Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 20 August 2026.

Amparo proceeding filed under case number 26-017161-0007-CO by Nombre01, identity card CED02, against the MUNICIPALITY OF SANTO DOMINGO.

Background:

  1. 1In a document received by this Office on 14 May 2026, the applicant filed an amparo proceeding against the Municipality of Santo Domingo and states: “1. I am a resident of Santo Domingo de Heredia. I am part of a corporation whose legal entity identification number is 3-101-868017. As president, I hold judicial and extrajudicial representation as a general attorney-in-fact without limitation as to amount. The corporation owns a right in the real property registered under real folio number PRN01. That property is divided among several owners or co-owners, not only myself. Evidence No. 1: literal certification of the corporation’s legal standing and properties 3-101-868017. Registry information for property PRN01. 2. On 29 April 2024, MSDH signed with all the co-owners of the property registered under real folio number PRN01 a ‘COOPERATION AGREEMENT FOR THE DELIVERY OF MATERIALS FOR WORK TO IMPROVE THE MUNICIPAL WATERWORKS’ URBAN INFRASTRUCTURE, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 70 OF THE URBAN PLANNING LAW.’ The purpose of the agreement was limited to delivering materials necessary and sufficient to eventually meet the need of the donors’ property and the neighboring community to have a distribution pipe with sufficient capacity to provide drinking water service to their property.Thus, through the delivery of materials entailing an urban improvement, the Municipality could adequately and continuously provide that drinking water service at Dirección02 in the District of Santa Rosa. It was therefore necessary to establish cooperation through the delivery of those materials under the legal form of a special contribution, allowing intervention in the waterworks system (extension of a pipe branch). In consideration for the donation of the materials, under the agreement MSDH would provide drinking water service to the property so that the owners could build their home, subject to obtaining construction permits and paying their taxes. Evidence No. 2: copy of the full settlement of the agreement signed between the co-owners of the property registered under real folio PRN01 and the Municipality of Santo Domingo de Heredia. 3. In letter DA-IA-OF-049-2024 from the Municipal Waterworks Engineering Department dated 20 May 2024, entitled final acceptance record, technical receipt of the materials delivered under the signed agreement was established, and those materials were found to conform to the items specified by that department (…) 4.On 9 June 2025, MSDH signed a full settlement of the agreement with all the co-owners of property PRN01, including the aforementioned corporation. The agreement was entitled ‘FULL SETTLEMENT OF THE COOPERATION AGREEMENT FOR THE DELIVERY OF MATERIALS FOR WORK TO IMPROVE THE MUNICIPAL WATERWORKS’ URBAN INFRASTRUCTURE, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 70 OF THE URBAN PLANNING LAW.’ (Hereinafter ‘the Full Settlement’). The Full Settlement was authorized for signature by Ordinary Session No. 11-2024 of the Municipal Council of Santo Domingo on Tuesday, 18 June 2024. Evidence No. 4: Copy of letter SCM-0346-06-2024 dated 24 June 2024, issued by the Council Secretariat, transcribing Article V, paragraph 1 of Ordinary Session No. 11-2024 of the Municipal Council of Santo Domingo on Tuesday, 18 June 2024. 5. The Full Settlement clearly stated that, by means of the acceptance record drawn up by the Waterworks Department on 20 May 2024, ‘the Donors have complied not only with delivery of the materials but also with the agreed supporting documents, and therefore, from that act onward, technical approval is granted for the commitment undertaken and fulfilled by the DONORS, verifying that the technical scope of the agreement signed between the parties has been achieved.’ 6.Letter DA-DISP-5285-05-2024 dated 24 May 2024 ruled on the application for water availability that I submitted through the platform on behalf of corporation 3-101-868017 and all the co-owners of property PRN02. The requested permit was for the construction of a single-family dwelling only under plan H-0814195-2002. This decision ratified the granting of water availability for the construction of a single-family dwelling only on the property. The decision states that granting the requested water availability is feasible and that the technical conditions were satisfactorily met (…) 7. On 6 March 2025, MSDH granted construction permit No. PC-392-2024 for a construction area of 10 m2 and 208 m for a booth and enclosure (…) 8. Without any prior notice, MSDH suspended the water supply to me and my co-owners. The foregoing occurred without any written letter or decision setting out the reason why the water supply was abruptly stopped.This was despite the fact that my client acted in good faith under the Agreement and applied for the necessary construction and water availability permits.” (sic). Based on the arguments presented, she considers that the challenged actions violate fundamental rights. She asks that the application be granted, with the consequences provided by law.
  2. 2By resolution issued at 21:56 on 12 June 2026, the Presidency of the Chamber admitted this amparo proceeding and requested a report from the respondent authority.
  3. 3In a document added to the electronic case file on 22 June 2026, Jorge Luis Fonseca Fonseca, mayor of the Municipality of Santo Domingo, reports under oath as follows: “(…) PRELIMINARY STATEMENT: According to the notice of transfer of this application, which was sent by email to the municipal mayor’s office, the term is taken as three days, as stated and provided in section 38 of Law 8687. Since notice was given on 15 June, it is deemed received on 16 June, and the three-day period is counted from 17 to 19 June 2026. Regarding the facts in the pleading for this amparo, I report as follows: First fact: Partially denied on the basis that Ms. Nombre01 is not telling the truth about the facts, since it is not true that she is a resident of Santo Domingo de Heredia; rather, her domicile is in the canton of San Pablo, specifically in Residencial Rosa Linda, as she established in the procedures carried out before this municipality to request a water connection and sign a cooperation agreement.The applicant is correct in stating that she represents a commercial corporation and that this corporation owns an undivided right in property located in Santa Rosa, Santo Domingo de Heredia, real folio PRN03. Second fact: Denied as a fact relevant to this proceeding, with the following clarification: although a cooperation agreement was signed between the co-owners of the property, including the corporation represented by the applicant, and the respondent municipality, that agreement was signed under the legal form of a special contribution, not for arbitrary reasons, but because at that time the technical perspective of the waterworks system determined that there was NO water or hydraulic capacity to provide subsequent drinking water service to the property, and that it is accessed by an easement, as can be seen from the applicant’s own evidence. It is important for this report to clarify that the agreement did not grant each owner a right to drinking water service, as is apparent from the text of the fact (…) (…) (…) That instrument was signed for the delivery of materials needed to expand the pipe to a diameter that would permit a half-inch water connection to the property, as occurred with the water availability granted on 20 May 2024 by the municipal waterworks.The applicant is NOT correct in saying that each co-owner has the right to build a dwelling on the property, since this is not permitted when there are more than 10 rights in the property. As explained, access to the property is by an easement, which limits the co-owners’ ability to dispose of it under the conditions set out in Article 270 of the Civil Code. Third fact: In this fact, this representative denies that it is a fact proper to the amparo proceeding, clarifying that although the parties complied with the agreement and water availability was granted, that act applies only to the property and not to each co-owner’s right. Nor does it grant construction rights or other procedures that are prior and necessary to build or occupy. Therefore, this statement by the applicant is considered irrelevant to this proceeding. Fourth fact: Denied as a fact relevant to this proceeding, since neither the signing of the agreement nor whether it was performed is disputed.Therefore, this statement by the applicant is considered irrelevant to this proceeding. Fifth fact: Denied; as stated above, neither the signing of the agreement nor whether it was performed is disputed. Therefore, this statement by the applicant is considered irrelevant to this proceeding. Sixth fact: As detailed in the municipal waterworks decision, that water availability is an act prior to actual provision of drinking water service through a water connection, which was subsequently granted to the property. As the applicant correctly states in this fact, one water connection was granted for the property and for a single-family dwelling only (point 1 of the operative section). To date, the dwelling has not been built, since there is no record of construction permits issued for a single-family dwelling, as the applicant’s own evidence establishes. Consider what was stated in the municipal waterworks decision DA-DISP-5285-05-2024 dated 24 May 2024, which clearly provided at the end, as relevant: (…) Seventh fact: The evidence provided by the applicant shows that although the municipality granted a construction permit, it was only for a perimeter wall measuring 203 linear meters and a 10-square-meter booth with a bathroom.No construction permit has been issued for a single-family dwelling on the property, as I demonstrate with the attached certification from the Directorate of Services and Territorial Planning, the municipal body responsible for issuing such permits. Eighth fact: Denied, as it is not true that the drinking water service to the property was suspended without notice. As shown in the report of the Municipal Waterworks Directorate, CRC-MSDH-DA-DIA-OF-033-2026, the water connection initially installed was temporary for construction of the walls and booth, which have not been built. It was also found that the applicant was using the water installation provided for purposes other than those covered by the referenced construction permit. Accordingly, sections 2, 11, and 21 of the Santo Domingo drinking water service regulations require both users and the municipality to comply, as relevant: (…) It is established that a permanent water connection for residential use has not yet been installed, because no construction permit has been issued for the single-family dwelling authorized by this municipality on the property in question.Rather, at that time, water service was supplied for construction of the wall and booth, subject to the term of the construction permit. It has therefore been shown that those authorized works have not been built, and that the authorizations granted by this municipality for the property were used improperly, as construction of apparent dwellings without construction licenses was detected. The permit was granted for a one-year term for work to begin; that did not occur, indicating that the permit has expired. The record shows that it was issued or released in the APC system on 6 March 2025 and expired one year later, on 6 March 2026 (see resolution CRC-MSDH-DSOT-DI-RESOL-041-2025 FR 212812), whose operative section expressly says this in point 4), and also states the consequence of expiration: the applicant and her co-owners would have to submit a new application to validate the construction permit granted for the wall and booth only; see point 4) of that resolution.The municipality’s action was therefore neither arbitrary, abrupt, nor abusive, but subject to the principles of legality, reasonableness, and proportionality, in light of the foregoing and pursuant to section 23 of the municipal drinking water service regulations, which states, as relevant: (…) It has been demonstrated that the municipality proceeded in accordance with its internal regulations, which rules out a violation of the cited constitutional right, and that its conduct complied with the principle of legality. The foregoing is also supported by section 74 of the Construction Law, among other applicable provisions. (…) Note from the attached evidence that this municipality has already acted in accordance with law and due process. When it detected those irregularities in construction work on the applicant’s property, it initiated demolition proceedings for construction works without a municipal license, relying on the police powers municipalities have in urban planning matters and which have been affirmed in several rulings of this Constitutional Chamber and the administrative courts.This rules out an injury to the constitutional right of access to drinking water, as the applicant claims. In addition, the Procurador has determined that a construction permit is a prior-control act, so any substantial modification to the work requires municipal approval, thereby protecting the orderly development of the canton. CONCLUSION For this Municipal Mayor’s Office, the contents of this amparo proceeding are surprising, since it alleges that this Municipality’s actions violate a constitutional right, when the evidence instead shows that its actions comply with the law and the principle of legality. In performing the oversight duty imposed by law and exercising its police powers, it has fulfilled its duty to ensure that residents of the canton use drinking water service according to need and safeguard its continuity. Thus, despite the numerous rulings cited by the applicant, they concern very different specific cases from the situation before us.The evidence shows, to the contrary, that the applicant has abusively used the administrative system, seeking to benefit from acts intended for specific purposes and attempting to use them to expand rights in a manner that violates the principles of legality, due process, and objective administrative action. This representative considers that the rulings submitted with the application concern matters very different from the actions at issue. Although the right to drinking water must be guaranteed, this is so only when the conditions of legality are met, which is not the case here. Further, there is no dwelling built on the site that would warrant permanent service to the property, ruling out the need and right to drinking water service for residential use. In support of this report, I quote part of the ruling of that Chamber which decided, as relevant: the ruling issued at 9:20 a.m. on 6 February 2026, No. 2026-004363 (…)”. He asks that the amparo proceeding be dismissed.
  4. 4In a document added to the electronic case file on 22 June 2026, Gerardo Ortega Fonseca, president of the Municipal Council of Santo Domingo, reports under oath as follows: “(…) ON THE FACTS AND ACTIONS ALLEGED. Regarding the facts, a specific statement must be made insofar as they concern actions within the knowledge of the Municipal Council. As the applicant herself states, the following are background matters before the collegial body of which I am a member: a) As the applicant states in the second fact, although the Municipal Council, within its powers and duties and in accordance with Article 13(e) of the Municipal Code, approved and authorized the signing of a cooperation agreement between this municipality and the co-owners of the property, including the corporation represented by the applicant, it must be clarified, as the Municipal Mayor’s Office explains in detail in its report to this Constitutional Chamber concerning this application, that the agreement was signed under the legal form of a special contribution authorized by Article 70 of the Urban Planning Law.This was not for arbitrary reasons, but because the technical perspective of the Municipal Waterworks Directorate determined at the time that there was NO water or hydraulic capacity to provide subsequent drinking water service to the property, which is accessed by an easement, as can be seen from the applicant’s own evidence. b) It is also important for this report to clarify that the Municipal Council’s authorization to sign the agreement, as detailed in the Municipal Mayor’s report to this Chamber, did not grant each owner a right to drinking water service, as is apparent from the text of the fact (…) (…) (…) The Agreement was signed for delivery of materials needed to expand the pipe to a diameter that would permit a half-inch water connection to the property, as occurred with the water availability granted on 20 May 2024 by the municipal waterworks. The applicant is NOT correct in saying that each co-owner has the right to build a dwelling on the property, since this is not permitted when there are more than 10 rights in the property.As explained by the Municipal Mayor’s Office, access to the property is by an easement, which limits the co-owners’ ability to dispose of it under the conditions set out in Article 270 of the Civil Code. c) As to the other facts, this Honorable Chamber must be informed that they concern matters within the competence of municipal departments under the authority of the Municipal Mayor’s Office (MUNICIPAL WATERWORKS DIRECTORATE). It is for that Municipal Mayor’s Office to address in greater detail the actions taken and carried out in relation to what the applicant alleges in this proceeding. (…)”. (sic). He asks that the amparo proceeding be dismissed.
  5. 5The legal requirements have been observed in the proceedings.

Drafted by Justice Hess Herrera; and, Reasons:

I. OBJECT OF THE APPLICATION

The applicant states that she is a resident of Santo Domingo de Heredia. She indicates that she represents a corporation that owns a right in the property under real folio number PRN01. She states that on 29 April 2024 the respondent signed an agreement with the property owners to deliver materials to build a drinking water distribution pipe at Dirección02 in the district of Santa Rosa. She explains that on 24 May 2024 the respondent ruled on the co-owners’ application for water availability for the property; however, she alleges that it later suspended their water supply without prior notice or any technical or legal reasons. She considers her fundamental rights to water and to a healthy and ecologically balanced environment to have been violated.

II. FACTS PROVEN

The following facts are considered duly established as relevant to deciding this matter, either because they have been substantiated or because the respondent failed to address them as required in the initial order:

  • a)The amparo beneficiary, Nombre01, identity card CED02, holds judicial and extrajudicial representation of 3-101-868017 Sociedad Anónima, a legal entity that owns the property under real folio number PRN04, located in Santa Rosa, Santo Domingo, Heredia (see evidence submitted).
  • b)On 29 April 2024, the amparo beneficiary—in representation of the above-mentioned corporation and the other owners of the specified property—and the Municipality of Santo Domingo—represented by the municipal mayor—signed an agreement entitled “COOPERATION AGREEMENT FOR THE DELIVERY OF MATERIALS FOR WORK TO IMPROVE THE MUNICIPAL WATERWORKS’ URBAN INFRASTRUCTURE, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 70 OF THE URBAN PLANNING LAW.” Its purpose was to deliver materials to meet the need for a drinking water distribution pipe at Dirección02 in the district of Santa Rosa, under the legal form of a special contribution, and thereby make water service available to the property for construction of a dwelling, subject to obtaining the construction permit and paying the corresponding tax (see evidence submitted).
  • c)On 24 May 2024, by letter No. DA-DISP-5285-05-2024, the Municipal Waterworks Directorate of the respondent authority determined as follows: “(…) THEREFORE: 1. Based on the foregoing Reasons, this Municipal Waterworks Engineering Department proceeds to RATIFY THE GRANTING of Water Availability for THE CONSTRUCTION OF A SINGLE-FAMILY DWELLING ONLY on the property under plan H-0814195-2002 and property PRN05. Requested by its owner Nombre01, identity card CED01, and others. According to the FOURTH REASON, granting the requested water availability is feasible; the technical conditions were satisfactorily met for: first, letter SMC-0120-03-2024 of 8 March 2024 from the Municipal Council; second, letter DA-IA-OF-139-2022 of 8 November 2022; third, ‘Cooperation agreement for the delivery of materials for work to improve Waterworks infrastructure, in accordance with the provisions of Articles 38 and 70 of the Urban Planning Law, between the Municipality of Santo Domingo and co-owners of Property FR 212812,’ signed on 29 April 2024. 2. The applicant is reminded that the professional responsible for the work must manage its land, design, permits, and construction, as stipulated in the current regulations, submitting its segregation sketch in a timely manner (see THIRD REASON, point four). It is recalled that, by virtue of its competence, the Directorate of Services and Territorial Planning (DSOT) and its departments oversee land use, urban control, real property, and the design and construction of buildings. The foregoing is in accordance with: Article 65, paragraph 1, of the General Public Administration Law No. 6227; Articles 3, 4, 8, and 9 of the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures No. 8220; the CFIA ‘Code of Hydraulic and Sanitary Installations in Buildings’; and other related rules. The DSOT and others involved are reminded that every subdivision and construction must be supported by a valid letter of drinking water availability under Articles 13, 18, 27, 36, 37, 39, 105, and 120 of the Regulation on Subdivisions and Urban Developments (RFU). It is recalled that the donated Arad SONATA model 12 mm ultrasonic meter, number 22A057714, will be held by the Waterworks Department and installed once the applicant effectively obtains the construction permit for their single-family dwelling only (actual provision of drinking water service). 3. This Municipal Waterworks Engineering Department informs municipal inspectors and the interested party that this availability is subject to compliance with all requirements and procedures established by this Waterworks Department’s regulations and the good practices prescribed by the Federated College of Engineers and Architects. This decision does NOT imply approval of any construction permits, number of buildings per lot, approval of plans, approval of an easement, land use, or business license; these procedures must be carried out in accordance with the applicable rules and procedures before this Municipality’s Cadastral and Urban Control Departments and, as applicable, the Licensing and Collections Department. This decision is issued for a term of ONE YEAR from its issuance date. After that period, a new drinking water availability application must be submitted. The remedy applicable to this decision may be filed within five days following notification, under the terms of section 171 of the current Municipal Code. (…)” (see evidence submitted).
  • d)On 9 June 2025, the parties that signed the above-mentioned agreement signed a full settlement of it (see evidence submitted).
  • e)On 14 April 2026, the respondent’s Municipal Waterworks Directorate recorded the following in an email to Municipal staff: “(…) Collections Management Department: it has been determined that several housing units are being built on the property under real folio PRN05, in the district of Santa Rosa, and the Institutional System (SIEM) does not show approved construction permits for those buildings. The water availability and the parties’ agreement for improvements to Public Infrastructure were established for construction of a single-family dwelling only. Aerial images show that at least four housing units are being or have been built, and construction is continuing. For the foregoing reasons, other administrative units of the Municipality of Santo Domingo are being notified and alerted, based on the provisions of the General Internal Control Law and the institutional internal control procedure, that there is apparently illegal construction of infrastructure on the property under real folio PRN06, located in the district of Santa Rosa. As legally required, the Commercial Department of the Waterworks Department ordered suspension of the drinking water service that was being used for construction work, which did not constitute the use for which Water Availability was granted and the Agreement between the Parties signed. Drinking water service will be restored once it is shown that the property has been brought into regular status with regard to obtaining permits for an urban development or condominium (stormwater drainage, drinking water, road infrastructure, and other civil works). The various administrative units are urged to act as promptly as possible, given that construction work remains active and ongoing. If any application has been made or the necessary construction permits have been obtained, the information is requested to be sent to the Waterworks Department, since capacity to provide drinking water service must be verified, given that, as stated, availability has been approved for one single-family dwelling only. Part of the file held by the Municipal Waterworks Department is attached for reference. If a document compiling all attached files is required, because of its size it must be copied to an external memory device. (sic) (…)” (see evidence submitted).
  • f)On 7 May 2026, the amparo beneficiary was notified of document No. CRC-MSDH-DSOT-CUR-INICIO PROCEDIMIENTO DE DEMOLICION-008-2026 dated 18 March 2026, which informs the owners of the property in which the company represented by the beneficiary owns a right of the commencement of demolition proceedings concerning several dwellings built on that property (see evidence submitted).

III. ON THE SPECIFIC CASE

The report submitted by the representative of the respondent authority—which is deemed to have been made under oath, with the consequences, including criminal consequences, provided in Article 44 of the Law governing this Jurisdiction—and the evidence establish that the amparo beneficiary, Nombre01, identity card CED02, holds judicial and extrajudicial representation of 3-101-868017 Sociedad Anónima, a legal entity that owns the property under real folio number PRN04, located in Santa Rosa, Santo Domingo, Heredia. It is also established that on 29 April 2024, the amparo beneficiary—in representation of the above-mentioned corporation and the other owners of the specified property—and the Municipality of Santo Domingo—represented by the municipal mayor—signed an agreement entitled “COOPERATION AGREEMENT FOR THE DELIVERY OF MATERIALS FOR WORK TO IMPROVE THE MUNICIPAL WATERWORKS’ URBAN INFRASTRUCTURE, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 70 OF THE URBAN PLANNING LAW.” Its purpose was to deliver materials to meet the need for a drinking water distribution pipe at Dirección02 in the district of Santa Rosa, under the legal form of a special contribution, and thereby make water service available to the property for construction of a dwelling, subject to obtaining the construction permit and paying the corresponding tax.

Next, it is established that on 24 May 2024, by letter No. DA-DISP-5285-05-2024, the Municipal Waterworks Directorate of the respondent authority determined as follows: “(…) THEREFORE: 1. Based on the foregoing Reasons, this Municipal Waterworks Engineering Department proceeds to RATIFY THE GRANTING of Water Availability for THE CONSTRUCTION OF A SINGLE-FAMILY DWELLING ONLY on the property under plan H-0814195-2002 and property PRN05. Requested by its owner Nombre01, identity card CED01, and others. According to the FOURTH REASON, granting the requested water availability is feasible; the technical conditions were satisfactorily met for: first, letter SMC-0120-03-2024 of 8 March 2024 from the Municipal Council; second, letter DA-IA-OF-139-2022 of 8 November 2022; third, ‘Cooperation agreement for the delivery of materials for work to improve Waterworks infrastructure, in accordance with the provisions of Articles 38 and 70 of the Urban Planning Law, between the Municipality of Santo Domingo and co-owners of Property FR 212812,’ signed on 29 April 2024. 2.

The applicant is reminded that the professional responsible for the work must manage its land, design, permits, and construction, as stipulated in the current regulations, submitting its segregation sketch in a timely manner (see THIRD REASON, point four). It is recalled that, by virtue of its competence, the Directorate of Services and Territorial Planning (DSOT) and its departments oversee land use, urban control, real property, and the design and construction of buildings. The foregoing is in accordance with: Article 65, paragraph 1, of the General Public Administration Law No. 6227; Articles 3, 4, 8, and 9 of the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures No. 8220; the CFIA ‘Code of Hydraulic and Sanitary Installations in Buildings’; and other related rules. The DSOT and others involved are reminded that every subdivision and construction must be supported by a valid letter of drinking water availability under Articles 13, 18, 27, 36, 37, 39, 105, and 120 of the Regulation on Subdivisions and Urban Developments (RFU).

It is recalled that the donated Arad SONATA model 12 mm ultrasonic meter, number 22A057714, will be held by the Waterworks Department and installed once the applicant effectively obtains the construction permit for their single-family dwelling only (actual provision of drinking water service). 3. This Municipal Waterworks Engineering Department informs municipal inspectors and the interested party that this availability is subject to compliance with all requirements and procedures established by this Waterworks Department’s regulations and the good practices prescribed by the Federated College of Engineers and Architects. This decision does NOT imply approval of any construction permits, number of buildings per lot, approval of plans, approval of an easement, land use, or business license; these procedures must be carried out in accordance with the applicable rules and procedures before this Municipality’s Cadastral and Urban Control Departments and, as applicable, the Licensing and Collections Department.

This decision is issued for a term of ONE YEAR from its issuance date. After that period, a new drinking water availability application must be submitted. The remedy applicable to this decision may be filed within five days following notification, under the terms of section 171 of the current Municipal Code. (…)” Thereafter, it is established that on 9 June 2025, the parties that signed the above-mentioned agreement signed a full settlement of it. Subsequently, it is inferred that on 14 April 2026, the respondent’s Municipal Waterworks Directorate recorded the following in an email to Municipal staff: “(…) Collections Management Department: it has been determined that several housing units are being built on the property under real folio PRN05, in the district of Santa Rosa, and the Institutional System (SIEM) does not show approved construction permits for those buildings. The water availability and the parties’ agreement for improvements to Public Infrastructure were established for construction of a single-family dwelling only.

Aerial images show that at least four housing units are being or have been built, and construction is continuing. For the foregoing reasons, other administrative units of the Municipality of Santo Domingo are being notified and alerted, based on the provisions of the General Internal Control Law and the institutional internal control procedure, that there is apparently illegal construction of infrastructure on the property under real folio PRN06, located in the district of Santa Rosa. As legally required, the Commercial Department of the Waterworks Department ordered suspension of the drinking water service that was being used for construction work, which did not constitute the use for which Water Availability was granted and the Agreement between the Parties signed. Drinking water service will be restored once it is shown that the property has been brought into regular status with regard to obtaining permits for an urban development or condominium (stormwater drainage, drinking water, road infrastructure, and other civil works).

The various administrative units are urged to act as promptly as possible, given that construction work remains active and ongoing. If any application has been made or the necessary construction permits have been obtained, the information is requested to be sent to the Waterworks Department, since capacity to provide drinking water service must be verified, given that, as stated, availability has been approved for one single-family dwelling only. Part of the file held by the Municipal Waterworks Department is attached for reference. If a document compiling all attached files is required, because of its size it must be copied to an external memory device. (sic) (…)”. Lastly, it is established that on 7 May 2026, the amparo beneficiary was notified of document No. CRC-MSDH-DSOT-CUR-INICIO PROCEDIMIENTO DE DEMOLICION-008-2026 dated 18 March 2026, which informs the owners of the property in which the company represented by the beneficiary owns a right of the commencement of demolition proceedings concerning several dwellings built on that property.

Accordingly, an injury to the beneficiary’s fundamental rights is ruled out. First, it is established that the reason water availability was suspended on the property in which the company represented by the amparo beneficiary owns a right was noncompliance with the conditions for use of that service. Contrary to the applicant’s allegation, this situation was duly communicated to her on 7 May 2026 by document No. CRC-MSDH-DSOT-CUR-INICIO PROCEDIMIENTO DE DEMOLICION-008-2026 dated 18 March 2026, which contained a legal justification for noncompliance with the requirements for the permit she had applied for. In these circumstances, there are objective reasons which, in light of the current regulations, justify the refusal to provide the service; the respondent’s actions were not arbitrary or illegitimate.

In any event, the beneficiary’s objections concern an ordinary legality issue that cannot be examined by this jurisdiction, since doing so exceeds the summary nature of the amparo proceeding and this Tribunal’s jurisdiction. These concerns must therefore be resolved before the respondent institution through the established mechanisms or before the competent ordinary jurisdiction, where she may discuss the merits of the matter fully and assert her claims. Accordingly, the present application must be dismissed.

IV. NOTE BY JUSTICE RUEDA LEAL

I must point out that, since ruling No. 2019002355, issued at 9:30 a.m. on 12 February 2019, my position regarding amparo proceedings brought on behalf of a legal entity has been as follows:

“…in Advisory Opinion 22-16 of 26 February 2016, the Inter-American Court of Human Rights indicated that, although some States recognize the right to petition for legal persons subject to special conditions, such as trade unions, political parties, or representatives of Indigenous peoples, Afro-descendant communities, or specific groups, the fact is that ‘Article 1.2 of the American Convention only enshrines rights in favor of natural persons; legal persons are therefore not holders of the rights enshrined in that treaty.’ On the other hand, in the same advisory opinion, the Inter-American Court held that, in certain particular contexts, natural persons may come to exercise their rights through legal persons (for example, through a media outlet, as occurred in the case of Nombre02 and Others v. Venezuela); however, for this to be subject to protection before the inter-American system, ‘the exercise of the right through a legal person must involve an essential and direct relationship between the natural person requiring protection from the inter-American system and the legal person through which the violation occurred, since a mere connection between the two persons is not sufficient to conclude that the rights of natural persons, rather than those of legal persons, are in fact being protected.

Indeed, it must be proven that more than the natural person’s mere participation in the legal person’s activities is involved, such that this participation is substantially connected to the rights alleged to have been violated.’ (emphasis added) (OC. 22/16).” In the present case, the amparo proceeding was brought by the applicant in her capacity as representative of the corporation 3-101-868017; however, she alleges that “the suspension of the drinking water service affects me directly as well, and no longer the company I represent.” In light of the foregoing, I consider that there is an essential relationship between the alleged effect on a legal person and the possible injury to a natural person; for that reason, an examination of the merits of this matter is appropriate in order to determine whether the claimed violation has occurred.

V. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Chamber must advise the applicant that, if she submitted any document, whether on paper, or any objects or evidence stored on any additional device, or by electronic, computer, magnetic, optical, telematic, or new-technology means, these must be collected from the office within 30 business days after receipt of notice of this judgment; otherwise, all such materials will be destroyed in accordance with the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.

THEREFORE:

The amparo proceeding is dismissed. Justice Rueda Leal records a separate note. Notify the parties.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 26-017161-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra la MUNICIPALIDAD DE SANTO DOMINGO.

Resultando:

  1. 1Por escrito recibido en este Despacho el 14 de mayo de 2026, la recurrente interpone recurso de amparo contra la Municipalidad de Santo Domingo y manifiesta: que “1. Soy vecina de Santo Domingo de Heredia. Formo parte de una sociedad anónima, cuyo número de cedula jurídica es 3-101-868017. Como presidenta ostento la representación judicial y extrajudicial en calidad de apoderada generalísima sin límite de suma. La sociedad es dueña de un derecho sobre el bien inmueble inscrito bajo el folio real numero PRN01. Dicha propiedad está dividida en varies dueños o copropietarios, no solamente mi persona. Prueba No. 1: literal de personería jurídica e inmuebles de la sociedad 3-101- 868017. Información registral del inmueble PRN01. 2. El 29 de abril de 2024 la MSDH suscribió junto con todos los copropietarios del inmueble inscrito bajo el folio real numero PRN01 un “CONVENIO DE COOPERACION PARA ENTREGA DE MATERIALES PARA OBRAS DE MEJORAS DE INFRAESTRUCTURA URBANA DEL ACUEDUCTO MUNICIPAL, DE CONFORMIDAD A LO ESTIPULADO EN EL ARTICULO 70 DE LA LEY DE PLANIFICACI6N URBANA.” La finalidad del convenio se circunscribió a la entrega de materiales necesarios y suficientes para cubrir eventualmente con la necesidad de la propiedad de los donantes y para la comunidad circunvecina, de contar con tubería de distribución en capacidad necesaria para poder materializar el servicio de prestación de agua potable a su propiedad, por lo que la Municipalidad a partir de esa entrega de materiales que conlleva una mejora urbana, pudiese brindar de manera adecuada y constante esa prestación del servicio de agua potable en la denominada Dirección02 en Distrito de Santa Rosa.Por ello se vio la necesidad de establecer una colaboración a partir de la entrega de esos materiales bajo la figura de contribución especial permitiendo realizar intervención del sistema de acueducto (ampliación ramal de tubería). Como contraprestación a la donación de los materiales, según el convenio la MSDH proveería del servicio de agua potable a la propiedad para que los propietarios puedan construir su vivienda, previo cumplimiento de permisos constructivos y pago de sus impuestos. Prueba No. 2: copia del finiquito sobre el convenio suscrito entre los copropietarios del inmueble inscrito bajo folio real PRN01 y la Municipalidad de Santo Domingo de Heredia. 3. En el oficio DA-IA-OF-049-2024 del Departamento de Ingeniería del Acueducto Municipal del 20 de mayo de 2024 denominado acta de recepción definitiva, se estableció la recepción técnica de los materiales entregados con ocasión del convenio suscrito y que dichos materiales se ajustan a los elementos definidos por dicho departamento (…) 4.El día 9 de junio de 2025 la MSDH suscribió un finiquito al convenio con todos los copropietarios del inmueble PRN01, incluidos la sociedad antedicha. Dicho convenio se denominó “FINIQUITO TOTAL SOBRE EL CONVENIO DE COOPERACION PARA ENTREGA DE MATERIALES PARA OBRAS DE MEJORAS DE INFRAESTRUCTURA URBANA DEL ACUEDUCTO MUNICIPAL, DE CONFORMIDAD A LO ESTIPULADO EN EL ARTICULO 70 DE LA LEY DE PLANIFICACION URBANA.” (En adelante “el Finiquito”). El Finiquito fue autorizado para su suscripción mediante Sesión Ordinaria numero 11-2024 del Concejo Municipal de Santo Domingo del martes 18 de junio de 2024. Prueba No.4: Copia del oficio SCM-0346-06-2024 del 24 de junio de 2024 emitido por la Secretaría del Concejo en transcripción del articulo V, inciso 1 de la Sesión Ordinaria numero 11-2024 del Concejo Municipal de Santo Domingo del martes 18 de junio de 2024. 5. En el finiquito se indicó claramente que mediante acta de recepción, levantada por el Departamento de Acueducto del 20 de mayo de 2024, “los Donantes cumplen no solo con la entrega de los materiales sino también de los documentos de respaldo convenidos, por lo que, a partir de ese acto, se brinda aval técnico al compromiso adquirido y ejecutado por los DONANTES, verificándose la obtención del alcance técnico de dicho convenio suscrito entre las partes 6.El oficio DA-DISP-5285-05-2024 del 24 de mayo de 2024 resolvió la solicitud para disponibilidad de agua que fue presentada ante la plataforma por mi persona en representación de la sociedad 3-101-868017 y todos los copropietarios de la finca PRN02. El permiso solicitado fue para la construcción de una vivienda unifamiliar únicamente bajo el piano H-0814195-

2002. Esta resolución dispuso ratificar el otorgamiento de la disponibilidad de agua para la construcción de una vivienda unifamiliar únicamente sobre la propiedad. La resolución indica que es viable el otorgamiento de la disponibilidad de agua solicitada y que se cumplieron a satisfacción las condiciones técnicas (…) 7. El 6 de marzo de 2025 la MSDH otorgo permiso de construcción, numero PC-392- 2024 para un área de construcción de 10m2 y 208m para caseta y cerramiento (…) 8. Sin comunicación previa alguna, la MSDH suspendió el abastecimiento de agua hacia la y la de mis copropietarios. Lo anterior sin que exista un oficio o decisión por escrito que fundamente la razón por la cual de manera intempestiva de detuvo el abastecimiento de agua. Lo anterior a pesar de que mi representada ha cumplido de buena fe con el Convenio y solicito los permisos necesarios de construcción y de disponibilidad de agua.” (sic). Con base en los alegatos expuestos, estima que, con las actuaciones acusadas, se están vulnerando derechos fundamentales. Solicita que se declare con lugar el recurso con las consecuencias de ley.

  1. 2Por medio de la resolución de las 21:56 horas del 12 de junio de 2026, la Presidencia de la Sala le dio curso al presente recurso de amparo y solicitó informe a la autoridad accionada.
  2. 3Mediante escrito incorporado al expediente electrónico en fecha 22 de junio de 2026, Jorge Luis Fonseca Fonseca, alcalde de la Municipalidad de Santo Domingo, informa bajo fe de juramento en los siguientes términos: “(…) MANIFESTACION PREVIA: Conforme la notificación del traslado de este recurso que se realizó por medio de correo electrónico a la alcaldía municipal, se toma como termino de tres días según lo señalado y dispuesto por el numeral 38 de la Ley 8687, así las al notificarse el 15 de junio se tiene por notificado el día 16 contabilizándose el plazo de tres días del 17 al 19 de junio de 2026. En cuanto a los hechos del líbelo de este amparo, se informa lo siguiente: Hecho primero: Se rechaza de manera parcial sustentado en que la señora Nombre01 falta a la verdad real de los hechos ya que no es cierto que sea vecina de Santo Domingo de Heredia, sino que su domicilio se ubica en el cantón de San Pablo concretamente en el Residencial Rosa Linda, así lo acreditó en los trámites realizados ante esta municipalidad para solicitud de paja de agua, y firma de convenio de cooperación.Si lleva razón la recurrente en lo manifestado de que es la representante de una sociedad anónima mercantil y que ésta a su vez es propietaria de un de derecho indivisible en una propiedad que se ubica en Santa Rosa de Santo Domingo de Heredia folio real PRN03. Hecho segundo, se rechaza como un hecho para este recurso con las siguiente aclaración, si bien se suscribió un convenio de cooperación entre los copropietarios de la citada finca entre ellas la sociedad anónima que representa la recurrente y la municipalidad recurrida, dicho convenio se suscribió bajo la figura de contribución especial, y no por razones arbitrarias sino porque desde la perspectiva técnica del acueducto se determinó en aquella oportunidad que NO existía capacidad ni hídrica ni hidráulica para brindarle un servicio posterior de agua potable a la citada propiedad y que la misma es acusada por una servidumbre tal como se puede extraer de la propia prueba que aporta la recurrente.Ahora bien, de importancia para este informe es aclarar que por dicho convenio no se dio derecho a cada propietario de contar con un servicio de agua potable como se extrae de la lectura del hecho (…) (…) (…) Dicho instrumento se suscribió para la entrega de materiales necesarios para ampliar la tubería en un diámetro necesario que permitiera brindarle a la propiedad una paja de agua de media pulgada tal como sucedió en la disponibilidad de agua otorgada el 20 de mayo de 2024 por el acueducto municipal. NO lleva razón la recurrente al señalar que cada copropietario tenga derecho a construir una vivienda en dicha propiedad ya que no es permitido al existir más de 10 derechos en la propiedad y como se expuso el acceso a la finca es por una servidumbre lo que limita la posibilidad de disposición de los copropietarios conforme las condiciones expuestas en el artículo 270 del código civil. Hecho tercero, en este hecho esta representación rechaza como un hecho propio del recurso de amparo aclarando que el convenio si bien fue cumplido por las partes que lo suscribieron y se otorgó la disponibilidad de agua ese acto es único para la finca y no para cada derecho de los copropietarios.Ni le otorga derechos de construcción u otros trámites que son previos y necesarios para que construir o habitar. Por lo que se considera no es vinculante para este recurso esa manifestación de la recurrente. Hecho cuatro, se rechaza como un hecho para este recurso pues no se discute el hecho de la suscripción del convenio ni si se ejecutó o no. Por lo que se considera no es vinculante para este recurso tal manifestación. Hecho cinco, se rechaza, al igual a lo anteriormente señalado no se discute el hecho de la suscripción del convenio ni si se ejecutó o no. Por lo que se considera no es vinculante para este recurso tal manifestación. Hecho sexto, según se detalla en la resolución del acueducto municipal dicha disponibilidad de agua que es un acto previo a la materialización al servicio de agua potable que es la paja de agua, situación que se otorgó de manera posterior a la finca y como bien lo señala la recurrente en este hecho se otorgó una paja de agua para la finca y para una única vivienda unifamiliar.(punto 1 de su por tanto). la cual a la fecha no ha sido construida ya que no consta permisos de construcción otorgados para una vivienda unifamiliar, situación que así acredita la propia recurrente con la prueba que adjuntó. Tómese en cuenta lo dicho en la resolución del acueducto DA-DISP-5285-05-2024 del 24 de mayo de 2024, que en su parte final claramente dispuso, en lo que interesa: (…) Hecho séptimo, conforme a la prueba que se aporta por la recurrente se denota que si bien se otorgó por la municipalidad un permiso de construcción el mismo lo fue para tapia perimetral con 203 metros lineales y una caseta con baño de 10 metros cuadrados, únicamente no se ha otorgado permiso de construcción para vivienda unifamiliar para la citada finca, lo anterior lo demuestro con la certificación que adjunto de la Direccion de Servicios y Ordenamiento territorial órgano municipal encargado de otorgar eses permisos.Hecho octavo, se rechaza ya que no es cierto que sin ninguna comunicación se suspendió el servicio de agua potable a la propiedad, toda vez que como se puede observar en el informe de la Dirección de Acueducto municipal CRC-MSDH-DA-DIA-OF-033-2026, la instalación de paja de agua conectada en una primera instancia es de carácter temporal para la construcción de las tapias y caseta, mismas que no se han sido construidas, además porque se detectó que esa instalación de agua proporcionada se utilizaba por la recurrente para otros fines que no fue la otorgada ante el permiso de construcción aludido, por ende tal como lo señala los numerales del reglamento de prestación de servicio de agua potable de Santo Domingo, en sus artículos 2, 1l, y 21 obligan a los usuarios como a la municipalidad a su aplicación, en lo que interesa: (…) A partir de ello, queda constatado que aún no se ha instalada una paja de agua permanente para uso habitacional, porque no se ha otorgado permiso de construcción para la vivienda unifamiliar autorizada por esta municipalidad a la propiedad de interés, sino que en aquella oportunidad se suministró el servicio de agua para la construcción de la tapia y caseta misma que estaba supeditado al plazo del permiso de construcción, entonces al demostrarse que no se ha construido esas obras autorizadas y además de un uso indebido de las autorizaciones otorgadas por esta municipalidad a la propiedad en el entendido que se detectó la construcción de aparentes viviendas sin contar con la licencias constructivas, permiso otorgado por el término de un año para que iniciara esas obras lo que no ha sucedido denota que el permiso otorgado ya caducó o venció pues se observa que fue otorgado o liberado en el sistema APC el 06 de marzo de 2025 venciendo al año siguiente es decir el 06 de marzo de 2026, (ver resolución CRC-MSDH-DSOT-DI-RESOL-041-2025 FR 212812) que en su parte dispositiva en el punto 4), expresamente lo señala además señala la consecuencia en caso de vencimiento del mismo al indicar que tendría la recurrente y sus copropietarios volver a presentar la gestión para una nueva validación del permiso constructivo otorgado para las tapias y caseta únicamente ver punto 4) de la citada resolución.Por lo que la actuación municipal no es arbitraria intempestiva ni abusiva, sino que está sujeta al principio de legalidad, razonabilidad y proporcionalidad, ante lo expuesto y en aplicación del numeral 23 del reglamento de prestación de servicio de agua potable municipal que señala en lo que interesa (…) Queda demostrado que procedió la municipalidad a aplicar su regulación interna, lo que descarta violación al derecho constitucional aludido, ajustando u actuar al principio de legalidad. Además, lo anterior se respalda por lo dispuesto por el numeral 74 de la ley de construcciones, entre otras normas vinculantes. (…) Nótese en la prueba adjunta que ya está municipalidad ha actuado apegada a derecho y debido proceso y en el momento que detectó esas irregularidades en obras constructiva en la finca de la recurrente, se dio inicio al proceso de demolición de las obras constructivas que no poseen licencia municipal, amparado en el poder de policía que les otorga la materia urbanística a las municipalidades y refrendado por sendos fallos de esta Sala Constitucional y Tribunales Contenciosos, descartándose una lesión al derecho constitucional de acceso al agua potable como lo pretende la recurrente.Además, el ente Procurador ha dictaminado que el permiso constructivo es un acto de control previo, por lo que toda modificación importante a la obra requiere el aval municipal, protegiendo así el desarrollo ordenado del cantón. CONCLUSION Para esta Alcaldía Municipal, causa sorpresa el contenido de este recurso de amparo donde se cita que lo actuado por parte de esta Municipalidad es violatorio a un derecho constitucional, más por el contrario se demuestra que lo actuado es ajustado a derecho y principio de legalidad y que en su función por imperativo legal de fiscalización y su poder de policía le otorga, cumple con el deber de garantizar que el uso del servicio de agua potable por los pobladores del cantón sea acorde a la necesidad y en resguardo a la continuidad del mismo, por lo que pese a la cantidad de fallos que sustenta la recurrente en su recurso, los mismos distan casos concretos muy distintos a la situación que nos ocupa para lo cual se demuestra la recurrente que a contrario sensu ha usado el sistema administrativo de manera abusiva pretendiendo sacar provecho de actos que son definidos para aspectos concretos y al pretender usarlos como una ampliación de derechos que violentan por su actuación el principio de legalidad debido proceso y acto administrativo objetivo.Es consideración de esta representación que los fallos aportados en el libelo de recurso tienen relación a aspectos muy diferentes al actuado ya que son bien se debe garantizar el derecho de agua potable es en tanto y cuanto se cuenta con las condiciones de legalidad y en este asunto no es así, además no hay vivienda construida en el lugar que permita dar el servicio permanente a la finca descartándose la necesidad y derecho al servicio de agua potable para habitación familiar. Como elemento de sustento para este informe extraigo parte del fallo de esa Sala donde resolvió en lo que interesa: el fallo de las 9:20 horas del 06 de febrero de 2026 Número 2026-004363 (…)”. Solicita que se declare sin lugar el recurso.
  3. 4A través de escrito incorporado al expediente electrónico en fecha 22 de junio de 2026, Gerardo Ortega Fonseca, presidente del Concejo Municipal de Santo Domingo, informa bajo fe de juramento en los siguientes términos: “(…) SOBRE EL ELENCO DE HECHOS Y ACCIONES ALEGADAS. Sobre los hechos debe manifestarse específicamente, que en lo que refiere a las acciones de conocimiento del Concejo Municipal. Tal y como lo expresa la misma recurrente, se tiene como antecedentes ante el órgano colegiado que integro lo siguiente: a) Tal y como lo manifiesta la recurrente, en el Hecho segundo, si bien el Concejo Municipal, en razón de sus competencias y atribuciones, de conformidad a lo establecido en el artículo 13 inciso e) del Código Municipal, aprobó y autorizó, la firma de un convenio de cooperación entre esta municipalidad y los copropietarios de la citada finca entre ellas la sociedad anónima que representa la recurrente; debe aclararse, tal y como lo detalla en forma amplia la Alcaldía Municipal, en el informe rendido ante esta Sala Constitucional, sobre este recurso, que dicho convenio se suscribió bajo la figura de contribución especial, que habilita el artículo 70 de la Ley de Planificación Urbana.Y no por razones arbitrarias, sino porque desde la perspectiva técnica de la Dirección de Acueducto Municipal, se determinó en aquella oportunidad que NO existía capacidad ni hídrica ni hidráulica, para brindarle un servicio posterior de agua potable a la citada propiedad y que la misma es acusada por una servidumbre, tal como se puede extraer de la propia prueba que aporta la recurrente. b) Asimismo, de importancia para este informe, es aclarar que la autorización de la firma del convenio, dada por el Concejo Municipal, tal y como lo detalla el informe del Alcalde Municipal a esta Sala, no dio derecho a cada propietario de contar con un servicio de agua potable como se extrae de la lectura del hecho (…) (…) (…) Dicho Convenio, se suscribió para la entrega de materiales necesarios para ampliar la tubería en un diámetro necesario que permitiera brindarle a la propiedad una paja de agua de media pulgada tal como sucedió en la disponibilidad de agua otorgada el 20 de mayo de 2024 por el acueducto municipal.NO lleva razón la recurrente al señalar que cada copropietario tenga derecho a construir una vivienda en dicha propiedad ya que no es permitido al existir más de 10 derechos en la propiedad y como se expuso por parte de la Alcaldía Municipal, el acceso a la finca es por una servidumbre lo que limita la posibilidad de disposición de los copropietarios conforme las condiciones expuestas en el artículo 270 del código civil. c) Sobre los demás hechos, debe informarse a esta Honorable Sala, que por referir los temas, a asuntos de competencia de las dependencias municipales que están al mando de la Alcaldía Municipal (DIRECCIÓN DEL ACUEDUCTO MUNICIPAL). Es a esa Alcaldía Municipal, a quien corresponde referirse en mayor detalle, a las acciones realizadas y ejecutadas, en razón de lo alegado por la recurrente en este recurso. (…)”. (sic). Solicita que se declare sin lugar el recurso.
  4. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I. OBJETO DEL RECURSO

La recurrente manifiesta que es vecina de Santo Domingo de Heredia. Indica que ostenta la representación de una sociedad que es propietaria de un derecho sobre el inmueble bajo el folio real número PRN01. Señala que, el 29 de abril de 2024, la accionada suscribió, junto con los propietarios del inmueble, un convenio de entrega de materiales para construir una tubería de distribución de agua potable en la Dirección02 del distrito de Santa Rosa. Expone que, el 24 de mayo de 2024, la recurrida resolvió la solicitud de disponibilidad de agua potable de los copropietarios de la finca; no obstante, acusa que, posteriormente, les suspendió el abastecimiento sin comunicación previa ni motivación técnica o jurídica alguna. Estima lesionados sus derechos fundamentales al agua y a un medio ambiente sano y ecológicamente equilibrado.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados, o bien, porque la recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)La amparada Nombre01, cédula de identidad CED02, ostenta la representación judicial y extrajudicial de 3-101-868017 Sociedad Anónima, una persona jurídica propietaria de la finca bajo número de folio real PRN04, la cual se encuentra ubicada en Santa Rosa, Santo Domingo, Heredia (ver prueba aportada).
  • b)El 29 de abril de 2024, la amparada -en representación de la sociedad citada supra y de los demás propietarios del inmueble indicado- y la Municipalidad de Santo Domingo -representada por el alcalde municipal-, suscribieron un convenio titulado “CONVENIO DE COOPERACIÓN PARA ENTREGA DE MATERIALES PARA OBRAS DE MEJORA DE INFRAESTRUCTURA URBANA DEL ACUEDUCTO MUNICIPAL, DE CONFORMIDAD A LO ESTIPULADO EN EL ARTÍCULO 70 DE LA LEY DE PLANIFICACIÓN URBANA”, cuya finalidad fue la entrega de materiales para cubrir la necesidad de contar con una tubería de distribución de agua potable en la Dirección02 del distrito de Santa Rosa, bajo la figura jurídica de la contribución especial y, así, disponer el servicio de agua a dicha propiedad para construir una vivienda, previo cumplimiento del permiso constructivo y pago de su impuesto (ver prueba aportada).
  • c)El 24 de mayo de 2024, mediante oficio No. DA-DISP-5285-05-2024, la Dirección de Acueducto Municipal de la autoridad recurrida determinó lo siguiente: “(…) POR TANTO: 1. Con fundamento en los anteriores Considerandos esta Ingeniería de Acueducto Municipal, procede a RATIFICAR EL OTORGAMIENTO de la Disponibilidad de Agua para LA CONSTRUCCION DE UNA VIVIENDA UNIFAMILIAR UNICAMENTE sobre la propiedad con plano H-0814195-2002 y finca PRN05. Solicitado por su propietario Nombre01 con cedula CED01 y otros. Según CUARTO CONSIDERANDO, es viable el otorgamiento de la disponibilidad de agua solicitada, se cumplieron a satisfacción las condiciones técnicas del: primero, oficio SMC-0120-03-2024 del 8 de marzo del 2024 del Concejo Municipal; segundo, oficio DA-IA-OF-139-2022 el 8 de noviembre de 2022; tercero, "Convenio de cooperación para la entrega de materiales para obras de mejoras a infraestructura del Acueducto de conformidad a lo estipulado en el Artículo 38 y 70 de la Ley de Planificación Urbana entre la Municipalidad de Santo Domingo y copropietarios Finca FR 212812" firmado el 29 de abril del 2024-. 2. Se recuerda al administrado que es responsabilidad del profesional responsable de la obra gestionar respectivamente su: suelo, diseño, permisos y construcción, según lo estipulado en la normativa vigente, presentando oportunamente su croquis de segregación (ver TERCER CONSIDERANDO punto cuarto). Se recuerda que, por competencia, existe la fiscalización por la Dirección de Servicios y Ordenamiento Territorial DSOT y sus departamentos en materia de uso del suelo, control urbano, bienes inmuebles, diseño y construcción de edificaciones. Lo anterior conforme a: Artículo 65 inciso 1) de la Ley General de Administración Pública No. 6227; Artículos 3, 4, 8 y 9 Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos No. 8220; "Código de instalaciones hidráulicas y sanitarias en edificaciones" del CFIA y demás normas afines. Se recuerda a la DSOT y demás involucrados, que todo fraccionamiento y construcción deberá estar respaldado de un oficio de disponibilidad de agua potable vigente según Artículos 13, 18, 27, 36, 37, 39, 105, 120 del Reglamento de Fraccionamientos y Urbanizaciones RFU. Se recuerda que: el medidor ultrasónico Arad modelo SONATA de 12mm número 22A057714 (donado) será custodiado por el Acueducto, e instalado una vez el administrado gestione efectivamente el permiso de construcción de su vivienda unifamiliar únicamente (materialización del servicio de agua potable). 3. Esta Ingeniería de Acueducto Municipal le indica a los inspectores municipales y al interesado que esta disponibilidad está sujeta al cumplimiento de todos los requisitos y trámites dispuestos por el reglamento de este Acueducto y las buenas prácticas dictadas por el Colegio Federado de Ingenieros y de Arquitectos. La presente resolución NO implica aprobación alguna de permisos de construcción, número de construcciones por lote, visado de planos, aprobación de servidumbre, uso de suelo o Patente; trámites que tienen que realizarse, cumpliendo la normativa y trámites correspondientes, ante los Departamentos de Catastro y Control Urbano de esta Municipalidad, y Departamento de Patentes y Cobros según corresponda. Esta resolución se emite por un plazo de UN AÑO, contado a partir de su fecha de emisión, transcurrido el cual se deberá proceder a tramitar una nueva disponibilidad para agua potable. Para la presente resolución aplican en los cinco días siguientes a la notificación el recurso, según los términos del numeral 171 del Código Municipal Vigente. (…)” (ver prueba aportada).
  • d)El 9 de junio de 2025, las partes suscribientes del convenio citado supra, firmaron un finiquito total de este (ver prueba aportada).
  • e)El 14 de abril de 2026, la Dirección de Acueducto Municipal de la accionada hizo costar al personal de la Municipalidad, vía correo electrónico, lo siguiente: “(…) Departamento de Agestión de Cobros; se logra determinar que en la finca con folio real PRN05, distrito de Santa Rosa, se están construyendo varias unidades habitacionales, que no se logra determinar en el sistema Institucional (SIEM), la existencia de permisos de construcción aprobados para el desarrollo de dichas construcciones; que la Disponibilidad de agua y el Convenio de partes para mejoras de Infraestructura Pública, se establecido para la construcción de una vivienda unifamiliar únicamente, lográndose observar mediante imanes que al menos se están y se han construido cuatro unidades de vivienda, y se continua en el proceso constructivo. Por lo anteriormente expuesto, se procede a comunicar y advertir otras unidades administrativas de la Municipalidad de Santo Domingo, que con fundamento en lo establecido en la Ley General de Control Interno, y al procedimiento de Control Interno institucional; el hecho de que en apariencia en la finca con folio real PRN06, ubicada en el distrito de Santa Rosa, se presenta una aparente construcción ilegal de obras de Infraestructura; que según derecho corresponde, el Departamento de Comercial de Acueducto procedió a ordenar la suspensión del servicio de agua potable que se estaba utilizando para obras constructivas, con lo cual no se le estaba dando el uso para el cual se dio la Disponibilidad de Agua Potable y se firmo el Convenio de Partes; que el servicio de agua potable se restablecerá una vez se demuestre la regularización de la finca, en cuanto a la tramitación de permisos de urbanización o condominio (desfogue pluvial, agua potable, Infraestrura vial y otras obra civiles). Se recomienda a las distintas unidades administrativas, se actúe con la mayor premura, dado que las obras constructivas se mantienen activas y en proceso. En caso de haberse realizo alguna gestión o contar con los debidos permisos de construcción, se soclita se traslade la información al Departamento de Acueducto, dado que se debe verificar la capacidad para la dotación del servicio de agua potable, dado que tal y como se indicó, únicamente se tiene disponibilidad aprobada para una vivienda unifamiliar. Se adjunta parte del expediente con el cual cuenta el Acueducto Municipal para su debida referencia. En caso de ser requerido un documento que recopila todos los archivis adjuntos, que por su capacidad debe ser copiado en un dispositivo externo de memoria. (sic) (…)” (ver prueba aportada).
  • f)El 7 de mayo de 2026, se notificó a la amparada del documento número CRC-MSDH-DSOT-CUR-INICIO PROCEDIMIENTO DE DEMOLICION-008-2026 del 18 de marzo de 2026, que informa a los propietarios del inmueble sobre el cual la sociedad que representa la tutelada tiene un derecho, acerca del inicio de un proceso de demolición de una serie de viviendas construidas en dicha finca (ver prueba aportada).

III. SOBRE EL CASO CONCRETO

Del informe rendido por el representante de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por demostrado que la amparada Nombre01, cédula de identidad CED02, ostenta la representación judicial y extrajudicial de 3-101-868017 Sociedad Anónima, una persona jurídica propietaria de la finca bajo número de folio real PRN04, la cual se encuentra ubicada en Santa Rosa, Santo Domingo, Heredia. Asimismo, se constata que el 29 de abril de 2024, la amparada -en representación de la sociedad citada supra y de los demás propietarios del inmueble indicado- y la Municipalidad de Santo Domingo -representada por el alcalde municipal-, suscribieron un convenio titulado “CONVENIO DE COOPERACIÓN PARA ENTREGA DE MATERIALES PARA OBRAS DE MEJORA DE INFRAESTRUCTURA URBANA DEL ACUEDUCTO MUNICIPAL, DE CONFORMIDAD A LO ESTIPULADO EN EL ARTÍCULO 70 DE LA LEY DE PLANIFICACIÓN URBANA”, cuya finalidad fue la entrega de materiales para cubrir la necesidad de contar con una tubería de distribución de agua potable en la Dirección02 del distrito de Santa Rosa, bajo la figura jurídica de la contribución especial y, así, disponer el servicio de agua a dicha propiedad para construir una vivienda, previo cumplimiento del permiso constructivo y pago de su impuesto.

Acto seguido, se verifica que el 24 de mayo de 2024, mediante oficio No. DA-DISP-5285-05-2024, la Dirección de Acueducto Municipal de la autoridad recurrida determinó lo siguiente: “(…) POR TANTO: 1. Con fundamento en los anteriores Considerandos esta Ingeniería de Acueducto Municipal, procede a RATIFICAR EL OTORGAMIENTO de la Disponibilidad de Agua para LA CONSTRUCCION DE UNA VIVIENDA UNIFAMILIAR UNICAMENTE sobre la propiedad con plano H-0814195-2002 y finca PRN05. Solicitado por su propietario Nombre01 con cedula CED01 y otros. Según CUARTO CONSIDERANDO, es viable el otorgamiento de la disponibilidad de agua solicitada, se cumplieron a satisfacción las condiciones técnicas del: primero, oficio SMC-0120-03-2024 del 8 de marzo del 2024 del Concejo Municipal; segundo, oficio DA-IA-OF-139-2022 el 8 de noviembre de 2022; tercero, "Convenio de cooperación para la entrega de materiales para obras de mejoras a infraestructura del Acueducto de conformidad a lo estipulado en el Artículo 38 y 70 de la Ley de Planificación Urbana entre la Municipalidad de Santo Domingo y copropietarios Finca FR 212812" firmado el 29 de abril del 2024-. 2.

Se recuerda al administrado que es responsabilidad del profesional responsable de la obra gestionar respectivamente su: suelo, diseño, permisos y construcción, según lo estipulado en la normativa vigente, presentando oportunamente su croquis de segregación (ver TERCER CONSIDERANDO punto cuarto). Se recuerda que, por competencia, existe la fiscalización por la Dirección de Servicios y Ordenamiento Territorial DSOT y sus departamentos en materia de uso del suelo, control urbano, bienes inmuebles, diseño y construcción de edificaciones. Lo anterior conforme a: Artículo 65 inciso 1) de la Ley General de Administración Pública No. 6227; Artículos 3, 4, 8 y 9 Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos No. 8220; "Código de instalaciones hidráulicas y sanitarias en edificaciones" del CFIA y demás normas afines. Se recuerda a la DSOT y demás involucrados, que todo fraccionamiento y construcción deberá estar respaldado de un oficio de disponibilidad de agua potable vigente según Artículos 13, 18, 27, 36, 37, 39, 105, 120 del Reglamento de Fraccionamientos y Urbanizaciones RFU.

Se recuerda que: el medidor ultrasónico Arad modelo SONATA de 12mm número 22A057714 (donado) será custodiado por el Acueducto, e instalado una vez el administrado gestione efectivamente el permiso de construcción de su vivienda unifamiliar únicamente (materialización del servicio de agua potable). 3. Esta Ingeniería de Acueducto Municipal le indica a los inspectores municipales y al interesado que esta disponibilidad está sujeta al cumplimiento de todos los requisitos y trámites dispuestos por el reglamento de este Acueducto y las buenas prácticas dictadas por el Colegio Federado de Ingenieros y de Arquitectos. La presente resolución NO implica aprobación alguna de permisos de construcción, número de construcciones por lote, visado de planos, aprobación de servidumbre, uso de suelo o Patente; trámites que tienen que realizarse, cumpliendo la normativa y trámites correspondientes, ante los Departamentos de Catastro y Control Urbano de esta Municipalidad, y Departamento de Patentes y Cobros según corresponda.

Esta resolución se emite por un plazo de UN AÑO, contado a partir de su fecha de emisión, transcurrido el cual se deberá proceder a tramitar una nueva disponibilidad para agua potable. Para la presente resolución aplican en los cinco días siguientes a la notificación el recurso, según los términos del numeral 171 del Código Municipal Vigente. (…)”. Después, se comprueba que el 9 de junio de 2025, las partes suscribientes del convenio citado supra, firmaron un finiquito total de este. Ulteriormente, se deduce que el 14 de abril de 2026, la Dirección de Acueducto Municipal de la accionada hizo costar al personal de la Municipalidad, vía correo electrónico, lo siguiente: “(…) Departamento de Agestión de Cobros; se logra determinar que en la finca con folio real PRN05, distrito de Santa Rosa, se están construyendo varias unidades habitacionales, que no se logra determinar en el sistema Institucional (SIEM), la existencia de permisos de construcción aprobados para el desarrollo de dichas construcciones; que la Disponibilidad de agua y el Convenio de partes para mejoras de Infraestructura Pública, se establecido para la construcción de una vivienda unifamiliar únicamente, lográndose observar mediante imanes que al menos se están y se han construido cuatro unidades de vivienda, y se continua en el proceso constructivo.

Por lo anteriormente expuesto, se procede a comunicar y advertir otras unidades administrativas de la Municipalidad de Santo Domingo, que con fundamento en lo establecido en la Ley General de Control Interno, y al procedimiento de Control Interno institucional; el hecho de que en apariencia en la finca con folio real PRN06, ubicada en el distrito de Santa Rosa, se presenta una aparente construcción ilegal de obras de Infraestructura; que según derecho corresponde, el Departamento de Comercial de Acueducto procedió a ordenar la suspensión del servicio de agua potable que se estaba utilizando para obras constructivas, con lo cual no se le estaba dando el uso para el cual se dio la Disponibilidad de Agua Potable y se firmo el Convenio de Partes; que el servicio de agua potable se restablecerá una vez se demuestre la regularización de la finca, en cuanto a la tramitación de permisos de urbanización o condominio (desfogue pluvial, agua potable, Infraestrura vial y otras obra civiles).

Se recomienda a las distintas unidades administrativas, se actúe con la mayor premura, dado que las obras constructivas se mantienen activas y en proceso. En caso de haberse realizo alguna gestión o contar con los debidos permisos de construcción, se soclita se traslade la información al Departamento de Acueducto, dado que se debe verificar la capacidad para la dotación del servicio de agua potable, dado que tal y como se indicó, únicamente se tiene disponibilidad aprobada para una vivienda unifamiliar. Se adjunta parte del expediente con el cual cuenta el Acueducto Municipal para su debida referencia. En caso de ser requerido un documento que recopila todos los archivis adjuntos, que por su capacidad debe ser copiado en un dispositivo externo de memoria. (sic) (…)”. Por último, se tiene que el 7 de mayo de 2026, se notificó a la amparada del documento número CRC-MSDH-DSOT-CUR-INICIO PROCEDIMIENTO DE DEMOLICION-008-2026 del 18 de marzo de 2026, que informa a los propietarios del inmueble sobre el cual la sociedad que representa la tutelada tiene un derecho, acerca del inicio de un proceso de demolición de una serie de viviendas construidas en dicha finca.

Así las cosas, se descarta una lesión a los derechos fundamentales de la tutelada. En primera instancia, queda acreditado que el motivo por el cual la disponibilidad de agua potable fue suspendida en la propiedad sobre la cual la sociedad que representa la amparada tiene un derecho, obedece a un incumplimiento de las condiciones de uso de dicho servicio. Contrario a lo alegado por la recurrente, esta situación le fue debidamente informada en fecha 7 de mayo de 2026, mediante el documento número CRC-MSDH-DSOT-CUR-INICIO PROCEDIMIENTO DE DEMOLICION-008-2026 del 18 de marzo de 2026, el cual contenía una justificación jurídica del incumplimiento de los requisitos del otorgamiento del permiso que había tramitado. Bajo esta tesitura, existen razones objetivas que, a la luz de la normativa vigente, justifican la negativa a proporcionar el servicio, no tratándose de situaciones arbitrarias o ilegítimas de parte de la accionada.

En todo caso, las inconformidades que plantea la amparada corresponden a un asunto de legalidad ordinaria que no puede ser examinado por esta jurisdicción, pues ello excede la naturaleza sumaria del recurso de amparo y la competencia de este Tribunal. Por ello, estas inquietudes deberán ser dilucidadas ante la institución accionada a través de los mecanismos establecidos para ello, o bien, en la jurisdicción ordinaria competente, pues estas son sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, lo procedente es desestimar el presente recurso.

IV. NOTA DEL MAGISTRADO RUEDA LEAL

Debo advertir que desde la sentencia nro. 2019002355 de las 9:30 de 12 de febrero de 2019, mi postura ha sido la siguiente en relación con los recursos de amparo cuando estos han sido planteados a favor de una persona jurídica:

“…en la Opinión Consultiva 22-16 del 26 de febrero de 2016, la Corte Interamericana de Derechos Humanos indicó que si bien algunos Estados reconocen el derecho de petición a personas jurídicas con condiciones especiales, como lo son los sindicatos, partidos políticos o representantes de pueblos indígenas, comunidades afrodescendientes o grupos específicos, lo cierto es que “El artículo 1.2 de la Convención Americana sólo consagra derechos a favor de personas físicas, por lo que las personas jurídicas no son titulares de los derechos consagrados en dicho tratado”. Por otro lado, en la misma opinión consultiva, la Corte Interamericana dispuso que, en ciertos contextos particulares, las personas físicas pueden llegar a ejercer sus derechos a través de personas jurídicas (verbigracia, a través de un medio de comunicación, como acaeció en el caso Nombre02 y otros contra Venezuela); empero, a efectos de que ello sea tutelable ante el sistema interamericano, “el ejercicio del derecho a través de una persona jurídica debe involucrar una relación esencial y directa entre la persona natural que requiere protección por parte del sistema interamericano y la persona jurídica a través de la cual se produjo la violación, por cuanto no es suficiente con un simple vínculo entre ambas personas para concluir que efectivamente se están protegiendo los derechos de personas físicas y no de las personas jurídicas.

En efecto, se debe probar más allá de la simple participación de la persona natural en las actividades propias de la persona jurídica, de forma que dicha participación se relacione de manera sustancial con los derechos alegados como vulnerados.” (énfasis agregado) (OC. 22/16)”.

En el sub lite, el recurso de amparo es interpuesto por la recurrente en su condición de representante de la sociedad anónima 3-101-868017; sin embargo, alega que “la suspensión del servicio de agua potable afecta tanto a mi persona directamente, ya no a la sociedad que represento”. En virtud de lo anterior, considero que existe una relación esencial entre la argüida afectación a una persona jurídica y la eventual lesión a una física; razón por la cual resulta procedente el análisis por el fondo de este asunto a fin de verificar si se ha dado o no el quebranto reclamado.

V. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

POR TANTO:

Se declara sin lugar el recurso. El magistrado Rueda Leal consigna nota. Notifíquese.- Fernando Castillo V.
