BACKGROUND:
“The amparo is granted. Accordingly, Eddy Marchena Vásquez, Director of the Acosta Health Regulatory Area, or whoever holds that position, is ordered to take the necessary steps so that, within fifteen days from notification of this judgment, a new inspection is conducted to address the complaint filed by the petitioner and a decision is issued [...]”.
“1. That on 28 May 2026, at the instruction of Dr. Cristina Corrales Escoto, Acting Director, the Acosta Health Regulatory Area sent the Central South Regional Health Regulatory Directorate the letter CARTA-MS-DRRSCSARSAC-164-2026 and the Request for Technical Support for Noise Measurement No. MS-DRRSCS-ARSAC-SAT-002-2026, formally reiterating the technical support required to address complaint D-069- 2025 and conduct a new inspection, in compliance with the order of the Constitutional Chamber (Sala Constitucional) in Resolution No. 2026018071, which required that the inspection be conducted and the corresponding decision issued within fifteen days. (folio 0636) 2. That on 4 June 2026, at the instruction of Dr. Eddy Marchena Vásquez, Director of the Acosta Health Regulatory Area, the Regional Directorate was formally asked whether the required inspection and measurement had already been coordinated or scheduled, without requesting information about the agreed date.
In its reply issued that same day, the Regulatory Unit reported that, as of 29 May 2026, it had already received a response from the complainant and had specific dates for conducting the measurement; however, it stated that it would not inform the Health Regulatory Area of the date ultimately agreed upon, in order to safeguard the technical operation, avoid any question concerning a possible information leak, and subsequently send the report once the inspection had been conducted. (folios 0637 to 0638 and 0641) 3. That on 08 June 2026, starting at 6:15 a.m., technical personnel from the Health Regulatory Unit of the Central South Regional Health Regulatory Directorate appeared at the residence associated with the complaint, installed and calibrated the sound-level measuring equipment, and remained under observation during the specified hours; however, no music played through loudspeakers or other sound source attributable to the CAIPAD facility that would allow noise measurement was recorded.
During that action, sound sources unrelated to the subject of the complaint were identified, particularly the constant barking of dogs nearby, as well as weather conditions influenced by the passage of a tropical wave, circumstances that could have affected the facility’s usual activities. The foregoing was documented in Technical Report No. IT-MS-DRRSCS-URS-289-2026. Because it was impossible to obtain representative data during the inspection of 08 June 2026, the technical personnel recommended scheduling a new visit, aiming for it to coincide with the hours when the activities described in the complaint usually took place and for suitable conditions to exist to assess the reported sound source. (folios 0644 to 0647) 4. That on 17 June 2026, at 6:10 a.m., a new inspection was conducted at the complainant’s residence, with the participation of personnel from the Regional Directorate’s Health Regulatory Unit and an official from the Alajuelita Health Regulatory Area, and the observation period continued until 8:00 a.m. During that period, no music or other sound source from the complained-of facility that would allow the noise measurement procedure to be carried out was recorded either.
Accordingly, Technical Report No. IT-MSDRRSCS-URS-310-2026 was issued, concluding that during the inspections conducted on 17 November 2025, 08 June 2026, and 17 June 2026, it was not possible to verify the presence of noise attributable to CAIPAD under conditions that would permit instrumental measurements to be obtained and compliance or noncompliance with the permissible limits established in the regulations in force to be determined. (folios 0648 to 0650) 5. That Technical Reports No. IT-MS-DRRSCS-URS-289-2026 and IT-MS-DRRSCS-URS-310-2026 were sent to the Directorate of the Acosta Health Regulatory Area by letter CARTA-MS-DRRSCS-URS-1108-2026, dated 26 June 2026, recording the actions taken, the technical limitations encountered, and the recommendations issued for following up on the case. 6. That on 13 July 2026, with the authorization of Dr. Leandra Madrigal Rodríguez, Acting Director of the Acosta Health Regulatory Area, Technical Report No. IT-MS-DRRSCS-URS-310-2026 was sent to the Constitutional Chamber, through the email address designated for receiving reports, as part of the actions taken to comply with judgment No. 2026018071, issued in case file No. 26-008759-0007- CO.
(folios 0651 to 0652) 7. That, considering the multiple inspections, coordination efforts, and measurement attempts carried out by this Health Regulatory Area and by technical personnel from the Central South Regional Health Regulatory Directorate, without conditions arising during those actions that would generate noise and permit a representative sound measurement in accordance with the established technical procedure, the administrative closure of complaint D-069-2025 is communicated to the complainant on 10 August 2026 by means of CARTA MSDRRSCS-ARSAC-238-2026 and MS-DRRSCS-ARSAC-CD059-2026 (folios 0656 to 0670). 8. That the inability to measure the noise was not due to a lack of action or inactivity on the part of this Health Authority, but to the fact that during the various visits conducted, the usual operating and noise-generating conditions described by the complainant did not occur, making it impossible to obtain technical evidence to determine whether there had been a violation of the limits established in the regulations in force. 9.
That closure of this complaint does not limit the right of interested persons to file a new health complaint if the reported conditions persist, recur, or arise again; to that end, they should indicate, to the extent possible, the days, times, and other circumstances in which the alleged harm occurs, to facilitate its technical verification.”
Justice Cruz Castro drafts the opinion; and, REASONS:
I.In judgment number 2026018071, issued at 9:30 a.m. on 22 May 2026, the amparo was granted. The following was ordered:
“The amparo is granted. Accordingly, Eddy Marchena Vásquez, Director of the Acosta Health Regulatory Area, or whoever holds that position, is ordered to take the necessary steps so that, within fifteen days from notification of this judgment, a new inspection is conducted to address the complaint filed by the petitioner and a decision is issued [...]”.
In subsequent briefs, the petitioner explains that, in his view, the respondent authority has not fully complied with what it was ordered to do. He explains that although an inspection was conducted, the source of the noise deliberately turned off its loudspeakers after its security personnel alerted it to the official presence. Despite knowing of these evasive tactics, the health authority ended the intervention, citing a lack of instrumental data, which, in his view, constitutes fictitious compliance and mockery of the court order.
For her part, the Director of the Acosta Health Area explained that on 8 June 2026, starting at 6:15 a.m., technical personnel from the Health Regulatory Unit of the Central South Regional Health Regulatory Directorate appeared at the residence associated with the complaint, installed and calibrated the sound-level measuring equipment, and remained under observation during the specified hours; however, no music played through loudspeakers or other sound source attributable to the CAIPAD facility that would allow noise measurement was recorded. During that action, sound sources unrelated to the subject of the complaint were identified, particularly the constant barking of dogs nearby, as well as weather conditions influenced by the passage of a tropical wave, circumstances that could have affected the facility’s usual activities. Subsequently, on 17 June 2026 at 6:10 a.m., a new inspection was conducted at the complainant’s residence, with the participation of personnel from the Regional Directorate’s Health Regulatory Unit and an official from the Alajuelita Health Regulatory Area, and the observation period continued until 8:00 a.m. During that period, no music or other sound source from the complained-of facility that would allow the noise measurement procedure to be carried out was recorded either.
The technical report issued concluded that during the inspections conducted on 17 November 2025, 08 June 2026, and 17 June 2026, “it was not possible to verify the presence of noise attributable to CAIPAD under conditions that would permit instrumental measurements to be obtained and compliance or noncompliance with the permissible limits established in the regulations in force to be determined”.
Finally, the administrative closure of complaint D-069-2025 was communicated to the complainant on 10 August 2026 by means of CARTA MSDRRSCS-ARSAC-238-2026 and MS-DRRSCS-ARSAC-CD059-2026. This is without prejudice to filing a new complaint.
II.In relation to the foregoing, it should be stated, as had already been stated in the judgment issued, that “it is not for this Chamber to verify directly whether the noise occurs at the levels alleged by the petitioner. The amparo is granted solely because of the time that elapsed after the same Health Area determined that a new inspection should be conducted and failed to conduct it.” On the other hand,
Disagreement with the manner in which the procedure was conducted or with its results is outside the scope of an amparo proceeding. The judgment ordered an inspection that the Ministry of Health itself indicated was pending, and that inspection was conducted. Consequently, there is no basis for granting the motion filed.
The petitioner is advised that, if any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device were submitted, they must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all such material not collected within this period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session number 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at session number 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:

Gestión posterior presentada por Nombre01, cédula de identidad número CED01, en el recurso de amparo interpuesto por él mismo contra el Ministerio de Salud.
RESULTANDO:
“Se declara con lugar el recurso. En consecuencia, se le ordena a Eddy Marchena Vásquez, Director del Área Rectora de Salud de Acosta, o a quien ocupe ese cargo, que realice las gestiones necesarias para que, en el plazo de quince días, contados a partir de la notificación de esta sentencia, se realice una nueva inspección para atender la denuncia planteada por el recurrente y se emita una resolución [...]”.
“1. Que el 28 de mayo de 2026, por indicación de la Dra. Cristina Corrales Escoto, Directora a.i., el Área Rectora de Salud de Acosta remitió a la Dirección Regional de Rectoría de la Salud Central Sur el oficio CARTA-MS-DRRSCSARSAC-164-2026 y la Solicitud de Apoyo Técnico para Medición de Ruido N.° MS-DRRSCS-ARSAC-SAT-002-2026, mediante los cuales se reiteró formalmente el apoyo técnico requerido para la atención de la denuncia D-069- 2025 y la realización de una nueva inspección, en cumplimiento de lo ordenado por la Sala Constitucional mediante la Resolución N.° 2026018071, la cual dispuso efectuar dicha inspección y emitir la resolución correspondiente dentro del plazo de quince días. (folio 0636) 2. Que el 4 de junio de 2026, por indicación del Dr. Eddy Marchena Vásquez, Director del Área Rectora de Salud de Acosta, se consultó formalmente a la Dirección Regional si la inspección y la medición requeridas ya habían sido coordinadas o programadas, sin solicitar información sobre la fecha acordada.
En respuesta emitida ese mismo día, la Unidad de Rectoría informó que, desde el 29 de mayo de 2026, ya contaba con una respuesta del denunciante y con fechas específicas para realizar la medición; no obstante, indicó que no comunicaría al Área Rectora la fecha finalmente pactada, con el propósito de salvaguardar la actuación técnica, evitar cualquier cuestionamiento relacionado con una posible filtración de información y remitir posteriormente el informe una vez ejecutada la inspección. (folio 0637 al 0638 y 0641) 3. Que el día 08 de junio de 2026, a partir de las 6:15 horas, personal técnico de la Unidad de Rectoría de la Salud de la Dirección Regional de Rectoría de la Salud Central Sur se presentó en la vivienda vinculada con la denuncia, instaló y calibró el equipo de sonometría y permaneció en observación durante el horario señalado; sin embargo, no se registró música reproducida mediante altoparlantes ni otra fuente sonora atribuible al establecimiento CAIPAD que permitiera efectuar la medición de ruido.
Durante dicha diligencia se identificaron fuentes sonoras ajenas al objeto de la denuncia, particularmente el ladrido constante de perros en las inmediaciones, así como condiciones climáticas influenciadas por el paso de una onda tropical, circunstancias que podrían haber incidido en el desarrollo habitual de las actividades del establecimiento. Lo anterior quedó documentado en el Informe Técnico N.° IT-MS-DRRSCS-URS-289-2026. Ante la imposibilidad de obtener datos representativos durante la inspección del 08 de junio de 2026, el personal técnico recomendó programar una nueva visita, procurando que esta coincidiera con el horario en que habitualmente se desarrollaban las actividades señaladas en la denuncia y que existieran condiciones adecuadas para evaluar la fuente sonora denunciada. (folio 0644 al 0647) 4. Que el día 17 de junio de 2026, a las 6:10 horas, se efectuó una nueva inspección en la vivienda del denunciante, con participación de personal de la Unidad de Rectoría de la Salud de la Dirección Regional y de un funcionario del Área Rectora de Salud de Alajuelita, manteniéndose el periodo de observación hasta las 8:00 horas.
Durante dicho lapso tampoco se registró música ni otra fuente sonora proveniente del establecimiento denunciado que permitiera ejecutar el procedimiento de medición de ruido. Por tanto, se emite informe Técnico N.° IT-MSDRRSCS-URS-310-2026 mediante el cual se concluyó que, durante las inspecciones realizadas los días 17 de noviembre de 2025, 08 de junio de 2026 y 17 de junio de 2026, no fue posible constatar la presencia de ruido atribuible al CAIPAD en condiciones que permitieran obtener mediciones instrumentales y determinar el cumplimiento o incumplimiento de los límites permisibles establecidos en la normativa vigente. (folio 0648 al 0650) 5. Que los Informes Técnicos N.° IT-MS-DRRSCS-URS-289-2026 e IT-MS-DRRSCS-URS-310-2026 fueron remitidos a la Dirección del Área Rectora de Salud de Acosta mediante el oficio CARTA-MS-DRRSCS-URS-1108-2026, de fecha 26 de junio de 2026, dejando constancia de las actuaciones realizadas, las limitaciones técnicas encontradas y las recomendaciones emitidas para el seguimiento del caso. 6.
Que el día 13 de julio de 2026, con autorización de la Dra. Leandra Madrigal Rodríguez, Directora a. i. del Área Rectora de Salud de Acosta, se remitió a la Sala Constitucional, mediante el correo electrónico dispuesto para la recepción de informes, el Informe Técnico N.° IT-MS-DRRSCS-URS-310-2026, como parte de las actuaciones realizadas en cumplimiento de la sentencia N.° 2026018071, dictada dentro del expediente N.° 26-008759-0007- CO. (folios 0651 al 0652) 7. Que, considerando las múltiples inspecciones, coordinaciones e intentos de medición efectuados por esta Área Rectora de Salud y por personal técnico de la Dirección Regional de Rectoría de la Salud Central Sur, sin que durante dichas diligencias se presentaran condiciones de generación de ruido que permitieran efectuar una medición sónica representativa conforme al procedimiento técnico establecido, se comunica el cierre administrativo de la denuncia D-069-2025 a la parte denunciante el día 10 agosto 2026 mediante CARTA MSDRRSCS-ARSAC-238-2026 y MS-DRRSCS-ARSAC-CD059-2026 (folios 0656 al 0670) 8.
Que la imposibilidad de efectuar la medición de ruido no obedeció a una falta de gestión o inactividad de esta Autoridad Sanitaria, sino a que, durante las diferentes visitas realizadas, no se presentaron las condiciones habituales de funcionamiento y generación del ruido descritas por la parte denunciante, por lo que no fue posible obtener evidencia técnica que permitiera determinar un eventual incumplimiento de los límites establecidos en la normativa vigente. 9. Que el cierre de la presente denuncia no limita el derecho de las personas interesadas de interponer una nueva denuncia sanitaria en caso de que las condiciones denunciadas persistan, se reiteren o vuelvan a presentarse, para lo cual deberán indicar, en la medida de lo posible, los días, horarios y demás circunstancias en que se genera la presunta afectación, a efectos de facilitar su verificación técnica”.
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.En sentencia número 2026018071 de las nueve horas treinta minutos del veintidós de mayo de dos mil veintiséis, se declaró con lugar el recurso. Se dispuso lo siguiente:
“Se declara con lugar el recurso. En consecuencia, se le ordena a Eddy Marchena Vásquez, Director del Área Rectora de Salud de Acosta, o a quien ocupe ese cargo, que realice las gestiones necesarias para que, en el plazo de quince días, contados a partir de la notificación de esta sentencia, se realice una nueva inspección para atender la denuncia planteada por el recurrente y se emita una resolución [...]”.
En escritos posteriores, el recurrente explica que, a su juicio, la autoridad recurrida no ha cumplido cabalmente con lo que se le ordenó. Explica que si bien se realizó una inspección, el emisor del ruido apagó deliberadamente sus altoparlantes tras ser alertado por su personal de seguridad sobre la presencia oficial. A pesar de conocer estas tácticas evasivas, la autoridad sanitaria dio por finalizada la intervención alegando falta de datos instrumentales, lo que, a su juicio, constituye un cumplimiento ficticio y una burla al mandato judicial.
Por su parte, la Directora del Área de Salud de Acosta, explicó que el 8 de junio del 2026, a partir de las 6:15 horas, personal técnico de la Unidad de Rectoría de la Salud de la Dirección Regional de Rectoría de la Salud Central Sur se presentó en la vivienda vinculada con la denuncia, instaló y calibró el equipo de sonometría y permaneció en observación durante el horario señalado; sin embargo, no se registró música reproducida mediante altoparlantes ni otra fuente sonora atribuible al establecimiento CAIPAD que permitiera efectuar la medición de ruido. Durante dicha diligencia se identificaron fuentes sonoras ajenas al objeto de la denuncia, particularmente el ladrido constante de perros en las inmediaciones, así como condiciones climáticas influenciadas por el paso de una onda tropical, circunstancias que podrían haber incidido en el desarrollo habitual de las actividades del establecimiento.
Posteriormente, el 17 de junio de 2026, a las 6:10 horas, se efectuó una nueva inspección en la vivienda del denunciante, con participación de personal de la Unidad de Rectoría de la Salud de la Dirección Regional y de un funcionario del Área Rectora de Salud de Alajuelita, manteniéndose el periodo de observación hasta las 8:00 horas. Durante dicho lapso tampoco se registró música ni otra fuente sonora proveniente del establecimiento denunciado que permitiera ejecutar el procedimiento de medición de ruido. En el informe técnico emitido, se concluyó que durante las inspecciones realizadas los días 17 de noviembre de 2025, 08 de junio de 2026 y 17 de junio de 2026 “no fue posible constatar la presencia de ruido atribuible al CAIPAD en condiciones que permitieran obtener mediciones instrumentales y determinar el cumplimiento o incumplimiento de los límites permisibles establecidos en la normativa vigente”.
Finalmente, se comunica el cierre administrativo de la denuncia D-069-2025 a la parte denunciante el día 10 agosto 2026 mediante CARTA MSDRRSCS-ARSAC-238-2026 y MS-DRRSCS-ARSAC-CD059-2026. Lo anterior, sin perjuicio de presentar una nueva denuncia.
II.En relación con lo expuesto se debe indicar, como ya se había expuesto en la sentencia dictada, que “no le corresponde a esta Sala verificar directamente si se produce o no el ruido en los niveles que alega el recurrente. El amparo se estima únicamente por el plazo transcurrido desde que la misma Área de Salud consideró que se debe realizar una nueva inspección y no la ha realizado”. Por otra parte,
La inconformidad con la forma de realizar el procedimiento o los resultados de este son cuestiones ajenas a un recurso de amparo. En sentencia se ordenó realizar una inspección que el mismo Ministerio de Salud indicó que estaba pendiente, la cual se realizó. En consecuencia, no hay razón para acoger la gestión planteada.
Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

No ha lugar a la gestión formulada.
