Amparo proceeding processed under expediente no. 26-023904-0007-CO, filed by Nombre02, identity card CED02, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (ICAA).

Background:

  1. 1In a filing added to the digital expediente on 2 July 2026, the applicant files an amparo application. She states that on 2 December 2025 she was given a water-consumption bill for a disproportionate amount of approximately 146,000 colones. She indicates that she filed a complaint and received a reduction of 23,000 colones. She alleges that ICAA employees said they would send an inspector to conduct a physical review of the matter, and that the December bill would remain marked “unpaid” while the review was resolved. She recounts that on 2 February 2026 a new bill arrived for 21,611 colones. She explains that, because her disagreement persisted and the promised inspection had not been resolved, she again filed a formal complaint with the respondent institute. She states that the March 2026 bill was for a normal and customary rate. She comments that, fully willing to keep the service current, she went to the ICAA offices to pay the March bill; however, the employee who assisted her said the system blocked payment for that month because the two earlier bills remained outstanding.She alleges that, although she explained in detail to the employee that the earlier amounts were under formal review and complaint, the institution refused to accept payment for current March consumption, stating that there was no notation regarding the two disputed bills and that she should submit a request for review of the matter so that administrative measures could be applied in light of her financial circumstances. She asserts that on 16 March 2026 she filed a complaint with ICAA under request no. 12370473. She alleges that on 20 March 2026 she received an email stating that an inspector would come to review the matter on the following 10 April; however, she says the inspector never appeared. She adds that on 22 April 2026 an ICAA employee came to her home and cut off the water. She further states that the employee gave her a document indicating that she owed 174,255 colones and took the meter.She recounts that on 23 April 2026 she went to the ICAA offices to file a complaint about the water cutoff and submit the request she had received concerning the disputed bills. She says she asked to be allowed to pay the outstanding bill so that her water service would be reconnected. She maintains that the bill was paid and that, since that date, she has had to go every month to have payment for the monthly bill enabled. She comments that she is currently applying for a housing subsidy because of the poor condition of her house, which belongs to her mother-in-law. She indicates that she again went to the ICAA offices to request a certificate stating that the property has a water meter; however, she complains that employees told her they could not issue the certificate because of the debt that the respondent institution itself has been unable to resolve. She expressly requests: “2. As an urgent PRECAUTIONARY MEASURE, order AyA TO REFRAIN from suspending or cutting off the drinking-water service at my home while this proceeding and the review of the amounts are definitively resolved, since I cannot pay them because of my financial circumstances. 3.Order AyA to provide me urgently with the certificate stating that the property has drinking-water service, so I can submit it as part of the housing subsidy application, since the house is in very poor condition.”
  2. 2By resolution issued at 20:17 on 9 June 2026, the Presidency of the Chamber admitted the proceeding.
  3. 3María de los Ángeles Morera Calderón, in her capacity as deputy general manager of the Costa Rican Institute of Aqueducts and Sewers, acting in place of the general manager, who is on medical leave, reports as follows: “I. REGARDING THE FACTS ALLEGED BY THE APPLICANT In response to the situation that is the subject of the amparo application filed by the applicant Nombre02 against the Costa Rican Institute of Aqueducts and Sewers, based on the technical report, memorandum No. UEN-SCCGAM- 2026-02897, dated 14 July 2026, from Javier Jiménez Rivas of UEN-Servicio al Cliente Comercial GAM, and its attachments, all of which are submitted as evidence for this report, and on the scope of the provision regulated for this purpose in the Regulation for the Provision of AyA Services, it is duly established that: FIRST: Based on the data in AyA’s Integrated Commercial System (SCIOPEN), a query using service number NIS CED01 clearly determined that this service is registered in the name of Nombre01, location PRN01, at the address: Dirección01.This service is registered under the Metropolitan Residential rate and has a total outstanding balance of ¢ 201,025.00 (See evidence 1, Memorandum No. UEN-SCC-GAM-2026-02897). - SECOND: A Technical-Commercial-Legal study was conducted regarding the complaint about high consumption recorded from October 2025 through July 2026, as follows: the service’s consumption pattern was checked, and the following field inspections were conducted: It was concluded from the foregoing that, in each billing cycle for the disputed periods from October 2025 through July 2026, increasing and consecutive readings were recorded. As indicated, these were verified by field inspections, which found no damage to the connection affecting the recorded consumption and no reading errors. After verifying the foregoing, consumption was allocated across the periods of November and December 2025, based on an average actual consumption of 40m³, generating a credit note in the user’s favor for ¢25,290.00, which was applied to the December 2025 period.Figure 1. On the other hand, the institutional policy, duly regulated in the applicable regulation, establishes in Article 95 the grounds for applying up to two adjustments to consecutive meter-read bills, provided that the following conditions are met:  AyA may apply up to two (2) adjustments every eighteen (18) months to consecutive meter-read bills for residential-use services where the billed or to-be-billed consumption is equal to or greater than 40 cubic meters and exceeds the normal average consumption for the previous twelve months by 100%.  The increase in consumption must have originated from a leak, for which a prior inspection called “In-home review by means of the hydrometer” must be conducted, with a result indicating an internal leak.  AyA’s systems and databases must contain no information from which it can be concluded that the increase originated from a change in consumption habits, an occasional activity, or seasonal consumption.In view of the foregoing, an adjustment to the bills under review is not appropriate, because they did not meet the requirements established for that purpose. Finally, it is noted that drinking-water service is billed by means of the hydrometer, which records water consumption, and that a meter-read bill may be modified only if there is a reading error or a cause attributable to the Institution, as provided in Article 97 of the Regulation for the Provision of AyA Services: “Article 97—Changes to billing. AyA may modify or correct billed consumption where there are justified grounds and an effect on consumption is verified in the following cases: i. A leak in the hydrometer and its accessories. ii. A reading showing actual accumulated consumption following consecutive estimated billings. iii. A volumetric test whose result indicates that the hydrometer is outside the permitted tolerance. iv.An effect caused by interruption of service. v. Water return due to the absence or poor condition of a one-way valve (check valve). vi. Correction of billed data. vii. Allocation of consumption. The foregoing shall comply with the policies and procedures established. When complaints are made about high consumption and there are doubts about meter operation, its accuracy may be checked by means of a volumetric test. In such cases, the meter’s accumulated reading must exceed 1000 m3. The user must pay the fee for the volumetric test, except where improper meter operation is confirmed.” (See evidence 1, Memorandum No. UEN-SCC-GAM-2026-02897). - THIRD: Accordingly, under case number CRM 1230303220, on 21 January 2026, formal notice of the resolution of the complaint regarding the December 2025 bill was sent to the email address provided by the user, ...01. The user was informed that a billing modification of ¢25,290.00 would be applied and was advised to formalize a payment arrangement to avoid suspension of service.The user was also informed that no further reductions or modifications to the disputed bills were appropriate under the Regulation for the Provision of AyA Services. An excerpt of the notice follows: FOURTH: It is important to clarify to the applicant that payments for drinking-water and sanitary-sewer services cannot be arranged or accepted at the Customer Service offices of the Costa Rican Institute of Aqueducts and Sewers, including the ICAA offices located at Dirección02, where the applicant appeared, because those offices do not have a collection cashier. Users must therefore pay their bills through any authorized collection agent of their choice. (See evidence 1, Memorandum No. UEN-SCC-GAM-2026-02897). - FIFTH: Regarding service order N° 54033992, which had an estimated resolution date of 10 April 2026, due to high demand for complaints and service orders requested on earlier dates, its resolution had to be rescheduled to 17 April 2026.The inspection then concluded that there was no damage to the Ford box (hydrometer), no damage was recorded inside the property, and the reading was correct. SIXTH: Regarding service order N°54254375, “Service disconnection,” the service was suspended on 23 April 2026 at 09:54 am, and that same day, under service order N° 54268456, a public water source was installed so the user would have access to drinking water. Subsequently, on 24 April 2026 at 08:48 am, the service was reconnected because the user had filed a formal written complaint with the Technical Studies Department, Zone 1 GAM, Commercial Directorate, UEN SEVENTH: Regarding the applicant’s request for a certificate stating that the property has a drinking-water meter, Article 15 of the Regulation for the Provision of AyA Services is relevant; it provides that the property’s service bills must be current with AyA. If the account is past due, the debt must be brought up to date before the request is approved.In light of the foregoing, it is recommended that the user formalize a payment agreement under special conditions for the outstanding debt, either digitally (with a digital signature) by email at ...02 or at any AyA service location, with a valid identity document. ACCOUNT STATEMENT (…) III. CONCLUSIONS  A Technical-Commercial-Legal study was conducted regarding the complaint about high consumption recorded from October 2025 through July 2026. It concluded that, in each billing cycle for the disputed periods, increasing and consecutive readings were recorded, which were verified by field inspections that found no leaks, no damage to the connection affecting the recorded consumption, and no reading errors.  Consumption was allocated across the periods of November and December 2025, based on an average actual consumption of 40m³, generating a credit note in the user’s favor for ¢25,290.00, which was applied to the December 2025 period.  It was determined that adjustments to the bills under review were not appropriate because they did not meet the requirements established for that purpose in Article 95 of the Regulation for the Provision of AyA Services.  On 21 January 2026, formal notice of the resolution of the complaint regarding the December 2025 bill was sent to the email address provided by the user, ...01.  Payments for drinking-water and sanitary-sewer services cannot be arranged or accepted at the ICAA offices located at Dirección02, where the applicant says she appeared, because those offices do not have a collection cashier.  On 23 April 2026, the drinking-water service was suspended, and that same day a public water source was installed so the user would have access to drinking water.Subsequently, on 24 April 2026, the service was reconnected because the user had filed a formal written complaint with AyA’s Technical Studies Department, Zone 1 GAM, Commercial Directorate, UEN Customer Service.  Regarding the applicant’s request for a certificate stating that the property has a drinking-water meter, the service under review is past due, so the debt must be brought up to date before the request is approved, all in accordance with the legal system.”
  4. 4Randall Campos Rojas, in his capacity as deputy manager of GAM Systems Management at ICAA, reports. His statement is in the terms set out above.
  5. 5The legal requirements have been observed in the proceedings.

She alleges that ICAA employees said they would send an inspector to conduct a physical review of the matter, and that the December bill would remain marked “unpaid” while the review was resolved. She recounts that on 2 February 2026 a new bill arrived for 21,611 colones. She explains that, because her disagreement persisted and the promised inspection had not been resolved, she again filed a formal complaint with the respondent institute. She states that the March 2026 bill was for a normal and customary rate. She comments that, fully willing to keep the service current, she went to the ICAA offices to pay the March bill; however, the employee who assisted her said the system blocked payment for that month because the two earlier bills remained outstanding.

She alleges that, although she explained in detail to the employee that the earlier amounts were under formal review and complaint, the institution refused to accept payment for current March consumption, stating that there was no notation regarding the two disputed bills and that she should submit a request for review of the matter so that administrative measures could be applied in light of her financial circumstances. She asserts that on 16 March 2026 she filed a complaint with ICAA under request no. 12370473. II.Facts established. The following facts, relevant to the decision in this matter, are deemed duly established:

  • a)NIS 3211088 has an outstanding debt with ICAA of 201025 colones for December 2025, as well as February, March, and July 2026. (See report submitted and evidence provided).
  • b)On an unspecified date, the applicant filed a complaint regarding the amount of the December 2025 bill. Case no. 1230303220 was assigned to that matter. (See report submitted and evidence provided).
  • c)On 21 January 2026, the applicant was formally notified of the resolution of the complaint concerning the December 2025 bill. She was informed that a billing modification of 25290 colones would be applied and was advised to formalize a payment arrangement to avoid suspension of service; she was also informed that no further reductions or modifications to the disputed bills were appropriate. (See report submitted and evidence provided).
  • d)Payments for drinking-water and sanitary-sewer services cannot be arranged or accepted at the Customer Service offices, including the ICAA offices located at Dirección02, where the applicant appeared, because those offices do not have a collection cashier. Users must therefore pay their bills through any authorized collection agent of their choice. (See report submitted and evidence provided).
  • e)Under order no. 540933992 of 17 April 2026, an inspection was conducted and it was determined that the hydrometer had no damage or leaks. (See report submitted and evidence provided).
  • f)At 9:54 a.m. on 23 April 2026, the water service was disconnected under service order no. 54254375. (See report submitted and evidence provided).
  • g)Under service order no. 54268456 of 23 April 2026, a public water source was installed so that the user would have access to drinking water. (See report submitted and evidence provided).
  • h)At 8:48 a.m. on 24 April 2026, the drinking-water service was reconnected following a complaint filed by the applicant. (See report submitted and evidence provided).
  • i)On 2 July 2026, the applicant filed this amparo application. (See digital expediente).

She explains that, because her disagreement persisted and the promised inspection had not been resolved, she again filed a formal complaint with the respondent institute. She states that the March 2026 bill was for a normal and customary rate. The record shows that NIS 3211088 has an outstanding debt with ICAA of 201025 colones for December 2025, as well as February, March, and July 2026. On an unspecified date, the applicant filed a complaint regarding the amount of the December 2025 bill. Case no. 1230303220 was assigned to that matter. On 21 January 2026, the applicant was formally notified of the resolution of the complaint concerning the December 2025 bill. She was informed that a billing modification of 25290 colones would be applied and was advised to formalize a payment arrangement to avoid suspension of service; she was also informed that no further reductions or modifications to the disputed bills were appropriate.

In addition, payments for drinking-water and sanitary-sewer services cannot be arranged or accepted at the Customer Service offices, including the ICAA offices located at Dirección02, where the applicant appeared, because those offices do not have a collection cashier. Users must therefore pay their bills through any authorized collection agent of their choice.

For its part, under order no. 540933992 of 17 April 2026, an inspection was conducted and it was determined that the hydrometer had no damage or leaks.

It is also established that, at 9:54 a.m. on 23 April 2026, the water service was disconnected under service order no. 54254375. Under service order no. 54268456 of 23 April 2026, a public water source was installed so that the user would have access to drinking water.

Finally, at 8:48 a.m. on 24 April 2026, the drinking-water service was reconnected following a complaint filed by the applicant.

In view of the foregoing, the application is dismissed.

In this regard, first, although a disconnection of the drinking-water service is established, that situation had been corrected as of 24 April 2026, well before this application was filed (2 July 2026). Moreover, it is not established that the applicant lacked the service in question when she came before the Chamber.

Furthermore, with regard to complaints about the amounts owed, it should be noted that this Court has held that the amount of a bill for drinking-water service is not disputed in this forum. This is a matter of legality that must be raised before the same administrative forum and, eventually, the ordinary courts.

Finally, the applicant asks this Chamber to order ICAA “to provide me urgently with the certificate stating that the property has drinking-water service, so I can submit it as part of the housing subsidy application, since the house is in very poor condition”; however, the Chamber is not responsible for determining, under the statutory and regulatory rules governing the matter, whether that document must be provided to the applicant, since this is a matter of mere legality. Accordingly, if she so wishes, the applicant may pursue her complaints through the administrative or ordinary judicial forum she deems appropriate.

IV.Documents submitted to the expediente. The parties are notified that any paper document, as well as any objects or evidence contained on an electronic, computer, magnetic, optical, telematic, or new-technology device that they may have submitted, must be collected from the office within a maximum period of 30 business days from notification of this judgment. Any material not collected within this period will be destroyed, pursuant to the “Regulation on the Electronic Expediente before the Judiciary,” approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011, published in Boletín Judicial no. 19 of 26 January 2012, and the resolution of the Superior Council of the Judiciary, approved in Article LXXXI of session no. 43-12 held on 3 May 2012.

Therefore:

The application is dismissed.

EV Generación de Machote: D:\Gestion-Judicial\Servidor de Archivos\MODELOS\S4SENAMH001.dpj SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .

Recurso de amparo que se tramita en expediente nro. 26-023904-0007-CO, interpuesto por Nombre02, cédula de identidad CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Resultando:

  1. 1Por escrito incorporado al expediente digital el 2 de julio de 2026, la accionante interpone recurso de amparo. Afirma que el 2 de diciembre de 2025 se le entregó un recibo por consumo de agua por un monto desproporcionado de aproximadamente 146.000 colones. Indica que interpuso un reclamo y se le aplicó una rebaja de 23.000 colones. Arguye que los funcionarios del ICAA indicaron que enviarían a un inspector para realizar la revisión física del caso, quedando ese recibo de diciembre en estado de "impagado" mientras se resolvía la revisión. Narra que el 2 de febrero de 2026 llegó un nuevo recibo por un monto de 21.611 colones. Explica que, al persistir la disconformidad y la falta de resolución de la inspección prometida, se volvió a tramitar un reclamo formal ante el instituto recurrido. Manifiesta que, en marzo de 2026, el recibo fue por una tarifa normal y habitual. Comenta que, con la total anuencia de mantener el servicio al día, acudió a las oficinas del ICAA para cancelar el recibo de marzo; sin embargo, el funcionario que la atendió indicó que el sistema bloqueaba el pago de ese mes debido a que existían los dos recibos anteriores pendientes.Aduce que, a pesar de que se le explicó detalladamente al funcionario que los montos anteriores se encontraban bajo un proceso de revisión y reclamo formal, la institución se negó a recibir el pago del consumo actual de marzo, indicando que no existía ninguna anotación sobre los dos recibos reclamados y que planteara una solicitud de revisión del caso para que aplicaran las medidas administrativas por su condición económica. Esgrime que el 16 de marzo de 2026 planteó el reclamo ante el ICAA bajo la solicitud nro.12370473. Arguye que el 20 de marzo de 2026 recibió un correo electrónico indicando que el 10 de abril siguiente llegaría un inspector a revisar el caso; empero, alega que nunca se presentó. Agrega que el 22 de abril de 2026 se apersonó en su casa un funcionario del ICAA y realizó el corte de agua. Añade que le entregó un documento que indicaba que tenía una deuda de 174.255 colones y se llevó el medidor.Relata que el 23 de abril de 2026 acudió a las oficinas del ICAA para interponer el reclamo por el corte de agua y entregar la solicitud recibida relacionada con los recibos reclamados. Señala que solicitó que le permitieran pagar el recibo pendiente para que le reconectaran el servicio de agua nuevamente. Sostiene que se pagó el recibo y, a partir de esa fecha, tiene que ir todos los meses para que le activen el pago a la factura mensual. Comenta que actualmente se encuentro tramitando un bono debido al mal estado en que se encuentra su casa, la cual pertenece a su suegra. Indica que acudió nuevamente a las oficinas del ICAA para solicitar un certificado que indique que la propiedad cuenta con medidor de agua; sin embargo, acusa que los funcionarios le indicaron que no podían emitirle el certificado debido a la deuda que la misma institución recurrida no ha podido resolverle. Solicita expresamente: “2.Como MEDIDA CAUTELAR urgente, ordenar al AyA que SE ABSTENGA de suspender o cortar el servicio de agua potable en mi vivienda mientras este recurso y la revisión de los montos se resuelven de forma definitiva ya que por mi condición económica no puedo pagarlos. 3. Ordenar al AyA que me sea entregado el certificado urgente donde indique que la propiedad cuenta con el servicio de agua potable, lo anterior para presentarlo en el trámite de Bono de vivienda, ya que la casa está en muy mal estado”.
  2. 2Mediante resolución de las 20:17 horas del 9 de junio de 2026, la Presidencia de la Sala dio curso al proceso.
  3. 3Informa María de los Ángeles Morera Calderón, en su condición de subgerenta general del Instituto Costarricense de Acueductos y Alcantarillados, en sustitución del gerente general que se encuentra incapacitado. Expone: “I. EN CUANTO A LOS HECHOS ALEGADOS POR LA RECURRENTE En atención a la situación objeto del amparo planteado por la recurrente Nombre02 contra el Instituto Costarricense de Acueductos y Alcantarillados, con fundamento en el informe técnico memorando No. UEN-SCCGAM- 2026-02897, del funcionario Javier Jiménez Rivas, de la UEN-Servicio al Cliente Comercial GAM, del 14 de julio del 2026 y sus anexos, todo lo cual se adjunta como prueba de este informe y el alcance de la norma que al efecto se regula en el Reglamento para la Prestación de los Servicios de AyA, queda debidamente acreditado que: PRIMERO: Con base en los datos del Sistema Comercial Integrado del AyA (SCIOPEN), se hace la consulta por medio del número de servicio NIS CED01 se determinó con meridiana claridad que este servicio se encuentra registrado a nombre de Nombre01, localización PRN01, con dirección: Dirección01.Dicho servicio se encuentra registrado con tarifa Metropolitana Residencial y tiene un pendiente total de ¢ 201,025.00 (Ver prueba 1 Memorando No. UEN-SCC-GAM-2026-02897). - SEGUNDO: Se realizó un estudio Técnico-Comercial-Legal, referente al reclamo por altos consumos registrados de octubre 2025 a julio 2026, procediéndose de la siguiente manera: Verificación del patrón de consumo del servicio, realizándose las siguientes revisiones de campo: De lo anterior, se concluyó que en cada ciclo de facturación de los periodos reclamados de octubre 2025 a julio 2026, se registraron lecturas ascendentes y consecutivas, las cuales como se ha indicado, fueron verificadas mediante inspecciones de campo y no se determinó que existieran daños en la conexión que afectara los consumos registrados, ni errores de lectura. Una vez verificado lo anterior, se procedió a aplicar distribución de consumos a los periodos de noviembre y diciembre 2025, a promedio de consumo real de 40m³, generando una nota de crédito a favor del usuario por ¢25,290.00, la cual se aplicó al periodo de diciembre 2025.Figura 1. Por otro lado, la política Institucional que se encuentra debidamente regulada en el reglamento de rito, en el artículo 95, regula las causas para la aplicación de hasta dos ajustes en facturas leídas consecutivas, siempre y cuando cumpla esta condición:  AyA podrá aplicar cada dieciocho (18) meses hasta dos (2) ajustes a las facturas leídas consecutivas, en servicios de uso residencial, y que el consumo facturado o a facturar sea igual o superior a los 40 metros cúbicos y supere en un 100% el consumo promedio normal de los últimos doce meses.  Que el incremento en el consumo se haya originado por la ocurrencia de fuga, donde se debe contar con una inspección previa denominada “Revisión a domicilio por medio del hidrómetro” cuyo resultado indique la existencia de fuga interna.  Que, en los sistemas y bases de datos del AyA, no conste registro de información con el cual se concluya que el incremento haya sido originado por variación en los hábitos de consumo, actividad ocasional o consumos estacionales.De conformidad con lo anteriormente expuesto, no es procedente aplicar ajuste a las facturas en estudio, debido a que las mismas no cumplieron con los requerimientos establecidos para este fin. Finalmente, se señala que la forma de cobrar el servicio de agua potable es mediante el hidrómetro, el cual registra el consumo de agua y en la facturación leída, solo se puede aplicar una modificación, si existe error de lectura o causa atribuible a la Institución, conforme lo dispone el artículo 97 del Reglamento para la Prestación de los Servicios del AyA: “Artículo 97- De las modificaciones a la facturación. AyA podrá modificar o rectificar los consumos facturados, cuando existan causas justificadas y se verifique la afectación de consumos en los siguientes supuestos: i. Fuga en el hidrómetro y sus accesorios. ii. Lectura con consumo real acumulado por facturaciones consecutivas estimadas. iii.Prueba volumétrica cuyo resultado indique que el hidrómetro está fuera de la tolerancia permitida. iv. Afectación por la no continuidad del servicio. v. Devolución de agua por ausencia o mal estado de válvula unidireccional (check). vi. Corrección de datos facturados. vii. Distribución de consumos. Lo anterior con apego a las políticas y procedimientos que se establezcan. Cuando se presenten reclamos por altos consumos y existan dudas sobre el funcionamiento del medidor, se podrá verificar la precisión a través de una prueba volumétrica. Para estos casos el registro acumulado del medidor a comprobar debe superar los 1000 m3. El pago de la tarifa de la prueba volumétrica deberá ser cancelada por el -usuario, excepto que se compruebe el mal funcionamiento del medidor.” (Ver prueba 1 Memorando No. UEN-SCC-GAM-2026-02897). - TERCERO: Así las cosas, mediante número de caso CRM 1230303220, el día 21 de enero del 2026, se procedió a notificar formalmente la resolución al reclamo interpuesto sobre la factura de diciembre 2025, al correo electrónico ofrecido por el usuario ...01, donde se le explicó que se le aplicaría una modificación a la facturación por un monto de ¢25,290.00 y se le recomendó formalizar arreglo de pago, para evitar la suspensión del servicio.Además, se le indicó que no era procedente aplicar más rebajos o modificaciones a las facturaciones reclamadas, de conformidad con el Reglamento para la Prestación de los Servicios de AyA. A continuación, un extracto de la notificación: CUARTO: Es importante aclararle a la recurrente que, en las oficinas de Atención al Cliente del Instituto Costarricense de Acueductos y Alcantarillados, como las oficinas del ICAA ubicadas en Dirección02, donde se presentó la recurrente, no es posible gestionar ni recibir pagos por los servicios brindados de agua potable y alcantarillado sanitario, ya que no se cuenta con caja recaudadora, de tal forma que los usuarios deben pagar sus facturas en cualquiera de los agentes recaudadores autorizados de su preferencia. (Ver prueba 1 Memorando No. UEN-SCC-GAM-2026-02897). - QUINTO: En referencia a la orden de servicio N° 54033992, con fecha estimada de resolución para el 10 de abril del 2026, se indica que, por problemas de alta demanda de reclamos y órdenes de servicio, solicitadas en fechas anteriores a la mencionada, debió reprogramarse su resolución para el 17 abril del 2026, en la cual se concluyó, que no hay daños en la caja Ford (hidrómetro), no se registran daños a lo interno del inmueble y la lectura está correcta.SEXTO: En referencia a la orden de servicio N°54254375 “Desconexión del servicio”, en fecha 23 de abril del 2026, se suspendió el mismo a las 09:54 am, y ese mismo día, mediante orden de servicio N° 54268456, se procedió a instalar una fuente pública, para que el usuario tenga acceso a agua potable. Posteriormente, en fecha 24 de abril del 2026, a las 08:48 am se ejecutó la reconexión del servicio, ya que el usuario presentó reclamo formal por escrito ante el Departamento de Estudios Técnicos Zona 1 GAM, Dirección Comercial UEN SETIMO: En relación con la solicitud que realizó la recurrente de un certificado que indique que la propiedad cuenta con medidor de agua potable; es relevante mencionar el artículo15 del Reglamento para la Prestación de los Servicios de AyA, que señala que las facturaciones del servicio del inmueble deberán encontrarse al día con AyA. En caso de mora, deberá normalizar la deuda, de previo a la aprobación de la solicitud.En virtud de lo anteriormente indicado, se recomienda formalizar un acuerdo de pago en condiciones especiales sobre la deuda pendiente, ya sea, de forma digital (con firma digital), al correo electrónico ...02 o en cualquiera de los puntos de atención del AyA con documento de identificación vigente. ESTADO DE CUENTA (…) III. CONCLUSIONES  Se realizó un estudio Técnico-Comercial-Legal, referente al reclamo por altos consumos registrados de octubre 2025 a julio 2026, que concluyó que en cada ciclo de facturación de los periodos reclamados, se registraron lecturas ascendentes y consecutivas, las cuales fueron verificadas mediante inspecciones de campo y no se determinó que existieran fugas, daños en la conexión que afectara los consumos registrados, ni errores de lectura.  Se procedió a aplicar distribución de consumos a los periodos de noviembre y diciembre 2025, a promedio de consumo real de 40m³, generando una nota de crédito a favor del usuario por ¢25,290.00, la cual se aplicó al periodo de diciembre 2025.  Se determinó la no procedencia de aplicar ajustes a las facturas en estudio, debido a que las mismas no cumplieron con los requerimientos establecidos para este fin, en el artículo 95 del Reglamento para la Prestación de los Servicios de AyA.  El 21 de enero del 2026, se procedió a notificar formalmente la resolución al reclamo interpuesto sobre la factura de diciembre 2025, al correo electrónico ofrecido por el usuario ...01  Las oficinas del ICAA ubicadas en Dirección02, donde dice la recurrente que se presentó, no es posible gestionar ni recibir pagos por los servicios brindados de agua potable y alcantarillado sanitario, ya que no se cuenta con caja recaudadora.  En fecha 23 de abril del 2026, se suspendió el servicio de agua potable y ese mismo día, se procedió a instalar una fuente pública, para que la usuaria tenga acceso a agua potable.Posteriormente, en fecha 24 de abril del 2026, se ejecutó la reconexión del servicio, ya que la usuaria presentó reclamo formal por escrito ante el Departamento de Estudios Técnicos Zona 1 GAM, Dirección Comercial UEN Servicio al Cliente de AyA.  En relación con la solicitud que realizó la recurrente de un certificado que indique que la propiedad cuenta con medidor de agua potable; el servicio bajo análisis se encuentra en mora, por lo que deberá normalizar la deuda, previo a la aprobación de la solicitud, todo de conformidad con el ordenamiento jurídico”.
  4. 4Informa Randall Campos Rojas, en su condición de subgerente de Gestión de Sistemas GAM del ICAA. Se expresa en los términos antedichos.
  5. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I.Objeto del recurso. La recurrente indica que el 2 de diciembre de 2025 se le entregó un recibo por consumo de agua por un monto desproporcionado de aproximadamente 146.000 colones. Indica que interpuso un reclamo y se le aplicó una rebaja de 23.000 colones. Arguye que los funcionarios del ICAA indicaron que enviarían a un inspector para realizar la revisión física del caso, quedando ese recibo de diciembre en estado de "impagado" mientras se resolvía la revisión. Narra que el 2 de febrero de 2026 llegó un nuevo recibo por un monto de 21.611 colones. Explica que, al persistir la disconformidad y la falta de resolución de la inspección prometida, se volvió a tramitar un reclamo formal ante el instituto recurrido. Manifiesta que, en marzo de 2026, el recibo fue por una tarifa normal y habitual. Comenta que, con la total anuencia de mantener el servicio al día, acudió a las oficinas del ICAA para cancelar el recibo de marzo; sin embargo, el funcionario que la atendió indicó que el sistema bloqueaba el pago de ese mes debido a que existían los dos recibos anteriores pendientes.

Aduce que, a pesar de que se le explicó detalladamente al funcionario que los montos anteriores se encontraban bajo un proceso de revisión y reclamo formal, la institución se negó a recibir el pago del consumo actual de marzo, indicando que no existía ninguna anotación sobre los dos recibos reclamados y que planteara una solicitud de revisión del caso para que aplicaran las medidas administrativas por su condición económica. Esgrime que el 16 de marzo de 2026 planteó el reclamo ante el ICAA bajo la solicitud nro.12370473. Arguye que el 20 de marzo de 2026 recibió un correo electrónico indicando que el 10 de abril siguiente llegaría un inspector a revisar el caso; empero, alega que nunca se presentó. Agrega que el 22 de abril de 2026 se apersonó en su casa un funcionario del ICAA y realizó el corte de agua. Añade que le entregó un documento que indicaba que tenía una deuda de 174.255 colones y se llevó el medidor.

Relata que el 23 de abril de 2026 acudió a las oficinas del ICAA para interponer el reclamo por el corte de agua y entregar la solicitud recibida relacionada con los recibos reclamados. Señala que solicitó que le permitieran pagar el recibo pendiente para que le reconectaran el servicio de agua nuevamente. Sostiene que se pagó el recibo y, a partir de esa fecha, tiene que ir todos los meses para que le activen el pago a la factura mensual. Comenta que actualmente se encuentro tramitando un bono debido al mal estado en que se encuentra su casa, la cual pertenece a su suegra. Indica que acudió nuevamente a las oficinas del ICAA para solicitar un certificado que indique que la propiedad cuenta con medidor de agua; sin embargo, acusa que los funcionarios le indicaron que no podían emitirle el certificado debido a la deuda que la misma institución recurrida no ha podido resolverle. Solicita expresamente: “2.

Como MEDIDA CAUTELAR urgente, ordenar al AyA que SE ABSTENGA de suspender o cortar el servicio de agua potable en mi vivienda mientras este recurso y la revisión de los montos se resuelven de forma definitiva ya que por mi condición económica no puedo pagarlos. 3. Ordenar al AyA que me sea entregado el certificado urgente donde indique que la propiedad cuenta con el servicio de agua potable, lo anterior para presentarlo en el trámite de Bono de vivienda, ya que la casa está en muy mal estado”.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El NIS 3211088 tiene una deuda pendiente con el ICAA correspondiente a 201025 colones, por los meses de diciembre de 2025, así como febrero, marzo y julio de 2026. (Ver informe rendido y prueba aportada).
  • b)En fecha indeterminada, la accionante planteó un reclamo por el monto de la factura de diciembre de 2025. A tal gestión se le asignó el caso nro. 1230303220. (Ver informe rendido y prueba aportada).
  • c)El 21 de enero de 2026, a la tutelada se le notificó formalmente la resolución del reclamo relativo a la factura de diciembre de 2025, donde se le explicó que se le aplicaría una modificación a la facturación por un monto de 25290 colones y se le recomendó formalizar un arreglo de pago, para evitar la suspensión del servicio; además, se le indicó que no era procedente aplicar más rebajos o modificaciones a las facturaciones reclamadas. (Ver informe rendido y prueba aportada).
  • d)En las oficinas de Atención al Cliente como las oficinas del ICAA ubicadas en Dirección02, donde se apersonó la recurrente, no es posible gestionar ni recibir pagos por los servicios brindados de agua potable y alcantarillado sanitario, ya que no se cuenta con caja recaudadora, de tal forma que los usuarios deben pagar sus facturas en cualquiera de los agentes recaudadores autorizados de su preferencia. (Ver informe rendido y prueba aportada).
  • e)Mediante orden nro. 540933992 del 17 de abril de 2026, se realizó la inspección y se determinó que el hidrómetro no registra daños ni fugas. (Ver informe rendido y prueba aportada).
  • f)A las 9:54 horas del 23 de abril de 2026, mediante la orden de servicio nro. 54254375, se realizó la desconexión del servicio de agua. (Ver informe rendido y prueba aportada).
  • g)Mediante orden de servicio nro. 54268456 del 23 de abril de 2026, se realizó la instalación de una fuente pública, a los efectos de que la usuaria tuviera acceso a agua potable. (Ver informe rendido y prueba aportada).
  • h)A las 8:48 horas del 24 de abril de 2026, debido a un reclamo planteado por la accionante, se reconectó el servicio de agua potable. (Ver informe rendido y prueba aportada).
  • i)El 2 de julio de 2026, la tutelada planteo este recurso de amparo. (Ver expediente digital).

III.Sobre el caso concreto. En el sub lite, la recurrente indica que el 2 de diciembre de 2025 se le entregó un recibo por consumo de agua por un monto desproporcionado de aproximadamente 146.000 colones. Indica que interpuso un reclamo y se le aplicó una rebaja de 23.000 colones. Arguye que los funcionarios del ICAA indicaron que enviarían a un inspector para realizar la revisión física del caso, quedando ese recibo de diciembre en estado de "impagado" mientras se resolvía la revisión. Narra que el 2 de febrero de 2026 llegó un nuevo recibo por un monto de 21.611 colones. Explica que, al persistir la disconformidad y la falta de resolución de la inspección prometida, se volvió a tramitar un reclamo formal ante el instituto recurrido. Manifiesta que, en marzo de 2026, el recibo fue por una tarifa normal y habitual. Sostiene que se pagó el recibo y, a partir de esa fecha, tiene que ir todos los meses para que le activen el pago a la factura mensual. Comenta que actualmente se encuentro tramitando un bono debido al mal estado en que se encuentra su casa, la cual pertenece a su suegra. Indica que acudió nuevamente a las oficinas del ICAA para solicitar un certificado que indique que la propiedad cuenta con medidor de agua; sin embargo, acusa que los funcionarios le indicaron que no podían emitirle el certificado debido a la deuda que la misma institución recurrida no ha podido resolverle. Solicita expresamente: “2.

Como MEDIDA CAUTELAR urgente, ordenar al AyA que SE ABSTENGA de suspender o cortar el servicio de agua potable en mi vivienda mientras este recurso y la revisión de los montos se resuelven de forma definitiva ya que por mi condición económica no puedo pagarlos. 3. Ordenar al AyA que me sea entregado el certificado urgente donde indique que la propiedad cuenta con el servicio de agua potable, lo anterior para presentarlo en el trámite de Bono de vivienda, ya que la casa está en muy mal estado”.

De los autos se desprende que el NIS 3211088 tiene una deuda pendiente con el ICAA correspondiente a 201025 colones, por los meses de diciembre de 2025, así como febrero, marzo y julio de 2026. En fecha indeterminada, la accionante planteó un reclamo por el monto de la factura de diciembre de 2025. A tal gestión se le asignó el caso nro. 1230303220. El 21 de enero de 2026, a la tutelada se le notificó formalmente la resolución del reclamo relativo a la factura de diciembre de 2025, donde se le explicó que se le aplicaría una modificación a la facturación por un monto de 25290 colones y se le recomendó formalizar un arreglo de pago, para evitar la suspensión del servicio; además, se le indicó que no era procedente aplicar más rebajos o modificaciones a las facturaciones reclamadas.

Además, en las oficinas de Atención al Cliente como las oficinas del ICAA ubicadas en Dirección02, donde se apersonó la recurrente, no es posible gestionar ni recibir pagos por los servicios brindados de agua potable y alcantarillado sanitario, ya que no se cuenta con caja recaudadora, de tal forma que los usuarios deben pagar sus facturas en cualquiera de los agentes recaudadores autorizados de su preferencia.

Por su parte, mediante orden nro. 540933992 del 17 de abril de 2026, se realizó la inspección y se determinó que el hidrómetro no registra daños ni fugas.

Otrosí, se constata que, a las 9:54 horas del 23 de abril de 2026, mediante la orden de servicio nro. 54254375, se realizó la desconexión del servicio de agua. Mediante orden de servicio nro. 54268456 del 23 de abril de 2026, se realizó la instalación de una fuente pública, a los efectos de que la usuaria tuviera acceso a agua potable.

Finalmente, a las 8:48 horas del 24 de abril de 2026, debido a un reclamo planteado por la accionante, se reconectó el servicio de agua potable.

Desde este panorama, se declara sin lugar el recurso.

En este sentido, en primer lugar, nótese que, si bien se constata una desconexión del servicio de agua potable, tal situación fue corregida desde el 24 de abril de 2026, sea, con sobrada antelación a la interposición de este recurso (2 de julio de 2026). Además, no se constata que, al momento en que la amparada acudió a la Sala, no contara con el servicio en cuestión.

Aunado a ello, sobre los reclamos por las sumas adeudadas, debe advertirse que este Tribunal ha resuelto que no es en esta sede donde se discute sobre el monto de un recibo por la prestación del servicio de agua potable. Pues se trata de una cuestión de legalidad que debe plantearse en la misma sede administrativa y, eventualmente, jurisdiccional ordinaria.

Por último, la accionante solicita que esta Sala le ordene al ICAA “que me sea entregado el certificado urgente donde indique que la propiedad cuenta con el servicio de agua potable, lo anterior para presentarlo en el trámite de Bono de vivienda, ya que la casa está en muy mal estado”; empero, se advierte que no le compete a la Sala determinar, según la normativa infraconstitucional que rige la materia, si tal documento le debe ser brindado o no a la tutelada, pues ello obedece a un extremo de mera legalidad. De ahí que, si a bien lo tiene, la gestionante podrá plantear sus reclamos en la vía administrativa o jurisdiccional ordinaria que estime procedente.

IV.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.

Por tanto:

Se declara sin lugar el recurso.
