Document Review CASE FILE No. 26-028174-0007-CO PROCEEDING: AMPARO PROCEEDING RULING No. 2026032239 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE (SALA CONSTITUCIONAL). San José, at nine hours and twenty minutes on 20 August 2026.

Amparo proceeding filed by Nombre03, identity card CED01, on behalf of ROCA GRANDE DEL CARIBE SOCIEDAD DE RESPONSABILIDAD LIMITADA, corporate identification number 3102877510, against the INSTITUTO DE DESARROLLO RURAL (INDER) and the REGISTRO NACIONAL, DIRECCIÓN DE GEOLOGÍA Y MINAS (DGM).

Background:

  1. 1By a brief entered in the Chamber’s digital case file at 15:49 on 4 August 2026, the applicant, in the capacity of attorney-in-fact with full powers and no limit on the amount for the commercial company named ROCA GRANDE DEL CARIBE SOCIEDAD DE RESPONSABILIDAD LIMITADA, files an amparo proceeding against INDER and the REGISTRO NACIONAL, DIRECCIÓN DE GEOLOGÍA Y MINAS (DGM). The applicant states as follows: “The purpose of this constitutional action is therefore to obtain an immediate declaration that Oficio number PR-INDER-GG-DRT-FT-IRT-OFI-0343-2025 is constitutionally invalid, and the consequent cessation of the harmful and continuing effects it has caused. (…) The property registered in the Public Real Estate Registry under Real Folio registration number PRN01, in the province of Limón, covered by cadastral plan number L-646722-1986, is the exclusive, lawful property, under full ownership, of the applicant commercial company, ROCA GRANDE DEL CARIBE SOCIEDAD DE RESPONSABILIDAD LIMITADA.(…) The factual origin, chain of title, and cadastral morphology of the property covered by registered cadastral plan number L-0646722-1986 show that the parent property came into existence as private property through a lawful process of parceling, subdivision, and allocation of land carried out, approved, and validated in the 1980s by the Instituto de Desarrollo Agrario itself, now the Instituto de Desarrollo Rural, hereinafter INDER, in favor of private parties. By removing this territorial area from its original assets and voluntarily introducing it into ordinary commerce, the respondent agency itself consolidated an established legal situation—which, it should be noted, has absolute functional autonomy and independence as a property—and one that is legally incompatible with the public-domain, inalienable, and collective regime applicable to Indigenous territories.3 By judgment number 2015000170, issued by the Constitutional Chamber at nine hours and one minute on 9 January 2015 in the constitutional amparo proceeding brought against the Instituto de Desarrollo Rural (INDER) and the State, the amparo proceeding was GRANTED AND DECLARED WITH MERIT.That constitutional relief was based precisely on the factual finding that the respondent authorities entirely lacked technical boundary demarcation, placement of boundary markers, or physical field measurements concerning the geographic extent of Decreto Ejecutivo Número 10706-G of 24 October 1979 and its amending and expanding decree, Número 21904-G of 20 January 1993 (historically associated with the alleged Finca de Nombre01). In light of INDER’s own sworn admission that it was unable to establish exact coordinates or plans for the area, this Constitutional Court granted the action directly, finding that maintaining a paper-based encumbrance for more than 30 years without conducting field studies was manifestly unreasonable, disproportionate, and in violation of the fundamental rights of those subject to the Administration, and ordering restoration of the constitutional order and requiring the agency to pay costs, damages, and losses.4 4.— On 7 July 2025, the Instituto Geográfico Nacional (IGN), in its capacity as the Republic’s highest cartographic and geodetic authority, issued Oficio number DIG-GDF-226-2025, officially certifying the exact location of my client’s registered cadastral plan (L-0646722-1986) within the corresponding Administrative Territorial Division of the District of Carrandí, Canton of Matina, Province of Limón.Despite this official geographic certainty issued by the technical governing body, and in disregard of what this Chamber ruled in Judgment Number 2015000170, the Instituto de Desarrollo Rural (INDER) subsequently issued report number PR-INDER-GG-DRT-FT-IRT-OFI-0343-2025. In doing so, INDER acted with manifest lack of objectivity and departed from the material truth by certifying to third parties an alleged overlap, with centimeter-level certainty, within an Indigenous perimeter concurrently regulated by the cited Decretos Número 10706-G and Número 21904-G, simulating technical demarcation that the Constitutional Court had already declared the Institute did not possess and had not measured in the field, thereby carrying out a clear de facto act that approaches and compromises the constitutional principles of rationality and legality.5 5.— As an aggravating circumstance demonstrating abuse of power and a departure from the principle of objectivity in the cited Oficio Número PR-INDER-GG DRT-FT-IRT-OFI-0343-2025, the respondent authority introduced an opaque procedural defect into my client’s procedural course by expressly requiring, on page 2 of that document, that the graphic information and digital map allegedly supporting the territorial overlap not be disclosed to third parties.By instructing that the technical evidence be kept confidential, INDER placed the applicant company in a state of complete defenselessness, violating its constitutional right to inspect, audit, and submit to party-appointed expert review the evidence the State unilaterally used to restrict the rights over a lawfully titled and cadastrally identified property.6 6.— The respondent authority’s conduct is not an isolated or completed act, but a continuing and permanent violation that currently harms the applicant’s legal sphere. By keeping Oficio number PR-INDER-GG-DRT FT-IRT-OFI-0343-2025 in full force, together with its resulting restrictive ‘computerized alert or mark’ on the SIRI and SNIT platforms (blindly based on layers associated with Decretos Número 10706-G and Número 21904-G), INDER unlawfully restricts and compels the free exchange of the property, creating a de facto blockade that prevents the central State from exercising its sovereignty to grant the Area Reservation for the subsoil in case file number 2025-CAN-PRI-044, perpetuating a state of complete legal uncertainty based on an uncertain fact that openly contradicts the Principle of Legality.(…) CHALLENGED HARMFUL CONDUCT8 A.1.— Cartographic Simulation of Authority (Fraud Against the Material Truth) The constitutional validity of Oficio number PR INDER-GG-DRT-FT-IRT-OFI-0343-2025 issued by INDER is expressly challenged. This instrument embodies a flagrant de facto act by certifying spatial coordinates with centimeter-level certainty over the applicant’s strictly private property (a property registered in the Real Folio system under registration number PRN01), thereby inventing at an INDER office a territorial encumbrance that the actual facts and this Chamber’s prior decisions have declared to be in a state of complete physical and technical indeterminacy. A.2.— Institutionalization of Secret Evidence in the Rule of Law The confidentiality order expressly contained on page 2 of the cited INDER oficio is formally challenged. Through this clandestine instruction, the respondent agency ordered that the graphic and cartographic information supporting its alleged overlap not be disclosed to third parties.This directive strips the proceeding of all public transparency, imposing evidentiary secrecy that prevents my client from auditing or submitting to party-appointed expert review the technical evidence the State used to halt its lawful concession applications in mining case file number 2025-CAN-PRI-044. (…) It is requested that this amparo proceeding against the Instituto de Desarrollo Rural (INDER) be GRANTED IN FULL and that, as a consequence and for the protection of the records in my client’s mining case file, ABSOLUTE NULLITY, REVOCATION, AND CONSTITUTIONAL ANNULMENT be declared as to the harmful and permanent effects arising both from the original act, namely Oficio number PR-INDER-GG-DRT-FT-IRT-OFI-0343-2025 issued by INDER, and from the related subsequent act, namely Oficio number DGM-TOP-O-200-2026 issued on 22 July 2026 by the Topography Department of the Mining Cadastre of the Dirección de Geología y Minas (DGM), because they are exercises of public authority vitiated in their grounds and cause and violate the principles of reasonableness, prohibition of arbitrariness, and material truth.SECOND.— (Relief Sought: Digital Restoration of the Property and Registry Purity) The Executive Presidency of the Instituto de Desarrollo Rural (INDER) and, correspondingly, the General Directorate of the Dirección de Geología y Minas (DGM) shall be ordered to immediately and definitively lift, remove, and completely clear any ‘computerized alert,’ control ‘cartographic mark,’ or Indigenous warning code unilaterally indexed against Real Folio registration number PRN01, in the province of Limón, and its legitimately originating registered cadastral plan number L-0646722-1986 on the SIRI and SNIT platforms and map viewers, restoring the property’s historical condition of cadastral purity and technical freedom. THIRD.— (Relief Sought: Mandatory Unblocking and Procedural Continuity) As a necessary consequence of restoring the constitutional order, the Dirección de Geología y Minas (DGM) and its Mining Control and Topography Department shall be ordered to advance, process, and immediately grant the Area Reservation requested by my client for Dirección02.2 hectares of Phase 1 within case file number 2025-CAN-PRI-044, and to ensure that the ordinary mining procedural course proceeds, advances, and reaches the evaluation phases before SETENA in accordance with the time limits in Resolution Number 306-2026, with the Public Administration strictly barred from using the above-annulled oficios as a pretext for suspension, silence, or denial.FOURTH.— (Relief Sought: Prohibition of ‘Secret Evidence’ and Disclosure of Evidence) The Instituto de Desarrollo Rural (INDER) shall be ordered to permanently lift the confidentiality order imposed on page 2 of its 2025 Oficio, and to make all graphic information layers and technical memoranda from its topography department freely available to this Court and those subject to the Administration, while reaffirming the absolute prohibition on basing property restrictions on concealed evidence withheld from public scrutiny. FIFTH.— (Relief Sought: Financial Liability of the Respondent Agency) The Instituto de Desarrollo Rural (INDER) shall be ordered to pay the legitimate costs, damages, and losses, both material and moral, caused to the protected company, ROCA GRANDE DEL CARIBE SOCIEDAD DE RESPONSABILIDAD LIMITADA, as a result of the halt, procedural strangulation, and closure of case file number 2024-CAN PRI-001, as well as the current blockade of case file number 2025-CAN-PRI- 044, with assessment and quantification to be carried out in the administrative-litigation jurisdiction through proceedings to enforce the judgment, pursuant to Article 51 of the Ley de la Jurisdicción Constitucional.
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to reject outright or on the merits, at any time, including upon filing, any application brought before it that is manifestly inadmissible, where it considers the record contains sufficient grounds for rejection, or where the application is merely a reiteration or reproduction of an earlier identical or similar application that was rejected.

Drafted by Justice Castillo Víquez; and, Reasons:

I. SUBJECT OF THE AMPARO

The applicant states that, by Oficio PR-INDER-GG-DRT-FT-IRT-OFI-0343-2025, the respondent certified an alleged territorial overlap between a property belonging to the protected company and an Indigenous territory. The applicant asserts that this is based on uncertain cartographic information and contradicts technical and judicial precedents showing that the area lacks precise physical and geographic demarcation. The applicant adds that the challenged oficio has continuing effects, generating alerts or restrictions on institutional platforms and affecting property transactions, registry security, and various administrative procedures related to use of the property. The applicant claims that the oficio required that the graphic information and digital map supporting the territorial overlap not be disclosed to third parties. The applicant explains that these restrictions have halted mining case files submitted by the protected company, particularly case file 2025-CAN-PRI-044, because other administrative authorities refuse to continue processing them while the criterion issued by INDER remains in force. The applicant considers fundamental rights to have been violated.

II. THE SPECIFIC CASE

In this case, the Court observes that it is not a legality oversight body or another level of the Administration. Accordingly, it is not for the Court to review, against the applicable regulatory framework, factual assumptions, and technical criteria, whether the oficio challenged here, issued by Inder, or the subsequent oficio issued by the Dirección de Geología y Minas was proper. In this regard, it is not for the Chamber to analyze whether the property in question lies within Indigenous territory. Nor is it within its remit to order removal of the alleged computerized alert or the disputed cartographic data. The same applies to processing and granting the Area Reservation requested by the protected company and, in general, to the relief sought in this amparo. Furthermore, the record does not show that any confidentiality order was issued; it shows only this statement by INDER: “graphic information (location map) is transmitted solely for interpretation by the Dirección de Geología y Minas; accordingly, we request that this information not be disclosed to third parties, as it is shared solely in the State’s interest.” Any disagreement with that request must be raised through the appropriate administrative channel.

In short, the matters challenged in this amparo amount to an ordinary legality dispute that does not directly involve any fundamental right. In addition, the Court emphasizes that it must not act as a mediator before a particular natural or legal person—whether governed by public or private law—to intercede for a third party so that the third party may obtain what it seeks. Those matters must be resolved by the Administration or, as applicable, by the ordinary courts. Accordingly, the amparo proceeding is declared inadmissible.

III. DIFFERENT REASONS OF JUSTICE RUEDA LEAL

I maintain that this matter should be rejected outright because the applicant filed the amparo proceeding on behalf of a legal person. Relevant to the case under review, in the dissenting opinion I recorded in judgment no. 2019-2355, issued at 9:30 on 12 February 2019, I maintained:

“[I]n Advisory Opinion 22-16 of 26 February 2016, the Inter-American Court of Human Rights stated that although some States recognize the right to petition for legal persons under special conditions, such as trade unions, political parties, or representatives of Indigenous peoples, Afro-descendant communities, or specific groups, the fact remains that ‘Article 1.2 of the American Convention grants rights only to natural persons, and legal persons are therefore not holders of the rights enshrined in that treaty.’ On the other hand, in the same advisory opinion, the Inter-American Court held that, in certain particular contexts, natural persons may exercise their rights through legal persons (for example, through a media outlet, as occurred in the case of Nombre02 et al. v. Venezuela); however, for such rights to be protected before the inter-American system, ‘the exercise of the right through a legal person must involve an essential and direct relationship between the natural person seeking protection from the inter-American system and the legal person through which the violation occurred, since a mere connection between the two persons is insufficient to conclude that the rights of natural persons, rather than those of legal persons, are in fact being protected.

Indeed, proof is required beyond the natural person’s mere participation in the activities of the legal person, such that the participation is substantially related to the rights alleged to have been violated.’ (emphasis added) (OC. 22/16).” In my view, interpreting the Ley de la Jurisdicción Constitucional requires applying the same rationale as the above-mentioned conventional interpretation to all fundamental rights. Thus, in a constitutional proceeding brought on behalf of a legal person, admission for review requires an essential and direct relationship between the legal person claiming to have been affected by a violation of the constitutional order and the natural person whose fundamental right has thereby been impaired indirectly but directly. For these purposes, a mere reference to a connection or link between the legal person and the natural person is insufficient to conclude that the constitutional proceeding is in fact seeking to protect the latter’s fundamental rights, rather than merely those of the former.

This requirement therefore constitutes a sine qua non condition for constitutional review by this jurisdiction. On the basis of the foregoing, I conclude that this is the standard by which the Ley de la Jurisdicción Constitucional must be interpreted. Accordingly, in the case under review, constitutional review is inadmissible because the evidence in the record does not establish an essential link between the protected legal person and any natural person, specifically in relation to the alleged right violated.

IV. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must collect them from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo proceeding is rejected outright. Justice Rueda Leal gives different reasons.

Revisión del Documento EXPEDIENTE N° 26-028174-0007-CO PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026032239 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre03, cédula de identidad CED01, a favor de ROCA GRANDE DEL CARIBE SOCIEDAD DE RESPONSABILIDAD LIMITADA, cédula jurídica 3102877510, contra el INSTITUTO DE DESARROLLO RURAL (INDER) y el REGISTRO NACIONAL, DIRECCIÓN DE GEOLOGÍA Y MINAS (DGM).

Resultando:

  1. 1Por escrito incorporado al expediente digital de la Sala a las 15:49 horas del 4 de agosto de 2026, el recurrente, en su condición de apoderado generalísimo sin límite de suma del empresario social denominado ROCA GRANDE DEL CARIBE SOCIEDAD DE RESPONSABILIDAD LIMITADA, interpone recurso de amparo contra el INDER Y EL REGISTRO NACIONAL, DIRECCIÓN DE GEOLOGÍA Y MINAS (DGM). Indica lo siguiente: “El objeto de esta acción constitucional se materializa entonces en la exigencia de obtener la inmediata declaración de invalidez constitucional y la consiguiente cesación de los efectos lesivos y continuados provocados por el Oficio número PR-INDER-GG-DRT-FT-IRT-OFI-0343-2025. (…) .- El inmueble inscrito en el Registro Público Inmobiliario bajo la matrícula de Folio Real número PRN01 del partido de Limón, amparado al plano de catastro número L-646722-1986, es propiedad exclusiva, legítima y de pleno dominio de la sociedad comercial recurrente, ROCA GRANDE DEL CARIBE SOCIEDAD DE RESPONSABILIDAD LIMITADA.(…) El origen fáctico, el tracto sucesivo y la morfología catastral del predio amparado al plano catastrado número L-0646722-1986, demuestran que el inmueble matriz nació a la vida jurídica privada mediante un proceso legítimo de parcelación, segregación y adjudicación de tierras ejecutado, visado y validado en la década de los años ochenta por el propio Instituto de Desarrollo Agrario, actualmente Instituto de Desarrollo Rural, en adelante INDER, a favor de sujetos particulares. Al haber desincorporado el propio ente recurrido esta superficie territorial de su patrimonio originario para introducirla de forma voluntaria en el tráfico comercial ordinario, el Estado costarricense consolidó una situación jurídica consolidada, valga la acotación, que goza de autonomía e independencia funcional predial absoluta, resultando jurídicamente incompatible con el régimen demanial, inalienable y colectivo propio de los territorios indígenas.3 Mediante la sentencia número 2015000170, dictada por la Sala Constitucional, a las nueve horas un minuto del nueve de enero de dos mil quince dentro del proceso constitucional de amparo planteado en contra del Instituto de Desarrollo Rural (INDER) y el Estado, se ACOGIÓ Y DECLARÓ CON LUGAR EL RECURSO DE AMPARO interpuesto.Dicha estimación constitucional se fundamentó, precisamente, en la comprobación material de que las autoridades recurridas carecen por completo de una delimitación técnica de linderos, amojonamiento o mediciones físicas de campo respecto a los alcances geográficos del Decreto Ejecutivo Número 10706-G del 24 de octubre de 1979 y su Decreto modificatorio y de ampliación Número 21904-G del 20 de enero de 1993 (asociados históricamente a la supuesta Finca de Nombre01). Ante la admisión del propio INDER bajo juramento sobre su incapacidad para fijar coordenadas o planos exactos en la zona, este Tribunal Constitucional estimó la acción de forma directa, determinando que mantener una afectación en papel por más de 30 años sin realizar los estudios de campo constituía una conducta manifiestamente irrazonable, desproporcionada y violatoria de los derechos fundamentales de los administrados, ordenando el restablecimiento del orden constitucional y condenando a la entidad al pago de las costas, daños y perjuicios.4 4.- El 7 de julio de 2025, el Instituto Geográfico Nacional (IGN), en su condición de máxima autoridad cartográfica y geodésica de la República, emitió el Oficio número DIG-GDF-226-2025, certificando con fe pública institucional la exacta ubicación del plano catastrado de mi representada (L-0646722-1986) dentro de la División Territorial Administrativa correspondiente al Distrito de Carrandí, Cantón de Matina, Provincia de Limón.A pesar de esta certeza geográfica oficial extendida por el órgano rector técnico, y en inobservancia de lo resuelto por esta Sala en la Sentencia Número 2015000170, el Instituto de Desarrollo Rural (INDER) emitió de forma posterior el informe número PR-INDER-GG-DRT-FT-IRT-OFI-0343-2025. En este acto, el INDER incurrió en una manifiesta falta de objetividad y apartamiento de la verdad real al certificar ante terceros un supuesto traslape con certeza centimétrica dentro de un perímetro indígena regulado de forma concurrente por los citados Decretos Número 10706-G y Número 21904-G, simulando una delimitación técnica que el Tribunal Constitucional ya declaró que el Instituto no posee ni ha medido en el campo, ejecutando una evidente Vía de Hecho que roza y compromete los principios constitucionales de racionalidad y legalidad.5 5.- Como un agravante que evidencia la desviación de potestad y el desborde del principio de objetividad ejercido en el citado Oficio Número PR-INDER-GG DRT-FT-IRT-OFI-0343-2025, la autoridad recurrida introdujo una patología procesal de corte opaco en el iter procedimental de mi representada, al exigir de forma expresa en la página número 2 de dicho documento que la información gráfica y el mapa digital que supuestamente daba base al traslape territorial no fuera trasladada a terceros.Con esta instrucción de mantener la prueba técnica en condición de reserva, el INDER colocó a la sociedad recurrente en un estado de absoluta indefensión, conculcando el derecho constitucional de fiscalizar, auditar y someter a peritajes de parte la evidencia utilizada de forma unilateral por el Estado para restringir las facultades de un inmueble legítimamente titulado y además dotado de identificación predial.6 6.- La conducta de la autoridad recurrida no constituye un acto aislado o agotado, sino una transgresión de efectos permanentes y continuados que lesiona de forma actual la esfera jurídica del recurrente. Al mantener el INDER plenamente vigente el Oficio número PR-INDER-GG-DRT FT-IRT-OFI-0343-2025 y su consecuente “alerta o mancha informática” restrictiva en las plataformas del SIRI y del SNIT (amparada ciegamente en las capas de los Decretos Número 10706-G y Número 21904-G), el INDER coarta y compele de forma ilegítima la libertad del tráfico inmobiliario de la superficie, proyectando un bloqueo de facto que impide que el Estado central ejerza su soberanía para otorgar la Reserva de Área sobre el subsuelo en el expediente número 2025-CAN-PRI-044, perpetuando un estado de absoluta inseguridad jurídica basado en un hecho incierto y abiertamente contradictorio con el Principio de Legalidad.(…) ACTUACIÓN LESIVA RECURRIDA8 A.1.- Simulación cartográfica de imperio (fraude a la verdad real) Se recurre de forma expresa la validez constitucional del Oficio número PR INDER-GG-DRT-FT-IRT-OFI-0343-2025 dictado por el INDER. Este instrumento corporiza una flagrante vía de hecho al certificar una delimitación de coordenadas espaciales con certeza centimétrica sobre el predio de naturaleza estrictamente privada del recurrente (finca inscrita en el sistema de folio real matrícula número PRN01), inventándose al efecto en una oficina del INDER una afectación territorial que la propia realidad y los antecedentes de esta Sala han declarado en absoluto estado de indeterminación física y técnica. A.2.- Institucionalización de la Prueba Secreta en el Estado de Derecho Se impugna formalmente la orden de confidencialidad contenida de forma expresa en la página número 2 del citado oficio del INDER.A través de esta instrucción clandestina, el ente recurrido ordenó que la información gráfica y cartográfica que sustenta su pretendido traslape no fuera trasladada a terceros. Esta directriz despoja al procedimiento de toda transparencia pública, implantando una reserva probatoria que impide a mi representada auditar o someter a peritajes de parte la evidencia técnica utilizada por el Estado para paralizar sus trámites lícitos de concesión en el expediente minero número 2025-CAN-PRI-044. (…) Se declare CON LUGAR en todos sus extremos el presente Recurso de Amparo en contra del Instituto de Desarrollo Rural (INDER) y, de forma refleja y consecuente, en protección de los autos del expediente minero de mi representada, se declare la NULIDAD ABSOLUTA, REVOCATORIA Y ANULACIÓN CONSTITUCIONAL de los efectos lesivos y permanentes derivados tanto del acto originario, sea el Oficio número PR-INDER-GG-DRT-FT-IRT-OFI-0343-2025 dictado por el INDER, como del acto reflejo y consecuente, sea el Oficio número DGM-TOP-O-200-2026 emitido el 22 de julio de 2026 por el Departamento de Topografía del Catastro Minero de la Dirección de Geología y Minas (DGM), por constituir manifestaciones de imperio viciadas en su motivo y causa, violatorias de los principios de razonabilidad, interdicción de la arbitrariedad y verdad real.SEGUNDO. - (Pretensión de Restitución Inmobiliaria Digital y Pureza Registral) Se ordene a la Presidencia Ejecutiva del Instituto de Desarrollo Rural (INDER) y, de forma refleja, a la Dirección General de la Dirección de Geología y Minas (DGM), proceder de manera inmediata al levantamiento, remoción y limpieza absoluta definitiva de cualquier "alerta informática", "mancha cartográfica" de control o código de advertencia indígena indexado unilateralmente sobre la finca matrícula de Folio Real número PRN01 del partido de Limón y su plano catastrado de origen legítimo número L-0646722-1986 en las plataformas y visores del SIRI y del SNIT, restituyendo al inmueble su condición histórica de pureza predial y libertad técnica. TERCERO. - (Pretensión de Desbloqueo y Continuidad Procedimental Mandatoria) Como consecuencia obligatoria del restablecimiento del orden constitucional, se ordene a la Dirección de Geología y Minas (DGM) y a su Departamento de Control Minero-Topografía dar curso, tramitar, procesar y otorgar de forma inmediata la Reserva de Área solicitada por mi representada sobre el Dirección02.2 Hectáreas de la Fase 1 dentro del expediente número 2025-CAN-PRI-044, disponiendo que el iter procedimental ordinario minero camine, avance y precluya hacia las fases de evaluación ante la SETENA de conformidad con los plazos de la Resolución Número 306-2026, quedando la Administración Pública estrictamente inhibida de utilizar los oficios anulados supra como pretexto de parálisis, silencio o denegatoria.CUARTO. - (Pretensión de Proscripción de la "Prueba Secreta" y Apertura Probatoria) Se intime al Instituto de Desarrollo Rural (INDER) a levantar de forma definitiva la orden de confidencialidad impuesta en la página número 2 de su Oficio del 2025, ordenándosele poner a libre disposición de este Tribunal y de los administrados la totalidad de las capas de información gráfica y memorandos técnicos de su departamento de topografía, ratificándose la prohibición absoluta de fundamentar restricciones patrimoniales en evidencias ocultas sustraídas de la fiscalización ciudadana. QUINTO. - (Pretensión de Responsabilidad Patrimonial del Ente Recurrido) Se condene al Instituto de Desarrollo Rural (INDER) al pago de las costas, daños y perjuicios legítimos, tanto materiales como morales, ocasionados a la sociedad amparada, ROCA GRANDE DEL CARIBE SOCIEDAD DE RESPONSABILIDAD LIMITADA, a consecuencia de la parálisis, el estrangulamiento procedimental y el archivo del expediente número 2024-CAN PRI-001, así como por el bloqueo actual del expediente número 2025-CAN-PRI- 044, cuya liquidación y cuantificación se ejecutarán en la sede contencioso administrativa por la vía del proceso de ejecución de sentencia de conformidad con el artículo 51 de la Ley de la Jurisdicción Constitucional.
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente manifiesta, por oficio PR-INDER-GG-DRT-FT-IRT-OFI-0343-2025, el recurrido certificó un supuesto traslape territorial entre una finca de la empresa amparada y un territorio indígena. Asegura que esto se fundamenta en información cartográfica incierta y contradice antecedentes técnicos y judiciales que evidencian la falta de delimitación física y geográfica precisa de la zona. Agrega que el oficio impugnado provoca efectos permanentes, al generar alertas o restricciones en plataformas institucionales, y afecta el tráfico jurídico de la propiedad, la seguridad registral y diversos trámites administrativos vinculados al aprovechamiento del inmueble. Reclama que en ese oficio se exigió que la información gráfica y el mapa digital que da base al traslape territorial no sea trasladada a terceros. Explica que tales restricciones paralizan expedientes mineros promovidos por la empresa tutelada, especialmente el expediente 2025-CAN-PRI-044, ya que otras autoridades administrativas se niegan a continuar su tramitación mientras permanezca vigente el criterio emitido por el INDER. Estima lesionados los derechos fundamentales.

II. SOBRE EL CASO CONCRETO

En el sub lite, se advierte que este Tribunal no es un contralor de legalidad ni una instancia más de la Administración, de modo que no le corresponde revisar, de acuerdo con el marco normativo, los supuestos fácticos y los criterios técnicos, la procedencia o no del oficio cuestionado, emitido por el Inder, ni el oficio subsiguiente emitido por Dirección de Geología y Minas. En este sentido, no le corresponde a la Sala analizar si la propiedad en cuestión está dentro de territorio indígena. Tampoco es de su resorte determinar la eliminación de la alerta informática aludida o de los datos cartográficos cuestionados. Igual suerte corre tramitar y otorgar la reserva de área solicitada por la empresa tutelada ni, en general, lo pretendido en este amparo. Incluso, de los autos no se colige alguna declaratoria de confidencialidad, únicamente esta manifestación del INDER, en el sentido de que “se remite información gráfica (mapa de ubicación), únicamente, a efectos de interpretación de la Dirección de Geología y Minas, por lo tanto, solicitamos que esta información no sea trasladada a terceros, se comparte únicamente como interés del Estado”, pero la disconformidad con tal solicitud debe ser discutida ante la vía administrativa respectiva.

En síntesis, lo acusado en este amparo no es más que un conflicto de legalidad ordinaria, que no involucra, al menos en forma directa, derecho fundamental alguno. Además, se destaca que este Tribunal no debe fungir como mediador ante una determinada persona física o jurídica -ya sea de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que ella pretende. Esos extremos deben ser resueltos por la Administración o, en su caso, la jurisdicción ordinaria. En consecuencia, el recurso se declara inadmisible.

III. RAZONES DIFERENTES DEL MAGISTRADO RUEDA LEAL

Sostengo que este asunto se debe rechazar de plano, por cuanto la parte accionante plantea el recurso de amparo a favor de una persona jurídica. De importancia para el sub examine, en el voto salvado que consigné en la sentencia nro. 2019-2355 de las 9:30 horas de 12 de febrero de 2019 sostuve:

“[E]n la Opinión Consultiva 22-16 del 26 de febrero de 2016, la Corte Interamericana de Derechos Humanos indicó que si bien algunos Estados reconocen el derecho de petición a personas jurídicas con condiciones especiales, como lo son los sindicatos, partidos políticos o representantes de pueblos indígenas, comunidades afrodescendientes o grupos específicos, lo cierto es que “El artículo 1.2 de la Convención Americana sólo consagra derechos a favor de personas físicas, por lo que las personas jurídicas no son titulares de los derechos consagrados en dicho tratado”. Por otro lado, en la misma opinión consultiva, la Corte Interamericana dispuso que, en ciertos contextos particulares, las personas físicas pueden llegar a ejercer sus derechos a través de personas jurídicas (verbigracia, a través de un medio de comunicación, como acaeció en el caso Nombre02 y otros contra Venezuela); empero, a efectos de que ello sea tutelable ante el sistema interamericano, “el ejercicio del derecho a través de una persona jurídica debe involucrar una relación esencial y directa entre la persona natural que requiere protección por parte del sistema interamericano y la persona jurídica a través de la cual se produjo la violación, por cuanto no es suficiente con un simple vínculo entre ambas personas para concluir que efectivamente se están protegiendo los derechos de personas físicas y no de las personas jurídicas.

En efecto, se debe probar más allá de la simple participación de la persona natural en las actividades propias de la persona jurídica, de forma que dicha participación se relacione de manera sustancial con los derechos alegados como vulnerados.” (énfasis agregado) (OC. 22/16)”.

En mi criterio, la lectura de la Ley de la Jurisdicción Constitucional obliga a la misma ratio de la hermenéutica convencional supracitada respecto a todo derecho fundamental. Así, en un proceso de constitucionalidad formulado a favor de una persona jurídica, su admisión para estudio exige una relación esencial y directa entre la persona jurídica que aduce verse afectada por alguna vulneración al orden constitucional y la persona natural que por tal lesión viene a ver menoscabado, de forma refleja pero directa, algún derecho fundamental. Ahora, para tales efectos es insuficiente la mera referencia a una conexión o vínculo entre la persona jurídica y la natural para poder colegir que, precisamente, por medio del proceso de constitucionalidad se esté procurando el resguardo de los derechos fundamentales de la última, no meramente los de la primera. El requerimiento antedicho deviene entonces un presupuesto sine qua non para la procedencia del control de constitucionalidad por parte de esta jurisdicción.

A partir de lo expuesto, colijo que esta debe ser la pauta con que se debe interpretar la Ley de la Jurisdicción Constitucional, de manera que en el sub iudice deviene improcedente la aplicación del control jurisdiccional de constitucionalidad, puesto que, con base en la prueba que consta en autos, no se ha demostrado el vínculo esencial entre la persona jurídica amparada y alguna natural, de modo específico, en relación con el presunto derecho agraviado.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso. El magistrado Rueda Leal da razones diferentes.
