CASE FILE: N° 26-027252-0007-CO PROCEEDING: AMPARO PROCEEDING RULING Nº 2026031608 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty minutes on 18 August 2026.

Amparo proceeding filed by Nombre01, identity card CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Background:

  1. 1In a brief added to this Chamber’s Judicial Office Management System at thirteen hours on 29 July 2026, the petitioner filed an amparo proceeding against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS and states that the bills for the final months of 2026 show a considerable increase in the amount due: in February, the petitioner was charged 41.000 colones; in March, 30.000 colones; and in July, 63.000 colones. The petitioner states that three people live in the household identified by NIS PRN01, two of whom have a disability. The petitioner states that historically the bill amount had not exceeded ¢15.000 colones, making the current increase unusual. The petitioner says they do not know the source of the excessive consumption shown for the service. The petitioner reports having previously made an inquiry to the Instituto Costarricense de Acueductos y Alcantarillados (AyA) in Goicoechea, after which an inspector was sent and told the petitioner that there was no leak affecting the bill.The petitioner alleges that AyA asked them to submit a letter and that they are still awaiting a response. The petitioner is concerned that the bills will continue to increase and reach an amount they cannot pay. The petitioner requests a detailed review of the recorded consumption and bills issued, to determine a viable and justified solution concerning the billed consumption. The petitioner considers their fundamental rights to have been violated.
  2. 2By ruling issued at thirteen hours and forty-three minutes on 5 August 2026, the petitioner was directed, within three days from notification of that order and under warning that the amparo application would be summarily dismissed if they did not comply, to indicate the following: “(...) • the specific date on which they submitted the request referred to in the filing brief, the lack of response to which they allege in that brief; • They must provide a complete, legible, and duly identified copy of the filing or request they say they submitted to the respondent authority identified above, together with the corresponding proof of receipt or email transmission. They must likewise provide any additional evidence supporting their statements. This information is essential to decide what is appropriate under the law (...)”.
  3. 3According to the notice of service contained in the electronic case file, the petitioner was notified by email at fourteen hours and seventeen minutes on 5 August 2026.
  4. 4By certificate dated 12 August 2026, signed by ARTURO DURÁN BARQUERO AND MARIANE CASTRO VILLALOBOS, respectively Court Technician and Acting Secretary, both of the Constitutional Chamber, they stated: “WE HEREBY CERTIFY THAT: upon review of the RECEIVED DOCUMENTS LOG and THIS CASE FILE in the COSTA RICAN JUDICIAL OFFICE MANAGEMENT SYSTEM, there is no record that, from 5 August 2026 through 11 August 2026, the petitioner(s) submitted any brief or document to comply with the direction in the ruling issued at thirteen hours and forty-three minutes on 5 August 2026 in the AMPARO PROCEEDING heard in case file number 26-027252-0007-CO, filed by Nombre01. The only item on record is the filing and documentation by which the AMPARO PROCEEDING was brought.”
  5. 5Article 42 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily dismiss an amparo application when defects incurred at the time of filing have not been corrected.

Justice Castillo Víquez drafts the ruling; and, Reasons:

I. SPECIFIC CASE

Before this Court could decide this amparo application, the petitioner was required to comply with the direction issued by this Court in its ruling at thirteen hours and forty-three minutes on 5 August 2026, which was served in accordance with the Ley de Notificaciones Judiciales. However, according to the certificate contained in the electronic case file, the direction was not complied with within the specified period. In light of the foregoing, and pursuant to Article 42 of the Ley de la Jurisdicción Constitucional, the appropriate course is to dismiss this amparo application.

II. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve those items from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not retrieved within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo application is summarily dismissed.

PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026031608 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Resultando:

  1. 1Por escrito agregado al Sistema de Gestión de Despachos Judiciales de esta Sala a las trece horas cero minutos del veintinueve de julio de dos mil veintiséis, la parte recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, y manifiesta que las facturas correspondientes a los últimos meses del año 2026 reflejan un aumento considerable en el monto a cancelar, así en febrero se le hizo un cobro de 41.000 colones en marzo de 30.000 colones y en julio de 63.000 colones. Señala que en su hogar con número de NIS PRN01 habitan tres personas, de las cuales dos tienen una discapacidad. Manifiesta que, históricamente, el monto de la factura no había superado los ¢15.000 colones, por lo que el incremento actual resulta inusual. Afirma que desconoce el origen del consumo excesivo reflejado en el servicio. Refiere que anteriormente realizó una consulta ante el Instituto Costarricense de Acueductos y Alcantarillados (AyA) de Goicoechea, tras lo cual se envió un inspector, quien le indicó que no existía ninguna fuga que afectara el recibo.Acusa que en el AyA le solicitaron aportar una carta, respecto de la cual aún se encuentra a la espera de respuesta. Expresa su preocupación porque las facturas continúen aumentando y alcancen un monto que no pueda cancelar. Solicita que se efectúe una revisión detallada del consumo registrado y de las facturas emitidas, con el fin de determinar una solución viable y justificada respecto del consumo facturado. Estima lesionados sus derechos fundamentales.
  2. 2Por resolución dictada a las trece horas cuarenta y tres minutos del cinco de agosto de dos mil veintiséis, se previno a la parte recurrente que dentro de tercero día contado a partir de la notificación de ese proveído y bajo apercibimiento de rechazar de plano el recurso si no lo hacía que indicara lo siguiente: "(...) • en qué fecha concreta planteó la solicitud que refiere en el escrito de interposición, cuya falta de respuesta alega en dicho memorial de interposición; • Deberá aportar la copia completa, legible y debidamente identificada de la gestión o solicitud que señala planteó ante la autoridad accionada -antes indicada-, con el respectivo comprobante de recibido o de remisión de correo electrónico. De igual modo, deberá aportar cualquier prueba adicional en la cual fundamente su dicho. Lo anterior, por cuanto tal información resulta esencial para resolver lo que en derecho corresponda (...)".
  3. 3De conformidad con el acta de notificación contenida en el expediente electrónico, la parte recurrente fue notificada por medio de correo electrónico, a las catorce horas diecisiete minutos del cinco de agosto de dos mil veintiséis.
  4. 4Mediante constancia del 12 de agosto del 2026, suscrita por ARTURO DURÁN BARQUERO Y MARIANE CASTRO VILLALOBOS, por su orden Técnico de Sala y Secretaria a.i., ambos de la Sala Constitucional, indicaron que "HACEMOS CONSTAR QUE: revisado, en el SISTEMA COSTARRICENSE DE GESTIÓN DE DESPACHOS JUDICIALES el CONTROL DE DOCUMENTOS RECIBIDOS Y ESTE EXPEDIENTE, no aparece que del cinco de agosto de dos mil veintiséis al once de agosto de dos mil veintiséis, la parte recurrente haya(n) presentado escrito o documento alguno, para cumplir con lo prevenido en la resolución de las trece horas cuarenta y tres minutos del cinco de agosto de dos mil veintiséis, dictada en RECURSO DE AMPARO que se tramita en el expediente número 26-027252-0007-CO promovido por Nombre01. Únicamente aparece la presentación del escrito y documentación mediante los que interpone(n) el RECURSO DE AMPARO".
  5. 5La Ley de la Jurisdicción Constitucional en el artículo 42 faculta a la Sala para rechazar de plano, aquel amparo en el que no se corrijan los defectos en que se hubiere incurrido al tiempo de interponerlo.

Redacta el Magistrado Castillo Víquez; y, Considerando:

I. CASO CONCRETO

Previo a la resolución de este recurso, la parte recurrente debía cumplir la prevención realizada por este Tribunal mediante la resolución de las trece horas cuarenta y tres minutos del cinco de agosto de dos mil veintiséis, que se notificó de acuerdo con la Ley de Notificaciones Judiciales. No obstante, según constancia contenida en el expediente electrónico, la prevención no fue cumplida en el plazo señalado. En virtud de lo expuesto y con sustento en el artículo 42 de la Ley de la Jurisdicción Constitucional, lo procedente es rechazar este recurso.

II. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
