Amparo application filed by Nombre01, identity card CED04, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS DE QUEPOS.
Background:
Drafted by Justice Castillo Víquez; and, Reasons:
The applicant seeks the intervention of this constitutional forum so that the challenged authority may be ordered to replace the meters identified and provide a solution regarding the charges for potable water service, which the applicant considers disproportionate.
Regarding the disagreement with the charges imposed, it should be noted that this Court has established that the amount of a bill for potable water service is not disputed in this forum. This is a matter of legality that must be raised in the same administrative forum and, eventually, in the ordinary judicial forum. Among others, Judgment No. 2018-017559, issued at 10:10 on 23 October 2018, stated the following:
“...The applicant complains about the high charges received on the water service bill. She states that she is a woman living alone with limited means and has observed that the amount payable shown on the water bill varies excessively, since the supply serves few people and the amount charged is unjustified. She explains that personnel from the challenged administration have already visited to inspect, but have not provided solutions. However, this Chamber is not a body that reviews the legality of the Administration’s actions or decisions. It is not within this Court’s jurisdiction to review, in accordance with the applicable law, whether or not there is a leak on the property or to determine the origin of the charge, nor to establish the correct amount to be paid for the service received, since this is a matter for the ordinary administrative and judicial forums. Accordingly, if the applicant considers it appropriate, she may raise her disagreement or complaint with the same challenged authority or in the competent judicial forum, where she may fully discuss the merits of the matter and assert her claims.
Accordingly, this application is inadmissible, and so it is declared...” These considerations apply to the case under review, since this Court finds no reason to depart from the position expressed in those judgments, nor grounds to assess the situation presented differently. The application does not show an injury to access to a public service, since the complaint concerns disagreement with the amount billed for potable water service, but the applicants continue to receive that service at the property to which they refer. In light of the foregoing, the protected parties’ disagreement with the facts underlying this matter is, as indicated, an issue to be raised in the ordinary administrative or judicial forum. Accordingly, if the applicant considers it appropriate, they may raise their disagreement or complaint with the same challenged institution or in the competent ordinary jurisdiction, where they may fully discuss the merits of the matter and assert their claims.
III.As to the disagreement with the refusal to replace the requested meters, it is important to state that this Court should not act as a mediator with a particular natural or legal person—whether governed by public or private law—to intercede on behalf of a third party so that the third party may obtain what they seek. Accordingly, it is not for this Court to assess or order the challenged institute to replace the requested meters before the challenged authority, as the protected party requests in this case. Therefore, the applicant may, if they so wish, raise their disagreements or complaints with the challenged authority, as they indicate they have done, or in the competent judicial forum, where they may fully discuss the merits of the matter and assert their claims. In view of the foregoing, the application is inadmissible.
The parties are advised that if they have submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Regulation on the Electronic Case File before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:

Revisión del Documento EXPEDIENTE N° 26-028642-0007-CO PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026031766 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .
Recurso de amparo interpuesto por Nombre01, cédula de identidad CED04, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS DE QUEPOS.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
El recurrente solicita la intervención de esta sede constitucional, para que se le ordene a la autoridad recurrida efectuar el cambio de los medidores señalados y brindar solución a los cobros realizados por el servicio de agua potable, los cuales estima desproporcionados.
Sobre la disconformidad con los cobros realizados, cabe indicar que, este Tribunal ha establecido que no es en esta sede donde se discute el monto de un recibo por la prestación del servicio de agua potable. Se trata de una cuestión de legalidad que debe plantearse en la misma sede administrativa y, eventualmente, jurisdiccional ordinaria. Entre otras, en la Sentencia N° 2018-017559 de las 10:10 horas del 23 de octubre de 2018, indicó lo siguiente:
“…La recurrente reclama por lo elevados cobros que ha recibido en la factura del servicio de agua. Expresa que es mujer sola y de escasos recursos y ha observado que el monto a pagar expresado en el recibo del agua varía de forma exagerada, ya que el suministro sirve a pocas personas y no se justifica lo cobrado. Explica que el personal de la administración recurrida ya ha acudido a revisar, pero no le dan soluciones. Sin embargo, esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto a pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, este recurso es inadmisible y así se declara…”.
Consideraciones que son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dichas sentencias, ni motivos que lo hagan valorar de manera distinta en la situación planteada. Del escrito de interposición del recurso, no se desprende una lesión al acceso a un servicio público, pues lo que se acusa es la discrepancia con el monto facturado por el servicio de agua potable, pero lo cierto es que los petentes mantienen el suministro de ese servicio en el inmueble a que hacen referencia. A partir de lo anterior, la disconformidad de los tutelados con los hechos que sustenta este asunto, es un aspecto que, como se indicó, es propio de alegarse en la vía común -administrativa o jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su disconformidad o reclamo ante la misma institución recurrida o en la jurisdicción ordinaria competente, vías en las que podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.
III.En cuanto al disconformidad con el rechazo al cambio de los medidores solicitado, resulta importante indicar que este Tribunal no debe fungir como mediador ante una determinada persona física o jurídica -ya sea de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que ella pretende. De manera, no le corresponde valorar ni ordenar al instituto recurrido el cambio de los medidores requerido, ante la autoridad recurrida tal y como así lo solicita la parte amparada en este caso. Por ello, deberá el petente -si a bien lo tiene- plantear sus inconformidades o reclamos ante la autoridad recurrida, como indica haberlo realizado, o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En mérito de lo expuesto, el recurso es inadmisible.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
