Background:

  1. 1By a written submission added to the case file on 7 June 2026, the applicant files an amparo proceeding. The applicant states that the persons protected by the amparo live in the maritime-terrestrial zone (zona marítimo terrestre) of Playa Agujas, Tárcoles district, Garabito canton, Puntarenas province. The applicant notes that the applicant’s clients are older adults who earn their living from fishing, as well as minors. The applicant states that, by judgment no. 2026010043 of 9:20 a.m. on 20 March 2026, issued in amparo proceeding no. 26-002780-0007-CO, the Constitutional Chamber ordered the Municipality of Garabito not to carry out, permit, or tolerate physical actions aimed at evicting, demolishing, or removing families located in the maritime-terrestrial zone without first completing real, comprehensive, and effective interinstitutional coordination and adopting specific measures to protect fundamental rights.The applicant complains that the local government issued letter AME-152-2026-FGM dated 29 May 2026, addressed to ASADAS Garabito, the Costa Rican Institute of Aqueducts and Sewers (ICAA) in Jacó, and the Costa Rican Electricity Institute (ICE) in Garabito. The applicant states that, through that document, the municipal administration informed those institutions that it “will proceed” to eliminate service structures, including meters and electrical connections, located in the maritime-terrestrial zone, protection areas, public zones, cantonal roads, or national roads. The applicant argues that the wording of the municipal letter constitutes notice of execution, rather than an interinstitutional coordination measure, and is therefore contrary to what the Constitutional Court decided. The applicant explains that letter AME-152-2026-FGM did not identify the people who might be affected or the homes to which the measure would apply, did not specify execution dates, and did not distinguish between homes occupied by older adults and homes where minors live.The applicant disputes that any prior assessment of the particular circumstances of those living in the maritime-terrestrial zone of Garabito was documented. The applicant states that the persons protected by the amparo have not been individually notified by the Municipality of Garabito of any order, decision, proceeding, or specific action to remove meters, eliminate connections, suspend basic services, or intervene in the service structures connected to their homes. The applicant details that the applicant’s clients also have not been notified by ICE, ICAA, or the Quebrada Ganado ASADA of any request, coordination, authorization, schedule, or measure related to the suspension, disruption, or elimination of basic services at their homes. The applicant states that eliminating meters, electrical connections, or service structures in the area where the persons protected by the amparo live threatens and compromises their health, hygiene, food, safety, ability to preserve medications, communication, and minimum conditions for a dignified life.The applicant maintains that the announced municipal action places the affected people in a state of helplessness or makes it impossible for them to remain in their homes. The applicant considers that the foregoing violates the fundamental rights of the applicant’s clients. The applicant requests that the amparo be granted.
  2. 2By order issued at 3:35 p.m. on 19 June 2026, the President of the Chamber admitted the proceeding and requested a report from the mayor of the Municipality of Garabito, the administrator of ICAA’s Garabito cantonal office, and the coordinator of ICE’s integrated Jacó agency.
  3. 3In a written submission added to the case file on 25 June 2026, Alejandro Hidalgo Arias, acting coordinator of ICE’s Garabito Agency, reports: “FIRST: By email received on 1 June 2026 in the institutional email inbox of Andrea Vargas León, Coordinator of the ICE Jacó Agency, letter AME-152-2026-FGM, dated 29 May 2026, sent by the Municipality of Garabito, was received. SECOND: On that same date, Ms. Vargas León forwarded the aforementioned letter to Nombre05, Subregion Coordinator, and Luis Pablo García Ureña, Zone Supervisor, copying Nombre07, Regional Chief, for their information and technical assessment. THIRD: On 2 June 2026, Nombre07 again forwarded the communication to Nombre05, requesting preparation of a plan to verify and potentially remove infrastructure, in response to what the Municipality of Garabito had set out in the cited letter. FOURTH: In a reply dated 3 June 2026, Nombre05 indicated that no plan had previously been established to address the described situation because the technical unit had no prior knowledge of the facts reported by the Municipality.He also stated that a joint visit with municipal representatives would be arranged to identify any services or customers that might be in the stated situation. However, as of the date of this report, that inspection has not taken place. FIFTH: Later, upon making the relevant inquiries with the Municipality of Garabito, ICE was informed that letter AME-152-2026-FGM was merely informational and that its content was not intended to request disconnection of meters or suspension of electrical services in the referenced area. Consequently, since no order, decision, or request issued by a competent authority instructs ICE to disconnect electrical services in the stated area, it was determined that no action concerning existing supplies should be pursued, and the matter was closed because no further administrative action was warranted. ANALYSIS OF THE CASE In light of the facts set out, the participation of the Costa Rican Electricity Institute was limited exclusively to receipt and internal processing of letter No. AME152-2026-FGM sent by the Municipality of Garabito, as well as the administrative steps necessary to determine its scope and content.The inquiries conducted established that the document was merely informational and contained no request directed to ICE to disconnect electrical services or carry out measures that might affect the legal interests of the persons subject to administration. It was also established that the institution has issued no administrative act, order, instruction, or physical action aimed at suspending services, removing infrastructure, or otherwise affecting the applicant’s rights. Rather, the steps taken were confined to verifying the content of the communication received and internally coordinating its review, without adopting any decision with effects on third parties. Accordingly, any disagreement the applicant may have concerning actions, decisions, or intentions of the Municipality of Garabito must be raised with that entity, as it issued the communication in question and is the only authority connected to the facts underlying the complaint.Consequently, there is no causal link between the conduct attributed to ICE and the alleged violation of fundamental rights. For the foregoing reasons, no action or omission attributable to ICE capable of violating fundamental rights has been established; therefore, this institution lacks passive standing with respect to the claims made in this amparo proceeding, since it neither participated in the reported events nor took any action capable of causing the alleged harm.”
  4. 4In a written submission added to the case file on 26 June 2026, Francisco José González Madrigal, mayor of the Municipality of Garabito, reports: “FIRST: Costa Rican legislation gives municipalities the duty to administer and regulate conservation areas, public roads, and the maritime-terrestrial zone. Accordingly, as an administrative authority, the Municipality of Garabito issues a series of provisions to ensure the proper use of these areas in strict compliance with the legal framework. SECOND: Letter AME-152-2026-FGM dated 29 May 2026 was not issued in isolation, since it was issued together with letter DA-CSTCCCI-ATACI-EXT-014-2026-LDOQ. Both are submitted with this document and are directed toward a series of proposals coordinated with other public institutions responsible for protecting the rights of citizens living in these areas. THIRD: As a result of these initiatives, a working group was coordinated among local government entities and other institutions involved, such as: Delegated Services Audit Office, Communal Systems Management Deputy General Management, Communal Systems Legal Counsel, Municipal Legal Counsel, Regulatory Authority and Framework, ASADAS Management Unit, AyA Jacó Agency Administration, Costa Rican Institute of Aqueducts and Sewers, Telecommunications Management, Electricity Management, ICE Garabito Agency Administration, Costa Rican Electricity Institute, administrators of the ASADAS of Garabito Canton, Internet and Fiber Optic Service Providers.At that working group, the relevant inquiries and prior assessments were conducted in accordance with the basic mechanisms of due process. FOURTH: Thus, in strict compliance with resolution No. 2026010043, in case No. 26-002780-0007-CO, issued by the Constitutional Chamber, this local government is carrying out all administrative acts permitted by the principle of legality to ensure real, comprehensive, and effective interinstitutional coordination, and adopting specific measures to protect fundamental rights in harmony with the rules governing the public assets it administers. FIFTH: As another matter, this administration has at no time intended to restrict the public’s access to the basic services to which they are entitled, provided that those services do not conflict with the provisions established for areas in which the legal order itself imposes restrictions. This is the case, for example, in the public area comprising the maritime-terrestrial zone.This administration, in coordination with the relevant public entities, will be responsible for clarifying the conditions under which the inhabitants of the territories mentioned in the amparo proceeding receive services. SIXTH: As mentioned and shown by the submitted letters, interinstitutional coordination is already underway to clarify and define the actual situation of the inhabitants of public areas and the basic services they receive. SEVENTH: As for the other facts mentioned in the amparo proceeding, they concern situations and stages that this process has not yet reached, since the initiative is very recent and coordination with the other institutions is still underway to clarify the procedures to follow for identifying the areas of intervention. The same applies to the notifications mentioned by the institutions. PRECAUTIONARY MEASURE (NO RISK FROM DELAY) As for the request for a precautionary measure, it is clear that there is no imminent serious harm in relation to the formalities of the coordination process that has just begun with the other institutions.The applicants have not established any risk of harm, much less any concrete harm, in relation to the initiative described here. In that regard, the Constitutional Chamber has been clear about the nature of precautionary measures in this field, which must be used as an instrument to guarantee continuity of the process and prevent violations of rights (Voto Nº 7190-1994, of 3:24 p.m. on 6 December; Voto Nº 6224-2005, of 3:16 p.m. on 25 May 2005). I therefore request that the requested precautionary measure not be considered on the presumption of an alleged harm that the applicants’ legal representative has not demonstrated at any time.”
  5. 5The legal requirements have been observed in the proceedings.

Justice Rueda Leal drafts this judgment; and, Reasons:

I. SUBJECT OF THE AMPARO

The applicant states that the persons protected by the amparo live in the maritime-terrestrial zone of Playa Agujas, in Garabito canton. The applicant explains that, in judgment no. 2026010043 of 9:20 a.m. on 20 March 2026, the Chamber ordered the respondent municipality “not to carry out, permit, or tolerate physical actions aimed at evicting, demolishing, or removing families located in the maritime-terrestrial zone without first completing real, comprehensive, and effective interinstitutional coordination and adopting specific measures to protect fundamental rights.” However, the applicant explains that the respondent local government issued letter no. AME-152-2026-FGM dated 29 May 2026, addressed to ASADAS Garabito, ICAA, and ICE, informing those agencies that the municipality would eliminate service structures, including meters and electrical connections located in those areas. The applicant considers the letter to be notice of execution, which the applicant considers contrary to what the Chamber decided. The applicant states that eliminating meters, electrical connections, or service structures in the area where the persons protected by the amparo live threatens and compromises their health, hygiene, food, safety, ability to preserve medications, communication, and minimum conditions for a dignified life.

II. FACTS PROVEN

The following facts relevant to deciding this matter are deemed duly established, either because they have been proven or because the respondent authority did not address them, as required in the initial order:

  • a)By letter no. DA-CSTCCCI-ATACI-EXT-014-2026-LDOQ dated 19 May 2026, addressed to ICAA and ICE authorities, the respondent municipality stated: “Subject: Invitation to a meeting on public services in public areas administered by the Municipality of Garabito. In response to the instructions and delegation conferred by the Mayor of the Municipality of Garabito through Administrative Resolution No. RAM-033-2026-FGM, in the exercise of his powers of administrative direction and organization, I hereby state the following: By this letter, you are cordially invited to an in-person meeting to be held on Friday, 29 May 2026, at 10:00 a.m., in the Meeting Room of the Municipal Council of Garabito. The purpose of this meeting is to create a forum for interinstitutional coordination and collaboration concerning the various public services currently provided, developed, maintained, or supported by infrastructure installed in public areas administered by the Municipality of Garabito. This is in view of the importance of strengthening technical and administrative coordination mechanisms relating to essential services connected with the supply of drinking water, electricity, telecommunications, connectivity, internet, networks, facilities, and other infrastructure of public interest located within cantonal public spaces. It is also intended to address matters relating to the management, use, intervention, planning, and organization of those public areas, seeking appropriate institutional coordination among public entities, ASADAS, and service providers, for the benefit of the cantonal public interest and the communities of Garabito canton. Please confirm the participation of a representative of each institution, entity, ASADA, or provider invited.” (Documentary evidence).
  • b)By letter no. AME-152-2026-FGM dated 29 May 2026, addressed to ICAA, ICE, and Asadas Garabito, the respondent municipality stated: “I am writing to greet you and also to inform you that, according to the work schedules for the different areas of the canton, this administration will proceed to eliminate all types of service structures (meters and electrical connections) located in the Maritime-Terrestrial Zone, protection areas, public areas of cantonal or national roads, all in accordance with the legal order.” (Documentary evidence).
  • c)The municipality is coordinating with the relevant institutions “to clarify what procedures should be followed for identifying the areas of intervention.” (Report of the respondent authority).
  • d)In response to an inquiry from ICE to the municipality concerning letter no. AME-152-2026-FGM, the local government explained to the institute that the letter “was merely informational and its content was not intended to request disconnection of meters or suspension of electrical services in the referenced area.” (Report of the respondent authority).

III. FACT NOT PROVEN

It is deemed not proven, as relevant to deciding this matter, that the respondent local government eliminated public service connections in the area where the persons protected by the amparo live.

VI. THE SPECIFIC CASE

In this case, the applicant states that the persons protected by the amparo live in the maritime-terrestrial zone of Playa Agujas, in Garabito canton. The applicant explains that, in judgment no. 2026010043 of 9:20 a.m. on 20 March 2026, the Chamber ordered the respondent municipality “not to carry out, permit, or tolerate physical actions aimed at evicting, demolishing, or removing families located in the maritime-terrestrial zone without first completing real, comprehensive, and effective interinstitutional coordination and adopting specific measures to protect fundamental rights.” However, the applicant explains that the respondent local government issued letter no. AME-152-2026-FGM dated 29 May 2026, addressed to ASADAS Garabito, ICAA, and ICE, informing those agencies that the municipality would eliminate service structures, including meters and electrical connections located in those areas. The applicant considers the letter to be notice of execution, which the applicant considers contrary to what the Chamber decided. The applicant states that eliminating meters, electrical connections, or service structures in the area where the persons protected by the amparo live threatens and compromises their health, hygiene, food, safety, ability to preserve medications, communication, and minimum conditions for a dignified life.

A review of the case file establishes that, by letter no. DA-CSTCCCI-ATACI-EXT-014-2026-LDOQ dated 19 May 2026, addressed to ICAA and ICE authorities, the respondent municipality stated: “Subject: Invitation to a meeting on public services in public areas administered by the Municipality of Garabito. In response to the instructions and delegation conferred by the Mayor of the Municipality of Garabito through Administrative Resolution No. RAM-033-2026-FGM, in the exercise of his powers of administrative direction and organization, I hereby state the following: By this letter, you are cordially invited to an in-person meeting to be held on Friday, 29 May 2026, at 10:00 a.m., in the Meeting Room of the Municipal Council of Garabito. AME-152-2026-FGM, the local government explained to the institute that the letter “was merely informational and its content was not intended to request disconnection of meters or suspension of electrical services in the referenced area.” On this basis, prima facie, no situation warranting intervention by this constitutional jurisdiction is established.

In this regard, contrary to the applicant’s allegations, it has not been established that, when the amparo was filed, the municipality had taken any action to eliminate public service connections in the area where the persons protected by the amparo live. In this respect, the respondent local government explains that the letter cited by the applicant (AME-152-2026-FGM), as well as letter no. DA-CSTCCCI-ATACI-EXT-014-2026-LDOQ dated 19 May 2026, are confined to actions in the coordination phase with the relevant institutions “to clarify what procedures should be followed for identifying the areas of intervention.” Specifically, in response to an inquiry from ICE, the municipality explained to that institute that the letter in question “was merely informational and its content was not intended to request disconnection of meters or suspension of electrical services in the referenced area.” In view of the foregoing, no current situation warranting the intervention of this Constitutional Court has been established.

Finally, it should be noted that if the applicant considers that there has been a specific failure to comply with any part of this Court’s judgment no. 2026010043 of 9:20 a.m. on 20 March 2026, the proper course is to submit the arguments the applicant considers relevant in that specific case file, so that the appropriate determination can be made in the enforcement proceeding.

Accordingly, the amparo is denied.

V. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper document, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them within a maximum period of 30 working days from notification of this judgment. Any material not collected within that period will be destroyed pursuant to the “Regulations on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary of 3 May 2012.

Therefore:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .

Recurso de amparo que se tramita en el expediente nro. 26-020378-0007-CO, interpuesto por Nombre02, cédula de identidad CED01, a favor de Nombre03, cédula de identidad CED02, Nombre04, cédula de identidad CED03, Nombre06, cédula de identidad CED04 y Nombre01, cédula de identidad CED05, contra la MUNICIPALIDAD DE GARABITO.

Resultando:

  1. 1Por escrito incorporado al expediente el 7 de junio de 2026, el recurrente interpone recurso de amparo. Manifiesta que los amparados habitan en la zona marítimo terrestre de Playa Agujas, distrito Tárcoles, cantón Garabito, provincia de Puntarenas. Acota que sus representados son personas adultas mayores que viven de la pesca, así como personas menores de edad. Señala que la Sala Constitucional, mediante resolución nro. 2026010043 de las 9:20 horas del 20 de marzo de 2026, dictada en el recurso de amparo nro. 26- 002780-0007-CO, ordenó a la Municipalidad de Garabito no ejecutar, permitir ni tolerar actuaciones materiales orientadas al desalojo, demolición o remoción de familias ubicadas en zona marítimo terrestre, sin haber cumplido previamente con una coordinación interinstitucional real, completa y eficaz, y sin haber adoptado medidas concretas de protección de derechos fundamentales. Reclama el referido gobierno local emitió el oficio AME-152-2026-FGM de fecha 29 de mayo de 2026, dirigido a ASADAS Garabito, Instituto Costarricense de Acueductos y Alcantarillados (ICAA) de Jacó e Instituto Costarricense de Electricidad (ICE) de Garabito.Comenta que por medio de ese documento, la administración municipal comunicó a dichas instituciones “va a proceder” a eliminar estructuras de servicios, incluyendo medidores y conexiones eléctricas, ubicadas en zona marítimo terrestre, áreas de protección, zonas públicas, vías cantonales o vías nacionales. Arguye que la forma en la que se redactó el oficio municipal constituye un aviso de ejecución y no una gestión de coordinación interinstitucional, lo cual deviene contrario a lo resuelto por el Tribunal Constitucional. Expone que el oficio AME-152-2026-FGM no individualizó a las personas que podrían resultar afectadas ni las viviendas sobre las cuales recaería la medida, no precisó fechas de ejecución ni distinguió entre viviendas habitadas por personas adultas mayores y casas donde residen personas menores de edad. Discute que tampoco se acreditó una valoración previa de la situación particular de quienes viven en la zona marítimo terrestre de Garabito.Señala que los tutelados no han sido notificados individualmente por la Municipalidad de Garabito sobre la existencia de una orden, resolución, procedimiento o actuación concreta dirigida a retirar medidores, eliminar conexiones, suspender servicios básicos o intervenir las estructuras de servicios vinculadas a sus viviendas. Detalla que sus defendidos tampoco han sido notificados por el ICE, por el ICAA ni por la ASADA de Quebrada Ganado, sobre la existencia de alguna solicitud, coordinación, autorización, programación o medida relacionada con la suspensión, afectación o eliminación de los servicios básicos en sus viviendas. Expresa que la eliminación de medidores, conexiones eléctricas o estructuras de servicios en el sector donde habitan los amparados amenaza y compromete la salud, higiene, alimentación, seguridad, conservación de medicamentos, comunicación y condiciones mínimas de vida digna de los amparados.Sostiene que la actuación municipal anunciada coloca a las personas afectadas en una condición de desamparo o de imposibilidad real de permanecer en sus viviendas. Estima que lo expuesto conculca los derechos fundamentales de sus patrocinados. Solicita que se declare con lugar el recurso.
  2. 2Mediante resolución de las 15:35 horas de 19 de junio de 2026, la Presidencia de la Sala le dio curso al proceso y le solicitó informe al alcalde de la Municipalidad de Garabito, al administrador de la oficina cantonal de Garabito del ICAA, y al coordinador de la agencia integrada de Jacó del ICE.
  3. 3Por escrito incorporado al expediente el 25 de junio de 2026, Alejandro Hidalgo Arias, coordinador a. i. de la Agencia de Garabito del ICE, informa: “PRIMERO: Mediante correo electrónico recibido el 1 de junio de 2026 en el buzón de correo institucional de la señora Andrea Vargas León, Coordinadora de la Agencia ICE Jacó, se recibió la nota AME-152-2026-FGM, de fecha 29 de mayo de 2026, remitida por la Municipalidad de Garabito. SEGUNDO: En esa misma fecha, la señora Vargas León trasladó la referida nota a los señores Nombre05, Coordinador de Subregión, y Luis Pablo García Ureña, Supervisor de Zona, con copia al señor Nombre07, Jefe Regional, para su conocimiento y valoración técnica. TERCERO: El 2 de junio de 2026, el señor Nombre07 remitió nuevamente la comunicación al señor Nombre05, solicitándole la elaboración de un plan de verificación y eventual retiro de infraestructura, en atención a lo expuesto por la Municipalidad de Garabito en la nota indicada.CUARTO: Mediante respuesta de fecha 3 de junio de 2026, el señor Nombre05 indicó que no existía un plan previamente definido para atender la situación descrita, por cuanto la dependencia técnica no tenía conocimiento previo de los hechos señalados por la Municipalidad. Asimismo, manifestó que se gestionaría una visita conjunta con representantes municipales para identificar los eventuales servicios o clientes que pudieran encontrarse en la condición indicada. No obstante, a la fecha del presente informe, dicha inspección no se ha realizado. QUINTO: Posteriormente, al efectuarse las consultas correspondientes con la Municipalidad de Garabito, se informó que la nota AME-152-2026-FGM tenía un carácter meramente informativo y que su contenido no pretendía solicitar la desconexión de medidores ni la suspensión de servicios eléctricos en el sector referido. En consecuencia, al no existir orden, resolución o requerimiento emitido por autoridad competente que instruya al ICE a proceder con la desconexión de servicios eléctricos en la zona indicada, se determinó que no corresponde gestionar actuación alguna sobre los suministros existentes, disponiéndose el archivo de las diligencias por carecer de objeto administrativo adicional.ANALISIS DEL CASO A la luz de los hechos expuestos, se desprende que la participación del Instituto Costarricense de Electricidad se limitó exclusivamente a la recepción y tramitación interna de la nota N.° AME152-2026-FGM remitida por la Municipalidad de Garabito, así como a las gestiones administrativas necesarias para determinar su alcance y contenido. De las diligencias realizadas se constató que dicho documento tenía carácter meramente informativo y que no contenía solicitud alguna dirigida al ICE para proceder con la desconexión de servicios eléctricos o la ejecución de medidas que pudieran afectar la esfera jurídica de los administrados. Asimismo, quedó acreditado que la institución no ha emitido acto administrativo, orden, instrucción o actuación material tendiente a suspender servicios, retirar infraestructura o afectar de cualquier forma los derechos del recurrente. Por el contrario, las gestiones efectuadas se circunscribieron a verificar el contenido de la comunicación recibida y a coordinar internamente su análisis, sin que ello implicara la adopción de decisión alguna con efectos sobre terceros.En este sentido, cualquier inconformidad que el recurrente mantenga respecto de actuaciones, decisiones o pretensiones de la Municipalidad de Garabito debe ser planteada ante dicha entidad, por ser la autoridad que emitió la comunicación en cuestión y la única vinculada con los hechos que motivan el reclamo. En consecuencia, no existe nexo causal entre la conducta atribuida al ICE y la supuesta lesión de derechos fundamentales alegada. Por lo anterior, no se configura ninguna acción u omisión imputable al ICE capaz de generar una vulneración de derechos fundamentales, razón por la cual esta institución carece de legitimación pasiva respecto de las pretensiones formuladas en el presente recurso, al no haber participado en los hechos que se denuncian ni haber desplegado actuación alguna susceptible de causar la afectación alegada.”.
  4. 4Por escrito incorporado al expediente el 26 de junio de 2026, Francisco José González Madrigal, alcalde de la Municipalidad de Garabito, informa: “PRIMERO: Que la normativa costarricense otorga a las municipalidades el deber de administrar y regular las áreas de conservación, vías publicas y zona marítima terrestre, en este sentido como autoridad administrativa la Municipalidad de Garabito emite una serie de disposiciones para garantizar el uso adecuado de estas zonas en estricto apego al marco legal. SEGUNDO: El oficio AME-152-2026-FGM de fecha 29 de mayo de 2026, no es un documento que se emitió de forma aislada ya que se hizo conjuntamente con el oficio DA-CSTCCCI-ATACI-EXT-014-2026-LDOQ, los cuales se aportan en este documento y que van orientadas hacia una serie de propuestas coordinadas con otras instituciones públicas encargadas de tutelar los derechos de los ciudadanos que habitan en estas zonas.TERCERO: Como resultado de estas iniciativas, se coordinó una mesa de trabajo entre entidades del gobierno local y demás instituciones involucradas, tales como: Auditoria de Servicios Delegados, Subgerencia Gestión de Sistemas Comunales, Asesoría Legal Sistemas Comunales Asesoría Legal Municipal, Rectoría y Marco Regulatorio, UEN Gestión de ASADAS, Administración Agencia AyA Jacó, Instituto Costarricense de Acueductos y Alcantarillados, Gerencia de Telecomunicaciones, Gerencia de Electricidad Administración Agencia ICE Garabito, Instituto Costarricense de Electricidad, Administradores ASADAS del Cantón de Garabito, Proveedores de Servicios de Internet y Fibra Óptica; en dicha mesa de trabajo se hicieron las consultas pertinentes y las valoraciones previas según lo establecido en los mecanismos básicos del debido proceso. CUARTO: Así las cosas y en estricto apego a la resolución Nº 2026010043, del expediente Nº 26-002780-0007-CO, dictada por la Sala Constitucional, este Gobierno Local esta realizando todos los actos administrativos que le permite el bloque de legalidad para realizar una coordinación interinstitucional real, completa y eficaz y adoptando medidas concretas de protección de los derechos fundamentales en armonía con la normativa que rige sobre los bienes públicos que administra.QUINTO: En otro orden de ideas, no ha existido en ningún momento intención de esta administración de restringir el acceso de los administrados a los servicios básicos a los que tienen derecho, siempre y cuando no riñan con las disposiciones establecidas para las áreas en las que el mismo ordenamiento normativo impone limitantes, tal es el caso del área pública que comprende la zona marítima terrestre, esta administración en coordinación con las entidades públicas correspondientes serán las responsables de aclarar en cuales condiciones se encuentran los pobladores de los territorios mencionados en el recurso de amparo, con respecto a los servicios que reciben. SEXTO: Tal y como se mencionó y se demuestra con los oficios aportados ya existe una coordinación interinstitucional para aclarar y definir cuál es la situación real de los pobladores de las zonas publicas y los servicios básicos que reciben.SETIMO: En cuanto a los demás hechos mencionados en el recurso de amparo, se menciona situaciones y etapas a las que aún no se ha llegado con este proceso ya que la iniciativa es muy resiente y aún se está en coordinación con las demás instituciones para aclarar cuales son los procedimientos a seguir en cuanto a la identificación de las zonas de intervención, lo mismo sucede con las notificaciones mencionadas por parte de las instituciones. MEDIDA CAUTELAR (NO EXISTE PELIGRO DE DEMORA) En cuanto a la solicitud de medida cautelar queda claro que no hay ningún daño grave inminente en cuanto a la formalidad del proceso de coordinación que acaba de iniciar con las demás instituciones, no existe ni se logra comprobar por parte de los recurrentes ningún peligro de daño y mucho menos un daño concreto respecto a la iniciativa aquí ya expuesta, en ese sentido nuestra Sala Constitucional ha sido clara en cuanto a la naturaleza de las medidas cautelares en esta materia, las cuales deben ser utilizadas como un instrumento de garantía para la continuidad del proceso y la no vulneración de derechos, (Voto Nº 7190-1994, de las 15:24 horas del 6 de diciembre; Voto Nº 6224-2005, de las 15:16 horas del 25 de mayo del 2005). Por lo que solicito no se considere la medida cautelar solicitada bajo la presunción de una supuesta afectación que en ningún momento fue demostrada por la representante legal de los recurrentes.”.
  5. 5En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I. OBJETO DEL RECURSO

La recurrente manifiesta que los tutelados habitan en la zona marítimo terrestre de Playa Agujas, en el cantón de Garabito. Expone que la Sala, en la sentencia nro. 2026010043 de las 9:20 horas del 20 de marzo de 2026, ordenó a la municipalidad accionada “no ejecutar, permitir ni tolerar actuaciones materiales orientadas al desalojo, demolición o remoción de familias ubicadas en zona marítimo terrestre, sin haber cumplido previamente con una coordinación interinstitucional real, completa y eficaz, y sin haber adoptado medidas concretas de protección de derechos fundamentales.”. Sin embargo, expone que el gobierno local accionado emitió el oficio nro. AME-152-2026-FGM de 29 de mayo de 2026, dirigido a ASADAS Garabito, ICAA e ICE, a través del cual se comunicó a esas dependencias que la municipalidad va a eliminar las estructuras de servicios, incluyendo medidores y conexiones eléctricas ubicadas en estas zonas. Estima que el oficio referido constituye un aviso de ejecución, lo cual estima contrario a lo resuelto por la Sala. Expresa que la eliminación de medidores, conexiones eléctricas o estructuras de servicios en el sector donde habitan los amparados amenaza y compromete la salud, higiene, alimentación, seguridad, conservación de medicamentos, comunicación y condiciones mínimas de vida digna de los amparados.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)Mediante el oficio nro. DA-CSTCCCI-ATACI-EXT-014-2026-LDOQ de 19 de mayo de 2026, dirigido a autoridades del ICAA y del ICE, la municipalidad accionada indicó: “Asunto: Convocatoria a reunión sobre servicios públicos en áreas públicas administradas por la Municipalidad de Garabito. En atención a las instrucciones y delegación conferidas por el Sr. Alcalde Municipal de Garabito, mediante la Resolución Administrativa No. RAM-033-2026-FGM, en el ejercicio de sus potestades de dirección y organización administrativa, me permito exponer lo siguiente: Por medio de la presente, se les extiende cordial convocatoria a reunión presencial a celebrarse el día viernes 29 de mayo de 2026, a las 10:00 a.m., en la Sala de Sesiones del Concejo Municipal de Garabito. La presente reunión tiene como finalidad generar un espacio de coordinación y articulación interinstitucional respecto a los distintos servicios públicos que actualmente se brindan, desarrollan, mantienen o poseen infraestructura instalada en áreas públicas administradas por la Municipalidad de Garabito. Lo anterior, considerando la importancia de fortalecer los mecanismos de coordinación técnica y administrativa relacionados con servicios esenciales vinculados al abastecimiento de agua potable, electricidad, telecomunicaciones, conectividad, internet, redes, instalaciones y demás infraestructura de interés público presente dentro de espacios públicos cantonales. Asimismo, se pretende abordar aspectos relacionados con la gestión, utilización, intervención, planificación y ordenamiento de dichas áreas públicas, procurando una adecuada coordinación institucional entre entidades públicas, ASADAS y proveedores de servicios, en beneficio del interés público cantonal y de las comunidades del cantón de Garabito. Se agradece confirmar la participación de la persona representante de cada institución, entidad, ASADA o proveedor convocado.”. (Prueba documental).
  • b)Mediante el oficio nro. AME-152-2026-FGM de 29 de mayo de 2026, dirigido al ICAA, ICE y Asadas Garabito, la municipalidad accionada detalló: “Sirva la presente para saludarle y a la vez para indicarles que de acuerdo a los cronogramas de trabajo en las diferentes áreas del cantón, esta administración va a proceder a eliminar todo tipo de estructura de servicios (medidores y conexiones eléctricas), que se encuentren en Zona Marítimo Terrestre, Áreas de protección, zonas públicas de vías cantonales o nacionales, todo esto de acuerdo al ordenamiento jurídico.”. (Prueba documental).
  • c)La municipalidad se encuentra en fase de coordinación con las instituciones respectivas “para aclarar cuales son los procedimientos a seguir en cuanto a la identificación de las zonas de intervención”. (Informe de la autoridad recurrida).
  • d)Ante una consulta que le formuló el ICE a la municipalidad sobre el oficio nro. AME-152-2026-FGM, el gobierno local le explicó a dicho instituto que el memorial “tenía un carácter meramente informativo y que su contenido no pretendía solicitar la desconexión de medidores ni la suspensión de servicios eléctricos en el sector referido.”. (Informe de la autoridad recurrida).

III. HECHO NO PROBADO

De importancia para la decisión de este asunto, se estima como no demostrado que el gobierno local accionado haya eliminado las conexiones de servicios públicos en la zona donde habitan los tutelados.

VI. SOBRE EL CASO CONCRETO

En el sub lite, la recurrente manifiesta que los tutelados habitan en la zona marítimo terrestre de Playa Agujas, en el cantón de Garabito. Expone que la Sala, en la sentencia nro. 2026010043 de las 9:20 horas del 20 de marzo de 2026, ordenó a la municipalidad accionada “no ejecutar, permitir ni tolerar actuaciones materiales orientadas al desalojo, demolición o remoción de familias ubicadas en zona marítimo terrestre, sin haber cumplido previamente con una coordinación interinstitucional real, completa y eficaz, y sin haber adoptado medidas concretas de protección de derechos fundamentales.”. Sin embargo, expone que el gobierno local accionado emitió el oficio nro. AME-152-2026-FGM de 29 de mayo de 2026, dirigido a ASADAS Garabito, ICAA e ICE, a través del cual se comunicó a esas dependencias que la municipalidad va a eliminar las estructuras de servicios, incluyendo medidores y conexiones eléctricas ubicadas en estas zonas. Estima que el oficio referido constituye un aviso de ejecución, lo cual estima contrario a lo resuelto por la Sala. Expresa que la eliminación de medidores, conexiones eléctricas o estructuras de servicios en el sector donde habitan los amparados amenaza y compromete la salud, higiene, alimentación, seguridad, conservación de medicamentos, comunicación y condiciones mínimas de vida digna de los amparados.

Del estudio de los autos se tiene por demostrado, que, mediante el oficio nro. DA-CSTCCCI-ATACI-EXT-014-2026-LDOQ de 19 de mayo de 2026, dirigido a autoridades del ICAA y del ICE, la municipalidad accionada indicó: “Asunto: Convocatoria a reunión sobre servicios públicos en áreas públicas administradas por la Municipalidad de Garabito. En atención a las instrucciones y delegación conferidas por el Sr. Alcalde Municipal de Garabito, mediante la Resolución Administrativa No. RAM-033-2026-FGM, en el ejercicio de sus potestades de dirección y organización administrativa, me permito exponer lo siguiente: Por medio de la presente, se les extiende cordial convocatoria a reunión presencial a celebrarse el día viernes 29 de mayo de 2026, a las 10:00 a.m., en la Sala de Sesiones del Concejo Municipal de Garabito. Lo anterior, considerando la importancia de fortalecer los mecanismos de coordinación técnica y administrativa relacionados con servicios esenciales vinculados al abastecimiento de agua potable, electricidad, telecomunicaciones, conectividad, internet, redes, instalaciones y demás infraestructura de interés público presente dentro de espacios públicos cantonales. Asimismo, se pretende abordar aspectos relacionados con la gestión, utilización, intervención, planificación y ordenamiento de dichas áreas públicas, procurando una adecuada coordinación institucional entre entidades públicas, ASADAS y proveedores de servicios, en beneficio del interés público cantonal y de las comunidades del cantón de Garabito. Se agradece confirmar la participación de la persona representante de cada institución, entidad, ASADA o proveedor convocado.”. Mediante el oficio nro. AME-152-2026-FGM de 29 de mayo de 2026, dirigido al ICAA, ICE y Asadas Garabito, la municipalidad accionada detalló: “Sirva la presente para saludarle y a la vez para indicarles que de acuerdo a los cronogramas de trabajo en las diferentes áreas del cantón, esta administración va a proceder a eliminar todo tipo de estructura de servicios (medidores y conexiones eléctricas), que se encuentren en Zona Marítimo Terrestre, Áreas de protección, zonas públicas de vías cantonales o nacionales, todo esto de acuerdo al ordenamiento jurídico.”.

La municipalidad se encuentra en fase de coordinación con las instituciones respectivas “para aclarar cuales son los procedimientos a seguir en cuanto a la identificación de las zonas de intervención”. Ante una consulta que le formuló el ICE a la municipalidad sobre el oficio nro. AME-152-2026-FGM, el gobierno local le explicó a dicho instituto que el memorial “tenía un carácter meramente informativo y que su contenido no pretendía solicitar la desconexión de medidores ni la suspensión de servicios eléctricos en el sector referido.”.

Desde este panorama, prima facie se descarta alguna situación que amerite la intervención de esta jurisdicción constitucional.

Al respecto, contrario a lo alegado por la recurrente, no se acredita que, al momento de interposición del recurso, la municipalidad haya ejecutado alguna acción para eliminar las conexiones de servicios públicos en la zona donde residen los tutelados. En tal sentido, el gobierno local accionado explica que el oficio referido por la recurrente (AME-152-2026-FGM), así como el nro. DA-CSTCCCI-ATACI-EXT-014-2026-LDOQ de 19 de mayo de 2026, se circunscriben a acciones de la etapa de coordinación con las instituciones respectivas “para aclarar cuales son los procedimientos a seguir en cuanto a la identificación de las zonas de intervención”. Justamente, ante una consulta que formuló el ICE, la municipalidad le explicó a ese instituto que el oficio en cuestión “tenía un carácter meramente informativo y que su contenido no pretendía solicitar la desconexión de medidores ni la suspensión de servicios eléctricos en el sector referido.”.

En virtud de lo anterior, no se verifica alguna situación actual que justifique la injerencia de este Tribunal Constitucional.

Finalmente, no está de más advertir que si la recurrente considera que se ha dado algún incumplimiento puntual a un extremo de la resolución nro. 2026010043 de las 9:20 horas del 20 de marzo de 2026 de este Tribunal, lo procedente es que formule los alegatos que estime pertinentes en ese expediente en concreto, para que en la vía de ejecución se resuelva lo correspondiente.

Ergo, se declara sin lugar el recurso.

V. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara sin lugar el recurso.
