CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE (SALA CONSTITUCIONAL). San José, at 9:30 a.m. on 13 August 2026.

Amparo proceeding registered under expediente number 26-028442-0007-CO, filed by Nombre01, identity card CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO.

Background:

  1. 1In a document filed with the Chamber’s Secretariat on 6 August 2026, the claimant filed an amparo proceeding against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO. The claimant states that they are a 66-year-old older adult and that, on 31 August 2023, they began the process before the Instituto Costarricense de Acueductos y Alcantarillados (AyA) to separate the drinking-water service for their home, located in San Antonio de Coronado. They were told that they needed a registered cadastral plan, which they obtained. The claimant states that on 21 May 2024 they were informed that a water reserve was available to provide the service and that they would have to wait until the first quarter of 2026. However, after that period had elapsed, they sent an email on 18 March 2026 to inquire about the status of the request and received no response. The claimant adds that they then went to AyA’s central offices in San José, where they were told to wait another three months.On 27 July 2026, they were informed that service was now available for installation and that they had to return within eight days to formalize the process. The claimant states that on 28 July 2026 they received the Certificate of Availability of Water Supply Service without Sewerage No. SIGDD-2024-00184467-1-1, which recorded that drinking water was available in front of the property and that a flow of 0.81 m³/d was available for the possible provision of an individually metered service. Nevertheless, the claimant states that on 3 August 2026, when they went to formalize the connection, they were told that the water connection could not be installed because the plan had expired, even though it was registered. The claimant complains that the proposed solution is to require a new plan, which entails a new expense and starting the process from scratch, with the possibility of having to wait until 2030 to 2032.The claimant attributes this situation to the time AyA took to respond and says they currently have no water. The claimant adds that the registered cadastral plan is No. 1-58795-2023 and asks that consideration be given to obtaining an extension from the Property Registry to keep it valid, thereby avoiding having to begin a process again that could take four to six years. On the basis of the foregoing, the claimant asks for a solution that will enable them to obtain their water connection, either by validating the plan prepared in 2023 or by providing instructions that will resolve their situation. They also ask that, if a new plan is required, they be given special priority to ensure installation of the service within less than six months. The claimant requests the Chamber’s intervention.
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily dismiss, on procedural or substantive grounds and at any time, including upon filing, any application submitted to it that is manifestly inadmissible, when it considers that there is sufficient evidence to dismiss it, or when it is merely a reiteration or reproduction of an earlier identical or similar application that was dismissed.

I. SUBJECT OF THE APPLICATION

The claimant complains that, although on 28 July 2026 the Instituto Costarricense de Acueductos y Alcantarillados issued the Certificate of Availability of Water Supply Service without Sewerage No. SIGDD-2024-00184467-1-1, recording that drinking water was available in front of their property, on 3 August 2026 it refused to install their water connection because registered cadastral plan No. 1-58795-2023 had expired. As a result, they are required to obtain a new plan and restart the process. The claimant considers this harmful to their right of access to drinking water and says it could also delay obtaining the service by several years. They therefore seek validation of the plan prepared in 2023 or another solution that will allow them to obtain the service connection, and, if a new plan is required, special priority to ensure installation within less than six months.

II. INADMISSIBILITY OF THE AMPARO

It follows from the facts set out by the claimant that they ask this Chamber to order the Instituto Costarricense de Acueductos y Alcantarillados to provide a drinking-water service connection to their home by validating registered cadastral plan No. 1-58795-2023 or, failing that, to allow them to resolve their situation without restarting the process and, if a new plan is required, to grant them special priority to ensure installation of the service within less than six months. In this regard, it should be stated that although this Chamber has recognized the fundamental right of access to water because it is an essential service for life and health, this does not entail an unrestricted right to obtain a new service connection, since the Administration may establish the requirements and technical and legal conditions for granting one. Accordingly, determining whether the requested connection should be granted in this specific case, as well as assessing whether registered cadastral plan No. 1-58795-2023 may be validated or extended and the technical and administrative reasons why the respondent authority requires a new plan to continue the process, are matters of ordinary legality beyond this jurisdiction’s competence.

Nor may this Court act as a reviewing instance for the technical decisions made by the authority administering the service, or order that a water connection be granted when that depends on verifying compliance with the applicable legal and technical requirements. In light of the foregoing, if the claimant disagrees with the administrative decisions concerning the drinking-water service connection, they must submit any claims they consider appropriate to the respondent authority itself or through the applicable legal channel, so that the matter may be resolved in accordance with law. Accordingly, the application is inadmissible insofar as it seeks to obtain a service connection by validation or extension of registered cadastral plan No. 1-58795-2023, or to obtain special priority for its installation, and this is so declared.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The claimant is advised that if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, telematic, or new-technology device, those items must be retrieved from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The application is dismissed on substantive grounds.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .

Recurso de amparo que se tramita bajo el número de expediente 26-028442-0007-CO, interpuesto por Nombre01, cédula de identidad CED01; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala el 6 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO. Manifiesta que es una persona adulta mayor de 66 años y que desde el 31 de agosto de 2023 inició ante el Instituto Costarricense de Acueductos y Alcantarillados (AyA) el trámite para independizar el servicio de agua potable de su vivienda, ubicada en San Antonio de Coronado, para lo cual se le indicó que debía contar con un plano catastrado, trámite que realizó. Señala que el 21 de mayo de 2024 se le comunicó que existía una reserva de agua para brindarle el servicio y que debía esperar hasta el primer trimestre de 2026; sin embargo, llegado dicho plazo, envió un correo el 18 de marzo de 2026 para consultar sobre el estado de la gestión, sin obtener respuesta. Agrega que, ante ello, acudió a las oficinas centrales del AyA en San José, donde se le indicó que debía esperar tres meses más, y que el 27 de julio de 2026 se le informó que ya existía disponibilidad para colocar el servicio y que debía regresar para formalizar el trámite dentro de ocho días.Refiere que el 28 de julio de 2026 recibió la Constancia de Disponibilidad de Servicio de Acueducto sin Alcantarillado N.° SIGDD-2024-00184467-1-1, en la cual se hizo constar que sí había disponibilidad de agua potable al frente de la propiedad y que se contaba con un caudal de 0,81 m³/d para la eventual dotación de un servicio de medición individual; no obstante, manifiesta que el 3 de agosto de 2026 acudió a formalizar la conexión y se le indicó que no podían colocarle la paja de agua debido a que el plano había caducado, pese a encontrarse inscrito. Reclama que, como solución, se le exige realizar un nuevo plano, lo que implica un nuevo gasto y reiniciar el trámite desde cero, con la posibilidad de tener que esperar hasta los años 2030 a 2032, situación que atribuye al tiempo que el AyA tardó en brindarle una respuesta y que actualmente la mantiene sin agua. Agrega que el plano catastrado corresponde al N.° 1-58795-2023 y solicita que se valore la posibilidad de obtener una prórroga por parte del Registro de la Propiedad para mantenerlo vigente, evitando así iniciar nuevamente un trámite que podría demorar entre cuatro y seis años.Con base en lo expuesto, solicita que se le brinde una solución para obtener su paja de agua, ya sea mediante la validación del plano que realizó en 2023 o mediante una indicación que le permita solucionar su situación, así como que, en caso de requerirse un nuevo plano, se le otorgue una prioridad especial que le garantice la instalación del servicio en un plazo menor a seis meses. Solicita la intervención de la Sala.
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente reclama que el Instituto Costarricense de Acueductos y Alcantarillados, pese a que el 28 de julio de 2026 le extendió la Constancia de Disponibilidad de Servicio de Acueducto sin Alcantarillado N.° SIGDD-2024-00184467-1-1, en la que se hizo constar la existencia de disponibilidad de agua potable frente a su propiedad, el 3 de agosto de 2026 se negó a colocarle la paja de agua debido a que el plano catastrado N.° 1-58795-2023 había caducado, por lo que se le exige realizar un nuevo plano y reiniciar el trámite, situación que considera lesiva de su derecho de acceso al agua potable y que, además, podría prolongar por varios años la obtención del servicio; por lo que pretende que se valide el plano realizado en 2023 o se le brinde una solución que le permita obtener la conexión del servicio y, en caso de requerirse un nuevo plano, que se le otorgue una prioridad especial para garantizar la instalación en un plazo menor a seis meses.

II. INADMISIBILIDAD DEL AMPARO

De la relación de hechos expuesta por la persona recurrente, se desprende que pretende que esta Sala ordene al Instituto Costarricense de Acueductos y Alcantarillados otorgarle la conexión del servicio de agua potable para su vivienda, mediante la validación del plano catastrado N.° 1-58795-2023 o, en su defecto, que se le permita solucionar su situación sin tener que reiniciar el trámite y, de requerirse un nuevo plano, se le otorgue una prioridad especial para garantizar la instalación del servicio en un plazo menor a seis meses. Al respecto, conviene indicar que, si bien esta Sala ha reconocido el derecho fundamental de acceso al agua por tratarse de un servicio esencial para la vida y la salud, ello no implica un derecho irrestricto a obtener una nueva conexión del servicio, pues la Administración puede establecer los requisitos y condiciones técnicas y legales para su otorgamiento. En ese sentido, determinar si, en el caso concreto, procede o no conceder la conexión solicitada, así como valorar si resulta procedente validar o prorrogar el plano catastrado N.° 1-58795-2023 y las razones técnicas y administrativas por las cuales la autoridad recurrida exige un nuevo plano para continuar con el trámite, constituye una cuestión de mera legalidad que escapa al ámbito de competencia de esta jurisdicción.

Tampoco puede este Tribunal fungir como instancia revisora de las decisiones técnicas adoptadas por la autoridad administradora del servicio, ni ordenar el otorgamiento de una conexión de agua cuando ello depende de la verificación del cumplimiento de los requisitos legales y técnicos aplicables. En virtud de lo expuesto, si la persona recurrente se encuentra inconforme con las decisiones administrativas relacionadas con la conexión del servicio de agua potable, deberá presentar los reclamos que estime pertinentes ante la propia autoridad recurrida o en la vía legal correspondiente, para que se resuelva como en Derecho corresponda. Así, en cuanto a la pretensión de obtener la conexión del servicio mediante la validación o prórroga del plano catastrado N.° 1-58795-2023, o de obtener una prioridad especial para su instalación, el recurso resulta inadmisible y así se declara.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza por el fondo el recurso.
