Review of the Document CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:40 a.m. on 27 August 2026.

Amparo proceeding processed in case file no. 26-016697-0007-CO, filed by Nombre01, identity card CED01, against the CÓBANO DISTRICT MUNICIPAL COUNCIL, THE MUNICIPALITY OF PUNTARENAS, THE NATIONAL TECHNICAL SECRETARIAT (SETENA), AND THE COSTA RICAN TOURISM INSTITUTE (ICT).

Background:

  1. 1By written submission entered into the case file on 11 May 2026, the claimant files an amparo proceeding. The claimant states that the Cóbano District Council and the Municipality of Puntarenas, in their capacity as entities responsible for land-use planning in Cóbano’s eleventh district, currently lack a duly approved regulatory plan covering the entire territory, specifically the area between boundary markers 303 and 305 and the adjoining areas, thereby failing to formally establish urban and territorial planning provisions in accordance with the legal system in force, including those concerning the maritime-terrestrial zone. The claimant notes that, from 2006 through 2022, various applications for a land concession were processed before the Municipality of Puntarenas concerning the area described in cadastral plan no. P-803302- 2002, located in Arío Manzanillo, Cóbano’s eleventh district, but those applications were not approved because there was no coastal regulatory plan in force, as reflected in official letter no. ZMT-202-2013 dated 31 May 2013.The claimant adds that, by official letter no. CAT-ZMT-087-2025 dated 16 March 2022, the engineer in the Cadastre and Valuations Department of the Cóbano District Municipal Council confirmed that the Manzanillo regulatory plan does not cover the area in question and that no instrument exists that includes it. The claimant further adds that, since 10 November 2009, the Department of the Maritime-Terrestrial Zone had warned, by official letter no. ZMT-418-2009, that a comprehensive regulatory-plan project was awaiting approval by the competent institutions, such as SETENA, INVU, and ICT, demonstrating that the Administration had prior knowledge of the need for such an instrument. The claimant asserts that, by resolution no. 1159-2023-SETENA, issued at 10:30 a.m. on 9 August 2023, that Secretariat granted environmental viability to the project entitled “Incorporation of the Environmental Variable into the Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone, Cóbano, Puntarenas,” conditioning its final approval on continuation of the procedure before the relevant bodies in accordance with law.However, according to an inquiry made to the National Institute of Housing and Urbanism on 19 February 2026, that entity stated that its records do not show submission of the aforementioned plan for approval, which demonstrates administrative inactivity in pursuing the procedure. The claimant asserts that all of the foregoing has caused direct harm to the claimant, who has held possession of the land in question since 1997 through an assignment of occupancy rights and has made the payments required by the municipal authorities, yet the claimant’s legal situation has not been resolved to date because of the prolonged omission of the competent authorities. Accordingly, the claimant requests that: “the amparo proceeding be declared well-founded and the Municipality of the Cóbano District and the Municipality of Puntarenas be ordered to issue, in accordance with the legal system, the Regulatory Plan for the Cóbano Maritime-Terrestrial Zone, and the Regulatory Plan or Land-Use Plan covering all of Cóbano’s eleventh district, particularly the area from boundary marker 303 to boundary marker 305, detailed in cadastral plan P-803302-2002.”

  5. 5By written submission entered into the case file on 10 June 2026, Rocío Alpízar Jiménez, coordinator of the Maritime-Terrestrial Zone Department of the Municipality of Puntarenas, submits a report. She notes that the Cóbano District Municipal Council has jurisdiction over the areas of the Cóbano Maritime-Terrestrial Zone.
  6. 6By written submission entered into the case file on 10 June 2026, Alberto López Chaves, general manager of the Costa Rican Tourism Institute (ICT), reports: “1. The claimant refers to cadastral plan P-803302-2002, located in ‘Manzanillo, Cóbano’s eleventh district, first canton of Puntarenas, province of Puntarenas,’ whose boundary of interest is described as lying between boundary markers 303 and 305 of the ZMT of Playa Manzanillo, Cóbano. 2. The information in municipal administrative case file 3061-06, as well as municipal official letters ZMT-202-2013 and CAT-ZMT-087-2025, shows that the current Manzanillo regulatory plan extends only as far as boundary marker 302 in the northern sector and does not include the stretch between boundary markers 303 and 305, where the parcel covered by plan P-803302-2002 is located. 3. Indeed, official letter ZMT-202-2013 from the Maritime-Terrestrial Zone Department of the Cóbano District Municipal Council expressly informs the claimant that, upon review of plan P-803302-2002, ‘it was found that no regulatory plan for the zone covers the boundary markers indicated in that plan,’ and therefore the concession cannot be processed until there is an approved coastal regulatory plan in force for that sector. 4.The claimant himself submits official letter CAT-ZMT-087-2025, dated 16 March 2022, in which the engineer in the Cadastre and Valuations Department of the Cóbano District Municipal Council confirms that ‘the Manzanillo Regulatory Plan does not cover the area where the land described in plan P-803302-2002 is located, and there is no regulatory plan that includes the area of the requested land.’ 5. Moreover, the record shows that the National Technical Environmental Secretariat (SETENA), by resolution 1159-2023-SETENA, granted environmental viability to the project entitled ‘Incorporation of the Environmental Variable into the Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone, Cóbano, Puntarenas,’ making clear that this viability does not constitute approval of the regulatory plan, but is instead a prerequisite for continuing the procedure before the other competent institutions (INVU, ICT, among others). 6.In response to an inquiry by the claimant’s representative, the National Institute of Housing and Urbanism (INVU) reported on 3 March 2026 that its case files concerning the Cóbano District Council ‘do not contain a Santa Teresa plan under review or submitted to us in recent years,’ mentioning only other amendments to plans that have already been suspended; it also stated that it has no knowledge of submission of the coastal regulatory plan whose environmental component was approved by SETENA. 7. As of the date of this report, ICT is not processing, nor has it resumed, any matter related to approval of a comprehensive regulatory plan for the ZMT of Cóbano District that includes the specific sector between boundary markers 303 and 305 of Playa Manzanillo, which is the sector of interest to the claimant. II. ICT’S JURISDICTION OVER THE MARITIME-TERRESTRIAL ZONE 1. The Maritime-Terrestrial Zone Law, Ley 6043, assigns municipalities immediate administration of the ZMT and the authority to grant concessions within their jurisdiction, while ICT participates as the national technical body in tourism planning and in preparing the general land-use plan for tourist zones, in coordination with INVU and other authorities. 2.Under Articles 3, 18, 19, 21, 22, 23, 26, 27, 29, 31, and 34 to 38 of Ley 6043, ICT participates in formulating coastal regulatory plans and defining tourist uses of the zones, but does not have direct jurisdiction to approve or deny municipal regulatory plans or grant concessions in the maritime-terrestrial zone; those functions belong to the municipal corporations and INVU under their respective laws. 3. Under that same Ley 6043 and Ley Forestal 7575, consistently with Constitutional Chamber case law and opinions of the Procuraduría cited in the municipal official letters (including opinion C-297-2004), lands in the ZMT, as well as forests and forest lands forming part of the State’s Natural Heritage, are public-domain property, inalienable and imprescriptible, in respect of which no person may claim private ownership rights. 4. Thus, even though the claimant asserts that he holds occupancy rights derived from assignments made since 1997 and has paid municipal fees, this does not make him an owner or give him a subjective right to demand a concession or approval of a specific regulatory plan, particularly because these are public-domain assets subject to the principle of unavailability and a special public-law regime.III. ABSENCE OF HARMFUL CONDUCT ATTRIBUTABLE TO ICT 1. The claimant’s account and the accompanying documentation show that his complaints are directed primarily against the alleged inactivity of the Cóbano District Council and the Municipality of Puntarenas regarding preparation and approval of a coastal regulatory plan covering the area between boundary markers 303 and 305 of Playa Manzanillo, as well as the processing of his concession application for the land described in plan P-803302-2002. 2. ICT has issued no act denying or halting the coastal regulatory plan for Cóbano District or the claimant’s concession application; on the contrary, ICT’s files contain no process for preparing a comprehensive regulatory plan. 3. Resolution 1159-2023-SETENA shows that the process of incorporating the environmental variable into the ZMT Santa Teresa-Mal País regulatory plan is a procedure advanced by the Cóbano District Municipal Council.That resolution does not establish any concrete, direct, and immediate obligation on ICT to promote approval of the plan on its own, much less to include particular properties or specific sectors in the municipal proposal. 4. For its part, INVU has confirmed that the Santa Teresa-Mal País ZMT regulatory plan has not been submitted to it for approval, so responsibility for advancing the file rests with the municipality promoting the plan, not ICT. 5. Therefore, there is no unlawful material omission attributable to ICT that could, in itself, be considered to have caused a current infringement of the claimant’s fundamental rights, since preparation, submission, and approval of the coastal regulatory plan primarily fall to the municipality and INVU, and the absence of a regulatory plan covering a particular sector cannot be attributed to the Institute as the sole body responsible for ensuring such an instrument exists.IV. ALLEGED VIOLATION OF FUNDAMENTAL RIGHTS 1. The claimant links the absence of a comprehensive regulatory plan for the entire Cóbano District to violation of his right to a healthy and ecologically balanced environment (Article 50 of the Political Constitution) and to the protection of consumers’ and users’ health, environment, safety, and economic interests (Article 46 of the Constitution), arguing that the prolonged omission of the competent authorities has prevented him from consolidating his legal situation in the ZMT. 2. However, with respect to ICT, it has not been shown that the Institute tolerated or encouraged materially polluting activities, or issued decisions that adversely affect the environment or land-use planning in the Manzanillo area; the complaint concerns the lack of progress in approving a coastal regulatory plan, which is primarily led by the Cóbano District Municipal Council in coordination with SETENA and INVU. 3.The Constitutional Chamber’s case law, cited by the claimant himself, recognizes that regulatory plans are valuable instruments for environmental protection and urban planning, but has also reiterated that municipalities bear central responsibility for land-use planning in their canton, without thereby transferring exclusive responsibility to ICT for omissions by those local corporations. 4. Although the absence of a coastal regulatory plan may be considered undesirable from the standpoint of sustainable development, this case file does not show that the omission is attributable to ICT or that there is a prior order of the Chamber that the Institute failed to comply with; consequently, there is no direct violation of fundamental rights attributable to this autonomous institution. 5. As for the claimant’s expectations of obtaining a concession over the land between boundary markers 303 and 305, it must be reiterated that the ZMT is public-domain property and that, under Ley 6043, no person may claim ownership rights in that zone. Accordingly, any occupancy rights, fee payments, or material acts do not in themselves create a fundamental right to a concession or transfer to ICT responsibility for failure to grant one.”
  7. 7By written submission entered into the case file on 11 June 2026, Randall Chavarría Matarrita, mayor of the Municipality of Puntarenas, submits a report. He states that the matter alleged falls within the jurisdiction of the Cóbano District Council.
  8. 8By written submission entered into the case file on 12 June 2026, Ulises Álvarez Acosta, secretary-general of the National Technical Environmental Secretariat (Setena), reports: “The account of the facts underlying this proceeding reveals a clear absence of direct factual attribution to this State representative. Based on the facts underlying this amparo proceeding, any administrative inactivity or omission by the National Technical Environmental Secretariat (SETENA) is categorically and expressly denied. The technical and factual materials in our records demonstrate that this body has acted with complete diligence, timely resolving the requests submitted to it concerning Cóbano District. The legal arguments supporting the consequent inadmissibility of the proceeding against us are set out below: 1. No causal link and absence of direct factual attribution. The account of the facts underlying this proceeding reveals a clear absence of direct factual attribution to this State representative.The claimant focuses his complaint on the absence of a fully effective and approved coastal Regulatory Plan, as well as the failure to resolve his applications for a land concession since 2006. In this regard, it must be clarified that SETENA has no legal authority to grant concessions in the Maritime-Terrestrial Zone (ZMT) or enact regulatory plans; those powers belong exclusively and solely to Local Governments, the Costa Rican Tourism Institute (ICT), and the National Institute of Housing and Urbanism (INVU). Therefore, there is no causal link between SETENA’s functions and the alleged harm invoked by the claimant. SETENA’s mention in the allegations is merely background, while the grievances are directed exclusively at the municipal corporations. 2. Procedural efficiency and SETENA’s timely compliance. Contrary to the claim of ‘prolonged inactivity by the authorities,’ SETENA has processed in an expeditious and lawful manner the two active case files related to land-use planning in Cóbano District, Puntarenas Canton: • Case file EAE-0003-2020 (‘Incorporation of the Environmental Variable into the Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone’): This file—which is directly related to the claimant’s complaint—was received by this Secretariat on 28 April 2020.Following the corresponding rigorous technical analysis, this body granted Environmental Viability (License) by resolution No. 1159-2023 of 9 August 2023. • Approval of the Sustainable Development Regulation: Subsequently, on 20 September 2024, the Sustainable Development Regulation was submitted for consideration; it was duly reviewed and approved by resolution No. 0650-2026 of 7 April 2026, and fully incorporated into the environmental viability granted. • Case file EAE-0006-2024 (‘Incorporation of the environmental variable into the Regulatory Plan for Cóbano District’): This process is in the active technical evaluation phase. Its current status is subject to compliance with requirements, and the proponent bears the procedural burden of submitting the corresponding corrections so that this Secretariat can continue with its environmental viability opinion. 3. Exhaustion of SETENA’s jurisdiction and transfer of the procedural burden.Under the body of environmental law, SETENA’s function in preparing a Regulatory Plan is strictly limited to evaluating and issuing an opinion on the environmental viability of the proposal’s environmental variable. Once the approving resolution has been issued, this body’s jurisdiction over the subsequent approval and entry-into-force stages comes to an end. As of today, case file EAE-0003-2020 has no pending procedure, request, or matter awaiting resolution before this Secretariat. Having issued the Environmental Viability in 2023 and approved the Sustainable Development Regulation in April 2026, SETENA has completed its involvement. Consequently, advancing procedures submitted to SETENA for approval and taking subsequent steps to obtain final approval and later publication of the Regulatory Plan once the Environmental Viability resolution has been obtained are the exclusive responsibility of bodies outside this institution, namely: the Cóbano District Municipal Council, INVU, and ICT.Conclusion. For the reasons stated, given that SETENA has been shown to have timely resolved the required environmental components in accordance with law and technical standards, and that no matter under our responsibility remains pending as of today, we respectfully request that the Constitutional Chamber dismiss this amparo proceeding with respect to SETENA and exclude this State representative from any responsibility in this case.”
  9. 9By written submission entered into the case file on 12 June 2026, Kerlyn Annette Molina Corella, president of the Municipal Council of Puntarenas, submits a report. She explains that the Cóbano District Municipal Council has jurisdiction over the matter.
  10. 10By written submission entered into the case file on 23 June 2026, Ronny José Montero Orozco, Minor Centeno Sandí, and Lidieth Porras Córdoba, respectively, intendant, president of the Council, and manager of the Maritime-Terrestrial Zone Department, all of the Cóbano District Municipal Council, submit a report. They state that the sector between boundary markers 303 and 305 currently has no regulatory plan in force; however, this is not due to any municipal situation, omission, or inactivity. They state that work is underway on the “Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone (ZMT),” which covers the area identified by the claimant. They explain that the environmental variable has already been approved by Setena and that they asked ICT whether the regulatory plan could be funded with the resources under subsection a) of Article 59 of law no. 6043; after that, they will continue with the corresponding procedure. They emphasize that part of the area between boundary markers 303 and 305 forms part of the “State’s Natural Heritage.”
  11. 11By written submission entered into the case file on 26 August 2026, the claimants reply to the reports of the respondent municipalities and conclude: “As shown by the reports submitted by the Municipalities of Puntarenas (which had been responsible from the publication of the Urban Planning Law at the end of 1968 until the amendment to the Maritime-Terrestrial Zone Law in mid-May 2006) and the District of Cóbano (from 15 May 2006 to the present), neither of the two municipalities issued the corresponding regulatory plan during the period for which each had legal jurisdiction. We consider that the period has been more than sufficient for preparation, processing, approval, and publication in the official gazette La Gaceta, and that this failure, in addition to infringing the fundamental rights described in Articles 50 and 46, has created an environmental problem and legal uncertainty in Cóbano District, since urban development and socioeconomic activities have been approved according to the subjective criteria of those responsible at each point in time—that is, without an objective technical-environmental instrument.”
  12. 12The legal requirements have been observed in these proceedings.

Justice Rueda Leal drafts; and, Reasons:

I. OBJECT OF THE AMPARO PROCEEDING

The claimant states that Cóbano District currently lacks a regulatory plan covering the area between boundary markers 303 and 305, which means that the obligation to formally establish urban and territorial planning provisions in accordance with the legal system in force, including those concerning the maritime-terrestrial zone, has not been fulfilled. In this context, the claimant argues that for years he has filed various applications for a land concession concerning the property shown on plan no. P-803302-2002, located between the referenced boundary markers in the maritime-terrestrial zone; however, the absence of a regulatory plan for the area has prevented this request from proceeding. The claimant thus asserts that he has suffered harm because he has held possession of the land in question since 1997 through an assignment of occupancy rights, yet his legal situation has not been resolved to date because of the prolonged omission of the competent authorities.

The claimant requests that: “the amparo proceeding be declared well-founded and the Municipality of the Cóbano District and the Municipality of Puntarenas be ordered to issue, in accordance with the legal system, the Regulatory Plan for the Cóbano Maritime-Terrestrial Zone, and the Regulatory Plan or Land-Use Plan covering all of Cóbano’s eleventh district, particularly the area from boundary marker 303 to boundary marker 305, detailed in cadastral plan P-803302-2002.”

II. FACTS FOUND

The following facts, relevant to deciding this matter, are considered duly established, either because they have been proven or because the respondent authority failed to address them, as required in the initial order:

  • a)The Cóbano District Municipal Council is preparing the “Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone (ZMT),” which covers the area between boundary markers 303 and 305 identified by the claimant. (Report of the respondent authority).
  • b)By resolution no. 1159-2023 of 9 August 2023, Setena granted environmental viability in case file “EAE-0003-2020 (Incorporation of the Environmental Variable into the Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone).” Subsequently, by resolution no. 0650-2026 of 7 April 2026, it granted environmental viability to the “Sustainable Development Regulation” for that project. (Report of the respondent authority and documentary evidence).
  • c)The aforementioned regulatory plan remains under processing before the competent ordinary authorities. (Report of the respondent authority).

III. THE SPECIFIC CASE

In this case, the claimant states that Cóbano District currently lacks a regulatory plan covering the area between boundary markers 303 and 305, which means that the obligation to formally establish urban and territorial planning provisions in accordance with the legal system in force, including those concerning the maritime-terrestrial zone, has not been fulfilled. In this context, the claimant argues that for years he has filed various applications for a land concession concerning the property shown on plan no. P-803302-2002, located between the referenced boundary markers in the maritime-terrestrial zone; however, the absence of a regulatory plan for the area has prevented this request from proceeding. The claimant thus asserts that he has suffered harm because he has held possession of the land in question since 1997 through an assignment of occupancy rights, yet his legal situation has not been resolved to date because of the prolonged omission of the competent authorities.

The claimant requests that: “the amparo proceeding be declared well-founded and the Municipality of the Cóbano District and the Municipality of Puntarenas be ordered to issue, in accordance with the legal system, the Regulatory Plan for the Cóbano Maritime-Terrestrial Zone, and the Regulatory Plan or Land-Use Plan covering all of Cóbano’s eleventh district, particularly the area from boundary marker 303 to boundary marker 305, detailed in cadastral plan P-803302-2002.” The record establishes that the Cóbano District Municipal Council is preparing the “Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone (ZMT),” which covers the area between boundary markers 303 and 305 identified by the claimant. By resolution no. 1159-2023 of 9 August 2023, Setena granted environmental viability in case file “EAE-0003-2020 (Incorporation of the Environmental Variable into the Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone).” Subsequently, by resolution no. 0650-2026 of 7 April 2026, it granted environmental viability to the “Sustainable Development Regulation” for that project. The aforementioned regulatory plan remains under processing before the competent ordinary authorities.

From this perspective, at first glance there appears to be no situation warranting intervention by this constitutional jurisdiction.

First, contrary to the claimant’s allegation, the record shows that the Cóbano District Municipal Council is carrying out the corresponding steps to prepare the “Regulatory Plan for the Santa Teresa-Mal País Maritime-Terrestrial Zone (ZMT),” which specifically covers the area between boundary markers 303 and 305. That process is ongoing, so it cannot be established that the respondent authority has been completely inactive or has omitted to act on this point.

The Chamber observes, however, that the complaint concerning implementation of the regulatory plan is actually ancillary to the claimant’s substantive argument in this case, which concerns the delay this has caused in resolving his applications for a concession over land located in the area at issue. It is precisely for that purpose that he requests intervention to implement the aforementioned regulatory plan.

However, it should be noted that determining whether the requested concession should be granted falls outside this Chamber’s jurisdiction. Nor may the Chamber intervene with the Administration to have it take particular actions to facilitate or expedite the processing of such requests in any way, such as, for example, ordering implementation of a regulatory-plan project that is still under processing. Likewise, in general, any delay in processing and deciding a concession application such as the one cited by the claimant does not fall within the exceptions recognized by this Chamber concerning prompt and effective justice under Article 41 of the Political Constitution (in the same vein, see, for example, judgment no. 2025023317, issued at 9:20 a.m. on 24 July 2025). Accordingly, the amparo proceeding is inadmissible in this constitutional forum and must be brought before the administrative-litigation jurisdiction, for the following reasons.

IV. A NEW ADMINISTRATIVE JUSTICE SYSTEM

AN EXPEDITIOUS AND EFFECTIVE MECHANISM FOR PROTECTING THE SUBSTANTIVE LEGAL POSITIONS OF ADMINISTRATIVE PARTIES. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in light of the absence of swift and expeditious procedural avenues for protecting substantive legal positions grounded in the infra-constitutional legal system or legality framework, which are indirectly connected with fundamental rights and Constitutional Law. In this regard, it should not be overlooked that, by virtue of its supremacy, super-legality, and direct and immediate effect, the Constitution indirectly grounds any conceivable substantive legal position of individuals. However, upon further consideration, and following enactment of the Code of Administrative Procedure (Law No. 8508 of 24 April 2006) and its entry into force on 1 January 2008, it has become clear that litigants now have access to a plenary and universal administrative-litigation jurisdiction that is highly expeditious through the various procedural mechanisms introduced into the legal system by that legislation.

These include shortened time limits for the various procedural acts; broad standing; interim measures; an open-ended list of claims that may be brought; oral proceedings—and their subprinciples of concentration, immediacy, and expedition; a single instance with appeal in expressly specified situations; in-process conciliation; unified proceedings; preferential proceedings or “amparo of legality”; proceedings based solely on questions of law; new enforcement measures (coercive fines, substitute or commissioner enforcement, seizure of fiscal-domain assets and certain public-domain assets); broad powers of the enforcement judges; extension and adaptation of the effects of case law to third parties; and flexibility in cassation review. All of these novel procedural institutions are expressly intended to achieve procedural economy, expedition, promptness, and effective protection of the substantive legal positions of administrative parties, while guaranteeing basic fundamental rights such as due process, the right of defense, and adversarial proceedings.

In short, the new administrative-litigation jurisdiction, with its new features of simplicity, expedition, and promptness, is a suitable avenue for the effective protection of administrative parties’ substantive legal positions where evidence must be gathered or questions of ordinary legality resolved.

V. VERIFICATION OF STATUTORY TIME LIMITS FOR RESOLVING ADMINISTRATIVE PROCEEDINGS

AN OBVIOUS QUESTION OF ORDINARY LEGALITY. Determining whether the public administration complies with the time limits established by the General Law of Public Administration (Articles 261 and 325) or sector-specific laws governing special administrative proceedings, for issuing a final act in an administrative proceeding—initiated ex officio or at a party’s request—or deciding the available administrative remedies, is plainly a question of ordinary legality that may henceforth be litigated and resolved before the administrative-litigation jurisdiction, applying the principles that inform the constitutional jurisdiction, such as representative standing, the possibility of self-representation—that is, appearing without counsel—and fee-free access for the claimant. Consequently, the proceeding must be summarily dismissed, and the applicant must be advised that, if they so wish, they may resort to the administrative-litigation jurisdiction.

VI. DOCUMENTATION SUBMITTED INTO THE CASE FILE

The parties are advised that, if they submitted any paper document, objects, or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or other new-technology device, they must retrieve it within a maximum period of 30 business days, counted from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011 and published in the Judicial Bulletin no. 19 on 26 January 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary of 3 May 2012.

Therefore:

The amparo proceeding is dismissed.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del veintisiete de agosto de dos mil veintiseis .

Recurso de amparo que se tramita en el expediente nro. 26-016697-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el CONCEJO MUNICIPAL DE DISTRITO DE CÓBANO, LA MUNICIPALIDAD DE PUNTARENAS, LA SECRETARÍA TÉCNICA NACIONAL (SETENA) Y EL INSTITUTO COSTARRICENSE DE TURISMO (ICT).

Resultando:

  1. 1Por escrito incorporado al expediente el 11 de mayo de 2026, el accionante interpone recurso de amparo. Manifiesta que el Concejo de Distrito de Cóbano y la Municipalidad de Puntarenas, en su condición de entidades responsables del ordenamiento territorial del distrito once de Cóbano, no cuentan a la fecha con un plan regulador debidamente aprobado por las autoridades competentes que abarque la totalidad del territorio, específicamente el área comprendida entre los mojones 303 al 305 y demás zonas anexas, incumpliendo así su obligación de establecer formalmente las disposiciones de ordenamiento urbano y territorial conforme al ordenamiento jurídico vigente, incluyendo lo relativo a la zona marítimo terrestre. Menciona que, desde el año 2006 y hasta el 2022, se han tramitado diversas solicitudes de concesión de terreno ante la municipalidad de Puntarenas, respecto del área descrita en el plano nro. P-803302- 2002, ubicada en Arío Manzanillo, distrito once Cóbano, sin que dichas gestiones hayan sido aprobadas debido a la inexistencia de un plan regulador costero vigente, como se desprende del oficio nro. ZMT-202-2013 de fecha 31 de mayo de 2013.Agrega que mediante oficio nro. CAT-ZMT-087-2025 de 16 de marzo de 2022, el ingeniero de Catastro y Valoraciones del Concejo municipal de Distrito de Cóbano confirmó que el plan regulador de Manzanillo no cubre el área en cuestión ni existe instrumento alguno que lo contemple. Agrega que, desde el 10 de noviembre de 2009, mediante oficio nro. ZMT-418-2009, el departamento de Zona Marítimo Terrestre advirtió la existencia de un proyecto de plan regulador integral pendiente de aprobación ante las instituciones competentes, tales como SETENA, INVU e ICT, evidenciándose el conocimiento previo de la administración sobre la necesidad de dicho instrumento. Asegura que mediante resolución nro. 1159-2023-SETENA de las 10:30 horas del 09 de agosto de 2023, dicha Secretaría otorgó la viabilidad ambiental al proyecto denominado "Incorporación de la Variable Ambiental al Plan Regulador de la Zona Marítimo Terrestre Santa Teresa-Mal País, Cóbano, Puntarenas", condicionando su aprobación definitiva a la continuación del trámite ante las instancias correspondientes conforme a derecho.No obstante, según consulta realizada al Instituto Nacional de Vivienda y Urbanismo el 19 de febrero de 2026, dicha entidad indicó que no consta en sus registros la presentación del referido plan para su aprobación, lo que evidencia la inactividad administrativa en la prosecución del trámite. Asegura que todo lo anterior ha generado un perjuicio directo al recurrente, quien desde el año 1997 ostenta la posesión del terreno en cuestión mediante cesión de derechos de ocupación, habiendo cumplido con los pagos requeridos por las autoridades municipales, sin que a la fecha se haya resuelto su situación jurídica por la omisión prolongada de las autoridades competentes. Por lo expuesto, solicita que: "se declare con lugar el recurso y se le ordene a la Municipalidad del Distrito de Cóbano y a la Municipalidad de Puntarenas a emitir conforme al ordenamiento jurídico el Plan Regulador de la Zona Marítima Terrestre de Cóbano, y el Plan Regulador o de Ordenamiento Territorial que incluya todo el distrito once Cóbano, y sobre todo el área que abarca desde el mojón 303 al mojón 305, que se encuentra detallada en el piano catastrado P-803302-2002".
  2. 2Mediante resolución de las 12:15 horas de 29 de mayo de 2026, la Presidencia de la Sala le previno al recurrente aportar documentación.
  3. 3Por escritos incorporados al expediente el 3 de junio de 2026, el accionante aporta la documentación requerida.
  4. 4Mediante resolución de las 14:27 horas de 4 de junio de 2026, la Presidencia de la Sala le dio curso al proceso y le solicitó informe al “INTENDENTE, EL PRESIDENTE DEL CONCEJO Y EL JEFE DEL DEPARTAMENTO DE LA ZONA MARÍTIMA TERRESTRE, TODOS DE LA CONCEJO MUNICIPAL DE DISTRITO DE CÓBANO; ASÍ COMO EL ALCALDE, EL PRESIDENTE DEL CONCEJO Y EL JEFE DEL DEPARTAMENTO DE LA ZONA MARÍTIMA TERRESTRE, TODOS DE LA MUNICIPALIDAD DE PUNTARENAS, Y EL SECRETARIO GENERAL DE LA SECRETARÍA TÉCNICA NACIONAL Y EL GERENTE GENERAL INSTITUTO COSTARRICENSE DE TURISMO”.
  5. 5Por escrito incorporado al expediente el 10 de junio de 2026, Rocío Alpízar Jiménez, coordinadora del Departamento de Zona Marítimo Terrestre de la Municipalidad de Puntarenas, rinde informe. Acota que la competencia sobre las áreas de Zona Marítimo de Terrestre de Cóbano la tiene el Concejo Municipal de Distrito de Cóbano.
  6. 6Por escrito incorporado al expediente el 10 de junio de 2026, Alberto López Chaves, gerente general del Instituto Costarricense de Turismo (ICT), informa: “1. El recurrente hace referencia al plano catastrado P-803302-2002, situado en “Manzanillo, distrito once Cóbano, cantón primero de Puntarenas, provincia de Puntarenas”, cuyo lindero de interés se describe entre los mojones 303 y 305 de la ZMT de Playa Manzanillo, Cóbano. 2. De la información que obra en el expediente administrativo municipal 3061-06, así como de los oficios municipales ZMT-202-2013 y CAT-ZMT-087-2025, se desprende que el plan regulador de Manzanillo vigente únicamente abarca hasta el mojón 302 en el sector norte, no incluyendo el tramo comprendido entre los mojones 303 al 305 donde se ubica la parcela amparada en el plano P-803302-2002. 3. En efecto, el oficio ZMT-202-2013 del Departamento de Zona Marítimo Terrestre del Concejo Municipal de Distrito de Cóbano informa expresamente al recurrente que, revisado el plano P-803302-2002, “no se encontró que ningún plan regulador de la zona abarque los mojones indicados en dicho plano”, razón por la cual no es posible tramitar la concesión mientras no exista un plan regulador costero aprobado y vigente para ese sector. 4.El propio recurrente aporta el oficio CAT-ZMT-087-2025, de 16 de marzo de 2022, en que el ingeniero de Catastro y Valoraciones del Concejo Municipal de Distrito de Cóbano confirma que “el Plan Regulador de Manzanillo no cubre el área donde se ubica el terreno descrito en el plano P-803302-2002 y no se cuenta con ningún plan regulador que incluya el área del terreno solicitado”. 5. Por otra parte, consta que la Secretaría Técnica Nacional Ambiental (SETENA), mediante resolución 1159-2023-SETENA, otorgó viabilidad ambiental al proyecto denominado “Incorporación de la Variable Ambiental al Plan Regulador de la Zona Marítimo Terrestre Santa Teresa-Mal País, Cóbano, Puntarenas”, dejando claro que dicha viabilidad no constituye aprobación del plan regulador, sino un requisito previo para continuar el trámite ante las demás instituciones competentes (INVU, ICT, entre otras). 6. El Instituto Nacional de Vivienda y Urbanismo (INVU), en respuesta a consulta de la apoderada del recurrente, informó el 3 de marzo de 2026 que en sus expedientes del Concejo Distrital de Cóbano “no tenemos un plan de Santa Teresa en revisión o que se nos haya presentado en los últimos años”, detallando solo otros ajustes de planes ya suspendidos; también indicó que no tiene conocimiento de que se haya presentado el plan regulador costero cuyo componente ambiental fue aprobado por SETENA. 7.A la fecha del informe, en el ICT no se tramita ni se ha reactivado gestión alguna relacionada con la aprobación de un plan regulador integral de la ZMT del distrito de Cóbano que incluya el sector específico comprendido entre los mojones 303 al 305 de Playa Manzanillo, que es el de interés del recurrente. II. COMPETENCIA DEL ICT EN MATERIA DE ZONA MARÍTIMO TERRESTRE 1. La Ley sobre la Zona Marítimo Terrestre, Ley 6043, asigna a las municipalidades la administración inmediata de la ZMT y la potestad de otorgar concesiones dentro de su jurisdicción, mientras que el ICT participa como ente técnico nacional en la planificación turística como en la elaboración del plan general de uso de la tierra en las zonas turísticas, en coordinación con el INVU y otras autoridades. 2. Conforme a los artículos 3, 18, 19, 21, 22, 23, 26, 27, 29, 31, 34 a 38 de la Ley 6043, el ICT interviene en la formulación de planes reguladores costeros y en la definición del uso turístico de las zonas, pero no ostenta la competencia directa de aprobar o denegar planes reguladores municipales ni de otorgar concesiones en la zona marítimo terrestre, función que corresponde a las corporaciones municipales y al INVU en el marco de sus respectivas leyes. 3.De acuerdo con la misma Ley 6043 y la Ley Forestal 7575, en armonía con la jurisprudencia constitucional y los dictámenes de la Procuraduría citados en los oficios municipales (entre otros el dictamen C-297-2004), los terrenos de la ZMT, así como los bosques y terrenos forestales integrantes del Patrimonio Natural del Estado, tienen carácter de bienes de dominio público, inalienables e imprescriptibles, sobre los cuales ninguna persona puede alegar derechos de propiedad privada. 4. Así, aun cuando el recurrente afirma ostentar derechos de ocupación derivados de cesiones realizadas desde 1997 y haber pagado cánones municipales, ello no lo convierte en propietario ni le otorga un derecho subjetivo a exigir la concesión o la aprobación de un plan regulador específico, máxime tratándose de bienes demaniales sometidos al principio de indisponibilidad y a un régimen especial de derecho público.III. AUSENCIA DE CONDUCTA LESIVA ATRIBUIBLE AL ICT 1. Del relato del recurrente y de la documentación acompañada se desprende que sus reclamos se dirigen, principalmente, contra la supuesta inactividad del Concejo de Distrito de Cóbano y de la Municipalidad de Puntarenas, en cuanto a la elaboración y aprobación de un plan regulador costero que abarque el área comprendida entre los mojones 303 a 305 de Playa Manzanillo, así como en relación con la tramitación de su solicitud de concesión sobre el terreno descrito en el plano P-803302-2002. 2. El ICT no ha dictado acto alguno que deniegue o paralice el plan regulador costero del distrito de Cóbano ni la solicitud de concesión del recurrente; por el contrario, no consta en los archivos de la Institución algún proceso de generación de un plan regulador integral. 3. La resolución 1159-2023-SETENA evidencia que el proceso de incorporación de la variable ambiental al plan regulador ZMT Santa Teresa-Mal País es un trámite impulsado por el Concejo Municipal de Distrito de Cóbano, sin que se desprenda de tal resolución una obligación concreta, directa e inmediata del ICT de promover por sí solo la aprobación del plan, ni mucho menos de incluir determinados inmuebles o sectores específicos dentro de la propuesta municipal. 4.El INVU, por su parte, ha confirmado que no se le ha presentado para aprobación el plan regulador de la ZMT Santa Teresa-Mal País, por lo que la responsabilidad de impulsar el expediente recae en la municipalidad promotora, no en el ICT. 5. No existe, por tanto, omisión material antijurídica imputable al ICT que pueda considerarse generadora, por sí sola, de una lesión actual a los derechos fundamentales del recurrente, toda vez que la elaboración, presentación y aprobación del plan regulador costero corresponde, en primer término, a la municipalidad y al INVU, y la ausencia de plan regulador que incluya un sector puntual no puede ser atribuida al Instituto como ente único garante de tal instrumento. IV. SOBRE LA ALEGADA VIOLACIÓN DE DERECHOS FUNDAMENTALES 1. El recurrente vincula la inexistencia de un plan regulador integral para todo el distrito de Cóbano con la violación de su derecho a un ambiente sano y ecológicamente equilibrado (artículo 50 de la Constitución Política) y a la protección de la salud, ambiente, seguridad e intereses económicos de los consumidores y usuarios (artículo 46 constitucional), sosteniendo que la omisión prolongada de las autoridades competentes le ha impedido consolidar su situación jurídica en la ZMT. 2.Sin embargo, en lo que respecta al ICT, no se demuestra que el Instituto haya tolerado o propiciado actividades materialmente contaminantes, ni que haya emitido decisiones que comprometan negativamente el ambiente o la ordenación del territorio en el área de Manzanillo; la queja se dirige a la falta de avance en la aprobación de un plan regulador costero, cuya conducción primaria incumbe al Concejo Municipal de Distrito de Cóbano, en coordinación con SETENA e INVU. 3. La jurisprudencia de la Sala Constitucional, citada por el propio recurrente, reconoce que los planes reguladores son instrumentos valiosos para la protección del ambiente y la planificación urbana, pero también ha reiterado que las municipalidades son los sujetos centralmente responsables de la ordenación territorial en su cantón, sin que ello suponga trasladar al ICT una responsabilidad exclusiva por la omisión de esas corporaciones locales. 4.Aun cuando la ausencia de un plan regulador costero pueda ser considerada una situación indeseable desde la perspectiva del desarrollo sostenible, en este expediente no se ha evidenciado que esa omisión sea atribuible al ICT ni que exista una orden previa de la Sala incumplida por el Instituto; en consecuencia, no se configura una violación directa de derechos fundamentales imputable a este ente autónomo. 5. En cuanto a las expectativas del recurrente de obtener una concesión sobre el terreno ubicado entre los mojones 303 al 305, debe reiterarse que la ZMT es un bien demanial y que, conforme a la Ley 6043, ninguna persona puede alegar un derecho de propiedad en dicha zona, de manera que los eventuales derechos de ocupación, pagos de cánones o actos materiales realizados no generan por sí mismos un derecho fundamental a la concesión ni pueden trasladar al ICT la responsabilidad por su falta de otorgamiento.”.
  7. 7Por escrito incorporado al expediente el 11 de junio de 2026, Randall Chavarría Matarrita, alcalde de la Municipalidad de Puntarenas, rinde informe. Expone que la situación alegada es competencia del Concejo de Distrito de Cóbano.
  8. 8Por escrito incorporado al expediente el 12 de junio de 2026, Ulises Álvarez Acosta, secretario general de la Secretaría Técnica Nacional Ambiental (Setena), informa: “De la relación de hechos que fundamentan el presente proceso, se desprende una evidente ausencia de imputación fáctica directa contra esta representación estatal. De acuerdo a los hechos que fundamentan el presente recurso de Amparo, se rechaza de forma categórica y expresa alguna inactividad u omisión administrativa por parte de la Secretaría Técnica Nacional Ambiental (SETENA). Con base en los elementos técnicos y fácticos que constan en nuestros registros, se demuestra que este órgano ha actuado con absoluta diligencia, resolviendo de manera oportuna las solicitudes sometidas a su conocimiento para el Distrito de Cóbano. A continuación, se exponen los argumentos jurídicos que sustentan la consecuente improcedencia del recurso en nuestra contra: 1.Inexistencia de nexo causal y ausencia de imputación fáctica directa De la relación de hechos que fundamentan el presente proceso, se desprende una evidente ausencia de imputación fáctica directa contra esta representación estatal. El accionante enfoca su reclamo en la inexistencia de un Plan Regulador costero plenamente vigente y aprobado, así como en la falta de resolución de sus solicitudes de concesión de terreno desde el año 2006. Al respecto, es preciso aclarar que la SETENA carece de competencias legales para otorgar concesiones en la Zona Marítimo Terrestre (ZMT) o para promulgar planes reguladores, siendo estas atribuciones exclusivas y excluyentes de los Gobiernos Locales, el Instituto Costarricense de Turismo (ICT) y el Instituto Nacional de Vivienda y Urbanismo (INVU). Por ende, no existe un nexo de causalidad entre las funciones de la SETENA y el presunto perjuicio invocado por el recurrente, siendo que la mención que se realiza de esta representación en los alegatos, lo es solo a manera de antecedente, siendo que los agravios se enfocan exclusivamente hacia las corporaciones municipales. 2.Eficiencia procedimental y cumplimiento oportuno de la SETENA Contrario a lo afirmado sobre una supuesta "inactividad prolongada de las autoridades", la SETENA ha tramitado de forma célere y conforme a derecho los dos expedientes activos vinculados con el ordenamiento del distrito de Cóbano, cantón de Puntarenas: • Expediente EAE-0003-2020 ("Incorporación de la Variable Ambiental al Plan Regulador de la Zona Marítimo Terrestre de Santa Teresa-Mal País"): Este expediente —que es el directamente vinculado al reclamo del recurrente— ingresó a esta Secretaría el 28 de abril de 2020. Tras el riguroso análisis técnico correspondiente, este órgano otorgó la Viabilidad (Licencia) Ambiental mediante la resolución N° 1159-2023 del 09 de agosto de 2023. • Aprobación del Reglamento de Desarrollo Sostenible: Posteriormente, el 20 de septiembre del 2024, se sometió a conocimiento el Reglamento de Desarrollo Sostenible, el cual fue debidamente revisado y aprobado mediante la resolución N° 0650-2026 del 07 de abril de 2026, integrándose plenamente a la viabilidad ambiental otorgada. • Expediente EAE-0006-2024 ("Incorporación de la variable ambiental en el Plan Regulador del Distrito de Cóbano"): Este proceso se encuentra en fase activa de evaluación técnica.El estado actual del trámite está sujeto al cumplimiento de prevenciones, encontrándose la carga procesal en manos del proponente, quien debe presentar las subsanaciones correspondientes para que esta Secretaría pueda continuar con el dictamen de viabilidad ambiental. 3. Agotamiento de la competencia de SETENA y traslado de la carga procedimental De conformidad con el bloque de legalidad ambiental, la función de la SETENA dentro del proceso de confección de un Plan Regulador se limita estrictamente a evaluar y dictaminar la viabilidad de la variable ambiental de la propuesta. Una vez emitida la resolución aprobatoria, la competencia de este órgano precluye respecto a las subsiguientes fases de aprobación y puesta en vigencia. A la fecha, el expediente EAE-0003-2020 no cuenta con ningún trámite, solicitud o gestión pendiente de resolución ante esta Secretaría. Al haberse emitido la Viabilidad Ambiental en 2023 y la aprobación del Reglamento de Desarrollo Sostenible, en abril de 2026, la SETENA agotó su intervención.En consecuencia, el impulso procesal de los trámites sometidos para aprobación ante la SETENA y las gestiones subsiguientes para lograr la aprobación definitiva y posterior publicación del Plan Regulador una vez obtenida la resolución de Viabilidad Ambiental, corresponden de forma exclusiva a instancias externas a este órgano, a saber: el Concejo Municipal del Distrito de Cóbano, el INVU y el ICT. Conclusión Por las razones expuestas, al demostrarse que la SETENA resolvió con oportunidad legal y técnica los componentes ambientales exigidos, y al no existir a la fecha ninguna gestión pendiente bajo nuestra responsabilidad, se solicita de la manera más respetuosa a la Sala Constitucional declarar sin lugar el presente recurso de amparo en lo que respecta a la SETENA, procediendo a excluir a esta representación estatal de cualquier responsabilidad en relación al presente caso.”.
  9. 9Por escrito incorporado al expediente el 12 de junio de 2026, Kerlyn Annette Molina Corella, presidenta del Concejo Municipal de Puntarenas, rinde informe. Explica que la competencia del asunto la tiene el Concejo Municipal de Distrito de Cóbano.
  10. 10Por escrito incorporado al expediente el 23 de junio de 2026, Ronny José Montero Orozco, Minor Centeno Sandí y Lidieth Porras Córdoba, por su orden, intendente, presidente del Concejo y gestora del Departamento de Zona Marítimo Terrestre, todos del Concejo Municipal de Distrito de Cóbano, rinden informe. Señalan que el sector comprendido entre los mojones 303 y 305 actualmente no cuenta con un plan regulador vigente; sin embargo, no es por alguna situación omisión o inactividad municipal. Aduce que se está trabajando en el “Plan Regulador de la Zona Marítimo Terrestre (ZMT) de Santa Teresa-Mal País”, que abarca precisamente el área señalada por el recurrente. Explica que la variable ambiental ya fue aprobada por Setena y consultó al ICT la posibilidad de financiar el plan regulador con los recursos del inciso a) del artículo 59 de la ley nro. 6043; luego de ello, se continuará con el trámite correspondiente. Destacan que una parte del área comprendida entre los mojones 303 y 305 forma parte del “Patrimonio Natural del Estado”.
  11. 11Por escrito incorporado al expediente el 26 de agosto de 2026, los recurrentes plantean réplica a los informes de la municipalidad recurrida y concluyen: “Como se desprende de los informes rendidos por las Municipalidades de Puntarenas (obligada desde la publicación de la Ley de Planificación Urbana finales de 1968 hasta la reforma de la Ley de Zona Marítimo Terrestre a mediados de mayo del 2006) y la de Distrito de Cóbano (a partir del 15 de mayo del 2006 y hasta el día de hoy), ninguna de las 7 dos municipalidades en el período que les corresponde por competencia legal, emitieron el plan regulador correspondiente. Consideramos que el plazo ha sido suficientemente extenso para la elaboración, tramitación, aprobación y publicación en el Diario Oficial La Gaceta, y dicho incumplimiento además de infringir los derechos fundamentales expuestos, que se contemplan en los Artículos 50 y 46, y creando en el territorio del Distrito de Cóbano, una problemática ambiental e inseguridad jurídica, pues el desarrollo urbanístico y de actividades socioeconómicas se han aprobado con criterios subjetivos de quienes han tenido la responsabilidad en cada momento, es decir, sin una herramienta técnico-ambiental objetiva.”.
  12. 12En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente manifiesta que el distrito de Cóbano no cuenta en este momento con un plan regulador que abarque el área comprendida entre los mojones 303 y 305, lo cual implica el incumplimiento de la obligación de establecer formalmente las disposiciones de ordenamiento urbano y territorial conforme al ordenamiento jurídico vigente, incluyendo lo relativo a la zona marítimo terrestre. En ese contexto, aduce que desde hace años ha tramitado diversas solicitudes de concesión de terreno, atinentes al inmueble con plano nro. P-803302-2002, que se ubica entre los mojones referidos y en zona marítimo terrestre; empero, la falta del plan regulador en la zona ha impedido continuar con este requerimiento. Así, asegura que se le ha causado un perjuicio, pues desde 1997 ostenta la posesión del terreno en cuestión mediante cesión de derechos de ocupación, sin que a la fecha se haya resuelto su situación jurídica por la omisión prolongada de las autoridades competentes.

Como petitoria formula: "se declare con lugar el recurso y se le ordene a la Municipalidad del Distrito de Cóbano y a la Municipalidad de Puntarenas a emitir conforme al ordenamiento jurídico el Plan Regulador de la Zona Marítima Terrestre de Cóbano, y el Plan Regulador o de Ordenamiento Territorial que incluya todo el distrito once Cóbano, y sobre todo el área que abarca desde el mojón 303 al mojón 305, que se encuentra detallada en el piano catastrado P-803302-2002".

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)El Concejo Municipal de Distrito de Cóbano se encuentra elaborando el “Plan Regulador de la Zona Marítimo Terrestre (ZMT) de Santa Teresa -Mal País”, que abarca la zona comprendida entre los mojones 303 y 305 que señala el recurrente. (Informe de la autoridad recurrida).
  • b)Mediante resolución nro. 1159-2023 de 9 de agosto de 2023, la Setena otorgó la viabilidad ambiental en el expediente “EAE-0003-2020 (Incorporación de la Variable Ambiental al Plan Regulador de la Zona Marítimo Terrestre de Santa Teresa-Mal País)”. Posteriormente, a través de la resolución nro. 0650-2026 de 7 de abril de 2026, otorgó la viabilidad ambiental al “Reglamento de Desarrollo Sostenible” de ese proyecto. (Informe de la autoridad recurrida y prueba documental).
  • c)El plan regulador de marras continúa en trámite ante las autoridades ordinarias competentes. (Informe de la autoridad recurrida).

III. SOBRE EL CASO CONCRETO

En el sub lite, el recurrente manifiesta que el distrito de Cóbano no cuenta en este momento con un plan regulador que abarque el área comprendida entre los mojones 303 y 305, lo cual implica el incumplimiento de la obligación de establecer formalmente las disposiciones de ordenamiento urbano y territorial conforme al ordenamiento jurídico vigente, incluyendo lo relativo a la zona marítimo terrestre. En ese contexto, aduce que desde hace años ha tramitado diversas solicitudes de concesión de terreno, atinentes al inmueble con plano nro. P-803302-2002, que se ubica entre los mojones referidos y en zona marítimo terrestre; empero, la falta del plan regulador en la zona ha impedido continuar con este requerimiento. Así, asegura que se le ha causado un perjuicio, pues desde 1997 ostenta la posesión del terreno en cuestión mediante cesión de derechos de ocupación, sin que a la fecha se haya resuelto su situación jurídica por la omisión prolongada de las autoridades competentes.

Como petitoria formula: "se declare con lugar el recurso y se le ordene a la Municipalidad del Distrito de Cóbano y a la Municipalidad de Puntarenas a emitir conforme al ordenamiento jurídico el Plan Regulador de la Zona Marítima Terrestre de Cóbano, y el Plan Regulador o de Ordenamiento Territorial que incluya todo el distrito once Cóbano, y sobre todo el área que abarca desde el mojón 303 al mojón 305, que se encuentra detallada en el piano catastrado P-803302-2002".

Del estudio de los autos se tiene por demostrado, que, el Concejo Municipal de Distrito de Cóbano se encuentra elaborando el “Plan Regulador de la Zona Marítimo Terrestre (ZMT) de Santa Teresa -Mal País”, que abarca la zona comprendida entre los mojones 303 y 305 que señala el recurrente. Mediante resolución nro. 1159-2023 de 9 de agosto de 2023, la Setena otorgó la viabilidad ambiental en el expediente “EAE-0003-2020 (Incorporación de la Variable Ambiental al Plan Regulador de la Zona Marítimo Terrestre de Santa Teresa-Mal País)”. Posteriormente, a través de la resolución nro. 0650-2026 de 7 de abril de 2026, otorgó la viabilidad ambiental al “Reglamento de Desarrollo Sostenible” de ese proyecto. El plan regulador de marras continúa en trámite ante las autoridades ordinarias competentes.

Desde este panorama, prima facie se descarta alguna situación que amerite la intervención de esta jurisdicción constitucional.

En primer lugar, contrario a lo alegado por el accionante, se observa que el Concejo Municipal de Distrito de Cóbano sí se encuentra realizando las diligencias correspondientes para la elaboración del “Plan Regulador de la Zona Marítimo Terrestre (ZMT) de Santa Teresa -Mal País”, que precisamente abarca la zona comprendida entre los mojones 303 y 305. Dicho proceso se encuentra en trámite, de modo que no es posible acreditar una completa inercia u omisión de la autoridad accionada en este punto.

Ahora bien, esta Cámara observa que el reclamo concerniente a la implementación del plan regulador realmente es accesorio al alegato de fondo que el amparado plantea en el sub iudice, que atañe al retraso que esto ha significado para la resolución de sus solicitudes de otorgamiento de concesión de un terreno que se ubica en la zona de marras. Véase que, precisamente, es bajo esa finalidad que solicita se intervenga para la implementación del plan regulador de marras.

Sin embargo, cabe advertir que excede las competencias de esta Sala determinar si corresponde otorgar o no la concesión requerida por el tutelado, ni tampoco puede esta Cámara interceder ante la Administración para que realicen determinadas actuaciones para facilitar o agilizar de alguna manera el trámite de tales requerimientos (como lo sería, por ejemplo, disponer ejecutar un proyecto de plan regulador que se encuentra en trámite). Asimismo, en general, se debe resaltar que la eventual mora para tramitar y resolver una solicitud de concesión como la que refiere el amparado no se encuentra dentro de los supuestos de excepción establecidos por esta Cámara en lo atinente a una justicia pronta y cumplida según el artículo 41 de la Constitución Política (en ese mismo sentido, verbigracia ver la sentencia nro. 2025023317 de las 9:20 horas de 24 de julio de 2025), razón por la cual el recurso resulta inadmisible en esta sede constitucional, y deberá ser objeto de discusión ante la jurisdicción contencioso-administrativa, de conformidad con las siguientes consideraciones.

IV.NUEVA JUSTICIA ADMINISTRATIVA, MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, de su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación.

Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.

V. VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS

CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para la recurrente. Consecuentemente, se impone el rechazo de plano e indicarle a la parte gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara sin lugar el recurso.
