Motion for supplementation and clarification filed by Nombre01, identity card CED01, in relation to judgment No. 2026030779, issued at 9:25 a.m. on 11 August 2026.

Background:

  1. 1By a brief entered in the Chamber’s digital case file on 14 August 2026, Nombre01 filed a motion for supplementation and clarification of judgment No. 2026030779, issued at 9:25 a.m. on 11 August 2026. The applicant asks this Court to clarify and reconsider the judgment issued, alleging that the amparo application was summarily dismissed on the ground that the dispute raised was an ordinary-legality dispute concerning billing and tariff classification, the resolution of which would require technical and legal evidence incompatible with the summary nature of this jurisdiction. The applicant maintains that this assessment overlooks the true purpose of the application, which is not to set tariffs, but to protect the fundamental right to potable water in its dimension of economic affordability and fair cost-based billing, in response to what the applicant considers a de facto action by the Instituto Costarricense de Acueductos y Alcantarillados (AyA), which allegedly failed to apply the general effects of ARESEP Resolution RE-0008-IA-2025 and continued to charge a commercial tariff to a residential complex comprising 160 families.The applicant alleges that the disputed charge represents a 60% surcharge, plus 13% VAT, which, in the applicant’s view, constitutes an economic barrier affecting the families’ essential and ordinary consumption and violating Articles 46 and 50 of the Political Constitution, as well as the principle of normative hierarchy and the principle that administrative acts cannot be repealed on an individual basis. The applicant asserts that documentation issued by AyA itself shows the contradiction between the residential tariff that, according to the applicant, should apply and the commercial charge imposed, and that complex technical evidence is therefore unnecessary to establish the alleged violation.
  2. 2The legal requirements have been observed in the proceedings conducted.

Justice Castillo Víquez drafts the judgment; and, Reasons:

I. AS TO WHAT THE CHAMBER DECIDED

In judgment No. 2026030779, issued at 9:25 a.m. on 11 August 2026, this Chamber decided, insofar as relevant:

“(…) II.- INADMISSIBILITY OF THE AMPARO. Having considered the appellant’s arguments, the Court points out that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as a means of reviewing the legality of acts of the Public Administration or as a general mechanism for channeling other types of requests. For that reason, the Chamber cannot act as an appellate body in the matter presented and review whether the tariff classification assigned by the Instituto Costarricense de Acueductos y Alcantarillados to the potable-water service at the appellant’s condominium, the application of the commercial-service tariff, the denial of the request for reclassification to the Large Residential Consumers Tariff (T-GCR), the collection of value-added tax, or the refund of amounts allegedly overcharged comply with the applicable regulations and regulatory provisions, since this is an ordinary-legality dispute that must be resolved through the corresponding administrative or judicial channel.

Nor is it for this Chamber to replace the powers legally assigned to the respondent institute, the Public Services Regulatory Authority, or the competent authorities in the matter, in order to determine whether the requested tariff reclassification is technically and legally warranted, verify the correct application of the tariff regime, establish whether the collection of value-added tax is warranted, or decide whether the claimed sums should be refunded, since that is a task for the Administration, and disputes of that kind are to be heard through the ordinary-legality channel, not through constitutional review. In this regard, it should be emphasized that a party cannot seek to have the Constitutional Chamber act, by means of an amparo proceeding, as a mere processing forum for complaints concerning billing and tariff classification for public services, since that would not only require technical and legal evidence incompatible with the summary nature of this forum, but would also directly replace administrative discretion and usurp the role of public offices in handling matters within their competence.

Accordingly, the appellant must resort to the ordinary-legality channel, administrative or judicial, and submit in writing any claims considered appropriate, so that the matter may be resolved as the law requires. Consequently, the application is inadmissible, and this is so declared.

(…)

THEREFORE:

The amparo application is summarily dismissed.”

II. AS TO THE MOTION FOR SUPPLEMENTATION AND CLARIFICATION

The Constitutional Jurisdiction Act empowers this Chamber to supplement and clarify its judgments where appropriate, by providing:

“Article 12.- Judgments issued by the Chamber may be clarified or supplemented at a party’s request, if requested within three days, and on the Chamber’s own initiative at any time, including during enforcement proceedings, to the extent necessary to give full effect to the ruling.” Accordingly, a ruling may be supplemented only when a point raised in the original application was not decided in the judgment, while clarification is permissible when the judgment contains unclear or ambiguous terms that make its meaning difficult to understand. Supplementation and clarification are therefore means of completing a judgment or explaining the scope of the ruling in question, not mechanisms for challenging it. Because this Chamber is bound by the Political Constitution, the general principles of constitutional law, and the law, it has allowed its judgments to be annulled by the Chamber itself, given that it is a court of sole instance, only to correct serious errors in the assessment of the facts or because other facts, duly established in the case file at the time the judgment was issued, were not taken into account.

III. AS TO THE MOTION FILED

In this case, the appellant filed a motion for supplementation and clarification concerning the judgment that summarily dismissed the amparo application filed against the Instituto Costarricense de Acueductos y Alcantarillados. The appellant asks the Court to clarify and reconsider its decision, disputing the characterization of the matter as an ordinary-legality dispute concerning billing and tariff classification, and alleging that the purpose of the application was not to obtain a technical setting of tariffs, but to protect the fundamental right to potable water in its dimension of economic affordability and fair cost-based billing, in response to the conduct attributed to the Instituto Costarricense de Acueductos y Alcantarillados.

However, although the appellant requests supplementation and clarification, the appellant plainly does not seek to supplement or clarify an omitted or ambiguous part of the judgment, but instead challenges the grounds and decision adopted by this Chamber and seeks reconsideration. Specifically, the appellant asks the Court to review the criteria used to determine that the tariff classification applied to the potable-water service, the denial of the requested reclassification, the collection of value-added tax, and the refund of amounts allegedly overcharged are matters of ordinary legality. The appellant maintains that those actions violate the fundamental right to potable water in its dimension of economic affordability. This Court has already expressly addressed those matters in the challenged judgment, establishing that the claims concerned an ordinary-legality dispute to be resolved through the corresponding administrative or judicial channel.

In this regard, the motion seeks to challenge a decision already issued by this Chamber by questioning the legal grounds for its ruling. That action is inadmissible under Article 11 of the Constitutional Jurisdiction Act, which provides that no appeals shall be admitted against judgments, orders, or rulings issued by this Chamber. This principle is fundamental to legal certainty and the stability of judicial decisions, ensuring that rulings reached after a thorough process of review and deliberation are not subject to continuous reconsideration. The Court must also point out to the appellant that the judgment whose clarification and supplementation the appellant seeks to challenge set out the legal reasons supporting the decision, including this Court’s view of the nature of the claim brought against the Instituto Costarricense de Acueductos y Alcantarillados and the impropriety of this Chamber determining the correct tariff classification, the application of the tariff regime, whether value-added tax may be collected, or whether the claimed sums should be refunded, since those are matters for the ordinary-legality channel.

Consistent with that reasoning, the moving party has identified no point that was omitted or is unclear and requires clarification or supplementation, but instead seeks a new assessment of legal criteria already considered and decided. In view of the foregoing, because the aforementioned judgment is duly reasoned, the motion for supplementation and clarification must be denied.

IV. DOCUMENTS SUBMITTED TO THE CASE FILE

The parties are notified that if they submitted any paper documents, or objects or evidence contained on any additional electronic, computing, magnetic, optical, telematic, or new-technology device, they must collect them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court in session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .

Gestión de adición y aclaración interpuesta por Nombre01, cédula de identidad CED01, en relación con la sentencia No. 2026030779, de las nueve horas veinticinco minutos del once de agosto de dos mil veintiséis.

Resultando:

  1. 1Mediante escrito incorporado al expediente digital de la Sala el 14 de agosto de 2026, Nombre01 plantea solicitud de adición y aclaración de la sentencia No. 2026030779, de las nueve horas veinticinco minutos del once de agosto de dos mil veintiséis. Solicita a este Tribunal que se aclare y reconsidere la sentencia dictada, pues alega que se rechazó de plano el recurso al considerar que la controversia planteada constituía un diferendo de legalidad ordinaria en materia de facturación y clasificación tarifaria, cuya resolución requeriría probanzas técnicas y jurídicas incompatibles con la naturaleza sumaria de esta jurisdicción. Sostiene que dicha apreciación desatiende el verdadero objeto del recurso, pues no pretende una fijación de tarifas, sino la tutela del derecho fundamental al agua potable en su dimensión de asequibilidad económica y cobro justo al costo, frente a lo que considera una actuación de hecho del Instituto Costarricense de Acueductos y Alcantarillados (AyA), que habría inaplicado los efectos generales de la Resolución RE-0008-IA-2025 de la ARESEP y mantenido una tarifa comercial sobre un complejo habitacional compuesto por 160 familias.Alega que el cobro cuestionado representa un sobreprecio del 60%, más un 13% de IVA, lo que, a su criterio, constituye una barrera económica que afecta el consumo vital y ordinario de las familias y vulnera los artículos 46 y 50 de la Constitución Política, así como el principio de jerarquía normativa y el de inderogabilidad singular de los actos administrativos. Afirma que la propia documentación emitida por el AyA evidencia la contradicción entre la tarifa residencial que, según sostiene, corresponde aplicar y el cobro comercial efectuado, por lo que no serían necesarias pruebas técnicas complejas para constatar la lesión alegada.
  2. 2En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. SOBRE LO RESUELTO POR LA SALA

En la sentencia No. 2026030779, de las nueve horas veinticinco minutos del once de agosto de dos mil veintiséis, esta Sala en lo que interesa resolvió:

“(…) II.- INADMISIBILIDAD DEL AMPARO. Vistos los alegatos de la parte recurrente, se le hace ver que la finalidad del recurso de amparo es brindar tutela oportuna contra infracciones o amenazas a los derechos y libertades fundamentales, no servir como instrumento de control de la legalidad de los actos de la Administración Pública, ni servir como un instrumento genérico para canalizar peticiones de otros tipos. Por esta razón, la Sala no puede hacer las veces de alzada en la materia expuesta y revisar si la clasificación tarifaria asignada por el Instituto Costarricense de Acueductos y Alcantarillados al servicio de agua potable del condominio recurrente, la aplicación de la tarifa de comercio-servicio, el rechazo de la solicitud de reclasificación a la Tarifa Grandes Consumidores Residenciales (T-GCR), el cobro del Impuesto al Valor Agregado o la devolución de los montos presuntamente cobrados en exceso, se ajustan o no a la normativa vigente y a las disposiciones regulatorias aplicables, por cuanto constituye un diferendo de legalidad ordinaria que debe ser dirimido en la vía administrativa o judicial correspondiente.

Tampoco corresponde a esta Sala sustituir las competencias legalmente asignadas al instituto recurrido, a la Autoridad Reguladora de los Servicios Públicos o a las autoridades competentes en la materia, a efecto de determinar si técnica y jurídicamente procede o no la reclasificación tarifaria solicitada, verificar la correcta aplicación del régimen tarifario, establecer la procedencia del cobro del Impuesto al Valor Agregado o definir si corresponde la devolución de las sumas reclamadas, por cuanto ello constituye una labor propia de la Administración, cuyos diferendos son propios de conocerse en la vía de legalidad ordinaria y no de constitucionalidad. Al respecto, cabe destacar que no puede pretenderse que, por la vía del amparo, la Sala Constitucional haga las veces de una mera instancia tramitadora de denuncias en materia de facturación y clasificación tarifaria de servicios públicos, puesto que ello no solamente haría necesario efectuar probanzas técnicas y jurídicas incompatibles con la naturaleza sumaria de esta sede, sino también sustituir directamente la voluntad administrativa y suplantar a los despachos públicos en la gestión de los asuntos de su competencia.

Así las cosas, deberá la parte recurrente acudir ante la vía de legalidad ordinaria, administrativa o judicial, a fin de plantear allí, por escrito, los reclamos que estime pertinentes, para que se resuelva lo que en derecho corresponda. En consecuencia, el recurso es inadmisible y así se declara.

POR TANTO:

Se rechaza de plano el recurso.”.

II. SOBRE LA GESTIÓN DE ADICIÓN Y ACLARACIÓN

La Ley de Jurisdicción Constitucional faculta a esta Sala para adicionar y aclarar sus sentencias en aquellos casos en que resulte procedente, al disponer:

“Artículo 12.- Las sentencias que dicte la Sala podrán ser aclaradas o adicionadas, a petición de parte, si se solicitare dentro de tercero día, y de oficio en cualquier tiempo, incluso en los procedimientos de ejecución, en la medida en que sea necesario para dar cabal cumplimiento al contenido del fallo.” Así las cosas, la adición de un pronunciamiento procede, únicamente, cuando un punto del planteamiento original del recurso no fue resuelto en el fallo, mientras que la aclaración es admisible cuando la sentencia correspondiente contiene términos oscuros o ambiguos, que hacen difícil comprender su contenido. La adición y la aclaración son, entonces, formas para complementar una sentencia o explicar los alcances que tiene el pronunciamiento del que se trate, no mecanismos para impugnarlo, siendo que esta Sala, en virtud de estar sometida a la Constitución Política, a los principios generales del derecho constitucional y a la ley, solamente ha admitido que sus fallos, por ser este un tribunal de única instancia, puedan ser anulados por él mismo, cuando se trata de corregir graves errores en la apreciación de los hechos, o porque se dejaron de tomar en cuenta otros que estaban debidamente acreditados en el expediente al momento de dictar la correspondiente sentencia.

III. SOBRE LA GESTIÓN PLANTEADA

En el sub lite, la parte recurrente planteó una gestión de adición y aclaración respecto a la sentencia mediante la cual se rechazó de plano el recurso de amparo interpuesto contra el Instituto Costarricense de Acueductos y Alcantarillados. Al respecto, solicita que se aclare y reconsidere lo resuelto por este Tribunal, pues cuestiona que la controversia planteada haya sido considerada como un diferendo de legalidad ordinaria en materia de facturación y clasificación tarifaria, alegando que el objeto del recurso no consistía en obtener una fijación técnica de tarifas, sino la tutela del derecho fundamental al agua potable en su dimensión de asequibilidad económica y cobro justo al costo, frente a la actuación que atribuye al Instituto Costarricense de Acueductos y Alcantarillados.

Ahora bien, aunque el recurrente solicite una adición y aclaración, claramente no pretende que se adicione o aclare algún extremo omitido o ambiguo de la sentencia, sino que cuestiona los fundamentos y la decisión adoptada por esta Sala y pretende su reconsideración. En efecto, solicita que se revisen los criterios utilizados para considerar que la clasificación tarifaria aplicada al servicio de agua potable, el rechazo de la reclasificación solicitada, el cobro del Impuesto al Valor Agregado y la devolución de los montos presuntamente cobrados en exceso constituyen extremos de legalidad ordinaria, y sostiene que tales actuaciones lesionan el derecho fundamental al agua potable en su dimensión de asequibilidad económica, extremos sobre los cuales este Tribunal ya se pronunció expresamente en la sentencia cuestionada, al establecer que lo reclamado constituía un diferendo de legalidad ordinaria que debía ser dirimido en la vía administrativa o judicial correspondiente.

Al respecto, cabe indicar que la gestión planteada pretende impugnar una resolución ya dictada por esta Sala, al cuestionar las razones jurídicas que sustentaron lo resuelto. Dicha acción no es procedente de acuerdo con el numeral 11 de la Ley de la Jurisdicción Constitucional, el cual establece que no se admitirán recursos contra las sentencias, autos o providencias dictadas por esta Sala. Este principio es fundamental para la certeza jurídica y la estabilidad de las decisiones judiciales, asegurando que las resoluciones alcanzadas después de un exhaustivo proceso de evaluación y deliberación no sean objeto de revisión continua. Adicionalmente, es imperativo señalar a la parte recurrente que la sentencia cuya aclaración y adición pretende cuestionar expuso las razones jurídicas que sustentaron la decisión adoptada, incluyendo el criterio de este Tribunal respecto de la naturaleza del reclamo formulado contra el Instituto Costarricense de Acueductos y Alcantarillados y la improcedencia de que esta Sala determine la correcta clasificación tarifaria, la aplicación del régimen tarifario, la procedencia del cobro del Impuesto al Valor Agregado o la devolución de las sumas reclamadas, por tratarse de extremos propios de la vía de legalidad ordinaria.

En esa misma lógica, no se advierte que la parte gestionante señale un extremo que haya sido omitido o que resulte oscuro y que requiera ser aclarado o adicionado, sino que pretende obtener una nueva valoración de los criterios jurídicos ya analizados y resueltos. En mérito de lo expuesto, al estar debidamente fundamentada la sentencia mencionada, la gestión de adición y aclaración debe ser desestimada.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

No ha lugar a la gestión formulada.
