Background 1. By a brief incorporated into the electronic case file on 7 August 2026, the appellant files an amparo proceeding against the Ministry of Environment and Energy. The appellant states that the amparo is brought on behalf of third parties who are beneficiaries of a housing grant and are processing housing construction permits. However, the appellant complains that the properties lack access to the sanitary sewer service, based on the criteria of the MINAE Water Directorate. On these grounds, the appellant considers the fundamental rights of the applicants to have been violated.

The appellant states that the amparo is brought on behalf of third parties who are beneficiaries of a housing grant and are processing housing construction permits. However, the appellant complains that the properties lack access to the sanitary sewer service, based on the criteria of the MINAE Water Directorate and the regulations governing the matter. On these grounds, the appellant considers the fundamental rights of the applicants to have been violated.
On numerous occasions, this Chamber has held that although the fundamental right of access to public services on equal terms is recognized, this right does not entail unrestricted access, since the Administration may validly establish general conditions and requirements for access to these services. Likewise, public or private entities that administer the service may validly reject service applications when the interested party fails to meet the requirements or when technical or legal reasons justify doing so. In this case, however, the appellant states in the application itself that the sanitary sewer service is denied based on the criteria of the MINAE Water Directorate and the regulations governing the matter.
Accordingly, the denial by the respondent authority is found to be supported by technical and legal reasons and is therefore not arbitrary. Consequently, the application is inadmissible, and so it is declared.
This Chamber must advise the parties that if they have submitted any paper documents, as well as objects or evidence stored on any additional device or electronic, computer, magnetic, optical, telematic, or new-technology medium, these must be collected from the office within 30 business days after notice of this judgment is received; otherwise, all such materials will be destroyed in accordance with the provisions of the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 on 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.

Recurso de amparo que se tramita en el expediente número 26-028582-0007-CO, interpuesto por Nombre01, cédula de identidad número CED01, contra el MINISTERIO DE AMBIENTE Y ENERGÍA.
Resultando
1. Por escrito incorporado al expediente electrónico el 7 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el Ministerio de Ambiente y Energía. Manifiesta que el amparo es a favor de terceros beneficiarios de un bono de vivienda quienes se encuentran tramitando los permisos de construcción de vivienda. Sin embargo, reclama que los inmuebles no cuentan con accesos al servicio de alcantarillado sanitario por criterio de la Dirección de Agua del MINAE. Por lo expuesto, estima lesionados los derechos fundamentales de las personas solicitantes.

El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.
Redacta el Magistrado Castillo Víquez; y,
Considerando:
La parte recurrente expresa que el amparo es a favor de terceros beneficiarios de un bono de vivienda quienes se encuentran tramitando los permisos de construcción de vivienda. Sin embargo, reclama que los inmuebles no cuentan con accesos al servicio de alcantarillado sanitario por criterio de la Dirección de Agua del MINAE y por la normativa que regula la materia. Por lo expuesto, estima lesionados los derechos fundamentales de las personas solicitantes.
En reiteradas ocasiones, esta Sala ha sostenido que si bien, se reconoce el derecho fundamental de acceso a los servicios públicos en igualdad de condiciones, este derecho no implica un acceso irrestricto, toda vez que, la Administración puede válidamente, establecer condiciones y requisitos generales para acceder a estos servicios. Asimismo, resulta válido que las entidades -públicas o privadas- que administren el servicio, puedan rechazar las solicitudes de servicios, cuando el interesado no cumple los requisitos o cuando existen razones técnicas o legales que los justifiquen. Ahora bien, en el caso concreto, del propio escrito de interposición la parte recurrente señala que por criterio de la Dirección de Agua del MINAE y por la normativa que regula la materia es que se niega el servicio de alcantarillado.
Así las cosas, se observa que la negativa de la autoridad accionada se encuentra sustentada en razones técnicas y legales, de manera que no resulta arbitraria. En consecuencia, el recurso resulta inadmisible y así se declara.
Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
