Amparo proceeding in case file No. 26-024164-0007-CO, filed by Nombre01, identity card CED01, against the CÓBANO DISTRICT MUNICIPAL COUNCIL.

Background:

  1. 1By written submission received by the Chamber’s Secretariat on 6 July 2026, the applicant files an amparo application. She states that on 27 April 2026 an administrative complaint was filed with the Cóbano District Municipal Council, in which residents opposed the application for “rental of space for a shooting range, sale of ammunition and tactical items,” which is located in a biological corridor and is 240 meters from the nearest house, and therefore poses a risk.
  2. 2By order of the President of the Chamber issued at 14:28 on 9 July 2026, the amparo proceeding was admitted.
  3. 3By order of the instructing justice issued at 15:32 on 14 July 2026, the following was ordered: “Whereas, due to a clerical error, the order of the President of the Chamber issued at 14:28 on 9 July 2026 stated that the application was directed against the Municipality of Cóbano District and requested a report from the mayor and the president of the Council, both of the Municipality of Cóbano District, the course of this proceeding is corrected so that it correctly reads: having examined the amparo proceeding in case file No. 26-024164-0007-CO, filed by Nombre01, identity card CED01, against the CÓBANO DISTRICT MUNICIPAL COUNCIL, pursuant to Articles 43, 44 and 45 of the Constitutional Jurisdiction Act, a report is requested from the intendente and the president of the Cóbano District Municipal Council.”
  4. 4Ronny Montero Orozco reports in his capacity as municipal intendente of the Cóbano District Municipal Council. He states: “FIRST: This Constitutional Chamber is informed that the matter to which the applicant refers concerns a ‘possible project’ related to a shooting range. In this regard, this municipal body learned of the matter both through statements made by the applicant and other residents of the district and through the filing with this municipal body of an application for a municipal location resolution. Nevertheless, the Patents Department has clearly and repeatedly explained verbally to all interested persons that, to date, the only action taken by this Municipal Council in connection with the project has been to decide the application for a municipal location resolution filed by the interested party regarding the property where the aforementioned activity is intended to take place.Consequently, this Municipal Council has issued no other administrative act related to the operation, authorization or commencement of operations of the aforementioned shooting range, other than Municipal Location Resolution No. 089-2025. That resolution may not be arbitrarily denied, since the department competent to issue it first verifies that the requested activity is compatible with the applicable regulations and the property, and issues it only when the relevant requirements have been met. SECOND: A municipal location resolution is an administrative act issued by the municipality that determines whether a given commercial activity may be carried out on a specific property, in accordance with the applicable provisions. However, that resolution does not, by itself, constitute authorization to conduct the commercial activity. In this regard, Article 2 of the General Regulations for the Granting of Operating Permits of the Ministry of Health defines a municipal location resolution as follows: ‘…44.Municipal Location Resolution: an administrative resolution issued by the local government before any of the activities regulated by this decree begin operating, certifying the condition of the site selected for the establishment of the requested activity with respect to zoning, location, setbacks and whether there are special zones subject to any reservation regarding their use and development…’ It follows from the definition quoted that the purpose of a municipal location resolution is to verify the urban-planning and territorial viability of the proposed activity, without authorizing its operation. Consequently, for a commercial activity to be lawfully conducted on a property, it is essential to obtain a municipal business license, which is the administrative license authorizing the conduct of the commercial activity, provided that the requirements established by the legal system have been met.In this matter, this Municipal Council has received no application for a business license for the shooting range to which the applicant refers. Consequently, the Patents Department is unable to issue an opinion or rule on an application that has not been filed or submitted for the Municipal Administration’s consideration. For the same reason, there is no administrative file, documentation or administrative act related to an application for a business license for that activity. THIRD: It should be noted that the municipal location resolution is issued by the Urban Management and Control Department. In this regard, by official letter GCU-059-2026 dated 16 April 2026, that Department responded to a written submission filed by the applicant on 30 March 2026, clarifying the legal nature of the municipal location resolution, as well as its scope and effects. The letter specified that this resolution only determines whether a given activity is compatible with the property on which it is intended to take place, in accordance with the applicable regulations, and that it does not constitute authorization to conduct the commercial activity or, by itself, authorize the activity to begin or operate.The following is quoted from that letter: ‘…In response to your inquiry concerning a possible application related to an open-air shooting range, I inform you of the following: The municipal location resolution, or location procedure, is a preliminary administrative act whose purpose is to make an initial determination as to whether a proposed activity is compatible with the territorial, urban-planning and land-use regulations applicable to a particular property. Consequently, that procedure does not, by itself, constitute final authorization to operate, build, conduct operations or open an activity, nor does it replace permits, licenses, approvals or authorizations that must later be obtained from the Municipality or other competent institutions. Its scope is limited to verifying, at this initial stage, the suitability of the location under the current regulatory framework. The other technical, legal, environmental, health, operational and safety requirements, as well as noise control, road impact, sectoral compliance and any other applicable regulatory requirements, must be substantiated and verified at later stages of the process before the competent authorities and before any possible final authorization.For the foregoing reasons, several matters raised in your letter concerning noise levels, type of weaponry, impacts on third parties, wildlife, public health, legal liability, operation of the establishment or other specialized studies are matters whose assessment is outside the scope of a municipal location resolution and instead belongs to later stages or to the specific authority of other institutions. Likewise, if there is an administrative file subject to public consultation, access will be granted in accordance with the current regulations, while safeguarding any restricted-access information. It is reiterated that all administrative action is governed by the principle of legality and is subject to full compliance with the requirements imposed by the legal system at each procedural stage…’ (Italics not in the original.) That letter was duly communicated to the applicant by email ...01 on 17 April 2026.FOURTH: The applicant was also given a hearing before the Council of Council Members, where she had the opportunity to present the facts and arguments she considered relevant, as recorded in Minutes No. 103-2026, corresponding to the ordinary session held by the Cóbano District Municipal Council on 21 April 2026, at 18:15, at the Casa de la Cultura of the Asociación de Desarrollo Integral de Cóbano. During that hearing, she was informed, among other things, that Cóbano District has no current urban regulatory plan, and that for this reason the Administration must process and decide applications under the applicable regulatory framework. She was also informed about the internal handling of this type of application and other relevant aspects related to the matter raised. There is currently no application for a business license to conduct this activity. The only existing administrative act is a municipal location resolution, which is limited to determining whether the activity is compatible with the relevant property and does not constitute authorization, permission or a license to conduct the commercial activity.The applicant also filed another written submission with the Tax and Financial Administration Department, requesting various actions related to a possible business license for a shooting range. In response to that request, the Department proceeded to reply as follows: In light of all the foregoing, it is hereby recorded that the applicant has been assisted with regard to the matters raised concerning the shooting range and has been informed of the scope of Municipal Location Resolution No. 089-2025, which only determines whether the activity is compatible with the relevant property and does not constitute a business license. In this regard, it is considered that the applicant is confused about the nature and effects of that resolution and how it differs from a business license. The applicant is also informed that she has acted in advance of the facts with respect to the possible application for a business license, since she has requested actions and documents that do not exist and cannot be issued as of this date, because the person interested in authorizing the shooting range has not yet filed a formal application for a business license.FIFTH: With regard to the written submission filed on 27 April 2026 with the Patents Department, entitled ‘Administrative Complaint Opposing the Application for Rental of Space for a Shooting Range, Sale of Ammunition and Tactical Items,’ it is reported that the submission was addressed by official letter No. CMDC-PAT-2026-106, which states: ‘…With reference to the complaint filed with this office, opposing the application related to the activity of “Rental of space for a shooting range, sale of ammunition and tactical items,” as well as requesting that Resolution No. 089-2025 be declared void, the following is stated: As to the request to declare Resolution No. 089-2025 void, this Patents Department lacks authority to hear and decide that request, by virtue of the principle of legality and the allocation of administrative powers. The power to review, amend, revoke or, where applicable, declare an administrative act void belongs to the body that issued it or, in accordance with the applicable legal system, to the competent higher-ranking body authorized to hear the relevant remedies or proceedings.In addition, among the requests made is a request that, before any possible granting of a business license, compliance be verified with the provisions of the Regulations for the Operation of Shooting Ranges or Shooting Fields for Permitted Firearms, issued by the Ministry of Public Security, as well as that a certified copy be obtained of the operating permit, environmental impact studies, certifications from the file and other authorizations related to operation of a shooting range. In this regard, this Department records that, as of this date, it has received no application for a business license or municipal patent to conduct the specified activity. Consequently, there is no pending administrative file in which to assess compliance with the applicable legal and regulatory requirements, nor is it appropriate to issue advance opinions on a nonexistent proceeding or presume possible noncompliance by a potential applicant.Accordingly, since there is no formal application for a business license, this Department has no information, documentation or administrative actions related to the authorizations mentioned in the complaint. For this reason, it is not possible to respond to the information requests made or rule on matters that, as of this date, are not part of an administrative proceeding before this office. Once a formal application for a business license is filed, it will be processed in accordance with the legally established procedure, and compliance with all requirements and permits applicable to the nature of the proposed activity will be verified before the corresponding administrative act is issued…’ (Italics and boldface not in the original.) It follows from the foregoing that there is currently no business-license application pending. For that reason, the actions and information requested by the applicant cannot be provided, as they concern an administrative proceeding that has not yet begun.Consequently, the requested documentation does not exist and cannot be issued or provided until the corresponding application for a business license is filed. The reply was issued several months later due to the volume of pending matters currently being processed by that Department. Nevertheless, this Chamber is informed that other requests submitted by the applicant and by other interested persons related to operation of the shooting range have been addressed in a timely manner, both verbally and through the corresponding written replies, as explained in the preceding sections. SIXTH: In compliance with this Chamber’s request, the institution’s contact telephone numbers are reported as follows: • 4070-1234 • 8995-9868.”
  5. 5Minor Centeno Sandí reports in his capacity as president of the Cóbano District Municipal Council. He states the foregoing.
  6. 6The legal requirements have been observed in the proceedings.

Prepared by Justice Hess Herrera; and, Reasons:

I. PRELIMINARY MATTER

Before examining the merits of the matter, it should be clarified that, beginning with judgment No. 2008002545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred matters to the administrative-litigation jurisdiction—with certain exceptions—when they concern whether the public administration has complied with the time limits set by the General Public Administration Act (Articles 261 and 325) or by sectoral laws for special administrative proceedings, to issue a final decision in an administrative proceeding—initiated on its own motion or at a party’s request—or to hear the applicable administrative remedies. The present case involves an exception, since it concerns an alleged delay in deciding a complaint regarding a shooting range that could cause noise pollution and endanger the physical integrity of residents. That clarified, the specific situation raised in this amparo will now be decided.

II. SUBJECT OF THE APPLICATION

The applicant complains that on 27 April 2026 an administrative complaint was filed with the Cóbano District Municipal Council, in which residents opposed the application for “rental of space for a shooting range, sale of ammunition and tactical items,” which is located in a biological corridor and is 240 meters from the nearest house, and therefore poses a risk.

III. FACTS PROVEN

The following facts are considered duly proven and relevant to deciding this matter:

  • a)On 30 October 2025, a Cóbano resident filed an application for a “MUNICIPAL LOCATION RESOLUTION” for a shooting range, ammunition sales and tactical items activity with the Cóbano District Municipal Council. (See evidence submitted.)
  • b)By municipal location resolution No. 089-2025 dated 26 November 2025, the Cóbano District Municipal Council stated: “Regarding your application for a Municipal Location Resolution to operate a business for RENTAL OF SPACE FOR A SHOOTING RANGE, SALE OF AMMUNITION AND TACTICAL ITEMS. Named On the aforementioned property, the following is issued: As of the date this Resolution is delivered, Cóbano District does not have a Regulatory Plan or a Zoning Regulation, and therefore the property may be used by its owner according to the owner’s interests, provided that everything specified in the legislation in force in the country is complied with. It should be borne in mind that, when carrying out the activity, all residual products and gray water generated must be properly managed and treated on the same property, and a commitment must be made not to cause disturbances to neighbors or the environment. The Municipal Location Resolution is granted for a period of one year from the date of issuance, subject to compliance with the foregoing. This Resolution is subject to change upon the entry into force of a Regulatory Plan. It is strictly prohibited to use the public road to park vehicles that obstruct free traffic, and the Municipal Council reserves the right to conduct inspections to verify reported information in the event of irregularities and to revoke this use permit if the provisions of this document and the laws governing the matter are not complied with. The applicant is hereby notified that they are required to respect and comply with the foregoing provisions concerning the aforementioned activity. Observations: THIS LAND USE MAY BE REVOKED BY THE CÓBANO DISTRICT MUNICIPAL COUNCIL IN THE EVENT OF ANY IRREGULARITY.” (See evidence submitted.)
  • c)By official letter GCU-059-2026 dated 16 April 2026, addressed to the applicant, the municipal architect stated: “The municipal location resolution, or location procedure, is a preliminary administrative act whose purpose is to make an initial determination as to whether a proposed activity is compatible with the territorial, urban-planning and land-use regulations applicable to a particular property. Consequently, that procedure does not, by itself, constitute final authorization to operate, build, conduct operations or open an activity, nor does it replace permits, licenses, approvals or authorizations that must later be obtained from the Municipality or other competent institutions. Its scope is limited to verifying, at this initial stage, the suitability of the location under the current regulatory framework. The other technical, legal, environmental, health, operational and safety requirements, as well as noise control, road impact, sectoral compliance and any other applicable regulatory requirements, must be substantiated and verified at later stages of the process before the competent authorities and before any possible final authorization. For the foregoing reasons, several matters raised in your letter concerning noise levels, type of weaponry, impacts on third parties, wildlife, public health, legal liability, operation of the establishment or other specialized studies are matters whose assessment is outside the scope of a municipal location resolution and instead belongs to later stages or to the specific authority of other institutions.   • d)On 27 April 2026, the applicant filed an “administrative complaint opposing the application for rental of space for a shooting range, sale of ammunition and tactical items (sic).” (See evidence submitted.)
  • e)By official letter CMDC-PAT-2026-106 dated 21 July 2026, the person in charge of Patents at the Cóbano District Municipal Council stated: “With reference to the complaint filed with this office, opposing the application related to the activity of ‘Rental of space for a shooting range, sale of ammunition and tactical items,’ as well as requesting that Resolution No. 089-2025 be declared void, the following is stated: As to the request to declare Resolution No. 089-2025 void, this Patents Department lacks authority to hear and decide that request, by virtue of the principle of legality and the allocation of administrative powers. The power to review, amend, revoke or, where applicable, declare an administrative act void belongs to the body that issued it or, in accordance with the applicable legal system, to the competent higher-ranking body authorized to hear the relevant remedies or proceedings. Once a formal application for a business license is filed, it will be processed in accordance with the legally established procedure, and compliance with all requirements and permits applicable to the nature of the proposed activity will be verified before the corresponding administrative act is issued.” That letter was notified to the amparo applicant on the same date.   • f)On 30 July 2026, the respondent authorities were notified of the order correcting the course of the proceeding. (See notices of service.)

IV. THE SPECIFIC CASE

In this case, the applicant complains that on 27 April 2026 an administrative complaint was filed with the Cóbano District Municipal Council, in which residents opposed the application for “rental of space for a shooting range, sale of ammunition and tactical items,” which is located in a biological corridor and is 240 meters from the nearest house, and therefore poses a risk.

The case file shows that on 30 October 2025, a Cóbano resident filed an application for a “MUNICIPAL LOCATION RESOLUTION” for a shooting range, ammunition sales and tactical items activity with the Cóbano District Municipal Council. By municipal location resolution No. 089-2025 dated 26 November 2025, the Cóbano District Municipal Council stated: “Regarding your application for a Municipal Location Resolution to operate a business for RENTAL OF SPACE FOR A SHOOTING RANGE, SALE OF AMMUNITION AND TACTICAL ITEMS. Named On the aforementioned property, the following is issued: As of the date this Resolution is delivered, Cóbano District does not have a Regulatory Plan or a Zoning Regulation, and therefore the property may be used by its owner according to the owner’s interests, provided that everything specified in the legislation in force in the country is complied with. It should be borne in mind that, when carrying out the activity, all residual products and gray water generated must be properly managed and treated on the same property, and a commitment must be made not to cause disturbances to neighbors or the environment.

The Municipal Location Resolution is granted for a period of one year from the date of issuance, subject to compliance with the foregoing. This Resolution is subject to change upon the entry into force of a Regulatory Plan. Observations: THIS LAND USE MAY BE REVOKED BY THE CÓBANO DISTRICT MUNICIPAL COUNCIL IN THE EVENT OF ANY IRREGULARITY.” By official letter GCU-059-2026 dated 16 April 2026, addressed to the applicant, the municipal architect stated: “The municipal location resolution, or location procedure, is a preliminary administrative act whose purpose is to make an initial determination as to whether a proposed activity is compatible with the territorial, urban-planning and land-use regulations applicable to a particular property.

Consequently, that procedure does not, by itself, constitute final authorization to operate, build, conduct operations or open an activity, nor does it replace permits, licenses, approvals or authorizations that must later be obtained from the Municipality or other competent institutions. Its scope is limited to verifying, at this initial stage, the suitability of the location under the current regulatory framework. The other technical, legal, environmental, health, operational and safety requirements, as well as noise control, road impact, sectoral compliance and any other applicable regulatory requirements, must be substantiated and verified at later stages of the process before the competent authorities and before any possible final authorization. For the foregoing reasons, several matters raised in your letter concerning noise levels, type of weaponry, impacts on third parties, wildlife, public health, legal liability, operation of the establishment or other specialized studies are matters whose assessment is outside the scope of a municipal location resolution and instead belongs to later stages or to the specific authority of other institutions.

Likewise, if there is an administrative file subject to public consultation, access will be granted in accordance with the current regulations, while safeguarding any restricted-access information. It is reiterated that all administrative action is governed by the principle of legality and is subject to full compliance with the requirements imposed by the legal system at each procedural stage.” Subsequently, and the subject of this application, on 27 April 2026 the applicant filed an “administrative complaint opposing the application for rental of space for a shooting range, sale of ammunition and tactical items (sic).” By official letter CMDC-PAT-2026-106 dated 21 July 2026, the person in charge of Patents at the Cóbano District Municipal Council stated: “With reference to the complaint filed with this office, opposing the application related to the activity of ‘Rental of space for a shooting range, sale of ammunition and tactical items,’ as well as requesting that Resolution No. 089-2025 be declared void, the following is stated: As to the request to declare Resolution No. 089-2025 void, this Patents Department lacks authority to hear and decide that request, by virtue of the principle of legality and the allocation of administrative powers.

The power to review, amend, revoke or, where applicable, declare an administrative act void belongs to the body that issued it or, in accordance with the applicable legal system, to the competent higher-ranking body authorized to hear the relevant remedies or proceedings. In addition, among the requests made is a request that, before any possible granting of a business license, compliance be verified with the provisions of the Regulations for the Operation of Shooting Ranges or Shooting Fields for Permitted Firearms, issued by the Ministry of Public Security, as well as that a certified copy be obtained of the operating permit, environmental impact studies, certifications from the file and other authorizations related to operation of a shooting range. In this regard, this Department records that, as of this date, it has received no application for a business license or municipal patent to conduct the specified activity.

Consequently, there is no pending administrative file in which to assess compliance with the applicable legal and regulatory requirements, nor is it appropriate to issue advance opinions on a nonexistent proceeding or presume possible noncompliance by a potential applicant. Accordingly, since there is no formal application for a business license, this Department has no information, documentation or administrative actions related to the authorizations mentioned in the complaint. For this reason, it is not possible to respond to the information requests made or rule on matters that, as of this date, are not part of an administrative proceeding before this office. Once a formal application for a business license is filed, it will be processed in accordance with the legally established procedure, and compliance with all requirements and permits applicable to the nature of the proposed activity will be verified before the corresponding administrative act is issued.” That letter was notified to the amparo applicant on the same date. On 30 July 2026, the respondent authorities were notified of the order correcting the course of the proceeding.

Accordingly, the application must be dismissed. In this regard, note that the application of 27 April 2026, which the applicant alleges was not decided, was addressed by official letter CMDC-PAT-2026-106 dated 21 July 2026. The applicant was notified of that letter on the same date, well before the respondents were notified of the order admitting this amparo proceeding and, therefore, without intervention by the Chamber.

V. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Tribunal’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the Administrative Litigation Courts, and not this Chamber, must hear the legal dispute. However, with the recent enactment of Law No. 9097, the Petition Rights Regulation Act, it has been established that this right may be protected judicially through the amparo proceeding provided for in Article 32 of the Constitutional Jurisdiction Act, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, its administrative acts or its response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Tribunal to change its line of precedent; under Article 7 of its Act, this Tribunal is exclusively responsible for defining its own jurisdiction.

Therefore, except for those constitutional legal disputes that this same Chamber has recognized as exceptions and that may indeed be heard in this jurisdiction through the constitutional amparo remedy, in all other cases, for the reasons given by this Tribunal (judgment No. 2008- 02545 issued at 8:55 a.m. on 22 February 2008), the competent authorities are the Judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles and rules) and the relevant legal rules, based on a logical, systematic and teleological interpretation of the legal system.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that if they submitted any paper document, or any objects or evidence contained on an electronic, computer, magnetic, optical, telematic or new-technology device, these must be collected from the office within a maximum period of 30 business days from notification of this judgment. Any such material not collected within this period will be destroyed, in accordance with the “Regulations on Electronic Case Files before the Judiciary,” approved by the full Court in Article XXVI of session No. 27-11 on 22 August 2011, published in Judicial Bulletin No. 19 on 26 January 2012, and the resolution of the Judiciary’s Superior Council, approved in Article LXXXI of session No. 43-12 held on 3 May 2012.

Therefore:

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .

Recurso de amparo que se tramita en expediente nro. 26-024164-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el CONCEJO MUNICIPAL DE DISTRITO DE CÓBANO.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 6 de julio de 2026, la recurrente interpone recurso de amparo. Manifiesta que el 27 de abril de 2026 se interpuso un reclamo administrativo ante el Concejo Municipal de Distrito de Cóbano, en el que los vecinos se opusieron a la gestión “alquiler de espacio para polígono de tiro, venta de municiones y artículos tácticos”, el cual se encuentra en un corredor biológico y está a 240 metros de la casa más próxima, por lo que es un riesgo.
  2. 2Mediante resolución de la Presidencia de la Sala de las 14:28 horas del 9 de julio de 2026 se dio curso al amparo.
  3. 3Mediante resolución de magistrada instructora de las 15:32 horas del 14 de julio de 2026, se dispuso: “Visto que, por error material, en la resolución de la Presidencia de la Sala de las 14:28 horas de 9 de julio de 2026, se indicó que el recurso se dirigía contra la Municipalidad del Distrito de Cóbano y solicitó informe al alcalde y al presidente del Concejo, ambos de la Municipalidad del Distrito de Cóbano, se rectifica el curso de este proceso para que se lea correctamente: visto el recurso de amparo que se tramita en expediente No. 26-024164-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el CONCEJO MUNICIPAL DE DISTRITO DE CÓBANO, en los términos de los artículos 43, 44 y 45 de la Ley de la Jurisdicción Constitucional, se requiere informe al intendente y al presidente del Concejo Municipal de Distrito de Cóbano”.
  4. 4Informa Ronny Montero Orozco, en su condición de intendente municipal del Concejo Municipal de Distrito de Cóbano. Expone: “PRIMERA: Se le informa a esta Sala Constitucional que el asunto al que hace referencia la parte recurrente corresponde a un “posible proyecto” relacionado con un polígono de tiro. Al respecto, este ente municipal ha tenido conocimiento del caso tanto por las manifestaciones formuladas por la parte recurrente y otros vecinos del distrito, como por la presentación de una solicitud de resolución municipal de ubicación ante este ente municipal. No obstante, se ha explicado de manera verbal, clara y reiterada por parte del Departamento de Patentes a todas las personas interesadas que, hasta la fecha, la única actuación realizada por este Concejo Municipal en relación con dicho proyecto ha consistido en resolver la solicitud de resolución municipal de ubicación presentada por la parte interesada respecto del inmueble donde se pretende realizar la actividad mencionada.En consecuencia, este Concejo Municipal no ha emitido ningún otro acto administrativo relacionado con el funcionamiento, la autorización o la puesta en operación del referido polígono de tiro, más allá de la Resolución Municipal de Ubicación número 089-2025. Dicha resolución no puede ser denegada de manera arbitraria, por cuanto el departamento competente para su emisión verifica previamente que la actividad solicitada sea compatible con la normativa aplicable y con el inmueble, emitiéndola únicamente cuando se cumplen los requisitos correspondientes. SEGUNDA: La resolución municipal de ubicación constituye un acto administrativo emitido por la municipalidad, mediante el cual se determina la compatibilidad de desarrollar una determinada actividad comercial en un inmueble específico, conforme a las disposiciones aplicables. No obstante, dicha resolución no constituye, por sí sola, una autorización para el ejercicio de la actividad comercial.En ese sentido, el artículo 2 del Reglamento General para el Otorgamiento de Permisos de Funcionamiento del Ministerio de Salud establece el concepto de resolución municipal de ubicación en los siguientes términos: “…44. Resolución Municipal de Ubicación: resolución administrativa emitida por el gobierno local previo al funcionamiento de cualquiera de las actividades reguladas en el presente decreto, en la que certifique la condición en que se encuentra el sitio elegido para el establecimiento de la actividad solicitada, en cuanto a la zonificación, ubicación, retiros y si existen zonas especiales, las que soporten alguna reserva en cuanto a su uso y desarrollo…” De la definición transcrita se desprende que la resolución municipal de ubicación tiene como finalidad verificar la viabilidad urbanística y territorial de la actividad pretendida, sin que ello implique la autorización para su funcionamiento.En consecuencia, para que una actividad comercial pueda desarrollarse legalmente en un inmueble, es indispensable la obtención de la patente municipal, la cual constituye la licencia administrativa que habilita el ejercicio de la actividad comercial, siempre que se hayan cumplido con los requisitos establecidos en el ordenamiento jurídico. Bajo ese contexto, en el presente asunto este Concejo Municipal no ha recibido solicitud alguna de patente comercial para el polígono de tiro al que hace referencia la parte recurrente. En consecuencia, el Departamento de Patentes no se encuentra en posibilidad de emitir criterio ni de pronunciarse sobre una gestión que no ha sido presentada ni sometida a conocimiento de la Administración Municipal. Por esa misma razón, tampoco existe expediente administrativo, documentación o actos administrativos relacionados con una solicitud de patente comercial para dicha actividad.TERCERA: Cabe señalar que la resolución municipal de ubicación es emitida por el Departamento de Gestión y Control Urbano. En ese sentido, mediante el oficio GCU-059-2026 de fecha 16 de abril del 2026, dicho Departamento dio respuesta a un escrito presentado por la parte recurrente el 30 de marzo de 2026, oportunidad en la cual se le aclaró la naturaleza jurídica de la resolución municipal de ubicación, así como sus alcances y efectos. En dicho oficio se precisó que esta resolución únicamente determina la compatibilidad de una determinada actividad con el inmueble en el que se pretende desarrollar, de conformidad con la normativa aplicable, y que no constituye una autorización para el ejercicio de la actividad comercial ni habilita, por sí sola, el inicio o funcionamiento de la actividad. Se transcribe lo indicado en el oficio mencionado: “…En atención a su gestión relacionada con una eventual solicitud de trámite vinculada con un polígono de tiro a cielo abierto, me permito indicarle lo siguiente: La resolución municipal de ubicación o trámite de ubicación constituye un acto administrativo preliminar, cuyo objeto es determinar, de manera inicial, la compatibilidad de una actividad propuesta con la normativa territorial, urbanística y de uso de suelo aplicable a una finca determinada.En consecuencia, dicho trámite no constituye por sí mismo una autorización definitiva de funcionamiento, construcción, operación ni apertura de actividades, ni sustituye permisos, licencias, visto buenos o autorizaciones que deban obtenerse posteriormente ante la Municipalidad o ante otras instituciones competentes. Su alcance se limita a verificar, en esta etapa inicial, la viabilidad locativa conforme al marco normativo vigente. Los demás requisitos técnicos, legales, ambientales, sanitarios, operativos, de seguridad, control de ruido, impacto vial, cumplimiento sectorial y cualquier otra exigencia normativa aplicable, deben ser acreditados y verificados en las etapas posteriores del proceso, ante las autoridades competentes y previo a cualquier eventual autorización final. Por lo anterior, varios de los aspectos consultados en su nota relacionados con niveles de ruido, tipo de armamento, impactos a terceros, fauna, salud pública, responsabilidades legales, operación del establecimiento u otros estudios especializados corresponden a materias cuya valoración no forma parte del alcance propio de una resolución municipal de ubicación, sino de fases posteriores o de competencias institucionales específicas.Asimismo, en caso de existir expediente administrativo sujeto a consulta pública, el acceso se brindará conforme a la normativa vigente y resguardando la información de acceso restringido, de haberla. Se reitera que toda actuación administrativa se rige por el principio de legalidad y sujeta al cumplimiento integral de los requisitos exigidos por el ordenamiento jurídico en cada etapa procedimental…” (La cursiva no es del original) Dicho oficio fue debidamente comunicado al recurrente en fecha 17 de abril del 2026 mediante el correo electrónico ...01. CUARTA: Asimismo, se le concedió al recurrente audiencia ante el Concejo de Concejales, espacio en el cual tuvo la oportunidad de exponer los hechos y argumentos que estimó pertinentes, según consta en el Acta número 103-2026, correspondiente a la sesión ordinaria celebrada por el Concejo Municipal de Distrito de Cóbano el día 21 de abril de 2026, a las 18:15 horas, en la Casa de la Cultura de la Asociación de Desarrollo Integral de Cóbano.Durante dicha audiencia se le explicó, entre otros aspectos, que el distrito de Cóbano no cuenta con un plan regulador urbanístico vigente, razón por la cual la Administración debe tramitar y resolver las solicitudes conforme al marco normativo aplicable. Asimismo, se le informó sobre el funcionamiento interno en relación con este tipo de gestiones y otros aspectos relevantes vinculados con el asunto planteado. Actualmente no existe una solicitud de patente comercial para el desarrollo de esa actividad. El único acto administrativo existente corresponde a una resolución municipal de ubicación, la cual se limita a determinar la compatibilidad de la actividad con el inmueble respectivo y no constituye una habilitación, autorización o licencia para el ejercicio de la actividad comercial. Asimismo, la parte recurrente presentó otro escrito dirigido al Departamento de Administración Tributaria y Financiera, mediante el cual solicitó diversas gestiones relacionadas con una eventual patente comercial para un polígono de tiro, de manera que, en atención a dicha gestión, el Departamento procedió a brindar respuesta, indicando lo siguiente: Por todo lo anterior, se hace constar que al recurrente se le ha atendido en relación con las gestiones que ha planteado respecto del polígono de tiro y se le ha explicado el alcance de la Resolución Municipal de Ubicación número 089-2025, la cual únicamente determina la compatibilidad de la actividad con el inmueble respectivo y no constituye una patente o licencia comercial.En ese sentido, se considera que existe una confusión por parte del recurrente respecto de la naturaleza y los efectos de dicha resolución, así como de su diferencia con la patente o licencia comercial. Asimismo, se le indica que se ha adelantado a los hechos en lo referente al eventual trámite de una patente comercial, toda vez que ha solicitado la realización de gestiones y la entrega de documentación que, a la fecha, no existen ni pueden emitirse, debido a que aún no se ha presentado una solicitud formal de licencia comercial por parte de la persona interesada en la habilitación del polígono. QUINTA: En relación con el escrito presentado el 27 de abril de 2026 ante el Departamento de Patentes, denominado “Reclamo Administrativo de Oposición a la Gestión Alquiler de Espacio para Polígono de Tiro, Venta de Municiones y Artículos Tácticos”, se informa que este fue atendido mediante el oficio número CMDC-PAT-2026-106, en el cual se indica: “…Con referencia al reclamo presentado ante esta oficina, mediante el cual se formula oposición a la gestión relacionada con la actividad de "Alquiler de espacio para polígono de tiro, venta de municiones y artículos tácticos", así como la solicitud de nulidad de la Resolución N.° 089-2025, se indica lo siguiente: En cuanto a la pretensión de declarar la nulidad de la Resolución N.° 089-2025, este Departamento de Patentes carece de competencia para conocer y resolver dicha solicitud, en virtud del principio de legalidad y de la distribución de competencias administrativas.La potestad para revisar, modificar, revocar o, en su caso, declarar la nulidad de un acto administrativo corresponde al órgano que lo dictó o, de conformidad con el ordenamiento jurídico aplicable, al órgano jerárquicamente superior que resulte competente para conocer los recursos o procedimientos correspondientes. Por otra parte, dentro de las peticiones formuladas se solicita que, previo al eventual otorgamiento de una licencia comercial, se verifique el cumplimiento de las disposiciones contenidas en el Reglamento para el Funcionamiento de Polígonos o Campos de Tiro para Armas de Fuego Permitidas, emitido por el Ministerio de Seguridad Pública, así como la obtención de copia certificada del permiso de funcionamiento, estudios de impacto ambiental, certificaciones del expediente y demás autorizaciones relacionadas con la operación de un polígono de tiro. Sobre este particular, este Departamento hace constar que, a la fecha, no se ha recibido solicitud alguna de licencia comercial o patente municipal para el desarrollo de la actividad indicada.En consecuencia, no existe expediente administrativo en trámite que permita valorar el cumplimiento de los requisitos legales y reglamentarios aplicables, ni resulta procedente emitir criterios anticipados sobre un procedimiento inexistente o presumir eventuales incumplimientos por parte de un eventual solicitante. En ese sentido, al no existir una gestión formal de licencia comercial, este Departamento no dispone de información, documentación o actuaciones administrativas relacionadas con las autorizaciones señaladas en el reclamo, razón por la cual no es posible atender las solicitudes de información planteadas ni pronunciarse sobre aspectos que, a la fecha, no forman parte de un procedimiento administrativo en conocimiento de esta dependencia. Una vez que se presente una solicitud formal de licencia comercial, esta será tramitada conforme al procedimiento legalmente establecido, verificándose el cumplimiento de todos los requisitos y permisos que resulten exigibles según la naturaleza de la actividad pretendida, previo a la emisión del acto administrativo que corresponda...” (La cursiva y la negrita no son del original) De lo anterior se desprende que, en la actualidad, no existe un trámite de patente comercial en curso, razón por la cual las gestiones e información solicitadas por el recurrente no pueden ser atendidas, en tanto se refieren a un procedimiento administrativo que aún no ha sido iniciado.En consecuencia, la documentación requerida no existe ni puede ser emitida o suministrada mientras no se presente la correspondiente solicitud de patente comercial. La respuesta fue emitida varios meses después debido al volumen de asuntos pendientes que actualmente tramita ese Departamento. No obstante, se hace del conocimiento de esta Sala que otras gestiones presentadas por el recurrente, así como por otras personas interesadas, relacionadas con el funcionamiento del polígono de tiro, han sido atendidas oportunamente, tanto de manera verbal como mediante las respuestas escritas correspondientes, según se expuso en los apartados anteriores. SEXTA: En cumplimiento de lo requerido por esta Sala, se informa que los números telefónicos de contacto de esta institución son los siguientes: • 4070-1234 • 8995-9868 ”.
  5. 5Informa Minor Centeno Sandí, en su condición de presidente del Concejo Municipal de Distrito de Cóbano. Se expresa en los términos antedichos.
  6. 6En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I. CUESTIÓN PREVIA

Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite se plantea un supuesto de excepción, pues se está ante la supuesta dilación en resolver una denuncia relativa a un polígono de tiro que podría causar contaminación sónica y poner en peligro la integridad de los vecinos. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La parte recurrente reclama que el 27 de abril de 2026 se interpuso un reclamo administrativo ante el Concejo Municipal de Distrito de Cóbano, en el que los vecinos se opusieron a la gestión “alquiler de espacio para polígono de tiro, venta de municiones y artículos tácticos”, el cual se encuentra en un corredor biológico y está a 240 metros de la casa más próxima, por lo que es un riesgo.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El 30 de octubre de 2025, una vecina de Cóbano planteó una gestión para “RESOLUCIÓN MUNICIPAL DE UBICACIÓN” para actividad de polígono de tiro, venta de municiones y artículos tácticos ante el Concejo Municipal de Distrito de Cóbano. (Ver prueba aportada).
  • b)Mediante resolución municipal de ubicación nro. 089-2025 del 26 de noviembre de 2025, el Concejo Municipal de Distrito de Cóbano indicó: “En relación a su solicitud de Resolución Municipal de Ubicación para operar un comercio para ALQUILER DE ESPACIO PARA POLIGONO DE TIRO, VENTA DE MUNICION Y ARTICULOS TACTICOS. Denominado En la propiedad antes mencionada, se emite lo siguiente: En el distrito de Cóbano no se cuenta al día de entregada esta Resolución con un Plan Regulador, ni con un Reglamento de Zonificación, por lo que dicho predio puede ser utilizado por el propietario según sus intereses, siempre y cuando cumpla todo lo especificado en la legislación vigente en el país. Se debe tener presente que al momento de realizar la actividad es necesario dar un adecuado manejo de todos los productos residuales y aguas grises que se generen debiendo ser tratadas en el mismo terreno y asumido un compromiso de no causar molestias a sus vecinos ni al medio ambiente. Se le concede La Resolución Municipal de Ubicación, por un periodo de un año a partir de la fecha de emisión, condicionado al cumplimiento de lo antes mencionado. Esta Resolución se encuentra sujeto a cambio por la entrada en vigencia de un Plan Regulador. Queda totalmente prohibido utilizar la vía pública para parquear vehículos que obstruyan el libre tránsito por ella y el Concejo Municipal se reserva el derecho de inspeccionar con el fin de verificar lo reportado en caso de anomalías y de revocar este permiso de uso en el caso en que no se cumpla lo estipulado de este documento y lo establecido en las leyes que regule la materia. Quedando notificado el tramitante de que está obligado a respetar y cumplir las disposiciones que se indican anteriormente con respecto a la actividad mencionada. Observaciones: ESTE USO DE SUELO PUEDE SER REVOCADO POR EL CONCEJO MUNICIPAL DE DISTRITO DE COBANO EN CASO DE CUALQUIER IRREGULARIDAD”. (Ver prueba aportada).
  • c)Mediante oficio GCU-059-2026 del 16 de abril de 2026, dirigido al accionante, la arquitecta municipal consignó: “La resolución municipal de ubicación o trámite de ubicación constituye un acto administrativo preliminar, cuyo objeto es determinar, de manera inicial, la compatibilidad de una actividad propuesta con la normativa territorial, urbanística y de uso de suelo aplicable a una finca determinada. En consecuencia, dicho trámite no constituye por sí mismo una autorización definitiva de funcionamiento, construcción, operación ni apertura de actividades, ni sustituye permisos, licencias, visto buenos o autorizaciones que deban obtenerse posteriormente ante la Municipalidad o ante otras instituciones competentes. Su alcance se limita a verificar, en esta etapa inicial, la viabilidad locativa conforme al marco normativo vigente. Los demás requisitos técnicos, legales, ambientales, sanitarios, operativos, de seguridad, control de ruido, impacto vial, cumplimiento sectorial y cualquier otra exigencia normativa aplicable, deben ser acreditados y verificados en las etapas posteriores del proceso, ante las autoridades competentes y previo a cualquier eventual autorización final. Por lo anterior, varios de los aspectos consultados en su nota relacionados con niveles de ruido, tipo de armamento, impactos a terceros, fauna, salud pública, responsabilidades legales, operación del establecimiento u otros estudios especializados corresponden a materias cuya valoración no forma parte del alcance propio de una resolución municipal de ubicación, sino de fases posteriores o de competencias institucionales específicas. Asimismo, en caso de existir expediente administrativo sujeto a consulta pública, el acceso se brindará conforme a la normativa vigente y resguardando la información de acceso restringido, de haberla. Se reitera que toda actuación administrativa se rige por el principio de legalidad y sujeta al cumplimiento integral de los requisitos exigidos por el ordenamiento jurídico en cada etapa procedimental”.   • d)El 27 de abril de 2026, la parte recurrente formuló un “reclamo administrativo de oposición a la gestión alquiler de espacio para polígono de tiro, venta de municiones y artículos tactivos (sic)”. (Ver prueba aportada).
  • e)Por oficio CMDC-PAT-2026-106 del 21 de julio de 2026, el encargado de Patentes del Concejo Municipal de Distrito de Cóbano indicó: “Con referencia al reclamo presentado ante esta oficina, mediante el cual se formula oposición a la gestión relacionada con la actividad de "Alquiler de espacio para polígono de tiro, venta de municiones y artículos tácticos", así como la solicitud de nulidad de la Resolución N.° 089-2025, se indica lo siguiente: En cuanto a la pretensión de declarar la nulidad de la Resolución N.° 089-2025, este Departamento de Patentes carece de competencia para conocer y resolver dicha solicitud, en virtud del principio de legalidad y de la distribución de competencias administrativas. La potestad para revisar, modificar, revocar o, en su caso, declarar la nulidad de un acto administrativo corresponde al órgano que lo dictó o, de conformidad con el ordenamiento jurídico aplicable, al órgano jerárquicamente superior que resulte competente para conocer los recursos o procedimientos correspondientes. Por otra parte, dentro de las peticiones formuladas se solicita que, previo al eventual otorgamiento de una licencia comercial, se verifique el cumplimiento de las disposiciones contenidas en el Reglamento para el Funcionamiento de Polígonos o Campos de Tiro para Armas de Fuego Permitidas, emitido por el Ministerio de Seguridad Pública, así como la obtención de copia certificada del permiso de funcionamiento, estudios de impacto ambiental, certificaciones del expediente y demás autorizaciones relacionadas con la operación de un polígono de tiro. Sobre este particular, este Departamento hace constar que, a la fecha, no se ha recibido solicitud alguna de licencia comercial o patente municipal para el desarrollo de la actividad indicada. En consecuencia, no existe expediente administrativo en trámite que permita valorar el cumplimiento de los requisitos legales y reglamentarios aplicables, ni resulta procedente emitir criterios anticipados sobre un procedimiento inexistente o presumir eventuales incumplimientos por parte de un eventual solicitante. En ese sentido, al no existir una gestión formal de licencia comercial, este Departamento no dispone de información, documentación o actuaciones administrativas relacionadas con las autorizaciones señaladas en el reclamo, razón por la cual no es posible atender las solicitudes de información planteadas ni pronunciarse sobre aspectos que, a la fecha, no forman parte de un procedimiento administrativo en conocimiento de esta dependencia. Una vez que se presente una solicitud formal de licencia comercial, esta será tramitada conforme al procedimiento legalmente establecido, verificándose el cumplimiento de todos los requisitos y permisos que resulten exigibles según la naturaleza de la actividad pretendida, previo a la emisión del acto administrativo que corresponda”. Tal oficio fue notificado esa misma fecha a la parte amparada. (Ver prueba aportada).
  • f)El 30 de julio de 2026, las autoridades recurridas fueron notificadas de la resolución de rectificación del curso. (Ver actas de notificación).

IV. SOBRE EL CASO CONCRETO

En el sub lite, la parte recurrente reclama que el 27 de abril de 2026 se interpuso un reclamo administrativo ante el Concejo Municipal de Distrito de Cóbano, en el que los vecinos se opusieron a la gestión “alquiler de espacio para polígono de tiro, venta de municiones y artículos tácticos”, el cual se encuentra en un corredor biológico y está a 240 metros de la casa más próxima, por lo que es un riesgo.

De los autos se desprende que, el 30 de octubre de 2025, una vecina de Cóbano planteó una gestión para “RESOLUCIÓN MUNICIPAL DE UBICACIÓN” para actividad de polígono de tiro, venta de municiones y artículos tácticos ante el Concejo Municipal de Distrito de Cóbano. Mediante resolución municipal de ubicación nro. 089-2025 del 26 de noviembre de 2025, el Concejo Municipal de Distrito de Cóbano indicó: “En relación a su solicitud de Resolución Municipal de Ubicación para operar un comercio para ALQUILER DE ESPACIO PARA POLIGONO DE TIRO, VENTA DE MUNICION Y ARTICULOS TACTICOS. Denominado En la propiedad antes mencionada, se emite lo siguiente: En el distrito de Cóbano no se cuenta al día de entregada esta Resolución con un Plan Regulador, ni con un Reglamento de Zonificación, por lo que dicho predio puede ser utilizado por el propietario según sus intereses, siempre y cuando cumpla todo lo especificado en la legislación vigente en el país.

Se debe tener presente que al momento de realizar la actividad es necesario dar un adecuado manejo de todos los productos residuales y aguas grises que se generen debiendo ser tratadas en el mismo terreno y asumido un compromiso de no causar molestias a sus vecinos ni al medio ambiente. Se le concede La Resolución Municipal de Ubicación, por un periodo de un año a partir de la fecha de emisión, condicionado al cumplimiento de lo antes mencionado. Esta Resolución se encuentra sujeto a cambio por la entrada en vigencia de un Plan Regulador. Queda totalmente prohibido utilizar la vía pública para parquear vehículos que obstruyan el libre tránsito por ella y el Concejo Municipal se reserva el derecho de inspeccionar con el fin de verificar lo reportado en caso de anomalías y de revocar este permiso de uso en el caso en que no se cumpla lo estipulado de este documento y lo establecido en las leyes que regule la materia.

Quedando notificado el tramitante de que está obligado a respetar y cumplir las disposiciones que se indican anteriormente con respecto a la actividad mencionada. Observaciones: ESTE USO DE SUELO PUEDE SER REVOCADO POR EL CONCEJO MUNICIPAL DE DISTRITO DE COBANO EN CASO DE CUALQUIER IRREGULARIDAD”. Mediante oficio GCU-059-2026 del 16 de abril de 2026, dirigido al accionante, la arquitecta municipal consignó: “La resolución municipal de ubicación o trámite de ubicación constituye un acto administrativo preliminar, cuyo objeto es determinar, de manera inicial, la compatibilidad de una actividad propuesta con la normativa territorial, urbanística y de uso de suelo aplicable a una finca determinada. En consecuencia, dicho trámite no constituye por sí mismo una autorización definitiva de funcionamiento, construcción, operación ni apertura de actividades, ni sustituye permisos, licencias, visto buenos o autorizaciones que deban obtenerse posteriormente ante la Municipalidad o ante otras instituciones competentes.

Por lo anterior, varios de los aspectos consultados en su nota relacionados con niveles de ruido, tipo de armamento, impactos a terceros, fauna, salud pública, responsabilidades legales, operación del establecimiento u otros estudios especializados corresponden a materias cuya valoración no forma parte del alcance propio de una resolución municipal de ubicación, sino de fases posteriores o de competencias institucionales específicas.

Asimismo, en caso de existir expediente administrativo sujeto a consulta pública, el acceso se brindará conforme a la normativa vigente y resguardando la información de acceso restringido, de haberla. Se reitera que toda actuación administrativa se rige por el principio de legalidad y sujeta al cumplimiento integral de los requisitos exigidos por el ordenamiento jurídico en cada etapa procedimental”.

Posteriormente, y lo que es objeto de este recurso, el 27 de abril de 2026, la parte recurrente formuló un “reclamo administrativo de oposición a la gestión alquiler de espacio para polígono de tiro, venta de municiones y artículos tactivos (sic)”. Por oficio CMDC-PAT-2026-106 del 21 de julio de 2026, el encargado de Patentes del Concejo Municipal de Distrito de Cóbano indicó: “Con referencia al reclamo presentado ante esta oficina, mediante el cual se formula oposición a la gestión relacionada con la actividad de "Alquiler de espacio para polígono de tiro, venta de municiones y artículos tácticos", así como la solicitud de nulidad de la Resolución N.° 089-2025, se indica lo siguiente: En cuanto a la pretensión de declarar la nulidad de la Resolución N.° 089-2025, este Departamento de Patentes carece de competencia para conocer y resolver dicha solicitud, en virtud del principio de legalidad y de la distribución de competencias administrativas.

Sobre este particular, este Departamento hace constar que, a la fecha, no se ha recibido solicitud alguna de licencia comercial o patente municipal para el desarrollo de la actividad indicada.

En consecuencia, no existe expediente administrativo en trámite que permita valorar el cumplimiento de los requisitos legales y reglamentarios aplicables, ni resulta procedente emitir criterios anticipados sobre un procedimiento inexistente o presumir eventuales incumplimientos por parte de un eventual solicitante. En ese sentido, al no existir una gestión formal de licencia comercial, este Departamento no dispone de información, documentación o actuaciones administrativas relacionadas con las autorizaciones señaladas en el reclamo, razón por la cual no es posible atender las solicitudes de información planteadas ni pronunciarse sobre aspectos que, a la fecha, no forman parte de un procedimiento administrativo en conocimiento de esta dependencia. Una vez que se presente una solicitud formal de licencia comercial, esta será tramitada conforme al procedimiento legalmente establecido, verificándose el cumplimiento de todos los requisitos y permisos que resulten exigibles según la naturaleza de la actividad pretendida, previo a la emisión del acto administrativo que corresponda”. Tal oficio fue notificado esa misma fecha a la parte amparada. El 30 de julio de 2026, las autoridades recurridas fueron notificadas de la resolución de rectificación del curso.

Así las cosas, lo correspondiente es declarar sin lugar el recurso. En este sentido, nótese que la gestión del 27 de abril de 2026, cuya falta de resolución acusa el accionante, fue atendida mediante el oficio CMDC-PAT-2026-106 del 21 de julio de 2026, el cual le fue notificado a la parte accionante esa misma fecha y con sobrada antelación a que los accionados fueran notificados de la resolución de curso de este amparo y, por ende, sin que mediara la intervención de la Sala.

V. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008- 02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.

Por tanto:

Se declara sin lugar el recurso. El magistrado Castillo Víquez pone nota.
