CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty on 18 August 2026.

Post-judgment motion filed by Nombre01 in relation to judgment no. 2026026881, issued at 9:25 on 17 July 2026.

Background:

  1. 1In a filing added to the digital case file on 12 August 2026, the amparo applicant files a motion alleging disobedience in relation to judgment no. 2026026881, issued at 9:25 on 17 July 2026. She alleges: “l. PURPOSE OF THIS MOTION By means of this filing, and with due respect, I ask this Chamber to assess whether the action reported by the Municipalidad de Talamanca in Official Letter No. OF A.M.T. E-202-2026, dated 7 August 2026, constitutes effective compliance with what was ordered in judgment No. 2026026881. I have received the Municipalidad’s response, and I appreciate that a formal reply was finally issued. However, I do not agree that the actions reported constitute an effective solution to the complaints that gave rise to the amparo proceeding. My intention is not to disregard the actions the Municipalidad may have taken, but to bring to this Chamber’s attention that, according to the Municipalidad’s own response, the flooding problem continues, and the response of 7 August does not establish what specific action will resolve it effectively.This Chamber’s own judgment granted my amparo application precisely because there had been undue delay or unjustified delay and because the record did not show that the Municipalidad had replied in a timely manner to each of the points raised in my various filings. 0031-0007-237692191-5618-F-2.PDF II. WHAT THE CHAMBER EXPRESSLY ORDERED Judgment No. 2026026881 ordered the Mayor of Talamanca to issue the necessary instructions, coordinate as appropriate, and take the corresponding measures within his authority to ensure that, within the maximum period of fifteen days, the complaints I filed on the following dates were addressed as required by law: 1 July 2021; 21 February 2023; 9 May 2024; and 13 February 2026. It also ordered that the relevant information be notified to me. 0031-0007-237692191-5618-F.PDF For that reason, I understand that compliance with the judgment must be assessed in relation to the content and purpose of those complaints, and not solely by whether the Municipalidad eventually issued a written response.III. THE MUNICIPALITY ITSELF ACKNOWLEDGES THAT THE PROBLEM CONTINUES In Official Letter No. OF A.M.T. E-202-2026, dated 7 August 2026, the Municipalidad reports that it carried out mitigation work between 11 and 29 September 2025, using heavy machinery and performing ditch cleaning and removal of logs, branches, and sediment. I do not dispute that these actions were carried out. However, the Municipalidad itself acknowledges in that same response that a “remaining problem” exists, which it attributes to the interruption of secondary ditches on private property and to the fact that the final discharge channel empties into a protected wetland. In other words, the Municipalidad’s own response acknowledges that the drainage problem has not been resolved. The Municipalidad now announces a cadastral survey, a visual inspection, and, eventually, the referral of documentation to the Ministerio de Salud and SINAC-ACLAC.My concern is that these new actions once again place a definitive solution in a future phase of studies and coordination, without stating what concrete solution there will be to the drainage problem that continues to affect the area. IV. THE MUNICIPALITY’S REPORT OF 25 SEPTEMBER 2021 I consider it especially important to submit to this Chamber Report No. ING.A.DV-107-2021, dated 25 September 2021, prepared by the Departamento Vial of the Municipalidad de Talamanca. This document is particularly relevant because it was prepared by the Municipalidad itself almost five years ago, when the problem had already been reported, and contains a specific technical analysis of the flooding in Dirección05. In that report, the Municipalidad found that existing drainage channels had been obstructed and that, in some cases, homes had been built over them or pipes had been installed that were subject to sediment buildup.The report concluded that a serious flooding problem existed in Dirección05 and that, from a technical standpoint, the solution was to build a collector channel to convey the volume of water to the discharge points at sea. The Departamento Vial even performed the corresponding hydraulic calculations and established the technical specifications for that channel, including a bottom width of approximately one meter, a depth of no less than 0.35 meters, and wall and floor thickness of no less than 0.10 meters. The report also estimated the cost of that solution at no less than ¢38.000.000 and stated that the Departamento Vial was pursuing arrangements with the Comisión Nacional de Emergencias to seek a solution. I consider this report extremely important because it shows that the Municipalidad had already technically identified the problem and determined a concrete solution as of September 2021.Therefore, I respectfully ask that the Chamber assess: a) what actions have been taken since that report was prepared; b) whether the technical solution identified there was carried out in whole or in part; d) what concrete solution the Municipalidad currently proposes to resolve the flooding problem. This is especially relevant because almost five years have passed since that report and the flooding problem continues. V. REGARDING THE SPECIFIC DITCH REPORTED IN FEBRUARY 2026 In my complaint of February 2026, I explained that there was a natural drainage channel or ditch along the road that had been closed, causing flooding on the road and adjacent properties. I also stated that municipal officials had visited the site and acknowledged the need to create a new ditch on the public road, but later indicated that no work would be carried out until the water’s outlet to the sea was resolved.This circumstance is especially important because it shows that the need to intervene in the drainage system is not my later interpretation, but rather an issue already identified by municipal officials. My February 2026 request also sought the adoption of immediate measures to restore the drainage and the carrying out of temporary and urgent works while a definitive solution was being determined. However, the Municipalidad’s response of 7 August does not state that the ditch was restored or indicate any specific action to resolve it. I therefore ask that the Chamber specifically assess what municipal action has been taken regarding the ditch reported in February 2026 and what solution is planned for that location. VI. WORK CARRIED OUT WITH MACHINERY IN 2025 The Municipalidad bases a significant part of its response on the work carried out between 11 and 29 September 2025. I wish to clarify to this Chamber that I do not deny that the Municipalidad used machinery in the area.What I wish to specify is that the work referred to by the Municipalidad was carried out on the parallel street (Dirección02), and not on my street (Dirección01) or at the specific ditch whose obstruction I reported in February 2026. Therefore, I consider that the cleaning and ditch work should not be interpreted as though it constituted implementation of the solution I had requested. The Municipalidad’s own documentation describes those actions as cleaning, ditch work, and removal of sediment, logs, and branches, and it currently acknowledges that the problem persists. VII. REGARDING THE WATER OUTLET AND THE PRECEDENT OF THE OTHER AMPARO PROCEEDING There is also a judicial precedent that I consider especially relevant. In case file 23-010056-0007-CO, concerning another amparo proceeding related to flooding in Puerto Viejo, Dirección05, the Constitutional Chamber ordered the Municipalidad to finally resolve the amparo applicant’s complaint.Later, upon a motion alleging disobedience, the Chamber determined that the order had not been complied with. On that occasion, the Municipalidad had reported actions related to the drainage system and had raised as an additional difficulty the presence of sewage in the storm drain system and the need to coordinate with the Ministerio de Salud. However, the Chamber considered that circumstance did not justify noncompliance, noting that the work in Bakery had not been completed and that there was no evidence of adequate coordination between the Municipalidad and the Ministerio de Salud. Accordingly, it granted the motion alleging disobedience and again ordered compliance with its ruling. I consider this precedent particularly relevant because it concerns: the same Municipalidad; the same community; the same general flooding problem; and the same Dirección05. I do not intend to claim that the two cases are technically identical.I ask only that the Chamber bear in mind that there is already a precedent in which it considered that the existence of additional problems related to water drainage and the need for coordination with other institutions did not, by themselves, justify leaving the flooding problem unresolved. VIII. REGARDING THE MUNICIPAL REPORT THAT CONDITIONS ACTIONS ON ANOTHER NEIGHBOR’S WATER OUTLET I also submit the municipal report that refers to the need to first resolve another neighbor’s water outlet before taking certain actions. This point is especially relevant because that same circumstance later became the subject of an independent amparo proceeding, case file 23-0100560007-CO, in which the Chamber ordered the Municipalidad to definitively resolve Bakery’s flooding problem. I do not claim that the documentation currently available is by itself sufficient to establish that the situation was definitively resolved.I ask that the Chamber assess whether the impediment previously used to justify the lack of municipal action still exists and, if so, what its basis is and what coordination actions the Municipalidad has taken to overcome it. I consider this especially relevant in light of the previously mentioned disobedience precedent. IX. REGARDING THE ALLEGED 14-METER WIDTH Another aspect of the Municipalidad’s response of 7 August 2026 with which I disagree is its reference to an alleged “2024 complaint” concerning the road’s 14-meter width. I wish to expressly clarify that I never filed a complaint seeking a determination by the Municipalidad that the road must be 14 meters wide. The reference to approximately 14 meters was made in the context of my filings concerning the road and the flooding problem, but the subject of my complaint has always been the solution to the drainage problem, water evacuation, and road conditions, not the determination of a 14-meter right-of-way.Therefore, I consider that this issue should not divert attention from the main subject of the complaints that the Chamber ordered to be addressed. X. REGARDING THE MOPT DOCUMENT ESTABLISHING 9.5 METERS I also submit official documentation from the Ministerio de Obras Públicas y Transportes (MOPT) concerning road 70403300 — Urban Streets of Puerto Viejo, which records a right-of-way width of 9.5 meters. Therefore, if the Municipalidad currently considers there to be a 14-meter strip, I respectfully ask that it state the technical, cadastral, or legal basis for that measurement and how it is reconciled with the official MOPT documentation establishing 9.5 meters. I reiterate that I am not asking this Chamber to determine what the road’s width should be, but simply to bear in mind that the 14-meter issue was not the subject of my complaints and that official documentation establishes a different measurement.XI. THIS CHAMBER’S OWN JUDGMENT ALREADY ESTABLISHED THAT THERE HAD BEEN UNJUSTIFIED DELAY Finally, I consider it important to recall that, in deciding my amparo application, this Chamber already determined that the Municipalidad had incurred undue delay or unjustified delay, even though some actions had been taken before notice of the amparo. The Chamber also stated that the record did not show that the Municipalidad had replied in a timely manner to each of the points raised in my various filings. The judgment therefore expressly ordered that the four complaints be addressed and the relevant information be notified to me within fifteen days. For that reason, I consider it legitimate for this Chamber now to assess whether the response issued on 7 August constitutes genuine compliance with that order or merely an administrative response that leaves unresolved the effective solution to the problem that gave rise to the amparo.XII. REQUEST For all the foregoing reasons, I respectfully ask this Chamber: 1. To accept this motion and add it to case file No. 26-016209-0007-CO. 2. To accept the Municipalidad’s response dated 7 August 2026, together with the accompanying documents. 3. To assess whether the actions reported by the Municipalidad in Official Letter OF A.M.T. E-202-2026 constitute effective compliance with judgment No. 2026026881. 4. To bear in mind that the Municipalidad itself acknowledges that the flooding problem continues, attributing it to various constraints. 5. To give special consideration to Report No. ING.A.DV-107-2021, dated 25 September 2021, prepared by the Municipalidad’s own Departamento Vial, which had already identified the serious flooding problem in Dirección05 and technically determined the need to build a collector channel as a solution. 6. If deemed necessary, to require the Municipalidad to report what specific actions it has taken since that 2021 report with respect to the technical solution identified there and, if it is no longer viable, what alternative solution it intends to carry out. 7.To specifically assess what action has been taken regarding the ditch whose obstruction was reported, given that the Municipalidad’s response does not establish that the ditch was restored or set out a specific solution for that location. 8. To consider the precedent in case file 23-010056-0007-CO, in which this Chamber granted a motion alleging disobedience related to flooding in Bakery and considered that difficulties involving sewage and the lack of interinstitutional coordination did not justify failing to comply with the order to definitively resolve the problem. 9. To bear in mind that the alleged 14-meter width is not the subject of my complaints, and that I submit official MOPT documentation recording a 9.5-meter right-of-way. 10. If this Chamber considers that the Municipalidad’s actions do not satisfy what was ordered in judgment No. 2026026881, to require the Municipalidad to proceed with effective compliance, addressing in a comprehensive manner the complaints that were the subject of the amparo proceeding. 11.And, if this Chamber considers that the judgment has not been complied with, I respectfully ask that this motion be treated as a motion alleging disobedience and that the appropriate measures be adopted pursuant to the Ley de la Jurisdicción Constitucional.”
  2. 2The legal requirements have been observed in the proceedings conducted.

Drafted by Justice Rueda Leal; and, Reasons:

I.In judgment no. 2026026881, issued at 9:25 on 17 July 2026, the following was ordered:

“ The amparo application is granted. Rugeli Morales Rodríguez, in his capacity as Mayor of Talamanca, or whoever holds that office, is ordered to immediately issue the necessary instructions, coordinate as appropriate, and take the corresponding measures within the scope of their respective authorities to ensure that, within the maximum period of FIFTEEN DAYS, counted from notification of this judgment, the amparo applicant’s complaints filed on 1 July 2021, 21 February 2023, 9 May 2024, and 13 February 2026 are addressed as required by law and the relevant information is notified to her. The foregoing is subject to the warning that, based on Article 71 of the Ley de esta Jurisdicción, whoever receives an order that must be complied with or enforced, issued in an amparo proceeding, and fails to comply with or enforce it, shall be punished by imprisonment of three months to two years or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty.

The Municipalidad de Talamanca is ordered to pay the costs, damages, and losses caused by the facts forming the basis for this declaration, which shall be calculated in the enforcement of judgment before the administrative-litigation jurisdiction. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note. Notify the parties.” That judgment was notified to the respondent authorities on 20 July 2026.

II.Regarding the motion alleging noncompliance. In this case, the amparo applicant files a motion alleging disobedience in relation to judgment no. 2026026881, issued at 9:25 on 17 July 2026. She states that although she was given a response, the municipal authorities have not taken the actions necessary to resolve the stormwater drainage problem in Dirección05.

In this regard, it is recalled that the Chamber ordered that “within the maximum period of FIFTEEN DAYS, counted from notification of this judgment, the amparo applicant’s complaints filed on 1 July 2021, 21 February 2023, 9 May 2024, and 13 February 2026 be addressed as required by law and the relevant information be notified to her.” In this regard, the evidence submitted shows that, in Official Letter OF-A.M.T. E-202-2026 of 7 August 2026, the following response was given to the amparo applicant:

“In strict compliance with the order of the Constitutional Chamber of the Supreme Court of Justice in Judgment No. 2026026881, this office formally communicates to you the resolution on the merits regarding your complaints about the stormwater problem in Dirección05, Dirección01:

1. In accordance with the report submitted by the Departamento Vial under No. ING.DV-87-2026, it is established that this Municipalidad carried out physical mitigation work in Dirección04 from 11 to 29 September 2025. For 19 calendar days, heavy machinery (Back Hoe) was used for ditch work, removal of logs and branches, and removal of sediment from the public stormwater channel to mitigate flooding in adjacent homes. This technical report had already been formally submitted by this Mayor’s Office to the Constitutional Chamber for inclusion in the judicial case file.

2. In accordance with the report submitted, the Technical Unit determined that the remaining problem is due to constraints outside the Municipalidad’s control: the interruption of secondary ditches by private individuals within their private properties and the fact that the final discharge channel empties directly into a protected wetland, classified as State Natural Heritage (PNE) in the Maritime Terrestrial Zone, which legally prevents major interventions without prior approval from the competent environmental authorities.

3. To resolve with absolute legal certainty your specific claims concerning the road’s 14-meter width (2024 complaint) and the closure of the ditch by a private individual (2026 complaint), you are informed that this office has issued a mandatory order to the Departamento Vial and the Topography Unit. By this formal instruction, they were ordered to conduct an on-site cadastral survey to legally determine the nature of the disputed strip, as well as a supplementary on-site visual inspection to verify the obstruction of the reported natural watercourse, with the immediate submission of evidence ordered if it is already held in the Technical Unit’s files, so that it may be promptly referred to the Ministerio de Salud and SINAC-ACLAC. The final results of these technical studies will be notified to your email address.

A certified true copy of Technical Report No. ING.DV-87-2026 is attached.” Accordingly, the evidence submitted shows that the respondent authority did respond to the amparo applicant’s filing. However, it is clear from the motion alleging disobedience that it expresses disagreement with the response given, as she considers the actions of the Municipalidad de Talamanca insufficient.

In this regard, note that the amparo applicant was informed that physical mitigation work had been carried out in September 2025, that it was determined that the remaining problem was due to actions by private individuals on their properties, and that an order was issued to the Departamento Vial and the Topography Unit to verify the obstruction of the reported natural watercourse, in order to channel the matter to the Ministerio de Salud and SINAC.

Consequently, it is established that the respondent authority is undertaking actions aimed at resolving the problem reported by the applicant, all of which was duly notified to her. In that regard, any dissatisfaction the amparo applicant may have with the response provided or the actions proposed by the Municipalidad entails a dispute outside this jurisdiction’s sphere of authority and must be resolved before the respondent authority itself or in the appropriate ordinary forum, where she may fully debate the merits of the matter and assert her claims.

Accordingly, in the terms in which the motion alleging disobedience was filed, no noncompliance warranting the Chamber’s intervention is apparent at this procedural stage. Therefore, the motion is denied.

III.Documents submitted to the case file. The parties are advised that, if they have submitted any paper document or objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved within a maximum period of 30 business days, counted from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Poder Judicial” (approved by the Corte Plena in Article XXVI of session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and Article LXXXI of session of the Consejo Superior del Poder Judicial no. 43-12 of 3 May 2012.

Therefore:

Resultando:

  1. 1Por escrito incorporado al expediente digital el 12 de agosto de 2026, la recurrente plantea gestión de desobediencia en relación con la sentencia nro. 2026026881 de las 9:25 horas del 17 de julio de 2026. Alega: “l. OBJETO DE LA PRESENTE GESTIÓN Por medio del presente escrito, y con el debido respeto, solicito a esta Sala que valore si la actuación comunicada por la Municipalidad de Talamanca mediante el Oficio N.° OF A.M.T. E-202-2026, de fecha 7 de agosto de 2026, constituye un cumplimiento efectivo de lo ordenado en la sentencia N.° 2026026881. He recibido la respuesta de la Municipalidad y agradezco que finalmente se haya emitido una contestación formal. Sin embargo, no estoy conforme con considerar que las actuaciones comunicadas constituyan una solución efectiva a las denuncias que dieron origen al recurso de amparo. Mi intención no es desconocer las actuaciones que la Municipalidad haya realizado, sino poner en conocimiento de esta Sala que, según la propia contestación municipal, el problema de inundaciones continúa, y que la respuesta de 7 de agosto no establece cuál será la actuación concreta que permitirá solucionarlo de manera efectiva.La propia sentencia de esta Sala declaró con lugar mi recurso precisamente porque había existido una dilación indebida o retardo injustificado y porque no constaba que la Municipalidad hubiera contestado oportunamente a cada uno de los puntos planteados en mis distintas gestiones. 0031-0007-237692191-5618-F-2.PDF ll. LO QUE ORDENÓ EXPRESAMENTE LA SALA La sentencia N.' 2026026881 ordenó al Alcalde de Talamanca que girara las instrucciones necesarias, coordinara lo pertinente y dispusiera lo correspondiente dentro de sus competencias para asegurar que, dentro del plazo máximo de quince días, se atendieran como en Derecho correspondiera las denuncias gestionadas por mí los días: 1 de julio de 2021; 21 de febrero de 2023; 9 de mayo de 2024; y 13 de febrero de 2026. Asimismo, ordenó que se me notificara lo pertinente. 0031-0007-237692191-5618-F.PDF Por ello, entiendo que el cumplimiento de la sentencia debe valorarse en relación con el contenido y objeto de esas denuncias, y no únicamente desde el punto de vista de si la Municipalidad emitió finalmente una respuesta escrita.III. LA PROPIA MUNICIPALIDAD RECONOCE QUE EL PROBLEMA CONTINÚA En su Oficio N.° OF A.M.T, E-202-2026, de fecha 7 de agosto de 2026, la Municipalidad informa que realizó trabajos de mitigación entre el 11 y el 29 de septiembre de 2025, mediante maquinaria pesada y labores de recaba, retiro de palos, ramas y sedimentos. No cuestiono que dichas actuaciones hayan sido realizadas. Sin embargo, la propia Municipalidad reconoce en esa misma contestación que existe una "problemática remanente", que atribuye a la interrupción de zanjas secundarias en propiedades privadas y a que el canal de descarga final vierte sobre un humedal protegido. Es decir, la propia respuesta municipal reconoce que la problemática de drenaje no ha quedado resuelta. La Municipalidad anuncia ahora un levantamiento catastral, una inspección ocular y, eventualmente, la remisión de documentación al Ministerio de Salud y al SINAC-ACLAC.Mi preocupación es que estas nuevas actuaciones vuelven a situar la solución definitiva en una fase futura de estudios y coordinaciones, sin indicar cuál será la solución concreta al problema de drenaje que continúa afectando a la zona. IV. EL INFORME MUNICIPAL DE 25 DE SEPTIEMBRE DE 2021 Considero especialmente importante aportar a esta Sala el Informe N.° ING.A.DV-107-2021, de fecha 25 de septiembre de 2021, elaborado por el Departamento Vial de la Municipalidad de Talamanca. Este documento es particularmente relevante porque fue elaborado por la propia Municipalidad hace casi cinco años, cuando el problema ya había sido denunciado, y contiene un análisis técnico específico de las inundaciones de Dirección05. En dicho informe, la Municipalidad constató que los canales de evacuación existentes habían sido obstruidos y que en algunos casos se habían construido viviendas sobre ellos o se habían colocado tuberías que presentaban sedimentación.El informe concluyó que existía un grave problema de inundaciones en Dirección05 y que, desde el punto de vista técnico, la solución consistía en construir un canal recolector que condujera el volumen de agua hacia los puntos de descarga al mar. Incluso el Departamento Vial realizó los cálculos hidráulicos correspondientes y estableció las características técnicas de dicho canal, incluyendo una base inferior de aproximadamente un metro, una profundidad no menor de 0,35 metros y un espesor de paredes y piso no menor de 0,10 metros. El informe estimó asimismo el coste de dicha solución en una cantidad no menor de ¢38.000.000, y señaló que el Departamento Vial estaba realizando gestiones ante la Comisión Nacional de Emergencias para procurar una solución. Considero que este informe es de enorme importancia porque demuestra que la Municipalidad ya había identificado técnicamente el problema y había determinado una solución concreta desde septiembre de 2021.Por ello, respetuosamente solicito que se valore: a) qué actuaciones se han realizado desde la elaboración de dicho informe; b) si la solución técnica allí identificada fue ejecutada total o parcialmente; d) cuál es actualmente la solución concreta que la Municipalidad propone para resolver el problema de inundaciones. Lo anterior resulta especialmente relevante porque han transcurrido casi cinco años desde aquel informe y el problema de inundaciones continúa. V. SOBRE EL ZANJO CONCRETO DENUNCIADO EN FEBRERO DE 2026 En mi denuncia de febrero de 2026 expliqué que en el camino existía un cauce o zanjo natural de desagüe que había sido cerrado y que ello generaba inundaciones en el camino y propiedades colindantes. Asimismo, indiqué que funcionarios municipales habían visitado el lugar y habían reconocido la necesidad de realizar un nuevo zanjo en la calle pública, pero posteriormente se indicó que no se realizaría ninguna obra mientras no se resolviera la salida del agua al mar.Esta circunstancia es especialmente importante porque demuestra que la necesidad de intervenir el sistema de drenaje no es una interpretación posterior mía, sino una cuestión que ya había sido identificada por funcionarios municipales. Mi petición de febrero de 2026 solicitaba, además, que se adoptaran medidas inmediatas para restablecer el desagüe y que se realizaran obras temporales y urgentes mientras se definía una solución definitiva. Sin embargo, la contestación municipal de 7 de agosto no establece que ese zanjo haya sido restablecido ni indica una actuación concreta para resolverlo. Por ello, solícito que se valore específicamente qué actuación municipal se ha realizado respecto del zanjo denunciado en febrero de 2026 y cuál es la solución prevista para dicho punto. VI. LOS TRABAJOS REALIZADOS CON MAQUINARIA EN 2025 La Municipalidad fundamenta parte importante de su contestación en los trabajos realizados entre el 11 y el 29 de septiembre de 2025.Deseo aclarar ante esta Sala que no niego que la Municipalidad haya utilizado maquinaria en la zona. Lo que deseo precisar es que los trabajos a los que hace referencia la Municipalidad se realizaron en la calle paralela (Dirección02) y no en mi calle (Dirección01) ni en el zanjo concreto cuya obstrucción denuncié en febrero de 2026. Por ello, considero que dichos trabajos de limpieza y recaba no deben interpretarse como si hubieran supuesto la ejecución de la solución que yo había solicitado. La propia documentación municipal describe esas actuaciones como labores de limpieza, recaba y retiro de sedimentos, palos y ramas, y reconoce actualmente que persiste la problemática. Vil. SOBRE LA SALIDA DEL AGUA Y EL ANTECEDENTE DEL OTRO RECURSO DE AMPARO Existe además un antecedente judicial que considero especialmente relevante. En el expediente 23-010056-0007-CO, relativo a otro recurso de amparo relacionado con las inundaciones de Puerto Viejo, Dirección05, la Sala Constitucional ordenó a la Municipalidad resolver en definitiva la denuncia de la recurrente.Posteriormente, ante una gestión de desobediencia, la Sala determinó que la orden no había sido cumplida. En aquella ocasión, la Municipalidad había informado sobre actuaciones relacionadas con el sistema de drenaje y había planteado como dificultad adicional la existencia de aguas negras en el alcantarillado pluvial y la necesidad de coordinar con el Ministerio de Salud. Sin embargo, la Sala consideró que esa situación no justificaba el incumplimiento, señalando que las obras en Bakery no habían terminado y que no constaba una adecuada coordinación entre la Municipalidad y el Ministerio de Salud. En consecuencia, acogió la gestión de desobediencia y ordenó nuevamente cumplir lo dispuesto. Considero este antecedente particularmente relevante porque se trata de: la misma Municipalidad; la misma comunidad; la misma problemática general de inundaciones; y la misma Dirección05. No pretendo afirmar que ambos casos sean técnicamente idénticos.Lo que solicito es que se tenga presente que ya existe un antecedente en el que esta Sala consideró que la existencia de problemas adicionales relacionados con la evacuación de aguas y la necesidad de coordinación con otras instituciones no constituían, por sí solas, una justificación para dejar sin resolver el problema de inundaciones. VIII. SOBRE EL INFORME MUNICIPAL QUE CONDICIONA LAS ACTUACIONES A LA SALIDA DEL AGUA DE OTRO VECINO Asimismo, aporto el informe municipal en el que se hace referencia a la necesidad de solucionar previamente la salida del agua correspondiente a otro vecino antes de realizar determinadas actuaciones. Este punto resulta especialmente relevante porque esa misma circunstancia fue posteriormente objeto de un recurso de amparo independiente, expediente 23-0100560007-CO, en el que la Sala ordenó a la Municipalidad resolver definitivamente la problemática de inundaciones de Bakery.No afirmo que la documentación actualmente disponible permita asegurar por sí sola que aquella situación quedó definitivamente solucionada. Lo que solicito es que la Sala valore si el impedimento que anteriormente se utilizaba para justificar la falta de actuación municipal continúa existiendo actualmente y, en caso afirmativo, cuál es su fundamento y qué actuaciones de coordinación ha realizado la Municipalidad para superarlo. Considero que esto es especialmente relevante a la luz del antecedente de desobediencia anteriormente señalado. IX. SOBRE EL SUPUESTO ANCHO DE 14 METROS Otro aspecto de la contestación municipal del 7 de agosto de 2026 con el que no estoy conforme es la referencia a una supuesta "denuncia de 2024" sobre el ancho de 14 metros del camino. Deseo aclarar expresamente que yo nunca presenté una denuncia cuyo objeto fuera solicitar que la Municipalidad determinara que la vía debía tener 14 metros de ancho.La referencia a aproximadamente 14 metros se realizó dentro del contexto de mis gestiones relacionadas con el camino y el problema de inundaciones, pero el objeto de mi reclamación siempre ha sido la solución del problema de drenaje, la evacuación de las aguas y las condiciones de la vía, no la determinación de un derecho de vía de 14 metros. Por ello, considero que esta cuestión no debe desviar el objeto principal de las denuncias que esta Sala ordenó atender. X. SOBRE EL DOCUMENTO DEL MOPT QUE ESTABLECE 9,5 METROS Aporto igualmente documentación oficial del Ministerio de Obras Públicas y Transportes (MOPT) correspondiente al camino 70403300 — Calles Urbanas de Puerto Viejo, en la que consta un ancho de derecho de vía de 9,5 metros. Por ello, si la Municipalidad considera actualmente que existe una franja de 14 metros, solicito respetuosamente que se indique cuál es el fundamento técnico, catastral o jurídico de esa medida y cómo se concilia con la documentación oficial del MOPT que establece 9,5 metros.Reitero que no solicito a esta Sala que determine cuál debe ser el ancho de la vía, sino simplemente que se tenga presente que la cuestión de los 14 metros no fue el objeto de mis denuncias y que existe documentación oficial que establece una medida diferente. XI. LA PROPIA SENTENCIA DE ESTA SALA YA ESTABLECIÓ QUE EXISTIÓ UN RETARDO INJUSTIFICADO Finalmente, considero importante recordar que esta Sala ya determinó, al resolver mi recurso, que la Municipalidad había incurrido en una dilación indebida o retardo injustificado, pese a que se habían realizado algunas gestiones antes de la notificación del amparo. La Sala señaló además que no constaba que la Municipalidad hubiera contestado oportunamente cada uno de los puntos planteados en mis distintas gestiones. La sentencia, por tanto, ordenó expresamente que se atendieran las cuatro denuncias y se me notificara lo pertinente dentro del plazo de quince días.Por ello, considero legítimo que esta Sala valore ahora si la respuesta emitida el 7 de agosto constituye un verdadero cumplimiento de aquella orden o simplemente una respuesta administrativa que deja pendiente la solución efectiva del problema que dio origen al amparo. XII. PETITORIO Por todo lo expuesto, respetuosamente solicito a esta Sala: 1. Que tenga por presentada esta gestión y la incorpore al expediente N.° 26-016209-0007-CO. 2. Que tenga por aportada la contestación municipal de fecha 7 de agosto de 2026, junto con los documentos que se acompañan. 3. Que valore si las actuaciones comunicadas por la Municipalidad mediante el Oficio OF A.M.T. E-202-2026 constituyen un cumplimiento efectivo de la sentencia N. 0 2026026881. 4. Que se tenga presente que la propia Municipalidad reconoce que la problemática de inundaciones continúa, atribuyéndola a diferentes condicionantes. 5. Que se valore especialmente el Informe N.' ING.A.DV-107-2021, de 25 de septiembre de 2021, elaborado por el propio Departamento Vial de la Municipalidad, en el que ya se identificaba el grave problema de inundaciones de Dirección05 y se determinaba técnicamente la necesidad de construir un canal recolector como solución. 6.Que se requiera, si se considera necesario, que la Municipalidad informe qué actuaciones concretas ha realizado desde dicho informe de 2021 respecto de la solución técnica allí identificada y, si ya no resulta viable, cuál es la solución alternativa que pretende ejecutar. 7. Que se valore específicamente qué actuación se ha realizado respecto del zanjo cuya obstrucción fue denunciado, dado que la respuesta municipal no acredita que dicho zanjo haya sido restablecido ni establece una solución concreta para dicho punto. 8. Que se valore el antecedente del expediente 23-010056-0007-CO, en el que esta Sala acogió una gestión de desobediencia relacionada con las inundaciones de Bakery y consideró que las dificultades relacionadas con aguas negras y la falta de coordinación interinstitucional no justificaban dejar sin cumplir la orden de resolver definitivamente la problemática. 9. Que se tenga presente que la cuestión del supuesto ancho de 14 metros no constituye el objeto de mis denuncias, y que aporto documentación oficial del MOPT en la que consta un derecho de vía de 9,5 metros. 10.Que, si esta Sala considera que las actuaciones municipales no satisfacen lo ordenado en la sentencia N.° 2026026881, se requiera a la Municipalidad para que proceda a su efectivo cumplimiento, atendiendo de manera integral las denuncias que fueron objeto del recurso de amparo. 11. Y, en caso de que esta Sala considere que existe incumplimiento de la sentencia, solicito respetuosamente que la presente gestión sea valorada como gestión de desobediencia, adoptándose las medidas que correspondan conforme a la Ley de la Jurisdicción Constitucional”.
  2. 2En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.En la sentencia nro. 2026026881 de las 9:25 horas del 17 de julio de 2026 se dispuso:

" Se declara con lugar el recurso. Se les ordena a Rugeli Morales Rodríguez en su condición de alcalde de Talamanca, o a quien ocupe ese cargo, que de manera inmediata gire las instrucciones necesarias, coordine lo pertinente y disponga lo correspondiente dentro del ámbito de sus competencias respectivas para asegurar que, dentro del plazo máximo de QUINCE DÍAS, contado a partir de la notificación de esta sentencia, se atienda como en Derecho corresponde las denuncias del recurrente gestionadas el 1° de julio de 2021, 21 de febrero de 2023, 9 de mayo de 2024 y 13 de febrero de 2026 y le notifiquen lo pertinente. Lo anterior, bajo el apercibimiento de que, con base en lo establecido en el artículo 71, de la Ley de esta Jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Talamanca al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia ante la jurisdicción contencioso-administrativa. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado pone nota. Notifíquese”.

Tal resolución fue notificada a las autoridades recurridas el 20 de julio de 2026.

II.Sobre la gestión de inejecución planteada. En la especie, la parte recurrente plantea una gestión de desobediencia en relación con la sentencia nro. 2026026881 de las 9:25 horas del 17 de julio de 2026. Expone que si bien le brindaron una respuesta, las autoridades municipales no han realizado las acciones necesarias para solucionar el problema de evacuación de aguas pluviales en Dirección05.

Sobre el particular, se recuerda que lo ordenado por la Sala fue que “dentro del plazo máximo de QUINCE DÍAS, contado a partir de la notificación de esta sentencia, se atienda como en Derecho corresponde las denuncias del recurrente gestionadas el 1° de julio de 2021, 21 de febrero de 2023, 9 de mayo de 2024 y 13 de febrero de 2026 y le notifiquen lo pertinente”.

Al respecto, de la prueba aportada se observa que en oficio OF-A.M.T. E-202-2026 del 7 de agosto de 2026, a la recurrente se le contestó lo siguiente:

“En estricto acatamiento de lo ordenado por la Sala Constitucional de la Corte Suprema de Justicia en la Sentencia N.' 2026026881, este Despacho le comunica formalmente la resolución de fondo respecto de sus denuncias sobre la problemática pluvial en la Dirección05, Dirección01:

1. De conformidad con el informe rendido por el Departamento Vial bajo el N.° ING.DV-87-2026, se comprueba que esta Municipalidad realizó trabajos materiales de mitigación en el Dirección04 del 11 al 29 de septiembre de 2025. Durante 19 días naturales, se utilizó maquinaria pesada (Back Hoe) para labores de recaba, retiro de palos, ramas y remoción de sedimentos del cauce pluvial público para mitigar las inundaciones en las viviendas colindantes. Dicho informe técnico ya había sido remitido formalmente por esta Alcaldía a la Sala Constitucional para que conste dentro del expediente judicial.

2. De conformidad con el informe rendido, la Unidad Técnica determinó que la problemática remanente obedece a condicionantes ajenos al dominio municipal: la interrupción de zanjas secundarias por parte de particulares dentro de sus propiedades privadas y el hecho de que el canal de descarga final vierte directamente sobre un humedal protegido, catalogado como Patrimonio Natural del Estado (PNE) en la Zona Marítimo Terrestre, lo que impide legalmente intervenciones mayores sin el aval previo de las autoridades ambientales competentes.

3. Con el propósito de resolver con absoluta certeza legal sus reclamos específicos sobre el ancho de 14 metros del camino (denuncia de 2024) y el cierre del zanjo por una particular (denuncia de 2026), se le informa que este Despacho ha emitido una orden de acatamiento obligatorio al Departamento Vial y a la Unidad de Topografía. Mediante esta instrucción formal, se ordenó realizar un levantamiento catastral en campo para definir jurídicamente la naturaleza de la franja en disputa, así como una inspección ocular de campo complementaria para constatar la obstrucción del cauce natural denunciado, disponiéndose la remisión inmediata de pruebas en caso de que ya consten en los archivos de la Unidad Técnica para canalizarlas de forma célere ante el Ministerio de Salud y el SINAC-ACLAC. Las resultas definitivas de estos estudios técnicos le serán notificadas a su correo electrónico.

Se adjunta copia fiel del Informe Técnico N.O ING.DV-87-2026”.

Así las cosas, de la prueba aportada se desprende que la autoridad recurrida sí contestó la gestión de la recurrente. Ahora bien, de la lectura de la gestión de desobediencia se desprende que se trata de una disconformidad con la respuesta otorgada, pues considera que las actuaciones de la Municipalidad de Talamanca han sido insuficientes.

Sobre el particular, véase que a la recurrente se le indicó que se realizaron trabajos materiales de mitigación en setiembre de 2025, se determinó que la problemática remanente obedece a actuaciones de particulares en sus propiedades privadas, por lo que se emitió una orden al Departamento Vial y a la Unidad de Topografía para constatar la obstrucción del cauce natural denunciado, a fin de canalizar las gestiones ante el Ministerio de Salud y el SINAC.

En consecuencia, se constata que la autoridad recurrida está realizando las gestiones tendientes a solucionar la problemática acusada por la accionante, todo lo cual le fue debidamente notificado. En ese sentido, cualquier descontento que la recurrente pueda tener, respecto de la contestación brindada o las acciones planteadas por la municipalidad, conlleva una discusión que resulta ajena al ámbito de competencia de esta jurisdicción y corresponde dilucidarse ante la propia autoridad recurrida o en la sede ordinaria que corresponda, en la cual podrá en forma amplia discutir el fondo del asunto y hacer valer sus pretensiones.

Por consiguiente, en los términos en que fue planteada la gestión de desobediencia, en este momento procesal no se observa incumplimiento alguno que amerite la intervención de la Sala. Ergo, no ha lugar a la gestión formulada.

III.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

No ha lugar a la gestión formulada.
