CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 25 August 2026.

Amparo proceeding filed by Nombre01, identity card number CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA) AND THE ADMINISTRATIVE ASSOCIATION OF THE SAN GABRIEL AQUEDUCT (ASADA SAN GABRIEL), legal entity identification number 3-002-317684.

Background:

  1. 1In a brief submitted through Gestión en Línea at 17:56 on 13 August 2026, the applicant files an amparo proceeding and states: “FIRST. I am the registered owner of property number PRN01, located in San Gabriel de Aserrí, Dirección02. The property is private property over which I lawfully exercise the attributes inherent in the right of ownership. SECOND. On 4 November 2025, personnel from ASADA San Gabriel entered my property without my authorization and carried out work related to the installation and modification of pipes. This physical intervention took place on property I own and without previously establishing the existence of a registered real right, agreement, formally constituted easement (servidumbre), expropriation proceeding, prior compensation, or any other sufficient legal title authorizing occupation of or interference with my property. THIRD. ASADA San Gabriel intends to install or maintain water meters within my property, even though the interested users already have meters located on the public road, in front of the entrance to the easement.This circumstance is particularly relevant because it shows that, according to the facts known to me, there is no unavoidable need to place the meters within my property. FOURTH. The right-of-way easement to which the provision of the service is to be linked is not registered in favor of AyA, according to the registry and documentary information available to me. Therefore, it cannot be presumed that a private or de facto easement automatically grants ASADA or AyA a real right to enter, install infrastructure, place meters, or carry out permanent operation and maintenance work on my property. FIFTH. I do not oppose my neighbors continuing to receive the public drinking-water service. On the contrary, I have expressly stated that I agree to the continued provision of services under the alternatives contemplated by the applicable regulations, leaving the meters at the beginning of the easement, on the public road, when that is the legally and technically appropriate solution.My objection is directed exclusively at the use of my private property and the installation of infrastructure on it without first legally regularizing the interference and, where applicable, recognizing the corresponding compensation. SIXTH. AyA’s own regulation is decisive. Article 16 of the Regulation for the Provision of AyA Services, approved by Board of Directors Agreement No. 2020-442, establishes as a general rule that the service connection must be made opposite the property boundary, on a public road or on a permanent pipe and right-of-way easement registered in favor of AyA. The same provision provides, exceptionally, for connection at the beginning of a right-of-way easement registered in favor of third parties or at the beginning of a de facto easement, but on the street or public road. Therefore, the regulations invoked by the respondents themselves do not constitute general authorization to enter private property and place meters or infrastructure on it without first establishing the corresponding legal title.SEVENTH. The ASADA Regulation provides that ASADAS are private nonprofit associations responsible for managing public services by delegation from AyA. AyA also retains its status as the technical governing entity and exercises functions of control, oversight, inspection, evaluation, standard-setting, sectoral planning, and direction of the management carried out by ASADAS. Accordingly, AyA cannot disavow a physical act by an ASADA that, as alleged, directly affects a constitutional property right. EIGHTH. On 13 March 2026, I submitted a formal request to Ms. Lourdes Sáurez Barboza, Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, seeking AyA’s immediate intervention in response to the actions of ASADA San Gabriel. In that request, I described in detail:a) the unauthorized entry onto my property on 4 November 2025;b) the installation and modification of pipes;c) the intention to place meters within my property;d) the existence of meters on the public road in front of the easement entrance;e) the absence of an easement registered in favor of AyA;f) the interference with my property right;g) the existence of physical and verbal assaults related to the dispute, reported to the relevant authorities;h) my willingness for my neighbors to continue receiving water service;i) my objection solely to the use of my property without the corresponding legal and property-related regularization; andj) my express request that AyA intervene and take the measures necessary to resolve the situation. NINTH. In that same request, I asked AyA to: 1. Intervene with respect to ASADA San Gabriel; 2. Order the removal of any meter installation within my property where there was no compensation and sufficient legal title; 3. Ensure respect for my property right; 4. Formally regularize any use of my property; 5. Carry out the corresponding appraisal; 6. Ensure the compensation legally due; and 7. Issue a formal written response. TENTH. Despite the seriousness of the reported facts and the fact that the request was submitted on 13 March 2026, as of the filing of this application I have not received an effective decision addressing and resolving the reported situation. The administrative omission continues. Approximately five months have passed since that request, and AyA has provided no response from which I can determine whether it considers ASADA’s actions lawful, what legal title supposedly authorizes occupation of my property, whether a registered easement exists, whether a regularization proceeding exists, or what measures it will take to prevent further interference. ELEVENTH. The absence of a response is not merely a formal matter. The failure to issue a determination leaves me in a state of legal uncertainty and allows the threat of further physical acts on my property to persist. As the governing entity, AyA is obligated to inspect ASADAS’ actions and cannot remain passive in the face of a specific complaint concerning possible unlawful interference with private property. III. FUNDAMENTAL RIGHTS VIOLATED AND THREATENED A. Violation of Article 45 of the Political Constitution: property right Article 45 of the Political Constitution provides: ‘Property is inviolable; no one may be deprived of their property except for a legally established public interest, with prior compensation in accordance with the law.’ The constitutional provision does not prevent the State from imposing limitations on property rights when there is a genuine public-interest purpose. What the Constitution prevents is using the public interest as general authorization for an Administration or a private party exercising a public function to physically occupy private property outside the legal procedure. The public interest does not displace legality. Nor does it automatically turn private property into property for public use. If the drinking-water service requires permanent use of a portion of the applicant’s property, it is necessary to determine legally which mechanism permits that interference—an easement, interference, acquisition, expropriation, or another legally applicable mechanism—and to meet the corresponding requirements. The Expropriation Law is particularly clear in providing that its rules apply to the creation of easements and to every type of interference with property and rights, and that when the interference substantially limits the availability of the property, the mechanism of interference is inapplicable and full expropriation must be used. Accordingly, the Administration cannot obtain in fact what it would have to obtain legally through a formal proceeding. B. Violation of the principle of legality under constitutional Article 11 Article 11 of the Constitution provides that public officials are mere custodians of authority and may not arrogate powers the law does not grant them. This principle is especially relevant in this case. The provision of public drinking-water service serves a public-interest purpose, but for that very reason the entities and persons involved in providing it must act within the powers and procedures established by the legal system. An ASADA cannot interpret delegation of a public service as authorization to physically dispose of private property belonging to others. Delegation to provide a service is not an unlimited delegation of the power to interfere with private property. ASADA’s actions must remain within the framework of the delegation and the technical and legal regulations governing it. C. Violation of constitutional Article 27: right to petition and obtain a prompt resolution Article 27 of the Political Constitution guarantees freedom of petition and the right to obtain a prompt resolution. The applicant exercised that right through a brief submitted to AyA on 13 March 2026. The request was not merely an informal inquiry. It expressly sought intervention by the governing entity in a specific situation affecting private property and involving an organization that provides a public service by delegation from AyA. The absence of a response for several months directly violates constitutional Article 27. The Constitutional Jurisdiction Act provides that, when an amparo concerns the right to petition and obtain a prompt resolution and no special time limit applies, a constitutional violation is established after ten business days, without prejudice to consideration of the nature and complexity of the matter. In this case, those ten business days have been exceeded by a wide margin. Even if the matter requires technical and legal analysis, that does not authorize the Administration to remain silent indefinitely. A matter’s complexity may justify a reasoned response and, potentially, a reasonable additional period; it does not justify the complete absence of a response. D. Violation of constitutional Article 41 Constitutional Article 41 guarantees that every person may obtain redress for harm suffered to their person, property, or interests, and requires prompt and effective justice in strict accordance with the laws. The reported situation directly affects the applicant’s property and, in addition, remains without an effective administrative response. The governing entity’s failure to act prevents the owner from learning AyA’s official position and which legal mechanism it intends to use to regularize, maintain, or remove the disputed infrastructure. E. Due process and effective administrative protection The Administration may not physically affect a person’s legal sphere without an identifiable legal basis and without respecting the minimum guarantees arising from due process. If a public interest justifies interference with the property, there must be: • • • • • • • • • a legally recognizable public purpose; authority of the body ordering the interference; a statutory basis; technical and legal studies where applicable; a determination of the necessity and proportionality of the interference; a legal procedure; precise identification of the interference; determination of compensation where applicable; and an effective opportunity for the owner to exercise their rights. None of this may be replaced by a de facto physical act. IV. ASADA’S ACTIONS ARE SUBJECT TO AMPARO ASADA San Gabriel is a private association, but that alone does not exclude constitutional jurisdiction. Article 57 of the Constitutional Jurisdiction Act expressly provides that amparo lies against actions or omissions of private-law subjects when they act or are required to act in the exercise of public functions or powers, or are in a position of power against which ordinary remedies are clearly insufficient or untimely. In this case, ASADA provides the public drinking-water service by delegation from AyA. The ASADA Regulation itself defines the relationship as a delegation to manage a public service. Consequently, ASADA’s physical actions directly related to providing the service cannot be analyzed as mere acts of an ordinary private party. ASADA is subject to the legal framework governing the delegated service, and its actions may directly affect the fundamental rights of third parties. V. AY A’S CONSTITUTIONAL RESPONSIBILITY FOR ITS FAILURE TO INSPECT AyA’s constitutional responsibility alleged here is not limited to claiming that AyA itself carried out the work on 4 November 2025. The principal constitutional complaint against AyA is that, after being formally informed of possible unlawful interference with private property by an ASADA acting under its delegation, it has neither provided an effective response nor adopted the corresponding inspection and corrective measures. The Constitutive Law of AyA grants the Institute powers of direction and oversight in drinking-water matters and to determine the feasibility of projects and works relating to aqueduct systems. The ASADA Regulation also expressly establishes AyA’s technical authority over ASADAS, including functions of control, oversight, inspection, evaluation, and direction. Therefore, when faced with a specific complaint of irregular conduct, AyA cannot simply allow the situation to continue indefinitely. VI. ARTICLE 16 OF THE AYA REGULATION DOES NOT AUTHORIZE ARBITRARY OCCUPATION OF PROPERTY Article 16 of the Regulation for the Provision of AyA Services is one of the central regulatory provisions in this application. It establishes that the connection must be made opposite the property boundary, either on a public road or, where applicable, on a permanent pipe and right-of-way easement registered in favor of AyA. The provision also provides exceptional alternatives, including connection at the beginning of a right-of-way easement registered in favor of third parties or at the beginning of a de facto easement, on the street or public road. This provision must be interpreted systematically and consistently with constitutional Article 45. It cannot be interpreted as allowing ASADA to turn a private or de facto right-of-way easement into authorization to bring infrastructure and meters onto someone else’s property without sufficient legal title. On the contrary, the provision itself offers a solution compatible with the applicant’s rights: locating the connection at the beginning of the easement, on the public road, where legally appropriate. VII. THE PUBLIC INTEREST IS NOT AN EXCEPTION TO THE CONSTITUTION It is understandable that the provision of drinking water is a service of clear public interest. The applicant does not dispute that interest or seek to deprive his neighbors of the service. For that very reason, his position is balanced and proportionate. He asks that the service be provided without unlawfully sacrificing one person’s property right. The public interest must be served using the mechanisms established by the legal system. The Administration has several ways to resolve the problem: 1. keep the meters on the public road; 2. use the beginning of the easement where appropriate; 3. formally create an easement; 4. acquire the necessary rights; 5. process an interference; 6. resort to expropriation where legally appropriate; or 7. adopt another duly reasoned technical and legal solution. What is constitutionally inadmissible is a de facto course of action: entering the property, placing infrastructure, and then attempting to treat the completed physical situation as sufficient to create a right that did not previously exist. VIII. THERE IS CURRENT AND CONTINUING INTERFERENCE This application is not based solely on the event of 4 November 2025. The constitutional injury continues because:a) the dispute persists over infrastructure installed or proposed within the property;b) there is a threat of further interventions;c) the applicant has not been shown that an easement registered in favor of AyA exists to legitimize the disputed installation;d) the interference has not been legally regularized;e) AyA has not resolved the request submitted on 13 March 2026; andf) the applicant remains exposed to the possibility that the physical situation will be maintained or expanded without a prior legal determination of the parties’ rights. The alleged threat and omission are therefore current. IX. REQUEST FOR INTERIM RELIEF Pursuant to Article 41 of the Constitutional Jurisdiction Act, I request that, upon processing this application, the following immediate interim relief be ordered: 1. ASADA San Gabriel and AyA shall refrain from re-entering property number PRN01 to install, modify, expand, or move pipes, meters, or other aqueduct-related infrastructure, unless the owner expressly consents or a valid order, act, or legal title lawfully authorizes such action. 2. Any physical action aimed at installing new meters within the applicant’s property shall be suspended. 3. The existing situation shall be preserved while the Chamber considers the merits of the application. 4. The measures necessary to prevent further physical interference with the property shall be adopted. Article 41 of the Constitutional Jurisdiction Act permits suspension of the specific challenged acts and empowers the President or the reporting Justice to order the conservation or security measures necessary to prevent further harm. X. RELIEF SOUGHT For the reasons stated, I respectfully request that the Constitutional Chamber: FIRST. Admit this amparo application against the Instituto Costarricense de Acueductos y Alcantarillados (AyA) and ASADA San Gabriel, as applicable under Article 57 of the Constitutional Jurisdiction Act. SECOND. Grant the application on the grounds of violation and threatened violation of Articles 11, 27, 41, and 45 of the Political Constitution, as well as the rights recognized by the American Convention on Human Rights, particularly Articles 21 and 25. THIRD. Declare that AyA violated the applicant’s constitutional right to petition and obtain a prompt resolution by failing to resolve the request submitted on 13 March 2026 within a constitutionally reasonable period. FOURTH. Order AyA to issue an express, complete, reasoned, and consistent response concerning the request submitted on 13 March 2026, specifically addressing:a) the legality of the actions carried out by ASADA San Gabriel;b) whether an easement registered in favor of AyA exists;c) the legal basis supposedly authorizing the installation of meters within property number PRN01;d) the technical reasons that would justify not placing the meters at the beginning of the easement, on the public road;e) the measures AyA will adopt concerning ASADA’s actions; andf) the legal mechanism by which the interference would be regularized if private property must be affected. FIFTH. Order ASADA San Gabriel and AyA to refrain from further physical actions within property number PRN01 involving the installation, modification, expansion, or maintenance of infrastructure to the detriment of the applicant’s property right, unless a sufficient and valid legal title authorizes the interference. SIXTH. If meters or other installations have been placed within the property without an enabling legal title, order the respondents to take the measures necessary to restore the prior situation, insofar as technically and legally possible. SEVENTH. Order AyA to conduct the corresponding technical and legal inspection of ASADA San Gabriel’s actions and determine whether they comply with the Regulation for the Provision of AyA Services and the ASADA Regulation. EIGHTH. Order the respondents to respect the constitutional regime of private property and refrain from using the public interest as grounds for carrying out physical actions that replace the legally established procedures for creating easements, interferences, or expropriations. NINTH. If permanent use of part of the applicant’s property is legally indispensable, order the Administration to regularize the situation in advance through the legal mechanism applicable under the legal system, without prejudice to any compensation legally due. TENTH. Deem the applicant’s ordinary actions reserved for seeking determination and payment of damages, losses, compensation, property-related interference, and other economic consequences arising from the reported conduct. ELEVENTH. Order the respondents to pay costs, damages, and losses, as applicable under the Constitutional Jurisdiction Act.” (SIC).
  2. 2Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily or on the merits reject, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that sufficient grounds exist to reject it, or that it is merely a repetition or reproduction of an identical or similar prior application that was rejected.

I. SUBJECT OF THE APPLICATION

The applicant is the registered owner of property located in San Gabriel de Aserrí, Dirección02. He states that on 4 November 2025 personnel from the respondent ASADA entered his property without authorization and carried out pipe installation and modification work. He indicates that these actions were carried out without establishing the existence of a registered easement, agreement, expropriation proceeding, prior compensation, or other legal title authorizing occupation of or interference with his property. He states that ASADA San Gabriel intends to install or maintain water meters on his property, although, according to him, the relevant users already have meters located on the public road in front of the easement entrance. He reports that the right-of-way easement associated with the service supply is not registered in favor of AyA and therefore questions whether any right exists authorizing entry, infrastructure installation, or permanent work on his property.

He states that on 13 March 2026 he submitted a formal request to AyA’s Executive President, seeking institutional intervention regarding the actions of ASADA San Gabriel. However, as of the filing of this amparo, no response has been provided.

He considers that the foregoing violates his fundamental rights. He requests an order directing AyA to resolve his complaint and assume administration of the ASADA; an order requiring removal of the meter installation on his property if he is not compensated; regularization of the use of his property; an official appraisal of the property and the interference arising from its use in accordance with the technical criteria established in the current legislation; and assurance of full compensation for the creation of a permanent pipe and right-of-way easement registered in favor of AyA.

II. AMPARO AGAINST THE ASADA

Having reviewed the applicant’s allegations and claims, the Chamber informs him that it is not an oversight body for the legality of the actions or decisions issued by the ASADA concerning provision of water service, infrastructure, and easements, nor may it replace the active Administration in the exercise of its powers. It therefore may not act as an appellate court in this area and review whether the ASADA’s conduct complies with the law, whether it has authorization, an easement, or legal authority to carry out the cited work, much less determine, under technical and legal criteria, whether payment or compensation is due to the applicant. These are matters of ordinary legality that must be resolved through the ordinary administrative or judicial channel, not before this specialized jurisdiction. In light of the foregoing, the applicant must bring his objections or claims before the respondent authorities or in the competent judicial forum, where he may fully litigate the merits and assert his claims. Accordingly, the amparo is inadmissible on this point.

III.- - ALLEGED ADMINISTRATIVE DELAY. The request submitted by the applicant to AyA on 13 March 2026, whose lack of response he challenges, is not a simple request for information protected by Article 27 of the Political Constitution. Rather, it is an administrative claim brought by the applicant concerning ASADA San Gabriel’s actions on his property, to which Article 41 of the Political Constitution applies, since it requires a determination by the Administration. However, beginning with decision number 2008-02545, issued at 8:55 a.m. on 22 February 2008, and subject to certain exceptions, this Chamber has referred such claims to the administrative-litigation jurisdiction. The issue raised here is not one of the exceptions the Chamber has accepted for considering the alleged violation of the right to obtain prompt and effective administrative justice. Accordingly, the proper course is to refer the applicant to the administrative-litigation channel to complain of the delay in question, on the basis of the following reasons.

IV. NEW ADMINISTRATIVE JUSTICE

AN EXPEDITIOUS AND EFFECTIVE MECHANISM FOR PROTECTING THE SUBSTANTIVE LEGAL POSITIONS OF ADMINISTRATIVE PARTIES. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in view of the absence of swift and expeditious procedural avenues for protecting substantive legal positions grounded in the infra-constitutional legal system or legality framework, which are indirectly connected to fundamental rights and the Law of the Constitution. In this regard, it must be kept in mind that the Constitution, by virtue of its supremacy, super-legality, and direct and immediate effect, indirectly grounds any conceivable substantive legal position of individuals. Nevertheless, upon better consideration and following enactment of the Administrative Litigation Procedure Code (Law No. 8508 of 24 April 2006), which entered into force on 1 January 2008, it has become clear that litigants now have access to a plenary and universal administrative-litigation jurisdiction that is highly expeditious and swift because of the various procedural mechanisms that legislation incorporates into the legal system.

These include shorter time limits for taking the various procedural steps, broad standing, interim measures, an open-ended range of claims that may be brought, oral proceedings—and their sub-principles of concentration, immediacy, and expedition—single-instance proceedings with a right of appeal in expressly specified situations, in-proceeding conciliation, a unified proceeding, a preferred-track proceeding or “amparo of legality,” proceedings on the merits, new enforcement measures (coercive fines, substitute or commissarial enforcement, attachment of property in the fiscal domain and some property in the public domain), the broad powers of the enforcement judges, the extension and adaptation of the effects of case law to third parties, and flexibility in cassation appeals. The express purpose of all these novel procedural institutions is to achieve procedural economy, expedition, promptness, and effective protection of the substantive legal positions of administrative parties, all while safeguarding basic fundamental rights such as due process, the right of defense, and adversarial proceedings.

In sum, the new administrative-litigation jurisdiction is a suitable avenue, given its new features of simplicity, expedition, and promptness, for the effective protection of the substantive legal positions of administrative parties where evidence must be gathered or questions of ordinary legality must be resolved.

V. VERIFICATION OF STATUTORY TIME LIMITS FOR RESOLVING ADMINISTRATIVE PROCEEDINGS

AN EVIDENT MATTER OF ORDINARY LEGALITY. It is evident that determining whether the public Administration complies with the time limits established by the General Public Administration Law (Articles 261 and 325) or sector-specific laws governing special administrative proceedings, whether to resolve an administrative proceeding by final act—initiated ex officio or at a party’s request—or to hear the applicable administrative appeals, is plainly a matter of ordinary legality. Going forward, this may be litigated and resolved before the administrative-litigation jurisdiction, applying the principles that inform constitutional jurisdiction, such as vicariate standing, the possibility of appearing without counsel, and exemption from costs for the applicant. Consequently, summary rejection is required, and the applicant is advised that, if he so wishes, he may proceed before the administrative-litigation jurisdiction.

VI. NOTE BY JUSTICE CASTILLO VÍQUEZ CONCERNING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the Administrative Litigation Courts, rather than this Chamber, must hear the legal dispute. However, with the recent enactment of Law n.° 9097, Law Regulating the Right of Petition, it has been established that this right is subject to judicial protection through the amparo proceeding provided for by Article 32 of the Constitutional Jurisdiction Act, in conjunction with Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s physical actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not mean that this Court must change its line of precedent, since under Article 7 of its Law it is exclusively for this Court to define its own jurisdiction.

Accordingly, except for those constitutional legal disputes that this same Chamber has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo proceeding, the Administrative Litigation Judges have jurisdiction in all other cases, for the reasons this Court has given (decision No. 2008-02545, issued at 8:55 a.m. on 22 February 2008). All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable statutory provisions, based on a logical, systematic, and teleological interpretation of the legal system.

VII. DISSENTING VOTE BY JUSTICE CRUZ CASTRO CONCERNING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

Although in the past I have held the Court’s majority view, upon better consideration of the fundamental rights being asserted, I consider that administrative delay constitutes a violation of a fundamental procedural guarantee. For that reason, I change the position I previously expressed and accept that there may have been an infringement of the right to prompt and effective administrative justice, departing from the Court majority’s view that—save for a few exceptions—this type of complaint must be resolved in the administrative-litigation jurisdiction. On the contrary, I consider that one of the rights this jurisdiction is called upon to protect is the right to prompt and effective justice, expressly enshrined in constitutional Article 41. This follows from the jurisdiction assigned to this Court in matters concerning protection of fundamental rights, under Articles 10 and 48 of the Political Constitution. Although I understand the importance of the reforms to the administrative-litigation jurisdiction following the entry into force of Law 8508 of 24 April 2006, that circumstance does not justify referring matters within this Chamber’s jurisdiction to that forum. Over the years, this Chamber has shown itself to be a swift and effective means of protecting the country’s inhabitants’ fundamental rights.

VIII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The applicant is advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that may have been submitted, must be collected from the court office within a maximum of 30 business days from notification of this judgment. Otherwise, any such material not collected within this period will be destroyed, pursuant to the “Regulation on Electronic Case Files in the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The application is summarily rejected. Justice Castillo Víquez files a note concerning constitutional Article 41. Justice Cruz Castro dissents concerning constitutional Article 41.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre01, cédula de identidad número CED01; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA) Y LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DE SAN GABRIEL (ASADA SAN GABRIEL), cédula jurídica número 3-002-317684.

Resultando:

  1. 1Por escrito presentado por Gestión en Línea a las 17:56 horas del 13 de agosto de 2026, el recurrente interpone recurso de amparo y manifiesta que: “PRIMERO Soy propietario registral de la finca número PRN01, ubicada en San Gabriel de Aserrí, Dirección02. La propiedad constituye un bien privado respecto del cual ejerzo legítimamente los atributos inherentes al derecho de propiedad. SEGUNDO El día 4 de noviembre de 2025, personal de la ASADA San Gabriel ingresó a mi propiedad sin mi autorización y realizó trabajos relacionados con la instalación y modificación de tuberías. Dicha intervención material se realizó dentro de un inmueble de mi propiedad y sin que previamente se me hubiera acreditado la existencia de un derecho real inscrito, convenio, servidumbre formalmente constituida, procedimiento expropiatorio, indemnización previa o cualquier otro título jurídico suficiente que autorizara la ocupación o afectación de mi inmueble.TERCERO La ASADA San Gabriel pretende instalar o mantener medidores de agua dentro de mi finca, aun cuando los usuarios interesados ya cuentan con medidores ubicados en la vía pública, frente al acceso de la servidumbre. Esta circunstancia es particularmente relevante porque demuestra que no existe, según los hechos conocidos por el suscrito, una necesidad inevitable de colocar los medidores dentro de mi propiedad. CUARTO La servidumbre de paso a la que se pretende vincular la prestación del servicio no se encuentra inscrita a favor del AyA, según la información registral y documental de que dispone el suscrito. Por ello, no puede presumirse que una servidumbre privada o una servidumbre de hecho otorgue automáticamente a la ASADA o al AyA un derecho real para ingresar, instalar infraestructura, colocar medidores o realizar labores permanentes de operación y mantenimiento dentro de mi inmueble.QUINTO El suscrito no se opone a que los vecinos continúen recibiendo el servicio público de agua potable. Por el contrario, expresamente he manifestado que estoy de acuerdo con que los servicios continúen prestándose bajo las alternativas contempladas por la normativa aplicable, dejando los medidores al inicio de la servidumbre, sobre la vía pública, cuando esa sea la solución jurídica y técnicamente procedente. Mi oposición se dirige exclusivamente contra la utilización de mi propiedad privada y la instalación de infraestructura dentro de ella sin que previamente se haya regularizado jurídicamente la afectación y, cuando corresponda, se haya reconocido la indemnización respectiva. SEXTO La propia regulación del AyA resulta determinante. El artículo 16 del Reglamento para la Prestación de Servicios de AyA, aprobado mediante Acuerdo de Junta Directiva No. 2020-442, establece como regla que la conexión del servicio debe realizarse frente al lindero del inmueble, sobre vía pública o sobre una servidumbre permanente de tubería y paso inscrita a favor del AyA.La misma norma contempla excepcionalmente la conexión al inicio de una servidumbre de paso inscrita a favor de terceros o al inicio de una servidumbre de hecho, pero sobre la calle o vía pública. Por tanto, la normativa invocada por los propios recurridos no constituye una autorización general para ingresar a una propiedad privada y colocar dentro de ella medidores o infraestructura sin acreditar previamente el título jurídico correspondiente. SÉTIMO El Reglamento de ASADAS establece que las ASADAS son asociaciones privadas sin fines de lucro encargadas de gestionar los servicios públicos por delegación del AyA. Asimismo, el AyA conserva la condición de ente rector técnico y ejerce funciones de control, vigilancia, fiscalización, evaluación, normalización, planificación sectorial y dirección de la gestión que realizan las ASADAS. Por ello, el AyA no puede desentenderse de una actuación material de una ASADA que, según lo denunciado, está afectando directamente un derecho constitucional de propiedad.OCTAVO El día 13 de marzo de 2026, presenté ante la señora Lourdes Sáurez Barboza, Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, una gestión formal solicitando la intervención inmediata del AyA ante las actuaciones de la ASADA San Gabriel. En dicha gestión expuse detalladamente:a) el ingreso no autorizado a mi propiedad ocurrido el 4 de noviembre de 2025;b) la instalación y modificación de tuberías;c) la pretensión de colocar medidores dentro de mi finca;d) la existencia de medidores en vía pública frente al acceso de la servidumbre;e) la ausencia de una servidumbre inscrita a favor del AyA;f) la afectación de mi derecho de propiedad;g) la existencia de agresiones físicas y verbales relacionadas con el conflicto, denunciadas ante las autoridades correspondientes;h) mi disposición a que los vecinos continúen recibiendo el servicio de agua;i) mi oposición exclusivamente a que se utilice mi propiedad sin la correspondiente regularización jurídica y patrimonial; yj) mi solicitud expresa para que el AyA interviniera y asumiera las medidas necesarias para solucionar la situación. NOVENO En esa misma gestión solicité al AyA que: 1. Interviniera respecto de la ASADA San Gabriel; 2. Ordenara eliminar cualquier instalación de medidores dentro de mi propiedad, cuando no existiera indemnización y título jurídico suficiente; 3. Garantizara el respeto de mi derecho de propiedad; 4. Regularizara formalmente cualquier utilización de mi inmueble; 5. Practicara la tasación correspondiente; 6. Garantizara la indemnización que jurídicamente correspondiera; y 7. Emitiera una respuesta formal y escrita. DÉCIMO A pesar de la gravedad de los hechos denunciados y de que la gestión fue presentada desde el 13 de marzo de 2026, a la fecha de presentación de este recurso no he recibido una resolución efectiva que atienda y resuelva la situación denunciada. La omisión administrativa continúa. Han transcurrido aproximadamente cinco meses desde aquella gestión sin que el AyA haya brindado una respuesta que permita conocer si considera legítima la actuación de la ASADA, cuál es el título jurídico que supuestamente habilita la ocupación de mi propiedad, si existe una servidumbre inscrita, si existe un procedimiento de regularización, o qué medidas adoptará para impedir nuevas afectaciones. UNDÉCIMO La ausencia de respuesta no constituye una cuestión meramente formal. La falta de pronunciamiento mantiene al suscrito en una situación de incertidumbre jurídica y permite que persista la amenaza de nuevas actuaciones materiales sobre mi propiedad. El AyA, como ente rector, tiene la obligación de fiscalizar la actuación de las ASADAS y no puede permanecer pasivo ante una denuncia concreta sobre una posible afectación ilegítima de propiedad privada. III. DERECHOS FUNDAMENTALES VIOLADOS Y AMENAZADOS A. Violación del artículo 45 de la Constitución Política: derecho de propiedad El artículo 45 de la Constitución Política establece: “La propiedad es inviolable; a nadie puede privarse de la suya si no es por interés público legalmente comprobado, previa indemnización conforme a la ley.” La norma constitucional no impide que el Estado establezca limitaciones al derecho de propiedad cuando exista una verdadera finalidad de interés público. Lo que la Constitución impide es que el interés público sea utilizado como una autorización genérica para que una Administración o un particular que ejerce una función pública pueda ocupar materialmente un inmueble privado al margen del procedimiento legal. El interés público no elimina la legalidad. Tampoco convierte automáticamente una propiedad privada en un bien de uso público. Si para garantizar el servicio de agua potable resulta indispensable utilizar permanentemente una porción de la finca del recurrente, corresponde determinar jurídicamente cuál es la figura que permite dicha afectación —servidumbre, afectación, adquisición, expropiación u otra legalmente procedente— y cumplir los requisitos correspondientes. La Ley de Expropiaciones resulta especialmente clara al disponer que sus reglas son aplicables a la constitución de servidumbres y a todo tipo de afectación de bienes y derechos, y que cuando la afectación limite sustancialmente la disponibilidad del bien, la figura de afectación resulta improcedente y debe acudirse a la expropiación integral. Por consiguiente, la Administración no puede obtener de hecho lo que jurídicamente tendría que obtener mediante un procedimiento formal. B. Violación del principio de legalidad del artículo 11 constitucional El artículo 11 de la Constitución dispone que los funcionarios públicos son simples depositarios de la autoridad y que no pueden arrogarse facultades que la ley no les concede. Este principio adquiere especial relevancia en el presente caso. La prestación del servicio público de agua potable constituye una finalidad de interés público, pero precisamente por ello las entidades y sujetos que participan en dicha prestación deben actuar dentro de las competencias y procedimientos establecidos por el ordenamiento. Una ASADA no puede interpretar la delegación del servicio público como una autorización para disponer materialmente de bienes privados ajenos. La delegación para prestar un servicio no equivale a una delegación ilimitada del poder de afectar la propiedad privada. La actuación de la ASADA debe permanecer dentro del marco de la delegación y de la normativa técnica y jurídica que la regula. C. Violación del artículo 27 constitucional: derecho de petición y pronta resolución El artículo 27 de la Constitución Política garantiza la libertad de petición y el derecho a obtener pronta resolución. El recurrente ejerció ese derecho mediante escrito presentado al AyA el 13 de marzo de 2026. La gestión no fue una consulta meramente informal. Se solicitó expresamente la intervención del ente rector ante una situación concreta que afecta una propiedad privada y que involucra a una organización que presta un servicio público por delegación del AyA. La ausencia de respuesta durante varios meses constituye una afectación directa del artículo 27 constitucional. La Ley de la Jurisdicción Constitucional establece que, cuando el amparo se refiere al derecho de petición y pronta resolución y no existe un plazo especial, transcurridos diez días hábiles se configura la violación constitucional, sin perjuicio de que se valore la naturaleza y complejidad del asunto. En el presente caso han transcurrido ampliamente esos diez días hábiles. Aun aceptando que el asunto requiere análisis técnico y jurídico, ello no autoriza a la Administración a guardar silencio indefinidamente. La complejidad de un asunto puede justificar una respuesta razonada y eventualmente un plazo adicional razonable; no justifica la ausencia absoluta de respuesta. D. Violación del artículo 41 constitucional El artículo 41 constitucional garantiza que toda persona encuentre reparación por los daños recibidos en su persona, propiedad o intereses y exige justicia pronta, cumplida y en estricta conformidad con las leyes. La situación denunciada afecta directamente la propiedad del recurrente y, además, permanece sin una respuesta administrativa efectiva. La ausencia de actuación del ente rector impide al propietario conocer cuál es la posición oficial del AyA y qué mecanismo jurídico pretende utilizarse para regularizar, mantener o eliminar la infraestructura cuestionada. E. Debido proceso y tutela administrativa efectiva La Administración no puede afectar materialmente la esfera jurídica de una persona sin que exista una base jurídica identificable y sin respetar las garantías mínimas derivadas del debido proceso. Si existe un interés público que justifica afectar el inmueble, debe existir: • • • • • • • • • una finalidad pública jurídicamente reconocible; competencia del órgano que dispone la afectación; fundamento normativo; estudios técnicos y jurídicos cuando correspondan; determinación de la necesidad y proporcionalidad de la afectación; procedimiento legal; identificación precisa de la afectación; determinación de la indemnización cuando corresponda; y posibilidad efectiva del propietario de ejercer sus derechos. Nada de ello puede sustituirse mediante una actuación material de hecho. IV. LA ACTUACIÓN DE LA ASADA ES SUSCEPTIBLE DE AMPARO La ASADA San Gabriel es una asociación privada, pero ello no excluye por sí mismo la jurisdicción constitucional. El artículo 57 de la Ley de la Jurisdicción Constitucional establece expresamente que el recurso de amparo procede contra acciones u omisiones de sujetos de derecho privado cuando actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren en una posición de poder frente a la cual los remedios ordinarios sean claramente insuficientes o tardíos. En este caso, la ASADA presta el servicio público de agua potable por delegación del AyA. El propio Reglamento de ASADAS define la relación como una delegación para la gestión de un servicio público. Por consiguiente, las actuaciones materiales de la ASADA relacionadas directamente con la prestación del servicio no pueden analizarse como simples actos de un particular cualquiera. La ASADA está sometida al marco jurídico que rige la prestación del servicio delegado y sus actuaciones pueden afectar directamente derechos fundamentales de terceros. V. RESPONSABILIDAD CONSTITUCIONAL DEL AYA POR SU OMISIÓN DE FISCALIZACIÓN La responsabilidad constitucional que aquí se denuncia respecto del AyA no se limita a afirmar que el AyA realizó personalmente los trabajos del 4 de noviembre de 2025. El reproche constitucional principal contra el AyA consiste en que, habiendo sido informado formalmente de una posible afectación ilegítima de propiedad privada por parte de una ASADA que actúa por delegación suya, no ha brindado una respuesta efectiva ni ha adoptado las medidas de fiscalización y corrección correspondientes. La Ley Constitutiva del AyA atribuye al Instituto competencias de dirección y vigilancia en materia de agua potable y de determinación de la viabilidad de proyectos y obras relacionadas con los sistemas de acueductos. Asimismo, el Reglamento de ASADAS establece expresamente la rectoría técnica del AyA sobre las ASADAS, incluyendo funciones de control, vigilancia, fiscalización, evaluación y dirección. Por ello, frente a una denuncia concreta de actuación irregular, el AyA no puede limitarse a dejar que la situación continúe indefinidamente. VI. EL ARTÍCULO 16 DEL REGLAMENTO DE AYA NO AUTORIZA LA OCUPACIÓN ARBITRARIA DE LA PROPIEDAD El artículo 16 del Reglamento para la Prestación de Servicios de AyA constituye uno de los elementos normativos centrales del presente recurso. La regla establece que la conexión debe realizarse frente al lindero del inmueble, ya sea sobre vía pública o sobre una servidumbre permanente de tubería y paso inscrita a favor del AyA cuando corresponda. La norma contempla además alternativas excepcionales, entre ellas la conexión al inicio de una servidumbre de paso inscrita a favor de terceros o al inicio de una servidumbre de hecho, sobre la calle o vía pública. Esta disposición debe interpretarse de manera sistemática y conforme con el artículo 45 constitucional. No puede interpretarse de manera que permita a la ASADA convertir una servidumbre de paso privada o de hecho en una autorización para introducir infraestructura y medidores dentro de una finca ajena sin título jurídico suficiente. Por el contrario, la propia norma proporciona una solución compatible con los derechos del recurrente: ubicar la conexión al inicio de la servidumbre, sobre la vía pública, cuando jurídicamente proceda. VII. EL INTERÉS PÚBLICO NO CONSTITUYE UNA EXCEPCIÓN A LA CONSTITUCIÓN Es comprensible que la prestación de agua potable constituya un servicio de evidente interés público. El recurrente no cuestiona ese interés ni pretende privar a los vecinos del servicio. Precisamente por ello, su posición es equilibrada y proporcional. Lo que se solicita es que el servicio se preste sin sacrificar ilegítimamente el derecho de propiedad de una persona. El interés público debe realizarse mediante los instrumentos que el ordenamiento jurídico establece. La Administración tiene múltiples mecanismos para solucionar el problema: 1. mantener los medidores en la vía pública; 2. utilizar el inicio de la servidumbre cuando corresponda; 3. constituir formalmente una servidumbre; 4. adquirir los derechos necesarios; 5. tramitar una afectación; 6. acudir a la expropiación cuando jurídicamente corresponda; o 7. adoptar otra solución técnica y jurídica debidamente fundamentada. Lo que no resulta constitucionalmente admisible es la vía de hecho: ingresar a la propiedad, colocar infraestructura y posteriormente pretender que la situación material consumada sea suficiente para crear el derecho que previamente no existía. VIII. EXISTE UNA AFECTACIÓN ACTUAL Y CONTINUADA El presente recurso no se sustenta exclusivamente en el hecho ocurrido el 4 de noviembre de 2025. La lesión constitucional se mantiene por cuanto:a) persiste la controversia sobre infraestructura instalada o pretendida dentro de la propiedad;b) existe una amenaza de nuevas intervenciones;c) no se ha acreditado al recurrente la existencia de una servidumbre inscrita a favor del AyA que legitime la instalación cuestionada;d) no se ha producido la regularización jurídica de la afectación;e) el AyA no ha resuelto la gestión presentada el 13 de marzo de 2026; yf) el recurrente continúa expuesto a que la situación material sea mantenida o ampliada sin que previamente exista una definición jurídica sobre los derechos de las partes. Por ello, la amenaza y la omisión denunciadas son actuales. IX. SOLICITUD DE MEDIDA CAUTELAR Con fundamento en el artículo 41 de la Ley de la Jurisdicción Constitucional, solicito que, al dar curso al presente recurso, se disponga como medida cautelar inmediata: 1. Que la ASADA San Gabriel y el AyA se abstengan de ingresar nuevamente a la finca número PRN01 para instalar, modificar, ampliar o trasladar tuberías, medidores u otra infraestructura relacionada con el acueducto, salvo que exista consentimiento expreso del propietario o una orden, acto o título jurídico válido que habilite legalmente dicha actuación. 2. Que se suspenda cualquier actuación material dirigida a instalar nuevos medidores dentro de la propiedad del recurrente. 3. Que se ordene conservar la situación existente mientras la Sala conoce el fondo del recurso. 4. Que se adopten las medidas necesarias para impedir nuevas afectaciones materiales a la propiedad. El artículo 41 de la Ley de la Jurisdicción Constitucional permite la suspensión de los actos concretos impugnados y faculta a la Presidencia o al Magistrado instructor para dictar las medidas de conservación o seguridad necesarias para prevenir nuevos daños. X. PETITORIA Por las razones expuestas, respetuosamente solicito a la Sala Constitucional: PRIMERO Que admita el presente recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados (AyA) y contra la ASADA San Gabriel, en lo que corresponda conforme al artículo 57 de la Ley de la Jurisdicción Constitucional. SEGUNDO Que declare con lugar el recurso por violación y amenaza de violación de los artículos 11, 27, 41 y 45 de la Constitución Política, así como de los derechos reconocidos por la Convención Americana sobre Derechos Humanos, particularmente sus artículos 21 y 25. TERCERO Que declare que el AyA violó el derecho constitucional de petición y pronta resolución del recurrente al no resolver la gestión presentada el 13 de marzo de 2026 dentro de un plazo constitucionalmente razonable. CUARTO Que ordene al AyA emitir una respuesta expresa, completa, motivada y congruente respecto de la gestión presentada el 13 de marzo de 2026, pronunciándose específicamente sobre:a) la legalidad de las actuaciones realizadas por la ASADA San Gabriel;b) la existencia o inexistencia de una servidumbre inscrita a favor del AyA;c) el fundamento jurídico que supuestamente habilita la instalación de medidores dentro de la finca número PRN01;d) las razones técnicas que justificarían no ubicar los medidores al inicio de la servidumbre, sobre la vía pública;e) las medidas que adoptará el AyA respecto de la actuación de la ASADA; yf) el mecanismo jurídico mediante el cual, de ser indispensable afectar la propiedad privada, se pretende regularizar dicha afectación. QUINTO Que se ordene a la ASADA San Gabriel y al AyA abstenerse de realizar nuevas actuaciones materiales dentro de la finca número PRN01 que impliquen instalación, modificación, ampliación o mantenimiento de infraestructura en perjuicio del derecho de propiedad del recurrente, salvo que exista título jurídico suficiente y válido que autorice la afectación. SEXTO Que, si existen medidores u otras instalaciones colocadas dentro de la propiedad sin título jurídico habilitante, se ordene a los recurridos adoptar las medidas necesarias para restablecer la situación anterior, en cuanto ello resulte técnica y jurídicamente posible. SÉTIMO Que se ordene al AyA realizar la correspondiente fiscalización técnica y jurídica de las actuaciones de la ASADA San Gabriel y determinar si estas se ajustan al Reglamento para la Prestación de Servicios de AyA y al Reglamento de ASADAS. OCTAVO Que se ordene a los recurridos respetar el régimen constitucional de propiedad privada y abstenerse de utilizar el interés público como fundamento para ejecutar actuaciones materiales que sustituyan los procedimientos legalmente establecidos para constituir servidumbres, afectaciones o expropiaciones. NOVENO Que, en caso de resultar jurídicamente indispensable la utilización permanente de parte del inmueble del recurrente, se ordene a la Administración regularizar previamente la situación mediante la figura jurídica que corresponda conforme al ordenamiento, sin perjuicio de la indemnización que legalmente proceda. DÉCIMO Que se tengan por reservadas al recurrente las acciones ordinarias que correspondan para reclamar la determinación y liquidación de los daños, perjuicios, indemnizaciones, afectaciones patrimoniales y demás consecuencias económicas derivadas de la actuación denunciada. UNDÉCIMO Que se condene a los recurridos al pago de costas, daños y perjuicios, conforme corresponda de acuerdo con la Ley de la Jurisdicción Constitucional.” (SIC).
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente es propietario registral de una finca ubicada en San Gabriel de Aserrí, Dirección02. Indica que el 4 de noviembre de 2025 personal de la ASADA recurrida ingresó a su propiedad sin autorización y efectuó trabajos de instalación y modificación de tuberías. Señala que tales actuaciones se realizaron sin que se le acreditara la existencia de una servidumbre inscrita, convenio, procedimiento expropiatorio, indemnización previa u otro título jurídico que habilitara la ocupación o afectación de su finca. Manifiesta que la ASADA San Gabriel pretende instalar o mantener medidores de agua dentro de su propiedad, pese a que, según afirma, los usuarios respectivos ya cuentan con medidores ubicados en la vía pública, frente al acceso de la servidumbre. Refiere que la servidumbre de paso vinculada al suministro del servicio no se encuentra inscrita a favor del AyA, por lo que cuestiona la existencia de un derecho que habilite el ingreso, instalación de infraestructura o labores permanentes dentro de su inmueble.

Indica que el 13 de marzo de 2026 presentó una gestión formal ante la Presidenta Ejecutiva del AyA, solicitando la intervención institucional respecto de las actuaciones de la ASADA San Gabriel. Sin embargo, a la fecha de interposición de este amparo no se le ha brindado respuesta.

Estima que lo anterior lesiona sus derechos fundamentales. Solicita que se ordene al AyA resuelva su reclamo y asuma la administración de la ASADA, se ordene la eliminación de la instalación de medidores en su propiedad en caso de no ser indemnizado, la regularización del uso de su propiedad, se practique una tasación oficial del inmueble y de las afectaciones derivadas del uso, conforme a los criterios técnicos establecidos en la legislación vigente; se garantice el pago de la indemnización integral respecto a la constitución de una servidumbre permanente de tubería y de paso inscrita a favor del AyA.

II. SOBRE EL AMPARO CONTRA LA ASADA

Vistos los alegatos y pretensiones del recurrente, se le hace saber que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones que emita la ASADA en materia de prestación del servicio de agua, infraestructura y servidumbres y tampoco puede reemplazar a la Administración activa en la gestión de sus competencias, de modo que no le corresponde actuar como tribunal de alzada en la materia y revisar si lo actuado por la ASADA se ajusta a Derecho, si cuenta con autorización, servidumbre o habilitación legal para realizar los trabajos que se citan, ni mucho menos determinar conforme a criterios técnicos y legales, la procedencia o no de un pago o indemnización a favor del amparado, pues se trata de extremos de legalidad ordinaria que deben ser dirimidos en la vía común, administrativa o jurisdiccional y no ante esa jurisdicción especializada. En virtud de lo expuesto, deberá la parte recurrente plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, el amparo resulta inadmisible en cuanto a este extremo.

III.- - SOBRE LA ALEGADA MORA ADMINISTRATIVA. La gestión formulada por el recurrente 13 de marzo de 2026 ante el AyA, cuya falta de respuesta reclama, no constituye una solicitud de información pura y simple protegida por el artículo 27 de la Constitución Política; sino que se trata de un reclamo administrativo planteado por el amparado respecto de las actuaciones de la ASADA San Gabriel en su propiedad, a lo cual le es aplicable lo dispuesto en el artículo 41 de la Constitución Política, pues requiere un pronunciamiento por parte de la Administración. Ahora bien, a partir del voto número 2008-02545 de las 8:55 horas del 22 de febrero de 2008 y salvo algunas excepciones, esta Sala ha remitido este tipo de reclamos a la jurisdicción contencioso administrativa y, precisamente, el tema aquí planteado no es una de las excepciones que esta Sala ha admitido para conocer la alegada violación al derecho a obtener justicia administrativa pronta y cumplida. En consecuencia, lo procedente es remitir a la parte recurrente a la vía contenciosa a acusar el retardo en cuestión, con fundamento en los siguientes considerandos.

IV.NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación.

Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.

V. VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS

CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para la parte recurrente. Consecuentemente, se impone el rechazo de plano e indicarle a la persona gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa.

VI. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VII. VOTO SALVADO DEL MAGISTRADO CRUZ CASTRO, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

Si bien en el pasado he sostenido el criterio de mayoría del Tribunal, bajo una mejor ponderación de los derechos fundamentales que se reclaman, estimo que la mora administrativa constituye una lesión a una garantía procesal fundamental, razón por la que cambio el criterio que había expuesto, admitiendo la posible infracción al derecho a una justicia administrativa pronta y cumplida, separándome de la visión de la mayoría del Tribunal, en el sentido que –salvo contadas excepciones- este tipo de reproches deben resolverse en la jurisdicción contenciosa administrativa. Por el contrario, estimo que uno de los derechos que esta jurisdicción se encuentra llamada a tutelar es el de la justicia pronta y cumplida, expresamente consagrado en el artículo 41 constitucional. Ello conforme al ámbito de competencia asignado a este Tribunal en materia de protección a derechos fundamentales, en atención a lo dispuesto en los artículos 10 y 48 de la Constitución Política.

Si bien, entiendo la importancia de las reformas de la jurisdicción contencioso administrativa a partir de la vigencia de la Ley 8508 del veinticuatro de abril de dos mil seis, lo cierto es que dicha situación no justifica la remisión a dicha instancia de los asuntos que versan sobre materia que es competencia de esta Sala, la cual ha demostrado a lo largo de los años que es un medio célere y efectivo para la tutela de los derechos fundamentales de los habitantes del país.

VIII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso. El Magistrado Castillo Víquez pone nota, en relación con el artículo 41 constitucional. El Magistrado Cruz Castro salva el voto, en relación con el artículo 41 constitucional.
