Motion alleging noncompliance with the amparo proceeding processed under case file number 25-026131-0007-CO, filed by Nombre01, identity card CED01, on behalf of THE RESIDENTS OF BARRIO EL ROBLE, against the MUNICIPALITY OF POCOCÍ.
Background:
Drafted by Justice Cruz Castro; and, Reasons:
I.In this matter, the applicant again alleges that the respondent authorities have failed to comply with what was ordered in judgment N° 2025031199 at nine hours and twenty-five minutes on 26 September 2025, in which the Municipality of Pococí was ordered to take, within six months, the actions necessary to make appropriate improvements to the road at issue in that proceeding, in order to prevent the flooding affecting the residents of Barrio El Roble. The applicant states that, despite the works reported by the Municipality, flooding continues to affect an area of that neighborhood, and submits photographs and a video illustrating the situation.
In this regard, it should be noted that this Chamber has already heard and resolved a first motion alleging noncompliance concerning this same matter, by order N° 2026013257 at nine hours and twenty minutes on 21 April 2026. The motion was dismissed after it was deemed established that the respondent authorities had complied with what was ordered in relation to Dirección01, according to the report submitted on that occasion by the Coordinator of the Municipal Public Works Process.
In this new motion, the Coordinator of the Municipal Public Works Process reiterated, by official letter OPM-0728-2026, that the technical and administrative actions documented in official letter OPM-0298-2026 show that the Municipality addressed the requirement within the scope of its powers. For their part, the Municipal Mayor and the President of the Council, through the “Report of No Disobedience” dated 10 August 2026, established that, charged to the extraordinary budget 2-2025, tender N° 2025LE-000007-0032000702, “Asphalt Treatments in Canton #2,” was carried out. It included improvements to Dirección01, as well as a stormwater drainage system in areas upstream and within the area of influence of Barrio El Roble. Those works were carried out during the current year.
In view of the foregoing, this Court finds that the respondent authorities have established that specific works were carried out to address what was ordered in judgment N° 2025031199. Accordingly, conduct by omission or deliberate disobedience of this Chamber’s ruling cannot be found. However, the photographs and video submitted by the applicant, which the respondent authorities did not dispute, show that, despite the works carried out, flooding continues to affect an area of Barrio El Roble. This demonstrates that the interventions, although they constitute real and verifiable progress, have not been sufficient to eliminate entirely the risk that gave rise to this proceeding.
Accordingly, there are no grounds to declare noncompliance with what was ordered in judgment N° 2025031199, since the record shows that the Municipality of Pococí has carried out works diligently and progressively. Nevertheless, because the applicant has established that some flooding impacts persist, the respondent authorities should be urged to continue the relevant technical work and follow-up, in order to determine the causes of the impacts that remain and carry out any necessary complementary improvements, until the flooding problem affecting the residents of Barrio El Roble has been addressed comprehensively and definitively.
The parties are advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, telematic, or new-technology device, they must collect it from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, all such material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session N° 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 on 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:
The motion filed is denied. YAMILETH HIDALGO ARIAS, as acting Mayor, and JUAN MAURICIO MORA CRUZ, as President of the Council, both of the Municipality of Pococí, or whoever holds those positions, are urged to continue the relevant technical and administrative work in order to determine and carry out any additional improvements necessary to address comprehensively the flooding impact that, according to the applicant, continues in an area of Barrio El Roble. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de agosto de dos mil veintiseis .
Gestión de incumplimiento del Recurso de amparo que se tramita en expediente número 25-026131-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, a favor de LOS VECINOS DE BARRIO EL ROBLE, contra la MUNICIPALIDAD DE POCOCÍ.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.En el presente asunto, la parte recurrente acusa nuevamente que las autoridades accionadas no han dado cumplimiento de lo ordenado en la sentencia N° 2025031199 de las nueve horas veinticinco minutos del veintiséis de setiembre de dos mil veinticinco, en la que se ordenó a la Municipalidad de Pococí ejecutar, en el plazo de seis meses, las acciones necesarias para realizar las mejoras adecuadas al camino objeto de ese proceso, a efectos de evitar las inundaciones que afectan a los vecinos de Barrio El Roble. Señala la recurrente que, pese a las obras informadas por la Municipalidad, persisten afectaciones por inundación en un sector de dicho barrio, para lo cual aporta fotografías y un video ilustrativos de la situación.
Al respecto, debe indicarse que esta Sala ya conoció y resolvió una primera gestión de incumplimiento planteada sobre este mismo extremo, mediante resolución N° 2026013257 de las nueve horas veinte minutos del veintiuno de abril de dos mil veintiséis, en la que se desestimó la gestión formulada, por estimarse acreditado que las autoridades accionadas habían dado cumplimiento de lo ordenado en relación con la Dirección01, según el informe rendido en esa oportunidad por el Coordinador del Proceso de Obra Pública Municipal.
En esta nueva gestión, el Coordinador del Proceso de Obra Pública Municipal reiteró, mediante oficio OPM-0728-2026, que las actuaciones técnicas y administrativas documentadas mediante el oficio OPM-0298-2026 constituyen evidencia de que la Municipalidad ha atendido el requerimiento dentro del ámbito de sus competencias. Por su parte, el Alcalde Municipal y el Presidente del Concejo, mediante el "Informe de No Desobediencia" de fecha 10 de agosto de 2026, acreditaron que, con cargo al presupuesto extraordinario 2-2025, se ejecutó la licitación N° 2025LE-000007-0032000702, "Tratamientos Asfálticos en el Cantón #2", que incluyó las mejoras a la Dirección01, así como un sistema de drenaje pluvial en los sectores ubicados aguas arriba y en el área de influencia de Barrio El Roble, obras que fueron ejecutadas durante el presente año.
Visto lo anterior, este Tribunal aprecia que las autoridades accionadas han acreditado la ejecución de obras concretas orientadas a atender lo ordenado en la sentencia N° 2025031199, por lo que no puede tenerse por configurada una conducta omisiva o de desobediencia deliberada a lo resuelto por esta Sala. Sin embargo, de las fotografías y el video aportados por la parte recurrente, no controvertidos por las autoridades accionadas, se desprende que, pese a las obras ejecutadas, persiste una afectación por inundaciones en un sector del Barrio El Roble, lo que evidencia que las intervenciones realizadas, si bien constituyen un avance real y verificable, no han resultado suficientes para erradicar en su totalidad el riesgo que dio origen al presente proceso.
En consecuencia, no procede declarar el incumplimiento de lo ordenado en la sentencia N° 2025031199, por cuanto consta la ejecución diligente y progresiva de obras por parte de la Municipalidad de Pococí. No obstante, dado que la propia parte recurrente ha acreditado que persisten afectaciones parciales por inundación, corresponde instar a las autoridades accionadas para que continúen las labores técnicas y de seguimiento correspondientes, a efectos de determinar las causas de las afectaciones que aún subsisten y ejecutar las mejoras complementarias que resulten necesarias, hasta lograr la atención integral y definitiva de la problemática de inundaciones que afecta a los vecinos de Barrio El Roble.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
No ha lugar a la gestión formulada, se insta a YAMILETH HIDALGO ARIAS, en condición de Alcaldesa a.i., y a JUAN MAURICIO MORA CRUZ, en condición de Presidente del Concejo, ambos de la Municipalidad de Pococí, o a quienes ocupen esos cargos, para que continúen las labores técnicas y administrativas correspondientes, a efectos de determinar y ejecutar las mejoras adicionales que resulten necesarias para atender de manera integral la afectación por inundaciones que, según lo informado por la parte recurrente, aún subsiste en un sector del Barrio El Roble.
