CASE FILE No. 26-028240-0007-CO PROCEEDING: AMPARO APPLICATION RULING No. 2026031708 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 18 August 2026.

Amparo application filed by Nombre01, identity card CED01, on behalf of Nombre03, Nombre04, and Nombre02, against the MUNICIPALITY OF SARAPIQUÍ.

Background:

  1. 1By written submission added to the electronic case file at 09:10 on 05 August 2026, the applicant files an amparo application. She states: “(…) FIRST. I own and reside in a property located at Dirección02, Horquetas de Sarapiquí, Heredia, where my home and lot are situated. SECOND. In the yard of my property there is a ditch (sic) or channel through which rainwater flows. As a result, during rainy periods, large amounts of water accumulate on the property. THIRD. This is neither an isolated nor a recent event. Rather, it is a recurring problem that has caused my property to flood whenever there is rainfall of a certain intensity. FOURTH. The problem has worsened because of the way rainwater is managed in the area. In particular, construction of the new road in the Dirección02 area has changed the path of the water, causing some of it to be diverted toward the area where my property is located.FIFTH. As a result, during rains, the volume of water reaching the property increases considerably, causing water to flood the lot and enter my house, damaging our car and the things inside the house. This also affects my family’s safety and health. When this happens, we cannot leave the house, and we cannot sleep because of our worry and the disruption caused by the flooding. SIXTH. In response to this situation, on 18 April 2022 I sent a communication to the Mayor of the Municipality of Sarapiquí, explaining the problem and requesting municipal assistance in obtaining culverts to channel the water through the property. In that communication, I explained that water accumulated in the yard of my house and that the situation had worsened with construction of the new road because water was being diverted toward the area. SEVENTH. Despite having made that request to the Municipality, I received no effective response resolving the situation or informing me of the specific actions that would be taken to address the problem.EIGHTH. Because the problem continued and no solution had been provided, on 19 December 2023 I formally filed a complaint with the Municipality of Sarapiquí regarding the water problem. The request was registered under consecutive number 29540, and the document expressly identifies the subject as: “COMPLAINT REGARDING WATER PROBLEM.” It also records that the complaint was received on 19 December 2023 and referred to the Technical Road Management Unit of the Municipality of Sarapiquí. NINTH. The complaint-receipt document also identifies Fiorella Carvajal Picado, in the Platform position, as the contact official for inquiries, complaints, or reports. TENTH. Despite formally filing the complaint and its receipt by the Municipal Administration, I obtained neither a solution to the problem nor an effective response about the actions taken by the Municipality. ELEVENTH. In the absence of a response, on 21 February 2024 I sent a new email to the Municipality of Sarapiquí, addressed to the relevant institutional email address, requesting information about the complaint filed on 19 December 2023.In that email, I expressly stated that I had filed a complaint about the water problems and that, despite the time elapsed, I had received no response, identifying the matter by consecutive number #29540. TWELFTH. Again, despite this follow-up, I received no effective response explaining what actions the Municipality had taken, whether any inspection had been carried out, whether there was a technical study, what had caused the problem, or what solution was proposed. THIRTEENTH. The situation continues to this day. Whenever it rains heavily, water accumulates on my property, floods the lot, and enters my house. The photographs attached to this application provide evidence of the scale of the problem and directly show the flooding conditions affecting my property. FOURTEENTH. I consider it particularly serious that, despite having reported the situation in 2022, filed a formal complaint in December 2023, and again requested information in February 2024, the Municipal Administration has provided no effective response and has shown no evidence that it carried out a technical study to determine the causes and establish a prompt solution.FIFTEENTH. I am not asking the Municipality simply to provide material assistance without technical grounds. I am asking that the problem be formally investigated, that an inspection and technical study be carried out on the management of the rainwater affecting my property, and that the necessary measures be adopted within the scope of municipal authority to prevent water from continuing to enter and accumulate on my land and threaten my home. SIXTEENTH. As possible solutions, I have asked the Municipality to consider providing fill material to raise and prepare the land, as well as installing culverts or other channeling works, provided these are technically appropriate and legally viable. However, the definitive solution must be determined through the corresponding technical assessment, since the aim is for the Administration to take action rather than simply leave the situation unaddressed without studying its causes.SEVENTEENTH. The General Law on Public Administration establishes that public servants must perform their duties primarily in pursuit of the public interest, while taking into account the values of legal certainty and justice for the community and the person subject to administration. The administrative legislation also establishes that public officials serve the persons subject to administration, and that an act, fact, or omission that, through fault or negligence, causes unjustified or arbitrary hindrances or obstacles to those persons constitutes irregular performance of public duties. In this case, the prolonged failure to respond is particularly concerning because the problem has not disappeared with the passage of time; it continues to affect my property whenever it rains. REQUESTED RELIEF For the reasons stated, I respectfully request that this Constitutional Chamber: FIRST. Declare this amparo application well-founded on the basis of the violation and threatened violation of my fundamental rights, particularly the right to petition and to a prompt resolution, as well as the rights related to life, personal integrity, a healthy environment, and protection of property.SECOND. Order the Municipality of Sarapiquí, through the Mayor’s Office and the competent municipal departments, to formally address the requests I have made, including the complaint filed on 19 December 2023 under consecutive number 29540, and provide me with a clear, complete, reasoned, and effective response. THIRD. Order the Municipality, within a reasonable period set by this Chamber, to conduct an inspection and technical study on my property, located at Dirección02, Horquetas de Sarapiquí, for the purpose of determining the causes of the flooding and the measures needed to resolve the problem. FOURTH. Once the technical study has been completed, order the Municipality to adopt the measures within its authority that are appropriate to prevent water from continuing to enter and accumulate on my property and threaten my home, including, if technically and legally appropriate, channeling works, installation of culverts, drains, or other necessary works.FIFTH. Order the Municipality to expressly assess, as part of the study and consideration of possible solutions, the provision of fill material for the lot, if it is technically determined that this measure is necessary or appropriate to mitigate the flood risk. SIXTH. Order the respondent authorities to inform this Chamber and me of the actions taken to address the problem, so that the matter is not postponed indefinitely. SEVENTH. Adopt any other measures this Chamber considers necessary to effectively guarantee my fundamental rights. (…)”
  2. 2Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily dismiss, either at the outset or on the merits and at any time, including upon filing, any matter submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is simply a reiteration or reproduction of an identical or similar prior matter that was dismissed.

I. REASONS WHY FURTHER PROCESSING OF THE CASE FILE IS UNNECESSARY

The facts raised here are already under review by this Chamber, since the applicant filed an amparo application in which she set out the same grievances alleged in these proceedings. It has been confirmed that the application is currently being processed in case file number 26-028237-0007-CO and, according to the information in the Costa Rican Judicial Office Management System (S.G.D.J.), as of the date this judgment was issued, that case file is under review. Accordingly, it is inadmissible to accept a new application to litigate the same facts that are, in essence, already being considered in that case file. Apart from creating a serious risk of two contradictory rulings, doing so would cause an unnecessary delay in processing the first application, to the detriment of the interests of the very party seeking protection. For the foregoing reasons, this matter must be ordered closed.

II. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve it from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.

EXPEDIENTE N° 26-028240-0007-CO PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026031708 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, a favor de Nombre03, Nombre04, Nombre02, contra la MUNICIPALIDAD DE SARAPIQUÍ.

Resultando:

  1. 1Por escrito incorporado al expediente electrónico a las 09:10 horas del 05 de agosto de 2026, la recurrente interpone recurso de amparo. Manifiesta lo siguiente: “(…) PRIMERO. Soy propietaria y residente de un inmueble ubicado en Dirección02, Horquetas de Sarapiquí, Heredia, lugar donde se encuentra mi vivienda y mi lote. SEGUNDO. En el patio de mi propiedad existe un sanja (sic) o cauce por donde circulan aguas pluviales, situación que provoca que, durante los períodos de lluvia, el agua se acumule en abundancia dentro del terreno. TERCERO. Esta situación no constituye un hecho aislado ni reciente. Por el contrario, se trata de una problemática que se ha presentado reiteradamente y que ha provocado que mi propiedad se inunde cada vez que se producen lluvias de cierta intensidad. CUARTO. La problemática se ha agravado debido a las condiciones de manejo de las aguas pluviales existentes en la zona.Particularmente, con la realización de la nueva carretera en el sector de Dirección02, se ha producido una modificación en el recorrido de las aguas, provocando que parte de estas sean desviadas hacia el sector donde se encuentra mi propiedad. QUINTO. Como consecuencia de lo anterior, durante las lluvias el volumen de agua que llega al terreno aumenta mucho, ocasionando que el agua inunde el lote e ingrese a mi casa, dañando el carro que poseemos y las cosas dentro de la casa. Algo que además afecta las condiciones de seguridad y salubridad de mi familia, quienes no podemos ni salir de la casa cuando esto pasa y tampoco podemos dormir por la preocupación y el desorden por las inundaciones. SEXTO. Ante esta situación, el 18 de abril de 2022 envié una comunicación dirigida a la Alcaldesa de la Municipalidad de Sarapiquí, mediante la cual expliqué el problema y solicité la colaboración municipal para obtener alcantarillas que permitieran canalizar el paso de las aguas por la propiedad.En dicha comunicación expliqué que el agua se acumulaba en el patio de mi casa y que la situación se había agravado con la construcción de la nueva carretera, debido al desvío de las aguas hacia el sector. SÉTIMO. Pese a haber realizado dicha gestión ante la Municipalidad, no recibí una respuesta efectiva que resolviera la situación ni que me informara sobre las acciones concretas que se realizarían para atender el problema. OCTAVO. Debido a que la problemática continuó y ante la falta de una solución, el día 19 de diciembre de 2023 presenté formalmente ante la Municipalidad de Sarapiquí una denuncia por el problema de aguas. La gestión quedó registrada mediante el consecutivo número 29540, documento que señala expresamente como asunto: “DENUNCIA POR PROBLEMA DE AGUAS”. Asimismo, consta que la denuncia fue recibida el 19 de diciembre de 2023 y remitida a la Unidad Técnica de Gestión Vial de la Municipalidad de Sarapiquí.NOVENO. En el documento de recepción de la denuncia consta además que la funcionaria de contacto indicada para atender consultas, quejas o denuncias era Fiorella Carvajal Picado, en el puesto de Plataforma. DÉCIMO. A pesar de haber presentado formalmente la denuncia y de que esta fue recibida por la Administración Municipal, no obtuve una solución al problema ni una respuesta efectiva sobre las actuaciones realizadas por la Municipalidad. DÉCIMO PRIMERO. Ante la ausencia de respuesta, el 21 de febrero de 2024 envié un nuevo correo electrónico a la Municipalidad de Sarapiquí, dirigido a la dirección institucional correspondiente, solicitando información sobre la denuncia presentada el 19 de diciembre de 2023. En dicho correo indiqué expresamente que había presentado la denuncia por los problemas de aguas y que, pese al tiempo transcurrido, no había recibido respuesta alguna, identificando el trámite mediante el consecutivo #29540.DÉCIMO SEGUNDO. Nuevamente, pese a esta gestión de seguimiento, no recibí una respuesta efectiva que permitiera conocer qué acciones había realizado la Municipalidad, si se había efectuado alguna inspección, si existía un estudio técnico, cuál era la causa del problema o cuál sería la solución propuesta. DÉCIMO TERCERO. La situación se mantiene hasta la actualidad. Cada vez que llueve fuerte se acumula el agua en mi propiedad y se inunda el lote y el agua se mete a mi casa. Las fotografías que adjunto a este recurso constituyen evidencia de la magnitud de la problemática y permiten observar directamente las condiciones de inundación que afectan mi propiedad. DÉCIMO CUARTO. Considero especialmente grave que, pese a haber comunicado la situación en 2022, haber presentado una denuncia formal en diciembre de 2023 y haber solicitado nuevamente información en febrero de 2024, la Administración Municipal no haya brindado una respuesta efectiva ni haya acreditado la realización de un estudio técnico que permita determinar las causas y establecer una solución pronta.DÉCIMO QUINTO. No pretendo que la Municipalidad simplemente me otorgue una ayuda material sin fundamento técnico. Lo que solicito es que se investigue formalmente la problemática, se realice una inspección y estudio técnico del manejo de las aguas pluviales que afectan mi propiedad y se adopten las medidas necesarias dentro de las competencias municipales para evitar que las aguas continúen ingresando y acumulándose en mi terreno y amenazando mi vivienda. DÉCIMO SEXTO. Como parte de las posibles soluciones, he solicitado que la Municipalidad valore la posibilidad de proporcionar material de relleno para elevar y acondicionar el terreno, así como la instalación de alcantarillas u otras obras de canalización, siempre que técnicamente resulten procedentes y legalmente viables. No obstante, la solución definitiva debe determinarse mediante la valoración técnica correspondiente, pues lo que se pretende es que la Administración actúe y no que simplemente mantenga la situación sin estudiar sus causas.DÉCIMO SÉTIMO. La Ley General de la Administración Pública establece que las personas servidoras públicas deben desempeñar sus funciones procurando primordialmente la satisfacción del interés público y teniendo en consideración los valores de seguridad jurídica y justicia para la comunidad y para la persona administrada. Asimismo, la propia legislación administrativa establece que el funcionariado público es servidor de las personas administradas y que constituye un irregular desempeño de la función aquel acto, hecho u omisión que por culpa o negligencia ocasione trabas u obstáculos injustificados o arbitrarios a las personas administradas. En este caso, la prolongada falta de respuesta resulta particularmente preocupante porque la problemática no ha desaparecido por el transcurso del tiempo, sino que continúa afectando mi propiedad cada vez que se presentan lluvias. PETITORIA Por las razones expuestas, respetuosamente solicito a esta Sala Constitucional: PRIMERO.Que se declare con lugar el presente recurso de amparo por la violación y amenaza de violación de mis derechos fundamentales, particularmente el derecho de petición y pronta resolución, así como los derechos relacionados con la vida, integridad, ambiente sano y protección de la propiedad. SEGUNDO. Que se ordene a la Municipalidad de Sarapiquí, por medio de la Alcaldía y de las dependencias municipales competentes, que atienda formalmente las gestiones realizadas por mi persona, incluyendo la denuncia presentada el 19 de diciembre de 2023 bajo el consecutivo 29540, y que se me brinde una respuesta clara, completa, fundamentada y efectiva. TERCERO. Que se ordene a la Municipalidad realizar, dentro de un plazo razonable que establezca esta Sala, una inspección y estudio técnico en mi propiedad, ubicada en Dirección02, Horquetas de Sarapiquí, con el propósito de determinar las causas de las inundaciones y las medidas necesarias para solucionar la problemática.CUARTO. Que, una vez realizado el estudio técnico, se ordene a la Municipalidad adoptar las medidas que correspondan dentro de sus competencias para evitar que las aguas continúen ingresando y acumulándose en mi propiedad y amenazando mi vivienda, incluyendo, de resultar técnica y jurídicamente procedente, obras de canalización, instalación de alcantarillas, drenajes u otras obras necesarias. QUINTO. Que se ordene a la Municipalidad valorar expresamente, dentro del estudio y de las soluciones posibles, la provisión de material de relleno para el lote, en caso de que técnicamente se determine que dicha medida resulta necesaria o adecuada para mitigar el riesgo de inundación. SEXTO. Que se ordene a las autoridades recurridas informar a esta Sala y a mi persona sobre las actuaciones realizadas para atender la problemática, evitando que la situación continúe siendo postergada indefinidamente. SÉTIMO. Que se adopten las demás medidas que esta Sala considere necesarias para garantizar de manera efectiva mis derechos fundamentales. (…)”.
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. RAZONES DEL TRÁMITE INNECESARIO DEL EXPEDIENTE

Los hechos que aquí se plantean ya son objeto de análisis ante esta Sala, toda vez que, la parte recurrente presentó un recurso de amparo en el cual expuso los mismos agravios que se alegan en estas diligencias. Se ha constatado que dicho recurso actualmente se tramita en el expediente número 26-028237-0007-CO y, según la información contenida en el Sistema Costarricense de Gestión de Despachos Judiciales (S.G.D.J.), a la fecha del dictado de esta sentencia, el expediente referido se encuentra en estudio. En razón de lo anterior, resulta improcedente admitir un nuevo recurso para discutir los mismos hechos que, en esencia, se conocen en ese expediente, pues esto, aparte de entrañar el serio riesgo que se dicten dos fallos contradictorios, provocaría un retraso innecesario en la tramitación del primer recurso, lo que iría en detrimento del interés de la propia parte tutelada. Por lo expuesto, corresponde ordenar el archivo de este asunto.

II. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:
