Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE (Sala Constitucional). San José, at 9:30 a.m. on 18 August 2026.

Amparo proceeding filed under case number 26-026803-0007-CO by Nombre01, identity card CED01, against the SISTEMA NACIONAL DE ÁREAS DE CONSERVACION.

Background:

  1. 1In a brief filed with the Chamber’s Secretariat on 6 August 2026, the amparo applicant files an amparo proceeding against the SISTEMA NACIONAL DE ÁREAS DE CONSERVACION. The applicant states that a situation exists in the Polo Turístico Golfo de Papagayo that, according to the applicant, puts hundreds of trees at serious risk. By resolution SINAC-OSRSCC-052-2026 of 9 April 2026, the Tempisque Conservation Area of the Sistema Nacional de Áreas de Conservación (SINAC) granted a permit that would allow clear-cutting 748 trees of 32 different species, along with their understory, located on state-owned land administered by the Instituto Costarricense de Turismo. The applicant maintains that the existence of State Natural Heritage should have been considered. The applicant adds that, if the trees are cut down, this would cause a land-use change (cambio de uso del suelo) and harm the natural landscape, ecosystems, biodiversity, and future generations.The applicant states that, in response to this situation, on 1 July 2026 the applicant filed a complaint and a request for environmental information with the Tempisque Conservation Area Office in Nicoya, specifically requesting the EXPERT OPINION DCF:2025-01041-BIO, prepared by the Department of Forensic Sciences, Forensic Biology Section, of the Organismo de Investigación Judicial. According to the applicant, the Fiscalía Agrario Ambiental sent it to SINAC officials by email on 16 April 2026, and it contains technical information about the existence of forest within the Polo Turístico Golfo de Papagayo. The applicant explains that the information was requested for analysis with forestry specialists and, eventually, to pursue administrative actions before SETENA and the Municipalidad de Liberia concerning the authorization to cut down the trees and the definition of forest and State Natural Heritage.The applicant asserts that the applicant explained to the respondents the right of access to information and participation in environmental matters and that, by LETTER-SINAC-ACT-DR-1156-2026 of 3 July 2026, the requested information was denied on the grounds that the Ministerio Público had seized the physical administrative file and that, because a criminal case was open, the information was subject to secrecy of the preliminary investigation. The applicant alleges that this denial is unjustified because the respondents themselves acknowledged that SINAC received and retains in its institutional systems the email containing the aforementioned expert opinion. The applicant therefore maintains that seizure of the physical file did not prevent the technical data and conclusions of the requested expert assessment from being provided without affecting the criminal investigation. The applicant considers that the denial violates the right of access to environmental information, the right to public participation, the right to a healthy and ecologically balanced environment, the right to a healthy climate, and the principle of forest irreducibility (irreductibilidad de los bosques), by preventing the applicant from obtaining technical information deemed necessary to participate in and influence administrative proceedings concerning environmental protection of the area.The applicant asks that it be declared that the respondents violated the applicant’s fundamental rights by denying access to EXPERT OPINION DCF:2025-01041-BIO, or to its conclusions and other technical data, and that they be ordered to provide relevant information about the existing forest on state-owned land in the Polo Turístico Golfo de Papagayo within five business days following issuance of the judgment. The applicant requests the Chamber’s intervention.
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily reject or reject on the merits, at any time, including upon filing, any application submitted for its consideration that proves manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is merely a reiteration or reproduction of an earlier identical or similar application that was rejected.

Justice Castillo Víquez drafts the opinion; and, Reasons:

I. SUBJECT OF THE AMPARO

The amparo applicant complains that SINAC denied access to EXPERT OPINION DCF:2025-01041-BIO, or to its conclusions and other technical data on the existence of forest on state-owned land in the Polo Turístico Golfo de Papagayo, even though, according to the applicant, the information is held by the institution. The stated grounds were that the physical administrative file had been seized by the Ministerio Público and that criminal proceedings were ongoing. The applicant considers that this denial infringes the right of access to environmental information and public participation in environmental matters, as well as the right to a healthy and ecologically balanced environment, the right to a healthy climate, and the principle of forest irreducibility, by preventing the applicant from obtaining technical information needed to pursue administrative actions concerning environmental protection and the possible felling of 748 trees on state-owned land. The applicant therefore seeks an order requiring the respondents to provide the requested information.

II. INADMISSIBILITY OF THE AMPARO

The evidence submitted in the case file shows that on 1 July 2026 the amparo applicant requested from the Sistema Nacional de Áreas de Conservación EXPERT OPINION DCF:2025-01041-BIO, prepared by the Department of Forensic Sciences, Forensic Biology Section, of the Organismo de Investigación Judicial, as well as its conclusions and other technical data. The applicant considered this information necessary to analyze whether forest existed on land within the Polo Turístico Golfo de Papagayo and, eventually, to pursue administrative actions before SETENA and the Municipalidad de Liberia. The record also establishes that, by LETTER-SINAC-ACT-DR-1156-2026 of 3 July 2026, the respondent authority answered the request and explained that it could not provide the requested information because the Ministerio Público had received the physical administrative file and a criminal investigation concerning the events was ongoing.

It follows that, contrary to the amparo applicant’s assertion, this is not a case in which the Administration failed to respond, but one in which it gave an express answer. The applicant’s disagreement is that the information should have been provided despite its connection to a criminal investigation. Thus, a conflict arises between the applicant’s position that the information should be public because of its environmental nature and because, according to the applicant, SINAC retains in its institutional systems the email containing the expert opinion, and the respondent authority’s position that the request concerns an ongoing criminal investigation and that the documentation cannot be provided under the conditions sought. This makes it necessary to address the limits on the right to information in environmental matters, a subject this Chamber has developed in its case law. In Judgment Nº 2010-007789, at 15:00 on 28 April 2010 (a position reiterated, among others, in Judgments Nº 2012-005593, at 16:04 on 2 May 2012, and Nº 2013-010883, at 09:30 on 16 August 2013), this Court stated:

“(…) IV.- LIMITS ON THE RIGHT OF ACCESS TO ENVIRONMENTAL INFORMATION. Although our legal system recognizes the essential importance of the right of access to information and, in this case, to information of an environmental nature, as a means of ensuring adequate protection of the environment—since its conservation is an obligation shared by the public authorities and society as a whole—the exercise of that right is also subject to limits. It is impossible to claim an absolute right of access to environmental information, because, like other rights, it is relative in nature. Accordingly, limits imposed on that right are justified in situations where transparency or disclosure may cause serious harm or disruption to general or private interests that society considers worthy of protection or prevailing. Hence, that right must yield to the demands of peaceful and democratic coexistence, a priority objective of society and its political organization, and, of course, also to the right to privacy and confidentiality of other members of the public.

From that perspective, it is possible to state, consistently also with the Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters, or Aarhus Convention, adopted at the Ministerial Conference ‘Environment for Europe’, held in Denmark on 25 June 1998, that a request for environmental information may be denied in the following cases: a) When the request concerns documents being prepared; and b) when disclosure of such information would adversely affect the following: b.1.) the proper administration of justice, the possibility for every person to receive a fair trial, or a public authority’s ability to conduct a criminal or disciplinary investigation; and b.2.) the confidential nature of data and personal files concerning a natural person, where that person has not consented to disclosure to the public, when the confidential nature of this type of information is provided for by domestic law (…)” The partially transcribed precedent establishes that the right of access to information in environmental matters is not absolute but is subject to various limitations.

Of particular relevance to this judgment are limits concerning the proper administration of justice, the possibility for every person to receive a fair trial, or an authority’s ability to conduct a criminal investigation. This case falls within the restrictions cited above: a criminal investigation is ongoing and the document to which the amparo applicant seeks access is directly related to it. Indeed, the applicant acknowledges that EXPERT OPINION DCF:2025-01041-BIO was prepared by the Department of Forensic Sciences, Forensic Biology Section, of the Organismo de Investigación Judicial and was sent by the Fiscalía Agrario Ambiental to SINAC officials in the context of the criminal investigation in question. For that reason, in this Chamber’s view, and consistently with the Derecho de la Constitución, the denial of the requested information is not arbitrary or unlawful in the circumstances described.

The information sought is indeed environmental in nature, but the requested document is also an expert opinion connected to a criminal investigation in progress. To avoid hindering that investigation or undermining the interests protected by keeping the proceedings confidential, SINAC’s restriction on access to the information is therefore valid.

In addition, it must be considered that the right of petition, established in Article 27 of the Constitución Política, refers to every person’s ability to address any public official or official entity in writing to raise a matter of interest. That guarantee is complemented by the right to receive a prompt response, although this does not mean that the member of the public must receive an answer favorable to their interests. In other words, it is the right to ask, not the right to obtain what is requested. It also includes the right to receive a response related to the request. In this matter, it was established that the respondent authority addressed the amparo applicant’s request by LETTER-SINAC-ACT-DR-1156-2026 of 3 July 2026, setting out its reasons for considering it inappropriate to provide the requested expert opinion. Thus, there is no failure to respond that can be remedied through this jurisdiction.

In this regard, the applicant’s disagreement concerns the content of the response received and the refusal to provide the requested document, a claim based on the applicant’s own assessment that the criminal investigation did not prevent the information from being provided. In these circumstances, it is concluded that, in this case, neither the right of access to information of the person whose rights are protected, set out in Article 30 of the Constitución Política, nor the right of petition provided for in Article 27 of the Constitution has been infringed, since the respondent authority gave a response related to the request and the restriction on access to the requested document is supported by its connection to an ongoing criminal investigation. Accordingly, the amparo is denied on the merits.

III. DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, DRAFTED BY THE LATTER

In the case at hand, the applicant complains that the Sistema Nacional de Áreas de Conservación denied access to an expert opinion concerning the possible existence of forest on state-owned land in the Polo Turístico Golfo de Papagayo. The applicant considers this information necessary to participate in administrative proceedings related to authorization to cut down 748 trees and to protect environmental heritage.

Unlike the majority, we consider the facts presented to be of sufficient constitutional significance to allow the amparo to proceed. We emphasize that the requested information relates directly to possible harm to forest resources located on state-owned land and, consequently, to the right to a healthy and ecologically balanced environment recognized in Article 50 of the Constitución Política. Accordingly, the respective reports should be requested and the matter resolved on the basis of a more complete record.

On the basis of the foregoing, we dissent and would order the amparo to proceed.

IV. DOCUMENTATION SUBMITTED TO THE CASE FILE

The amparo applicant is advised that any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device that may have been submitted, must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session Nº 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, and the agreement approved by the Consejo Superior del Poder Judicial at session Nº 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo is denied on the merits. Justices Cruz Castro and Rueda Leal dissent and would order the amparo to proceed.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .

Recurso de amparo que se tramita bajo el número de expediente 26-026803-0007-CO, interpuesto por Nombre01, cédula de identidad CED01; contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACION.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala el 6 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACION. Manifiesta que en el Polo Turístico Golfo de Papagayo existe una situación que, según afirma, pone en alto riesgo cientos de árboles, pues mediante resolución SINAC-OSRSCC-052-2026, de 9 de abril de 2026, el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación (SINAC) otorgó un permiso que permitiría la tala rasa de 748 árboles de 32 especies diferentes y su respectivo sotobosque, ubicados en terrenos estatales administrados por el Instituto Costarricense de Turismo, respecto de los cuales sostiene que debió considerarse la existencia de Patrimonio Natural del Estado. Agrega que, de materializarse la tala, se produciría un cambio en el uso del suelo y afectaciones al paisaje natural, los ecosistemas, la biodiversidad y las generaciones futuras.Señala que, ante esa situación, el 1 de julio de 2026 presentó ante la Oficina del Área de Conservación Tempisque en Nicoya una denuncia y petición de información ambiental, en la que solicitó específicamente el DICTAMEN PERICIAL DCF:2025-01041-BIO, elaborado por el Departamento de Ciencias Forenses, Sección de Biología Forense, del Organismo de Investigación Judicial, el cual, según indica, fue remitido por la Fiscalía Agrario Ambiental a funcionarios del SINAC mediante correo electrónico el 16 de abril de 2026 y contiene información técnica sobre la existencia de bosque dentro del área del Polo Turístico Golfo de Papagayo. Expone que requirió dicha información para analizarla con especialistas en materia forestal y, eventualmente, ejercer acciones administrativas ante la SETENA y la Municipalidad de Liberia relacionadas con la autorización de tala y la conceptualización de bosque y Patrimonio Natural del Estado.Afirma que justificó ante los recurridos su derecho de acceso a la información y de participación en materia ambiental y que, mediante CARTA-SINAC-ACT-DR-1156-2026, de 3 de julio de 2026, se le negó la información solicitada, bajo el argumento de que el Ministerio Público había secuestrado el expediente administrativo físico y de que, al existir una causa penal abierta, la información se encontraba sujeta al secreto del sumario. Alega que dicha negativa resulta injustificada, pues los propios recurridos reconocieron que el SINAC recibió y conserva en sus sistemas institucionales el correo electrónico que contiene el referido dictamen, por lo que sostiene que el secuestro del expediente físico no impedía proporcionar los datos técnicos y conclusiones del peritaje solicitados, sin que ello afectara la investigación penal. Considera que la negativa vulnera el derecho de acceso a la información ambiental, el derecho de participación ciudadana, el derecho a un ambiente sano y ecológicamente equilibrado, el derecho a un clima sano y el principio de irreductibilidad de los bosques, al impedirle contar con información técnica que estima necesaria para participar e incidir en procedimientos administrativos relacionados con la protección ambiental del área.Solicita que se declare que los recurridos violentaron sus derechos fundamentales al negarle el acceso al DICTAMEN PERICIAL DCF:2025-01041-BIO, o a sus conclusiones y demás datos técnicos, y que se ordene proporcionar la información pertinente sobre el bosque existente en los terrenos estatales del Polo Turístico Golfo de Papagayo, dentro del plazo de cinco días hábiles siguientes al dictado de la sentencia. Solicita la intervención de la Sala.
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente reclama que el SINAC le negó el acceso al DICTAMEN PERICIAL DCF:2025-01041-BIO, o a sus conclusiones y demás datos técnicos sobre la existencia de bosque en terrenos estatales del Polo Turístico Golfo de Papagayo, pese a que, según afirma, dicha información se encuentra en poder de la institución, bajo el argumento de que el expediente administrativo físico fue secuestrado por el Ministerio Público y que existe una causa penal en curso; considera que dicha negativa lesiona su derecho de acceso a la información ambiental y de participación ciudadana en materia ambiental, así como el derecho a un ambiente sano y ecológicamente equilibrado, el derecho a un clima sano y el principio de irreductibilidad de los bosques, al impedirle contar con información técnica que requiere para promover actuaciones administrativas relacionadas con la protección ambiental y la eventual tala de 748 árboles en terrenos estatales, por lo que pretende que se ordene a los recurridos suministrarle la información solicitada.

II. INADMISIBILIDAD DEL AMPARO

De la prueba aportada a los autos se desprende que el 1 de julio de 2026 la parte recurrente solicitó al Sistema Nacional de Áreas de Conservación el DICTAMEN PERICIAL DCF:2025-01041-BIO, elaborado por el Departamento de Ciencias Forenses, Sección de Biología Forense, del Organismo de Investigación Judicial, así como sus conclusiones y demás datos técnicos, por considerar que dicha información resultaba necesaria para analizar la existencia de bosque en terrenos del Polo Turístico Golfo de Papagayo y, eventualmente, promover actuaciones administrativas ante la SETENA y la Municipalidad de Liberia. Asimismo, se constata que, mediante CARTA-SINAC-ACT-DR-1156-2026, de 3 de julio de 2026, la autoridad recurrida brindó respuesta a la gestión y explicó que no podía suministrar la información requerida, en razón de que el Ministerio Público había recibido el expediente administrativo físico y de que existía una investigación penal en curso relacionada con los hechos.

De lo anterior se colige que, contrario a lo que afirma la parte recurrente, no se está ante un supuesto de ausencia de respuesta de la Administración, sino frente a una contestación expresa cuya disconformidad radica en que el accionante considera que la información debió serle entregada pese a encontrarse vinculada con una investigación penal. Así, se presenta un conflicto entre la posición del recurrente, quien sostiene que la información debe ser pública por su naturaleza ambiental y porque, según afirma, el SINAC conserva en sus sistemas institucionales el correo electrónico que contiene el dictamen, y la postura de la instancia recurrida, la cual indica que lo solicitado se encuentra relacionado con una investigación penal en curso y que la documentación no puede ser suministrada en las condiciones pretendidas. Esto conlleva la necesidad de referirse a los límites del derecho a la información en materia ambiental, tema que ha sido desarrollado por esta Sala en su jurisprudencia.

En Sentencia Nº 2010-007789 de las 15:00 horas de 28 de abril de 2010 (criterio reiterado, entre otras, en Sentencias Nº 2012-005593 de las 16:04 horas de 2 de mayo de 2012 y Nº 2013-010883 de las 09:30 horas de 16 de agosto de 2013), este Tribunal indicó:

“(…) IV.- LÍMITES AL DERECHO DE ACCESO A LA INFORMACIÓN AMBIENTAL. Si bien se reconoce en nuestro ordenamiento jurídico la importancia esencial que posee el derecho de acceso a la información y, en este caso, a la información de índole ambiental, como un instrumento para garantizar la adecuada protección del medio ambiente –pues su conservación es una obligación que comparten los poderes públicos y la sociedad en su conjunto-, lo cierto es que, también, el ejercicio de dicho derecho se encuentra sujeto a límites. Resulta imposible predicar, respecto del derecho de acceso a la información ambiental, un derecho absoluto, puesto que, como el resto de derechos, posee un carácter relativo. De modo tal que, los límites que se le impongan a dicho derecho, se justifican en cuanto habrá situaciones en que la transparencia o publicidad puede causar serios perjuicios o trastornos a los intereses generales o particulares que la sociedad estime dignos de protección o prevalecientes.

De ahí que, dicho derecho debe ceder ante las exigencias de una convivencia pacífica y democrática, objetivo prioritario de la sociedad y de su organización política y, desde luego, también, ante el derecho a la intimidad y reserva del resto de los administrados. Desde esa perspectiva, resulta factible señalar, de conformidad, a su vez, con lo dispuesto por la Convención sobre el acceso a la información, la participación del público en la toma de decisiones y el acceso a la justicia en asuntos ambientales o Convención de Aarhus, adoptada en la Conferencia Ministerial “Medio Ambiente para Europa”, celebrada en Dinamarca el 25 de junio de 1998, que una solicitud de información sobre el medio ambiente podrá denegarse en los siguientes supuestos: a) Cuando la solicitud se refiere a documentos que están elaborándose y b) cuando la divulgación de tal información tenga efectos desfavorables sobre los siguientes aspectos: b.1.) La buena marcha de la justicia, posibilidad que toda persona pueda ser juzgada, equitativamente, o la capacidad de una autoridad pública para efectuar una investigación de orden penal o disciplinario y b.2.) el carácter confidencial de los datos y de los expedientes personales respecto de una persona física si esta persona no ha consentido la divulgación de esas informaciones al público, cuando dicho carácter confidencial de este tipo de información esté previsto por el derecho interno (…)” Del precedente parcialmente transcrito, se colige la afirmación de que el derecho de acceso a la información en materia ambiental no es absoluto, sino que admite una serie de limitaciones, siendo de importancia para esta sentencia lo referente a la buena marcha de la justicia, posibilidad de que toda persona pueda ser juzgada equitativamente o la capacidad de una autoridad de efectuar una investigación penal.

El caso que nos ocupa plantea un supuesto que encaja dentro de las restricciones anteriormente citadas, como lo es la existencia de una investigación penal en curso con la cual se encuentra directamente relacionado el documento cuyo acceso pretende la parte recurrente. En efecto, el propio accionante reconoce que el DICTAMEN PERICIAL DCF:2025-01041-BIO fue elaborado por el Departamento de Ciencias Forenses, Sección de Biología Forense, del Organismo de Investigación Judicial y que fue remitido por la Fiscalía Agrario Ambiental a funcionarios del SINAC, en el contexto de la investigación penal referida. Es por tal motivo que, en criterio de esta Sala y, en concordancia con lo dispuesto por el Derecho de la Constitución, la denegatoria de la información solicitada no resulta, en las circunstancias expuestas, arbitraria ni ilegal. Ciertamente, lo solicitado es de carácter ambiental, pero también es cierto que el contenido de la documentación requerida corresponde a un dictamen pericial vinculado con una investigación penal en fase de desarrollo; por lo que, a efectos de no entorpecerla y no atentar contra los intereses tutelados mediante la reserva de las actuaciones, resulta válida la limitación de acceso a la información planteada por el SINAC.

Aunado a lo anterior, debe tomarse en consideración que el derecho de petición, establecido en el artículo 27 de la Constitución Política, hace referencia a la facultad que posee toda persona para dirigirse por escrito a cualquier funcionario público o entidad oficial con el fin de exponer un asunto de su interés, garantía que se complementa con el derecho a obtener pronta respuesta, aunque esto último no significa que el administrado deba recibir una contestación favorable a sus intereses. En otras palabras, es el derecho a pedir y no el derecho a obtener lo que se pide. Además, implica el derecho a que la respuesta que se brinde esté relacionada con lo que se pide. En el presente asunto, quedó acreditado que la autoridad recurrida atendió la gestión formulada por la parte recurrente mediante la CARTA-SINAC-ACT-DR-1156-2026, de 3 de julio de 2026, en la cual expuso las razones por las que estimaba improcedente entregar el dictamen requerido, de modo que no se configura una omisión de respuesta susceptible de tutela mediante esta jurisdicción.

En este sentido, la inconformidad del recurrente se dirige al contenido de la contestación recibida y a su negativa de suministrarle el documento solicitado, pretensión que parte de su propia valoración de que la existencia de la investigación penal no impedía la entrega de la información. ajo tal estado de las cosas, se concluye que, en la especie, no se ha lesionado el derecho de acceso a la información del tutelado, contenido en el numeral 30 de la Constitución Política, ni el derecho de petición previsto en el artículo 27 constitucional, pues la autoridad recurrida brindó una respuesta relacionada con lo solicitado y la restricción impuesta al acceso del documento requerido encuentra sustento en su vinculación con una investigación penal en desarrollo. En consecuencia, se rechaza por el fondo el recurso.

III. VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL, CON REDACCIÓN DEL SEGUNDO

En el sub lite, el recurrente reclama que el Sistema Nacional de Áreas de Conservación le negó el acceso a un dictamen pericial relacionado con la eventual existencia de bosque en terrenos estatales del Polo Turístico Golfo de Papagayo, información que estima necesaria para participar en los procedimientos administrativos vinculados con la autorización para talar 748 árboles y proteger el patrimonio ambiental.

A diferencia de la mayoría, consideramos que los hechos planteados revisten suficiente trascendencia constitucional para cursar el amparo. Subrayamos que la información requerida se relaciona directamente con la eventual afectación a recursos forestales ubicados en terrenos estatales y, por ende, con el derecho a un ambiente sano y ecológicamente equilibrado reconocido en el artículo 50 de la Constitución Política. En consecuencia, corresponde solicitar los informes respectivos y resolver el asunto con mayores elementos de juicio.

Con base en lo anterior, salvamos el voto y disponemos que se curse el amparo.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza por el fondo. Los magistrados Cruz Castro y Rueda Leal salvan el voto y disponen cursar el amparo.
