Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 20 August 2026.

Amparo application filed by Nombre01, identity card no. CED01, against the ASSOCIATION ADMINISTERING THE RURAL AQUEDUCT AND SANITARY SEWER SYSTEM OF SAN GABRIEL DE ASERRÍ, the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS, and the MINISTRY OF HEALTH.

Background:

  1. 1By a document received through the Chamber’s Online Filing system on 25 February 2026, the applicant files an amparo application against ASADA San Gabriel de Aserrí. She alleges that she owns a property in San Gabriel de Aserrí, where there is a pressure-break tank belonging to the ASADA, located in the immediate vicinity of her home and partly within the boundaries of her property. She states that the constant operation of this infrastructure generates loud, continuous noise, affecting the tranquility of her home, her health, the normal use and enjoyment of the property, and the right to a healthy environment. She adds that the respondent association intends to keep the infrastructure within her property boundaries, without any financial compensation, and to promote amendment of the cadastral survey plan to conform it to the existing structure. She requests that the application be granted, that a definitive and effective solution be ordered, that the alleged noise pollution be eliminated, that the association be prohibited from requiring her to convey part of her property, and that the matter be resolved within a reasonable period.
  2. 2By a resolution issued at 20:04 on 10 April 2026, the amparo application was admitted for processing, notice was given to the president and legal representative of the Association Administering the Rural Aqueduct and Sanitary Sewer System of San Gabriel de Aserrí, and a report was requested from the head of the UEN Rural Aqueduct Management of the Costa Rican Institute of Aqueducts and Sewers and the director of the Aserrí Health Area of the Ministry of Health concerning the facts alleged by the applicant.
  3. 3By a document received through the Chamber’s Online Filing system on 24 April 2026, Rafael Barboza Topping reports under oath, in his capacity as head of the UEN ASADA Management of the Costa Rican Institute of Aqueducts and Sewers, that the pressure-break tank forms part of the aqueduct system operated by ASADA San Gabriel de Aserrí. He specifies that part of the infrastructure is located within the property registered under real-property folios PRN01 and 002, owned by the applicant. He states that the tank was built before the property acquired its current configuration and before the existing home was constructed, and that no easement is currently formally registered. He explains that technical report GSD-UEN-GAR-2025-04304 did not assess noise levels, as its scope was exclusively hydraulic and operational. He also states that technical alternatives have been assessed, including demolishing the current structure and replacing it with a smaller polyethylene tank while maintaining the same hydraulic elevation, in order to reduce the physical impact on the front of the property and improve access. He requests that the amparo application be denied.
  4. 4By a document received through the Chamber’s Online Filing system on 24 April 2026, Karla Rodríguez Montero reports under oath, in her capacity as director of the Aserrí Health Regulatory Area Directorate, that a review of the database of complaints for 2020 shows no complaint filed by the applicant. She specifies that complaint no. 145-2025 concerns bad odors in the Aserrí area and was filed by a different person; and that, as of the date of the report, the applicant had not filed a new complaint against ASADA San Gabriel concerning alleged noise pollution. She requests that the amparo application be denied.
  5. 5By a document received through the Chamber’s Online Filing system on 29 April 2026, Roger Abarca Vargas states, in his capacity as legal representative of ASADA San Gabriel de Aserrí, that the matter concerning pressure-break tank 2411 is historical, technical, property-related, and administrative in nature. He specifies that the ASADA has taken steps to seek a solution. He states that there is no official technical evidence of noise pollution and no final health order. He maintains that the tank is part of essential infrastructure for continuity of the public drinking-water service; and that, according to the submitted topographic report, there is a partial occupation of 3.41 m², but also a complex cadastral situation involving possible effects on a public road and other survey plans. He requests that the amparo application be denied.
  6. 6By a document received through the Chamber’s Online Filing system on 5 May 2026, the applicant challenges the arguments of the respondent authorities. She maintains that taking administrative steps neither precludes nor remedies the alleged violation, because the impact on her property persists without an effective solution. She states that the absence of an official measurement of noise pollution cannot be used to her detriment, as it results from the competent authorities’ failure to act in a timely manner, and alleges that the impact is real, current, and ongoing. She states that ASADA San Gabriel de Aserrí operates the disputed infrastructure and is therefore directly responsible for its effects, and that the technical or oversight involvement of other institutions does not remove its duty to provide the service without violating fundamental rights. She reiterates that she is not asking the Chamber to resolve a complex boundary dispute, but to protect her right to property from a direct impact arising from public infrastructure remaining on her property and the possible formalization of that occupation through a land conveyance without financial compensation.She adds that the public interest in the drinking-water service does not authorize imposing disproportionate burdens on an individual and that, despite the existence of technical alternatives acknowledged by the respondent, no effective solution has been implemented. She requests that the respondent authority’s arguments be deemed refuted, that the amparo application be granted, and that ASADA be ordered to adopt a definitive, effective, and proportionate solution that eliminates the alleged impact.
  7. 7The legal requirements have been observed in the proceedings.

Drafted by Justice Araya García; and, Reasons:

I.Admissibility of the amparo application. Where amparo applications are brought against private entities, as is the case here, the Chamber has clearly stated: “Given the exceptional nature of the procedure, the ordinary processing of amparo applications against private-law entities must begin by examining whether, in the particular case, we are dealing with any of the circumstances that make the application admissible, in order to determine subsequently, if so, whether it should be granted” (see Judgment No. 151-97). Article 57 of the Law on Constitutional Jurisdiction provides that this type of application may be brought against acts or omissions of private-law entities when they act or must act in the exercise of public functions or powers, or when they are, in law or in fact, in a position of power against which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights or freedoms referred to in Article 2(a) of that same Law. In the case under review, the Chamber considers that ASADA San Gabriel de Aserrí acts in the exercise of public functions or powers. Accordingly, the amparo application before the Chamber is admissible, and the merits will therefore be decided immediately.

II.Subject of the amparo application. The applicant complains that a pressure-break tank operated by ASADA San Gabriel de Aserrí is located in the immediate vicinity of her home and partly within her property, which, in her view, causes noise pollution, affects the normal use and enjoyment of the property, and violates her fundamental rights to property, health, privacy in the home, and a healthy environment. She also challenges the possibility that the technical solution may entail amending the cadastral survey plan or formalizing the occupation of part of her land.

III.Facts found. The following facts, relevant to the decision in this matter, are considered established:

  • a)The pressure-break tank alleged by the applicant forms part of the aqueduct system operated by ASADA San Gabriel de Aserrí, and part of the infrastructure is located on the applicant’s property (see report from the respondent authorities).
  • b)The pressure-break tank was built before the property acquired its current configuration and before the existing home was constructed (see report from the respondent authorities).
  • c)There is currently no formally registered easement concerning the tank’s location (see report from the respondent authorities).
  • d)The respondent ASADA requested technical assistance from the ICAA to assess possible solutions; a field inspection was conducted on 13 August 2025, and technical report GSD-UEN-GAR-2025-04304 was issued. One alternative assessed was demolishing the current structure and replacing it with a smaller polyethylene tank while maintaining the same hydraulic elevation, in order to reduce the physical impact on the front of the applicant’s property and improve access to it (see evidence submitted to the case file and report from the respondent authorities).
  • e)The topographic report submitted by the ASADA determined that the tank encroaches on survey plan SJ-1526354-2011 over an area of 3.41 m². The tank supplies approximately 1,730 people and serves, among other locations, Escuela Gabriel Brenes Robles, the CENCINAI, and the EBAIS (see evidence submitted to the case file).

IV.Fact not proven. The following relevant fact is considered not established for purposes of this ruling:

Sole fact.—That the applicant filed a complaint concerning noise pollution with the Aserrí Health Regulatory Area based on the events alleged in this amparo application (the case file).

V.The specific case. The amparo proceeding is intended to protect fundamental rights against concrete, current, and manifest violations. However, it is not the appropriate avenue to replace ordinary or administrative proceedings in which matters requiring technical evidence, a full adversarial process, and specialized assessment must be determined, such as boundaries, easements, registry formalization, compensation, property liability, or whether cadastral survey plans may be amended. In this case, although partial occupation of the applicant’s property by communal aqueduct infrastructure is established, that situation appears connected to a historical, topographic, and registry problem that falls outside the scope of this jurisdiction. Those matters must be litigated through the corresponding administrative or ordinary avenue.

The applicant also states that operation of the tank produces continuous noise and affects her tranquility, health, and healthy environment. However, the case file contains no official noise measurement, final health resolution, or administrative order determining that the pressure-break tank is responsible for noise pollution. The Ministry of Health reported under oath, after due warning of the consequences provided for in Article 44 of the Law on Constitutional Jurisdiction, that there is no record of a complaint filed by the applicant against ASADA San Gabriel. Consequently, the evidence in the record does not make it possible to find a constitutional violation concerning noise pollution.

In light of the foregoing, no direct and manifest constitutional violation warranting the granting of the amparo application has been established. What has been established is the existence of a genuine dispute concerning the location of communal infrastructure, its possible formalization, and the property-related consequences of that occupation, as well as a noise complaint unsupported by evidence in the case file. Accordingly, the amparo application must be denied, without prejudice to the applicant pursuing the corresponding administrative or ordinary avenue to litigate boundaries, an easement, registry formalization, possible compensation, or property liability.

VI.Documents submitted to the case file. The parties are advised that if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must be collected from the Court within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Regulation on the Electronic Case File before the Judiciary,” approved by the Full Court at session number 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at session number 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre01, cédula de identidad no. CED01, contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL Y ALCANTARILLADO SANITARIO DE SAN GABRIEL DE ASERRÍ, el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS y el MINISTERIO DE SALUD.

Resultando:

  1. 1Por escrito recibido mediante Gestión en Línea de la Sala el 25 de febrero de 2026, la recurrente interpone recurso de amparo contra la ASADA San Gabriel de Aserrí. Alega que es propietaria de una finca ubicada en San Gabriel de Aserrí, donde existe un tanque quiebra gradiente perteneciente a la ASADA, ubicado en las cercanías inmediatas de su vivienda y parcialmente dentro de los límites de su propiedad. Afirma que el funcionamiento constante de esa infraestructura genera ruidos fuertes y permanentes, lo que afecta la tranquilidad de su hogar, su salud, el disfrute normal del inmueble y el derecho a un ambiente sano. Añade que la asociación recurrida pretende mantener la infraestructura dentro de los límites de su propiedad, sin compensación económica alguna y promover la modificación del plano catastrado para ajustarlo a la obra existente. Solicita que se declare con lugar el recurso, se ordene adoptar una solución definitiva y eficaz, eliminar la presunta contaminación sónica, abstenerse de requerir la cesión de parte de la propiedad y resolver la problemática en un plazo razonable.
  2. 2Por resolución de las 20:04 horas del 10 de abril de 2026, se dio curso al recurso, se le dio traslado al presidente y representante judicial de la Asociación Administradora del Acueducto Rural y Alcantarillado Sanitario de San Gabriel de Aserrí, y se solicitó informe al jefe de la UEN Gestión de Acueductos Rurales del Instituto Costarricense de Acueductos y Alcantarillados y directora del Área de Salud de Aserrí del Ministerio de Salud, sobre los hechos alegados por la accionante
  3. 3Por escrito recibido mediante Gestión en Línea de la Sala el 24 de abril de 2026, informa bajo juramento Rafael Barboza Topping, en su condición de jefe de la UEN Gestión de ASADAS del Instituto Costarricense de Acueductos y Alcantarillados, que el tanque quiebra gradiente forma parte del sistema de acueducto operado por la ASADA San Gabriel de Aserrí. Precisa que parte de la infraestructura se ubica dentro de la finca inscrita bajo los folios reales PRN01 y 002, propiedad de la recurrente. Afirma que el tanque fue construido con anterioridad a la conformación actual de la finca y a la edificación de la vivienda existente, no existe actualmente una servidumbre formalmente inscrita. Explica que el informe técnico GSD-UEN-GAR-2025-04304 no evaluó niveles de ruido, pues su objeto fue exclusivamente hidráulico y operativo. Asimismo, señala que se han valorado alternativas técnicas, entre ellas la demolición de la estructura actual y su sustitución por un tanque de polietileno de menor tamaño, manteniendo la misma cota hidráulica, con el fin de reducir la afectación física al frente de la propiedad y mejorar el acceso. Solicita declarar sin lugar el recurso.
  4. 4Por escrito recibido mediante Gestión en Línea de la Sala el 24 de abril de 2026, informa bajo juramento Karla Rodríguez Montero, en su condición de directora de la Dirección de Área Rectora de Salud Aserrí, que de la revisión de la base de datos de denuncias correspondientes al año 2020, no consta la presentación de ninguna denuncia interpuesta por la recurrente. Precisa que la denuncia no. 145-2025 corresponde a malos olores en el sector de Aserrí, interpuesta por una persona distinta; y que, a la fecha del informe, la recurrente no ha interpuesto una nueva denuncia contra la ASADA San Gabriel, relacionada con presunta contaminación sónica. Solicita declarar sin lugar el recurso.
  5. 5Por escrito recibido mediante Gestión en Línea de la Sala el 29 de abril de 2026, manifiesta Roger Abarca Vargas, en su condición de representante legal de la ASADA San Gabriel de Aserrí, que la situación del tanque quiebra gradiente 2411 es histórica, técnica, patrimonial y administrativa. Precisa que la ASADA ha realizado gestiones para procurar una solución. Afirma que no existe prueba técnica oficial de contaminación sónica ni orden sanitaria firme. Sostiene que el tanque forma parte de infraestructura esencial para la continuidad del servicio público de agua potable; y que, según el informe topográfico aportado, existe una ocupación parcial de 3,41 m², pero también una situación catastral compleja que involucra posibles afectaciones a calle pública y a otros planos. Solicita declarar sin lugar el recurso.
  6. 6Por escrito recibido mediante Gestión en Línea de la Sala el 5 de mayo de 2026, la recurrente se opone a los argumentos de las autoridades recurridas. Sostiene que la realización de gestiones administrativas no excluye ni subsana la violación denunciada, pues la afectación sobre su propiedad persiste sin una solución efectiva. Afirma que la ausencia de medición oficial sobre la contaminación sónica no puede utilizarse en su perjuicio, ya que obedece a la falta de actuación oportuna de las autoridades competentes, y alega que la afectación es real, actual y continua. Manifiesta que la ASADA San Gabriel de Aserrí es la entidad operadora de la infraestructura cuestionada y, por tanto, responsable directa de sus efectos, sin que la intervención técnica o fiscalizadora de otras instituciones elimine su deber de prestar el servicio sin lesionar derechos fundamentales. Reitera que no pretende que la Sala resuelva un conflicto complejo de linderos, sino que tutele una afectación directa al derecho de propiedad, derivada de la permanencia de infraestructura pública en su inmueble y de la eventual regularización mediante cesión de terreno sin compensación económica.Añade que el interés público del servicio de agua potable no autoriza imponer cargas desproporcionadas sobre un particular y que, pese a existir alternativas técnicas reconocidas por la recurrida, no se ha ejecutado una solución efectiva. Solicita que se tengan por refutados los argumentos de la autoridad recurrida, que se declare con lugar el recurso y que se ordene a la ASADA adoptar una solución definitiva, eficaz y proporcional que elimine la afectación denunciada.
  7. 7En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Araya García; y,

Considerando:

I.Admisibilidad del recurso. Tratándose de acciones de amparo dirigidas contra sujetos privados, como es aquí el caso, la Sala ha sido clara al decir: "Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para –posteriormente y en caso afirmativo– dilucidar si es estimable o no" (ver Sentencia N° 151-97). Establece el artículo 57 de la Ley de la Jurisdicción Constitucional, que esta clase de demandas se conceden contra las acciones u omisiones de sujetos de derecho privado cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a), de la misma Ley. En el caso bajo examen, considera la Sala que la ASADA San Gabriel de Aserrí actúa realizando un ejercicio de funciones o potestades públicas, motivo por el cual se estima que el recurso que nos ocupa sí es admisible, procediendo de inmediato a resolver el fondo del asunto.

II.Objeto del recurso. La recurrente reclama que un tanque quiebra gradiente operado por la ASADA San Gabriel de Aserrí se encuentra ubicado en las cercanías inmediatas de su vivienda y parcialmente dentro de su propiedad, lo que, a su juicio, ocasiona contaminación sónica, afecta el uso y disfrute normal del inmueble y vulnera sus derechos fundamentales de propiedad, salud, intimidad domiciliar y ambiente sano. Además, cuestiona que la eventual solución técnica implique modificar el plano catastrado o regularizar la ocupación de parte de su terreno.

III.Hechos probados. De importancia para la decisión de este asunto se tienen por acreditados los siguientes hechos:

  • a)El tanque quiebra gradiente alegado por la recurrente forma parte del sistema de acueducto operado por la ASADA San Gabriel de Aserrí, y parte de la infraestructura se ubica dentro de la propiedad de la accionante (ver informe de las autoridades recurridas).
  • b)El tanque quiebra gradiente fue construido con anterioridad a la conformación actual de la finca y a la edificación de la vivienda existente (ver informe de las autoridades recurridas).
  • c)No existe actualmente una servidumbre formalmente inscrita respecto de la ubicación del tanque (ver informe de las autoridades recurridas).
  • d)La ASADA recurrida solicitó apoyo técnico al ICAA para valorar alternativas de solución; el 13 de agosto de 2025 se realizó inspección de campo y se emitió el informe técnico GSD-UEN-GAR-2025-04304. Se valoró como alternativa la demolición de la estructura actual y su sustitución por un tanque de polietileno de menor tamaño, manteniendo la misma cota hidráulica, con el fin de reducir la afectación física al frente de la propiedad y mejorar el acceso de la propiedad de la accionante (ver prueba aportada al expediente e informe de las autoridades recurridas).
  • e)El informe topográfico aportado por la ASADA determinó que el tanque invade el plano SJ-1526354-2011 en un área de 3,41 m². El tanque abastece aproximadamente a 1.730 personas e incluye dentro de los sectores abastecidos la Escuela Gabriel Brenes Robles, el CENCINAI y el EBAIS (ver prueba aportada al expediente).

IV.Hecho no probado. Se estima como no demostrado el siguiente hecho, de relevancia para esta resolución:

Único.- La recurrente haya interpuesto denuncia por contaminación sónica ante el Área Rectora de Salud Aserrí, por los hechos alegados en este recurso de amparo (los autos).

V.Sobre el caso concreto. El recurso de amparo está previsto para tutelar derechos fundamentales frente a lesiones concretas, actuales y manifiestas. Sin embargo, no es la vía idónea para sustituir los procesos ordinarios o administrativos en los que deben definirse extremos que requieren prueba técnica, contradictorio amplio y valoración especializada, tales como linderos, servidumbres, regularización registral, indemnización, responsabilidad patrimonial o la procedencia de modificar planos catastrados. En el caso concreto, aunque se acredita una ocupación parcial de la finca de la recurrente por parte de infraestructura del acueducto comunal, esa situación aparece vinculada a un problema histórico, topográfico y registral que excede el ámbito de conocimiento propio de esta jurisdicción. Esos extremos deben discutirse en la vía administrativa u ordinaria correspondiente.

Por otra parte, la accionante afirma que el funcionamiento del tanque produce ruido constante y afecta su tranquilidad, salud y ambiente sano. No obstante, del expediente no se desprende una medición oficial de ruido, una resolución sanitaria firme ni una orden administrativa que haya determinado contaminación sónica atribuible al tanque quiebra gradiente. El Ministerio de Salud informó bajo juramento, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, que no consta denuncia presentada por la recurrente contra la ASADA San Gabriel. En consecuencia, con la prueba incorporada no es posible tener por demostrada una lesión constitucional en materia de contaminación sónica.

De conformidad con lo expuesto, no se acredita una vulneración constitucional directa y manifiesta que amerite la estimatoria del recurso. Lo demostrado es la existencia de una controversia real sobre la ubicación de una infraestructura comunal, su eventual regularización y los efectos patrimoniales derivados de esa ocupación, así como una queja por ruido que no cuenta con prueba en el expediente. En consecuencia, corresponde declarar sin lugar el recurso, sin perjuicio de que la recurrente acuda a la vía administrativa u ordinaria correspondiente para discutir linderos, servidumbre, regularización registral, eventual indemnización o responsabilidad patrimonial.

VI.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

Por tanto:
