Amparo proceeding in expediente number 26-029550-0007-CO, filed by Nombre01, identity card number CED01, on behalf of Nombre02, identity card number CED02, against the AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Background 1. By a written submission entered into the electronic expediente on 14 August 2026, the claimant files an amparo application against the Autoridad Reguladora de los Servicios Públicos and the Instituto Costarricense de Acueductos y Alcantarillados. The claimant states that the amparo beneficiary is a user of the drinking-water service supplied by the respondent authority under NIS 5403835. However, the claimant challenges excessive charges for that service and states that, despite having filed the corresponding complaints, they were denied. The claimant alleges that such charges limit the beneficiary’s right of access to water. For the foregoing reasons, the claimant considers her fundamental rights to have been violated.

2. Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily reject, or reject on the merits, at any time, including upon filing, any matter submitted to it that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is merely a reiteration or reproduction of an identical or similar prior matter that was rejected.

I. SUBJECT OF THE AMPARO APPLICATION

The claimant states that the amparo beneficiary is a user of the drinking-water service supplied by the respondent authority under NIS 5403835. However, the claimant challenges excessive charges for that service and states that, despite having filed the corresponding complaints, they were denied. The claimant alleges that such charges limit the beneficiary’s right of access to water. For the foregoing reasons, the claimant considers her fundamental rights to have been violated.

II. INADMISSIBILITY OF THE AMPARO APPLICATION

Having considered the claimant’s allegations, the Chamber points out that the purpose of an amparo application is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as an instrument for reviewing the legality of acts of the Public Administration, or as a general instrument for channeling other types of requests. For this reason, the claimant should bear in mind that this Chamber has ruled that this is not the forum in which to dispute the amount of a bill for drinking-water service. Among other decisions, in judgment No. 2018017559, at 10:10 hours on 23 October 2018, it stated:

“…The claimant complains about the high charges she has received on her water-service bill. She states that she is a woman living alone with limited means and has observed that the amount payable shown on the water bill varies excessively, since the supply serves few people and the amount charged is unjustified. She explains that staff of the respondent administration have already come to inspect, but have offered no solutions. However, this Chamber is not a reviewer of the legality of the actions or decisions of the Administration. It is not within this Court’s jurisdiction to review, under the applicable law, whether or not there is a leak on the property, or to determine the source of the charge, or to establish the correct amount payable for the service received, since this is a matter for the ordinary administrative and judicial channels. Accordingly, if the claimant considers it appropriate, she may raise her objection or complaint with the respondent authority itself, or before the competent judicial forum, where she may fully discuss the merits of the matter and assert her claims.

Accordingly, this amparo application is inadmissible, and it is so declared…”. (emphasis added) These considerations apply to the case under review, since this Court finds no reason to depart from the criterion expressed in those judgments, nor any grounds to assess the situation presented differently.

Accordingly, it is not for this jurisdiction to intervene on behalf of the amparo beneficiary before the respondent authorities in order to determine, under the nonconstitutional regulations governing the matter, whether the bill in question was properly charged. This situation concerns a dispute over legality alone, whose resolution lies outside this Court’s jurisdiction. Therefore, the claimant may, if she so wishes, raise her objections through the administrative channel itself or before the competent judicial forum, where she may fully discuss the merits of the matter and assert her claims.

Consequently, the amparo application is inadmissible.

III. DOCUMENTATION SUBMITTED TO THE EXPEDIENTE

This Chamber must advise the parties that if they have submitted any paper documents, as well as objects or evidence stored on any additional device or electronic, computer, magnetic, optical, telematic, or new-technology medium, these must be collected from the office within 30 business days after receipt of notice of this judgment; otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo application is summarily rejected.

Recurso de amparo que se tramita en el expediente número 26-029550-0007-CO, interpuesto por Nombre01, cédula de identidad número CED01, favor de Nombre02, cédula de identidad número CED02, contra la AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Resultando

1. Por escrito incorporado al expediente electrónico el 14 de agosto de 2026, la parte recurrente interpone recurso de amparo contra la Autoridad Reguladora de los Servicios Públicos y el Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta que la amparada es usuaria del servicio de agua potable suministrado por la autoridad accionada bajo el NIS 5403835. Sin embargo, reclama cobros excesivos por la prestación de dicho servicio y, pese haber presentado los reclamos correspondientes estos fueron negativos. Acusa que tal cobro limita su derecho de acceso al agua. Por lo expuesto, estima lesionados sus derechos fundamentales.

2. El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente expresa que la amparada es usuaria del servicio de agua potable suministrado por la autoridad accionada bajo el NIS 5403835. Sin embargo, reclama cobros excesivos por la prestación de dicho servicio y, pese haber presentado los reclamos correspondientes estos fueron negativos. Acusa que tal cobro limita su derecho de acceso al agua. Por lo expuesto, estima lesionados sus derechos fundamentales.

II. INADMISIBILIDAD DEL RECURSO

Vistos los alegatos de la parte recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de la Administración Pública, ni servir como un instrumento genérico para canalizar peticiones de otros tipos. Por esta razón, debe tener en cuenta la parte recurrente que esta Sala ha resuelto que no es en esta sede donde se discute sobre el monto de un recibo por la prestación del servicio de agua potable. Entre otras, en la sentencia nro. 2018017559 de las 10:10 horas del 23 de octubre de 2018, indicó lo siguiente:

“…La recurrente reclama por lo elevados cobros que ha recibido en la factura del servicio de agua. Expresa que es mujer sola y de escasos recursos y ha observado que el monto a pagar expresado en el recibo del agua varía de forma exagerada, ya que el suministro sirve a pocas personas y no se justifica lo cobrado. Explica que el personal de la administración recurrida ya ha acudido a revisar, pero no le dan soluciones. Sin embargo, esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto a pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.

Así las cosas, este recurso es inadmisible y así se declara…”. (énfasis agregado) Consideraciones que son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en tales sentencias, ni motivos que lo hagan valorar de manera distinta en la situación planteada.

De esta manera, no le corresponde a esta jurisdicción interceder a favor de la parte amparada ante las autoridades recurridas a fin de determinar, según la normativa infraconstitucional que rige la materia, la procedencia del cobro de la factura de marras. Tal situación hace referencia a un conflicto de mera legalidad, cuya resolución es ajena al ámbito de competencia de este Tribunal. Por ello, la parte recurrente podrá plantear, si a bien lo tiene, sus reparos en la propia vía administrativa o en la sede jurisdiccional competente, en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.

En consecuencia, el recurso es inadmisible.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
