inexistencia o interrupción total de la prestación del servicio de recolección de residuos, ni tampoco algún problema que, por su magnitud, represente algún riesgo para la integridad de las personas o problema de salud pública que amerite la intervención de la Sala.
Al respecto, si el accionante considera que tiene derecho a la recolección de residuos de zacate u otras plantas vegetales, o bien, que este se encuentra incluido en la tasa que paga, puede formular sus reclamos ante el propio gobierno local o en la vía jurisdiccional ordinaria, a los efectos de que someta a contradictorio su posición y evacúe la prueba que estime pertinente. En igual sentido, si se encuentra inconforme con la clasificación de residuos hecha por el ayuntamiento.
Por lo anterior, se declara sin lugar el recurso.
IV.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:
Se declara sin lugar el recurso.
