CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty minutes on 20 August 2026.
Post-judgment application filed by Nombre01, IN HIS CAPACITY AS EXECUTIVE DIRECTOR OF THE NATIONAL ROAD COUNCIL (CONAVI), in case file no. 26-009841-0007-CO.
Background:
Justice Rueda Leal drafted this decision; and, Reasons:
I.In judgment no. 2026025653 issued at 9:25 hours on 10 July 2026, the following was ordered:
“ON THE SPECIFIC CASE. In this case, the applicant states that a tree posing a risk to people who live and travel in the area is located in front of the respondent municipality’s building. She argues that she has repeatedly asked the local government to remove the aforementioned tree; however, this has not happened. She also notes that a request was made for the matter to be taken up with other public institutions so they could address the issue and eliminate the risk; however, the relevant steps have not been taken.
Upon review of the record, it is established that, at ordinary session no. 06-2025 of 10 February 2025, the respondent municipality considered the situation concerning the tree described by the protected party; however, it determined that the tree is located ‘in front of private property and within the right-of-way of Dirección02.’ On 14 March 2025, the respondent municipality sent an application to Conavi’s Roads and Bridges Maintenance Management, requesting its intervention to address the matter of the aforementioned tree. The Roads and Bridges Maintenance Management was notified of the order commencing these proceedings on 8 June 2026. In official letter no. CARTA-CONAVI-CA-DIE-GCSV-DRC-971-2026 of 10 June 2026, Conavi’s Roads and Bridges Maintenance Management stated: ‘The assessment of tree species located within or near the right-of-way is a specialized matter requiring the involvement of professionals competent in forestry, who must determine the tree’s condition, structural stability, potential risk of falling, effects on existing infrastructure, and the technical appropriateness of any pruning, felling, or removal work.
Accordingly, any intervention on a tree must be based in advance on a field inspection and a specialized technical opinion, as well as compliance with applicable environmental regulations and the corresponding administrative procedures. In this case, after reviewing the available background, the need for a specialized technical assessment was determined, and the matter was therefore referred to the competent forestry professional to conduct the relevant inspection and issue the corresponding technical opinion. Consequently, any determination as to whether the tree at issue in the application should be intervened upon is subject to the outcome of that specialized technical assessment, which is essential to this Administration’s decision-making.’ First, it should be noted that, in this particular case, it is not for this Court to determine whether the tree in question should be pruned or eventually felled, as the applicant seeks.
This is because such a determination requires a broad, technical, and specialized analysis that exceeds the summary nature of this amparo proceeding and therefore must be determined through the corresponding ordinary procedure.
In that regard, it is clear that, in this case, it is for Conavi’s Roads and Bridges Maintenance Management to conduct the relevant technical study to define the tree’s condition, as well as any actions that should be taken in response to risk situations that may be confirmed, as that department itself acknowledges in official letter no. CARTA-CONAVI-CA-DIE-GCSV-DRC-971-2026 of 10 June 2026. However, it has not been established that the authority ultimately took those steps, even though the matter was referred to it in March 2025—that is, more than 1 year ago.
Accordingly, this Chamber’s intervention is necessary precisely because of the delay by Conavi authorities in addressing this matter and conducting the relevant technical studies, especially since it must be determined whether the risk to the community alleged by the applicant exists.
Therefore, the amparo application is granted on this point, on the terms set out in the operative part of this decision.
As for the Municipality of Goicoechea, the application is denied because, since February 2025, it had been determined that Conavi was responsible for addressing the matter (because the tree in question is within the right-of-way of a national route), and the matter was referred to that department in March of that same year, as stated above. In that regard, no action or omission by the respondent municipality that infringed fundamental rights can be discerned.
Finally, although the applicant refers in a subsequent brief to circumstances concerning another tree in the community (located in front of Centeno Güell school), it should be noted that these proceedings were initiated specifically concerning the tree in front of the municipal building, as set out in the specific terms of the initiating brief. Thus, the matters raised in that subsequent brief concern circumstances beyond the specific subject matter of this case, and the Court therefore cannot rule on that new issue in these proceedings (…)”
Therefore:
The amparo application is partially granted, solely with respect to the National Road Council. The person serving as manager of the National Road Council’s Roads and Bridges Maintenance Management is ordered to issue the necessary instructions, coordinate as appropriate, and carry out all actions within the scope of their powers so that, within a maximum period of ONE MONTH from notification of this judgment, the relevant assessments and technical studies are conducted and a final opinion is issued concerning the condition of the tree at issue in this application. The respondent authority is advised that, pursuant to Article 71 of the Constitutional Jurisdiction Act, anyone who receives an order to be carried out or enforced, issued in an amparo proceeding, and fails to carry it out or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The National Road Council is ordered to pay the costs, damages, and losses caused by the acts underlying this declaration, to be assessed in enforcement of judgment through the administrative-litigation jurisdiction. In all other respects, the amparo application is denied. Notify the parties.”
In this case, the respondent party requests an extension of the period granted in the principal judgment in this matter. To justify this request, it explains that the relevant forestry opinion has already been issued, but a contract specifically for carrying out the felling and lopping of the tree is being formalized, which requires additional time.
However, it should be noted that in the aforementioned judgment this Chamber did not order the felling or lopping of the tree in question, as it specifically reasoned as follows:
“First, it should be noted that, in this particular case, it is not for this Court to determine whether the tree in question should be pruned or eventually felled, as the applicant seeks. This is because such a determination requires a broad, technical, and specialized analysis that exceeds the summary nature of this amparo proceeding and therefore must be determined through the corresponding ordinary procedure.
In that regard, it is clear that, in this case, it is for Conavi’s Roads and Bridges Maintenance Management to conduct the relevant technical study to define the tree’s condition, as well as any actions that should be taken in response to risk situations that may be confirmed, as that department itself acknowledges in official letter no. CARTA-CONAVI-CA-DIE-GCSV-DRC-971-2026 of 10 June 2026. Accordingly, this Chamber’s intervention is necessary precisely because of the delay by Conavi authorities in addressing this matter and conducting the relevant technical studies, especially since it must be determined whether the risk to the community alleged by the applicant exists (…)” In that regard, the operative part of the judgment ordered only that “within a maximum period of ONE MONTH from notification of this judgment, the relevant assessments and technical studies be conducted and a final opinion be issued concerning the condition of the tree at issue in this application.” Thus, the additional period requested by the respondent authority specifically to carry out pruning and lopping of the tree is inconsistent with what this Court ordered in this case, since, as reiterated, no intervention of that kind was ordered at any time.
Consequently, the application filed is denied.
The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve these from the Court office within a maximum period of 30 business days from notification of this judgment. Any material not retrieved within this period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011, published in Judicial Bulletin no. 19 of 26 January 2012, as well as the Superior Council of the Judiciary’s resolution approved in Article LXXXI of session no. 43-12 held on 3 May 2012.
Therefore:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .
Gestión posterior planteada por Nombre01, EN SU CONDICIÓN DE DIRECTOR EJECUTIVO DEL CONSEJO NACIONAL DE VIALIDAD (CONAVI), en el expediente nro. 26-009841-0007-CO.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.En la sentencia nro. 2026025653 de las 9:25 horas de 10 de julio de 2026 se dispuso:
“SOBRE EL CASO EN CONCRETO. En el sub lite, la recurrente expone que, frente al edificio de la municipalidad recurrida, se ubica un árbol que representa un riesgo para las personas que residen y transitan por el lugar. Arguye que en varias ocasiones ha solicitado al gobierno local la eliminación del árbol antedicho; sin embargo, esto no ha ocurrido. Además, acota que se solicitó también que se gestionara ante otras instituciones públicas para que atendieran el asunto y se eliminara el riesgo; empero, no se ha diligenciado lo pertinente.
Del estudio de los autos se tiene por demostrado, que, en la sesión ordinaria nro. 06-2025 de 10 de febrero de 2025, la municipalidad accionada conoció la situación del árbol expuesto por la tutelada; empero, determinó que este se ubica “frente a propiedad privada y sobre el derecho de vía de la Dirección02”. El 14 de marzo de 2025, la municipalidad recurrida remitió una gestión a la Gerencia de Conservación de Vías y Puentes del Conavi, mediante la cual solicitó su intervención para abordar el tema del árbol de marras. La Gerencia de Conservación de Vías y Puentes fue notificada de la resolución de curso de este proceso el 8 de junio de 2026. Mediante el oficio nro. CARTA-CONAVI-CA-DIE-GCSV-DRC-971-2026 de 10 de junio de 2026, la Gerencia de Conservación de Vías y Puentes de Conavi detalló: “la valoración de especies arbóreas ubicadas dentro o en las inmediaciones del derecho de vía constituye una materia especializada que requiere la intervención de profesionales competentes en el área forestal, quienes deben determinar la condición del árbol, su estabilidad estructural, el riesgo potencial de caída, la afectación a la infraestructura existente y la procedencia técnica de eventuales labores de poda, corta o remoción.
En virtud de lo anterior, cualquier intervención sobre un árbol debe sustentarse previamente en una inspección de campo y en un criterio técnico especializado, así como en el cumplimiento de la normativa ambiental aplicable y de los procedimientos administrativos correspondientes. Para el caso que nos ocupa, una vez revisados los antecedentes disponibles, se determinó la necesidad de contar con una valoración técnica especializada, razón por la cual la gestión fue trasladada al profesional forestal competente para la realización de la inspección respectiva y la emisión del criterio técnico correspondiente. Por consiguiente, la eventual determinación sobre la necesidad o no de intervenir el árbol objeto de la gestión se encuentra sujeta al resultado de dicha valoración técnica especializada, la cual constituye el insumo indispensable para la toma de decisiones por parte de esta Administración.”.
En primer lugar, cabe advertir que, en este caso particular, no le corresponde a este Tribunal establecer si el árbol en cuestión debe ser podado o eventualmente derribado, como pretende la accionante. Lo anterior debido a que tal determinación requiere un análisis amplio, técnico y especializado, que excede la naturaleza sumaria de este proceso de amparo y, por ende, debe ser definido en la vía ordinaria correspondiente.
En ese tanto, justamente se observa que en el caso de marras le corresponde a la Gerencia de Conservación de Vías y Puentes del Conavi efectuar el estudio técnico correspondiente, para definir las condiciones del árbol, así como las eventuales acciones que deben ejecutarse ante situaciones de riesgo que puedan corroborarse, según lo reconoce esa propia dependencia en el oficio nro. CARTA-CONAVI-CA-DIE-GCSV-DRC-971-2026 de 10 de junio de 2026. Sin embargo, no se constata que finalmente dicha autoridad haya diligenciado tales actuaciones, pese a que la situación le fue trasladada desde marzo de 2025; sea, hace más de 1 año.
Así las cosas, resulta necesaria la intervención de esta Sala, precisamente respecto de la dilación de las autoridades del Conavi para atender el caso de marras y realizar los estudios técnicos pertinentes, máxime que, precisamente, debe determinarse si se configura el riesgo que la accionante señala que existe para la comunidad.
Ergo, se declara con lugar el recurso en cuanto a este extremo, en los términos que se indican en la parte dispositiva de este pronunciamiento.
Por su parte, en relación con la Municipalidad de Goicoechea se desestima el recurso, pues se observa que desde febrero de 2025 se determinó que el abordaje del asunto era competencia del Conavi (por encontrarse el árbol en cuestión sobre el derecho de vía de una ruta nacional), y se trasladó a esa última dependencia en marzo de ese mismo año, tal y como se indicó supra. En ese tanto, no es posible advertir alguna acción u omisión lesiva de derechos fundamentales por parte de la municipalidad recurrida.
Finalmente, si bien en un escrito posterior la recurrente expone situaciones atinentes a otro árbol de la comunidad (ubicado al frente de la escuela Centeno Güell), cabe advertir que este proceso fue cursado específicamente respecto del árbol que se encuentra frente al edificio municipal, en los términos específicos del escrito de interposición. De tal modo, lo expuesto en ese escrito posterior atañe a situaciones que exceden el objeto concreto del sub iudice, motivo por el cual no puede este Tribunal emitir algún pronunciamiento respecto de ese nuevo extremo en este proceso (…)
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente respecto del Consejo Nacional de Vialidad. Se ordena a quien ocupe el cargo de gerente de Conservación de Vías y Puentes del Consejo Nacional de Vialidad, que gire las órdenes pertinentes, coordine lo correspondiente y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se realicen las valoraciones y estudios técnicos correspondientes y se emita el criterio definitivo respecto de la situación del árbol objeto de este recurso. Se advierte a la autoridad recurrida, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Consejo Nacional de Vialidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la vía contencioso-administrativa. En todo lo demás, se declara sin lugar el recurso. Notifíquese.”.
En el sub lite, la parte recurrida solicita una ampliación del plazo otorgado en la sentencia principal de este asunto. Para justificar tal requerimiento, explica que ya se emitió el criterio forestal respectivo, pero se está formalizando una contratación propiamente para la ejecución de las labores de corta y descuaje del árbol, lo cual amerita un tiempo adicional.
Sin embargo, cabe advertir que en la sentencia de marras esta Sala no ordenó la corta o descuaje del árbol en cuestión, pues específicamente se razonó lo siguiente:
“En primer lugar, cabe advertir que, en este caso particular, no le corresponde a este Tribunal establecer si el árbol en cuestión debe ser podado o eventualmente derribado, como pretende la accionante. Lo anterior debido a que tal determinación requiere un análisis amplio, técnico y especializado, que excede la naturaleza sumaria de este proceso de amparo y, por ende, debe ser definido en la vía ordinaria correspondiente.
En ese tanto, justamente se observa que en el caso de marras le corresponde a la Gerencia de Conservación de Vías y Puentes del Conavi efectuar el estudio técnico correspondiente, para definir las condiciones del árbol, así como las eventuales acciones que deben ejecutarse ante situaciones de riesgo que puedan corroborarse, según lo reconoce esa propia dependencia en el oficio nro. Así las cosas, resulta necesaria la intervención de esta Sala, precisamente respecto de la dilación de las autoridades del Conavi para atender el caso de marras y realizar los estudios técnicos pertinentes, máxime que, precisamente, debe determinarse si se configura el riesgo que la accionante señala que existe para la comunidad (…)”.
En ese tanto, justamente en la parte dispositiva lo que se ordenó fue que “dentro del plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se realicen las valoraciones y estudios técnicos correspondientes y se emita el criterio definitivo respecto de la situación del árbol objeto de este recurso”.
De tal manera, el plazo adicional solicitado por la autoridad accionada concretamente para realizar acciones de poda y descuaje del árbol no se ajusta a lo dispuesto por este Tribunal en el sub iudice, pues se reitera que en ningún momento se ordenó una intervención de ese tipo.
En consecuencia, se declara no ha lugar la gestión interpuesta.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
No ha lugar la gestión formulada.
