Subsequent motion processed in case file number 17-015023-0007-CO, filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.
Background:
SECOND: The Administration takes reasonable steps to seek continuity in access to water resources by scheduling and carrying out supplies by tanker truck and using temporary storage points to serve the affected population. As shown in the logbook, water was supplied to the entire community of Berlín de Quebrada Grande, Liberia, Guanacaste, on 28 July 2026. In addition to the operational logbook for 28 July 2026, there is photographic evidence of the supply made on Tuesday, 11 August 2026, which supplements the information provided in memorandum No. SG-AF-CSA-2026-02430. While the logbook verifies that the route scheduled for 28 July 2026 was carried out, the photographs show that supplies continued afterward and that the tank was filled again as a delivery point for the community of Berlín de Quebrada Grande. Accordingly, it is considered that AyA acted within the scope of its powers and did not fail to comply with what was ordered in resolution No. 2018002405, at 09:15 hours on 16 February 2018 (See report No. SG-AF-CSA-2026-02430, logbook, photographs, and report No. GSP-RCH-CL-2026-00618).
THIRD: This Honorable Chamber should not fail to note that, in order to exercise their rights, Costa Rican citizens must first comply with the applicable regulations by properly channeling the various requests and motions submitted to the Administration. AyA has specific regulations, processes, and procedures that persons it administers must observe to ensure the effective and efficient provision of public services under its administration. The applicant repeatedly makes assertions against the Institute and files actions such as this one without first having pursued the corresponding administrative procedures, since the institutional records contain no record of any complaint by the applicant reporting the irregularity concerning the filling of the temporary supply tank. We emphasize that AyA fully complies with all requirements concerning water distribution according to the established schedules, as well as tank maintenance and filling, all in accordance with resolution No. 2018-002405, at 09:15 hours on 16 February 2018 (…)”. They request that the amparo application for disobedience be denied, that the case file be ordered archived, and that the Costa Rican Institute of Aqueducts and Sewers be exempted from all liability.
Justice Cruz Castro prepares the opinion; and, Reasons:
I.By a written submission filed before this Constitutional Jurisdiction on 29 July 2026, the applicant alleges disobedience of what this Chamber ordered in resolution 2018002405, at 09:15 hours on 16 February 2018.
In this regard, the respondent authorities stated: “(…) distribution by tanker truck was not included in the operational schedule for 29 July 2026, because the tank was filled on 28 July 2026, in accordance with the established schedule, since supply operations for that area take place on Tuesdays (…) As shown in the logbook, water was supplied to the entire community of Berlín de Quebrada Grande, Liberia, Guanacaste, on 28 July 2026. In addition to the operational logbook for 28 July 2026, there is photographic evidence of the supply made on Tuesday, 11 August 2026 (…) The photographs show that supplies continued afterward and that the tank was filled again as a delivery point for the community of Berlín de Quebrada Grande. Accordingly, it is considered that AyA acted within the scope of its powers and did not fail to comply with what was ordered in resolution No. 2018002405, at 09:15 hours on 16 February 2018 (…)”. In view of the foregoing, since the alleged noncompliance has not been established, the motion filed must be dismissed.
The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 on 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .
Gestión posterior que se tramita en expediente número 17-015023-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.Mediante escrito presentado ante esta Jurisdicción Constitucional el 29 de julio de 2026, el recurrente acusa la desobediencia a lo ordenado por esta Sala en la resolución 2018002405 de las 09:15 horas del 16 de febrero de 2018.
Al respecto, las autoridades accionadas indicaron que: “(…) el servicio de distribución mediante camión cisterna no estaba contemplado dentro de la programación operativa para la fecha 29 de julio de 2026, debido a que la atención del llenado del tanque se ejecutó el día 28 de julio de 2026, conforme al cronograma establecido, ya que las labores de abastecimiento para esa zona se realizan los días martes (…) tal como se demuestra en la bitácora, el suministro de agua se brindó en fecha del 28 de julio de 2026 a toda la comunidad de Berlín de Quebrada Grande, Liberia, Guanacaste. Ahora bien, además de la bitácora operativa correspondiente al 28 de julio de 2026, se cuenta con evidencia fotográfica del abastecimiento realizado el martes 11 de agosto de 2026 (…) las fotografías demuestran que el abastecimiento continuó realizándose posteriormente y que el tanque fue nuevamente llenado como punto de entrega para la comunidad de Berlín de Quebrada Grande, por lo que se considera que AyA ha actuado dentro del ámbito de sus competencias y no existe incumplimiento en lo emanado de la resolución N° 2018002405 de las 09:15 horas del 16 de febrero de 2018 (…)”. Por lo anterior, al no constatarse el acusado incumplimiento, procede la desestimatoria de la gestión formulada.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
