Noncompliance proceeding brought by Nombre01, in his capacity as special judicial attorney-in-fact for Asociación Preserve Planet, in relation to judgment no. 2025041946 of 9:30 a.m. on 19 December 2025.
Background:
Prepared by Justice Cruz Castro; and, Reasons:
I.In judgment no. 2025041946 of 9:30 a.m. on 19 December 2025, this Chamber ordered:
“The amparo application is granted. Accordingly, Efraím Zeledón Leiva, in his capacity as Minister of Public Works and Transport, or whoever holds that office, is ordered, within three months from notification of this judgment, to adopt and coordinate all necessary measures to ensure effective compliance with the provisions of Article 8, paragraph 7, of Decreto Ejecutivo N°39724-MOPT-MINAE-S, ‘Regulations for the Control of Polluting Emissions Produced by Motor Vehicles with Internal Combustion Engines.’ The respondent is warned that, pursuant to Article 71 of the Constitutional Jurisdiction Law, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the acts underlying this declaration, which shall be assessed in enforcement proceedings within the administrative-litigation jurisdiction. Notify the parties.”
In this case, the applicant reiterates the noncompliance proceeding because he considers that the respondent authority continues to fail to comply with what was ordered in judgment no. 2025-041946 of 9:30 a.m. on 19 December 2025. It should be recalled that this is already the second time that noncompliance with that judgment has come before the Chamber: by decision no. 2026023513 of 9:20 a.m. on 26 June 2026, this Chamber granted a noncompliance proceeding because effective compliance had not been established despite the matter having been referred to the Road Safety Council, and again reminded the respondent authority of its duty to comply with what was ordered in judgment no. 2025041946 of 9:30 a.m. on 19 December 2025.
In this new matter, the acting Minister of the Ministry of Public Works and Transport states in his report—which is deemed to have been made under oath, after due warning of the consequences, including criminal consequences, provided for in Article 44 of the Constitutional Jurisdiction Law—that, by official letter CARTA-COSEVI-DE-0720-2026, the Road Safety Council informed him that on 29 July 2026 the amendment to the Procedures Manual for the Implementation of Decreto Ejecutivo N° 41837-H-MOPT, Regulations for the Application of Article 5 of the Land Traffic and Road Safety Law, was published in Alcance N° 99 to La Gaceta N° 141, and that coordination efforts with Radiográfica Costarricense (RACSA) to configure the TDCar platform began on 10 August 2026. Their completion is estimated to take 15 to 22 days, that is, no later than 1 September 2026.
This Chamber observes that the regulation in question states that Article 5 of the Land Traffic Law is intended to implement a series of controls before the nationalization of first-entry vehicles registered in their country of origin, so as to prevent them from being placed under the definitive import regime in the national territory in a condition unsuitable for circulation, a matter within MOPT’s competence under the powers granted to it by the Land Traffic Law.
The judgment whose noncompliance is alleged, for its part, orders that all necessary measures be adopted and coordinated within three months to ensure effective compliance with the provisions of Article 8, paragraph 7, of Decreto Ejecutivo N°39724-MOPT-MINAE-S, “Regulations for the Control of Polluting Emissions Produced by Motor Vehicles with Internal Combustion Engines.” Paragraph 7 of Article 8 of Decreto Ejecutivo N°39724-MOPT-MINAE-S provides: “For used vehicles entering the country for the first time, a certificate of conformity or a report measuring the polluting emissions of each vehicle must also be submitted. If it is determined that the certificate of conformity does not meet this regulation’s emissions standards, its nationalization will not be authorized.” In his report, the respondent authority refers to official letter CARTA-COSEVI-DE-0720-2026, which sets out “a schedule of the steps to be carried out shortly in order to complete the registration and/or nationalization processes in the vehicle technical inspection under Decreto Ejecutivo N°39724-MOPT-MINAE-S, ‘Regulations for the Control of Polluting Emissions Produced by Motor Vehicles with Internal Combustion Engines.’” From the foregoing, compliance with the order has not been established because the respondent authority itself acknowledges that the requirement to verify polluting emissions is not being applied.
In addition, more than eight months have elapsed since notification of the judgment, which allowed three months for compliance—a period that expired long ago—yet as of this date there is no evidence that the order has been fully implemented in practice. Accordingly, the noncompliance proceeding should be granted, as is hereby ordered.
Lastly, the applicant is informed that it is not for this Chamber to tell the Ministry of Public Works and Transport and the Road Safety Council how they must verify emissions certificates at customs, as he requests, because that is a matter for the administration.
In light of the foregoing, effective compliance with the order has not been established, and the proceeding should be granted.
THEREFORE:
The noncompliance proceeding is granted. Pablo Camacho Salazar, in his capacity as acting Minister of Public Works and Transport, or whoever holds that office, is ordered to comply effectively and immediately with what this Chamber ordered in judgment no. 2025041946 of 9:30 a.m. on 19 December 2025. This is subject to the warning that, if noncompliance is established, the opening of administrative proceedings against the official who fails to comply with this Chamber’s ruling may be ordered and, in addition, the relevant record may be sent to the Ministerio Público in connection with the possible commission of the offense of noncompliance (Articles 53 and 71 of the Constitutional Jurisdiction Law). Judgment no. 2025041946 of 9:30 a.m. on 19 December 2025 shall be served personally on Pablo Camacho Salazar. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veinticinco de agosto de dos mil veintiseis .
Gestión de desobediencia planteada por Nombre01, en su condición de apoderado especial judicial de la Asociación Preserve Planet, en relación con la sentencia nro. 2025041946 de las 9:30 horas del 19 de diciembre de 2025.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.En la sentencia nro. 2025041946 de las 9:30 horas del 19 de diciembre de 2025, esta Sala dispuso:
"Se declara con lugar el recurso. En consecuencia se ordena a Efraím Zeledón Leiva, en su carácter de Ministro de Obras Públicas y Transportes o a quien ocupe tal cargo que en el plazo de tres meses, contado a partir de la notificación de esta sentencia, adopte y coordine todas las medidas necesarias, a fin de asegurar el cumplimiento efectivo de lo dispuesto en el artículo 8 párrafo 7 del Decreto Ejecutivo N°39724-MOPT-MINAE-S, "Reglamento para el control de las emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna". Se le advierte al recurridos que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese."
En la especie, el recurrente reitera la gestión de desobediencia al considerar que la autoridad recurrida persiste en el incumplimiento de lo ordenado en la sentencia nro. 2025-041946 de las 9:30 horas del 19 de diciembre de 2025. Cabe recordar que esta es ya la segunda ocasión en que se conoce el incumplimiento de dicha sentencia: mediante resolución nro. 2026023513 de las 9:20 horas del 26 de junio de 2026, esta Sala declaró con lugar una gestión de desobediencia, al no acreditarse cumplimiento efectivo pese al traslado del asunto al Consejo de Seguridad Vial, y se reiteró a la autoridad recurrida el deber de dar cumplimiento a lo ordenado en la nro. 2025041946 de las 9:30 horas del 19 de diciembre de 2025.
Ahora bien, en este nuevo asunto, en su informe, el Ministro a.i. del Ministerio de Obras Públicas y Transportes —que se tiene por dado bajo fe de juramento, debidamente advertido de las consecuencias, incluso penales, previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional—, afirma que mediante oficio CARTA-COSEVI-DE-0720-2026 el Consejo de Seguridad Vial le comunicó que el 29 de julio de 2026 se publicó, en el Alcance N° 99 a La Gaceta N° 141, la reforma al Manual de Procedimientos para la Ejecución del Decreto Ejecutivo N° 41837-H-MOPT, Reglamento para la aplicación del artículo 5° de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, y que a partir del 10 de agosto de 2026 se iniciaron las gestiones de coordinación con la Radiográfica Costarricense (RACSA) para configurar la plataforma TDCar, estimando su conclusión en un plazo de 15 a 22 días, es decir, a más tardar el 1° de setiembre de 2026.
Esta Sala advierte que en el reglamento en cuestión, se indica que el artículo 5 de la Ley de Tránsito, tiene como propósito implementar una serie de controles previos a la nacionalización de vehículos de primer ingreso, inscritos en el país de su procedencia, con miras a impedir que sean sometidos al régimen de importación definitiva en el territorio nacional, en condiciones no aptas para circular aspecto que es competencia del MOPT de acuerdo a las facultades que le otorga la Ley de Tránsito.
Por su parte la sentencia cuyo incumplimiento se reclama, ordena que en el plazo de 3 meses se adopte y coordine todas las medidas necesarias, a fin de asegurar el cumplimiento efectivo de lo dispuesto en el artículo 8 párrafo 7 del Decreto Ejecutivo N°39724-MOPT-MINAE-S, "Reglamento para el control de las emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna".
Este párrafo 7 del artículo 8 del Decreto Ejecutivo N°39724-MOPT-MINAE-S, dispone que: “Para los vehículos usados de primer ingreso, también se deberá presentar un certificado de conformidad o bien un informe de medición de las emisiones contaminantes por cada vehículo. De comprobarse un incumplimiento de lo indicado en el certificado de conformidad con los estándares de emisiones de este reglamento, no se autorizará su nacionalización.” En su informe, la autoridad recurrida se refiere al oficio CARTA-COSEVI-DE-0720-2026, que establece “un cronograma de los actos a realizar próximamente, esto a fin de concretar los procesos de inscripción y/o nacionalización en la inspección técnica vehicular del Decreto Ejecutivo N°39724-MOPT-MINAE-S, "Reglamento para el control de las emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna.” De lo anteriormente expuesto, no se constata el cumplimiento a lo ordenado pues, la propia autoridad recurrida reconoce que el requisito de verificación de emisiones contaminantes no se aplica.
Aunado a lo anterior, no puede perderse de vista que han transcurrido más de ocho meses desde la notificación de la sentencia que otorgó un plazo de tres meses para el cumplimiento, plazo que se encuentra vencido desde hace largo tiempo, sin que a la fecha conste ejecución material completa de lo ordenado. Así las cosas, procede declarar ha lugar la gestión de desobediencia, como en efecto se dispone.
Por último se aclara a la parte recurrente que no compete a esta Sala decirle al Ministerio de Obras Públicas y Transportes y al Consejo de Seguridad Vial cómo deben realizar la verificación de los certificados de emisiones en aduanas, como pretende, pues ello es del resorte de la administración.
Corolario de lo expuesto, no se acredita el cumplimiento efectivo de lo ordenado y procede acoger la gestión.
POR TANTO:
Se declara ha lugar la gestión de desobediencia. Se ordena a Pablo Camacho Salazar, en su carácter de Ministro a.i. de Obras Públicas y Transportes o a quien ocupe tal cargo, dar cumplimiento efectivo a lo dispuesto por esta Sala en la sentencia nro. 2025041946 de las 9:30 horas del 19 de diciembre de 2025, de manera inmediata. Lo anterior, bajo la advertencia que, de acreditarse la desobediencia, se podrá ordenar la apertura de un procedimiento administrativo contra el funcionario remiso a cumplir con lo resuelto por esta Sala y, además, ordenar testimoniar piezas ante el Ministerio Público por la eventual comisión del delito de desobediencia (artículos 53 y 71 de la ley de la jurisdicción constitucional). Notifíquese la sentencia nro. 2025041946 de las 9:30 horas del 19 de diciembre de 2025 personalmente a Pablo Camacho Salazar. Notifíquese.
