Amparo proceeding filed in case number 26-029212-0007-CO by Nombre01, holder of identity card number CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERAGE.
Background 1. In a written submission entered in the electronic case file on 12 August 2026, the applicant files an amparo proceeding against the Costa Rican Institute of Aqueducts and Sewerage. The applicant states that they own the property registered under real folio no. 6-166374-000, survey plan no. P-1171453-2007. The applicant also requested potable water service from the respondent authority. The applicant states that, by resolution of 2 July 2026, the respondent institute informed them that, in order to provide potable water service, they must undertake construction of infrastructure and satisfy the following requirements: “1. Installation of a distribution branch approximately 102 meters long. 2. 100 mm pipe. 3. Valves, fittings, and complementary works. 4. Professional design endorsed by engineering. 5. Procedure before CFIA. 6. Municipal or MOPT permits. 7. Hydrostatic tests paid for by me. 8. Technical handover and final interconnection.” The applicant adds that these steps would cost approximately fifteen to twenty million colones, which they are unable to afford given their financial situation. The applicant considers that responsibility for meeting this condition lies with the public service operator and not with the service user, upon whom it was improperly imposed. For these reasons, the applicant considers their fundamental rights to have been violated.
2. Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily dismiss, or dismiss on the merits, at any time, including upon filing, any submission brought before it that is manifestly inadmissible, when it considers that there is sufficient evidence to dismiss it, or when it is merely a reiteration or reproduction of an identical or similar prior submission that was dismissed.

On numerous occasions, this Chamber has held that, although the right of access to public services is recognized, that right does not entail unrestricted or free access to those services, since the Administration may validly establish general conditions and requirements for accessing services such as potable water. It is also valid for public or private entities administering the service to reject water service applications when the interested party does not meet the requirements or when technical or legal reasons justify doing so.
In this case, according to the evidence submitted, the respondent authority informed the applicant that, in order to provide the requested potable water service, they must undertake construction of infrastructure and satisfy the following requirements: “1. Installation of a distribution branch approximately 102 meters long. 2. 100 mm pipe. 3. Valves, fittings, and complementary works. 4. Professional design endorsed by engineering. 5. Procedure before CFIA. 6. Municipal or MOPT permits. 7. Hydrostatic tests paid for by me. 8. Technical handover and final interconnection.” However, the applicant’s arguments show that they disagree with this requirement, asserting that it should be met by the public service operator and not by the service user. Nevertheless, as indicated above, entities—public or private—that administer the service may validly reject applications or establish general requirements. In this case, it has not been shown that the application was ignored or rejected. On the contrary, as part of the applicable procedure, a technical study was requested; therefore, access to the service is not being denied without justification or arbitrarily, but rather the applicant is being asked to satisfy a prior requirement.
It should be noted, however, that whether the requirements imposed are appropriate and what technical or legal reasons supported that decision are not matters to be addressed in this jurisdiction, as they concern an ordinary legality dispute outside this Chamber’s jurisdiction. Nor may this Court act as a mediator with a particular natural or legal person—whether the latter is governed by public or private law—to intercede on behalf of a third party so that the third party may obtain what they seek. Accordingly, the applicant’s request that this Chamber intercede on their behalf to secure the requested service is inadmissible. Therefore, if the applicant disagrees with this requirement, they must submit their claims to the respondent authority or pursue them through the competent legality forum (see, to the same effect, judgments number 2016012194, at 9:30 a.m. on 26 August 2016; number 2021006138, at 09:35 a.m. on 23 March 2021; and 2023006560, at 09:15 a.m. on 17 March 2023). Consequently, the amparo is inadmissible.
This Chamber must advise the parties that, if they submitted any paper documents, objects, or evidence stored on any additional device or in electronic, computer, magnetic, optical, telematic, or new-technology format, they must retrieve them from the Chamber’s offices within 30 business days after receiving notice of this judgment. Otherwise, all such materials will be destroyed in accordance with the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in the Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo is summarily dismissed.

Recurso de amparo que se tramita en el expediente número 26-029212-0007-CO, interpuesto por Nombre01, cédula de identidad número CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando
1. Por escrito incorporado al expediente electrónico el 12 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta que es propietario del inmueble registrado bajo el folio real nro. 6-166374-000, plano nro. P-1171453-2007. Asimismo, solicitó ante la autoridad accionada el suministro de agua potable. Señala que, mediante resolución del 2 de julio de 2026, el instituto recurrido le indicó que para poder otorgar el servicio de agua potable debe de asumir la construcción de infraestructura y el cumplimiento de los siguientes requisitos: “1.- Instalación de un ramal de distribución de aproximadamente 102 metros. 2.- Tubería de 100 mm. 3.- Válvulas, accesorios y obras complementarias. 4.- Diseño profesional visado por ingeniería. 5.- Trámite ante CFIA. 6.- Permisos municipales o del MOPT. 7.- Pruebas hidrostáticas costeadas por mi persona. 8.- Entrega técnica e interconexión final”. Agrega que tales diligencias representan un costo aproximado de quince a veinte millones de colones, los cuales dada su situación económica no le es posible asumir. Considera que el cumplimiento de tal condición le corresponde al operador del servicio público y no al administrado a quien indebidamente le fue impuesta. Por lo expuesto, estima lesionados sus derechos fundamentales.
2. El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.
Redacta el Magistrado Castillo Víquez; y,
Considerando:
La parte recurrente expresa que es propietario del inmueble registrado bajo el folio real nro. 6-166374-000, plano nro. P-1171453-2007. Asimismo, solicitó ante la autoridad accionada el suministro de agua potable. Señala que, mediante resolución del 2 de julio de 2026, se indicó que para poder otorgar el servicio de agua potable debe de asumir la construcción de infraestructura y el cumplimiento de los siguientes requisitos: “1.- Instalación de un ramal de distribución de aproximadamente 102 metros. 2.- Tubería de 100 mm. 3.- Válvulas, accesorios y obras complementarias. 4.- Diseño profesional visado por ingeniería. 5.- Trámite ante CFIA. 6.- Permisos municipales o del MOPT. 7.- Pruebas hidrostáticas costeadas por mi persona. 8.- Entrega técnica e interconexión final”. Agrega que tales diligencias representan un costo aproximado de quince a veinte millones de colones, los cuales dada su situación económica no le es posible asumir. Considera que el cumplimiento de tal condición le corresponde al operador del servicio público y no al administrado a quien indebidamente le fue impuesta. Por lo expuesto, estima lesionados sus derechos fundamentales.
En reiteradas ocasiones, esta Sala ha sostenido que, si bien se reconoce el derecho de acceso a los servicios públicos, también, ha indicado que este derecho no implica un acceso irrestricto, ni gratuito a estos servicios, toda vez que, la Administración puede válidamente, establecer condiciones y requisitos generales para acceder a los servicios, como es el caso del agua potable. Asimismo, resulta válido que las entidades -públicas o privadas- que administren el servicio, puedan rechazar las solicitudes de agua, cuando la parte interesada no cumple los requisitos o cuando existen razones técnicas o legales que los justifiquen.
En el caso concreto, según consta en la prueba aportada la autoridad accionada le comunicó a la parte recurrente que para poder otorgar el servicio de agua potable solicitado debe de asumir la construcción de infraestructura y el cumplimiento de los siguientes requisitos: “1.- Instalación de un ramal de distribución de aproximadamente 102 metros. 2.- Tubería de 100 mm. 3.- Válvulas, accesorios y obras complementarias. 4.- Diseño profesional visado por ingeniería. 5.- Trámite ante CFIA. 6.- Permisos municipales o del MOPT. 7.- Pruebas hidrostáticas costeadas por mi persona. 8.- Entrega técnica e interconexión final”. Sin embargo, vistos los alegatos de la parte accionante se observa que no está conforme con esa exigencia, pues afirma que tal requisito deber ser asumido por operador del servicio público y no por el administrado. No obstante, tal como se indicó líneas atrás, resulta válido que las entidades -públicas o privadas- que administren el servicio, puedan rechazar las solicitudes, o bien, establecer requisitos generales.
En este caso, no se acredita que la solicitud fuera ignorada o rechazada, caso contrario, en atención al trámite correspondiente se solicitó el estudio técnico, por ende, no se le está negando el acceso al servicio de manera injustificada o arbitraria, sino que se le está solicitando el cumplimiento de un requisito previo, el cual debe de cumplir la parte amparada.
Ahora bien, cabe mencionar que, la pertinencia o no de los requisitos exigidos y las razones técnicas o legales que sustentaron tal decisión, no son cuestiones que deban discutirse en esta jurisdicción, por tratarse de un conflicto de legalidad ordinaria ajeno al ámbito de competencia de esta Sala. Tampoco, puede este Tribunal fungir como mediador ante una determinada persona física o jurídica -ya sea ésta última de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que pretende, por lo que, la solicitud de la parte recurrente para que esta Sala interceda a su favor para que se le brinde el servicio solicitado, resulta improcedente. Así las cosas, si la parte amparada se encuentra inconforme con esa exigencia, deberá plantear sus reclamos ante la autoridad recurrida, o bien, en la vía de legalidad competente (véanse en igual sentido las sentencias número 2016012194 de las 9:30 horas del 26 de agosto de 2016; número 2021006138 de las 09:35 horas del 23 de marzo de 2021 y 2023006560 de las 09:15 horas del 17 de marzo de 2023). En consecuencia, el recurso resulta inadmisible.
Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
