Review of the Document CASE FILE No. 26-028349-0007-CO PROCEEDING: AMPARO PROCEEDING RULING No. 2026031726 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty a.m. on 18 August 2026.
Amparo proceeding filed by Nombre02, of legal age, identity card No. CED01, against the Instituto Costarricense de Acueductos y Alcantarillados.
Background:
“FACTS:
1. The drinking water service is registered under NIS 3257708, in the name of Nombre01, at the following address: Dirección02.
2. For a long time, the home’s average consumption was 19 m3 per month, for an amount of approximately ₡ 18 000. From December 2025 through July 2026, consumption has risen without justification, reaching as much as 37 m3 per month, causing the bills to rise to ₡62 000 per month. This has happened without any change in the people living in the residence or their consumption habits.
3. In addition, I am charged the same high amount for sewer service, doubling the charge without any logical or justified explanation for the increase.
4. I requested an inspection of the meter. Before the inspection took place, the meter was replaced without informing me whether the previous equipment had been recording incorrect readings, preventing me from learning the real cause of the alleged increase.
5. I have filed formal complaints, but the institution responds that everything is in order, without conducting a genuine technical inspection. The personnel who come to the property merely uncover the meter and state that it is working properly, without conducting tests such as opening and closing the shutoff valves to verify its accuracy, leaving me without a justified answer as to whether the meter is recording correctly.
6. I am currently being threatened with suspension of service for outstanding bills that I consider improper and excessive, in violation of my right to have a transparent and complete technical inspection carried out before payment is demanded.
REQUEST:
For the foregoing reasons, I respectfully request:
1. That this amparo proceeding be admitted, as it was filed in due time and proper form.
2. That Acueductos y Alcantarillados (Ay A) be ordered to conduct an in-depth and complete technical inspection of the installed meter, the previous equipment, and ALL bills issued from December 2025 through July 2026.
3. That a functionality test be conducted in my presence with the valves open and closed, to verify whether the equipment measures correctly.
4. That the equally high sewer charge be explained and justified, since it is charged in proportion to water consumption, and that it be adjusted to reflect reality if actual consumption is lower.
5. That the disputed charges be reviewed and adjusted to the verified historical consumption of 1 9 m 3 per month, rather than the 37 m3 billed without justification.
6. That suspension of service be prohibited while the merits of the matter are being resolved.”
Drafted by Justice Castillo Víquez; and, Reasons:
The applicant alleges that, since December 2025, the metered drinking water consumption has risen without justification, even though the number of people living on the property and their consumption habits have not changed. This has caused a considerable increase in the corresponding charge, which the applicant considers improper and excessive. The applicant states that the sewer charge has also increased, without any logical or justified explanation for the increase. The applicant asserts that they have “filed formal complaints, but the institution responds that everything is in order, without conducting a genuine technical inspection. The personnel who come to the property merely uncover the meter and state that it is working properly, without conducting tests such as opening and closing the shutoff valves to verify its accuracy, leaving me without a justified answer as to whether the meter is recording correctly.”
Reviewing the validity of the charges disputed by the applicant falls outside this Chamber’s jurisdiction. This Court has indicated that:
“... it cannot act as an appellate body in the matter described and review whether the charges and bills for water service disputed by the amparo applicant conform to the facts and the legislation in force, since this is an ordinary legality dispute that must be resolved through the ordinary process.” (ruling No. 2023010523, at 9:20 a.m. on 5 May 2023).
Likewise, when considering a case analogous to the present one, this Chamber ruled:
“I.— Subject of the amparo. The applicant states that the property where they live has historically had a monthly drinking water consumption of between 14 and 15 cubic meters, with no changes in the number of residents or their consumption habits. They report, however, that on the bill for June 2026, the Instituto Costarricense de Acueductos y Alcantarillados charged them for consumption of 40 cubic meters, considerably increasing the amount billed. They allege that they timely filed an administrative complaint disputing that charge. However, following an inspection by officials of the institution, their claim was denied on the grounds that there were no leaks and that the meter was working properly, leading to the conclusion that the recorded consumption was actual. They dispute that technical assessment, considering that no comprehensive inspection of the metering system was conducted and that other possible causes of the recorded increase were not analyzed. They therefore consider that the charge does not correspond to the actual consumption of the service received.
II.Inadmissibility of the amparo. This Court has ruled that disputes concerning the amount billed for the provision of drinking water service are not to be resolved in this forum. This is a matter of legality that must be raised and resolved in the administrative forum and, if necessary, before the competent ordinary jurisdiction. Among other decisions, in ruling No. 2018-017559, at 10:10 a.m. on 23 October 2018, this Chamber stated the following:
“The applicant complains about the high charges she has received on her water service bill. She explains that she is a woman living alone with limited resources and has observed that the amount payable shown on the water bill varies excessively, since the supply serves few people and the amount charged is unjustified. She explains that personnel from the respondent administration have already come to inspect, but have not provided solutions. However, this Chamber is not a reviewer of the legality of the Administration’s actions or decisions. It is not within this Court’s jurisdiction to review, in accordance with applicable law, whether or not there is a leak on the property, to determine the origin of the charge, or to establish the correct amount payable for the service received, since this is a matter for the ordinary administrative and judicial processes. Accordingly, if the applicant considers it appropriate, they may raise their objection or claim with the respondent authority itself or before the competent judicial forum, where they may fully debate the merits of the matter and assert their claims.
Therefore, this amparo is inadmissible, and so it is declared.” In the case at hand, the applicant disputes the amount billed for drinking water service for June 2026, considering that the recorded consumption does not correspond to the property’s historical usage. The applicant also expresses disagreement with the technical assessment carried out by ICAA, which concluded that the meter was working properly and that the billed consumption was actual, because they consider that no additional checks were conducted on the condition of the metering system. In that regard, it is evident that the applicant’s request is for this Chamber to review the technical correctness of the verification procedure carried out by the Administration and determine whether the recorded consumption and billed amount correspond to the property’s actual consumption. Such a dispute falls within the administrative sphere and, as applicable, the ordinary jurisdiction, since it entails assessing technical matters and questions of legality that exceed the scope of review in an amparo proceeding.
Therefore, as no direct violation of a fundamental right susceptible to protection in this jurisdiction is apparent, the amparo is inadmissible. Accordingly, it is summarily rejected.” (ruling No. 2026025399, at 9:25 a.m. on 7 July 2026).
Considerations applicable to the case under review. Accordingly, it is not for this Court to rule on the validity of the disputed charge for drinking water consumption or on the technical suitability of the method or procedure applied to resolve the complaints filed by the applicant. The same applies to the validity of the sewer charge. Accordingly, the applicant must raise the various objections through the administrative forum itself or before the corresponding ordinary jurisdiction.
In light of the foregoing, the present amparo must be summarily rejected, as is hereby ordered.
The parties are advised that if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum period of 30 business days from notification of this ruling. Otherwise, any such material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court in session No. 27-11 of 22 August 2011, Article XXVI, and published in the Judicial Bulletin No. 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary in session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The amparo proceeding is summarily rejected.

Revisión del Documento EXPEDIENTE N° 26-028349-0007-CO PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026031726 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .
Recurso de amparo interpuesto por Nombre02, mayor de edad, cédula de identidad nro. CED01, contra el Instituto Costarricense de Acueductos y Alcantarillados.
Resultando:
“HECHOS:
1. El servicio de agua potable se encuentra registrado bajo el NIS 3257708, a nombre de la señora Nombre01, en la dirección: Dirección02.
2. Durante largo tiempo, el consumo promedio de la vivienda fue de 19 m3 mensuales, por un monto aproximado de ₡ 18 000. A partir de diciembre de 2025 y hasta julio de 2026, los consumos se han elevado de forma injustificada, pasando a registrarse hasta 37 m3 mensuales, por lo que las facturas han subido a ₡62 000 mensuales. Esto ha ocurrido sin que hayan variado las personas que habitan la residencia ni los hábitos de consumo.
3. Adicionalmente, se me cobra el mismo monto elevado por concepto de alcantarillado, duplicando el cobro sin que exista explicación lógica ni justificada para tal aumento.
4. Solicité una revisión del medidor. Antes de realizarse la inspección, el medidor fue cambiado sin que se me informara si el equipo anterior registraba lecturas incorrectas, impidiéndome conocer la causa real del supuesto aumento.
5. He presentado reclamos formales, pero la institución responde indicando que todo se encuentra en orden, sin realizar una revisión técnica real. El personal que se apersona se limita a destapar el medidor y afirmar que funciona bien, sin realizar pruebas como abrir y cerrar las llaves de paso para verificar su exactitud, dejándome sin respuesta justificada, si el medidor está marcado correctamente.
6. Actualmente se me amenaza con la suspensión del servicio por facturas pendientes que considero indebidas y excesivas, en violación a mi derecho a que se realice una revisión técnica transparente y completa antes de exigir el pago.
PETITORIA:
Por lo expuesto, solicito respetuosamente:
1. Que se admita el presente Recurso de Amparo por estar interpuesto en tiempo y forma.
2. Que se ordene a Acueductos y Alcantarillados (Ay A) realizar una revisión técnica profunda y completa del medidor instalado, del equipo anterior y de TODAS las facturas emitidas desde diciembre 2025 hasta julio 2026.
3. Que se practique en mi presencia la prueba de funcionamiento con llaves abiertas y cerradas, para verificar si el equipo mide correctamente.
4. Que se explique y justifique el cobro igual de alto por concepto de alcantarillado, el cual se cobra en proporción al consumo de agua, y que se ajuste a la realidad si el consumo real es menor.
5. Que se revisen los cobros cuestionados y se ajusten al consumo histórico comprobado de 1 9 m 3 mensuales, y no a los 37 m3 facturados sin justificación.
6. Que se ordene no suspender el servicio mientras se resuelve el fondo del asunto.”
Redacta el Magistrado Castillo Víquez; y,
Considerando:
El recurrente alega que, a partir del diciembre de 2025, la medición por consumo de agua potable se ha elevado de forma injustificada, pese que no ha variado el número de personas que habitan en el inmueble, ni sus hábitos de consumo. Lo que ha provocado un aumento considerable en el respectivo cobro, el que estima indebido y excesivo. Señala que también se ha elevado el monto que se cobra por concepto de alcantarillado, sin que exista una explicación lógica o justificada para tal aumento. Aduce que ha “presentado reclamos formales, pero la institución responde indicando que todo se encuentra en orden, sin realizar una revisión técnica real. El personal que se apersona se limita a destapar el medidor y afirmar que funciona bien, sin realizar pruebas como abrir y cerrar las llaves de paso para verificar su exactitud, dejándome sin respuesta justificada, si el medidor está marcado correctamente.”
Resulta ajeno al ámbito de competencia de esta Sala el revisar la procedencia de los cobros cuestionados por el recurrente. Este Tribunal ha indicado que:
“... no puede hacer las veces de alzada en la materia expuesta y revisar si los cobros y facturaciones por el servicio de agua que la amparada objeta, se ajustan o no a los hechos y a la normativa legal vigente, puesto que ello es un diferendo de legalidad ordinaria que debe ser dirimido en la vía común.” (voto nro. 2023010523 de las 9:20 horas del 5 de mayo de 2023).
Asimismo, al conocer de un caso análogo al presente, esta Sala resolvió que:
“I.- Objeto del recurso. El recurrente señala que el inmueble donde reside mantiene históricamente un consumo mensual de agua potable de entre 14 y 15 metros cúbicos, sin que se hayan producido cambios en el número de habitantes o en los hábitos de consumo. Refiere que, no obstante, en la facturación correspondiente al mes de junio de 2026, el Instituto Costarricense de Acueductos y Alcantarillados le cobró un consumo de 40 metros cúbicos, lo que incrementó considerablemente el monto facturado. Aduce que presentó oportunamente un reclamo administrativo cuestionando dicho cobro. Sin embargo, tras una inspección realizada por funcionarios de la institución, su gestión fue rechazada bajo el argumento de que no existían fugas y que el medidor funcionaba correctamente, concluyéndose que el consumo registrado era real. Cuestiona esa valoración técnica, al considerar que no se efectuó una revisión integral del sistema de medición ni se analizaron otras posibles causas del incremento registrado, por lo que estima que el cobro efectuado no corresponde al consumo real del servicio recibido.
II.Inadmisibilidad del recurso. Este Tribunal ha resuelto que no es en esta sede donde corresponde dilucidar las controversias relacionadas con el monto facturado por la prestación del servicio de agua potable. Se trata de una cuestión de legalidad que debe plantearse y resolverse en la sede administrativa y, de ser necesario, ante la jurisdicción ordinaria competente. Entre otras, en la sentencia nro. 2018-017559 de las 10:10 horas del 23 de octubre de 2018, esta Sala indicó lo siguiente:
“La recurrente reclama por lo elevados cobros que ha recibido en la factura del servicio de agua. Expresa que es mujer sola y de escasos recursos y ha observado que el monto a pagar expresado en el recibo del agua varía de forma exagerada, ya que el suministro sirve a pocas personas y no se justifica lo cobrado. Explica que el personal de la administración recurrida ya ha acudido a revisar, pero no le dan soluciones. Sin embargo, esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración. No es competencia de este Tribunal revisar, de conformidad con la ley aplicable, si en la propiedad existe o no una fuga o determinar el origen del cobro, ni establecer cuál debe ser el monto correcto a pagar por el servicio recibido, toda vez que se trata de una labor propia de la vía común -administrativa y jurisdiccional-. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante la misma autoridad recurrida, o ante la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, este recurso es inadmisible y así se declara”.
En el sub lite, el recurrente cuestiona el monto facturado por concepto del servicio de agua potable correspondiente al mes de junio de 2026, al estimar que el consumo registrado no se corresponde con el comportamiento histórico del inmueble. Asimismo, manifiesta su inconformidad con la valoración técnica efectuada por el ICAA en cuanto concluyó que el medidor funcionaba correctamente y que el consumo facturado era real, por considerar que no se realizaron verificaciones adicionales sobre el estado del sistema de medición. En ese sentido, resulta evidente que la pretensión del accionante se dirige a que esta Sala revise la corrección técnica del procedimiento de verificación efectuado por la Administración y determine si el consumo registrado y el monto facturado responden o no al consumo real del inmueble. Tal discusión constituye una materia propia del ámbito administrativo y, en su caso, de la jurisdicción ordinaria, pues implica valorar aspectos eminentemente técnicos y de legalidad que exceden el ámbito de cognición del recurso de amparo. Por ello, al no advertirse una lesión directa a un derecho fundamental susceptible de tutela en esta jurisdicción, el recurso resulta inadmisible. Ergo, se rechaza de plano.” (voto nro. 2026025399 de las 9:25 horas del 7 de julio de 2026).
Consideraciones aplicables al caso en estudio. De esta forma, no compete a este Tribunal resolver sobre la procedencia del cobro cuestionado por concepto de consumo de agua potable o sobre la idoneidad técnica del método o procedimiento aplicado para resolver los reclamos formulados por el recurrente. Lo mismo debe indicarse respecto de la procedencia del cobro por concepto de alcantarillado. Ergo, el recurrente deberá formular sus distintos reproches en la propia sede administrativa o en la jurisdicción ordinaria correspondiente.
Como corolario de lo anterior, procede rechazar de plano el presente amparo, como así se dispone.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano el recurso.
