The Chamber rejected the amparo application outright because determining the basis and amount of a potable water charge is a matter of legality to be raised before the administrative authority and, eventually, the ordinary courts.

SummaryResumen

The applicant alleged that, for a year, they had received excessive charges for potable water service from the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), under NIS 5245706. The Constitutional Chamber (Sala Constitucional) of the Supreme Court rejected the amparo application outright: determining whether the charge was correct is a matter of ordinary legality and falls outside the amparo’s role of protecting fundamental rights. The applicant may bring the complaint before the same administrative authority or the competent ordinary court, where they can fully address the merits and assert their claims. The ruling also instructed that any submitted documents and objects must be collected within 30 business days after notification; otherwise, they will be destroyed under the cited regulations and agreements.

EV Generation of Template: D:\Gestion-Judicial\Servidor de Archivos\MODELOS\S4SENAMH000.dpj CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty minutes on 13 August 2026.

Amparo proceeding filed in case number 26-028300-0007-CO, brought by Nombre01, identity card number CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.

Background 1. By written submission entered into the electronic case file on 5 August 2026, the applicant files an amparo proceeding against the Costa Rican Institute of Aqueducts and Sewers. The applicant states that for one year they have received an excessive charge for the provision of drinking-water service supplied under NIS 5245706. On that basis, the applicant considers their fundamental rights to have been violated.

2. Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily reject, either outright or on the merits, at any time, including upon filing, any matter submitted for its consideration that proves manifestly inadmissible, when it considers that there is sufficient evidence to reject it, or when it concerns the simple reiteration or reproduction of an earlier identical or similar matter that was rejected.

Justice Castillo Víquez drafts the ruling; and, Reasons:

I. SUBJECT OF THE AMPARO

The applicant states that for one year they have received an excessive charge for the provision of drinking-water service supplied under NIS 5245706. On that basis, the applicant considers their fundamental rights to have been violated.

II. INADMISSIBILITY OF THE AMPARO

Having reviewed the applicant’s arguments, the applicant is advised that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as an instrument for reviewing the legality of acts of the Public Administration, nor as a general instrument for channeling other types of requests. For this reason, the applicant should bear in mind that this Chamber has ruled that the amount of a bill for drinking-water service is not disputed before this Chamber. This is a matter of legality that must be raised before the administrative authority itself and, eventually, in the ordinary courts. Among other rulings, judgment no. 2018017559, issued at 10:10 hours on 23 October 2018, stated as follows:

“…The applicant complains about the high charges she has received on her water-service bills. She states that she is a single woman with limited resources and has observed that the amount payable shown on the water bill varies excessively, since the supply serves few people and the amount charged is unjustified. She explains that the staff of the respondent administration have already come to inspect, but have not provided solutions. However, this Chamber is not a reviewer of the legality of the actions or decisions of the Administration. It is not within this Court’s jurisdiction to review, in accordance with the applicable law, whether or not there is a leak on the property, to determine the origin of the charge, or to establish the correct amount payable for the service received, since that is a matter for the ordinary administrative and judicial proceedings. Accordingly, if the applicant considers it appropriate, she may raise her objection or complaint with the respondent authority itself or in the competent judicial forum, where she may fully discuss the merits of the matter and assert her claims.

Therefore, this amparo is inadmissible, and it is so declared…”. (emphasis added) These considerations apply to the case under review, since this Court finds no reason to depart from the position set out in those rulings, nor any grounds to assess the situation presented differently.

Accordingly, it is not for this jurisdiction to intervene on behalf of the amparo applicant before the respondent authorities in order to determine, under the statutory regulations governing the matter, whether the bill at issue was properly charged. This situation concerns a dispute over legality alone, the resolution of which falls outside this Court’s jurisdiction. Therefore, if the applicant so wishes, they may raise their objections through the administrative process itself or before the competent judicial forum, where they may fully discuss the merits of the matter and assert their claims.

Consequently, the amparo is inadmissible.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Chamber must advise the parties that if they have submitted any paper documents, as well as objects or evidence stored on any additional device or on electronic, computer, magnetic, optical, telematic, or new-technology media, they must be collected from the court office within 30 business days after receiving notice of this judgment. Otherwise, all such materials will be destroyed in accordance with the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo is summarily rejected.

Considerando:

I. OBJETO DEL RECURSO
