CASE FILE N° 26-029829-0007-CO PROCEEDING: AMPARO APPLICATION RULING Nº 2026032733 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 25 August 2026.
Amparo application filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.
Background:
Justice Castillo Víquez writes the opinion; and, Reasons:
The petitioner states that since 2010 he has lived in Residencial Bruno Martínez, located in Ipís de Guadalupe, and since that date he has been charged for sewerage (wastewater), which he considers illegal because he says the house has a septic tank and has never been connected to the A y A sewer system. He further alleges that the bill has increased disproportionately despite consumption remaining the same, and according to the latest bills it rose by almost 100%, to 70,000 colones, which he considers disproportionate. He says he contacts them constantly and they do not give him a logical or reasonable explanation; they only make a small reduction, but the following month the bill is the same.
In light of the petitioner’s arguments, it should be noted that this Court has held that disputes over the amount charged on a bill for drinking water service are not heard in this forum. This is a matter of legality that must be raised before the same administrative authority and, potentially, in the ordinary courts. Among others, in Judgment N° 2018-017559, issued at 10:10 a.m. on 23 October 2018, the Court stated the following:
“…The petitioner complains about the high charges on her water service bill. She says she is a single woman with limited means and has observed that the amount due on the water bill varies excessively, since the supply serves few people and the amount charged is unjustified. She explains that staff of the respondent administration have already come to inspect, but they have offered no solutions. However, this Chamber is not a legality-review body for the Administration’s actions or decisions. It is not within this Court’s jurisdiction to review, under the applicable law, whether there is a leak on the property or to determine the origin of the charge, or to establish the correct amount payable for the service received, since that is a matter for the ordinary administrative and judicial avenues. Accordingly, if the petitioner considers it appropriate, she may raise her objection or claim before the same respondent authority or before the competent judicial forum, where she may fully dispute the merits of the matter and assert her claims.
Therefore, this application is inadmissible, and so it is declared…” These considerations apply to the case under review, since this Court finds no reason to depart from the position set out in those judgments, nor any grounds to assess the situation presented differently. The application does not disclose an infringement of access to a public service, since the complaint concerns disagreement with the amount billed for drinking water service; in fact, the petitioner continues to receive that service at the property to which she refers. Accordingly, the protected party’s disagreement with the facts underlying this matter is an issue that, as stated, must be raised through the ordinary administrative or judicial avenues.
The parties are advised that if they submitted any paper document, or objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not retrieved within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session N° 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo application is summarily rejected.

EXPEDIENTE N° 26-029829-0007-CO PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026032733 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .
Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
El recurrente señala que desde el 2010 vive en el Residencial Bruno Martínez, ubicado en Ipís de Guadalupe, y desde esa fecha le han cobrado alcantarillado (aguas residuales) algo que estima ilegal, por cuanto indica que en la casa hay un tanque séptico y nunca ha estado conectado con el alcantarillado del A y A. Adicionalmente alega que la factura ha tenido un incremento desproporcionado dado que ha existido el mismo consumo, y se pasó a casi un 100% de incremento de acuerdo a las últimas facturas de 70.000 colones, algo que considera desproporcionado. Menciona que se comunica constantemente y no le dan una explicación lógica o razonable, solo le hacen un pequeño rebajo, pero al mes siguiente la factura llega igual.
Según lo planteado por la recurrente, cabe indicar que, este Tribunal ha resuelto que no es en esta sede donde se discute sobre el monto de un recibo por la prestación del servicio de agua potable. Se trata de una cuestión de legalidad que debe plantearse en la misma sede administrativa y, eventualmente, jurisdiccional ordinaria. Entre otras, en la Sentencia N° 2018-017559 de las 10:10 horas del 23 de octubre de 2018, indicó lo siguiente:
“…La recurrente reclama por lo elevados cobros que ha recibido en la factura del servicio de agua. Expresa que es mujer sola y de escasos recursos y ha observado que el monto a pagar expresado en el recibo del agua varía de forma exagerada, ya que el suministro sirve a pocas personas y no se justifica lo cobrado. Explica que el personal de la administración recurrida ya ha acudido a revisar, pero no le dan soluciones. Sin embargo, esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto a pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, este recurso es inadmisible y así se declara…”.
Consideraciones que son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dichas sentencias, ni motivos que lo hagan valorar de manera distinta en la situación planteada. Del escrito de interposición del recurso, no se desprende una lesión al acceso a un servicio público, pues lo que se acusa es la discrepancia con el monto facturado por el servicio de agua potable, pero lo cierto es que la petente mantiene el suministro de ese servicio en el inmueble a que hace referencia. A partir de lo anterior, la disconformidad de la tutelada con los hechos que sustenta este asunto, es un aspecto que, como se indicó, es propio de alegarse en la vía común -administrativa o jurisdiccional-.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
