Disobedience proceeding brought by Nombre02, identity card CED01, against the MUNICIPALIDAD DE OSA.
Background:
“[T]he order of the Constitutional Chamber, on Saturday, 21 March 2026, in a defiant attitude toward the judicial authority and the office you hold as Mayor responsible for enforcing the law in the canton, those people once again returned to illegally occupy the maritime-terrestrial zone. In response, the committee was reactivated and, as a first measure, the Public Force was called to evict those people. However, to our surprise, no eviction took place; rather, the Public Force merely made a simple ‘report’ addressed to the Municipal Mayor about the people illegally occupying the maritime-terrestrial zone of Playa Dominical, claiming they were not committing any offense... For this reason, the Comité de Comerciantes y Ciudadanos Pro Defensa Playa Dominical requires the immediate action of the Municipalidad de Osa to carry out the eviction and demolition of structures belonging to the illegal occupants who again took up residence as of 21 March 2026 in the maritime-terrestrial zone of Playa Dominical” (Sic).
“FIRST. The Municipalidad de Osa emphatically rejects that there has been inaction, abandonment, indifference, or disobedience with respect to what was ordered by that Constitutional Chamber. On the contrary, the municipal administration has carried out concrete, material, ongoing, verifiable, and duly documented actions aimed at inspecting, intervening in, recovering, and protecting the public zone of Playa Dominical, in compliance with Constitutional Judgment No. 2025-037551 at 09:20 on 14 November 2025, in which it was ordered to carry out the necessary actions to safeguard the coastal sector of Dominical. SECOND: One of the first actions carried out was described in the compliance report dated 20 March 2026, which stated that, according to memorandum AIZ-0014-2026 (on file) dated 20 February 2026, an inspection was conducted in the Dominical sector, with the following result: ➢ Commercial activities were being conducted and the area was occupied in the public zone of Playa Dominical. ➢ Approximately 30 stalls were identified along a 300-linear-meter stretch.
In addition, memorandum AIZ-0021-2026 (on file), dated 6 March 2026, was brought to the attention of your authority. It described the work carried out, including: ➢ The people who had been conducting commercial activities irregularly in the public zone voluntarily vacated the area. ➢ Improvised structures and ties used to set up informal stalls were removed, thereby clearing the public space. ➢ The area where the intervention took place was cleaned with the participation of public-site cleaning staff. ➢ It was confirmed that there were no illegal vendors present at the time and no attempts to reinstall stalls in the inspected sector. ➢ 19 informational signs were installed along approximately 300 meters of beach to warn against and prevent new irregular occupations. By virtue of the actions carried out by the Municipalidad de Osa, duly documented in the inspection and intervention reports, the area where the intervention took place was left free of irregular occupations and preventive measures had been adopted to prevent new installations.
It should also be emphasized that evictions, structure removal, cleaning, preventive signage, and effective recovery of the public space were carried out. THIRD: It should be emphasized in particular that the municipal actions did not end with the submission of the compliance report on 20 March 2026. Rather, the municipality continued its oversight, inspection, and control efforts in response to the reappearance of unauthorized occupations and activities. Therefore, the assertion that the municipality remained inactive after people supposedly reoccupied the public zone does not correspond to the documented facts. On 13 May 2026, a new operation was conducted at Playa Dominical, documented in memorandum PZM-0142-2026, specifically as a follow-up to oversight and regulation of the Maritime-Terrestrial Zone. This intervention included officials from the Department of the Maritime-Terrestrial Zone, Municipal Services staff, and three Playa Dominical Tourist Police officers, who provided support, security, and protection during the actions.
During this new operation, the following work was carried out, among other things: 1. A preventive patrol and inspection were conducted in the area between markers M1A and M34. 2. Temporary structures, tents, and unauthorized occupations in the public zone were identified. 3. The structures and objects found were immediately removed. 4. Removal was carried out with support from the Tourist Police and Municipal Services staff. 5. The people present were verbally warned that remaining in or irregularly occupying the Maritime-Terrestrial Zone was prohibited. 6. A list was compiled of the people identified as conducting activities contrary to the regulations. 7. A considerable quantity of waste and materials affecting the public zone was removed. 8. Repeat offenders who had already been warned during an earlier intervention were identified. For the foregoing reasons, the documentation submitted categorically refutes the allegation that the Municipalidad de Osa has taken no action to recover and protect the public zone of Playa Dominical.
FOURTH: Without prejudice to the actions already carried out and substantiated, the Municipalidad de Osa recognizes that the irregular occupation and possible usurpation of the public zone of Playa Dominical, including in other sectors, constitute a problem requiring an ongoing, coordinated, and comprehensive response. For that reason, we have been promoting a sustained interinstitutional approach, including the participation of the Ministerio Público and the Fiscalía Ambiental, since cases may be present that these authorities must address. In this regard, this administration is promoting the preparation and implementation of a strategic joint-operation plan under which actions will be coordinated with the Public Force, the Migration Police, SINAC, the Fiscalía Ambiental, the Ministry of Health, and the other competent institutions, in order to schedule interinstitutional operations, as well as carry out the administrative and material actions necessary to recover the public zone and review the legal status of the people who are irregularly present in that coastal zone.
Likewise, given the possible failure to comply with orders to vacate the public zone, the municipality will prepare and bring before the courts the corresponding proceedings and legal actions against the people found and identified occupying, using, or usurping the coastal public zone irregularly, with full respect for due process and each institution’s authority. The foregoing forms part of the interinstitutional coordination on which we have been working. The municipality will maintain a firm position toward these occupations. The measures adopted will not be limited to isolated operations, but will form part of an ongoing strategy aimed at protecting the public domain, preventing new occupations, and ensuring that repeat offenders answer administratively and judicially for their actions. In this regard, this administration is promoting the preparation and implementation of a strategic joint-operation plan under which actions will be coordinated with the Public Force, the Migration Police, SINAC, the Fiscalía Ambiental, the Ministry of Health, and the other competent institutions, in order to schedule interinstitutional operations, as well as carry out the administrative and material actions necessary to recover the public zone and review the legal status of the people who are irregularly present in that coastal zone.

I.On what this Chamber ordered. The applicant brought the following claim:
“II.- Purpose of the application. The applicant complains that the Municipalidad de Osa has failed to exercise its duty of effective protection in the maritime-terrestrial zone of Playa Dominical, since that omission has led to illegal occupation of those public-domain areas, preventing the public from freely accessing and enjoying those common-use areas, as they have been illegally taken over by a mafia that has caused chaos and established criminal activity in the area. For the foregoing reasons, the applicant states that on 19 May 2025 he submitted a request to the Department of the Maritime-Terrestrial Zone of the Municipalidad de Osa; however, he complains that, as of the date he filed the amparo application, he had received neither a response nor any solution from the respondent authority, which has remained completely silent and has taken no concrete action, demonstrating total inertia in the face of the reported problem.” By judgment no. 2025-037551 at 09:20 on 14 November 2025, this Chamber ordered as follows:
“Therefore:
The application is granted. Mainor Anchia Angulo, in his capacity as mayor, and Diego Arias Morales, in his capacity as acting head of the Department of the Maritime-Terrestrial Zone, both of the Municipalidad de Osa, or whoever may hold those positions in their stead, are ordered to coordinate what is necessary and carry out all actions within their authority so that, within FOUR MONTHS from notification of this judgment, (a) the beach where the applicant reported the failure to comply with the Maritime-Terrestrial Zone requirements in his complaint of 19 May 2025 is addressed, processed, and inspected; and, if noncompliance with the law is established, all necessary measures are to be taken to ensure respect for the maritime zone, in accordance with the broad powers established by the Ley de la Zona Marítimo Terrestre; and (b) within that same period, the applicant is to be notified of the outcome of his complaint, including all information concerning its status, follow-up, and the adoption of the appropriate actions in response to the complaint filed.
The respondent party is warned that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law of this jurisdiction, a person who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be punished by imprisonment of three months to two years or a fine of twenty to sixty daily units, provided the offense is not subject to a more severe penalty. The Municipalidad de Osa is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration; these shall be assessed in enforcement proceedings before the administrative-litigation jurisdiction. Justice Castillo Víquez records a separate note. Notify the parties.” The judgment was notified to the respondent authority on 17 November 2026.
II.On the proceedings brought. The applicant alleges disobedience of the order issued in judgment no. 2025-037551 at 09:20 on 14 November 2025.
In this regard, the analysis of the report submitted by the respondent municipality reveals the actions it has adopted to comply with what this Court ordered. Specifically, it is established that on 20 February 2026 an inspection was conducted in the Dominical sector, with the following result: “The area was occupied and commercial activities were being conducted in the public zone of Playa Dominical. Approximately 30 stalls were identified along a 300-linear-meter stretch”; on 6 March 2026, the following work was carried out: “The people who had been conducting commercial activities irregularly in the public zone voluntarily vacated the area. Improvised structures and ties used to set up informal stalls were removed, thereby clearing the public space. The area where the intervention took place was cleaned with the participation of public-site cleaning staff. It was confirmed that there were no illegal vendors present at the time and no attempts to reinstall stalls in the inspected sector. 19 informational signs were installed along approximately 300 meters of beach to warn against and prevent new irregular occupations”; and on 13 May 2026, a new operation was conducted at Playa Dominical, during which the following measures were taken: “1.
A preventive patrol and inspection were conducted in the area between markers M1A and M34. 2. Temporary structures, tents, and unauthorized occupations in the public zone were identified. 3. The structures and objects found were immediately removed. 4. Removal was carried out with support from the Tourist Police and Municipal Services staff. 5. A list was compiled of the people identified as conducting activities contrary to the regulations. 7. A considerable quantity of waste and materials affecting the public zone was removed. 8. Repeat offenders who had already been warned during an earlier intervention were identified.” In light of the foregoing, it is determined that although the respondents have taken steps to comply with the judgment, the fact remains that the problem persists, as they themselves acknowledge in their report when they state that the irregular occupation and possible usurpation of the public zone of Playa Dominical require an ongoing, coordinated, and comprehensive response.
For that reason, they indicate that they are promoting the preparation and implementation of a strategic joint-operation plan with the following authorities: the Public Force, the Migration Police, the Sistema Nacional de Áreas de Conservación, the Fiscalía Ambiental, and the Ministry of Health. They further state that they will carry out the administrative and material actions necessary to recover the public zone.
Accordingly, effective compliance with what was ordered in the aforementioned judgment has not been established, and the respondents themselves acknowledge that the problem has not been definitively resolved.
Consequently, the respondent authority is again directed to comply with what this Chamber ordered in judgment no. 2025-037551 at 09:20 on 14 November 2025.
III.Documents submitted to the case file. The parties are advised that any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device that they have submitted, must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulations on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The disobedience proceeding is granted. Mainor Anchia Angulo, in his capacity as mayor, and Nombre01, in her capacity as acting head of the Department of the Maritime-Terrestrial Zone, both of the Municipalidad de Osa, or whoever may hold those positions in their stead, are ordered to comply with what this Chamber ordered in judgment no. 2025-037551 at 09:20 on 14 November 2025, in the sense that they must address, process, and inspect the beach where the applicant reported the failure to comply with the Maritime-Terrestrial Zone requirements in his complaint of 19 May 2025; and, if noncompliance with the law is established, they must take all necessary measures to ensure respect for the maritime zone, in accordance with the broad powers established by the Ley de la Zona Marítimo Terrestre. This is subject to the warning that the record will be referred to the Ministerio Público concerning the offense provided for in Article 71 of the Law on Constitutional Jurisdiction. This judgment shall be served personally on Mainor Anchia Angulo, in his capacity as mayor, and Nombre01, in her capacity as acting head of the Department of the Maritime-Terrestrial Zone, both of the Municipalidad de Osa, or whoever may hold those positions in their stead.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .
Gestión de desobediencia presentada por Nombre02, cédula de identidad CED01, contra la MUNICIPALIDAD DE OSA.
Resultando:
“[L]a ordenanza de la Sala Constitucional, el dia sábado 21 de mazo del 2026, en una actitud desafiante a a la autoridad judicial y al cargo que usted ostenta como Alcalde reponsable de hacer valer la ley en el cantón, nuevamente regresan esas personas a ocupar ilegalmente la zona maritimo terrestre. Ante ello se activa nuevamente el comité y como primera medida se llama a Fuerza Pública para que desalojen a esas personas. Sin embargo nuestra sorpresa es que no se hace el desalojo y más bien Fuerza Pública se limita a hacer un simple “reporte” dirigido al Alcalde Municipal de las personas que ocupan ilegalmente la zona maritimo terrestre de Playa Dominical, alegando que no cometen delito alguno... Por ello requerimos por parte del El Comité de Comerciantes y Ciudadanos Pro Defensa Playa Dominical la acción inmediata de la Municipalidad de Osa para materializar el desalojo y demolición de estructuras de los ocupantes ilegales instalados nuevamente desde el 21 de marzo del 2026, en la zona maritimo terrestre de PLaya Dominical” (Sic).
“PRIMERO. Que la Municipalidad de Osa rechaza enfáticamente que haya existido inactividad, abandono, indiferencia o desobediencia respecto de lo ordenado por esa Sala Constitucional. Por el contrario, la administración municipal ha llevado a cabo actuaciones concretas, materiales, continuas, verificables y debidamente documentadas, dirigidas a inspeccionar, intervenir, recuperar y proteger la zona pública de Playa Dominical, lo anterior, en acatamiento de la sentencia constitucional N° 2025-037551 de las 09:20 horas del 14 de noviembre de 2025, en la cual se ordenó ejecutar las actuaciones necesarias con el fin de resguardar el sector costero de Dominical. SEGUNDO: Que una de las primeras acciones que se realizaron son las indicadas en el informe de cumplimiento de fecha del día 20 de marzo del 2026 en el cual se indicó que según el oficio AIZ-0014-2026 (consta en el expediente) de fecha del día 20 de febrero del 2026, se indica la inspección realizada en el sector de Dominical, en la cual se tuvo como resultado: ➢ La ocupación y desarrollo de actividades comerciales en la zona pública de Playa Dominical. ➢ Se identificó una concentración aproximada de 30 puestos en un tramo de 300 metros lineales.
Además, se hizo del conocimiento de su autoridad el oficio AIZ-0021-2026 (consta en el expediente) de fecha del día 6 de marzo del 2026 en el cual se indicó sobre las labores que se ejecutaron tales como: ➢ Las personas que se encontraban realizando actividades comerciales de forma irregular en la zona pública procedieron a desalojar voluntariamente el área. ➢ Se retiraron estructuras improvisadas y amarres utilizados para establecer puestos informales, logrando liberar el espacio público. ➢ Se efectuó limpieza del área intervenida mediante la participación del personal de limpieza de sitios públicos. ➢ Se constató que no existe presencia actual de vendedores ilegales ni intentos de reinstalación de puestos en el sector inspeccionado. ➢ Se instalaron 19 rótulos informativos en aproximadamente 300 metros de playa, con el fin de advertir y prevenir nuevas ocupaciones irregulares. En virtud de las actuaciones realizadas por la Municipalidad de Osa, debidamente documentadas mediante los informes de inspección y de intervención, el área intervenida quedó libre de ocupaciones irregulares y que se habían adoptado medidas preventivas para evitar nuevas instalaciones, asimismo, enfatizar que desalojos, remoción de estructuras, limpieza, señalización preventiva y recuperación efectiva del espacio público.
TERCERO: Que debe destacarse especialmente que las actuaciones municipales no finalizaron con la presentación del informe de cumplimiento del día 20 de marzo de 2026, sino que la municipalidad continuó realizando gestiones de fiscalización, inspección y control ante la reaparición de ocupaciones y actividades no autorizadas, por ello, la afirmación de que la municipalidad permaneció inactiva después de la supuesta reinstalación de personas en la zona pública no corresponde con la realidad documentada. Que el día 13 de mayo de 2026 se realizó un nuevo operativo en Playa Dominical, documentado mediante el oficio PZM-0142-2026, precisamente como seguimiento de las labores de fiscalización y regulación de la Zona Marítimo Terrestre. Esta intervención contó con funcionarios del Departamento de Zona Marítimo Terrestre, personal de Servicios Municipales y tres agentes de la Policía Turística de Playa Dominical, quienes brindaron apoyo, seguridad y protección durante las actuaciones.
Durante este nuevo operativo se ejecutaron, entre otras, las siguientes labores: 1. Se efectuó un recorrido preventivo y de inspección en el área comprendida entre los mojones M1A y M34. 2. Se identificaron estructuras temporales, tiendas de campaña y ocupaciones no autorizadas en la zona pública. 3. Se realizó la remoción inmediata de las estructuras y objetos encontrados. 4. La remoción se efectuó con apoyo de la Policía Turística y del personal de Servicios Municipales. 5. Se previno verbalmente a las personas presentes sobre la prohibición de permanecer u ocupar irregularmente la Zona Marítimo Terrestre. 6. Se levantó un listado de las personas identificadas desarrollando actividades contrarias a la normativa. 7. Se removió una cantidad considerable de desechos y materiales que afectaban la zona pública. 8. Se identificaron personas reincidentes que ya habían sido advertidas en una intervención anterior.
Por lo anterior, la documentación aportada desvirtúa categóricamente la acusación de que la Municipalidad de Osa no ha realizado acciones para recuperar y proteger la zona pública de Playa Dominical. CUARTO: Que, sin perjuicio de las actuaciones ya realizadas y acreditadas, la Municipalidad de Osa reconoce que la ocupación irregular y la eventual usurpación de la zona pública de Playa Dominical, inclusive en otros sectores representan una problemática que requiere una respuesta continua, coordinada e integral, por ello venimos promoviendo un abordaje interinstitucional de menara sostenida incluyendo la participación del Ministerio Público y la Fiscalia Ambiental, por cuanto podríamos estera en presencia de casos que deben ser atendidos por estas autoridades. En dicho sentido, esta administración se encuentra impulsando la elaboración y ejecución de un plan estratégico de operación conjunta, mediante el cual se coordinarán actuaciones con Fuerza Pública, Policía de Migración, SINAC, Fiscalia Ambiental, Ministerio de Salud y las demás instituciones que resulten competentes con el fin de programar operativos interinstitucionales, además de ejecutar las acciones administrativas y materiales necesarias para recuperar la zona pública y asimismo, revisar el estatus legal de la personas que se encuentra irregularmente en dicha zona costera.
Asimismo, dada la posible desatención de las ordenes de desalojar la zona pública, la municipalidad estará preparando y presentando en sede judicial los procesos y acciones legales correspondientes contra las personas que sean encontradas e individualizadas ocupando, utilizando o usurpando de manera irregular la zona pública costera, con pleno respeto del debido proceso y de las competencias de cada institución, lo anterior forma parte de las coordinaciones interinstitucionales que venimos trabajando.. La municipalidad mantendrá una posición firme frente a estas ocupaciones, las medidas adoptadas no se limitarán a operativos aislados, sino que formarán parte de una estrategia continúa destinada a proteger el dominio público, evitar nuevas ocupaciones y procurar que las personas reincidentes respondan administrativa y judicialmente por sus actuaciones En dicho sentido, esta administración se encuentra impulsando la elaboración y ejecución de un plan estratégico de operación conjunta, mediante el cual se coordinarán actuaciones con Fuerza Pública, Policía de Migración, SINAC, Fiscalia Ambiental, Ministerio de Salud y las demás instituciones que resulten competentes con el fin de programar operativos interinstitucionales, además de ejecutar las acciones administrativas y materiales necesarias para recuperar la zona pública y asimismo, revisar el estatus legal de la personas que se encuentra irregularmente en dicha zona costera.

La municipalidad mantendrá una posición firme frente a estas ocupaciones, las medidas adoptadas no se limitarán a operativos aislados, sino que formarán parte de una estrategia continúa destinada a proteger el dominio público, evitar nuevas ocupaciones y procurar que las personas reincidentes respondan administrativa y judicialmente por sus actuaciones”.
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Sobre lo dispuesto por esta Sala. La parte recurrente planteó el siguiente reclamo:
“II.- Objeto del recurso. El recurrente reprocha una inacción por parte de la Municipalidad de Osa en ejercer su función de tutela efectiva en la zona marítimo terrestre de Playa Dominical, dado que esa omisión ha provocado la ocupación ilegal en dichas áreas de dominio público que impiden a la ciudadanía poder acceder y disfrutar libremente de dichas áreas de uso común, toda vez que han sido tomados ilegalmente por una mafia que ha generado el caos y asentado la delincuencia en el lugar. Por lo anterior, señala que el 19 de mayo de 2025 remitió una gestión ante el departamento de la Zona Marítimo Terrestre de la Municipalidad de Osa; sin embargo, reclama que a la fecha en la que acude en amparo no ha recibido respuesta ni solución alguna por parte de la autoridad recurrida, la cual se ha mantenido en absoluto silencio y sin ejecutar ninguna acción concreta, evidenciando una actitud de total inercia frente a la problemática denunciada”.
Mediante la sentencia nro. 2025-037551 de las 09:20 horas del 14 de noviembre de 2025, esta Sala dispuso lo siguiente:
“Por tanto:
Se declara con lugar el recurso. Se ordena a Mainor Anchia Angulo, en su condición de alcalde, y a Diego Arias Morales, en su condición de encargado interno del Departamento de Zona Marítimo Terrestre, ambos de la Municipalidad de Osa, o a quienes en sus lugares ejerzan esos cargos, que coordinen lo necesario y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que dentro del plazo de CUATRO MESES, contado a partir de la notificación de esta sentencia, a) se aborde, tramite e inspeccione la playa en que el recurrente denunció el incumplimiento a la Zona Marítimo Terrestre en su denuncia del 19 de mayo de 2025 y de acreditar la inobservancia a la legislación, deberán tomar todas las medidas necesarias para que la zona marítima sea respetada, de conformidad con las amplias potestades que establece la Ley de la Zona Marítimo Terrestre; y b) además, dentro de ese mismo plazo, deberán notificarle al recurrente el resultado de su denuncia, lo cual contempla comunicar todo lo relacionado al estado, al seguimiento y a la adopción de las acciones pertinentes en atención al denuncia formulada.
Se advierte a la parte recurrida que, de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Osa al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez consigna nota. Notifíquese”.
La sentencia fue notificada a la autoridad recurrida el 17 de noviembre de 2026.
II.Sobre las gestiones planteadas. La parte recurrente acusa la desobediencia de lo ordenado en la sentencia nro. 2025-037551 de las 09:20 horas del 14 de noviembre de 2025.
Al respecto, del análisis del informe rendido por parte del municipio accionado se desprenden las acciones que han adoptado en aras de cumplir con lo ordenado por este Tribunal. En ese sentido, se verifica que el 20 de febrero de 2026 se realizó una inspección en el sector de Dominical, la cual tuvo como resultado: “La ocupación y desarrollo de actividades comerciales en la zona pública de Playa Dominical. Se identificó una concentración aproximada de 30 puestos en un tramo de 300 metros lineales”; el 6 de marzo de 2026 realizaron las siguientes labores: “Las personas que se encontraban realizando actividades comerciales de forma irregular en la zona pública procedieron a desalojar voluntariamente el área. Se retiraron estructuras improvisadas y amarres utilizados para establecer puestos informales, logrando liberar el espacio público. Se efectuó limpieza del área intervenida mediante la participación del personal de limpieza de sitios públicos.
Se constató que no existe presencia actual de vendedores ilegales ni intentos de reinstalación de puestos en el sector inspeccionado. Se instalaron 19 rótulos informativos en aproximadamente 300 metros de playa, con el fin de advertir y prevenir nuevas ocupaciones irregulares”; y el 13 de mayo de 2026 realizaron un nuevo operativo en la Playa Dominical en donde realizaron las siguientes diligencias: “1. Se efectuó un recorrido preventivo y de inspección en el área comprendida entre los mojones M1A y M34. 2. Se identificaron estructuras temporales, tiendas de campaña y ocupaciones no autorizadas en la zona pública. 3. Se realizó la remoción inmediata de las estructuras y objetos encontrados. 4. La remoción se efectuó con apoyo de la Policía Turística y del personal de Servicios Municipales. 5. Se previno verbalmente a las personas presentes sobre la prohibición de permanecer u ocupar irregularmente la Zona Marítimo Terrestre. 6.
Se levantó un listado de las personas identificadas desarrollando actividades contrarias a la normativa. 7. Se removió una cantidad considerable de desechos y materiales que afectaban la zona pública. 8. Se identificaron personas reincidentes que ya habían sido advertidas en una intervención anterior”.
En virtud de lo expuesto, se determina que a pesar de que los recurridos han realizado gestiones para dar cumplimiento a lo establecido en la sentencia, lo cierto del caso es que la problemática persiste, tal como lo reconocen en el informe rendido al señalar que la ocupación irregular y la eventual usurpación de la zona pública de la Playa Dominical requiere una respuesta continua, coordinada e integral, por tal razón indican que se encuentran impulsando la elaboración y la ejecución de un plan estratégico de operación conjunta con las siguientes autoridades Fuerza Pública, Policía de Migración, Sistema Nacional de Áreas de Conservación, Fiscalía Ambiental, Ministerio de Salud. Adicionalmente, exponen que van a ejecutar las acciones administrativas y materiales necesarias para recuperar la zona pública.
Así las cosas, al no haberse constatado el efectivo cumplimiento de lo dispuesto en la sentencia aludida e incluso los propios recurridos reconocen que la problemática no ha sido solventada de forma definitiva.
En consecuencia, se reitera a la autoridad recurrida dar cumplimiento de lo ordenado por esta Sala en la sentencia nro. 2025-037551 de las 09:20 horas del 14 de noviembre de 2025.
III.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se acoge la gestión de desobediencia formulada. Se le ordena a Mainor Anchia Angulo, en su condición de alcalde, y a Nombre01, en su condición de encargada a. i. del Departamento de Zona Marítimo Terrestre, ambos de la Municipalidad de Osa, o quienes en sus lugares ocupen dichos cargos, que procedan a dar cumplimiento a lo dispuesto por esta Sala en la sentencia nro. 2025-037551 de las 09:20 horas del 14 de noviembre de 2025, en el sentido de que se aborde, tramite e inspeccione la playa en que el recurrente denunció el incumplimiento a la Zona Marítimo Terrestre en su denuncia del 19 de mayo de 2025 y de acreditar la inobservancia a la legislación, deberán tomar todas las medidas necesarias para que la zona marítima sea respetada, de conformidad con las amplias potestades que establece la Ley de la Zona Marítimo Terrestre. Lo anterior, bajo la advertencia de ordenar el testimonio de piezas ante el Ministerio Público por el delito previsto en el artículo 71 de la Ley de la Jurisdicción Constitucional. Notifíquese esta sentencia a Mainor Anchia Angulo, en su condición de alcalde, y a Nombre01, en su condición de encargada a. i. del Departamento de Zona Marítimo Terrestre, ambos de la Municipalidad de Osa, o quienes en sus lugares ocupen dichos cargos, en forma personal.
